Abstract:
Estoppel is a well-known defence against (or limitation on) the rei vindicatio. This would be the case for example where the owner by some representation creates the impression that a third party is the owner of a thing and that the third party has the capacity to alienate the property. The bona fide third party can, when the owner then institutes the rei vindication to recover his property, raise estoppel and preclude the real owner from claiming his property. Before 2002, if one wanted to evict an unlawful occupier from certain residential premises, one would institute the rei vindicatio. In Ndlovu v Ngcobo; Bekker v Jika [2002] 4 All SA 384 (SCA) the court, however, ruled that the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 (PIE) must be used in all instances of evicting people from urban residential premises. The question is: does estoppel serve as a defence/limit in the application of PIE? Surprisingly few cases deal with this issue. The court in Joe Slovo made a few remarks about the possibility of using estoppel as a defence against the rei vindicatio by looking at the interpretation of ‘tacit consent’ required by PIE. This article will interpret provisions of PIE and look at case law that deals with the use of estoppel in lease cases. It will conclude by remarking on the feasibility of using estoppel as a defence in PIE eviction cases.

The scientific article is devoted to the solution of the scientific-applied problem of delimitation of the obtaining, keeping of pro -perty without sufficient legal basis with the vindicatio.The criteria for the ratio of a reclaim owner’s property from someone else’s illegal possession and a condictio claim are consi -dered. Both common and distinctive features of these legal institutions are analyzed. Vindicatio and condictio lawsuits are effectiveways to protect property rights, not measures of liability.Obligations arising from the obtaining, keeping of property without sufficient legal basis, as well as reclaim owners property fromsomeone else’s illegal possession, by their legal nature belong to the number of renewable, protective and non-contractual legal relations.The similarity can be seen in the so-called criteria as «right to follow». It is concluded that the range of persons entitled to file acondictio claim is wider than the subjects entitled to vindicatio.The main difference between condictio and vindicatio is that a claim for the return of property from someone else owns withoutsufficient legal basis is a legal remedy, and a claim for recovery of property from someone else’s illegal possession is a legal claim. Itis established that in contrast to vindicatio, the fact that the illegal purchaser actually owns the thing, in the case of condictio is not decisive.It is justified that in comparison with the vindicatio the condictio obligation has a wider range of action and is applied regardlessof the good faith of the purchaser and regardless of how the property was taken out of the possession of the creditor.Based on the generalization of theoretical research, analysis of current legislation of Ukraine, it is established that the obligationof condictio is a universal independent way to protect subjective civil law and an effective means of influencing the illegal acquirer.Condictio is applied in the alternative to vindicatio, when a certain requirement of the titular owner of the property is not covered bythe regulations of the main method of protection. The author concludes that it is impossible to compete in vindicatio and condictioclaims.

Tomasza według którego vindicatio miał ważną rolę w wymierzenia kary, tak by mogła ona służyć nawróceniu grzesznika i przywróceniu sprawiedliwości. W artykule opisano jego dodatkowy aspekt tej cnoty, który może być zdefiniowany jako personalistyczny - jest bardzo dobrze zobrazowany w biblijnej historii Józefa z Egiptu. Składa się z pewnych aktów, przyczyniając się ostatecznie do budowania pełnego pojednania międzyludzkiej. Położenie większego nacisku na ten aspekt może doprowadzić do lepszego zrozumienia procesu pojednania i jej praktycznych wymagań.

Property right as the most extensive legally recognized ownership on things has also wide-ranging legal protection. The author deals with the issue of the protection of the property rights in accordance with the Republika Srpska Law of Proprietary Rights. This Law distinguishes property claim for return on things (rei vindicatio), hypothetical property claim, (actio Publiciana) and claim for intrusion or disturbance (actio negatoria). The aforementioned claims also existed in the Roman legislation. Principles regarding protection of the property rights, mostly apply to the protection of rights of co-owners and joint proprietors.

Abstract: Book VIII of the Draft Common Frame of Reference (DCFR), formally dedicated to the 'Acquisition and Loss of Ownership of Goods', also sets out model rules for protection of ownership of goods, providing owners of movables with the right to prevent others from taking them away (rei vindicatio) or from exercising any interference with their proprietary interests (actio negatoria). While consistent with the continental roots of property law, this model of defence is, to a certain extent, unknown in the evolved tradition of personal property in common law. This article analyses the potential impact of the rules proposed by the drafters in the light of the overriding interests found at the core of the principles of European private law, aiming in particular to evaluate the impact that their underlying rationales may have on the development of a harmonized system of European property. Résumé: Le livre VIII du Projet de Cadre commun de référence (DCFR), officiellement consacré à l«Acquisition et perte de la propriété des biens», énonce également des modèles de règles ayant pour objet la protection de la propriété des biens meubles, qui confèrent aux propriétaires le droit d'empêcher les tiers de s'en approprier (rei vindicatio) ou d'interférer avec leurs prérogatives (actio negatoria). Quoique compatible avec les racines continentales du droit de la propriété, ce modèle de protection est, dans une certaine mesure, inconnu dans la tradition de la personal property propre à la common law. Abstract:
The purpose of this article is to present the regulations on supplementary claims applicable under the Polish and German law. The concept of supplementary claims under the Polish law refers to claims regulated in Articles 224 to 225 of the Polish Civil Code. Under German law, the core of the regulations governing the types and scope of these claims is contained in the text of §§ 987 to 993 of the BGB. On the grounds of both the analysed legal orders, one can notice numerous similarities regarding the way these claims are shaped. The most fundamental is the desire to provide increased protection for the good faith possessor and to tighten the liability of the person in possession of the thing, who is already aware of a vindicatory action against them or is in bad faith. Notwithstanding the foregoing, the analysis of the solutions for supplementary claims also allows us to see significant differences, expressed primarily in the much more comprehensive regulation of the issue in question in the German law. The article offers a comparative legal analysis of the solutions functioning on the grounds of both these legal orders and conclusions.

Dopo una presentazione della legittimazione passiva segue l’esegesi di D. 6.1.9. Si discute del contrasto trai quidam e ulpiano, della sussidiarietà tra le azioni contrattuali e la rei vindicatio. Infine si tratta della facultas restituendi menzionata dal giurista severiano in chiusura del passo.
The work deals with the judicial protection of ownership in Roman law. The focus is on the basic elements of the rei vindicatio per formulam petitoriam. After a presentation of the passive legitimation, it follows the exegesis of D. 6.1.9. It is discussed the contrast between the quidam and Ulpiano, of the subsidiarity between the contractual actions and the rei vindication. It finally deals with the facultas restituendi mentioned by the severian jurist in the closing of the step

'This doctoral thesis is an examination, and vindication, of a position that has been identified with the expression 'aesthetic empiricism' and typically captured by the claim that 'what is aesthetically valuable in a painting can be detected merely by looking at it - features that cannot be so detected are not properly aesthetic ones' (Currie, 1989). Such a position continues to be a focus for contemporary discussion (e.g., Davies, 2004, 2006, and Graham, 2006), yet it is far from clear precisely what it entails or even who subscribes to it. All that seems to have been agreed is that aesthetic empiricism is false, demonstrably so in the light of Walton's claims in 'Categories of Art' (1970), and Danto's work on indiscernibles (1981). The lack of theoretical clarity would suffice to motivate a closer look at aesthetic empiricism; however, the more specific target of this thesis is· to show that the received treatment is mistaken - aesthetic empiricism, once clearly identified, can be seen to be both intuitive and beguiling. It earns our philosophical consideration by providing a formidable accoiint ofthe aesthetic and also a valuable contribution to our understanding of art criticism.

Some philosophers dispute the claim that there is a notion of logical necessity involved in the concept of logical consequence. They are sceptical about logical necessity. They argue that a proper characterisation of logical consequence - of what follows from what - need not and should not appeal to the notion of necessity at all. Quine is the most prominent philosopher holding such a view. In this doctoral dissertation, I argue that scepticism about logical necessity is not successful. Quine's scepticism takes three forms. Firstly, he is often interpreted as undermining, in his classic paper 'Two Dogmas of Empiricism', the very intelligibility of notions such as meaning, necessity, and analyticity. If the notion of necessity is meaningless, it is clear that ascriptions of logical necessity are also meaningless. In the thesis, I defend Quine's criticism of these notions by situating it in its historical context and emphasising that the real target in those writings is not the intelligibility of these notions as such, but only their Platonistic interpretation. I agree with Quine that a good theory about meaning, necessity, or analyticity must avoid such an ontological commitment. Secondly, Quine advocates, in the same paper, a holistic picture of knowledge and claims that in this picture, ascriptions of logical necessity are superfluous. I then show that holism a la Quine is committed to admit the necessity of statements of logical consequence. Thirdly, there is Quine's substitutional account of logical consequence (as exposed in his (1970)). He contends that this theory makes no use of logical necessity, thus showing its superfluousness. I show that any plausible account of logical consequence needs to appeal to logical necessity, thus undercutting Quine's claim - and, more generally, undercutting scepticism about logical necessity.

Victimisation at work is a problem able to cause mental illness and the victims often search for vindication, where different regulations can be actualized. The purpose of this essay is to examine the legal framework to show the possibilities to vindication and financial compensation, for an individual exposed for victimisation. Also female-dominated professions possibilities to vindication and financial compensation are examined, especially how it will be affected by the regulation Organizational and social work environment (AFS 2015:4). The method that has been used to fulfil the purposes of the essay is the method of jurisprudence. To fulfil the second purpose the sociology of law was also applied. The result of the essay showed that the regulations hold different possibilities to vindication and financial compensation. However the individual often meet with obstacles. The result also showed that the possibilities to vindicaition and financial compensation for female-dominated professions are effected by the new regulation Organizational and social work environment. The final conclusion is thus, that the legal framework does not provide any distinct way for vindication or financial compensation for victimisation.

Abstract:
There exists a scholarly debate on the cultural impact of globalization and how and to what extent it is affecting indigenous people in particular. Three theoretical standpoints can be discerned from the debate; the homogenization-perspective which holds that globalization is making world cultures more similar, the hybridization-perspective which emphasizes that it is fragmenting cultural boundaries and the differentiation-perspective which implies that globalization is augmenting differences and making humanity as a whole more diverse. As regards the cultural impact of globalization on indigenous peoples, many question marks can be raised. The objective of this research is to contribute to the debate by bringing to light the perspective of the indigenous movement in Ecuador, CONAIE. An analysis is made on how they perceive globalization affecting the maintenance of indigenous identities and culture among today’s youth. That information is then used as a foundation to analyze CONAIE’s level of success regarding their main objective; to preserve Ecuador’s indigenous nationalities and peoples. The study, which has a qualitative ethnographic approach and is based on semi-structured interviews, was carried out during an eight weeks long field study in Quito and in San Pedro de Escaleras, Cuenca, Ecuador. The research has an abductive approach and the theoretical debate on globalization’s cultural impact on indigenous peoples sets the analytical frame of the study. The three theoretical standpoints; globalization as homogenization, globalization as differentiation and globalization as hybridization play central roles in the analysis of the empirical material. The findings show that there are many elements that obstruct the maintenance of indigenous culture and identity among youth in contemporary Ecuador. There is a connection between youth being exposed to cultural globalization and that they lose cultural characteristics for the indigenous identity. Hybridization of identities due to globalization is presented as a possible factor to play a role in this. Indigenous youth tend to drop characteristics for the indigenous identity as they adopt features from the mestizo culture, in case they see no benefit in maintaining the former. This indicates that what ultimately might be at stake is cultural homogenization. Light is also shed on that CONAIE lacks strategies and possibilities to reinforce the indigenous identity among the youth that is in a process of identity change. The findings thus point at that despite efforts for cultural revival by the indigenous movement in Ecuador, the maintenance of rigid frontiers between the ethnically diverse nationalities in the country is threatened. Seen to a larger picture, this implies that globalization’s impact on indigenous culture among youth is very difficult to counteract. It appears as if the move towards more cultural similarity in Ecuador cannot be hindered.

Abstract:
Gaius Julius Caesar remains one of the most studied characters of antiquity. His personality, political career, and military campaigns have garnered numerous scholarly treatments, as have his alleged aspirations to monarchy and divinity. However, comparatively little detailed work has been done to examine his own personal religiosity and even less attention has been paid to his religion in the context of his military conquests. I argue that Caesar has wrongly been deemed irreligious or skeptical and that his conduct while on campaign demonstrates that he was a religious man. Within the Roman system of religion, ritual participation was more important than faith or belief. Caesar pragmatically manipulated the Romans' flexible religious framework to secure military advantage almost entirely within the accepted bounds of religious conduct. If strict observance of ritual was the measure of Roman religiosity, then Caesar exceeded the religious expectations of his rank and office. The evidence reveals that he was an exemplar of Roman religio throughout both the Gallic Wars (58-51BC) and the subsequent Civil Wars (49-45BC).

Abstract:
Uncertainties are inherent to the physical world, which has made them a prominent field of research. They manifest themselves in many fields of engineering, one of which is known as tolerance analysis, where engineers attempt to predict system performance affected by the tolerance through analytical models. Ordinarily, discrepancies between analytical and experimental models are overcome by calibration techniques, using experimental data. Acquiring experimental data becomes a monetary expensive endeavor, when performed on assemblies with relative large design parameters. This work presents a methodology to formulate and calibrate analytical models, using Bayesian inference and Gaussian processes. The advantage of this methodology is that it uses a single set of overall performance experimental data, with a more accurate result than conventional methods. Subsidiary to the proposed methodology is a case study, vindicating as well as illustrating its transcendence from the confining extremities delineated by the panoply of current tolerance analysis and calibration techniques.

Este artículo sintetiza la tesina que bajo el mismo título pretende poner de relieve la particularidad de la ciudad anónima latinoamericana mediante la caracterización de sus componentes desde un enfoque positivo que permita formular estrategias para ponerla en valor dentro de su misma lógica. Studies about Latin American cities are usually carried out from standpoint of their issues, but not from their possibilities. This paper summarizes a broader research that aims to highlight the singularity of the anonymous city concept in Latin America by means of the characterization of its components. Such characterization is performed from a positive perspective that allows formulating strategies to vindicate the anonymous city within its own logic.

Abstract: In 1921, issue 11-12 of L’Esprit Nouveau featured an article entitled “Toepffer, précurseur du cinema” where Le Corbusier, signing as ‘De Fayet’, vindicated the figure of Rodolphe Töpffer (1799-1846), a Swiss a pioneer of comics, as a key element in the development of cinema. Marginal as it may seem, this reference unveils a deeper relationship between Jeanneret and Töpffer’s work which started in his childhood, and would have a key role in the development of some of Le Corbusier’s trademark obsessions: travel, drawing, and cinematic narratives. In this context, “La Ligne Claire de Le Corbusier” proposes a close examination of the presence of graphic narrative and its aesthetics in Le Corbusier's early work in relation to its evolution from a sequential promenade architecturale to multispatial enjambment. The paper explores themes such as narrative and the inclusion of time in le Corbusier's Purist paintings, or his evolution from a painterly approach to drawing to an idealized, linear and synthetic rendering style. In a color atlas, the uniformity of color spacing between reflectances is disturbed by changes in the spectral power distribution (SPD) of the illumination. Because the atlas may still be useful under different lights, we introduce a new metric of color order that is less sensitive to change of illumination. Three reflectances with labels 1, 2, 3 map to points in chromaticity space (under a particular light) that, if not collinear, are ordered either clockwise or counterclockwise. The ordering parameter P of the reflectances is –1 for clockwise ordering, +1 for counterclockwise ordering, and 0 for collinear points. The perceptual significance of P can be tested via a dichotomous color-blindness test (such as the Farnsworth D-15 test). It has been shown mathematically1 that the P of three reflectances depends on illumination only if, when the reflectances are treated formally as color-matching functions, the chromaticity space that results has a spectrum locus that is not everywhere convex. Illuminants affect P when one or more reflectances is purple—a vindication of the model because purples are known not to be color-constant. A color atlas is called statistically consistent if its first three principal components form a chromaticity space that is convex and well ordered in wavelength. The Munsell atlas is statistically consistent. Convexity of the spectrum locus also insures that no linear combination of the reflectances (or reflectance principal components) has more than two zero crossings. Implications of these theorems for color technology and robotic vision are noted.

This paper describes high temperature cyclic and creep relaxation testing and modelling of a high nickel-chromium material (XN40F) for application to the life prediction of superplastic forming (SPF) tools. An experimental test programme to characterise the high temperature cyclic elastic-plastic-creep behaviour of the material over a range of temperatures between 20°C and 900°C is described. The objective of the material testing is the development of a high temperature material model for cyclic analyses and life prediction of superplastic forming (SPF) dies for SPF of titanium aerospace components. A two-layer visco-plasticity model which combines both creep and combined isotropic-kinematic plasticity is chosen to represent the material behaviour. The process of material constant identification for this model is presented and the predicted results are compared with the rate-dependent (isothermal) experimental results. The temperature-dependent material model is furthermore applied to simulative thermo-mechanical fatigue (TMF) tests, designed to represent the temperature and stress-strain cycling associated with the most damaging phase of the die cycle. The model is shown to give good correlation with the test data, thus vindicating future application of the material model in thermo-mechanical analyses of SPF dies, for distortion and life prediction.

Abstract:
In polymer processing by extrusion, the thermal behavior of the components downstream of the extruder dye is of great relevance to the final characteristics of the product. In fact, the process productivity, the product dimensional quality and the physical/mechanical properties are strongly dependent upon the cooling process. In the present work, a numerical model adequate to describe the thermal behavior of the calibrator and the polymer profile is developed and implemented as a computer code. The model is fully 3D, transient and includes a formulation for the polymer movement inside the calibrator based upon the VOF method [1]. Although for practical purposes, a steady solution is desired, the model was implemented as a transient case, to enable its accurate validation with experimental data. The interface between the extrudate and the calibrator is described through a coefficient for the thermal contact resistance. The equations were discretized in a finite volume formulation [2] and the code implemented in Fortran. The good agreement between the model and the experimental data has vindicated the accuracy of the computer model and its subsequent application in the analysis and optimization of complete calibration units. A parametric analysis for the most relevant variables, such as polymer velocity and calibrator length, demonstrated the consistency of the numerical model.
