This chapter discusses the rules relating to the use of written evidence in civil proceedings. Under the Civil Procedure Rules 1998 (CPR), evidence given in civil trials is given primarily from the witness box, but with witness statements exchanged well before trial standing as the evidence-in-chief of the witnesses. The parties are required to exchange their witnesses’ statements in order to save time and costs at trial, and to enable the parties to evaluate the merits of their dispute with a view to settlement. Written evidence in support of interim applications can be given by a variety of different methods, but the principal means is by way of signed witness statements.

Full text
Abstract:
This chapter analyses the widely publicized November 1906 trial of Regine Riehl, a Viennese brothel keeper of Jewish origin. Riehl faced charges of embezzlement, fraud, pandering, and other crimes associated with the operation of her establishment. The trial became a point of reference for discussions of the efficacy of regulated prostitution in Cisleithanian Austria. The proceedings generated a great deal of publicity because Riehl’s alleged gross maltreatment of the tolerated prostitutes she employed occurred in a bourgeois neighborhood near the center of the imperial capital. The chapter addresses both the trail itself and the varied ways the local and regional press reported it. In their one-dimensional descriptions and explanations, the prosecution and newspapers presented the prostitutes in this trial as simple, often passive, victims at the hands of Riehl, but closer examination of their behavior reveals that the women acted in a variety of ways.

Abstract:
The Trial, written from 1914 to 1915 and published in 1925, is a multifaceted, notoriously difficult manifestation of European literary modernism. Written in a relatively abstract language, it tells the story of Josef K., who is accused of a crime he has no recollection of having committed (and whose nature is never revealed to him). The novel has often been interpreted theologically, expressing a form of radical nihilism in a modern world abandoned by God. However, it has just as often been read as a parable of the cold, inhumane rationality of modern bureaucratization. Like many other novels of this turbulent period, it offers a tragic quest-narrative in which the hero’s search for truth and clarity (about himself, his alleged guilt, and the anonymous system he is facing) progressively leads to greater and greater confusion, ending with his execution. In this volume, the contributors deal with a range of issues arising in this work. Theology is central, and related to that are questions of justice, law, ethics, resistance, and subjectivity. All the contributors view the novel as responding to a context of rapid modernization, and questions of metaphysics intersect with the most mundane challenges of everyday life. There is here a fundamental uncertainty, a context of skepticism, that the contributors approach from a variety of angles.

Abstract:
The trial might well have taken place were it not for a variety of unforeseen circumstances. For example, the Dutch might have agreed to the Kaiser’s surrender and the Kaiser might even have agreed to the trial. Other options would have been a trial in absentia or a trial in the Netherlands itself. Had a trial been held, the enigmatic charge of an ‘offence against international morality and the sanctity of treaties’ would have required interpretation. Many considered that it would have covered not only violations of the laws of war within the conflict, but also the launching of the aggressive war. This would have necessitated proof that Germany was actually responsible for starting the war, and a possible inquiry into the conduct of the European Powers over several years prior to 1914, something for which the British and the French had little enthusiasm.

Sessler, Curtis N., and Katie M. Muzevich. Sedatives and anti-anxiety agents in critical illness. Oxford University Press, 2016. http://dx.doi.org/10.1093/med/9780199600830.003.0042.

Full text
Abstract:
Sedative and anti-anxiety agents are administered to many mechanically-ventilated intensive care unit (ICU) patients. While commonly considered supportive care, suboptimal administration of sedatives has been linked to longer duration of mechanical ventilation and longer ICU length of stay. The use of a structured multidisciplinary approach can help improve outcomes. The level of consciousness, as well as the presence and severity of agitation should be routinely evaluated using a validated sedation–agitation scale. The approach to delivery of sedation should be based upon specific goals, particularly mechanical ventilation, while maintaining the lightest possible level of sedation. Selection should be based upon clinical circumstances and patient characteristics, however, when continuous infusion sedation is required, experts suggest using non-benzodiazepine agents. A variety of strategies for sedation management have been demonstrated to be effective in clinical trials including use of protocols, targeting light sedation, preference of analgesics for initial therapy, use of intermittent, rather than continuous drug delivery when possible, and daily interruption of sedation. Finally, light sedation should be linked to performance of spontaneous breathing trials, as well as early mobilization.

Abstract:
The Kaiser did not seem overly concerned about trial and there is no evidence he made any preparations for his defence. With Dutch Government approval, he bought a permanent residence in Doorn, near Utrecht, and proceeded to renovate the place.r The Pope took the initiative to campaign against trial of the Kaiser, and European royalty joined in a variety of initiatives to protect their ‘cousin’. Dutch public opinion appeared to harden in favour of refusing any surrender of the Kaiser. Then, at the end of the year, incriminating documents known as the Kautsky papers were published in Germany showing the Kaiser’s belligerence during the fateful weeks of July 1914.

Full text
Abstract:
Diagnosis and treatment of acute stroke has advanced considerably in the past 2 decades. Most notably, in cases of ischemic stroke, intravenous alteplase has become the standard of medical treatment despite its multiple contraindications and limited time window. More recently, trials have proven that endovascular thrombectomy is superior to medical therapy alone, advancing the standard of care for patients who present with acute ischemic stroke from a large vessel occlusion and salvageable brain tissue. The treatment of hemorrhagic stroke now involves the use of novel pharmacological agents and advanced minimally invasive technology. Important changes have also occurred at the levels of hospital organization and treatment decision-making. Such changes in organization and designation of hospitals with distinct levels of stroke care and the variety of stroke protocols now requires team work of emergency medical services (EMS), Emergency Department, stroke neurologists, neurosurgeons, and neurointerventionalists. This book provides an overview of the modern medical and surgical options for the treatment of patients with acute ischemic and hemorrhagic strokes. The pivotal role of EMS in prehospital evaluation and triage of a stroke patient and the levels of stroke systems of care are discussed. In addition, the current guidelines on the management of acute stroke, with the focus on early care of acute stroke patients at the Emergency Department and the first 24 hours of hospital admission, are reviewed. Each chapter contains a discussion of common clinical scenarios including initial management steps, practical points, and common pitfalls.

Hilliard, Christopher. The Littlehampton Libels. Oxford University Press, 2017. http://dx.doi.org/10.1093/oso/9780198799658.001.0001.

Full text
Abstract:
This book reconsiders the workings of literacy and law in everyday life in early twentieth-century Britain. It does so through an analysis of an extraordinary criminal case from the 1920s—a poison-pen mystery that led to a miscarriage of justice and four criminal trials. The case, which unfolded in the coastal Sussex town of Littlehampton, proved as difficult to the police and the lawyers involved as any capital crime. Yet the offence in question was not murder, but libel, a crime involving words. So when a leading Metropolitan Police detective was tasked with solving the case, he questioned the residents of Littlehampton about their neighbours’ vocabularies, how often they wrote letters, what their handwriting was like, whether they swore. He assembled an ethnographic archive of working-class literacy. This book uses the materials generated by the investigation and the legal proceedings to examine, first, the variety of language used in working-class communities, and, second, the ways working-class people engaged with the legal system and vice versa. The four trials illustrate questions of access to justice; the relationship between respectability and credibility as a witness; and the largely forgotten history of criminal libel in modern times.

Outline of the key landmarks in the history of Type 1 diabetes. Epidemiology, focusing on its rising incidence and the increasing prevalence of later-onset autoimmune diabetes. Genetics are briefly covered; the evidence for and against the impact of a variety of environmental factors thought to be important in aetiology are emphasized, especially in relation to prospective randomized clinical trials (RCT) in early Type 1 diabetes, aiming to delay the onset of autoimmunity in high-risk individuals or slow the decline in C-peptide levels shortly after clinical diagnosis. The balance-risk hypothesis, which allows for inclusion of protective and promoting factors, is introduced.

Abstract:
The first 15 chapters of this book have described, and hopefully simplified, the major legal issues that are inherent in the practice of the mental health professions. However, there are a number of important issues that do not fit neatly into the preceding chapters and do not require a full chapter themselves, but are important to the clinician because they are so common and can cause considerable consternation. These issues, covered in this chapter, include record keeping, requests for release of information in a variety of contexts, patients’ requests for evaluation of fitness to return to work or carry firearms, and testimony at depositions and trials.

Abstract:
Contemporary drug policy constitutes three broad areas: programmes to prevent drug use, services that help heavy drug users change their behaviour, and supply control programmes, including incarceration. In recent years addiction science has matured as an aid to policy formation. The scientific evidence for policy options is derived from a variety of research methods and measurement techniques, ranging from randomized clinical trials of prevention programmes to ‘natural experiments’ that evaluate the impact of new policies on substance use. Drawing on an extensive literature of both original research and integrative literature reviews, the remainder of this book critically evaluates the scientific evidence relevant to each of these areas.

Abstract:
The phenomenology of PTSD has been established in the previous chapters to be an already broad domain that encompasses a myriad of interactions between brain systems. As our understanding of the disorder expands and yields new questions, so do the available options for treatment. The current chapter reviews the cognitive and behavioral interventions for PTSD and other anxiety disorders that have demonstrated efficacy in clinical trials, as well as a variety of emerging pharmacological interventions and the preclinical literature that has informed their development. The identification of biomarkers for PTSD is discussed in terms of their potential application as both potential predictors of the development of PTSD and of the outcome of interventions designed to treat it.
