Sahay, Sundeep, T. Sundararaman, and Jørn Braa. The ‘Information-Use Problematic’ in Health Information Systems. Oxford University Press, 2017. http://dx.doi.org/10.1093/med/9780198758778.003.0003.

Abstract:
It is well understood that use of information is essential not only for justifying the investments made in building information systems, but they are also essential for improving the quality and equity of healthcare delivery. The paradox is that there is a data overload that impedes relevant information use, and to solve this more IT systems are deployed, thus creating more data, which further confounds the information use problem. One reason for this is that health information systems in LMICs are typically not conceived as built for users at different levels with varying needs, but primarily to satisfy the monitoring and control needs of central apex authorities and funding agencies. While in recent years, tremendous improvements have been made in LMICs, there still tends to exist a weak understanding and use of indicators, poor data quality that is all too readily and mistakenly attributed to non-truthful reporting when there are many other remediable factors at work. The Expanded PHI approach seeks to address these issues. It posits that meanings can be best made only through ‘conversations over data’, and user friendly systems requires ‘communities of practice’ to build and sustain.

Abstract:
Titles in the Complete series combine extracts from a wide range of primary materials with clear explanatory text to provide readers with a complete introductory resource. This book deals with the emergence of equity and how it differs from the common law. The trust concept is explained and the different types of trust that exist outlined. These include resulting, constructive, and charitable trusts. Trusts must obey certain basic rules such as legal formalities and the three certainties of intention, subject matter, and the need for a beneficiary. There are exceptions to these strict rules, such as proprietary estoppel and certain gifts made upon death, for example secret trusts and donatio mortis causa. The office of trustee is considered, including the methods of appointment; their powers of maintenance, advancement, variation, and investment; and the fiduciary nature of their office. Equitable remedies, such as injunctions, specific performance, and tracing are included. The use of constructive trusts in cohabitation disputes is analysed.

Abstract:
This chapter considers the climate change regime in the context of intra- and inter-generational equity. The principle of inter-generational equity defines the rights and obligations of present and future generations with respect to the use and enjoyment of natural and cultural resources, inherited by the present generation and to be passed on to future generations in no worse condition than received. In this context, climate change regime accommodates the interests of future generations in a balancing of interests, thereby falling into the field of the two principles. The chapter describes how Article 3 of the United Nations Framework Convention on Climate Change (UNFCCC) may be viewed as supporting the legitimate expectation of future generations of equitable access to planetary resources, and the concomitant obligation of the present generation as trustee of these resources to ensure that future options are not unduly constrained.

Abstract:
Policies affecting the type, amount, and organization of health and social services play an important role in the overall effectiveness of a service system. Countries differ markedly in their service systems, which vary in terms of the availability, accessibility, coordination, cost-effectiveness, and coerciveness of treatment and harm-reduction services. There are now a large number of evidence-informed health and social services that are ready for implementation in systems of care in both low and high-income countries. These interventions, along with innovations in the organization of service systems, can directly address access, equity, and coordination. Coordination between the criminal justice system, mental health services, primary health care, and the treatment system can reduce drug use, improve health, prevent crime, and decrease recidivism. Health and social services organized within an integrated system, can have an impact on the population in a variety of areas targeted by drug policy.

Abstract:
This chapter argues for a greater commitment to water equity and a transformation of water governance. Marrying contradictory principles flawed the global water governance paradigm that emerged in the 1990s. Efficiency and equity are often incompatible, and unequal power relations are embedded in many longstanding water institutions and concepts. The chapter suggests that the epistemology of water and the vocabulary and fundamental concepts used to understand water, including its socio-nature and close relation with politics, must be transformed. It introduces five “directional principles” to guide thinking about a transformational governance. It also reviews these principles in light of four real-world cases. Decades of water scholarship provide a critical lens to search for equity, but recognizing equity when it occurs in specific contexts, such as the Colorado River Delta or the city of Detroit, where new networks have emerged to challenge existing rules and power relations, is also vital.

Abstract:
This chapter focuses on the social determinants of health. The phrase—the social determinants of health—is used to describe the factors and forces in society that cause ill health and premature death. To achieve health equity, it is important to understand the impact of social determinants and work to mitigate their adverse health effects. The practice of social medicine uses a biosocial approach that merges biomedical science with social analysis to design programs that strive for health equity. Because of the historical and geopolitical forces that have shaped global inequities, social medicine and a biosocial approach are important in global health and health equity and are addressed in this chapter.

Abstract:
Without assuming prior legal knowledge, books in the Directions series introduce and guide readers through key points of law and legal debate. Questions, diagrams and exercises help readers to engage fully with each subject and check their understanding as they progress. This book explains the key topics covered on equity and trusts courses. The content of the text is designed to emphasise the relationship between equity, trusts, property, contract and restitution to enable students to map out conceptual connections between related legal ideas. There is also a focus on modern cases in the commercial sphere to reflect the constantly changing and socially significant role of trusts and equity. The book starts by introducing equity and trusts. It then includes a chapter on understanding trusts, and moves on to consider capacity and formality requirements, certainty requirements and the constitution of trusts. Various types of trusts are then examined such as purpose, charitable, and variation trusts. The book then describes issues related to trusteeship. Breach of trust is explained, as is informal trusts of land. There is a chapter on tracing, and then the book concludes by looking at equitable liability of strangers to trust and equitable doctrines and remedies. This new edition includes coverage of significant recent cases, including the Supreme Court decision on interest to be paid by tax authorities on monies owed; the Supreme Court decision on the test of dishonesty applicable to civil matters; the Privy Council decision on the division of investment property acquired by cohabitants; the Court of Appeal decisions on Quistclose trusts; fiduciary duties in arms-length contracts; transactions prejudicing creditors; beneficiary anonymity in variation of trust cases; exemption clauses; discretion exercised beyond trustee’s authority; implications of GDPR for trustee disclosures; trustee personal liability; causation and equitable compensation; statutory relief for a professional trustee’s breach of trust; use of proprietary estoppel to reward work undertaken in farming families; costs of seeking court’s directions; injunctions ordered against persons unknown; equitable jurisdiction to rectify agreements.

Full text
Abstract:
This chapter discusses three directional hedge fund strategies: long/short equity, short only, and equity market neutral. These strategies rely on different types of positions that are enumerated and explained using trade examples. A key feature of funds implementing directional strategies is the market exposure best described by gross exposure and beta-adjusted net exposure. In long/short equity funds, money managers often use yield enhancement strategies based on option overlays. A review of different management styles explicates the heterogeneity of hedge funds and liquid alternatives that implement the long/short equity strategy. Analysis of portfolio diversification highlights why equity market-neutral funds have more holdings than long/short equity funds. For equity market-neutral funds, the chapter highlights a link between the fund’s correlation with the market and its beta: low beta does not imply that it has a low correlation with the market. The chapter provides a theoretical discussion with some real fund examples.
