The United Nations Convention against Corruption (UNCAC) from 2003 marks the peak of a broad international development in the fight against corruption, which started in the early 1990s. In recent years, it has been signed and ratified by an overwhelming majority of states. Although the UNCAC is not just a criminal law convention, but encompasses a multitude of rules on prevention, asset recovery, and international cooperation, it also includes a comprehensive arsenal of criminal law provisions. This chapter explores the origin of the UNCAC as a whole and the background and scope of all its criminal law provisions, both mandatory and discretionary.

This chapter examines disputes involving allegations of corruption, violation of trade sanctions, and other forms of misconduct in the mining industry. It identifies the factors that explain the mining sector’s particular vulnerability to corruption. It then discusses the main national anti-corruption regimes, including the U.S. Foreign Corrupt Practices Act (1977), the Organization of American States’ (OAS) Inter-American Convention against Corruption (1997), the OECD Convention on Combating Bribery of Foreign Officials in International Business Transactions (1999) and United Nations International Convention against Corruption (2005), Canada Corruption of Foreign Public Officials Act (1999, 2013), and UK Bribery Act (2011). The remainder of the chapter covers the impact of allegations of corruption in commercial and investor-State arbitration proceedings; and examines how US trade sanctions and export controls regulations can play a significant role in the context of international mining disputes.

Conventional wisdom dictates that Ukraine’s political crises can be traced to the linguistic differences and divided political loyalties that have long fractured the country.
