The discussion examines the idea that because of its relatively unique nature, commercial law has the distinct ability to evolve and function in the absence of a central coercive authority. While law of a non-commercial nature generally requires the backing of a state through which to derive its efficacy, a great deal of commercial law as it exists today evolves often in the absence of a single coercive authority, shaped largely by market forces outside the purview of any one state power. To this end, we look primarily at transnational commercial law, specifically at what is commonly understood as the new law merchant.
It is the central contention of this paper that commercial law stands apart from other forms of law in that it is uniquely equipped to generate norms in situations where a single legislative power is notably not present, as it is largely impacted by the choices and behaviour of individual economic actors. We examine the notion that the manner of interaction implied by commercial intercourse involves a higher degree of overall engagement. This we term ‘high engagement’, which we divide into two elements: repetition and game creation, which with reciprocity, works in tandem to produce identifiable legal norms and the subsequent compliance with them.
In Part I, after presenting a brief overview of the idea of reciprocity and spontaneous law theory, a more detailed explanation of the notion of engagement is offered. In Part II, we set out exactly how high engagement facilitates the development of and compliance with legal norms. Finally, the conclusion this paper reaches is that this element of high engagement, a salient characteristic of commercial interaction, plays a decisive role in the ability of commercial law to evolve and function in the vacuum of a central legislative authority.

Le Québec répertorie officiellement sur son territoire un seul et unique fleuve, le Saint-Laurent. Cependant, la Commission de toponymie du Québec présente une définition qui devrait englober au moins vingt-huit autres rivières. La présente étude tente de rendre compte de cette situation en retraçant les processus évolutifs de l’utilisation du générique « fleuve », par son origine étymologique et son implantation en Amérique. La méthodologie utilisée privilégie une approche comparative de ses définitions sociales et physiques chez les différentes communautés francophones. Le passé et la mentalité des explorateurs et des premiers colons du continent, ainsi que des premiers toponymistes du Québec, seront analysés afin d’illustrer l’impact et le rôle qu’ils ont eus dans les différents processus toponymiques. L’importance du fleuve Saint-Laurent en lien avec l’identité québécoise sera exposée afin de démontrer les raisons pour lesquelles il est le seul cours d’eau possédant le générique « fleuve » dans la province. Le système toponymique québécois sera ensuite analysé afin de comprendre pourquoi un changement tel que l’ajout de vingt-huit fleuves à la nomenclature québécoise serait difficile à effectuer, mais néanmoins souhaitable et quels seraient les impacts d’un tel changement.

The aim of the diploma thesis is to evaluate consequences of the United Kingdom withdrawal from the European Union to financial sector and provide different view of the issue than studied analysis carried out so far. The thesis proves the size, broad structure and unique position of the British financial sector in Europe and the world. Theoretical part focuses on the historical perspective, to the explanation of how the financial system works, last but not least to the crucial regulatory norms and sector participants. Based on real and specific data, practical part explains the scope of financial sector, its significance and analyses the UK role in the approval process of specific regulatory standards. Lobbying is denoted as an effective way of influencing standards towards national interests. In conclusion, thesis provides an overview of UK losses and benefits after Brexit, including a proposal for modification the practical operation of the financial system and pay attention to problematic areas. It is demonstrated that Britain for its scale of the financial sector has been long-term influencing European regulation of the sector and despite withdrawal from European Union likely remain a global financial centre.

L’obiettivo di questo lavoro di tesi è rappresentato dalla definizione di un metodo di ricerca terminologica e documentazione, nonché di traduzione assistita, supportato dalle moderne tecnologie disponibili in questo campo (Antconc, Bootcat, Trados ecc.), valido per la traduzione di questo tipo di documenti, gli standard, ma sfruttabile anche in altri ambiti della traduzione tecnico-scientifica, permettendo al traduttore e, di conseguenza, al committente, di ottenere un documento “accettabile” e qualitativamente idoneo in lingua di arrivo. Il percorso tracciato in questo elaborato parte dalla presentazione del quadro storico generale, per poi passare alla classificazione degli additivi alimentari in base alla tipologia e agli impieghi in campo alimentare. Verranno illustrati in modo generale i metodi di analisi degli additivi e i criteri di validazione dei metodi impiegati, in funzione degli standard internazionali relativi alla materia, rivolgendo particolare attenzione al quadro normativo e alle agli organi coinvolti nella regolamentazione e nel controllo di queste sostanze, sia in Italia che in Russia e nel resto del mondo. Tutto ciò in funzione degli avvenimenti sul piano geopolitico e su quello culturale: da un lato le sanzioni economiche tra UE e Russia, dall’altro EXPO 2015, opportunità per numerosi traduttori e terminologi di approfondire e arricchire le proprie conoscenze in un ambito tanto importante: alimentazione e sicurezza alimentare, in relazione al progetto di gestione terminologica VOCA9. The first part describes the legislative documents, their properties and the current legislative requirements of EU and EAES. In the second part is an analysis and described comparison of legislative safety requirements of the European Union, the Czech Republic, the Eurasian Economic Union and the Russian Federation. In the third part is described comparison of standards, and were made updates. In the practical part is an analysis of risks pump manufacturer "SIGMA GROUP" according to the requirements EAES and proposed methods for reducing risk prevention. Also in the practical part is analyzed and is created methodical preparation of certification of machinery and pumps placed on the market in the Eurasian Economic Union and the Russian Federation.

The master's thesis "Role of technical standardization in international trade" focuses on the role of technical standardization in international trade, and what benefits standards may have for companies trading with the foreign countries. The aim of the thesis is to map the present role of the technical standardization in international trade with an emphasis on quality management systems standards, environment systems standards and health and safety at work systems standards. The other objective of this thesis is to carry out a comparison of present standardization in the European Union and outside the EU and the results of the theoretical part verify by questionnaire survey of selected companies and its results interpret and draw conclusions. The primary objective of the survey is to determine the role of the standard's use in trade with foreign countries. Contribution of the author consists of presentation a coherent overview of the current process of standardization in the world and the impact of standards on international trade. Structure of the thesis is divided into two main chapters, the first chapter deals with the basic theoretical framework of the topic and the second chapter is devoted to the practical part, i. e. questionnaire survey. Both chapters are further divided into their respective subchapters.

L‘analyse des données révèle un champ linguistique complexe et multilingue (arabe-français-berbère) où l‘auteur du guide est confronté aux problèmes posés par le transfert de dénominations idiosyncrasiques relatives à la réalité algérienne. Dans le cadre d‘une recherche impliquant une dimension nécessairement traductologique, nous effectuons une analyse morphosyntaxique et sémantico-référentielle de ces DM. Au terme de cette analyse qui met en évidence la complexité de ces formes appellatives, tant au plan de la forme qu‘à celui du sens, nous proposons des éléments susceptibles de contribuer à une nouvelle définition du nom ! propreThis thesis aims to analyze uniquely-referring names which refer to singular referents indicating a place, a person, an event, an institution or a product of human activity in a corpus of tourist guide specific to Algeria. It is evident from the analysis that the issue of language contact poses a multilingual (Arabic – Berber – French) complexity in the linguistic field where the author is constantly confronted with idiosyncratic names that identify Algerian reality. The basic legal provisions governing machinery manufacturers are described and analyzed here. The second part deals with the safety of tool grinder, risk analysis and proposal of preventive measures for risk reduction. The tool grinder is analyzed here and the results are summarized in the block diagram is drawn. Moreover, there are identified potential hazards for individual parts and the appropriate safety requirements are construed.

Then a system analysis of the issue is created with a proposal and justification of the chosen procedure. In the second part of the thesis there is solved the failure risk analysis, which is focused on the operations of the operator in the area of maintenance, service and during the operation of the vertical machining center located in the company TAJMAC – ZPS Zlín. The result of this thesis is the design and recommendation of preventive measures to reduce unacceptable risks in the relevant operations at the machining center.

A classical result due to M. Eidelheit and B. Yood states that the standard algebra
norm on the algebra of bounded linear operators on a Banach space is minimal, in
the sense that the norm must be less than a multiple of any other submultiplicative
norm on the same algebra. This de nition does not assume that the arbitrary
algebra norm is complete. In cases when the standard algebra norm is, in addition,
maximal, it is therefore unique up to equivalence. More recently, M. Meyer showed
that the Calkin algebras of a very restricted class of Banach spaces also have unique
algebra norms.
We generalise the Eidelheit-Yood method of proof, to show that the
conventional quotient norm on a larger class of Calkin algebras is minimal. Since
maximality of the norm is a presumed property for the class, the norm is also unique.
We thus extend the result of Meyer. In particular, we establish that the Calkin
algebras of canonical Banach spaces such as James' space and Tsirelson's space have
unique algebra norms, without assuming completeness. We also prove uniqueness
of norm for quotients of the algebras of operators on classical non-separable spaces,
the closed ideals of which were previously studied by M. Daws.
One aspect of the Eidelheit-Yood method is a dependence on the uniform
boundedness principle. As a component of our generalisation, we prove an analogue
of that principle which applies to Calkin algebra elements rather than bounded
linear operators. In order to translate the uniform boundedness principle into this
new setting, we take the perspective that non-compact operators map certain wellseparated
sequences to other well-separated sequences. We analyse the limiting
separation of such sequences, using these values to measure the non-compactness of
operators and de ne the requisite notion of a bounded set of non-compact operators.
In the cases when the underlying Banach space has a Schauder basis, we are able to
restrict attention to seminormalised block basic sequences. As a consequence, our
main uniqueness of norm result for Calkin algebras relies on the existence of bounded
mappings between, and projections onto, the spans of block basic sequences in the
relevant Banach spaces.

This thesis focuses on the analysis of a possible formation of the EU disinformation policy by norm entrepreneurs including Lithuania, Latvia, Estonia, France and Germany. The work is based on the theory of social constructivism and the concept of norms. Through the analytical framework of the norm life cycle, it seeks to find out how the disinformation policy can be integrated into the EU by norm entrepreneurs, and what normative clashes can be found in the process of the birth of the disinformation policy of the EU. A possible formation of the EU disinformation policy is analysed through three stages of the norm life cycle - norm emergence, norm cascade and norm internalisation. In the norm emergence part, the Baltic states with France and Germany are examined in terms of their motivation and efforts to promote a disinformation-related norm. The norm cascade part discusses a normative clash of a regulation norm and the norm of freedom of expression. Lastly, the norm internalisation part analyses the challenges of the incorporation of the norm in the system once the previous stages are accomplished. The diploma thesis on the topic "The fulfillment of European union norms in area population protection" is divided into two parts, a theoretical and a practical part. Theoretical part is divided into three parts. First part is devoted to the description of the Czech system of population protection. It describes the development of population protection in the Czech Republic, introduces basic legislation in the area of population protection and elaborates tasks of population protection (evacuation, warning and notification, concealment, individual protection, emergency population survival and decontamination). The second part of the theoretical part is devoted to the international context of population protection. Describes the Geneva Conventions, Additional Protocols to the Geneva Conventions, and European Union Documents and norms in the area of population protection. The third part explains the term of civil emergency planning. In the practical part, the system of protection of the population (civil protection) in the United Kingdom of Great Britain and Northern Ireland and the system of population protection in the Czech Republic were discussed. As a basis for this part of the work were used the National Security Strategy, the Civil contingency act and basic Czech legislation in this area. Finally, the system of population protection in the United Kingdom of Great Britain and Northern Ireland and the Czech Republic was compared. The aim of the diploma thesis is to clarify the problems of population protection, to describe the system of population protection in the Czech Republic and the European Union and to compare this area in the Czech Republic and the United Kingdom of Great Britain and Northern Ireland. Based on the analysed documents, a research question was answered.

The aim of this thesis was to examine the extent to which the European Union can be considered a normative power in relation to the Russian Federation. The European Union has evolved into one of the most important global actors in the international arena and this development has, consequently, sparked series of debates trying to define the role of its actorness in relation to third parties. On one hand, scholars have emphasized the normative and value-driven features of the European Union as a whole, especially in the area of foreign policy cooperation where there exists enhanced emphasis on the importance of values and norms in comparison to other traditional actors in international relations. On the other hand, structural realists provided alternative interest-driven vision under which the member states are expected to follow common approach of the European Union only in cases that do not conflict with their national interests that are claimed to always prevail. These two alternative perspectives to the research have provided thesis with criteria of expected behaviour that the thesis examined on the specific case of the visa policy of the European Union towards Russia. The diploma thesis deals with non-tax instruments connected with the operation of road motor vehicles. The literary part presents a general definition of environmental taxes, characteristics of charges related to the operation of road motor vehicles and European union legislation of charges imposed on these vehicles. An analysis of the currently applied non-tax instruments connected with the operation of road motor vehicles in all European union countries is preformed, including revenue development of these charges as well as the structure and the age of car fleet. After this, the author presents a comparison of the findings and based on that the author proposes a new toll sticker and toll-charging schemes with respect to ecological aspects and support of eco friendly vehicles in the Czech Republic.

One of the tools for dealing with this issue is diversification of the suppliers a searching for a new sources of energy to sustain the economical development of the EU. One of the goals of the EU' Energy security strategy is to lower its dependence on gas imports from Russia. In the lights of recent events, when the gas supply was disrupted a few times, because of the events on Ukraine, Russian aggression in the eastern part of Ukraine and annexation of the Crimea, EU is looking for a better alternative. The research is trying to find out what is the role of the Nord Stream 2 gas pipeline, which will bypass Ukraine and go straight from Russia to Germany and will have impact on other Central and Eastern European countries. The question is whether the project is viable vis-a-vis energy security framework metrics and whether there are better alternatives such as the Southern Gas Corridor or the possibility to import liquified natural gas LNG from elsewhere. The thesis seeks to examine the underlying motivations behind the conclusion of the Stability and Association Agreement between European Union and Kosovo on the 27th of October 2015. To determine the role of material interests and shared ideas in the process of concluding the SAA the thesis discusses and applies rationalism and constructivism, both grand theories of international relations. To test the theories and their respective hypotheses identifying the role of the relevant concepts, the research employs a single case study method, using a congruence analysis approach. In conclusion, through the rationalist lens within the perspective of the EU, the thesis confirms the existence of material interest in the conclusion of the SAA, representing security, power and economic gains. To complement the analysis via a constructivist lens within the perspective of Kosovo, the thesis solely implies a limited role of identity and norms while it points out that such constructivist concepts rather impeded the reaching of the SAA, veiling the actual role of material interest.

The aim of this thesis is to analyse Italian political parties, which are active in both state and regional governance level. The research is focused on the internal structure of political parties and tries to understand, how this structure is influenced by decentralization. The thesis is based on the theoretical framework of stratarchical organization of the political parties in multilevel political environment. The empirical part is dedicated to the test of the hypothesis claiming that the internal organization of Italian political parties is stratarchical. The research method is the analysis of formal profiles of selected political parties (Il Popolo della Libertá, Partito Democratico, Lega Nord and Unione di Centro). The thesis focuses on current diversification scenarios in the field of gas supply the Visegrad Group (V4) and the Russian Federation relying on the model of asymmetrical interdependence. Russian Federation, the main supplier of natural gas to this region, has lost its status of a reliable partner due to the gas wars with Ukraine in 2006 and 2009, which have negatively affected the supply of natural gas to the EU countries. The research focuses on the current diversification options of V4 countries related to their suppliers and supply routes with respect to their relationship with the Russian Federation; the diversification options for the purchasing markets of the Russian Federation are also analyzed. The author validates the hypothesis that energy relations among the Visegrad countries and the Russian Federation in the field of gas supply are largely controlled by the asymmetric interdependence that is currently exacerbating tensions among the set actors. Current diversification scenarios are presented and evaluated, with the aim of assessing the importance of the projects with regard to actors' energy security. This master thesis The emergence of the Common energy policy of the EU in the context of the EU-Russia energy cooperation aims to answer the question of whether Russia with its aggressive energy policy (gas crisis, gas pipeline projects) stands behind the EU's inability to advance a strong Common energy policy despite all its efforts. By analysing the member states' behaviour in relation to the key development in the energy field, we will be able to assess Russia's influence. The thesis will then demonstrate that it is the divergent national policies of the member states that stand behind the EU's inability to push forward a Common energy policy. The member states, in the pursuit of the maximization of benefits, support the Common energy policy only if it aligns with their national interests. The categorization of the member states based on their dependence on Russian gas and the size of their gas markets in relation to Russian gas exports will provide broadly representative conclusions about the member states behaviour towards the Common energy policy based on these two variables.
