Full texts participation movements into European Union brought also with themselves the first signs of the potential impacts which the European Union will cause to come into existence on the Turkish bureaucracy. The purpose of this study is to ascertain the role the European Union plays as an environmental factor in the formation of organizational culture. In order to realize the purpose of this thesis, a comparative survey was administered between the State Planning Organization (SPO) and the Turkish National Agency which was established as a department in SPO in 2002 and attained its autonomous body within the framework of legal arrangements and which is in a direct interaction with the European Commission in respect of working environment. The study has reached the conclusion that the Turkish National Agency has higher level of cultural characteristics than SPO in the framework of organizational culture. The reached findings support that the Turkish National Agency, although a state/public institution, is under the impact of EU which bring in differentiation. In addition, questionnaire results were compared with Turkish cultural characteristics in Hofstede&rsquo
s national cultural analysis and it was seen that some aspects of Turkish National Agency were also reflected those characteristics. As a result, the Turkish National Agency developed a &rdquo
hybrid&rdquo
structure under the impact of EU and Turkish bureaucracy, and this structure, which is the first sample of its own kind, will be a significant example for similar institutions which will possibly come into being in future.

Full textIn the field of the borders control and migration flows management, the aim of this analyse is determine whether Member States discretion arises as a prerogative of sovereignty for reasons of internal security of the Union, or whether this sovereign prerogative is consolidated through internal security. This analyse also serves to illustrate the importance of the work of the Court of Justice of the European Union to harmonize the EU legislation in this area. Specifically, this study details how the "imprecision" of the EU legal framework permits discretion to national authorities in the interpretation of facts, in accordance with the general provisions of the legal framework. So, discretionary power with which consular and border authorities of the Member States apply this legislation, leaves a reasonable doubt on the proper implementation of the legal framework. In other terms, authorities of the Member States have discretionary power, which allow them to adopt ad hoc solutions to fill the gaps left by European legislation. Consequently, intervention of the Court of Justice is essential in order to ensure a uniform application of the Union's secondary legislation
El presente trabajo tiene por objeto de estudio determinar, en el ámbito del control de fronteras y la gestión de los flujos migratorios, por una parte, si la discrecionalidad de los Estados miembros surge por cuestiones que atañen a la seguridad interior de la Unión o por una prerrogativa soberana, o bien si la discrecionalidad se consolida a través de la seguridad interior. Y, por otra parte, destacar la importancia de la labor del Tribunal de Justicia de la Unión Europea para armonizar la normativa de la Unión en este ámbito. En concreto, este estudio describe con detalle como la “imprecisión” del ordenamiento de la Unión otorga un libre margen de apreciación a la autoridad nacional para interpretar los hechos conforme al precepto general del ordenamiento. De modo que, la discrecionalidad con la que esta legislación es aplicada por las autoridades consulares y fronterizas de los Estados miembros deja dudas razonables acerca de la correcta aplicación del ordenamiento. En otros términos, las autoridades de los Estados miembros disponen de facultades discrecionales que les permiten adoptar soluciones ad hoc para llenar los vacíos dejados por la legislación europea. Por lo tanto, la intervención del Tribunal de Justicia es indispensable para garantizar la aplicación uniforme del Derecho derivado de la Unión

Full textCom este estudo pretende-se identificar o benefício da existência do serviço prestado pela Rede de Navios para Resposta à Poluição da Agência Europeia de Segurança Marítima (EMSA). Para este efeito, é analisado o caso de um derrame de hidrocarbonetos (HC) no Mar Português, provocado por um acidente com um navio e é feita a simulação da intervenção da Agência nas operações de recolha de HC. A análise será feita com base na capacidade de resposta, percentagem de HC recolhido nos primeiros dias de operações e custo estimado da actuação da Agência para este e dois outros acidentes anteriores semelhantes ocorridos na costa atlântica. Através deste estudo, verifica-se que a intervenção da EMSA pode levar à redução dos custos de combate à poluição por HC.
This study aims to identify the benefit of the existence of the service provided by the European Maritime Safety Agency (EMSA) Pollution Response Network. For this purpose, the case of an oil spill in the Portuguese Sea caused by an accident with a ship is analyzed and the Agency's intervention in the oil recovery operations is simulated. The analysis will be based on the responsiveness and the estimated percentage of oil recovered on the first days of operations and cost of the Agency's action for this and two other similar previous accidents off the Atlantic coast. Through this study, it can be concluded that EMSA?s intervention may lead to the reduction of the costs of combating oil pollution.

Full textThe objective of this work is to present the forms acquired for the culture of the dock work after the process of modernization, occurrence in 1993, year of promulgation of the Law nº 8.630, that it prevails on the Brazilian port reform. The studied case is the Port of Santos. The study it raises the hypothesis that with the regulation of the syndical activity and the entailing of the dock work to the union (closed shop), fact occurred in years 1930, this culture starts to base in the figure of the labor union. The process of economic regulation and reform of the Brazilian state, initiate in the Government Fernando Collor de Mello, finishes with closed shop and ties the port work with a managing agency of man power. The law appears as landmark, therefore determines the end of the closed-shop system. For analysis of the formation of this culture it is used experience notion and the concept of class conscience of E.P. Thompson and the concept of habitus of Pierre Bourdieu.

Full textFacing the current salience of internal security issues and criticism regarding the European construction, this dissertation focuses on Europol’s institutional trajectory from the 1990s to 2018. It analyses how it has evolved from an intergovernmental organisation, officially starting its activities in 1999, to an EU agency benefiting from growing resources and prerogatives. Therefore, this research offers an analytical altenative to the dominant principal-agent model in the field of agencies, by exploring the academic works on autonomy, renewed by a cognitive and sociological approach. Using a qualitative methodology, this thesis highlights the diversity of internal and external actors and dynamics contributing to Europol’s creation and autonomisation processes. It reveals the promises offered by the multi-faceted concept of autonomy, used to Europol, inserted in a complex and multi-level environement due to its national and European, technical, bureaucratic and political stakeholders. Such perspective aims thereby to understand not only the degree of Europol’s autonomy, but intends also to identify from whom this autonomy must be considered. Thus, this dissertation tends more broadly to develop new research perspectives on EU agencies operating in a core-state power

s citizens. Within this context, the literature has focused on the importance of a European civil society. The desire to establish a deeper European political integration by constructing a European public space has made the European civil society a popular concept. On the other hand, the community institutions have also started to introduce policies to increase the role of civil society in order to close the gap between the Union and its citizens. In this respect, it can be argued that this process has been intensified after the publication of White Paper on European Governance. In the White Paper, the Commission has underlined the significance of a European civil society to strengthen the ties between the citizens and the EU. Then, a further step was taken by the Convention on the Future of the European Union. With the Convention, for the first time citizens and their representatives participated in the decision-making concerning the future shape of the Union. This is an important departure from the past and an essential step in the direction of a public debate on the prospective characteristics of European governance and democracy. This debate has raised interesting questions about the relationship between democracy, subsidiarity, efficiency and governance. Within this context, the purpose of this thesis is to analyze whether the development of an organized European civil society, which gains prominence by forms of governance developed by the EU, is perceived as a part of the solution to get the Union closer to its citizens. In this respect, the question of to what extent the European civil society is perceived as an arena, where EU citizens can exercise their rights beyond the nation-state will be discussed. In addition, different attitudes of the community institutions concerning European civil society will be also examined.

The Brazilian banking correspondent network has been a topic of study for already a decade, due to its well-documented success in improving access to financial services in remote areas. The marginal but growing role of credit unions in the usage of correspondents has not received much attention from academics, despite the appraised importance of credit unions in finance of proximity. This thesis takes a multi-method approach to perform an exploratory research of credit union correspondents in Brazil. The research objective is two-fold, aiming, from one side, at understanding the incentives of credit unions for contracting correspondents and, from the other, at evaluating whether credit union correspondents improve financial inclusion. The research consists of a case study and quantitative analysis of correspondent registration data and credit union financials. The results indicate that generally the largest and most profitable credit unions use banking correspondents in order to improve efficiency and decrease waiting lines, while promoting financial inclusion only in one restricted dimension – bill payment. Nevertheless, in 2014, credit union correspondents had an important role in providing access to payments in 690 municipalities, of which 200 had low financial depth. Despite the scope limitation of credit union correspondents, the results give reasons to believe that these actors could increase their importance in the promotion of financial inclusion in the future.
A rede de correspondentes bancários do Brasil tem sido estudada há mais de uma década, em particular por causa da sua importância no aumento do alcance de serviços financeiros para regiões distantes dos maiores centros urbanos. O uso de correspondentes por cooperativas de crédito não tem recebido destaque, apesar do papel importante das cooperativas na inclusão financeira. Esta dissertação adota uma abordagem 'multimétodo' para efetuar uma pesquisa exploratória dos correspondentes de cooperativas de crédito no Brasil. A pesquisa visa, por um lado, alargar a compreensão dos incentivos que levam cooperativas a usarem correspondentes, e por outro, avaliar se esses correspondentes merlhoram a inclusão financeira. A pesquisa é formada por um estudo de caso assim como por análise de dados relativos ao registro de correspondentes bancários e de dados financeiros das cooperativas. Os resultados apontam que o uso de correspondentes bancários por cooperativas está relacionado à busca de maior eficiência e redução de filas nas agências. A melhoria da inclusão financeira por esses correspondentes limita-se a um serviço único – o recebimento de pagamentos. Não obstante, em 2014, cooperativas de correspondentes de crédito tinham um papel importante no fornecimento de serviços de recebimento de contas em 690 municípios brasileiros, dos quais 200 tinham baixos níveis de inclusão financeira. Apesar da escassa disponibilidade de serviços dos correspondentes das cooperativas, os resultados sugerem que esses atores poderiam adquirir uma importância maior na promoção de inclusão financeira no futuro.
