Full textThe research focuses on the EU right to data protection of non-EU citizens in the fields of migration and borders control. Once outlined the current legal framework of such right in the EU, it is highlighted the nature of fundamental right enshrined by Article 8 of the EU Charter of Fundamental Rights and better defined by the EU Court of justice case law. The application of right to data protection in the mentioned fields is scrutinized from two different perspectives: the use of sectoral large-scale databases (SIS, VIS, EURODAC, EES, ETIAS); the controversial interoperability of such databases, which appears extremely challenging for the actual respect of Article 8 also within the framework of the EU New Pact on Migration and Asylum. Finally, some critical remarks on the balancing between data protection and other general interests of the EU (efficient management of migration and borders control) are offered, through the analysis of certain EU Court of Justice rulings and the case of automatic facial recognition techniques.

Full textThe power to control the activity of workers has always been an ineradicable manifestation of the employer’s legal position. To the extent that it is necessary for the correct performance of the contract, the subjection of the worker to the employer control is an essential element of the relationship referred to in Article 2094 of the Italian Civil Code and plays a crucial role in the definition of subordination. For this reason, an accurate recognition of the legal limits on the entrepreneur’s controls is important to avoid the risk that the employment relationship becomes an occasion for conditioning workers’ freedom in a way that is incompatible with the principles of a democratic society. Based on these considerations, the study analyzes the regulatory framework on the employer’s power to control workers, focusing mostly on the rules laid down by Legge no. 300/1970 (Statuto dei lavoratori) and on the recent Personal Data Protection Regulation. The reflection, which is organized around four chapters, is carried out with an eye on both traditional problems related to this topic and new challenges raised by technological innovation.

The introduction of digital citizenship has obliged to rethink the bunch of rights and the way to apply them. The religious freedom, both individually and in association, has suffered the effects of these changes, but moreover has been a preferred sector where testing new governance rules needed to manage the innovations due to constantly increasing presence of information technologies in day by day life. Therefore, starting from a deep rethinking of the relationships between law and religion, some sectors of analysis, where testing new electronic governance rules, has been identified, in order to understand new evolutions of religious freedom rights in the digital society. These sectors are: presence of religious denominations in the national press; Internet world and issues related both to the trademark management and to religious sentiments; presence of religious denominations in radio-TV system; protection of religious sensitive personal data in agreement with the new privacy Code.

Full textThis work has as its central point the study of the right to protection of personal data and how this right is related to the flow of personal data, driven by dynamic new Internet economy. Reflectively, we will analyze issues relevant to the topic and to the current moment, starting with a social approach, broader and more comprehensive, which unfolded form will culminate in the development of the protection of personal data, both in international law, as in Brazil. Also, it will be object of study the use of data as a raw material for the provision of the services offered by companys.com, in order to create innovation and increase competition between them. As well as, we will demonstrate which options of control and protection of personal data the consumer / user has to protect their privacy. Conclusively, by evaluation of brazilian legislative propositions about personal data protection, we will issue a critical-reflective judgment about the failures and successes of each one front to the topics relevant to the protection of personal data
Essa dissertação tem como ponto central o estudo do direito à proteção de dados pessoais e de que modo este direito se relaciona com a circulação de dados pessoais, impulsionada pela nova e dinâmica economia da Internet. De forma reflexiva, analisaremos questões pertinentes ao tema e ao momento atual, iniciando com uma abordagem social, mais ampla e abrangente, a qual de forma desdobrada culminará na evolução da tutela de dados pessoais, tanto na legislação internacional, como na brasileira. Será ainda, objeto de estudo a utilização dos dados como matéria-prima para prestação dos serviços das empresas.com, de modo a criar inovações e acirrar a concorrência entre estas. Assim como, vamos demonstrar quais as opções de controle e tutela em relação à circulação de dados pessoais o consumidor/usuário possui a resguardar sua privacidade. Full textThis work addresses the issues of competition and inventions in the U.S. employment relationships. The research was carried out in part at the Boston University School of Law of, under the supervision of Micheal C. Harper, professor of Labour Law. The selection of the topic is justified in the light of its importance, given that in the new production organization, based largely on globalized knowledge, employees are now increasingly being asked for professionalism, innovation and creativity. The decision to examine this issue from the perspective of the "U.S. laboratory" is due to the primacy that this nation holds at international level on the economic, scientific and innovation of work processes, which bring out critical issues that in other Countries probably have not yet been raised. In order to frame the above-mentioned topics, it has become appropriate to give an account of the system of regulatory sources in the USA, with particular focus on the Restatement of Employment Law, i.e. the collection of fundamental principles developed over the years by common law in the field of employment relationships. The examination of the sources is followed by the definition of the concept of employee and self-employed worker (independent contractor), necessary for the assessment of the application of the obligations arising from the employment relationships, including the duty of loyalty, involved in the fiduciary law. In this context, the evolution of the case law has been observed, as well as the examination of the criteria relating to the distinction between employees and independent contractors, mainly concerning the judgement on the relevance of the factual elements determining the assessment of the existence of an employment relationship. Subsequently, this study addresses the issue of the typical form of the U.S. employment contract, the so-called employment-at-will. This peculiarity is originated from the principle that the parties are not bound by any obligation to provide reasons for termination. The third part of the work has as its object the discipline of competition of the worker carried out on the basis of the knowledge acquired, legally or illegally, during the relationship and the relative legal remedies for the employer, against the violation of the duty of loyalty, intended as an obligation of the employee to perform the work in the exclusive interest of the entrepreneur and, consequently, to refrain from engaging in prejudicial conduct against the company. About the remedies available in the event of breach of the obligations examined, the legal and equitable remedies that U.S. law offers the employer have been explained. The final part of this study deals with the rules governing the ownership of rights arising from inventions developed by employees in the course of their employment. The definitions of "invention" and "patent" and their relationship in the context of employment law has been examined and the difference between invention as a work of genius and intellectual property protected by copyright has been highlighted. In addition, the mechanisms underlying the basic rules governing the subject matter and their coexistence with the contractual freedom of the parties and their power to dispose of these rights have been observed.

Full textO presente estudo ocupa-se da tutela do direito à reserva da intimidade da vida privada no âmbito do Regulamento nº. 2016/679 do Parlamento Europeu e do Conselho, de 27 de abril de 2016, relativo à proteção das pessoas singulares no que diz respeito ao tratamento de dados pessoais e à livre circulação desses dados. Analisar o designado instrumento legislativo implica confrontar o direito à proteção dos dados enquanto direito de carácter pessoal e o significativo aumento dos fluxos transfronteiriços de dados pessoais, considerando o intercâmbio de dados entre entidades públicas, empresas e pessoas singulares; tudo no contexto da evolução informática, novas tecnologias, internet, globalização, economia capitalista e mercado interno da União Europeia. Neste sentido, a proteção da pessoa e o direito à proteção de dados tem uma direta relação com a proteção da privacidade ou com o direito à reserva sobre a intimidade da vida privada. Busca-se assim nas fontes tradicionais do direito civil o fundamento dogmático para a proteção destes valores ante a nova realidade tecnológica e as novas previsões normativas e as formas de ressarcimento dos danos causados à reserva da intimidade da vida privada. Para uma resposta a estas e a outras perguntas iremos analisar, em primeiro lugar, o enquadramento do Regulamento n.º 2016/679 no contexto histórico-legal de outros instrumentos legislativos da União Europeia e do próprio ordenamento jurídico português, particularmente no que diz respeito ao tratamento e proteção de dados pessoais.Em segundo lugar, caracterizaremos os direitos de personalidade, em geral e em especial, o que implicará considerar, por exemplo, o direito à reserva da intimidade sobre a vida privada, seu conteúdo, abrangência e demais questões relacionadas no contexto da privacidade a ser respeitada pelo responsável pelo tratamento.Por fim, ficará uma abordagem à responsabilidade civil e às respetivas consequências do inadimplemento das normas dispostas no Regulamento n.º 2016/679 da União Europeia, quer no campo do Regulamento ou nas formas indemnizatórias tradicionais do direito civil.
The present study deals with the protection of the right to privacy in the scope of Regulation no. No 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data. Analyzing the so-called legislative instrument involves confronting the right to data protection as a personal right and the significant increase in cross-border flows of personal data, taking into account the exchange of data between public entities, companies and people; all in the context of new technologies, the internet, globalization, the capitalist economy and the internal market of the European Union. In this sense, the protection of people and the right to data protection are directly related to the protection of privacy or the right to privacy. Thus, the traditional sources of civil law seek the dogmatic basis for the protection of these values in the face of the new technological reality and the new normative forecasts and the ways of reimbursing damages caused to the privacy of private life. In order to answer these and other questions, we will first examine the framework of Regulation No 2016/679 in the historical-legal context of other European Union legislative instruments and of the Portuguese legal system, in particular with regard to Processing and protection of personal data.Secondly, we will characterize personality rights, in general and in particular, which will imply considering, for example, the right to privacy in privacy, its content, scope and other related issues in the context of privacy to be respected By the controller.Finally, there will be an approach to civil liability and the consequences of non-compliance with the rules laid down in Regulation 2016/679 of the European Union, whether in the field of regulation or in traditional civil law compensation forms.
