Full textFamily Patrimony and Its Legal Status The family patrimony institution is relatively new in Lithuanian civil law. It came into effect on the 1st of July 2001 when the new Civil Code was introduced. The instititution was introduced for one main reason – the protection of the rights and interests of minors and the weaker (in an economic sense) spouse. The family patrimony is composed of the residence of the family or the rights which confer use of them, the movable property which they are furnished with and the items that serve for the use of the household and are owned by one or both of the spouses. Since the family patrimony has a protective purpose and the property it constitutes is a material guarantee of the family well-being, special rules apply to the disposal of family patrimony. Without the consent of the other spouse, a spouse cannot dispose of, mortgage, rent or otherwise restrict the right to use a movable item. In the case of immovable property a written consent from the other spouse is necessary. If the spouses live in a rented property the spouse who signed the lease cannot without written consent of the other spouse terminate the lease, sublease the property or transfer the rights under the lease. In cases where spouses have children who are under-age, in order to be able to perform transactions related to the family residence it is obligatory to obtain a court order. Full textSUMMARY This master‘s degree work is an analysis of the institution of family assets and their legal status. One of the new features established by the Civil Code of 1 July 2001 was the institution of family assets. This was done in response to international commitments undertaken by the Republic of Lithuania in the area of protection of the rights and lawful interests of children. The purpose of the institution of family assets is to protect the rights and lawful interests of children and the economically-weaker spouse. However, the interests of the economically-weaker spouse are defended only to the extent that such defence helps to protect the interests of the children who remain with the spouse after the dissolution of the marriage. The concept of family assets, its composition, the legal status of family assets, and the means by which they are created is analysed in the work. Problems arising from the right of marriage partners to control and use assets are discussed. Cases associated with family assets, the placing of limits on their disposition and use, and court permissions as a form of control in defence of the rights and lawful interests of children and the economically-weaker spouse are analysed. Problems arising from court protection of family assets, the conclusion of legal oversight of family assets, and distribution of family assets are discussed. Full textThe last decade, a residential real estate prices in Lithuania and neighbor countries grew rapidly in the region and also between the European Union members. This increase was largely influenced by a growing domestic economy and improving economic indicators such as gross domestic product, wages and other factors. Also the real estate market is influenced by psychological factors, such as a profitable investment. Rapid grow of the house prices was possible to obtain real estate price bubble, which until now Lithuanian real estate market was not a familiar. Property prices began to rise rapidly in 2003, and it can be considered as starting point for emerging price bubble and in year 2005 prices raised the most during the last decade. Baltic states property market prices growth strongly dependent on macroeconomic indicators.

Full textThe subject of the Master's thesis is the Land Lot Purchase Agreement. In this paper the author studies the legal frames of the Republic of Lithuania concerning the Land Lot Purchase Agreement. The possibility of entering into such an Agreement is discussed in a relation to Lithuanian judicial practice, also taking into account the similar legal practices in other foreign countries. It should be noted that the essential conditions for such an Agreement is the subject of the Agreement, its price, and notarizing the Agreement. The emphasis of this Master thesis is the subject of the Land Lot Purchase Agreement – the land lot – which in its specificity distinguishes this Agreement from the other different Purchase Agreements, as well as the parties of the Agreement do. It should be noted that the land lot may be only a matter of the Land Lot Purchase Agreement if it is formed and registered in a public register under the laws of the Republic of Lithuania. Full textIn the last few decades economic conditions has changed dramatically because of real estate market huge impact for the economy development. Obviously, that real estate market involves financial, constructional, building materials, working resources, goods, and other markets. More than once the historical guidelines of many countries had disclosed the threat of real estate market fluctuation to the harmonious development of a national economy. Encouragements of experts to resist euphoria came short of living standards’ growth and the psychological impulse that followed the tendency of residential real estate market’ growth. It was favourable for real estate developers because dwelling prices were growing and the demand was great, but since the end of year 2007, situation in real estate market’ changed. Full textThe conception of real estate can be understood very differently – depending on its utilization. For some people it is either working or resting place, for others – safe investment, property guarantee, business or other activity mean. Lithuanian real estate market, especially the separate segments are very young and still in developing phases. This offers both advantages and disadvantages: investments bring big profits but convey the huge risk. The development of Lithuanian real estate market began in 1990, when the government of Lithuania officially declared independence, after which land and real estate questions became the most important. Economical growth in Lithuania was related with business development, when the demand of office accommodation stimulated trade. The purpose of work is to find out what competitive strategies are used by the real estate companies’. The first part of the work presents theoretical aspects of competitive strategies, including corporate competitive strategies, also other competitive strategies of companies’ such as competitive strategies of companies‘ by the part of market they take. In the second part of the work there is represented results of previous research, where variuos authors analyse competition and competitive strategies in real estate market. The third section shows the way, how the research was organised, presents methods of research and also there you can find practical information (findings of research) about the competition and competitive strategies, that are used of real estate companies operating in the market of Kaunas. Full textThe concept of mortgage originated from a Greek word “hypotheke” that means a thing in mortgage but the thing is still left for the owner to posses. Although the homeland of lien is considered to be Babylon, the legal institute of mortgage appeared as the result of Roman law reception in the states of western law tradition. In Lithuania, like in the ancient Rome, mortgage progressed from one developmental stage to another, i.e. from 1818 when the regulations of mortgage were accepted till the implementation of reformed mortgage system in Civil Code and Code of Civil Procedure that are available now. However when new civil laws became operative, a material legal regime was attached to mortgage, the dual nature of mortgage law cannot be considered strictly the right in rem, so in the Master thesis one analyses the topic of mortgage legal nature, researches mortgage, as a real security device, and relationship with other security devices. Full textThe final master’s thesis examines the issues related to one of contemporary means of visualisation, virtual tours, and determined in the analysis of the global practice related to the application of virtual tours. The thesis describes the results of the study, which aimed to discover classification, penetration, advantages and disadvantages, and other relevant information about virtual tours. The technologies used in development of virtual tours are analysed. The potential of virtual tours to be employed by subjects operating in the real estate sector is discussed. Suggestions are made how to select the best type of a virtual tour for specific cases of real estate depending on its types. The potential of virtual tours in the tourism sector and in the area of discretisation and promotion of real estate heritage is described. A SWOT analysis summarises the potential use of virtual tours. The significance of virtual tour to society in the context of the quality of human life is analysed. Analysis of theoretical and practical possibilities to employ virtual tours is made and the final thesis ends with the conclusions and suggestions. Full textThe final thesis consists from two main parts: theoretical evolution of factors, influencing real estate market and practical evaluation of factors influencing residential real estate market in Vilnius since 2008 financial crisis. The first part examined the most relevant scientific publications to identify the fundamental economic crisis and real estate price bubble formation mechanism. Theoretical causes of asset price dynamics are examined. Performed deep analysis of banks' and psychological factors roles in real estate development and decline. The second part is practical evaluation Vilnius residential real estate market since 2008 based on the Centre of Registers, Bank of Lithuania, Department of Statistics and other data. The original findings about the capital real estate market activity being influenced by macroeconomic, psychological and other factors are based on actual figures. These are amount of sold apartments relevance to: GDP per capita; consumer confidence level; bank policy etc. According to the results, it is suggested to create a model, which would include all the influencing factors taking into account their correlation coefficient. Model could be used to forecast real estate market activity and price dynamics. Work size: 76 pages, 1 table, 22 figures, 70 bibliographic sources.

Full textLithuania as well as many European countries has implemented in the new civil code the pluralistic civil relations of objects to the doctrine of assigning property rights. This paper analyzes the specific assignment transaction - sale and purchase agreement of succession rights. The transaction problem areas are the following: limits of the transfer of succession rights, responsibility for the debts of the deceased, sale of status of the successor, documents which confirms the property rights for the purchaser of succsession rights, also discussed the assumptions to assess the agreement as having the element of risk. The same sale and purchase agreement of succession rights makes it easy for the successor position in respect of the disposition of those rights. However, it is rarely applied due to lack of analysis of its legal practice. The paper expressed the view that the successor rights of the sale and purchase agreement of succession rights is transferred to the heir to the legacy which has adopted a subjective property right, the object - the right of successor - legacy as property complexes, seen as an integrated set of rights and obligations, recognized as an intangible asset that can be transferred to the right of succession certificate. It is also very important for left-making process, which depends on the successor rights of the buyer's responsibility for the debts of the deceased. Full textAlthough economists offer different variants for welfare measuring, none of this variants can disclose the fool situation of economic wellbeing. That is why the main goal of this thesis is to analyze possibilities of economic welfare measuring by macroeconomics indicators. The thesis includes three parts. The first one is for theoretical analyses (ideas of historical economic schools, thoughts by A.C.Pigou – one of the welfare economics beginners, mathematic direction of economics). In the second part usefulness of possible indicators for measuring of economical welfare is being tried to discover through analysis of statistics data (using European Union statistics). That is how basis for the third part was made. In the last part unified index of economic welfare, which summarizes all mentioned macroeconomics indicators, is tried to be obtained. Theoretical analysis and empirical research allowed to make and describe the system (index of economic welfare) for the author by himself. This system includes main macroeconomical indicators and allows to unite both parts of economic welfare wealth and distribution. After some test with statistical data index of economic welfare was mainly balanced.

Full textThe purpose of master work is to analyse the current situation of the real estate taxing system in the European Union countries and provide the perfect ways for this tax in Lithuania. The real estate tax system in Lithuania is on the creation cycle, so it doesn‘t adjust to each region as in many European Union countries. However in many EU countries, and especially in Lithuania are validate many privileges of the real estate tax, which make a reserve of the corruption and the black economy and also it twist the rules of the Taxes ethical codex. On purpose to stimulate a small and medium enterprises, it‘s very important estimate the rates and the value method regard to regional peculiarity. The current value method of the real estate, massive appraisal, doesn‘t have such efficiency, how was expected. The method doesn‘t crack the latest problems but made presumptions to new. In that case it would be advisable to practise the real estate tax, which is relate with the land value, about what consider many EU countries. The real estate tax impact not only laws or real estate value, but also taxing policy of the local government. From the local government chosen policy depends concatenations between authority and enterprisers, to manage motivate this tax incomes resorting for towns image and together for raising investment. To make the real estate system working in maximal function, it‘s necessary all named elements of jus base constantly development.

In order to attain the given aims, the following tasks have been set: to research influence of external factors on the real estate markets; to discuss and to analyse real estate concept and development trends in Šiauliai City; to give conclusions and suggestions. Further, assessment criterions and structuring legal framework of tax base are discussed, and analysis of provisions of Lithuanian and other European countries legal acts, regulating taxes on immovable property, is presented. Also the importance of tax on immovable property for municipal budget revenues is evaluated, and possible changes in the legal framework of Lithuanian laws regulating tax on immovable property are predicted. After the analysis of provisions of Lithuanian and other European countries legal acts, regulating taxation of immovable property, was completed, and topics related to taxes on immovable property in ad hoc literature were explored, it was found, that recent system of taxation of immovable property in Lithuania does not fully correspond with tendencies dominating in international practices: though Law on immovable property, which came into force since 1st of January 2006, extended the tax base, and though methods for determining taxable values of immovable property are the same which are used in international practices of immovable property taxation, still not all problems, relating to taxation on immovable property (as well as land) are solved. Full textReal estate cadastre and register system developed in all country‘s administrative territories. In real estate register data bank is concentrate exhaustive data in real estate objects, including land, buildings, lodgings, flats and infrastructure. Also there are saved data about relations governed by law in real estate objects control, difficulties, servitudes, facts in law, hypothec. In that way, citizen properties rights to real estate are protect. Real estate cadastre and register system is effective in Lithuania. It is orientated to public and supported purpose of adaptation conception. In the research work analyzed registered houses and garden-houses numbers and connection between property and gardens-plots numbers plots. Other searching object was house and other purpose buildings number and density. All researches carry out in the year 2004-2005. In analyzed period was noticed, that the most registered was purpose of house buildings. This number of registered objects was almost 22,000 house buildings. In the mean time registration of garden-houses was very slow. Even 81 percentages of garden–plots was without registered garden-houses in the year 2005. Such situation was influence by many reasons. For example garden-houses is already used as house building.

Tangible assets are used and the total businesses. In many companies, this property makes up most of the available assets. Therefore, fixed assets accounting and analysis is a very hot topic master thesis. In order to provide accurate and truthful information about the company's status and performance of the company accountants and managers is important to choose the most appropriate long-term tangible assets in the accounting and depreciation methods. Overview of global positioning system, measuring methods, the errors and accuracy of coordinates measured in the Lithuanian State GPS Network. Discuss the Republic of Lithuania laws, government regulations and other legal acts, the articles that define the cadastral work methodology through cadastral case, the combination of turning points outside the bordering neighbors, and the importance of the correct boundary of the construction, measurement of land area and more. The most common reason for errors committed by surveyors who carry out the cadastral measurements of the city of Vilnius and the Vilnius region, which influences the occurrence of errors and the need for cadastral measurements. Spatial planning documents for non-compliance with reality. So, it is very important to define the accurate value of the real estate, which could be used during the privatization of the state-owned land (during land reform), as well as making real property transactions or calculating real estate taxes. Land market in Prienai district was analyzed in this thesis work. The data about premise and agricultural land plots in Prienai district during 2007 has been collected for this research work. On purpose to evaluate the accuracy of mass appraisal of land, the prices of these plots were compared to those received while calculating according to the value model used for the compiling of value maps. According to the received data, market prices do not correspond to those presented in the land value maps.

Full textCadastrial measurements at present rise in importance. Their importance will especially increase after the 1st of January, 2008, when they will become compulsory in all cases. The author in the article reviews tendences of the quantity of geodesically measured land plots during the last five years in Alytus district. Their quantity is analysed according to the purpose and character. Geodesical measurements of house domain purpose land plots and problems occurring during their measurement are analysed separately. Also the problems that can occur after the end of land reform are discussed. Legal regulation of preliminary and cadastrial measurements, qualification requirements for specialists forming land plots are reviewed. Examples of specific problems occurring while performing cadastrial measurements are given, and their ways of solution are discussed.

Full textCadastral measurements are the actions, by which is identified real estate such as buildings, formed plots of land, premises, and etc. The outcome of the cadastral measurements is a collection of the cadastral data on the real estate. The purpose of buildings‘, plots‘ of land, and premises‘ cadastral measurements is to estimate the size of the real estate, its physical condition, value, and other indicators. These indicatiors are needed for the real estate records, transactions, taxation, and the rights of ownership to registrate. Property‘s physical condition and value, dynamics of market, and foreseen changes in real estate market are calculated using cadastral data. Cadastral measurement file is completed after cadastral measurements are done. The file consists of real estate plans that are estimated by cadastral measurements and all documents and forms that are filled for the measured real estate. The cadastral surveys of land and buildings are provided in ten counties of Lithuania. One of them is Šiauliai county, which ranges norht and middle parts of Lithuania: Šiauliai city, Akmenė, Joniškis, Kelmė, Pakruojis, Radviliškis and Šiauliai regions. Šiauliai county is in great geographical location, and geopolitical state; has high infrastructure, increasing economy and agriculture; high level in education, medicine and culture.

Full text(Consequences of Invalidity of a Transaction and Determination of the Starting Point of its Invalidity) The goal consequences of invalidity of transactions are stable and legitimate civil circulation. Invalidity of a transaction eliminates the legal validity. On the one hand, invalidity of a transaction has no legal consequences for the future, on the other hand, using the retroactive recognition of the transactions (retroactivity) principle, the transaction presumed to have not existed and the consequences of transaction are disappeared. Whereas, certain facts have occurred in reality, using legal instruments, parties are returned to the status quo before the transactional. Restitution, the main consequence of invalidity transactions, of subject of transaction, counterparts specific, or third parties rights in subject of transaction, may not always be applicable. In this context, parties returned to the status quo before the transactional, are used other legal instrument: no reason on assets and unjust enrichment rules, vindication, Actio Pauliana legal action. When the restitution returning the item back to the whole or counting the value of money becomes impossible and parties have legal obligation relationships, used no reason on assets and unjust enrichment rules.
