Abstract:

The tribunes are a group of sports facilities accompanying many sports facilities of various disciplines. These objects had many types of architectural forms, from small-scale wooden structures, through medium-sized steel structures, to large brick and reinforced concrete structures. The tribunes, depending on the rank of the sports facility, were designed as open or roofed. In some buildings, the function of the audience was combined with the back of sanitary rooms, cloakrooms, cash registers, entrances, restaurants, etc. Many of these buildings played a representative role. The stands built in the interwar period were one of the first facilities of this type. The later projects of the tribunes referred in their function and form to the examples from the Second Polish Republic.

Abstract:

AbstractThe tribunes of the people at Rome were an immensely significant constitutional institution and are intimately associated with the early days of the Republic. The sources present a varied account of their origin and powers, and the debates visible in those versions are strongly related to the disputed nature of the plebs and its role in the formation of Rome's political community. Moreover, the close connections of the tribunes with writing, record-keeping and with Greekness all raise questions about the sophistication of the early Republic, but are also implicated in debates over the reliability of the historiographical tradition. This paper considers the arguments for accepting the reliability of some aspects of that tradition and presents an account of the tribunes' functions in the early Republic, including their sacrosanctity.

Abstract:

Les églises des Pyrénées occidentales possèdent de très nombreuses tribunes ou galeries de bois. Ces compositions meublant le fond de la nef (côté ouest le plus souvent) participent à la décoration globale de l'église. Les cent trente édifices cités dans l'inventaire possèdent une ou des tribunes d'un des trois types établis. La plus simple : large et droite, puis le modèle intermédiaire : une tribune large avec deux avancées latérales et enfin la composition à plusieurs étages. Les éléments décorés de la tribune qu'ils soient peints, dorés ou sculptés se situent habituellement le long de la balustrade et des piliers de soutien. L'originalité de ces aménagements réside souvent dans la création de types divers de balustres tournés ou découpés. Ces constructions de bois ne sont pas les seuls exemples de ce type dans un village pyrénéen. On retrouve systématiquement dans différents édifices civils cette même technique du balcon. Le bois joue donc un rôle fondamental dans l'architecture pyrénéenne et l'église rurale n'en n'est qu'une représentation. L'augmentation de la population aux dix-septième et dix-huitième siècles ainsi que le retour à des temps plus calmes et le renouveau religieux de la réforme catholique furent déterminants pour les améliorations et les travaux décoratifs des églises de la région étudiée. Les traditions religieuses et sociales locales comme le rôle des femmes dans les rites funéraires, l'importance des chorales masculines, la place de l'église entourée du cimetière au sein du village furent des facteurs favorisant l'établissement d'un espace propre aux hommes à l'étage préservant l'unité de la nef habituellement unique, privilégiant l'acoustique et utilisant le matériau traditionnel et disponible de la région. Ces aménagements intérieurs bien que parfois très humbles sont une caractéristique significative du mobilier religieux des églises pyrénéennes

Abstract:

Cette étude s'articule autour d'une méthodologie d'évaluation du confort aérothermique des spectateurs dans les stades modernes et aborde les aspects du confort visuel et acoustique. Dans en premier temps, la démarche a consisté à appréhender la notion du confort dans les espaces semi-extérieurs : une zone de confort aérothermique qui intègre l'effet de la température et du vent est définie afin d'évaluer le confort aérothermique des spectateurs. Dans un deuxième temps, l'impact de la morphologie architecturale du stade sur les caractéristiques de l'écoulement a été étudié. Pour cela une série d'essais paramétriques a été effectuée sur vingt configurations architecturales du stade dans une soufflerie à couche limite. La vitesse du vent et l'écart type ont été mesurés par l'anémométrie à fil chaud au niveau des tribunes. Les paramètres suivants ont été modifiés : l'inclinaison et le débord de la toiture, la porosité de la façade et le plan du stade. Les ont mis en évidence qu'il existe des relations entre la morphologie du stade et les caractéristiques de l'écoulement. Le confort visuel des spectateurs en lumière du jour est analysé pour des stades comportant des toitures opaques de différentes positions, à partir de l'uniformité d'éclairement de l'aire de jeu. Une méthode a été mise en œuvre qui permet de définir l'emplacement de la partie opaque et transparente d'une toiture afin d'augmenter la longueur de la période de l'éclairement uniforme de l'aire de jeu. Une méthode d'évaluation du confort aérothermique basée sur la transposition des résultats des essais menés en soufflerie a été développée qui serve à intégrer du stade dans son environnement climatique
This study presents a methodological approach to evaluate the aerothermal comfort of spectators in stadia. Its extension raises some aspects of the spectators' visual and acoustic comfort. First, the conception of a comfort zone integrating the effect of temperature and wind has been developed based on the mechanical nuisance due to the wind and on the thermal effect of different temperature and wind speed combinations. Then, the effect of the morphology on the airflow inside the stadium has been investigated through wind tunnel tests in a boundary layer wind tunnel on a stadium model of variable geometry. The following architectural parameters have been modified: slope, overhang of the roof, façade porosity, stadium layout. Mean wind speed and standard deviation have been measured by hot wire anemometer at spectators' height in the bowl. The tests revealed that a relationship exists between the morphology and the airflow. The results associated with the meteorological data (temperature and wind speed) of a given site facilitate to define the frequency of comfort and discomfort. This methodology should be ideally applied in the design phase of the project. The roof position influences also the visual comfort of the spectators. The last has been analysed by daylight with an opaque roof. The visual comfort requirements are based on the uniform lighting conditions of the pitch; i. E. No accentuated contrast should appear on the pitch due to the shadow of the roof. A method facilitating the definition of the photometric morphology of the roof in order to prolong the visually comfortable period (localisation of the opaque and the transparent roof parts) has been developed

Abstract:

This study intends to analyze the importance of institutional trust in the process of democratization. In this particular case, the period from 494 to 88 BC in the Roman republic is examined. The theories of Charles Tilly and Robert Putnam are utilized to more deeply examine the concepts and manifestations of trust and democratization. Using the ideas and theories of these authors together provides a unique insight into the means by which a population comes to trust that government is responsive, and further comes to expect increased responsiveness in the future. Institutional trust as an element of mutually binding consultation will be explored via proposed and successful plebeian legislation in the Roman republic. This study examines legislative actions, defined as proposed legislation (rogationes) alongside successful legislation (plebiscita and leges), which originated in the plebeian assembly, the concilium plebis, under the guidance of the tribunes of the plebs, the elected officials of the plebeian population at Rome. In all, 236 legislative actions between 494 and 88 BC are divided into four themes of democratizing action, termed equality, broadening of participation, protection and mutually binding consultation, and then further organized into one of nine sub-categories for each theme. Findings suggest that the final period of 192 to 88 BC, which is period of frenzied plebeian political activity through the concilium plebis and the tribunes of the plebs, is made possible by a marked increase in legislative actions related to mutually binding consultation in the pervious period (292 to 193 BC). These findings support the claim by Tilly and Putnam that democratization can occur only with increases in institutional trust.

Desde hace aproximadamente una década, el Tribunal Constitucional se ha convertido, en forma progresiva, en actor fundamental del quehacer tributario peruano, regulando límites a la potestad tributaria, fijando pautas para el establecimiento de una definición de tributo, determinando obligaciones que corresponden a los administrados y facultades que competen a la Administración, procurando una relación de equilibrio en los procedimientos tributarios y planteando derroteros para la imposición de sanciones tributarias. La importancia que ha adquirido la jurisprudencia del Tribunal Constitucional no es un hecho privativo de la materia tributaria; muy por el contrario, el Tribunal Constitucional está presente en todas las áreas del derecho, siendo para muchos una expresión más de un mundo globalizado en donde el Derecho Civilista adquiere cada vez más características que corresponden al Derecho Anglosajón y viceversa. El presente artículo no pretende agotar toda la injerencia que hasta la fecha ha ejercido el Tribunal Constitucional en el Derecho tributario peruano; pero sí busca detenernos a meditar un aspecto importante de esa participación, específicamente en la elaboración del concepto de tributo y, más concretamente, en el análisis de cada uno de los elementos que conforman dicho concepto y que en conjunto le dan vida; con el propósito de plantear, a partir de tal análisis, una apreciación crítica del concepto vertido y su impacto en las decisiones del Tribunal Fiscal.

En el presente trabajo se analiza las sentencias del Tribunal Constitucional Chileno más importante relativa a los cobros que realizan los entes públicos, por la utilización de bienes de uso público, actividades o servicios que prestan a los ciudadanos, sean en forma directa o indirecta, que el Tribunal Constitucional en su jurisprudencia reciente denomina como “derecho” o “tarifas”, en relación con el concepto de “tributo”, y en especial con una de sus especies las “tasas”. Con dicho objeto, en primer lugar, es necesario salvar problemas terminológicos, para luego fijar los conceptos comúnmente utilizados relativos a los tributos y sus especies. A su vez, determinar las dos posturas contrapuestas, doctrinales y jurisprudenciales, que sobre sobre el concepto de tasa se han desarrollado en Chile. Por otra parte, se analizará la diferencia entre las tasas y el concepto de precios, y la distinción entre potestad de tributaria y potestad tarifaria. Del examen de los conceptos, posturas y diferenciaciones doctrinales y jurisprudenciales, se extraerán principios y reglas, que se aplicarán a las sentencias del Tribunal Constitucional, con el objeto de extraer el fundamento o doctrina base de las sentencias analizadas, con el objeto de poder deducir principios y reglas de aplicación a casos futuros.

Abstract:

The topic of this master's thesis is the revitalization of the former Spartakiad stadium. Nowadays it functions as a sports complex Ohrada, which is in neglected condition and not widely used. The area is located at the southern edge of the city Vsetín and is defined by a 1st class road from the northeast, Vsetínská Bečva from the western and agricultural areas from the southern side. Above Bečva, the Bečevná hill rises and together they create a pleasant, out-of-town atmosphere with a great potential. The priority of the proposal was to create an attractive place with a variety of sports and recreational activities for all ages. However, at the beginning it was necessary to somehow insulate the area from the overpass. Therefore a sports and recreation facility was designed at the entrance to the area - it copies the shape of the road and forms an imaginary entrance gate to the zone. A car park was designed under the overpass, so the rest of the area remained exclusively for pedestrians. Sufficient distances among the individual sports grounds are supplemented by recreational areas of greenery. Most playgrounds are designed as multi-purpose, for greater variability of the territory. The buildings have a maximum of two floors and they are located in a way not to disturb the views of the recreational areas. They contain sports facilities as well as a wide range of interior activities. Three materials are used on all the buildings - wood, steel and glass, complemented by neutral white plaster. Therefore, the area operates in a comprehensive and uniform manner.

Abstract:

Abstract This chapter explores the interactions between plebeian tribunes and the Senate in law-making. During the Republican period the interactions between tribunes and the Senate underwent substantial modifications. From the third century bce, after the lex Hortensia, the tribunician college became a governing body, now formally accepted and recognized: the tribunes were indeed invited to join the Senate and to become part of it. The tribunes became then privileged interlocutors of the Senate and sometimes “instruments of the senatorial will” (as Francesco De Martino effectively put it). However, this vision of the two-way relationship between the tribunician college and the Senate, based on concordia, was not always shared by all the tribunes. In the dialectic between the Senate and the tribunes, commonality or divergence of intents were determined by political considerations.

Abstract:

O isolamento social imposto pela pandemia de COVID-19 exigiu mudanças estruturais e instrumentais nos diversos âmbitos de trabalho. Os tribunais judiciários mantiveram suas atuações de forma contínua, lastreados pelas possibilidades trazidas pelas novas tecnologias de informação e comunicação. Dentre os atores dessas instituições, os gestores de vara judiciária tiveram grande desafio de ajustar sua função de gestão ao sistema híbrido de trabalho. A partir da Análise Ergonômica do Trabalho e da autoconfrontação, o serviço de saúde ocupacional de um tribunal foi capaz de conhecer as tarefas executadas, os riscos atribuídos a elas e as estratégias desenvolvidas pelos secretários de vara. Incluem-se entre as tarefas observadas dos secretários: aspectos administrativos e gestionários, atividades jurídicas processuais e comunicação e atendimento da unidade aos públicos interno e externo. A multiplicidade de tarefas dessa função foi evidenciada como gerador de custos pessoais, modulado pelas escolhas e estratégias assumidas por cada trabalhador. Abstract:

El presente trabajo recoge parte de los resultados obtenidos en el marco del proyecto de innovación docente “Herramientas para la planificación, realización y valoración de los Trabajo Fin de Grado (TFGs)”. Se pretende resolver la problemática a la que se enfrenta el alumnado, los tutores y los tribunales en cuanto a los criterios de valoración de los TFGs, aportando herramientas para su evaluación (rúbricas). Actualmente, no existen unos criterios claros y objetivos para la evaluación de los TFGs, quedando en ocasiones su calificación sometida a valoraciones subjetivas, por parte del tribunal evaluador. Así, es más detallado el documento para la evaluación de las competencias trasversales que el utilizado para la evaluación del TFG. Por tanto, es necesario desarrollar un documento “Guía del Trabajo Fin de Grado”, que proporcione instrumentos para una adecuada y óptima planificación y evaluación de los TFGs. Uno de los puntos clave del proyecto, ha sido la elaboración de una rúbrica con indicadores medibles que faciliten y clarifiquen la evaluaciónn de los TFGs. Dicha rúbrica, se pasará a los diferentes grupos de interés (profesorado, alumnado y comisiones académicas) para mejorarla y validarla. Palabras clave: evaluación, valoración, criterios, rúbrica

Abstract:

Introdução: A Tribulus terrestris, popularmente conhecida como videira da punctura, abrolho terrestre, rabo-de-calango, tribulo, tribulus e cabeça-de-touro, é uma erva daninha da família Zygophyllaceae com propriedades medicinais e fama afrodisíaca. Planta nativa e frequente na Europa e Sul da Ásia, atualmente, pode ser encontrada em diferentes regiões do mundo, sendo considerada uma planta invasora. Objetivo: Revisar sobre informações existentes a respeito da Tribulus terrestris e seu uso medicinal, levando em consideração a sua composição química, assim como sua utilização na medicina tradicional. Material e métodos: Trata-se de uma pesquisa efetuada por meio de revisão bibliográfica de artigos científicos encontrados nas bases de dados da Scientific Electronic Library Online (SCIELO) e Medical Literature Analysis and Retrieval System Online (MEDILINE), o critério de inclusão utilizado foi a compatibilidade com o tema, foram utilizados artigos em português e inglês produzidos nos últimos cinco anos. Resultados: Na composição da tribulus são encontradas substâncias como saponinas, flavonóides, glicosídeos, alcalóides e taninos, sendo as saponinas as substâncias mais importantes e estudadas nesta planta por suas propriedades. As saponinas, em específico a protodioscina e protogracilina presentes na planta, são responsáveis pela fama afrodisíaca. A tribulus apresenta atividade diurética devido a sua concentração de nitrato e óleo essencial presentes em seus frutos e sementes, em animais apresenta também várias outras atividades farmacológicas como ativada antiurolítica e imunomoduladora, mas existe a carência de amplos estudos dessas atividades farmacológicas em humanos. Tradicionalmente, esta planta é historicamente utilizada na medicina tradicional da China, Ayuveda e Unani para tratar disfunção erétil, fígado deprimido, utilizada como cardiotônico, diurético entre outras atividades medicinais atribuídas a planta. Conclusão: Assim sendo, o uso da Tribulus terrestris é antigo na sociedade e está presente em diversas medicinas tradicionais. Famosa por seu efeito afrodisíaco, mas existe a possibilidade da tribulus contribuir para medicina moderna com sua atividade farmacológica.

Abstract:

Arbitration is a well-established and widely used method of resolution of disputes outside the state courts. There are various arbitration centers around the world. The Istanbul Arbitration Centre ISTAC is an independent, neutral and impartial institution providing efficient dispute resolution services for both international and domestic parties. The arbitral awards rendered under ISTAC Arbitration Rules are subject to enforcement by officers just as court decisions. ISTAC arbitration proceeding is carried out by The Sole Arbitrator or Arbitral Tribunal which consist of President and other arbitrators. The Sole Arbitrator or Arbitral Tribunal shall render the award on the merits of the dispute, within 6 months from the date upon which the completion of the signatures on the terms of reference. When the dispute is resolved by an Arbitral Tribunal, it shall decide by majority. In the absence of majority, the award shall be made by the President of the Arbitral Tribunal. The arbitral award contains information of parties and arbitrators, the reasoning of the award, the decision, the decision concerning the costs of the arbitration. The awards are signed by Sole Arbitrator or Arbitral Tribunal. The Sole Arbitrator or Arbitral Tribunal may correct ex officio any computational and typographical errors in the award within 30 days of the date on which the award was rendered. The arbitration proceedings are terminated by the issuance of the award or by the occurrence of any circumstances which are stipulated under ISTAC Arbitration Rules Article 3.
