Abstract:
In settler societies, tribal self-governance creates a legal distinction between indigeneity (defined by settler governments) and tribal membership (defined by tribes). Many legally indigenous persons are not tribal members, and some tribal members are not legally indigenous. This book considers the membership rules included in the constitutions and membership codes of nearly 750 recognized tribes in Canada, New Zealand, Australia, and the United States. It addresses the first-order question of tribal constitutionalism: who are the members of tribes, and how are they chosen? The question is of practical and theoretical import. A large proportion of indigenous peoples in each state are not enrolled in a recognized tribe, and the majority of indigenous peoples do not live near their tribal territories. The book's empirical study challenges many of the assumptions used to model tribalism in theories of cultural pluralism, especially those that depict tribes as distinctively insular, ascriptive, and territorially-confined. The book shows that while they are descent-based groups, tribes also self-constitute relationally, by enrolling non-descendants in accordance with cultural and social criteria, and by recruiting from other indigenous communities. The book draws on tribal law and practice, political theory, legal doctrine, policy, and demographic data to critically assess the strategies used by tribes and states to manage the jurisdictional and ideological challenges of tribal membership governance.

This chapter deals with the history of the emergence, development, triumph and present-day challenges of Deobandi madrasa teaching and of the politicisation of Sunni identity in Iran’s Baluch society, against the socioeconomic backgrounds reconstructed in the volume’s previous sections. It relates, notably, the origins of the Sarbaz nexus. It explores the centrality of the Sarbaz oasis in early modern Iranian Baluchistan; its connexions with the Baluch transnational labour emigration; British and Iranian support to Deobandi teaching during the Interwar period, as a bulwark against Soviet influence and communist ideology; the decisive role played after WWII by intermediary agents in Karachi and Pakistani Baluchistan for the propagation of Deobandi teaching in Iranian territory; and the special connexion of the Sarbazi nexus of ulama with the Isma‘ilzayi tribe and its allies in Baluch society.

Abstract:
Tribal governments in the Southwest employ a number of individuals to help with the preservation of tribal values and places. In this chapter, Theresa Pasqual, former director of Acoma Pueblo’s Historic Preservation Office and an Acoma tribal member, talks about her professional pathway, how Acoma has worked with other tribes to protect traditional cultural properties (TCPs), the challenges that tribes face in implementing the National Environmental Policy Act (NEPA), and how tribal values can be incorporated into the preservation process. Based on her long experience, she emphasizes the importance of stewardship, listening, and collaboration—with the latter including collaboration between tribes as well as with archaeologists, anthropologists, and historians. She also provides insights into the process for the recent successful nomination of Mount Taylor to the New Mexico Register of Cultural Historic Properties, the largest such property currently on the register.
