Abstract:
This thesis is a study of the problem of subjectivity and prostitution in the Middle Ages. Three legal case studies of unpublished archival material and one chapter focussing on fictional texts from late mediaeval Germany and Switzerland are used to investigate the conditions of prostitutes' subjectification in law and literature. The thesis takes impetus from Ruth Karras's recent articulation of the problem of prostitution and sexuality, seeking to engage critically with her notion of “prostitute” as a medieval sexual identity that might be applied to any woman who had extra-marital sex. In dealing with trial records, it also aims to make a methodological contribution to the study of crime and the problem of locating the individual. Chapters I-III examine the records of criminal cases featuring the testimony of prostitutes, or women who risked such categorisation, to consider the available subject positions both within and outwith the context of municipal regulation. Whilst acknowledging the force of normative ideas about prostitutes as lustful women, these chapters argue that prostitutes' subject positions in legal cases were adopted according to local conditions, and depended upon the immediate circumstances of the women involved. They also consider trial records as a form of masculine discourse, arguing that an anxious masculine subject can be seen to emerge in response to the phenomenon of prostitution. Chapter IV expands this discussion by drawing on literary texts showing how prostitutes prompted concern on the part of male poets and audiences, for whom their sexual agency was a threat which belied their theoretical status as sexual objects. Note: Transcriptions of the legal cases making up chapters I-III are provided in Appendices A, B, and C.

Abstract:
The purpose of this essay is to explore actions of the representatives of the church during the first of the trials of what later developed to the great swedish witch-hunts between the years 1668–1676. The method of this study is microhistorical, where you look at local events that then can be applied on a bigger scale. The theoretical ideas applied are Michel Foucault theories of a society at war, and the dynamics between central power and peripheral power in that kind of situation. By applying these theories, the relations between central juridical directives and the enforcement of these in a local place can be studied. The main subject of interest for this essay is clerical representative Lars P. Elvius, who, during the trials, were the one responsible and the one the rest of the court relied on for interpreting the crimes of witchcraft, maleficum and other crimes of supernatural art. By looking at the directives and laws concerning witchcraft, how he interpreted the testimonies of the accused and what kind of verdict was given at the end of the trial, the relationship between central directives and peripheral enforcement is made clear. This study is part chronological and part thematic; the directives and laws presented first, followed by the interpretation during the trial categorized thematically, with correlating testimony and crime, and finally the verdict at the end of the trial.

Arbeit und Magie werden in der ländlichen Gesellschaft der Frühen Neuzeit neu bewertet. Während die Reformation die Arbeit aufwertet, verteufelt sie den Müßiggang. Als zentrale Lebensäußerung bei der man häufig mit dem Lebensbereich des Anderen in Berührung kommt, birgt Arbeit ein hohes Konfliktpotential in sich. Als Glaubensform basiert Magie auf kollektiven Übereinkünften und strebt einen praktikablen Umgang mit feindseligen Mächten an, so dass sie mit Formen alltäglicher Konfliktaustragung (Gegenzauber, Bezichtigung als Zauberer/Zauberin) bekämpft werden können. Auf Magie als Deutung oder Handlung haben ihre beginnende Kriminalisierung (Carolina) und das Vordringen der Schriftlichkeit nachhaltigen Einfluss. Aus diesen Veränderungen heraus empfängt das Themenpaar Arbeit und Magie seine Bedeutung, das hier in seinem Zusammenwirken erstmals untersucht wird und zwar am Beispiel der Mittelmark. Wie die Auswertung von Gesuchen mittelmärkischer Gerichte um Rechtsbelehrung an den Schöppenstuhl in Brandenburg zum neuen Delikt der Zauberei im Zeitraum von 1551 bis 1620 beweist, handelt es sich bei der Mittelmark um ein verfolgungsarmes Territorium, das sich daher bestens für die Untersuchung des selbstverständlichen Umgangs mit Magie eignet. In 98 von 136 Prozessen sind insgesamt 107 Frauen und 9 Männer angeklagt – darunter eine „weise Frau“ und zwei Männer als volksmagische Spezialisten. Der Höhepunkt der Spruchtätigkeit liegt zwischen 1571 und 1580. In dieser Phase tauchen erstmals dämonischer Vorstellungen auf und werden weibliche Magiedelikte auch auf Männer übertragen (Schadenszauber, Teufelspakt). Der Vorwurf des Teufelspaktes ist überwiegend im Nordwesten der Mittelmark anzutreffen und wird hier auch zuerst erhoben. Dennoch kann sich der dämonische Hexenglauben als städtisches Phänomen in der ländlich geprägten Mittelmark kaum durchsetzen, denn in keinem der untersuchten Fälle taucht der Terminus „Hexe“ auf. Die Rezeption der Hexenlehre in all ihren wesentlichen Elementen (Buhlschaft, Zusammenkunft auf dem Blocksberg und die Fahrt dorthin) ist erst 1613 abgeschlossen. Damit kommt sie für die Mittelmark zu spät, um ihre zerstörerische Wirkung zu entfalten: Die Auswirkungen des Dreißigjährigen Krieges überlagern alsbald die Vorstellungen von „bösen Zauberinnen“. Mit Hilfe der Studien von RAINER WALZ zur magischen Kommunikation und EVA LABOUVIE (Offizialisierungsstrategien) wurden drei Fälle näher untersucht, in denen die Arbeit entweder Konfliktanlass ist, mit magischen Mitteln beeinflusst wird oder es um die professionelle Ausübung von Magie im Bezug auf ländliche Arbeit geht. In Nassenheide wird 1573 dem Bauern Peter Calys das Abzaubern von Feldfrüchten unterstellt. Seine Nachbarschaft beobachtet ein ihr unbekanntes Ritual (vermutlich eine Schädlingsbekämpfung), was sie in kein geduldetes magisches Handeln einordnen kann. In Liebenwalde geht es 1614 um „fliegende Worte“, die im Streit um erschlagene Gänse ausgesprochen und später, nach einer Reihe von Unglücksfällen, vom Gescholtenen als Flüche umgedeutet werden. In Rathenow steht 1608 der Volksmagier Hermann Mencke vor Gericht. Sein Repertoire an magischen Hilfsleistungen umfasst Bann-, Heil- und Hilfszauber. Diese drei Fallstudien ergaben für das Thema Arbeit und Magie, dass Magie in der sich schwerfällig entwickelnden Landwirtschaft ein innovatives Potential zukommt. Das Experimentieren mit Magieformen bleibt jedoch Spezialisten der Volksmagie vorbehalten. Insbesondere in den Dörfern, wo die Grenzen zwischen männlicher und weiblicher Magie durchlässig sind, erweist sich die Geschlechtsspezifik der volkstümlichen Magie als Produkt der Lebens- und Arbeitsbeziehungen in der ländlichen Gesellschaft. Männer wie Frauen verfügen über die zu ihren Arbeitsbereichen passenden Hilfszauber. Dass Zauber zu Frauenarbeiten wie Milchverarbeitung und Bierbrauen überwiegen, liegt neben der Häufigkeit, mit der diese Verrichtungen anfallen, ihrer Anfälligkeit für Fehler und ihrer Bedeutung für die Ernährung daran, dass sie sich im Verborgenen abspielen und daher verdächtig sind. Außerdem handelt es sich um mühselige und monotone Tätigkeiten, die daher der Motivation durch Magie bedürfen. Die Schlichtheit der weiblichen Magie korrespondiert mit der geringeren Spezialisierung weiblicher Arbeit in der Landwirtschaft, die sich in der Verwendung einfacher Werkzeuge bekundet. Wörter können wegen der spezifischen Organisation der Hirnareale zur Sprachverarbeitung in einer auf Mündlichkeit beruhenden Kultur heilen oder eine lebensbedrohliche Waffe sein. Indem Magie das Profane dramatisiert, kommt ihr die Funktion einer Erinnerungskunst zu, die später durch die Schrift ausgefüllt wird. Die Schrift macht Magie als Mnemotechnik überflüssig und immunisiert gegen die Macht des Wortes. Damit reift auch die Skepsis an der Wirksamkeit von Magie. Schließlich werden Schadenszaubervorwürfe nur noch als Injurienklagen verhandelt. Sie bestimmen die Prozesse um Zauberei nach dem Großen Krieg.
Work and magic have been redefined by the rural society of the early modern period. The reformation revalorized labor and condemned idleness. As basic means of existence, which was highly interwoven with the living spheres of other people, labor contained a high potential of conflict. Magic was a set of beliefs based on collective agreements and aspired to deal with evil powers by fighting them with every day strategies of solving conflicts like counter spells or accusations of sorcery. As an interpretation or action, magic was greatly influenced by its definition as an act of crime and an increase in literacy. These changes inspired the subject of this paper, which will analyze for the first time the interplay of work and magic in the electorate of Brandenburg, more precisely the Mittelmark. The examination of legal proceedings between 1551 an 1620 proves that the Mittelmark has been less infected by witch craze, which makes it an appropriate area to investigate the everyday use of magic. In 98 of 136 proceedings 107 women and 9 men have been accused of sorcery, among them one midwife and two specialists of popular magic. The climax of the proceedings happened in the 1570s. Now, demonic imaginations occurred and former female acts of magic were attributed to men as well. The assumption of a pact between witches and devil was typical for the northwestern part of the Mittelmark and has also been brought up as a charge there for the first time. Witch craze, however, was a phenomenon of the cities and hardly infiltrated the rural Mittelmark. In none of the investigated proceedings the word “witch” has been used. The reception of witchcraft in all its details like the pact with the devil or the gathering and the flight to the Witches’ Sabbath was only completed in 1613, too late to develop its destructiveness: The effects of the Thirty Years’ War overshadowed the conceptions of evil witches. By using the studies of Rainer Walz and Eva Labouvie, I closely examined three legal proceedings, in which the cause of conflict was either work, influences of magic on work, or in which someone worked as a popular sorcerer within rural work life. In 1573, the peasant Peter Calys, living in Nassenheide, has been accused to spirit away the crops. His neighborhood observed an unknown ritual which did not appear to be any form of harmless magic. 1614 “flying words” have been spoken in Liebenwalde during a quarrel about slain geese and were reinterpreted later as curses. In Rathenow the popular sorcerer Hermann Mencke had to defend himself in a trial in 1608. His magic enabled him to banish, to cure diseases, or to repair misfortune. As one healing attempt failed, his whole practice was viewed in a different light by his clients. The investigation of these three cases showed that magic possessed an innovative potential in the otherwise only slowly developing agriculture. But only specialists of popular magic were allowed to experiment with magic. The gender specificity of magic proved rather to be a result of relations and working conditions in rural society than of abstract ideas. Both men and women were well grounded in suitable spells for their working sphere. The greater quantity of spells belonging to typical female tasks like dairy or brewery work can be explained not only by importance and frequency of such duties in peasant housekeeping. These error-prone procedures could also fail easily and were additionally executed in the seclusion of a chamber and therefore suspicious. Above all, the tasks were monotonous and exhausting and therefore needed a magical motivation. The more artless female magic, relying mostly on power of words, corresponded with the less specialized female labor in agriculture. Due to the different organization of the cerebral areas for speech processing in an oral society, words could be lethal or healing. By dramatizing the profane, magic fulfilled functions of a mnemotechnique which were substituted later by writing. Writing protected against the power of words and accelerated skepticism of magic. In the end, accusations of sorcery were taken as defamations, which dominated legal proceedings after the Thirty Years’ War.

Abstract:
In 1950, the leader of the German Democratic Republic (East Germany), Walter Ulbricht, began a policy of connecting foreign threats with domestic policy failures as if the two were the same, and as if he was not responsible for either. This absolved him of blame for those failures and allowed Ulbricht to define his internal enemies as agents of the western powers. He used the state's secret police force, known as the Stasi, to provide the information that supported his claims of western obstructionism and to intimidate his adversaries. This resulted in a politicization of intelligence whereby Stasi officers slanted information so that it conformed to Ulbricht's doctrine of western interference. Comparisons made of eyewitness' statements to the morale reports filed by Stasi agents show that there was a difference between how the East German worker felt and the way the Stasi portrayed their attitudes to the politburo. Consequently, prior to June 17, 1953, when labor strikes inspired a million East German citizens to rise up against Ulbricht's oppressive government, the politicization of Stasi intelligence caused information over labor unrest to be unreliable at a time of increasing risk to the regime. This study shows the extent of Ulbricht's politicization of Stasi intelligence and its effect on the June 1953 uprising in the German Democratic Republic.

This thesis examines the body of international law drawn upon during the Nuremberg trials after World War II. The work analyzes the Hague Conventions, the Paris Peace Conference, and League of Nations decisions to support its conclusions. Contrary to the commonly held belief that the laws violated during World War II by the major war criminals were newly developed ideas, this thesis shows that the laws evolved over an extended period prior to the war. The work uses conference minutes, published government sources, the official journal of the League of Nations, and many memoirs to support the conclusions.

Fairy Tales have been an important part of peoples' cultural heritage since time immemorial. From a very early age on, children hear stories about witches, giants, dwarf's, and magicians which make up their first entry into the literary world. Only recently have scholars begun to research just how much influence these stories have on children and how they might have a different impact on girls than on boys. This thesis will investigate the world of fairy tales in relation to their historical context and their differing relevance for male and female readers. I will examine the fairy tales of the brothers Grimm and of Ludwig Bechstein because these three scholars count among the most important fairy tale narrators in the German-speaking region. I will limit my examination to the witch in fairy tales because of all the figures she seems to have the most impact on the audience.

La present recerca té com a objectiu l'estudi de la cacera de bruixes desenvolupada a Catalunya, des dels seus orígens a finals de l'època medieval fins a la seva articulació durant els primers temps moderns. La investigació aporta, en primer lloc, un volum considerable de documentació judicial inèdita dels segles XV i XVI, la qual constitueix la base imprescindible per a una aproximació global a aquest fenomen històric. A partir d'aquest material i de les fonts ja conegudes, l'anàlisi s'ha estructurat sobre tres eixos principals. Primerament, s'aborden els elements que donaren lloc a l'estereotip de la bruixa durant l'època baix-medieval. Seguidament, s'estudien les primeres caceres desenvolupades a Catalunya durant les primeres dècades del segle XV, tot comparant-les amb els esments coetanis a nivell europeu. Finalment, s'analitza en detall la documentació judicial inèdita per mirar d'entendre l'articulació de la cacera de bruixes a Catalunya durant els segles XV i XVI. La present investigació ha donat com a resultat la creació del primer corpus documental sobre els primers dos-cents anys de cacera de bruixes a Catalunya, evidenciant la riquesa documental del Principat per a l'estudi d'aquest fenomen. Així mateix, el treball ha permès arribar a una sèrie de conclusions sobre l'origen i articulació d'aquest fenomen a Catalunya en època medieval i moderna. En primer lloc, destaca la importància dels canvis operats a finals de l'època baix-medieval en referència a la teologia i a les noves reflexions demonològiques, la influència de l'acció inquisitorial contra el maleficium i la seva influència en les cúries laiques, o el discurs anti-supersticiós desplegat per la predicació baix-medieval. En segon lloc, la present recerca ha servit per constatar la precocitat, intensitat i duresa de la persecució de bruixes a Catalunya, un fet que remarca la seva singularitat en el context dels regnes hispànics. Aquesta situació aniria lligada a la pròpia situació político-jurídica del Principat, amb una forta autonomia de les autoritats locals i una manca de control per part d'institucions de justícia centralitzades, ja fos el Sant Ofici o la pròpia justícia reial. Catalunya seguiria així el model descrit per autors com Brian P. Levack, segons el qual aquells territoris amb un poder central fort i un sistema judicial centralitzat, haurien registrat una intensitat molt baixa de persecucions, amb una absència gairebé total de sentències a mort. Un model perfectament vàlid per al centralitzat i gairebé lliure de bruixes regne de Castella, i també, però just a l'inrevés, per al jurisdiccionalment fragmentat i ple de forques Principat de Catalunya. Finalment, l'última de les conclusions derivades d'aquesta investigació fa referència a la importància del marc local en l'articulació de la cacera, amb un protagonisme destacat d'unes autoritats locals sovint esperonades per la pròpia població. Aquesta constatació ens allunya de concepcions historiogràfiques que vinculaven tradicionalment la cacera de bruixes als mecanismes d'Estat o a l'impuls de l'Església post-tridentina, enfrontats a una suposada cultura popular. En canvi, en el cas català, la persecució seria majoritàriament instigada per la pròpia població en un context de desgràcies com ara epidèmies, maltempsades i morts d'infants o bestiar. Una persecució judicial, doncs, que aniria de baix a dalt, iniciada en les pròpies comunitats a partir d'acusacions de malefici o emmetzinament i desenvolupada en el marc de les cúries locals, amb una subversió evident de l'ordre del dret, un ús habitual del turment i una gran predisposició a emetre sentències de mort.
This research focuses on the Catalan witch-hunt, from its origins during the Late Middle Ages until its development during the Early Modern period. The research provides, in the first place, a considerable amount of unpublished witchcraft trials form the XVth and XVIth centuries, which becomes the basic ground for a global approach to this historical phenomenon. Through this material, together with the sources already known, we have structured the analysis around three main axes. First, we address the elements that formed the witch stereotype during the Late Middle Ages. Next, we study the firsts witch-hunts developed in Catalonia during the first decades of the fifteenth century, by also comparing them with other contemporary European sources. Finally, we analyze in detail the unpublished trials in the aim of understanding the articulation of the witch-hunts in Catalonia during the fifteenth and sixteenth centuries. The results of this work include the creation of a first documentary corpus for the first two-hundred years of witch-hunts in Catalonia, thus revealing the abundance of sources in the Principality for the study of this phenomenon. Also, the work provides some conclusions about the origins and the development of this phenomenon in medieval and modern Catalonia. First, we emphasize the importance of the changes operated at the end of the Late Middle Ages, concerning both theology and the new demonological debates, as well as the inquisitorial action against maleficium and its influence on secular courts, or the anti-superstitious discourse deployed by Late Medieval preachers. Second, this research also proves the precocity, intensity and harshness of the witch persecution in Catalonia, a fact that stresses the Catalan uniqueness in the context of the Hispanic kingdoms. This situation of the Principality is due to its own political and judiciary status, with a strong autonomy of local authorities and a lack of control by centralized judiciary institutions, either the Inquisition or the Royal justice. On that sense, Catalonia follows the model described by authors such as Brian P. Levack, according to which those areas with a strong central government and a centralized judicial system, would have experienced a very low intense persecution, and an almost total lack of death sentences. A model which is perfectly valid for the highly centralized and almost witch-free kingdom of Castile, and also, only in the opposite way, for the jurisdictionally fragmented and full of gallows Principality of Catalonia. Finally, the last conclusion resulting from this research points to the importance of the local context in the development of the witch-hunt, with a prominent role played by local authorities, often spurred by the population itself. This observations moves us away from traditional historiographical conceptions that linked the persecutions with the State mechanisms or the post-Tridentine Church, both faced with an alleged popular culture. Instead, in the Catalan case, prosecutions would be mostly instigated by the people in a context of disasters such as epidemics, bad weather and deaths of children or cattle. A persecution, then, that appears to be bottom-up, initiated among the communities from accusations of maleficium or poisoning and then articulated in the context of the local courts, with a clear subversion of the legal order, a current use of torture and an acute predisposition to issue death sentences.

Early Modern Professors of Law in the Holy Roman Empire were more than mere teachers. In judicial matters they were called upon to judge and speak justice / especially in witch-trials. This study focuses on bridging discourses of demonology as they were elaborated and taught at Protestant universities in Northern Germany with the social and cultural sphere of the professors. By coupling an intellectual approach to theories of witchcraft, the role of the Devil and demons, with micro-historical investigations into the social and cultural practices of professors engaged in theorising and judging witchcraft, this study renders a more complex and nuanced contribution to the history of the university, its epistemic culture as well as its impact on its surroundings. This study traces the academic discourses of demonology from the high-times of orthodox belief and persecution to that of scepticism and reform. It does so by focusing on the demonological argumentation and the scientific methods employed by Hermann Goehausen (1593-1632), Heinrich Bode (1652-1720), and Christian Thomasius (1655-1728). What comes to the fore is a system of beliefs that accommodated the Devil, demons and witches in compatible and consistent ways with other intellectual dealings until academic practices, including the rendering of legal decisions in witch-trials and new methods of scientific enquiry (the purging of Scholastic Aristotelianism in the context of the Early German Enlightenment) necessitated a reconsideration of the theoretical principles underpinning the theological, philosophical and political aspects of demonology.

Abstract:

This dissertation challenges depictions of witchcraft as a sensational or disruptive phenomenon, presenting witch beliefs instead as organically woven into everyday community life, religious beliefs, and village culture. It argues that witch beliefs were adaptive, normal, and rational in regions that never suffered convulsive witch persecutions. Furthermore, this dissertation, the first to work systematically through Spanish secular court witch trials, upends scholars’ views about the dominance of the Spanish Inquisition in witchcraft prosecutions. Through a serial study of secular court records, this dissertation reveals that the local court of Navarra poached dozens of witch trials from the Spanish Inquisition, and independently prosecuted over one hundred accused witches over one hundred-and-fifty years. These overlooked local sources document witch beliefs in far greater detail than Inquisition records and allow the first reconstruction of village-level witch beliefs in Spain. Drawing from historical, anthropological, and literary methods, this dissertation employs a transdisciplinary approach to examine the reports from villagers, parish priests, and jurists, produced under the specific local and older accusatorial judicial procedure. Free of the Inquisitorial filter that has dominated previous studies of Spanish witchcraft, these sources reveal the way villagers—not Inquisitors—conceived of, created, feared, and survived in a world with witches and sorceresses.

Using these local sources, this dissertation illuminates the complex social webs of witchcraft accusations, the pathways of village gossip, and the inner logic of witch beliefs. It reveals the central role of Catholic performativity and the grave consequences of being marked as a mala cristiana, the importance of fama and kin ties, and reveals the rationality of the curious and pervasive presence of the common toad (Bufo bufo) in Navarra’s witch trials. By moving away from the prevalent focus given to the more spectacular witch panics and trials, this work demonstrates the value of local trial records. This dissertation argues that far from irrational or absurd, witchcraft beliefs in early modern Navarra were internally coherent and intellectually informed by an amalgamation of religious, social, and legal forces.

In mid-January of 1691/2 two young girls in the household of Samuel Parris, the minister of Salem Village, Massachusetts, began exhibiting strange behavior. "It began in obscurity, with cautious experiments in fortune telling. Books on the subject had 'stolen' into the land; and all over New England, late in 1691, young people were being 'led away with little sorceries.'" The young girls of Salem Village had devised their own creation of a crystal ball using "the white of an egg suspended in a glass" and "in the glass there floated 'a specter in the likeness of a coffin.'"

Ce mémoire de maîtrise analyse les liens entre les premiers procès militaires alliés en Allemagne occupée et l’opinion publique allemande dans l’après-guerre immédiat. Notre mémoire de maîtrise, à travers la présentation de l’analyse du procès de Belsen, organisé par les forces d’occupation britanniques de septembre à novembre 1945, et du procès de Dachau, tenu par le gouvernement militaire américain entre novembre et décembre 1945, cherche à mettre en lumière l’importance que ces derniers revêtaient dans l’établissement de relations cordiales entre occupants et occupés. Ce mémoire démontre donc, par les exemples de Belsen et Dachau, que les procès se situaient à la croisée entre le besoin des Alliés d’établir des relations positives avec les Allemands et leurs programmes de dénazification et de rééducation. Nous remarquons ainsi que, des premières étapes dans l’organisation de ces tribunaux jusqu’à leur achèvement, les Alliés ont pris en considération les différentes réactions des Allemands face aux procédures judiciaires : d’abord, avec l’ancrage des accusations et des procédures judiciaires dans une législation internationale qui précédait le début de la guerre, puis avec l’autorisation d’une défense pour les accusés qui permettait aux Alliés de revendiquer une autorité morale sur leur zone d’occupation. Ce mémoire de maîtrise, en plus d’examiner les procès d’après-guerre et leurs objectifs, propose également une analyse de la couverture journalistique de ces tribunaux et des sondages d’opinion publique menés après les procédures judiciaires. Notre étude établit ainsi que la couverture journalistique des procès était, souvent, une des premières fois où les Allemands se trouvaient confrontés aux atrocités commises dans les camps de concentration nazis. Finalement, avec l’analyse des sondages d’opinion publique, nous argumentons que les procès, en tant qu’outil politique, ont eu un succès mitigé dans l’établissement de relations positives entre les forces d’occupation britanniques et américaines et les Allemands.
This masters’ thesis analyses the connections between the first allied military trials held in postwar Germany and German public opinion toward the British and American occupation forces. Focused on the Belsen trial, held in the British occupation zone from September to November 1945, and the Dachau trial, held by the American military government in the U.S. occupation zone between November and December 1945, this study seeks to highlight the importance both trials held for the British and the Americans in establishing positive relations with the Germans. Using Belsen and Dachau as case studies, it argues that, while they were essential to British and American denazification and re-education programs, they also had to be conducted in a manner that ensured the best possible relationship the German public and the occupation forces in both the American and British occupation zones. I demonstrate that, from the initial steps implemented to set up the trials through their conclusion, both powers took German concerns and reactions to the judiciary procedures into account: first by anchoring the charges and the trials themselves in international law preceding the Second World War; then by providing the right to a defense to the accused. Both factors, the Allies believed, allowed them to claim a moral authority over their occupation zone. The memoir’s examination of the trials and their purpose is complimented by an analysis of the press coverage of the trials and public opinion surveys taken after the trials. This study states that the press coverage was oftentimes one the first instances in which Germans were confronted to the atrocities committed in the concentration camps. Finally, this study argues that, as a part of larger programs, the trials had a limited success as a tool to implement positive relations between the British and American occupation forces and the German population.
