Abstract:
ABSTRACT The macaw palm [Acrocomia aculeata (Jacq.) Lood. ex Mart] has been domesticated to subsidize biodiesel production programs in Brazil. However, little is known about the seedling production of this species. This study aimed to evaluate substrate mixtures, limestone and phosphorus rates for substrate amendment and topdressing frequency in macaw palm seedlings. Three trials were conducted in a greenhouse up to six months of nursery cultivation. Trial 1: determination of percent mineral and organic fractions of seven substrate mixtures. Trial 2: evaluation of four limerates for soil amendment versus four phosphorus rates. Trial 3: evaluation of N, K and Mg topdressing frequency. Significant differences were found in the three trials for most of the variables (plant height, leaf number, shoot dry mass, root dry mass, vigor and bulb diameter). The main results obtained were as follow: Trial1 - the best seedling growth was observed in substrates with at least 25% organic matter. Trial2 -lime rates ranging from 0.50 to 1.25 kg associated with 3 to 4 kg of single superphosphate per m3 of substrate provided the best seedling growth. Trial 3 - topdressing fertilization provided better development of seedlings regardless of frequency.

Abstract:
This study aimed to determine the effect of a commercial diet's protein level on the fry-to-fingerling stage. Thirty days-old fries having the initial length and weight of 18.25 ± 0.15 mm fish-1 and 0.036 ± 0.50 g fish-1 respectively have been used in this study. Diet having three protein levels i.e. 30% (trial 1 as control), 35% (trial 2), 40% (trial 3), and 45% (trial 4), respectively, have been used to evaluate the effect of protein, and each trial has been repeated three times. During the study, stocking density was allocated to 1000 fish per composite tank with a volume of 1 m3. After 30 days of rearing, the weight of fingerlings in trial 1 reached up to 1.50 ± 0.02 g fish-1 and it was recorded as 1.52 ± 0.01g for trial 2, these two were lower than that of trials 3 and 4, where fingerling weight was reported 1.69 ± 0.01 and 1.58g fish-1 respectively and obtained the best weight compared to others. The length of fingerlings at the end of the experimental period was also changed in different trials and it was recorded 47.12; 46.92; 50.97; and 48.89 mm fish-1 for trail 1, 2, 3, and 4 respectively, among the tested combinations lower fingerlings length was recorded for trial 2 (35% CP), but it is not significantly different for trial 1 and 2 and a significant difference (P < 0.05) was reported for trail 2, 3, and 4. The survival rate of fingerlings ranged from 67.27 to 72.33%. Meanwhile, the herd distribution coefficient variation (CVW) in the treatment using 40% protein (trial 3) was the highest at 72.33% (p < 0.05). The results of the study can be concluded that the level of protein has a significant effect on the various growth parameters of fingerlings.

Abstract:
Information processing speed (Reaction time, RT) to a single administration of the Trails A and Trails B components of the Trail Making Test (TMT) is used in the assessment of brain and behavioural functional integrity across the lifespan in both clinical and research contexts. Although the clinical utility of such single trial-related and thus rapidly gained results, is recognised, it is possible that its administration as a single trial only, precludes its ability to provide a more in-depth and thus relevant representation of functional integrity per se, and it does not allow a range of ability to be examined. Because outcome from a single trial can be susceptible to the influence of spurious and extraneous effects we examined how, within a single testing session, RT varied with respect to the administration of four trials of both Trails A and B of the TMT, and how the effects may be associated with anxiety and self-consciousness. We examined how RT varied with respect to the administration of four trials of the Trail making test and compared the performance over each of these trials with that of the first trial. Between the third and fourth trial, questionnaires on anxiety and self-consciousness were administered. This paradigm was tested with fifty five younger adults (age range eighteen - thirty years). Our results indicated that repeating both Trails A and B of the TMT, administering the tests over four trials, revealed a significantly disproportionately slowed information processing speed (RT) to the first compared to consecutive trials, with the effect greatest for the more difficult or resource-demanding Trails B test. There were no significant correlations between change in information processing speed and anxiety or self-consciousness. The first of the four trials represents the only trial typically performed in the clinical application of this test. Our finding that the time to complete one single trial can be significantly slower compared to the response to additional trials, indicates that an individuals’ information processing speed can appear much slower than their actual ability. Such findings can be expected to be of particular relevance to the future use of this test clinically when an individual’s performance is measured and judged with respect to possible diagnosis, and in future research when group-level TMT performance is compared between younger and older adults for example.

The objective of this thesis is to study the challenges of data sharing in healthcare (namely clinical trials), and propose the use of Open Algorithms (OPAL) as a viable solution for research collaboration that allows for access to data without compromising data ownership (data is only used once for the intended purpose, raw data is never leaked, the value generated from the data is transferred to the owner). This thesis surveys the challenges unique to clinical trials, and highlights the various methods for privacy-preserving computation prior to this work. Through the overview of OPAL's solution in the space of privacy-preserving computation, we show the implementation details of how OPAL was applied to clinical trials in a project called Open Trial Chain, a platform for clinical trial data built for analytics, security, and incentivized sharing through technologies like federated learning and blockchain. With motivated examples derived from real-world reported problems in healthcare, we also demonstrate speed, accuracy, and security metrics. In the application, Open Trial Chain can drastically reduce clinical trial costs, reduce error, and increase quality of analysis diversity. Overall, this project shows promise for further extension in other health datasets for compliance in an ever-complicated move towards regulations that reflect for conscientiousness for data security, ownership, and provenance.

Julian, Robert F. "The role of the judge and jury in complex trials." Thesis, Queen Mary, University of London, 2008. http://qmro.qmul.ac.uk/xmlui/handle/123456789/28172.

Full text
Abstract:
This thesis examines the mode of trial concerns in the U.S.A., New York State, California, England and Wales and Canada --specifically the ability of the jury to comprehend complex cases and the perception/reality that bench trials may not be as fair as jury trials. Defining complex cases as those involving serious fraud indictments, capital murder trials, and lawsuits or indictments against corporations and their managers, the thesis examines problems associated with jury trials in such cases. It evaluates the comparative law and customs and practices regarding the use of juries, emphasizing problems with jury selection, deficits in jury deliberation and post trial problems associated with jury verdicts. The thesis also evaluates the judge only trial, attempting to determine whether a state imposed non jury trial in a criminal case as is presently proposed in the England and Wales Parliament creates an unfairness to the defendant because bench trials significantly differ from jury trials in the application of the rules of evidence and in the role of the judge. The thesis reports on the results of a survey of New York State trial judges, a like survey of New York State lawyers, and the opinions of nine England and Wales judges authorized to try serious fraud cases who were interviewed regarding these issues. The surveys and interviews finds that there is a high degree of support for jury verdicts expressed by the judges, examines evidentiary and pretrial practices in both modes of trial and attempts to evaluate whether claims of procedural flaws and prejudice in bench trials by respected academics are accurate. The thesis concludes by affirming the competence of juries to try complex cases, proposing modifications to post jury verdict procedures to evaluate jury misconduct and advocating that the bench trial evidentiary rules and conduct rules become comparable to the jury trial. The thesis recommends that mode of trial choices be given to the defendant, advocates that when a bench trial is selected that peremptory challenges of the trial judge be permitted and postulates that these reforms will make the bench trial a more attractive alternative to the jury trial in complex cases.

Abstract:
Complex data are frequently recored in recent clinical trials and require the use of appropriate statistical methods. HIV vaccine research is an example of a domaine with complex data and a lack of validated endpoints for early-stage clinical trials. This thesis concerns methodological research with regards to the design and analysis aspects of HIV vaccine trials, in particular the definition of immunogenicity endpoints and phase I-II trial designs. Using cytokine multiplex data, we illustrate the methodological aspects specific to a given assay technique. We then propose endpoint definitions and statistical methods appropriate for the analysis of multidimensional immunogenicity data. We show in particular the value of non-parametric multivariate scores, which allow for summarizing information across different immunogenicity markers and for making statistical comparisons between and within groups. In the aim of contributing to the design of new vaccine trials, we present the construction of an optimized early-stage HIV vaccine design. Combining phase I and II assessments, the proposed design allows for accelerating the clinical development of several vaccine strategies in parallel. The integration of a stopping rule is proposed from both a frequentist and a Bayesian perspective. The methods advocated in this thesis are transposable to other research domains with complex data, such as imaging data or trials of other immune therapies

Abstract:
Magister Legum - LLM
News coverage of high profile criminal matters has increased in South Africa. Such matters are of public concern, as every citizen has a right to receive and impart information and to debate openly and frankly matters which are of public concern, including matters before the courts. The legitimacy of the courts is dependent on robust media reportage and public scrutiny of judicial matters which such reportage stimulates. However, criminal trials of high profile accused persons such as Oscar Pistorius, Shrien Dewani and J Arthur Brown, turn easily into a show with strong entertainment value, giving the media strong profitmaking reasons to cover it. In their pursuit of profit and in seeking to satisfy the curiosity of their readers, listeners or viewers, the media regularly resort to trial by media or adverse pre-trial publicity. Trial by media is nothing more than commercially motivated expression which does not warrant constitutional protection. At the receiving end of such coverage are accused persons. Public censure of crime and of accused persons which follows trial by media should not be imposed on the innocent. The right to a fair trial requires that an accused be treated fairly from the inception of the criminal process, from which point the person suspected of committing the crime in question is considered innocent. Any pre-trial process which implies that the accused is guilty, including any such process influenced by media reports surrounding criminal offences, violates the presumption of innocence. Despite the availability of remedies, the media in South Africa usually are not held to account for their actions and persist with adverse, biased and irresponsible pre-trial reporting. Courts have shown a tendency to protect the media in these cases, despite the effect of such reporting on the judicial process, the administration of justice and the fair trial rights of accused persons. The reason for this is usually the hesitation on the part of judges to recognise their susceptibility to extraneous matters. Judges should not be placed in a position where their independence and impartiality are questioned as a result of media sensationalism. Where the media create mistrust in the integrity of the judiciary, the rule of law is in peril.

Ostler, Megan Jane. "The Triad Trial: Online Education for Coaches on the Prevention of the Female Athlete Triad." DigitalCommons@USU, 2014. https://digitalcommons.usu.edu/etd/3565.

Full text
Abstract:
High school coaches play a huge role in establishing a healthy environment for their athletes and often students. The coach-°©‐athlete relationship has proven to be a strong and useful bond in prevention of adverse behaviors of athletes or in prevention of health problems such as concussions. The female athlete triad (triad) is a common health problem among female athletes. Many high school coaches are unaware of the triad or the serious health and performance consequences for their athletes. The triad is a syndrome marked by 3 interrelated adverse effects: decreased energy availability, menstrual dysfunction, and decreased bone mineral density. The Purpose of this study was to develop an online educational resource aimed at educating coaches about the triad. After the online education materials were created and reviewed by small panel groups, the materials were launched online and available to the public with the aim to target high school coaches. We collected online surveys from 90 participants including coaches and parents of high school female athletes and found a lack of knowledge, attitudes, and confidence in preventing the triad. By educating coaches and providing the tools for prevention, we hypothesize that coaches can play a large role in the prevention of the triad among high school athletes and help to keep our student athletes healthy and performing well in school and sports.

Abstract:
AbstractThe pretrial preparation and trial will commence after appropriate service of the court documents on all parties. Ordinary procedure, summary procedure and special procedure are three concepts of parallel standing in the CPL. Except for cases under the summary procedure and the special procedure, all the other cases are tried under the ordinary procedure, which is the basis of all procedures and covers all necessary steps stipulated by the CPL. Our introduction will firstly be based on the ordinary procedure as well. (1) After serving court documents on all parties, the court needs to wait at least 30 days (or 45 days if the defendant is a foreign party without domicile in China) for the defendant to submit statement of defense and evidence. After that, the court can arrange a pretrial conference or a court hearing. There is no specific provision on the process and content of the pretrial conference, and in practice, the pretrial conference may proceed as an ordinary court hearing. Therefore, we advise that the parties try to figure out the process and content of the pretrial conference, and even make proper preparations with reference to the requirements of the ordinary court hearing. (2) In China, the steps of a court hearing generally include: court-conducted investigation, debates in court, closing argument and mediation. Among them, court-conducted investigation and debates in court are the core steps of court trial. To avoid unnecessary repetition and improve trial efficiency, Chinese courts sometimes combine these two steps together. During the Chinese court trial, we should pay attention to the following points: Firstly, judges are not passive listeners, but the leaders and controllers of all trial activities. Secondly, judges generally care more about the fact finding than the opinions of the parties on the law application. Thirdly, Chinese courts attach importance to the trial efficiency, and therefore the parties need to express their opinions as concisely as possible. Fourthly, the court trial may be made publicly available on the Internet; some court trials are also conducted online. (3) After finishing court hearing, the court will make the first-instance judgment and serve it on the parties through legal means to complete the rendering thereof. The parties may appeal within 15 days (or 30 days, if the appellant is a foreign party without domicile in China) and initiate the second-instance procedure. (4) Generally speaking, the trial process of second instance is not so different from that of first instance. The second-instance judgment is the effective final judgment. Under certain circumstances, the second-instance court may also remand the case to the first-instance court for retrial. (5) The trial time limit of first-instance cases under ordinary procedure is 6 months, and can be extended twice up to 15 months. The trial time limit of second-instance cases is 3 months, and can be extended once up to 6 months. But it is sometimes difficult for Chinese courts to close the case within the statutory trial time limit due to the litigation explosion. (6) In addition to the ordinary procedure, Chinese courts will try cases with little dispute and simple legal relations through the summary procedure. Cases under summary procedure are tried by one judge only, with shorter trial period and more flexible and simpler trial procedures. The summary procedure is applicable to most cases accepted by Chinese courts. However, the summary procedure is not frequently applied to foreign-related cases in China. (7) For money-judgment cases with a disputed amount below a certain standard, the trial procedure thereof will be further simplified and referred to as “Small Claims Procedure”. The first instance of such cases is final, and no appeal is allowed. However, the small claims procedure is not applicable to foreign-related cases. (8) At last, all civil cases in China can be divided into two categories: foreign-related cases and non-foreign-related cases. Foreign-related cases refer to cases with foreign elements, including cases where one of the litigants is a foreigner or a foreign organization, etc. There are special rules for the trial of foreign-related cases under the Chinese legal system, mainly to protect the litigious rights of foreign parties. However, it is worth noting that if the parties submit a non-foreign-related case to a foreign court or arbitration institution, it is highly likely that Chinese courts may refuse to recognize and enforce the judgment/award so rendered. This is one of the reasons why we have to distinguish foreign-related cases from non-foreign-related cases.

Xing, Jasmine, and Ang Li. "Enhancing Clinical Trial Access and Diversity: An Innovative App for Personalized Trial Recommendations and Equitable Healthcare Participation." In 10th International Conference on Artificial Intelligence & Applications. Academy & Industry Research Collaboration Center, 2023. http://dx.doi.org/10.5121/csit.2023.131906.

Full text
Abstract:
This project focuses on creating an app to recommend clinical trials to users based on their profiles, improving access and diversity in trial participation. It addresses disparities in trial representation and aims to provide easy access to trial information. The app utilizes web scraping, a recommendation system, and a saving mechanism for trials. An experiment evaluates the recommendation system's accuracy, highlighting the challenges of ethnicity clustering. The app aims to promote equitable healthcare access and expand participation in clinical trials. Shortcomings of existing solutions include limited scope, such as being specific to cancer trials or certain patient groups. In contrast, the app aims to provide recommendations for a broader range of diseases and profiles, improving accessibility and diversity. Future improvements include refining the recommendation model, increasing the number of clusters, adding location-based recommendations, and expanding the trial database. The ultimate goal is to enhance the diversity of trial participants and improve healthcare equity.

Abstract:
The traditional balancing methods using trial or calibration weights are quite effective, yet too many trials may result in a lengthy balancing process. It had been suggested in the literature that it is possible to balance flexible rotors without the use of trial weights, if a rotor model is available. A procedure is developed in this paper to balance flexible rotors using complex modes and complex vibration measurements. It is shown that a complex rotor model is essential for the success of the technique. Moreover, careful calibration of the rotor model is the major cornerstone of the procedure. Experimental results illustrate the success of the procedure.

Abstract:
A Deep Sea Cruising AUV “URASHIMA” has been developed by JAMSTEC since 1998. The dimensions and weight are 10m (L), 1.3m (W), 1.5m (H), and about 7.5 tons in air. A main power source device system of AUV “URASHIMA” is a large capacity of lithium-ion (Li-ion) rechargeable battery system or Solid Polymer Electrolyte Fuel Cell (PEFC) system. AUV “URASHIMA” will be able to cruise for about 100km with Li-ion battery system and it will cruise for about 300km with fuel cell system. The cruising trial used by the fuel cell system will start at the end of 2002. The instruments for science researches are an automatic multi-water-sampling system, a CTDO, a side-scan sonar, a digital still camera with a thermoelectrically cooled CCD image sensor, a TV camera, and so on. Three operation modes, which are UROV mode, acoustic remote control mode and autonomous mode, are available. Those three kinds of modes are used acceding to each development stage and ocean researches. UROV mode is to monitor the state of the vehicle with fiber optics. At the first development stage of AUV “URASHIMA”, we carried out long cruising trial for about 100km and maximum operational depth trial at 3,500m used by Li-ion rechargeable battery system. URASHIMA was succeeded to reach at 3,518m depth of the seafloor at the sea trial of August 2001. We also carried out long cruising trial that was controlled by autonomous mode. Then, URASHIMA was cruised 70km distance at the sea trial of December 2001. We will have a next sea trail on May 2002 for 100km long cruising test. At the next development stage, we will carried out long cruising trial for 300km used by the fuel cell system.
