Abstract:
This chapter is devoted to cross-border principles. It begins with an examination of two sets of opposing principles: unity of proceedings versus plurality and universality or territoriality in the administration of the debtor's assets in insolvency. This is followed by an examination of two major instruments: the widely adopted 1997 UNCITRAL Model Law on Cross-Border Insolvency and the EU Insolvency Regulation (recast), approved in 2015 and incorporating numerous significant changes to the former EC Regulation. The Model Law is concerned with recognition of foreign insolvency proceedings, carrying with it an automatic stay of local proceedings, and the status of foreign administrators and duties of co-operation with foreign courts and foreign administrators. The EU Insolvency Regulation (recast) is primarily a conflict of laws regulation governing jurisdiction and the law applicable to insolvency matters.

Abstract:
This chapter explains principles of the res judicata doctrine for international commercial arbitral tribunals based on transnational law. There are two main values that transnational litigation upholds in determining the scope of the preclusive effects of a prior judgment in one country and the subsequent proceedings in another country. First, a judgment must be accepted in the recognising state with the original effects it would have in the state in which it was first rendered. Thus, the law of the country, where the first judgment was rendered, will determine the judgment’s preclusive effects in the subsequent proceedings. Second, the application of the law of the rendering state should preserve the integrity of the rendering state’s judicial system and that state’s resources.

Abstract:
Proceeding from autobiography, this chapter analyses the multiple dimensions that influenced the formation of the Church of South India. Such a post-Anglican ecumenical movement was prompted by drawing away from the receding shadow of the British Empire and moving towards other native communities emerging at the dawn of Indian Independence. Against this backdrop, the chapter examines the current realignments taking place within the Anglican Communion. The emergence of ‘transnational compactism’, in which collaborations are pursued with like-minded churches, are not the same as previous movements of ecumenism. What then are the directions open for the Anglican Communion? ‘Cosmo-transAnglicanism’ is offered as a model. Constructively working with Christology, a re-appropriation of Christ as the reconciling and compassionate One, is put forward as a challenge to both the Uniting Churches and the not-so-united churches within the Anglican Communion.

Abstract:
Materials scientists from Ústí nad Labem and Dresden met in June of 2022 for the first joint PhD Conference on Material Science, with the special focus on biologization, nanotechnology and simulation. The conference aimed to encourage interdisciplinary exchange between Čzech and German research institutes and promote transnational cooperation on an international level along the Saxon- Čzech border. Due to the restrictions caused by the corona pandemic, several attempts were necessary before the conference, which was first planned in 2020, could finally take place for the first time in 2022. The conference could take place in presence, which was seen as a big plus by all participants, especially as it was the first meeting in this German - Čzech context for most of the participants. The attending scientists (about 60) met at the Institute of Material Science of TU Dresden in Germany for the first half of the week before the conference moved to the faculties of Science and Environment of the Jan Evangelista Purkyně University UJEP in Ústí nad Labem in Čzechia. The organized activities ranged from scientific presentations of current PhD projects and research topics, lab tours in the participating institutions, come-together events such as a guided tour at the dye collection of the TU Dresden and a hiking trip to Bohemian Switzerland. The conference was funded by INTERREG VA Saxony - Čzech Republic - a cooperation programme of the Elbe/Labe region. All participants - PhD students, scientists and staff members of the participating institutions - enjoyed this opportunity to build individual and new contacts, exchange information on current research topics and methods, find starting points for future collaborations between the different research areas and institutions and also discuss the similarities and differences between the German and Čzech research landscape. The purpose of this brochure is to present the institutions with their special topics and laboratories and to present current research topics - on the base of the presented PhD projects.

Abstract:
This commentary focuses on Article 1.4, which clarifies the relationship between the UNIDROIT Principles of International Commercial Contracts (PICC) and mandatory rules originating from sources external to the PICC. Mandatory rules are rules which cannot be derogated from by the parties, and are therefore mandatory for them. The typical rationale for making certain rules mandatory is to protect weaker parties or the public interest. Mandatory rules can be of two kinds: domestic mandatory rules and international mandatory rules. Art 1.4 covers relevant rules of private international law, choice of law rules applicable in court proceedings, arbitral tribunals, and origin of mandatory rules. It also discusses the applicability of the PICC to international contracts that include an arbitration clause, along with the application of mandatory rules by arbitral tribunals in relation to the doctrine of transnational public policy.
