This chapter discusses Article 9 of the ATT, which covers the regulation of each state party of the transit and trans-shipment of conventional arms through its territory. The obligation does not extend to ammunition/munitions or parts and components. The inclusion of specific obligations with respect to transit and trans-shipment reflects the need to ensure that all activities that form part of international arms transfers are regulated in order for the object and purpose of the ATT to be achieved in practice. The obligation in Article 9 is heavily qualified in recognition of the practical and legal issues that limit the ability—and capacity—of states to regulate and control goods in transit. State parties also have an obligation to prevent diversion of such arms, to co-operate and exchange information to mitigate any detected risk of diversion, and to take action to address any diversion detected.

Chapter 4 classifies treaty obligations concerning transit with a view to determining which state is injured under the law of international responsibility and can invoke responsibility including by recourse to countermeasures against the responsible transit state. The question posed is to whom is each obligation owed. The analysis in this chapter also assists in determining which treaty party may have recourse to means available in the treaty where the treaty does not contain sufficiently express rules on standing, a matter which is analysed in Chapter 6. The analysis illustrates the polyphony of primary rules vis-à-vis their nature, and argues that bilateralism is not the only model in this area of international law (either in form or in substance). Rather, a number of treaties create collectively owed obligations: some erga omnes partes and some interdependent..

What does it mean for someone to be ‘trans’? What are the implications of this for healthcare provision? Drawing on the findings of an extensive research project, this book addresses urgent challenges and debates in trans health. It interweaves patient voices with social theory and autobiography, offering an innovative look at how shifting language, patient mistrust, waiting lists and professional power shape clinical encounters, and exploring what a better future might look like for trans patients. These book aims to uncover how trans identities and experiences, along with conceptualisations of trans health, are understood in multiple contexts. The purpose is to grasp the social processes at play in encounters where trans patients feel marginalised, misunderstood, and/or discriminated against.

This chapter proposes an understanding of trans-Pacific Chinese literature not as yet another uncritical expansion of the territory of Chinese literature, but as an examination of the relationship between Chinese-language literature and the trans-Pacific world(s) it makes, as well as that between the literature and the real worlds of the Pacific societies it touches. Whereas “Asia Pacific” as a regional concept is inseparable from Euro-American expansions in the region, trans-Pacific Chinese literature does not necessarily reproduce this dominant regional thinking. Through reading narratives of the Cold War written in different locations of the Asia Pacific, this chapter shows that thinking comparatively about Chinese literature from disparate locations of the Asia Pacific can engender alternative regional imagination.

Over the past few decades, a few thousand international investment agreements have been concluded. One cornerstone of those treaties has been a straightforward model of foreign investment: an investor based in a home state that has made an investment located in the territory of a host state. Under that model, treaty protections operate reciprocally, protecting the investments of each treaty party’s nationals made in the territory of another treaty party. That model, however, often does not capture current economic reality. Foreign investments by multinational enterprises routinely involve multiple jurisdictions in which inputs are traded and through which capital is channeled. The reliance by multinational enterprises on international production networks and transit investment has challenged the reciprocal foundation of investment treaties. This chapter responds to that risk by developing strategies for policymakers and decision makers to preserve the reciprocal foundation of investment treaties in a twenty-first-century global economy.

What does ritual do? Sociological and anthropological theory of the first half of the twentieth century proposes that ritual—secular or sacred—binds groups together, ensuring their harmonious functioning by generating and maintaining orders of meaning, purpose, and value. ‘Ritual and society’ discusses the theories of Emile Durkheim, Roy Rappaport, and Clifford Geetz and their ideas on ritual producing solidarity and effervescence and ritual's role in politics, power, and negotiation. In the 1970s, a sea change in ritual studies followed the work of Victor Turner and others who highlighted ritual's critical and creative potential. Public ritual is complex: rites can conserve, transmit, and protect tradition, but others are creatively, critically, strategically employed to enact change.

The tsetse fly is a pan-African insect that bites an infective forest animal and ingests blood filled with invisible parasites, which it carries and transmits into cattle and people as it bites them, leading to n'gana (animal trypanosomiasis) and sleeping sickness. This book examines how the presence of the tsetse fly turned the forests of Zimbabwe and southern Africa into an open laboratory where African knowledge formed the basis of colonial tsetse control policies. The book traces the pestiferous work that an indefatigable, mobile insect does through its movements, and the work done by humans to control it. The book restores the central role not just of African labor but of African intellect in the production of knowledge about the tsetse fly. It describes how European colonizers built on and beyond this knowledge toward destructive and toxic methods, including cutting down entire forests, forced “prophylactic” resettlement, massive destruction of wild animals, and extensive spraying of organochlorine pesticides. Throughout, the book uses African terms to describe the African experience, taking vernacular concepts as starting points in writing a narrative of ruzivo (knowledge) rather than viewing Africa through foreign keywords.

Greek demonstrates both a change from inner (Aktionsart) into outer (grammatical) aspect as well as a change from demonstratives into definite articles, as does English. Even though aspect and definiteness are connected with Case, we argue that the tendencies in Greek with regard to the Case system differ in several aspects from the development of the Case system in English. We consider changes in the Case system of Greek in relation to syntactic properties of the clause, and in particular the realization of +/-interpretable features in inner and outer aspect. We argue that the change that takes place in the history of Greek involves a transitional stage in Ancient Greek where the relevant features can appear on the Trans[itivity] head (outer aspect) or the (inner) Asp[ect] head. The completion of the change in Post-Koine Greek involves the loss of the interpretable feature on Asp; thus Case remains (uninterpretable) on the higher Trans head.

Chapter 41 concerns unilateral mistakes. A unilateral mistake is a transient mental blunder that results from an error in the mechanics of an actor’s mental machinery, such as incorrectly adding a column of figures. Mistakes of these kinds are referred to in this book as mechanical errors. Mechanical errors differ from evaluative mistakes in several critical respects. For one thing, unlike evaluative mistakes the prospect that a counterparty will make a mechanical error normally is not a risk that is bargained for. And unlike evaluative mistakes, relief for mechanical errors would not undermine the very idea of promise: A promisor who seeks relief on the ground of a mechanical error does not assert that all things considered she doesn’t wish to perform. Rather, she asserts that she has a morally acceptable excuse that is well within the systemics of promise.

A referida obra é composta por 13 artigos articulados na discussão sobre educação intercultural, letramento e experiência em formação docente. Oferece ao leitor, a cada conclusão dos artigos, reflexões e questionamentos sobre as temáticas abordadas. Os contextos apresentados transitam em diversos âmbitos de ensinoaprendizagem no ensino básico e superior e em distintos contextos interculturais. O livro está organizado em duas partes principais: educação intercultural letramentos. Na primeira parte, os autores discutem sobre educação intercultural e formação docente para a diversidade, tendo em vista alguns entreves encontrados por alunos e alunas indígenas em diferentes âmbitos de ensinos constituídos sob uma ótica hegemônica e ocidental. Na segunda parte, os autores discutem as experiências de letramento voltadas para o contexto de ensino intercultural, bem como as práticas de letramento de resistência em um conjunto de contextos minoritarizados.

Near the turn of the 21st century, as more physicians began performing the Epley and Semont maneuvers for treatment of benign paroxysmal positional vertigo (BPPV), it became apparent that the procedures could be done at the time of initial examination without the need for sedation or vibration. Furthermore, modified versions of the maneuvers evolved that were more effective and easier to perform. There are clear similarities in these modified repositioning maneuvers. BPPV nearly always results from otoconial debris within the posterior semicircular canal because this is the canal in which it is most easily trapped. Although less common, there are horizontal and anterior semicircular canal variants of BPPV, and otolithic debris can become attached to the cupula, producing a true cupulolithiasis. The nystagmus is in the plane of the affected canal; the nystagmus is transient when the debris is freely floating and persistent when debris is attached to the cupula.

Creating, inviting, and repurposing sacrality was a fundamental quest of social behaviour in the medieval period. From the major shrines of cathedrals down to the portable sanctity of amulets, the pursuit of sacredness affected the everyday lives of Christian believers, helping to fashion memories and create heirlooms. Drawing on history, art history, anthropology, and folklore under the broad umbrella of material culture, this contribution takes a socially informed and trans-disciplinary approach to archaeology and seeks a holistic interpretation of the medieval past, one that does not neglect the intangible. This contribution seeks to underline the value of recent, new perspectives in this area and to broaden their application. Three overlapping themes are considered: relics, places, and mobility.

Maximal oxygen uptake ( V O 2 · max), the highest rate at which an individual can consume O2 during exercise, is widely recognized as the best single measure of adults’ aerobic fitness.1,2 Maximal V O 2 · ultimately limits an individual’s capacity to perform aerobic exercise but it does not describe fully all aspects of aerobic fitness. The transient kinetics of V O 2 · best reflect the integrated response of the O2 delivery system and the metabolic requirements of the exercising muscle to rapid changes in exercise intensity. Furthermore, V O 2 · max is not the best index of an individual’s ability to sustain submaximal aerobic exercise and despite its derivation from anaerobic metabolism, measures of blood lactate accumulation during submaximal exercise provide useful indicators of aerobic fitness.As the assessment of V O 2 · kinetics is addressed in Chapter 22, in this chapter, we will focus on the assessment of V O 2 · max and blood lactate accumulation.

The genesis of these poems links them to places as diverse as Horse Lake and Zigzag Creek, Oregon, sometimes in quest for monsters such as the mythic Ogopogo in Lake Okanagan in the same part of America. Klan Country may be less unspoilt and scenic than the above-mentioned Oregonian sites, but is part of a Trans American journey, and such places as Mala Ivanča, Serbia, Ahwaz, Iran or Mt. Fujimidai, Japan, although scattered over the globe, coexist in John Quinn’s “chronotopic poetic imaginary,” as it were. The poet has shared his poems with us, but he has also challenged us to explore remote places on our own, once the reading of these poems is done. He invites us to explore the wilderness and its wildlife, in addition to his poetic vision.

Free trade is always under attack, more than ever in recent years. The imposition of numerous U.S. tariffs in 2018, and the retaliation those tariffs have drawn, has thrust trade issues to the top of the policy agenda. Critics contend that free trade brings economic pain, including plant closings and worker layoffs, and that trade agreements serve corporate interests, undercut domestic environmental regulations, and erode national sovereignty. Why are global trade and agreements such as the Trans-Pacific Partnership so controversial? Does free trade deserve its bad reputation? This book aside the misconceptions that run rampant in the debate over trade and gives readers a clear understanding of the issues involved. In its fifth edition, the book has been updated to address the sweeping new policy developments under the Trump administration and the latest research on the impact of trade.

The records of the sharīʿah court in Abéché in eastern Chad span the twentieth century. While the legal notion of property used by the court is Islamic and thus not seen to be problematic, the content of the property relations is fluid, and difficult to fix over time. In an inherently mobile society, and one that has long been open to trans-regional exchange, this is done through reliance on guarantors and witnesses. Property thus emerges as an inherently relational and unstable category; and while in Western legal systems, legal philosophers agonise about the individual ‘state of mind’ that defines property transactions, these questions are here a matter of public opinion. Suretyship and the preponderance of property as a precondition for moral personhood might hide a nuanced approach to the notion of ‘authority’, giving us insights into the peculiar functioning of the Chadian state (and similar political formations elsewhere).

The Trans-Pacific Partnership Agreement (TPPA) is an economic partnership pact negotiated by 12 countries in three continents, namely Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, United States and Vietnam. The TPPA has evolved into the Comprehensive and Progressive Agreement for Trans Pacific Partnership (CPTPP), when the United States pulled out from the multilateral free trade deal in 2018. Malaysia began negotiations on the TPPA in August 2010, and participated as a full negotiating member from October 2010 onwards.The TPPA itself was based on the United States-Korea Free Trade Agreement (KORUS), which was completed in 2011. This agreement provided a benchmark to decide and evaluate on several issues in the CPTPP. The overall intent of the CPTPP is a simple one: it is to extend non-discriminatory practices to all CPTPP members. This does not mean that regulations and restrictions will not exist that such regulations will apply equally to Malaysian and non-Malaysian CPTPP members. Contentious issues in the CPTPP will be analyse and discuss in this book. Is the Malaysian economy ready for the CPTPP rules especially in the financial and capital markets? To what extent that Bank Negaras ability to retain their power to intervene when either the balance of payments or the currency is felt to be under threat with CPTPP? What are the impacts of CPTPP to the real economic side of the Malaysian economy? Will national rights are being relinquished under CPTPP? How about the concern over investor-state dispute settlement (ISDS)? This book will address these issues in an objective and rational manner.

Peak V · O 2 limits the child’s capacity to perform aerobic exercise but it does not describe fully all aspects of aerobic fitness. Exercise of the intensity and duration required to elicit peak V · O 2 is rarely experienced by many young people.17,18 The vast majority ofhabitual physical activity is submaximal and of short duration and, under these circumstances, it is the transient kinetics of V · O 2 which reflect the integrated response of the oxygen delivery system and the metabolic requirements of the exercising muscle.19–21 Furthermore, peak V · O 2 is neither the best measure of a child’s ability to sustain submaximal aerobic exercise nor the most sensitive means to detect improvements in aerobic fitness after a training programme. Despite its origins in anaerobic metabolism, blood lactate accumulation is a valuable indicator of aerobic fitness and it can be used to monitor improvements in muscle oxidative capacity with exercise training in the absence of changes in peak V · O 2 .16,22 However, as V · O 2 kinetics is comprehensively reviewed in Chapter 22 and blood lactate accumulation during exercise is analysed in Chapter 8, we will focus herein on aerobic fitness as described by peak V · O 2 .

This is the first book-length study of Caribbean slavery to make disability its primary focus. The book sets out to answer the following questions: How does colonialism—specifically slavery—challenge the way we think about histories of disability, race, and labor? In what ways might slavery and the expansion of the slave trade have transformed English understandings of supposedly defective bodies and minds in the metropole and colonies? How did disability, disfigurement, and deformity among the enslaved—whether transient, permanent, natural, or inflicted—influence English understandings of race and ability in the colonial period? How did slavery-induced disability shape the embodied reality of enslavement in the British Caribbean? The analysis of disability in the context of Atlantic world slavery is threefold. First, it explores representations of disability as they connect with enslavement and the development of an English antiblack racism from the sixteenth to the eighteenth century. Second, it moves between the realms of representation and reality in order to examine the embodied, physical, emotional, and psychological impairments produced by the institution of slavery and endured by the enslaved. Third, it examines slave law as an institutionally driven system of enforced disablement. This book illustrates that the histories of disability and slavery overlap in significant ways, and second, that Caribbean bondspeople form an integral part of wider disability history.

Muchos argentinos abandonaron el país por razones políticas, forzados por la violencia desplegada por el terrorismo de Estado en la Argentina durante el tercer peronismo y, especialmente, en la dictadura cívico-militar de 1976 a 1983. El exilio formó parte de las violaciones a los derechos humanos tal como la persecución, detención, tortura sistematizada, apropiación de niños y desaparición forzada de personas. México fue uno de los principales países receptores de las familias exiliadas y allí los hijos debieron transitar entre las dos culturas. En este libro nos centramos en las relaciones entre arte, memoria y exilio a partir de un conjunto de producciones visuales actuales de artistas pertenecientes a esta segunda generación de exiliados políticos en México, que han retornado a la Argentina. El objetivo es indagar sobre las múltiples memorias que se cruzan en la construcción identitaria argenmex a partir de un corpus de producciones artísticas en torno al pasado reciente argentino, teniendo en cuenta la especificidad del medio artístico. Nuestra principal hipótesis sostiene que las especificidades artísticas de cada uno de los medios puestos en juego, es decir, lo fotográfico, lo corporal y lo objetual, es un espacio privilegiado para la elaboración y transmisión de memorias traumáticas, del exilio y del retorno.

The Shikoku pilgrimage, a 1400-kilometre, eighty-eight-temple circuit around Japan’s fourth largest island, takes around forty days by foot and a week by car. Historically Buddhist ascetics walked it incessantly, creating a tradition of unending pilgrimage that continues in the present era, both by pilgrims on foot and by those in cars. Some spend decades walking the pilgrimage, while others drive repeatedly and do hundreds of pilgrimage circuits. Most are retired and make the pilgrimage the centre of their post-work lives, while others work full-time but spend their free time and weekends as pilgrims. Some have only done the pilgrimage a few times but already imagine themselves as unending pilgrims and intend to do it ‘until we die’. They talk, happily, of being addicted and having Shikokubyō, ‘Shikoku illness’, while portraying such ‘illness’ and addiction as blessings. This book, based in extensive fieldwork, shows that unending pilgrimage is the dominant theme of the Shikoku pilgrimage and argues that this is not specific to Shikoku but found widely in global contexts, although it has barely been examined in studies of pilgrimage. It counteracts normative portrayals of pilgrimage as a transient activity involving temporarily leaving home to visit sacred places outside the everyday parameters of life; rather, pilgrimage for many participants means creating a sense of home and permanence on the road. As such this book presents new theoretical perspectives on pilgrimage in general, along with rich ethnographic examples of pilgrimage practices in contemporary Japan.

Something remarkable has occurred in Asia with little fanfare over the past twenty-five years. Considered severely underinstitutionalized at the end of the Cold War, Asia’s regional architecture is now characterized by a complex patchwork of overlapping alliances and multilateral institutions. How did this happen? Why should we care? And what does this mean for the future of regional order and Asian security? Adopting a new framework grounded in historical institutionalism, this book examines the transformation of Asia’s regional architecture from 1945 to the present. The book traces institutional and political developments in Asia beginning with the emergence of the postwar US bilateral alliance system and covers the debate and contention behind the rise of several post–Cold War multilateral initiatives. These include the Asia-Pacific Economic Cooperation, ASEAN Regional Forum, East Asian Summit, Trans-Pacific Partnership, China-Japan-Korea Trilateral Summit, Asian Infrastructure Investment Bank, and the Belt and Road Initiative, among others. Asian policy makers have endeavored to create a set of rules, norms, and institutions to build confidence, facilitate cooperation, improve governance, and ultimately bring peace and order to a region fraught with underlying historical and political tensions. Although Asia’s complex patchwork of institutions may exacerbate regional rivalries, the book demonstrates how overlapping institutions may ultimately bring greater stability to the region.

Religion, Emotion, Sensation asks what the blooming field of critical inquiry known as affect theory has to say about God or gods, religion or religions, scriptures, theologies, or liturgies. Contributors explore the crossings and crisscrossings between affect theory and theology and the study of religion more broadly. At once transpersonal and prepersonal, affect transcends and subtends the human. As such, it has affinity with divinity, but a divinity that is indissociable from materiality. The History of Russian Literature provides a comprehensive account of Russian writing from its earliest origins in the monastic works of Kiev up to the present day, still rife with the creative experiments of post-Soviet literary life. Five chronological parts by design unfold in diachronic histories; they can be read individually but are presented as inseparable across the span of a national literature. Throughout its course, this History follows literary processes as they worked in respective periods and places, whether in monasteries, at court, in publishing houses, in the literary marketplace, or the Writers’ Union. Evolving institutional practices used to organize literature are themselves a part of the story of literature told in poetry, drama, and prose including diaries and essays. Equally prominent is the idea of writers’ agency in responding to tradition and reacting to larger forces such as church and state that shape the literary field. Coverage strikes a balance between extensive overview and in-depth thematic discussion, addressing trans-historical questions through case studies detailing the importance of texts, figures, and notions. The book does not follow the decline model often used in accounts of the nineteenth century as a change-over between ages of prose and poetry. We trace in the evolution of literature two interrelated processes: changes in subjectivities and the construction of national narratives. It is through categories of nationhood, literary politics, and literary life, forms of selfhood, and forms of expression that the intense influence of literature on a culture as a whole occurs.

Esta obra se debruça sobre diálogos entre políticas públicas e direito, trazendo artigos científicos de diversos autores brasileiros acerca da participação e da sua efetividade na sociedade contemporânea. O livro apresenta um olhar interdisciplinar, sendo composto por capítulos escritos por pesquisadores não só da área jurídica, como também de Psicologia, Biologia, Odontologia e Pedagogia. A divisão dos capítulos parte de temas mais relacionados à participação política por diferentes vias, passando pelas demandas por efetivação dos direitos humanos, sem retrocesso social. Em seguida, transita por violações específicas no âmbito dos direitos a educação, igualdade racial e de gênero, moradia, dignidade física, psíquica e sexual, segurança pública e saúde. O primeiro capítulo discute em que medida foi eficaz a participação popular na tramitação da reforma política na Câmara dos Deputados do Brasil. Descreve as vias de participação popular nesse âmbito e discute seus efeitos na tramitação da referida reforma, a partir dos procedimentos metodológicos de revisão bibliográfica, análise de documentos, estudo de caso e process tracing com elite interviewing, em abordagem qualitativa. Os resultados indicam que, embora tenha havido aumento da participação popular institucional no período sob enfoque, o parlamento aplicou não decisões em relação à reforma política intencionada pelas entidades da sociedade civil que organizaram as provocações ao Poder Legislativo. Em seguida, o segundo capítulo tem como principal objetivo a análise acerca do Portal e-Democracia e o seu papel para uma maior democracia participativa de, principalmente, inclusão das minorias sociais. Estuda a relação entre a democracia brasileira e a participação popular, investiga o porquê do Portal e-Democracia ser tão necessário para a defesa dos direitos das minorias sociais, bem como explica a importância da participação popular legislativa das minorias sociais. Esta pesquisa parte de fontes bibliográficas primárias e secundárias, com revisão bibliográfica e análise do próprio portal em estudo. O estudo conclui que é essencial a criação de políticas públicas para a participação política das minorias sociais, sendo uma delas o mencionado portal eletrônico, porém esta medida isolada não resolve a presente questão, sendo necessárias políticas públicas de fácil acesso a todos e todas. O terceiro capítulo aborda as relações que conectam o princípio da vedação ao retrocesso social com as manifestações que apoiam o movimento de retorno da ditadura militar no Brasil no século XXI. Para tanto, no primeiro momento, os autores elucidam os conceitos de vedação ao retrocesso social, bem como o significado do chamado efeito cliquet, o qual corrobora com os ditames fixados do respectivo princípio, haja vista que, no alpinismo, significa que quando atingida uma determinada altura, não se pode mais voltar. Contextualizam, ademais, as heranças e as consequências da ditadura militar no Brasil, além de analisarem as manifestações que têm ocorrido na atualidade em prol de um retrocesso ao período ditatorial. O trabalho comprova que a volta da ditadura militar seria uma afronta ao princípio da vedação ao retrocesso social, uma vez que extinguiria e revogaria direitos fundamentais já consolidados no ordenamento jurídico brasileiro e regressaria a um período autoritário, que não se coaduna com o Estado Democrático de Direito. Conectando-se à discussão acerca de retrocessos e inefetividade de direitos, o quarto capítulo mergulha no debate democrático acerca da expansão da educação superior brasileira e das políticas de acesso que promoveram um significativo acréscimo de ingressantes nos cursos de graduação no Brasil. O trabalho atende a pesquisa bibliográfica e fundamenta-se na revisão de literatura com o suporte teórico de autores e legislações da área afim, refletindo sobre o processo de evolução e inclusão mediante a implementação de programas e ações afirmativas para a educação superior que corroboraram para dirimir o caráter elitista impregnado no perfil deste nível de ensino. Embora distante de reparar as injustiças sociais no Brasil, tais políticas geraram um número maior de ingressantes das camadas menos favorecidas da sociedade e, com isso, a representatividade dos grupos denominados de minorias aumentou, ainda que de modo tímido, mas refletindo na redução do déficit de acesso ao ensino superior. Ainda sobre desigualdades na educação no país, no quinto capítulo as autoras investigam como a discussão sobre o mito da democracia racial no Brasil impulsionou práticas racistas ao longo do tempo e como, a partir de um viés multiculturalista, se assentam as políticas afirmativas, com destaque para a política de cotas para ingresso de negros e pardos nas Universidades, implementadas a partir de 2012. Apontam, para tanto, que a construção deste mito não se coaduna com questões mais modernas e de relevo econômico e social que pautaram a promoção de políticas afirmativas no Brasil. Nesta senda, as políticas sociais afirmativas de cotas são medidas tomadas pelo Estado, de cunho temporário ou especial, com o objetivo de assegurar igualdade de oportunidades e que foram negadas historicamente para a população afro. Para embasar este artigo, foi utilizada a metodologia de revisão bibliográfica e a análise documental das políticas afirmativas de cotas. O capítulo seguinte aventa que as relações sociais são produtos da vida em sociedade e caracterizam-se, essencialmente, pela interação que há entre seus componentes considerando territórios, culturas, identidade e ideias. Contudo, é da natureza dessa dinâmica social que alguns grupos sociais se sobressaiam sobre os demais e imponham seus interesses pessoais acima dos interesses públicos, prejudicando, assim, a concretização de interesses gerais. Dessa maneira, com o intuito de explicar como essas relações de poder e de domínio influenciam na concretização de políticas públicas, o trabalho se propôs a analisar qual o protagonismo que os agentes sociais têm nessa fase. Como exemplo prático dessa discussão acadêmica, analisa-se como a elite governante brasileira busca conciliar seus interesses com a efetivação de políticas públicas habitacionais. Em outro aspecto de violação de direitos através de deficiências de políticas públicas, o sétimo capítulo analisa a evolução da taxa de homicídios no Brasil, verificando grande heterogeneidade entre os estados. Isso constitui uma deficiência estrutural grave, que compromete as bases do desenvolvimento no país. Assim, o propõe-se o entendimento da correlação das taxas de homicídios no Brasil em um período de 10 anos, verificando que os estados do Rio Grande do Norte, Goiás, Maranhão e Piauí se correlacionaram positivamente, apresentando um aumento na taxa de homicídios, enquanto Espírito Santo e Paraíba obtiveram redução. Diante dos resultados, destaca-se a atenção às políticas de segurança pública e conclui-se que é possível identificar padrões estruturais das distintas dinâmicas de homicídios contribuindo para e informações relevantes que possam subsidiar a implantação e efetividade das políticas públicas no país. Na seara das violências, o oitavo capítulo destaca aquelas cometidas contra mulheres no ambiente doméstico no bairro de Narandiba, em Salvador-BA. O artigo tem como objetivo geral analisar a possibilidade ou não de ampliação no atendimento às mulheres que sofrem violência doméstica através da unidade do Centro Judiciário de Solução Consensual de Conflitos (CEJUSC), órgão vinculado ao Tribunal de Justiça da Bahia, localizado no bairro de Narandiba, em Salvador. Como primeiro objetivo específico, examina se o acolhimento dessas vítimas estaria em conformidade com o regulamento e a missão que fundamenta o trabalho do CEJUSC. Como segundo objetivo específico, reflete sobre a demanda de mulheres, vítimas de agressão doméstica, que passam pela unidade de Narandiba em busca de um apoio ou uma orientação jurídica. Em termos metodológicos, o artigo é qualitativo e analisa o tema proposto utilizando a revisão bibliográfica, a análise de documentos e a observação da autora durante o período de janeiro a outubro de 2019. As violências domésticas atingem, não raro, a dignidade sexual de crianças e adolescentes. Assim, a conexão para o nono capítulo apresenta as etapas da perícia psicológica nos casos de suspeita de abuso sexual, tendo como enfoque os instrumentos e testes psicológicos mais utilizados nestas avaliações. Os objetivos específicos englobam conceituar avaliação psicológica e abuso sexual, bem como trazer técnicas da Psicologia que melhor respaldem o psicólogo nesse processo de avaliação. O método deste estudo foi realizado por meio de pesquisa bibliográfica. A avaliação psicológica pericial difere de outros tipos de avaliação psicológica em função de sua meta final onde atua subsidiando decisões legais quando estas dependem de um entendimento de funcionamento psicológico do(s) envolvidos(s) nos casos de suspeita de abuso sexual de crianças e adolescentes. Abuso sexual é qualquer contato ou interação entre uma criança ou adolescente e alguém em estágio psicossexual mais avançado do desenvolvimento, na qual a criança ou adolescente estiver sendo usado para estimulação sexual do perpetrador. As avaliações psicológicas têm sido requisitadas em todas as fases de encaminhamento dos casos, da notificação ao processo judicial. Desde a fase inicial ou investigativa, a criança pode passar por inúmeras intervenções (entrevistas, aplicação de testes psicológicos, etc), inclusive de psicólogos que não atuam diretamente com a justiça, mas que acabam colaborando no processo quanto à veracidade da situação de abuso. Não obstante possam ser vítimas de diversas violações de direitos, por vezes crianças e adolescentes entram em conflito com a lei. Nesse contexto, o décimo capítulo investiga a contribuição da aplicabilidade da entrevista terapêutica no processo de avaliação psicológica de adolescentes em conflito com a lei, descrevendo as características de adolescentes, explicando a função da Psicologia e elucidando entrevista terapêutica como ferramenta diferencial na avaliação psicológica desses adolescentes. Como metodologia foi realizada uma revisão bibliográfica, com base em livros e artigos científicos, com tratamento particular de publicações da área de Psicologia e da legislação específica sobre os direitos do adolescente. Como resultados, os adolescentes em conflitos com a lei apresentam características que se fundamentam em aspectos históricos, sociais e culturais e a entrevista terapêutica mostrou-se como importante na contribuição da avaliação psicológica desses adolescentes, uma vez que se dispõe como uma técnica de analise aberta, capaz de se ajustar a diferentes situações clínicas, com possibilidades de descobrir as subjetividades, conhecer comportamentos, indicar encaminhamentos ou fazer intervenções. Diante de uma realidade vivencial complexa e aprisionadora, a avalição psicológica é uma prática relacional, que visa com alteridade contribuir para incluir socialmente os adolescentes. É certo que a mudança comportamental dos adolescentes infratores requer apoio familiar e um trabalho multidisciplinar, que não comporta apenas o papel do Psicólogo, mas, o envolvimento do Estado e da sociedade como um todo em ações conjuntas, para efetivamente produzir transformações. Conclui-se que o estudo produziu uma discussão importante, por dispor conhecimentos para área da Psicologia, profissionais que atuam e para a sociedade, que podem melhor conhecer os espaços de intervenção, meios de atuação e a importância da psicologia neste contexto. Nessa linha de discussão que abarca questões relacionadas à saúde, o capítulo seguinte analisa a judicialização do direito à saúde. Esse direito, conforme o artigo 196 da Constituição Federal, pertence a todos e é dever do Estado fornecê-lo por meio de políticas públicas. Entretanto, a possibilidade de exercício por todos do referido direito fica limitada aos recursos disponíveis e por ações judiciais no âmbito do Sistema Único de Saúde (SUS). O objetivo geral, portanto, é analisar se a judicialização da saúde é a solução mais adequada para se obter uma vaga de leito de UTI no SUS. Assim, o trabalho descreve como o SUS regula a distribuição de leitos e reflete sobre o fenômeno da judicialização e o seu potencial ou não de efetivar esse direito com isonomia. Para a sustentação metodológica, o estudo utilizou de uma pesquisa qualitativa, com método fundamentado em análise de documentos e revisão bibliográfica a respeito do tema. Os resultados mostram que, embora o SUS estabeleça a quantidade de leitos de UTIs, alguns hospitais carecem de mais ofertas de leitos. Desta forma, é relevante ter um políticas públicas que efetivem o direito à saúde, em cumprimento às previsões legais. Nesse contexto de inefetividade do direito à saúde, o capítulo seguinte descreve o perfil das demandas judiciais referentes a medicamentos no município de Cuiabá – Mato Grosso, realizado na Defensoria Pública, em 2013, utilizando indicadores de Pepe. Foram analisadas 135 ações judiciais relativas às solicitações de medicamentos e 166 medicamentos requeridos nas mesmas. Em quatro dimensões (sócio demográficas do autor da ação judicial; processuais das ações judiciais; médico sanitárias das ações judiciais; político-administrativas das ações judiciais). As informações obtidas e delineadas no capítulo expõem o cenário da saúde frente a judicialização de medicamentos e as características dos indivíduos que abriram demandas contra o Estado ou o Município. Em preocupação com a saúde e a segurança alimentar dos brasileiros, o décimo terceiro capítulo discute o cabimento de arguição de descumprimento de preceito fundamental (ADPF) contra a nova política brasileira de agrotóxicos. A evolução clássica da política brasileira de agrotóxicos foi marcada pela ótica da proteção. Todavia, novos desafios, hoje, contrariam a política até então vigente e faz surgir um movimento, cada vez mais forte, pela flexibilização de normas. Nesse cenário, percebe-se o surgimento de uma nova política sobre tema, mas desta vez, tendo o agronegócio como protagonista. Desse modo, os efeitos desta nova política já são tangíveis, o que nos leva a discutir a constitucionalidade de tais ações. Posto isso, este trabalho tem como objetivo promover um debate acerca da existência de uma nova política brasileira sobre agrotóxicos em suas principais questões. Para realizar este trabalho, foram utilizados os tipos de pesquisa bibliográfica e documental, através da abordagem qualitativa. Conclui-se que a nova política de agrotóxicos é inconstitucional e, por consequência, atacável por meio da ADPF. Avançando na busca de efetivação de direitos humanos através de políticas públicas, o último capítulo investiga a necessidade de ressignificação das bases da teoria da execução para efetivar ações civis públicas em que se discutem tais políticas. Para tanto, utiliza-se de procedimento monográfico e bibliográfico. O estudo expõe as razões que levaram à judicialização da política, bem como traça diretrizes gerais sobre o atual panorama da execução. Aborda, ainda, a crise de efetividade da execução, que insiste em se valer de multas pelo descumprimento – que vêm sendo inefetivas para o cumprimento. Após essa discussão, o trabalho traz instrumentos jurídicos hábeis a colaborar com a concretização dos direitos. Espera-se que esta seleção de artigos científicos contribua, como obra coletiva, para avanços no conhecimento sobre políticas públicas como efetivadoras de direitos humanos, bem como sobre as múltiplas formas de participação popular na luta por tais direitos na sociedade contemporânea.

El año 1991 marcó un hito histórico en Colombia. La gestación y promulgación de la Constitución Política introdujo un radical cambio en todos los aspectos de la vida nacional y esto porque la nueva Carta consagró un robusto catálogo de derechos fundamentales; y su fundamentalidad proviene precisamente del hecho de ser garantías de una vida digna, es decir, la Constitución establece las directrices que han producido un “giro copernicano” en la vida del país. Todo el aparato estatal, todos los desarrollos legislativos y todo el sistema judicial queda puesto al servicio de la persona y de su dignificación. Pero este acontecimiento que marcó los nuevos rumbos del país no es un hecho aislado, sucede porque hace parte de una corriente mundial de renovación que tiene sus antecedentes remotos en la Declaración Universal de los Derechos del Hombre y el Ciudadano de 1789 y la Bill of Rights de 1791 y, más recientemente, en la Declaración Universal de los Derechos del Hombre de 1948. La experiencia traumática de las dos guerras mundiales (la de 1914 a 1918 y la de 1939 a 1945) obligó a la humanidad a replantearse los fines y propósitos de los Estados y dio origen a un movimiento cada vez más urgente por sociedades incluyentes, garantistas y equitativas. La proclamación de “nuevas constituciones” a lo largo y ancho del planeta es un síntoma indiscutible de esas urgencias. Paralelamente, el modelo económico extractivo cuyos afanes de explotación se vieron incrementados con formas de capitalismo radical (“capitalismo salvaje”, “neoliberalismo”), han producido, de una parte, profundas desigualdades, sociedades excluyentes y extensas porciones de población sumidas en la pobreza hasta el extremo de la indigencia; de otra parte, este modelo económico ha devastado el planeta, ha agotado los recursos naturales y ha desatado todo tipo de alteraciones y cambios catastróficos que, una y otra vez, anuncian el agotamiento de los ecosistemas. A pesar de las evidencias, el sistema económico no muestra un verdadero compromiso con la recuperación ecológica. La Organización de las Naciones Unidas propuso en 2015 lo que denominó los Objetivos de Desarrollo Sostenible, 17 propósitos que coinciden con los anhelos más tradicionales del humanismo occidental: erradicar el hambre y la pobreza, acceso a la salud y al bienestar, desarrollo económico en armonía con la naturaleza, reducción de las desigualdades, uso de energías amigables… en fin, la utopía de una humanidad próspera y en paz. No obstante, todas esas metas implican la implementación de políticas públicas perdurables en el tiempo y socialmente verificables y una renuncia a las ambiciones de los sectores productivos, pero… ¿no es acaso la obtención y ejercicio del poder el propósito de la acción política y no es acaso el afán de ganancia el motor de todo el sistema capitalista? Queda planteada apenas la cuestión. Volviendo al ámbito local, el panorama nacional ofrece los contrastes sociales y económicos apenas lógicos en una nación con un Estado tradicionalmente débil y centralizado y amplios territorios en disputa por parte de grupos armados ilegales enfrentados o cohonestados en torno a la disputa por las rentas ilegales. En este escenario, las comunidades más desaventajadas pugnan por acceder a los derechos más elementales. En este contexto, ese conglomerado de garantías que podríamos reunir bajo la categoría de “seguridad social” y que incluyen derechos como la salud, la vivienda, el trabajo digno, por mencionar solo algunos, son una tarea aún por hacer, y comunidades como la de los wayúu en Malouyen (en el departamento de La Guajira) han visto menoscabados estos y otros derechos fundamentales. El ODS 4 hace referencia a una educación de calidad, asunto que compete a la universidad, máxime si hablamos de la universidad contemporánea que ya no funge como simple repositorio y guardiana del saber a ser transmitido a nuevas generaciones de profesionales, sino que, además de cumplir su función académica y científica, es un actor social determinante para la transformación social. La universidad está llamada a dirigir todo potencial a metas de alto impacto científico y social. La Corporación Universitaria Americana transita por esa senda y este libro da cuenta de ese interés y de ese compromiso. El texto presenta los resultados de un proyecto de investigación y de intervención social que involucró a la Institución y a la comunidad wayúu de Malouyen, una comunidad urgida de soluciones y con capacidad de autogestión. La experiencia no pudo ser más enriquecedora para ambos actores y puso en evidencia la necesidad de una relación más estrecha entre la universidad y la realidad.
