Abstract:
The case of the French Revolution supports the proposition that principles of political legitimacy which shape state identities are linked to domestic social structures, and help determine the resources states mobilize in international competition. To the degree that they are shared across states, legitimacy principles also shape international society. The enactment of a deviant principle of legitimacy by a major power will have systemic consequences because it undermines the existing rules of the game; it may have transformative effects if the efficacy of the new principle is demonstrated in competition. Closer attention should be paid to the complex manner in which new principles interact with existing rules of international society.

Abstract Appropriation art (AA) involves the use of pre-existing works of art with little to no transformation. Works of AA (often) fail to satisfy established criteria for originality, such as creative labour and transformative use. As such, appropriation artists are often subject to copyright lawsuits and defend their work under the fair use doctrine of US copyright law. In legal cases regarding AA and fair use, judges lack a general principle whereby they can determine whether or not the offending party has ‘transformed’ the original work. Further, it is not the case that there is some antecedent fact that could determine the outcome one way or another. I diagnose debates surrounding the transformative nature of works of AA as cases of ‘metalinguistic negotiation’ over what concepts we should attach to terms like ‘copy’, ‘transformative’, and ‘work of art’.

AbstractThe 2003 occupation of Iraq ignited an important debate among scholars over the merits of transformative occupation. An occupier has traditionally been precluded from making substantial changes in the legal or political infrastructure of the state it controls. But the Iraq experience led some to claim that this ‘conservationist principle’ had been largely ignored in practice. Moreover, transformation was said to accord with a variety of important trends in contemporary international law, including the rebuilding of post-conflict states along liberal democratic lines, the extra-territorial application of human rights treaty obligations, and the decline of abstract conceptions of territorial sovereignty. This article argues that these claims are substantially overstated. The practice of Occupying Powers does not support the view that liberal democratic transformations are widespread. Human rights treaties have never been held to require states parties to legislate in the territories of other states. More importantly, the conservationist principle serves the critical function of limiting occupiers' unilateral appropriation of the subordinate state's legislative powers. Post-conflict transformation has indeed been a common feature of post-Cold War legal order, but it has been accomplished collectively, most often via Chapter VII of the UN Charter. To grant occupiers authority to reverse this trend by disclaiming any need for collective approval of ‘reforms’ in occupied states would be to validate an anachronistic unilateralism. It would run contrary to the multilateralization of all aspects of armed conflict, evident in areas well beyond post-conflict reconstruction.

The focus and principle interest of this essay, called The Listening Voice, is The Art of Transformation. My approach recognizes the overlap that clearly exists between the Alchemical Psychology articulated by C.G. Jung and James Hillman, and the native ancestral wisdom kept alive to this day in what we now call Shamanism. Both offer laws, principles and practices to guide the individual in search of the kind of transformation that brings about the appearance of the most essential and authentic aspects of their true nature. While practicing these “arts”, I recognized how both traditions work in concrete and imaginative ways with the energy that underlies what has been materialized, what we psychologically call “symptoms”. Given that energy manifests as vibration, and that the most direct way of working with vibration is sound, and that the sound coming out of our own being is the sound that is most transformative, I recalled my own experiences with the discoveries of Alfred Wolfsohn – who healed himself of deep trauma involving auditory hallucinations by working with his own voice – to bring the vocal practices into the work to dissolve knots, to open psychic spaces, and to give explicit palpable shape to subtle things waiting and wanting to take on concrete form and reality in our lives. This essay shares my discoveries, and makes practical suggestions for developing and nurturing a Listening Voice, which is unmistakably transformative. The subject of the research is the principle of cultural conformity. The object of the research is education in general and professional teacher training in particular. The aim of the research is to reveal the multidimensional understanding of the cultural onformity principle and its applying in the modern education system. The cultural conformity principle is analyzed in the research in terms of functional, social, cultural and system approaches. From the functional perspective, this principle is treated as the method to eliminate cross-cultural barriers and resolve cognitive issues. Social and cultural approach highlighted the importance of cultural conformity principle, its cultural, social and personal characteristics when laying the groundwork for harmonious collaboration. The research has made it possible to build a systematic typology of goal-setting and definition of the objectives for teachers to apply this method in learning. The system approach focuses on presenting education as a social institution, a part of the transformative processes. Post evaluation allowed to illustrate the education goals transformation, that influenced educational paradigms, and, consequently, led to the transformation of teachers’ values system. These changes are exemplified through the European research supervised by S. Shwarz. Social, cultural and system approaches brought to light the potential of cultural conformity principle and its ability to eliminate negative influences of institutional changes on the society in general and on the education system in particular. The cultural conformity principle interpretation analysis made on the basis of functional, social, cultural and system approaches, revealed the differences in the treatment of the concept itself, discriminated its application as a didactic principle and expanded its understanding.

Socio-political, environmental, cultural, and digital changes require literacies that will be crucial for facing complex challenges. This article contributes to a notion of digital literacies as agentic and transformative and having epistemological implications. Although studies in digital literacies have examined diverse forms of understanding and relating to digitalization, we find that few studies have adopted a principled approach to transformative enactment of digital literacies. Our analytic focus is on how agents turn to digital (and other) resources when faced with problems in order to make them manageable. We conceptualize this notion of digital literacies by drawing on the Vygotskian principle of double stimulation. To demonstrate how agentic and transformative literacies appear in technology-rich learning environments, we make use of an empirical setting in which lower secondary school students and their teacher face a conundrum in a science project. We use this case as an empirical carrier of the conceptual and analytical framework employed. The analysis shows how the teacher enacts digital literacies in the design and orchestration of student activities in technology-rich learning environments where unforeseen issues occur, and how the collaborating students enact digital literacies by drawing on resources that enable them to resolve their insufficient understanding of a problem to reach insights that are shared with their peers.

Abstract:
This study critically examines the additivity of the proeutectoid ferrite transformation. The study has been carried out in two parts with the first part involving experimental verification of the additivity of the proeutectoid ferrite transformation and the second part a theoretical assessment of the additive nature of the ferrite transformation with the aid of mathematical models. Austenite-to-proeutectoid ferrite transformation kinetics were measured under a number of isothermal, stepped-isothermal and continuous-cooling conditions for three plain-carbon hypo-eutectoid steel grades (AISI 1010,1020 and 1040) using a dilatometer and a Gleeble 1500 thermomechanical simulator. Isothermal transformation kinetics were characterized using the Avrami equation. The stepped-isothermal transformation tests were designed to experimentally assess the additive nature of the austenite to proeutectoid ferrite transformation by measuring transformation kinetics partially at one temperature and after a rapid temperature change to another temperature. Results on the 1010 and 1040 steels showed that the proeutectoid ferrite transformation with polygonal morphology is additive under changing temperature in that the ferrite transformation kinetics at the second temperature are quite similar to the isothermal kinetics at that temperature. Stepped-isothermal transformation measurements were made on the 1020 steel with the resulting ferrite morphology either remaining Widmanstatten at both temperatures or changing from allotriomorph to predominantly Widmanstatten at the two temperatures. In both cases the results showed additive behavior. However, the stepped-isothermal test in which the proeutectoid ferrite was transformed to an equilibrium amount and equilibrated at the first temperature and then rapidly changed to the second temperature was not additive. Characterizing the isothermal formation of proeutectoid ferrite in the three steels using the Avrami equation resulted in a reasonably constant value of n and the b parameter increasing with increasing transformation temperature. Early site saturation was evident in a number of test specimens. In the second part of the study, two mathematical models with planar and spherical interface geometries were developed to theoretically assess the additivity of the proeutectoid ferrite transformation. A finite-difference numerical technique was employed to describe the austenite to ferrite diffusion controlled moving-interface problem for a system having finite boundaries. A test of additivity of the proeutectoid ferrite transformation was made by predicting the ferrite growth kinetics and the associated carbon gradients under stepped-isothermal conditions. The predictions were consistent with the observed experimental additivity of the proeutectoid ferrite transformation in the 1010 steel. The spherical model predicted isothermal ferrite growth kinetics compared more favorably with the experimentally measured kinetics of the 1010 steel than the planar model. An unusual phase was detected in the 1020 steel. A number of tests were performed to measure the isothermal transformation kinetics of the new phase. Scanning electron microscopy (SEM) and scanning-transmission electron microscopy (STEM) were used to further investigate the structural details in this new phase. The results indicated that the new phase is a type of bainite but having some of the characteristics attributable to massive transformation products.

Abstract:

This dissertation explores the need for critical transformative leaders who critique oppression within schools and have a desire for social justice. This study attempts to learn more about the principal practices that maintain or disrupt the status quo and what ritual patterns emerge in relation to the work of principals. Two public elementary school principals were observed over the course of a three-day period to better understand the challenges that critical transformative leaders face in the field of education. Four lessons emerged regarding the ritual patterns of principals studied: (a) an emphasis on solidarity, which creates ends that support status quo practices and restricts the development of dialogue centered on social justice issues, (b) the need to expose the hidden curriculum through praxis and work toward liberation, (c) a limited resistance in leadership practice, and (d) that a theoretical understanding of social justice leadership is not enough for transformation to occur in schools. The lessons learned in this study suggest that the neoliberal influences placed upon public schools and public school principals are a major obstacle preventing principals from doing critical transformative work. Furthermore, the academic coursework that principals are involved in is not a sufficient condition for doing critical transformative work. These themes suggest that there is a great need to find ways to open dialogue amongst principals, school staff, parents, and those who make policy decisions so that these groups can begin examining oppressive conditions in schools. Reflection and action against unjust policies are essential to aspects of praxis for which dialogue can be used as a vehicle for change.

Abstract:

The 1983 publication of A Nation at Risk gave birth to an effort to reform K-12 schools and increase student achievement all over the United States. More than 30 years later, the school reform efforts have grown into immense industries with marginal effect. Major legislation and programs have been launched throughout 3 decades, with No Child Left Behind legislation and Common Core States Standards Initiative being the latest and biggest endeavors, still with minimal outcomes. These efforts follow and run along with many years of structural changes such as Voucher, Small, Pilot, and Charter Schools. The problem of effectively transforming K-12 schools into places of high student achievement remains intractable.

The principal’s role by its unique position in the educational delivery structure and its very nature is key, and may be the single most determining factor in the failure or success of a school. There are very few studies that focus on principal leadership and its effect on student achievement outcomes. All studies and most literature on principal leadership and effectiveness put most attention on traits and observable behaviors. However, it is important to look at the inner world of principals, for this influences, if not determines, the traits and behaviors they exhibit in their leadership. There are no known studies that have focused in on the inner states and experiences of effective school principals.

This phenomenological study represents a seminal effort to study the inner experiences of principals. The participant selection was done through criterion type purposive sampling to link this study to leadership effectiveness. Only principals who were able to transform their schools from failing into successful according to the objective California State Standards of Adequate Yearly Progress were included. This sampling method also enabled the study to look deeply into the inner phenomenological experience of these transformative principals.

The study findings yielded data compelling enough to propose a conclusion of effective school transformation and proposed a model to illustrate how the inner experiences of principals fit into effective school transformation. The study also presented its implications, limitations, and recommendations for future research.

En 2000, le Chili a promulgué un nouveau Code de procédure pénale qui a bouleversé les fondements de l’ancienne procédure. Cette réforme s’est appuyée sur l’idée d’une rupture totale avec la législation antérieure en faisant graviter la procédure autour de la notion clé de débat contradictoire. L’émergence de ce principe a été obtenue grâce à une répartition innovante des rôles entre les différents protagonistes du procès, notamment avec la réapparition du Ministère Public en première instance. Afin d’innerver l’ensemble du procès, le débat contradictoire se réalise à toutes les étapes de la procédure et permet d’aboutir à une décision judiciaire qui puise sa légitimité dans la participation active des parties aux débats. Toutefois, ce débat contradictoire ne peut acquérir sa pleine dimension et son effectivité maximale que grâce à l’institution de mécanismes particuliers. Ainsi, la prévention des atteintes au contradictoire est assurée par la refonte du statut des protagonistes du procès et par l’obligation du juge de motiver ses décisions. Enfin, ce sont les voies de recours qui ont été modifiées et repensées afin d’assurer l’effectivité du principe du contradictoire. Grâce à ce mouvement, le Chili a effectué une véritable révolution juridique parachevant ainsi sa transition vers la démocratie
In 2000, Chili promulgated a new Code of criminal procedure that deeply shook the foundations of the previous procedure. This reform is based on the idea of a complete change from the former legislation by having criminal procedure rotate around the key concept of adversarial debate. The development of this principle was allowed thanks to the innovative distribution of the tasks bearing on those involved in the trial, such as the appearance of the Public Prosecutor who has recovered his function of criminal prosecution, which had been so far handled by the judge. In order to affect the whole trial, the adversarial principle carries out its effects at every stage of the proceedings. It leads to a ruling that grounds its legitimacy in the active participation of the parties in the proceedings. Consequently, the law of evidence was modified and the legal hierarchy of evidence gave way to the principle of free assessment of evidence. Yet, the adversarial debate can only develop and be effective through the setting up of specific mechanisms. Therefore, a reworking of the status of the actors of the criminal proceedings has been designed to prevent any breach of the adversarial principle. Regarding the possible breaches of the adversarial principle by the judge, these are prevented by the obligation bearing on the judge to give grounds for his rulings, as well as the modification of his status. Finally, the judicial remedies were modified and rethought in order to ensure the efficiency of the adversarial principle. Thanks to this reform, Chile made a real legal revolution, thereby completing its transition to democracy

The martensitic transformation in TiNi-based shape memory alloys has been investigated using various theoretical methods. The direct method for ab initio lattice dynamics is used for calculating phonon dispersion relations in austenite (B2) and martensites (B19, B19′). Normal mode symmetries in a B2 crystal are determined. Vibrational modes in the B2 crystal are labelled according to symmetry properties of their polarisation vector. Normal modes with imaginary frequencies are observed at the locations of experimentally observed soft modes. While labelling normal modes, the published mode symmetry label of a soft transverse acoustic (TA2) mode with a [Mathematical formula appears here. Irreducible representations of the soft modes are used for determining the order parameters for various martensitic transformation paths experimentally observed using group theoretical methods. Accuracy of the interpolated frequencies in the phonon dispersion relations is assessed by using three different supercell sizes and by calculating the elastic constants from the slopes of the acoustic branches at the Brillouin zone. Born et al. derived a relation between the force constants and elastic constants for a general crystal. Further simplification of this relation is possible for a B2 crystal because of its symmetry. This simplification is derived by applying elementary group theory. Elastic constants calculated with the simplified relation are in agreement with the elastic constants calculated from the slopes of the dispersion relations. The self-consistent ab initio lattice dynamics (SCAILD) formulation is derived for an ordered compound. Precautions that need to be taken while practically implementing this formulation are discussed. The effect of Hf or Zr addition to a binary Ti-Ni system is studied by considering one configuration at each of five compositions from 0 to 25 at.% Hf or Zr. Elastic constants are calculated following a homogeneous deformation method. Selected normal mode frequencies are calculated using the direct method.

Abstract Transformative festivals have emerged as a fascinating trend in events literature. These festivals promise long-lasting personal transformation in what are often billed as modern-day rites of passage. Some scholars view Burning Man as the progenitor of all transformative festivals, although the decommodified nature of the now 75,000-person annual arts and culture event marks it as distinct in several key ways. Foremost among these is the official code of conduct for the community known as the 10 Principles. A grassroots commitment to consent, known as 11th Principle Consent, also distinguishes the community from outwardly similar festivals. Within the liminal space of the event, these rules supplant many of the hegemonic structures of everyday life, making Burning Man, and its global network of smaller events, a fascinating case study from which to explore the creation of alternative cultural norms and their effects. This chapter explores the evolution and implementation of a culture of consent through in-depth interviews with the female-identifying Burners who drove the creation of this movement. It also traces the development of community-protected safe spaces to explore and grow. The liminal nature of the tourism event experience makes such an experimental culture possible and serves as a unique case study for scholars interested in the transformative potential of tourism events.

By considering the character of fellow body and surface forces, the generalized quasi-variational principles of non-conservative systems are established in elasto-dynamics in phase space. By doing inverse Laplace transformation, the convolutional generalized quasi-variational principles of non-conservative systems of elasto-dynamics are established in original space. Applying the generalized quasi-complementary energy principle to the mechanical vibration problem of two kinds of variables, the authors of this paper present a calculation method for solving two kinds of variables simultaneously: the internal force and the displacement of a typical fellow force system.

Since the mainstream racial awakening to pervasive and entrenched structural racism, many organizations have made commitments and adopted practices to increase workplace diversity, inclusion, and equity and embed these commitments in their organizational missions. A question often arises about how these concepts apply to research. This paper discusses how organizations can build on their specific commitments to diversity, inclusion, and equity by applying these principles in the research enterprise. RTI International’s framework for conducting equity-centered transformative research highlights how incorporating principles of diversity, inclusion, and equity requires a departure from mainstream practice because of historical and intentional exclusion of these principles. Drawing on methodologies of culturally responsive evaluation, research, and pedagogy; feminist, Indigenous, and critical methodologies; community-based participatory research; and theories of social transformation, liberation, and racial justice, this organizing framework illustrates what this departure requires and how research can serve liberation and social justice by transforming the researcher, the research content, and the day-to-day practice of conducting research. Centering the work of seminal scholars and practitioners of color in the field, this paper provides a holistic framework that incorporates various research approaches and paradigms intended to shift power to minoritized and marginalized communities to achieve social transformation through research.

Worldwide, interventions and policies to improve gender equality or close gender gaps often struggle to reach their targets. For example, women lag considerably behind in use of even simple digital technologies such as mobile phones or the internet. In 2020, the gap in mobile internet use in low- and middle-income countries was at 15%, while in South Asian and Sub-Saharan African countries, it remained as high as 36% and 37% respectively (GSMA, 2021). Use of the internet for more complex activities shows an even wider gap. In Cairo, in 2018, only 21% of female internet users gained economically, and only 7% were able to voice their opinions online (with similar statistics for India, Indonesia, Kenya, Uganda and Colombia, Sambuli et al., 2018). This is despite the fact that empowering women through digital technologies is central to global gender equality strategies (e.g. Sustainable Development Goals, United Nations, 2015), and is believed to facilitate economic growth and industry-level transformation (International Monetary Fund, 2020). Progress is slow because behaviours are gendered: there are stark dissociations between what women and men do – or are expected to do. These dissociations are deeply entrenched by social norms, to the extent that interventions to change them face resistance or can even backfire. Increasingly, governments are using behavioural change interventions in a bid to improve public policy outcomes, while development or gender organisations are using behavioural change programmes to shift gender norms. However, very little is known about how gendered social norms impact the digital divide, or how to use behavioural interventions to shift these norms. Drawing on several research papers that look at the gender digital gap, this brief examines why behavioural change is difficult, and how it could be implemented more effectively. This brief is addressed to policymakers, programme co-ordinators in development organisations, and strategy planners in gender equality interventions who are interested in ways to accelerate progress on gender equality, and close the gender digital gap. The brief offers a set of principles on which to base interventions, programmes and strategies to change gendered behaviours. The principles in this brief were developed as part of a programme of research into ways to close the gender digital gap.

The research is devoted to the study of the phenomenon of mediatization of art on the example of virtual museums. Main objective of the study is to give communication characteristics of the mediatized socio-cultural institutions. The subject of the research is forms, directions and communication features of virtual museums. Methodology. In the process of study, the method of communication analysis, which allowed to identify and characterize the main factors of the museum’s functioning as a communication system, was used. Among them, special emphasis is put on receptive and metalinguistic functions. Results / findings and conclusions. The need to be competitive in the information space determines the gradual transformation of socio-cultural institutions into mass media, which is reflected in the content and forms of dialogue with recipients. When cultural institutions begin to function as media, they take on the features of media structures that create a communication environment localized by the functions of communicators and audience expectations. Museums function in such a way that along with the real art space they form a virtual space, which puts the recipients into the reality of the exhibitions based on the principle of immersion. Mediaization of art on the example of virtual museum institutions allows us to talk about: expanding of the perceptual capabilities of the audience; improvement of the exposition function of mediatized museums with the help of Internet technologies; interactivity of museum expositions; providing broad contextual background knowledge necessary for a deep understanding of the content of works of art; the possibility to have a delayed viewing of works of art; absence of thematic, time and space restrictions; possibility of communication between visitors; a huge target audience. Significance. The study of the mediatized forms of communication between museums and visitors as well as the directions of their transformation into media are certainly of interest to the scientific field of “Social Communications”.

The research was aimed to determine features of cloud services application in preparation of future PhDs. Concepts of “cloud computing”, “cloud technologies”, “cloud learning technologies”, “cloud services”, “cloud oriented environment” were analyzed. Experience of cloud technologies and their services application in educational and scientific space in researches of foreign and Ukrainian students was considered. Ukrainian experience in preparation of future PhD of various specialties with cloud services application was analyzed. It was emphasized that approaches improving to preparation of future PhDs based on cloud services application would increase their level of digital competence. It is recommended to include a separate course or module of specific discipline on work with cloud technologies and services during preparation of future PhDs. It is important to improve disciplines and tools content to support education process. It can be learning of disciplines using cloud technologies or services by future PhD’s. Also, cloud services application to support scientific and scientific-organizational activities will increase level of organization and implementation of scientific research. It is important to create cloud-oriented environment for preparation of future PhDs in higher education and research institutions. Making cloud-oriented educational and scientific environment should be based on principles of open education. With the region home to global energy companies and historical high levels of energy sector employment, the narrative on transition is predominantly framed within an industrial and technological context, including narratives on new opportunities in green jobs, green industrial development, technical innovation and new infrastructure to support energy transition. As the energy landscape shifts in the North-East of Scotland, the impacts will be felt most keenly in communities from shifts in employment to changes to local supply chains. It is important to note that Net Zero ambitions will also change the nature and structure of communities in the region, for those within a shifting oil and gas industry and those without. A just transition ensures that all voices are heard, engaged and included in the process of change, and that communities, including those who have benefited and those who have not, have a stake in determining the direction of travel of a changing society and economy of the North-east. As a result, there is a need for a community-oriented perspective to transition which discusses a range of values and perspectives, the opportunities and resources available for transition and how communities of place can support the process of change toward Net Zero. Social transformation is a key element of a just transition and community engagement, inclusion and participation is embedded in the principles laid down by the Just Transition Commission. Despite this high-level recognition of social justice and inclusion at the heart of transition, there has been little move to understand what a just transition means in the context of local communities in the NorthEast. This project aims to address this imbalance and promote the ability of communities to not only engage but to help steer net zero transitions. It seeks to uncover and build a stronger local consensus about the vision and pathways for civil society to progress a just transition in the Northeast of Scotland. The project aims to do this through bringing together civil society, academic, policy and business stakeholders across three interactive workshops to: 1. Empower NE communities to engage with the Just Transition agenda 2. Identify what are the key issues within a Just Transition and how they can be applied in the Northeast. 3. Directly support communities by providing training and resources to facilitate change by working in partnership. The project funding supported the delivery of three professionally facilitated online workshops that were held over 2021/22 (Figure 1). Workshop 1 explored the global principles within a just transition and how these could apply to the Scottish context. Workshop 2 examined different pathways and options for transition in the context of Northeast Scotland. Workshop 3, in partnership with NESCAN explored operational challenges and best practices with community participants. The outcomes from the three workshops are explored in detail.
