Full textThe research deals with some aspects of the reuse of Roman sources, and of their modern tradition, within the national legal system after the civil codification. The attention is directed mainly to art. 3, Preliminary provisions of the Code of 1865 with its reference to the ‘general principles of law’ in order to the analogia iuris. Based on this research approach, the study focuses on the analysis of some specific voices of Italian legal science from both nineteenth and twentieth centuries. The second part of the study is devoted to an examination of judicial practice and, more specifically, of the Supreme Courts. At this stage we pursue a twofold objective: on the one hand, to ascertain whether, and if so to what extent, Roman law could still play a role in the (modern) jurisprudence of legitimacy; on the other hand, to assess the concrete possibility, envisaged by a part of legal science, of appealing to the Supreme Court to challenge a judgment allegedly contrary to the general principles of law laid down in Art. 3 par. 2 of the Prelaws. The analysis thus starts from the content of the individual decisions of the Supreme Court, then moves on to the exegesis of the fragments referred to each time; finally, we will conclude with a summary operation aimed at assessing, for each case, the (legal) consistency of the analogical reasoning.

Full textThe present research focuses on the principle servitus in faciendo consistere nequit in Roman law and in the Roman tradition. Through the analysis of Roman sources, the refectio parietis in the servitus oneris ferendi has been traced back to an archetype of land burden. The Roman jurisprudence, therefore, considered admissible situations in which a facere could constitute the content of a real right in the event that it brought an objective utilitas. In light of these considerations, the analysis continued with a brief excursus on the real burden in the medieval law. The issue was then examined keeping in mind the achievements of the French Revolution concerning real rights transfused in the Code civil, in the codes of the italian pre-unification States, in the first Civil Code, in the current one and in the European codes that follow the French model. It has been shown, therefore, that the principle servitus in faciendo consists nequit, far from being a consolidated rule deriving from Roman law, constitutes instead a dogma, together with that of the numerus clausus of real rights, which developed as a result of the claims of French revolutionaries aimed at affirming the fullness of ownership. Moreover, through the analysis of some landmark judgments, it has been demonstrated how a part of the jurisprudence had brought certain cases back to the category of real burdens. To conclude, it was therefore stressed that in certain situations, and always keeping in mind the limit constituted by utilitas, it is possible to admit onera in faciendo whenever the practice requires it.

Full textDie Forschung betrifft das pactum de non petendo, welches das Abkommen ist, mit welchem der Gläubiger verzichtet, die Erfüllung der Leistung zu fordern. Zuerst wird der Unterschied zwischen dem p.d.n.p. und anderen Rechtsgeschäften (wie z.B. der Erlass, der Vergleich, der Schuldaufschub) erklärt. Danach wird die Struktur des p.d.n.p. vertieft. Insbesondere wird man die Idee von p.d.n.p. als Verzicht auf die Durchsetzbarkeit der Forderung und seine Rechtsregime beschreibt. Zuletzt wird die Darstellung des Falles der Vajont-Katastrophe der Anlass geben, das Thema des p.d.n.p. in Gesamtschulden zu betrachten.
