Full textThe concept of contamination between visual and figurative arts and architecture is very old. The dichotomy of art and architecture, sanctioned definitively with the modern museum of Napoleonic looting, can only be considered a variation on the neo-technicism who, not always rightly, have been settling the teachings of the polytechnics. It has not be the same during the time. As the greek temple can be seen as a plastic work as a whole, as one of the first fusion between art and architecture, many are the examples that have guided the direction of the pursued research. There are many example from the past which introduce the figure of artist-architect: an exemple of all Michelangelo Buonarroti; is not unusual, for pure artist, to engage in the design of architectural or urban space, as well as, for architect to be involved by the investigation of his own contemporary artistic research and to draw inspiration from it. The representation of visual languages are the result of contaminations occurring at different levels from different directions. Often the most significant artists research have put forward and influenced the world of design, architecture, or communication. Therefore the inner intention of the research was to deepen, through a travel into the twentieth century, with particular attention to the Second World War period, the cultural phenomena which produced the most significant stylistic developments in research and the renewal of architectural language. The task, paraphrasing Leonardo Benevolo, was not to list individual steps of the discussion but to identify that contributions which follow active development. Starting from Bauhaus school lesson, art and architecture have been joined because considered closely related expressions of contemporary cultural phenomena. The target was to identify mechanisms and interactions between disciplines, trying to delineate the complex profile of contemporary architecture.

Full textIn the case of Orleans as in Catania, no mysterious disappearance has been reported, the facts did not really happen: the rumor creates the event. As in a dream in which fantasy and reality mingle, the collective memory takes possession of the floating myth anchoring it to reality using it to shout loudly its own disturbance and contradictions. Then everything seems to be evidence that those contradictions and disturbances actually never leave the social body but these are recovered and expressed when a reading of the context by the actors is interpreted as overload of ambivalence. It is clear that the contextual reading expressed in these terms will never be expression of an "objective" crisis: two cities, different environments, different contradictions. But the crucial issue seems to be different. Two cities with different contexts and contradictions behind, in distant times one to the other, take the same approach: a mythopoeic force unites the two cities. If the reading of the context and its interpretation is left to the actors and finds direction when put in that context, then the use of mythological explanations and the search for culprits could unite the entire society.

Full textThis essay tries to answer the following question: is it theoretically and practically correct to formulate a theory on “terzo contratto” with respect to the body of rules that regulate affairs between businesses with an unequal bargaining power? This three chapter long work begins with some considerations on the asymmetrical contract in the context of contractual jurisprudence and continues by examining the theoretical framework around the “terzo contratto”, with a special focus on the specific laws it hinges on (abuse of economic dependence, laws on late payments in commercial transactions and on franchising). Finally, the work focuses on the latest approaches in regulation, with a particular regard to agroindustrial business law. Both doctrinal and jurisprudential evidences are presented, for we believe that only a holistic approach can help fully present the subject. This especially holds with respect to the practical implications that arise to the attention of law operators. The work tries to understand the reasons behind the increasing safeguards for the business negatively subjected to disproportionate contractual power within the Italian and European legal framework; mainly for comparison purposes, the work will refer to the British framework too, drawing from the wealth of researching experience acquired during the visiting term at the Institute of European and Comparative Law at the University of Oxford. Finally, the work gets to a possible conclusion on the new governing bodies of the “terzo contratto”. The most recent developments of jurisprudence on the contractual relationships arising from the sale of agricultural goods and food processing creates enough background for a theory to be built upon. This is particularly true in light of the clause 62 of Italian bill “Cresci Italia”, which favours the approach not least for the renewed importance of the agroindustrial sector and its related food processing sector, of which the current Expo 2015 is a visible proof. The ultimate purpose of such a theory needs to be set clear: to protect one party from the inherent weak position arising from asymmetrical contractual relations, yet at the same time to safeguard general instances of contractual justice and its free market principles.

Full textTrademark co-existence agreements are very popular tools to avoid/settle trademark disputes. However, many questions concerning these agreements remain unanswered. This thesis explores some of the most relevant issues from an Italian legal standpoint and the solutions offered by other countries. The thesis starts by analysing the issue of the validity of co-existence agreements (they were once considered void, were then accepted as valid by some courts and then finally also by the legislator). The thesis then analyses the typical content of co-existence agreements, with an overview of the main provisions (limitation to products and services, territorial divisions, modifications to the signs, etc.), with a focus on some wording that the parties may have further discussions on. Also examined is the relationship between co-existence agreements and third parties and the issues that can arise from the legal qualification of co-existence agreements as being binding only on the parties to it. The thesis closes with an analysis of the impact of co-existence agreements in opposition proceedings by examining the European and Italian trademark offices’ main caselaw.

Full textThe thesis deals with the possible forms of cooperation between carriers in the different transport sectors, mainly with a focus on air and maritime area. In the last decades the growth of the competition level between competitors, as a consequence of the progressive liberalization and globalization of transports, lead the carriers to adopt new commercial strategies for the risks sharing, the reduction of the costs, the expansion of their networks and the flexibilization of the internal processes to adapt their structure to the continuous expansion and contractions of the market. In the transport sector, for those reasons, arose new forms of agreements, different from each other for structure, integration level of the partners and complexity degree. Therefore the thesis closely examines the several juridical figures born in the commercial praxis, such as codesharing agreements, interlining, wet lease, dry lease, franchising, grand alliances, Conferences and Consortia. The research, having regard both to commercial uses and national, EU and international rules, focuses on the problems of juridical qualification of those agreements, on the applicable law, and on their object and content. Then follows a comparative-contrastive study of the differences between the various forms of partnership and a deepening on the aspects related to the protection of the customers, such as the liability of the carriers. Lastly the dissertation analyzes the compliance of the agreements with the EU competition rules.
