As an extreme form of social relationship of submission, torture is still an ongoing and widespread practice; this is also due to several processes typical of the neo-liberal era, starting from the policies aimed at the security armoring of society. This volume investigates torture against immigrants, focusing on the situation in different countries and on aspects related to health, highlighting the link with the worsening conditions of migration and the war on migrants.

Abstract:
This chapter examines torture in relation to rescue, prevention, and punishment, beginning with a discussion of what torture is and the differences among various legal and philosophical conceptions of torture. It analyses the legal definitions of torture proposed by the UN Convention Against Torture, and Other Cruel, Inhumane or Degrading Treatment or Punishment; the US Torture Statute; Henry Shue; and David Sussman. These conceptions of torture focus on the type of pain and suffering being inflicted as well as their purposes and by whom and when they are inflicted. The chapter considers hypothetical cases that address whether torture is permissible and involve officials who know the perpetrator and expect what he would do. It also explores other categories of people whom it might be useful to torture aside from a perpetrator whose being tortured will save only his own victim from the harm he would cause.

Abstract:
Despite its universal and absolute prohibition in international human rights and humanitarian law, torture has persisted even in liberal democracies. This chapter traces how changing national security legal cultures have shaped justifications for torture in the United States, culminating in an extensive torture program in the global war on terror. A culture of exception helped legitimize slave torture, lynching, and colonial torture through much of the United States’ early history, while a culture of secrecy facilitated covert and proxy torture during the Cold War. After 9/11, American authorities operated in a culture of legal rationalization. Rather than suspend or ignore the torture prohibition, the Bush administration sought legal cover for torture. As evidenced by the torture memos, lawyers reframed practices such as waterboarding as lawful enhanced interrogation techniques. These attempts to construct the plausible legality of torture effectively immunized Americans from prosecution for grave human rights violations.
