Abstract:
This paper reconsiders the anteriority of Robert Torrens’s theory of natural wage to that of David Ricardo. Ricardo was influenced by Torrens’s thinking when writing the chapter on “Wages” of the Principles. For many historians of economic thought, this influence is limited to Torrens’s focus on the socio-cultural aspect of necessity goods, which determine the natural price of labor. While this interpretation is consistent with that of Ricardo, we argue that the anteriority of Torrens to Ricardo more generally focuses on the method used by the latter to justify the indexation of money wages on the money price of subsistence goods. Finally, this paper shows that the tribute paid to Torrens by Ricardo paradoxically explains posterity’s misunderstanding of his theory.

Abstract:
This paper examines the arguments of Colonel Robert Torrens against the hypothetical prospect that rising corn prices might result in higher farmers’ profits by reducing the real costs of manufactured articles used in the crop-growing activity. First, it shows how this idea evolved through time in Malthus’ writings on rent. Next, it scrutinizes Torrens’ approach to the subject of value, from its origins to the more elaborate version built up in some of his early inquiries regarding political economy. The outcome of his effort was a simplified image of the mutual interaction among the productive sectors, similar to modern input–output models, composed of an interdependent system with prices and a uniform profit rate determined simultaneously. Finally, some applications for this innovative analytical device are presented, but with an emphasis on the refutation of Malthus’ proposition. The concluding remarks stress Torrens’ ability to devise a proper quantitative answer to the parson’s theoretical challenge despite the scanty technical resources available to classical economists at that time.

This paper analyzes how Robert Torrens's system of prices is applied to the aggregate economy. His personal interpretation of Say's Law is articulated with a numerical illustration and the Hawkins-Simon conditions to exemplify how the correct supply of the ingredients of capital is presented as a necessary condition for the full clearing of markets. Next, the possible causes of a shortage in effectual demand are discussed. The quantitative illustrations developed by Torrens are carefully reviewed to show how the monetary factors play a crucial role during the general glut, as well as the appropriate policy measures to stabilise the economy. The final comments reflect on the originality of Torrens's theoretical work.

This article describes the customary land tenure in Samoa, and analyses the effects of the introduction of a Torrens system of land registration on the customary land tenure. In particular, it examines the registration of adjudicated customary land (customary land in respect of which judgment has been made by the Land and Titles Court) under the Land Titles Registration Act 2008, as well as the combined effect of the Taking of Land Act 1964 and Torrens registration on customary land. It argues that the LTRA 2008 may be repugnant to the Constitution and that the Torrens system is incompatible with customary land tenure. It recommends that the law expressly exclude customary land from the indefeasibility of title effect of the Torrens system.

Urbanization poses a challenge to sustainable catchment management worldwide. This study compares streamflows and nutrient loads in the urbanized Torrens catchment in South Australia at present and future urbanization levels, and addresses possible mitigation of urbanization effects by means of the control measures: river bank stabilization, buffer strip expansion, and wetland construction. A scenario analysis by means of the Soil and Water Assessment Tool (SWAT) based on the anticipated urban population density growth in the Torrens catchment over the next 30 years predicted a remarkable increase of streamflow and Total Phosphorous loads but decreased Total Nitrogen loads. In contrast, minor changes of model outputs were predicted under the present urbanization scenario, i.e. urban area expansion on the grassland. Scenarios of three feasible control measures demonstrated best results for expanding buffer zone to sustain stream water quality. The construction of wetlands along the Torrens River resulted in the reduction of catchment runoff, but only slight decreases in TN and TP loads. Overall, the results of this study suggested that combining the three best management practices by the adaptive development of buffer zones, wetlands and stabilized river banks might help to control efficiently the increased run-off and TP loads by the projected urbanization of the River Torrens catchment.

In the current era of quantity theorists and inconvertible currencies, the real bills doctrine has received a surprising amount of recent attention (e.g., Sargent and Wallace, 1982; Smith, 1988; Selgin, 1989; Cunningham, 1992). While the real bills doctrine has a long history, the doctrine underwent considerable evolution during the period from the Bullionist debates of the Restriction Period, 1797–1819, to the Banking School versus Currency School debates surrounding the introduction of Peel's Act in 1844. The debates of the Restriction period are significant for being directly concerned with the workings of an inconvertible, real-bills-based paper currency while the later debates involved the real bills doctrine under convertibility. A primary objective of this paper is to explore the views that Robert Torrens held concerning the inconvertible and convertible versions of the real bills doctrine as a rule for central bank policy. Torrens's contributions as an anti-bullionist and, later, as a leading member of the Currency School reflect the importance that both convertibility and bank lending practices have for interpreting the real bills doctrine and the related law of reflux. The apparently paradoxical evolution of Torrens's monetary thought identified by Lionel Robbins (1958) is attributed primarily to the evolution of his views on bank lending practices.

Timbul persoalan sama ada undang-undang tanah Islam dan adat Melayu telah dihapuskan secara total atau pun masih ada ruang kepada pemakaiannya. Kertas kerja ini akan membincangkan kajian terhadap pemakaian undang-undang Islam dan adat Melayu yang masih wujud dalam undang-undang tanah yang menggunakan prinsip Torrens di Malaysia. Kaedah yang digunakan adalah kajian kepustakaan dan analisis dokumen. Analisis mendapati undang-undang Islam dan adat Melayu diiktiraf dan dipakai hanya dalam hal-hal tertentu sahaja. Dispersal and many other factors affect population genetic structure. In central Chile, rivers are characterised by strong currents and transverse mountain chains, which impose physical barriers to the populations that inhabit them. The objective of the present study was to study the population genetic structure of two widespread species of aquatic insects, the caddisfly Smicridea annulicornis and the mayfly Andesiops torrens, in three isolated rivers, Choapa, Maipo and Maule. The analysis of population structure, using both mtDNA (cytochrome C oxidase subunit 1, COI) and nuclear markers (amplified fragment length polymorphism, AFLP), considered samples from within and among rivers. In S. annulicornis, we found differentiation within and among rivers, indicating a low dispersal among the study area. Populations of A. torrens shared haplotypes in all three rivers and no differences were found among rivers, indicating that this species probably has more dispersal potential than does S. annulicornis; however, significant differences were observed within rivers. Our results indicate that the transverse mountain chains are not a barrier for A. torrens, which can disperse among rivers. Within rivers, the population structure suggests that these species are probably adapted to avoid drift because of the torrential character of these Chilean rivers.

Inicialmente, revisa-se a investida que promoveu contra a noção do tempo de trabalho como elemento exclusivo de regulação das trocas mercantis. Após, apresenta-se a defesa desse princípio por McCulloch e pelo próprio Ricardo. Prossegue-se com o exame das origens da abordagem sistêmica dos lucros de Torrens, baseada na interdependência recíproca dos setores produtivos. Contemplam-se, na sequência, as aplicações dessa teoria realizadas pelo coronel, notadamente na defesa do livre comércio. Ao final, destaca-se o caráter pioneiro de seu tratamento dos lucros no contexto da economia clássica.

Malthus’s main economic argument against free corn trade in his Essay on Population concerned the issue of structural change triggered by international trade. Malthus claimed that, in the long run, agricultural countries will develop their domestic industrial sectors and cut both their corn exports and their imports of foreign industrial goods. We critically assess Malthus’s views and compare them with Torrens 1815 and Ricardo 1822. We argue that the weak point of Malthus’s reasoning lies in his inability to perceive that an international trade-induced structural change process is at work both in agricultural and manufacturing countries. Moreover, we show that, notwithstanding the broad similarity of their conclusions, Torrens and Ricardo followed two analytically different paths.

Commercial people often draw an analogy between the Torrens system and the system of registration of petroleum tenements to reach the conclusion that title to petroleum tenements is indefeasible or secure. The analogy is a false analogy.This paper examines some of the fundamental principles relevant to title to petroleum tenements to demonstrate why titles are not as secure as is sometimes supposed. The paper also highlights some of the key points resources lawyers need to remember when they consider title.In its conclusion, the paper outlines the reasons why Torrens system legislation is inappropriate for petroleum tenements. It also suggests some simple reforms the State Governments might introduce to improve security of title.

This research investigated faecal pollution by sterol profiling in two Adelaide metropolitan catchments in winter 2000 and summer 2001. Water was sampled from five sites on the River Torrens and two sites on Patawalonga river catchment. The steroids detected were coprostanol, epicoprostanol, cholesterol, cholestanol, stigmasterol, betasitosterol, and stigmastanol. The concentrations range from 5 ng/L (of coprostanol) to 34 μmg/L (of stigmasterol), with cholesterol detected more frequently at relatively high concentrations (approximately 2 μmg/L). Sterol profiling suggested two sites on two occasions may have been impacted by human faecal contamination. Other steroid profiles suggested that sources of pollution consistently included dogs and birds. The steroid concentrations in the Torrens catchment were higher in winter, however, this was not observed in the Patawalonga catchment.

The population of water-rats (Hydromys chrysogaster) on the River Torrens in Adelaide was monitored over a three-year period. Initially, the population density was high but it became greatly reduced after the water level was lowered and did not recover again until over a year after the high water level had been restored. Males tended to have a larger home range than did females although they did not appear to exclude other individuals from their territory. Breeding generally took place in spring and summer although a few young appeared to be produced in most months of the year. This high population of water rats may, to some extent, be due to the abundance of the exotic fish species that occur in the River Torrens.

The Torrens System of land registration which is practiced in Malaysia can be traced back to Sir Robert Torrens in South Australia during the late eighteenth century. The land registration system should be made flexible enough to adapt to the changing of technologies but also secure enough to ensure that the registered proprietors have good title to their lands. This article is intended to explore the rigorous and somewhat tedious process that is provided under the National Land Code 1965 relating to the attestation of instruments before the presentation for registration.

<p> </p><p><span style="font-size: medium;"><span style="font-family: Times New Roman;"><em>In early 2015, the High Court of Australia decided </em>Cassegrain v Gerard Cassegrain &amp; Co Pty Ltd<em>, relating to the fraudulent registration of a joint tenancy under Torrens legislation. The Court unanimously criticised the methods employed by lower courts in interpreting New South Wales’ Torrens legislation (and its ‘protection of purchasers’ provision) and in determining the existence and scope of an agency relationship. However, the Court split on the question of whether an innocent joint tenant had their interest rendered defeasible by reason of their co-joint tenant’s fraud. This article reviews and analyses in particular the Court’s evaluation and treatment of the legal principles of joint tenancy.</em></span></span></p><p> </p><p><em>.</em></p>

Abstract:
Iḥyā’ al-mawāt is one of the methods to own certain land in Islam. Anyone who clears land and works on it has a right of ownership on the land. The method to own land by iḥyā’ al-mawāt is actually was practiced in Tanah Melayu before the British colonialisation. However, during the colonial period, they introduced a land system which is known as the Torrens system. The Torrens system is a system of land administration in which registration is very important to recognised land ownership and it is in contradiction to iḥyā’ al-mawāt. This principle was applied through the enforcement of the National Land Code. The question arises whether ihya’ al-mawāt can still be applied and recognised under the Malaysian land law. Therefore, the objectives of this paper are to discuss iḥyā’ al-mawāt and also to determine its place in the Malaysian land law. This paper which employs the content analysis method of court case and statute finds that iḥyā’ al-mawāt is not recognised under the Malaysian land law and further, it is an offence under section 425 of the National Land Code.
