O trabalho que agora apresentamos corresponde a algumas inquietações decorrentes de um dos aspectos fundamentais da nossa dissertação de doutoramento - a possibilidade de modelar a performance desportivomotora, a partir da integração das perspectivas de Fleishman e Quaintance (1984) e da metodologia da Modelação da Estrutura da Covariância. Trata-se sobretudo de uma exposição sem outras pretensões que não sejam a da estimulação da discussão e da crítica às idéias que avançaremos. A possibilidade de modelar a performance desportivo motora tem exercido um enorme fascínio em investigadores de diferentes áreas do conhecimento. A prová-lo estão as suas variadas e incessantes propostas. Thomas, Eclache e Keller (1 989) oferecem uma visão lata deste movimento no contexto do desporto de rendimento. Convém referir, no entanto e de acordo com a nossa perspectiva, que as propostas pictográficas dos vários autores nem sempre correm em paralelo com o vigor que deveria ser exigido aos enunciados teóricos que lhes servem de base, excepção feita para o modelo de Bouchard e Godbout (1 973).

ZusammenfassungKapitel 2 behandelt die wissenssoziologische Organisationsforschung als den theoretischen Bezugsrahmen der umgesetzten empirischen Untersuchung. Jeweils in mehreren Etappen wird Wissen zum einen in der Wissenssoziologie betrachtet, zum anderen in der Organisationsforschung beleuchtet. So entsteht zunächst ein Überblick über die wissenssoziologische Entwicklung von deren Anfängen bis in die Gegenwart, im Hinblick auf die Fragestellung dieser Studie und daher auch nicht durchgehend chronologisch. Zu Beginn geht es um Wissen, das auf Ideologien beruht oder durch diese erzeugt wird. Wesentliches in diesem Kontext zu behandelndes Gedankengut entstammt der Arbeit von Karl Mannheim. Es folgt ein Sprung in die entgegengesetzte Art der Wissenserzeugung, nämlich diejenige durch Wissenschaft. Zum einen wird auf die Ideologiekritik, die die Aufklärung hervorgebracht hat, eingegangen; zum anderen werden positivistische Konzeptionen, wie sie Auguste Comte begründet hat, in den Fokus der Betrachtung gerückt. Daraufhin richtet sich der Blick auf die klassische Wissenssoziologie der Moderne, welche anhand der Theorie von Max Weber vorgestellt wird. In der wissenssoziologischen Entwicklung folgt dann bereits die Gegenwart, die hier in ihrer sozialkonstruktivistischen Perspektive thematisiert wird: Überlegungen von Alfred Schütz, das Werk von Peter L. Berger und Thomas Luckmann und auch die derzeitige Wissenssoziologie anhand eines Aufsatzes von Oliver Dimbath und Reiner Keller. Ein Exkurs über Wissenskulturen schließt dabei einen ersten Block und leitet zugleich über in den zweiten. Dieser betrachtet Wissen aus dem Blickwinkel der Organisationsforschung. Anfangs steht die theoretische Perspektive auf Organisationen als Gegenstand der Soziologie, um daraufhin in theoretischer Hinsicht Wissen sowohl innerhalb von Organisationen zu bestimmen als auch die organisationale Wissensgenese im Vorfeld deren empirischer Untersuchung zu thematisieren. Sodann nimmt die Studie Bezug zu ihrem Fallbeispiel, indem sie zum einen das Kundenwissen als eine für die deutsche Automobilindustrie relevante Wissensart darlegt und zum anderen auf die Marktforschung als deren üblichen Weg der Wissensgenese eingeht. Abstract In this chapter, we meet Thomas Kelly’s (2014) argument for permissivism about rational belief. It is inspired by William James’ (1897) permissivism about attitudes to epistemic risk. We interpret Kelly’s argument using an account of epistemic value due to Kenny Easwaran (2016) and Kevin Dorst (2019). According to this, we encode Jamesian attitudes to epistemic risk in our epistemic utilities. For the epistemically risk-averse, the disvalue of believing falsely is greater than the value of believing truly; for the risk-inclined, it is reversed. Kelly holds that rationality requires us to do whatever maximises expected epistemic utility from the point of view of our evidential probabilities. He notes that, since rationality permits different attitudes to epistemic risk, which we encode in different epistemic utilities, the same evidential probability might demand of one person that they believe a proposition and of another that they withhold judgment. This gives permissivism about rational belief.

Public lawyers in the Weimar Republic conceptualized the law as a novel means of performing the following pressing tasks that confronted state and society in the twentieth century: the regulation of an industrial economy, the amelioration of economic inequality, and the negotiation of cultural disagreement. During the Kaiserreich, monarchically legitimated elites unilaterally executed comparable tasks. However, in the Weimar Republic, previously excluded social groups—for instance, those represented by the Catholic, Social Democratic, Communist and National Socialist parties—now vied with traditionally represented social forces in electoral and parliamentary fora to formulate and direct regulatory, redistributive, and socially integrative policy. This chapter focuses on the fraught but not necessarily hopeless relationship of law and the welfare state or Sozialstaat. It traces the way liberal and social democratic lawyers like Richard Thoma and Hermann Heller attempted to constitutionally legitimize novel efforts at political regulation, economic redistribution and social integration while avoiding the intellectual either/or's insisted upon by the dominant legal theorists of the epoch, Hans Kelsen and Carl Schmitt.

Abstract:
On May 9, 1880, on an American ship named the Bullion docked in the harbor of Yokohama, Japan, John Ross stabbed his crewmate Robert Kelly to death with a knife. As was the common practice at the time for Westerners who committed crimes in Asia, Ross did not face trial for murder before local Japanese authorities, nor did Japanese law influence the outcome of the case in any way. Rather, Ross’s trial was conducted by Thomas van Buren, the local American consul in Kanagawa, Japan. The trial occurred under consular jurisdiction (described in chapter 1 in this volume), a form of extraterritoriality that was commonly asserted in the past by European great powers in states they deemed “uncivilized.” Japan, though soon to join the ranks of the civilized nations, was at the time of Robert Kelly’s death compelled to afford the Western powers a free hand in adjudicating the crimes of their countrymen within Japan. The American consular court in Kanagawa convicted John Ross of murder and sentenced him to death. Although Ross was in fact British, the court held that because he was a seaman on a U.S. vessel he was subject to the jurisdiction of the United States. Ross’s death sentence was ultimately commuted to life imprisonment by President Rutherford B. Hayes. Apparently unsatisfied, in 1890 Ross brought a challenge to his murder conviction that rose to the Supreme Court. In the late nineteenth century the connections of American citizens to foreign places and foreign markets were rising rapidly. Extraterritorial jurisdiction was a European practice of long standing, but it became much more significant and extensive in the late nineteenth century. Ross’s case directly raised the question of the legality of such jurisdiction, not in terms of international law (that was generally unquestioned at the time), but in terms of domestic law. His case thus implicated the extraterritorial reach of constitutional rights at a time when imperialism was undergoing a major resurgence and the United States was assuming a more prominent place in international affairs than ever before.

Abstract:
A numerical approach is developed for simulation of pressure wave propagation in a tube containing a dilute concentration of small gas bubbles. The two-phase fluid is considered homogeneous and spatial distribution of bubbles is assumed to be uniform. Bubble oscillations are modeled using the Keller equation which accounts for liquid compressibility. Heat transfer between liquid and gas is included in the analysis through solution of the radial conduction equation for a spherical gas bubble with moving interface. An energy balance over the bubble surface determines bubble internal pressure, which is assumed to be uniform. Continuity and momentum relations for the homogenous mixture along with the Keller equation are used to derive an alternate set of equations, which are more amenable to application of elementary numerical methods. These alternate equations include a diffusion equation, which is linear in the homogeneous mixture pressure. Two additional equations define the bubble radius and gas-liquid interface speed in terms of the local spatial variation in the homogeneous pressure field. The diffusion equation is solved easily using the second-order accurate Crank-Nicolson method in conjunction with the Thomas algorithm for the discretized tridiagonal algebraic system. The remaining equations comprising the fluid model are solved with an explicit, second-order accurate predictor-corrector scheme. The present approach avoids the need for staggered grids and iterative pressure correction methods used in previous work. Numerical calculations are carried out for a shock wave in a liquid column containing gas bubbles. Results show good agreement with experimental data available in the literature.
