Abstract:
Європейська комісія розглядає малі та середні підприємства (МСП) та підприємництво як ключове для забезпечення економічного зростання, інновацій, створення робочих місць та соціальної інтеграції в ЄС. У розвинених країнах ЄС частка малих та середніх підприємств понад 99% у всіх сферах бізнесу та забезпечує робочі місця для майже 65 мільйонів громадян або близько 70% зайнятих країн ЄС. Результати аналізу показали, що у 2015 р. в середньому та малому бізнесы було задіяно понад 133 мільйони людей в ЄС. Протягом трьох місяців у 2016 році сектор малого та середнього бізнесу в цілому давав 57,5% валової доданої вартості, отриманої приватною нефінансовою економікою в ЄС.
Европейская комиссия считает малые и средние предприятия (МСП) и предпринимательство ключевыми для обеспечения экономического роста, инноваций, создания рабочих мест и социальной интеграции в ЕС. В развитых странах ЕС доля МСП превышает 99% во всем бизнесе и обеспечивает рабочие места почти для 65 миллионов граждан, или около 70% занятого ЕС. Результаты анализа показали, что в 2015 году МСП заняло более 133 миллионов человек в ЕС. В целом по секторам МСП - 57,5% валовой добавленной стоимости, созданной частной, нефинансовой экономикой в ЕС в течение трех месяцев 2016 года.
The European Commission considers Small and Medium Sized Enterprises (SMEs) and entrepreneurship as key to ensuring economic growth, innovation, job creation, and social integration in the EU. In developed EU countries, the share of SMEs over 99% in all business and it provides jobs for almost 65 million citizens, or about 70% of the employed EU. The results of analysing showed that in 2015 SME employed more than 133 million people in EU. The SME sector as a whole delivered 57.5% of the gross value added generated by the private, non-financial economy in EU during three months in 2016.

Стратегії енергетичної безпеки є основою для економічного зростання країн на шляху до сталого розвитку. Четверта промислова революція викликає нові виклики і є основою для Industry 4.0. Європейський Союз постійно шукає інформаційні, економічні та технологічні перетворення, які призведуть до формування концепції "Енергія 4.0". Поточна цифралізація галузей обумовлює перехід до відновлюваних ресурсів. Це в основному стосується "зеленої" енергії (сонячної, геотермальної енергії вітру, припливної енергії).
Стратегии в области энергетической безопасности являются основным элементом экономического роста стран на пути к устойчивому развитию. Четвертая промышленная революция создает новые проблемы и составляет основу для индустрии 4.0. Европейский союз постоянно ищет информационные, экономические и технологические преобразования, которые приведут к формированию концепции Energy 4.0. Текущая цифровизация отраслей промышленности приводит к переходу на возобновляемые ресурсы. Это в основном относится к «зеленой» энергии (солнечная энергия, ветер, геотермальная энергия, энергия приливов).
Energy security strategies are the core pillar for countries economic growth on the way to sustainable development. The Fourth Industrial Revolution brings new challenges and forms the basis for Industry 4.0. The European Union is constantly seeking for information, economic and technological transformations that would lead to formation of Energy 4.0 concept. Ongoing digitalization of industries causes the transition to renewable resources. It refers basically to "green" energy (solar, wind geothermal heat, tidal energy).

Abstract:
This thesis is based on the theoretical knowledge derived from the European integration experience to conduct a comparative study between the EU and ASEAN. This thesis investigates how endogenous factors affect how exogenous factors influence the EU and ASEAN institution building process within the European Single Market and ASEAN Free Trade Area. It argues that ASEAN members' domestic political interest and national preference formed within their cultural context as a result of their informal institutional economic cooperation. The thesis reviews literature and finds that the European model cannot be simply applied to ASEAN, thus a combination of new regionalism and liberal intergovernmentalism seeks to contribute alternatives to different aspects in the analysis of ASEAN regional integration.

V práci jsou analyzovány kořeny, vývoj, současné postavení, hrozby a výzvy think-tanků v České a Slovenské republice. Srovnání s jejich tradicí ve Spojených státech zkoumá přenositelnost amerického "modelu" think-tanků do střední a východní Evropy. Tento přenos je značně omezený a krátkodobě nerealizovatelný vzhledem k rozdílným legislativním podmínkám a nerozvinuté filantropii. Zvláštní pozornost je věnována motivům k vytváření regionálních i mezinárodních sítí think-tanků. Práce vychází jednak z dosavadní literatury na toto téma, jednak z dotazníkového šetření.

Стаття показує важливість розвитку відновлюваних джерел енергії. Більшість досліджень пов’язує зменшення викидів парникових газів із заміною традиційних джерел енергії на альтернативні. ЄС досяг значного успіху, отримавши лише за рахунок сонця і вітру 21% в загальній кількості електроенергії в 2020 р. Інтеграція України до Європейського Союзу є стратегічним напрямом України в реалізації зарубіжної політики країни.
The paper shows the importance of renewable energy sources development. Most studies have found that a reduction of greenhouse gases emissions can be achievable by replacing conventional sources of energy with alternative ones. The EU has achieved significant success, getting only wind and solar in total electricity generation 21% in 2020. The integration of Ukraine to the European Union is a strategic direction of the country foreign policy.

This dissertation analyzes the thinking of Georges Bataille with the objective to investigate in his intempestivity the conception of eroticism. The complex movement that the author wages to develop this concept allows new possibilities to approach the nature/culture border, as well as animality and humanity concepts. In the introdution of The Eroctism the author announces to be in search of the Man in its totality, turning himself against the fragmentaries lines to pursuit the idea of a whole. This pursuance will be given by human passion and its only object, that implies in a tour upon the human spirit and its inner life. In the innerness of the being there is the encounter with the most overwhelming experiences, with the holy, the beauty, the horror and the passion. In the Baitaille's proposition there isn't borders between man and animal, mind and body, life and death; these instances constantly overflows one another and is in this intempestive movement that he sees the totality of the being. In this complex and unexpected field of human inner life, the being oversteps the limitrophes of the objective conscience into disconcerting experiences in which the conscience dissolves itself in the corporeal. The intent of this work it's to comprehend the totality that the batailliam thought seeks to reach in the inner experience consception by the means of problematization of the notions of eroctism, animality and humanity
Esta dissertação analisa o pensamento de Georges Bataille com o objetivo de investigar em sua intempestividade a concepção de erotismo. O complexo movimento que o autor trava ao desenvolver esse conceito permite novas possibilidades para abordar a fronteira natureza/cultura, assim como os conceitos de animalidade e humanidade. Na introdução de O Erotismo o autor anuncia estar à procura do homem em sua totalidade, volta-se contra as linhas fragmentárias para perseguir a ideia de conjunto. Essa busca se dá pela paixão humana e seu único objeto, que implica num passeio sobre o espírito humano e sua vida interior. Na interioridade do ser há o encontro com as experiências mais avassaladoras, com o sagrado, a beleza, o horror e a paixão. Na proposta de Bataille não há fronteiras entre homem e animal, mente e corpo, vida e morte; estas instâncias constantemente transbordam uma na outra e é neste movimento intempestivo que vê a totalidade do ser. Neste campo complexo e imprevisto da vida interior humana, o ser ultrapassa os limítrofes da consciência objetiva para experiências desconcertantes em que a consciência se dissolve no corpóreo. ЄС запускає суперкомп’ютерну мережу для підтримки європейських програм досліджень і розробок, а також розробки та впровадження інноваційних технологій у критичних промислових областях. Європейські компанії досліджують взаємодію блокчейну з Інтернетом речей, а потім обговорюють, як технологія блокчейн може сприяти концепції IoT, надаючи децентралізовану платформу для централізованого підходу до Інтернету речей.
The main criteria of disruptive technologies are high potential need of humanity or many users, increased accessibility to everyone, and relatively low cost. The EU launches a supercomputer network to support European R&D programs and develop and implement innovative technologies in critical industrial areas. European companies investigate the interaction of the blockchain with the IoT and then discuss how blockchain technology can contribute to the IoT concept by providing a decentralized platform for a centralized IoT approach.

This dissertation focuses on the musical experiences of senior women. The general purpose of the research is to comprehend the musical experiences in the memories of elderly women, and, as specific objectives, it was intended to evoke spaces in which these musical experiences happen/have happened, reconstruct the kinds of musical experiences, interpret the means through which these experiences were lived, describing and discussing the content of these experiences. Considered as qualitative research, it has as methodological option the Oral History and uses the interview as procedure for collecting information. Participated in this study 10 elderly women who are part of the Coral AFRID (Project Physical Activity and Recreational Facilities for the Elderly).The theoretical reference is based on the discussion concerning the musical experience as social experience, as well as the issues regarding the memory and recollections related to the memory of elderly people, which, in this case, are women. It was observed that the musical experiences of the women happened mainly in the areas of family, home, school, church, parties. Musical experiences related to music, with singing, see the play. The radio was the medium most used by the elderly to live music throughout their lives. The memories are permeated with musical learning from experienced to learn when they listen to or sing along and / or alone. It is believed that that this study contributes to the area in the elaboration of musical-pedagogical propositions involving this public, for the planning and organizing of public politics related to the aging process, the comprehension of the ways music and its teaching/learning can be present in this process, enabling a different perception of oldness.
Esta dissertação tem como foco as experiências musicais de idosas. O objetivo geral da pesquisa é compreender experiências musicais que estão nas lembranças de idosas, e como objetivos específicos pretendeu-se evocar espaços nos quais essas experiências musicais acontecem/ram, reconstruir os tipos de experiências musicais, interpretar os meios pelos quais essas experiências foram vividas, descrevendo e discutindo o conteúdo dessas experiências. Considerada como pesquisa qualitativa, tem como opção metodológica a História Oral e utiliza a entrevista como procedimento de coleta de dados. Participaram dessa pesquisa 10 idosas que fazem parte do Coral do AFRID (Projeto de Atividades Físicas e Recreativas para Idosos). O referencial teórico tem como base a discussão sobre experiência musical, como, por exemplo, experiência social, e a questão da memória e da lembrança relacionadas à memória de velhos , os quais, nesse caso, são mulheres. Observou-se que as experiências musicais das idosas aconteceram, principalmente, nos espaços da família, das casas, escola, igreja, festas. Experiências musicais relacionadas com o ouvir música, com o cantar, com o ver tocar. O rádio foi o meio mais utilizado pelas idosas para vivenciar a música ao longo de suas vidas. As lembranças são permeadas de aprendizagens musicais vividas a partir de quando escutam para aprender ou cantam junto e/ou sozinhas. Acredita-se que esse estudo possa contribuir para a área da educação musical na elaboração de propostas pedagógico-musicais que envolvam esse público, para a organização e planejamento de políticas públicas relacionadas ao envelhecimento, para a compreensão das maneiras que a música e o seu ensino/aprendizagem podem marcar presença nesse processo, possibilitando outra percepção da velhice.

This study aims the reading of the novel O falso mentiroso: memórias, by Silviano Santiago, as literary space, according to Maurice Blanchot‘s concept, where literary experiences enable an action of dilution of its own limits, such as reality and fiction, in a constant self-questioning exercise. The axis of Silviano Santiago‘s critical thought axis is the ―space-in-between" concept, based on the anthropophagic ritual, which deconstructs binary speeches and the concept of origin. Essential to us understand the literary relations and how this studied novel sets dialogs between fiction and the author‘s theory, therefore, between the fictitious writer and the reviewer. Connected to discussions of authors such as Walter Benjamin, Michael Foucault e Giorgio Agamben, we conceive Silviano Santiago‘s novel literary space as a place of deconstruction, where statutes are rated under suspicion and where the literature is also, theory.
Este trabalho propõe a leitura do romance O falso mentiroso: memórias, de Silviano Santiago, como espaço literário, apropriando-se do termo de Maurice Blanchot, onde experiências literárias possibilitam um processo de diluição dos seus próprios limites, como realidade e ficção, em um exercício de autoquestionamento constante. O eixo do pensamento crítico de Silviano Santiago é o conceito de ―entre-lugar‖ que, baseado no ritual antropofágico, descontrói discursos binários e o conceito de origem. Sua compreensão torna-se essencial para entendermos as relações literárias e como o romance aqui estudado estabelece diálogos entre a ficção e a teoria do autor, logo, entre o ficcionista e o crítico. Articuladas às discussões de autores como Walter Benjamin, Michael Foucault e Giorgio Agamben, pensamos o espaço literário do romance de Silviano Santiago como um lugar de desconstrução, onde estatutos são colocados sob suspeita e onde a literatura é, também, teoria.

Resumo: O objetivo dessa tese consiste na penetração reflexiva da questão da subjetividade contemporânea a partir de uma manifestação estética, a literatura, no romance Em busca do tempo perdido. O romance de Proust atesta exemplarmente um momento de ruptura que coloca em questão o eu linear e articulado do romance tradicional, na medida em que apresenta uma série de aporias, tensões e contradições que revelam uma crise da subjetividade. Nossa investigação se situa na discussão das fronteiras entre filosofia e literatura, por meio do estudo das relações entre forma e conteúdo e da contribuição da identidade narrativa para pensar filosoficamente a problemática da constituição do si e sua interpretação. Para explicitar esse problema é necessário analisar o longo percurso da obra que descreve a desilusão como aprendizagem da verdade e, concomitantemente, problematizar a verdade atingida por meio de aporias irresolúveis que se renovam na circulação de sentido no romance. A tensão das relações entre unidade e multiplicidade, literatura e vida, desejo e realidade, tempo e eternidade, verdade e estilo, conduz ao estudo da experiência como negatividade que se configura na morte dos eus e, simultaneamente, na multiplicação de eus no espaço narrativo. As implicações dessa experiência dialética apontam para a questão do sentido da obra que se apresenta aberto a múltiplas possibilidades de interpretação
Abstract: This thesis aims at investigating reflectively into the issue of contemporary subjectivity departing from an aesthetic manifestation ¿ literature ¿ in the novel A la recherche du temps perdu. Proust¿s novel typically represents a moment of rupture which calls into question the linear and articulated 'I¿ of the traditional novel, in so far as it presents a series of aporias, tensions and contradictions which reveal a subjectivity crisis. Our research has as its basis the discussion of the boundaries between philosophy and literature, through the study of the relations between form and content and of the contribution of narrative identity to the philosophical reflection on the problem of self-constitution and self-interpretation. In order to make this question explicit it is necessary to analyze the work¿s long course, which describes disillusion as truth-learning and, at the same time, problematizes the truth reached by means of insoluble aporias that renew themselves in the circulation of meaning in the novel. The tense relations between unity and multiplicity, literature and life, desire and reality, time and eternity and truth and style lead to the study of experience as negativity, which is configured as the death of the 'I¿s and, simultaneously, in the multiplication of the 'I¿s in the narrative space. The implications of this dialectic experience point to the issue of the work's meaning, which is open to multiple interpretation possibilities

Esta tese à uma etnografia dos fazeres juvenis elaborados e vivenciados pelos/as jovens cearenses ao produzirem e atuarem com um cosplay. Na busca de compreender esses fazeres, foram acompanhados 10 jovens em seus percursos cotidianos e em eventos (SANA), no perÃodo de 2014 a 2016. Os suportes teÃricos da tese foram: Certeau (1995; 2013), Nunes (2015), Ortiz (2007; 2009), Deleuze e Guatarri (1997), Turner (2013), Schechner (2012), Pais (2003; 2005; 2006), Ferreira (2016), Louro (2003; 2008a), Larrosa (2016), Sales (2014; 2016a), Joca (2013) dentre outros. Esses/as jovens cosplayers estÃo inseridos em uma cultura pop que à multitemÃtica e traz para as suas performances uma diversidade de personagens e histÃrias para customizarem esses fazeres que partem da escolha desses personagens para entrar em cena e aos fazeres das mÃos que customizam a roupa e os acessÃrios. Ao atuarem como cosplayer no CearÃ, eles/as tÃm referÃncias de uma cena cosplayer apresentada em outros estados brasileiros, em outros paÃses como o JapÃo e os Estados Unidos, no entanto, conseguem tecer suas maneiras de ser cosplayer, simbolizados em suas atuaÃÃes, mas principalmente nos fazeres das mÃos, produzidos no cosplay e em todos os seus acessÃrios. Nesse processo de atuaÃÃo como cosplayer, os/as jovens elaboram fazeres ritualizados e performÃticos para adentrar e se fixar na cena cosplayer. Vivenciam seus ritos de iniciaÃÃo, e nesse processo buscam ser aceitos pelos/as cosplayers que jà atuam em cena, assim como pelos grupos. Na performance desses personagens, rompem com os marcadores de gÃnero homem/mulher para corresponderem as suas preferÃncias de como querem se apresentar nos palcos. Por fim, desde a escolha do personagem, o conhecimento da sua histÃria, as performances que deverÃo ser elaboradas à customizaÃÃo do cosplay e dos acessÃrios, eles/as anunciam diversas experiÃncias de aprendizagem, seja com o corpo ao usar as mÃos para customizarem suas roupas e demarcarem as suas habilidades e criatividades, seja em suas performances ao se prepararem para estar em cena. Todos esses fazeres promovem nos/as jovens a capacidade de mudar a sua realidade juvenil e tecer enredos que vÃo compor as suas sagas juvenis dentro e fora do universo cosplay.

A presente dissertação toma como propósito as obras poéticas de Ricardo Reis e de Paul Celan, acentuando a sua tarefa de originar uma poesia de risco, que experiencia a linguagem e a ameaça. Nesse sentido, a pesquisa desenvolvida reconhece a singularidade da leitura imposta pelos poemas. Tal fato estabelece algumas especificidades da leitura, sem pretender com elas decifrar qualquer conteúdo nos poemas escolhidos. Dessa maneira, esse trabalho recolhe, coleciona e elege premissas de compreensão derivadas de outros ambientes literários. Assim, a hipótese fundamental sustentada ao longo da dissertação expõe o próprio desempenho da leitura como exercício de escrita, sem recorrência a qualquer facilidade contextual, historicista ou formalista; ou melhor: o que é ler Ricardo Reis pós Paul Celan, tomando como elemento básico a própria experiência de risco da leitura
The present dissertation takes as purpose Ricardo Reis and Paul Celans poetic works, emphasizing their task of originating a poetry of risk, which experiences and threatens language. In this sense, the research developed acknowledges the singularity of the reading imposed by the poems. This fact establishes some specificities of reading, which do not intend to decipher any content in the chosen poems. In this way, this work guards, collects and elects premises of comprehension derived from other literary environments. In this thesis, Greek, Portuguese and Spanish accession of European Union is investigated. Agricultural production, consumption and trade patterns of Greece, Portugal and Spain have changed by the full application of Common Agricultural Policy. The commodity composition of these countries experienced an adjustment, too. The production of vegetables, fruits, fish and other typical Mediterranean products have increased. The composition of consumption has moved from low-income elastic products to high-income elastic products. The agricultural trade direction of these countries has shifted to the European Union. Trade with neighbouring EU member states increased relatively faster than the trade increase with other members of the European Union. Most of the trade volume of these countries is with the Mediterranean countries of the European Union.

Bakgrund: Globalisering och folkvandringar ställer nu helt andra krav på hälso- och sjukvård i hela Europa. Bara i Sverige är 1/5 av Sveriges befolkning är födda i andra länder är Sverige. Vi är med andra ord ett mångkulturellt samhälle. Detta ställer den svenska sjukvården inför stora utmaningar och på hur sjuksköterskorna förmår att möta denna utmaning i det dagliga omvårdnadsarbetet. Syfte: Att beskriva sjuksköterskors erfarenheter av att vårda patienter med olika kulturella bakgrunder. Metod: En deskriptiv litteraturstudie utfördes med hjälp av tio kvalitativa studier. Resultat: Resultatet i detta arbete beskriver omvårdnadsarbetet med transkulturella patienter i tre dimensioner enligt följande: kommunikationsproblem, kulturellt könsrollsrelaterade diskrepanser samt avslutningsvis, att sjuksköterskorna påvisar stereotypisering vid arbete med transkulturella patienter. Slutsats: Det har framkommit i detta arbete att sjuksköterskor i sitt dagliga arbete med transkulturella patienter upplever olika språk, kommunikations och kulturrelaterade problem i den praktiska omvårdnadssituationen. Den transkulturella omvårdandsteorin har gjort anspråk på att kunna förklara och lösa denna typ av friktion mellan sjuksköterskan och de transkulturella patienterna, men har inte lyckats göra detta. Det har föreslagits att den transkulturella omvårdandsteorin är inaktuell för dagens snabba föränderliga mångkulturella migration. Det behövs ny forskning som kan stödja sjuksköterskeprofessionen in i framtiden
Background: Globalization and immigration now make completely different demands on healthcare service throughout Europe. In Sweden one fifth of the population are born in another country. In other words, Sweden is a multicultural society. The healthcare service of Sweden faces a great challenge and in how nurses are capable to meet this challenge. Aim: The purpose of this study was to describe nurses' experiences of caring for patients with different cultural backgrounds. Method: A descriptive literature study was performed analyzing ten qualitative studies. Result: It has been found in this thesis that when working with transcultural patient’s nurse’s experiences problems in three dimensions surrounding the nursing situation. The problems were the following: Language and communications problems, culture-gender role discrepancies and finally stereotyping by nurses. Conclusion: It has been found that nurses in their daily work with transcultural patients experience different cultural problems in their nursing situation. The transcultural care theory has claimed to be able to explain and solve this kind of friction between the nurse and the transcultural patient, but not managed to do so. It has been argued that the transcultural care theory has proven to be out-of-date for today’s fast multicultural migration. New research is needed to support the nursing profession into the future.

Esta tese trabalha uma concepção fundamental para a Psicologia: a de indivíduo, tal como compreendida na obra de Theodor W. Adorno. Neste estudo, essa concepção foi analisada à luz das considerações de Adorno à peça Fim de Partida, de Samuel Beckett. No ensaio Intento de entender Fin de Partida, Adorno avalia essa peça como denúncia realista das condições deterioradas de formação do indivíduo. Para Adorno, é por meio da forma de paródia do drama que a peça expõe a dilaceração das possibilidades de contato entre os homens e destes com a natureza e o mundo. Nesse contexto, outro conceito se fez importante: o de experiência, tal como o entende Walter Benjamin. Esse conceito também foi fundamental para Adorno desenvolver suas análises sobre as condições de constituição do indivíduo. Essas referências iluminam a obra beckettiana, que se desvela em seu aspecto formal como historiografia do sofrimento e explicita o caráter fragmentário e impotente com que a concepção de indivíduo se apresenta na modernidade
This thesis discusses a fundamental conception for Psychology: the individual, as it is conceived in the works of Theodor W. Adorno. In this study, this conception was analyzed in the light of Adorno considerations to the play Endgame, by Samuel Beckett. In the essay Trying to Understand Endgame, Adorno evaluates this play as a realistic denunciation of the deteriorating conditions of the individual\'s formation. For Adorno, is through the form of drama\'s parody that the play exposes the disruption of contact opportunities between the men and between those with the nature and the world. In this context, other concept became significant: the experience, such as Walter Benjamin understands it. This concept was also essential for Adorno develop his analysis of the conditions of the individual\'s constitution. These references illuminates the work of Beckett, which is revealed in its formal aspect as a historiography of the suffering and explains the powerless and fragmentary character that the conception of the individual shows in modernity

Esse texto diz de experiências de encontros. Encontro com uma perspectiva de pesquisa em Educação, encontro com a não-binaridade de gênero, encontro com pessoas que se diferenciam do binário de gênero, encontro com a diferença. Todos esses – e ainda outros – produziram essa pesquisa que agita as questões de gênero e Educação se lançando ao rompimento de binarismos. Dos questionamentos que costuro nesse texto destaco um que atravessa todos os outros: como as experiências na não-binaridade de gênero movimentaram e movimentam outras experiências? Utilizo retalhos teórico-metodológicos pós-estruturalistas, retalhos poéticos de Federico García Lorca e retalhos narrativos para formar essa colcha. As narrativas foram produzidas através de conversas com três pessoas que não fixam suas identidades enquanto femininas ou masculinas, mas intentam se desterritorializar esse binário. Conversei com cada pessoa duas ou três vezes e suas histórias as tornam coautoras desse texto e pesquisa – o narrar-se durante essas conversas foi, também, uma (re)invenção de nossas próprias diferenças de gênero. Observo e exploro alguns atravessamentos entre as narrativas e as leituras de autoras e autores do campo do Gênero e da Educação: a identificação de uma matriz de gênero binária produzida por diversos espaços e instituições e que provocará fortes subjetivações; as tentativas de rompimento com tal matriz a partir de dimensões corporais, estéticas e morais; e as relações (harmoniosas ou desconfortáveis) constituídas a partir desse rompimento consigo mesmo e com o mundo. Uma pesquisa que vibrou em mim costuras de desestabilizações, provocações e questionamentos, muito mais que certezas: “deixaria nesse livro toda minha alma...” (LORCA, 2004, p. 571)
This text is about encounter experiences. Meeting with a research perspective in Education, meeting with non-binarity of gender, meeting with people who differ from gender binary, meeting with difference. All these meetings - and still others - produced this research that stirs in the questions of gender and Education and that launches to the breaking of binarismos. Of the questions that I put together in this text I highlight one that crosses all others: how have experiences in non-binarity of gender moved other experiences? I use poststructuralist theoretical-methodological flaps, poetic flaps by Federico García Lorca and narrative flaps to form this quilt. The narratives were produced through conversations with three people who do not fix their identities as female or male, but try to deterritorialize this binary. I have talked to each person two or three times, and their stories have made them the co-authors of this text and research - to narrate it during these conversations was also a (re)invention of our own gender differences. I observe and explore some crossings between the narratives and the readings of authors of the field of Gender and Education: the identification of a matrix of binary gender produced by diverse spaces and institutions and that will provoke strong subjections; the attempts to break with such a matrix from bodily, aesthetic, and moral dimensions; and the relations (harmonious or uncomfortable) constituted from this break with himself and with the world. research that vibrated in me seams of destabilization, provocations and questions, much more than certainties: "I would leave this book in my soul ..." (LORCA, 2004: 571).

Abstract:
During the term of 2010 we received a Minor Field Study scholarship from the Swedish International Development Cooperation Agency (Sida), which allowed us to do a two-month study in Tirana, Albania. The study examined one of Europe’s most common tools when it comes to assisting candidate countries, potential candidate countries, and neighbouring countries of the European Union: Twinning. The idea of Twinning is that the beneficiary country gets assistance from EU member state institutions in order to develop its own institutions, in terms of standards of quality and safety. We have observed a Twinning project structured in the form of a consortium between the Swedish Tax Agency and the French Tax Agency assisting the Albanian General Tax Directorate (GTD) in Tirana. The study highlights the relationship between the four different actors involved in the ongoing project (EU, Sweden, France and Albania) and Twinning as a working method. More specifically we investigated (A) the transition from an old to a new system and if any difficulties emerged in the process, (B) what necessary factors are needed for a successful Twinning project, and (C) how the actors’ different backgrounds affect the project. The result we gained from the field study shows that the transition towards a new system progresses well as long as the project follows the main principles of Twinning: partnership and cooperation. These two principles allow the Albanian GTD to direct the project and decide the direction of their Europeanization process. Twinning generates many positive aspects e.g. institutional understanding and friendship, and it brings the cooperating nations closer to each other. The difficulties that have emerged have been technical or when one of the actors has not followed the structure of the project. These difficulties are natural in the beginning of any project since structures and relations take time to establish. Three main qualities affect the outcome of this Twinning project: experience, flexibility and communication. Actors involved in the project have to be experienced, in form of personal as well as institutional experience. Besides, they have to be flexible since the project follows the development of society where unpredicted needs can emerge. Most importantly, communication has to be free from friction between the actors in order to maintain the partnership principle of Twinning. Our analysis shows that the outcomes of this Twinning project are mutually shaped between the actors involved. Therefore, the emphasis should be on personal abilities to mutually create a working structure that follows the principles of Twinning.

The EU experience shows the best legislative and socio-economic mechanisms to ensure the Third (T.i.r.) and Fourth Industrial Revolutions (F.i.r.). There are three major groups of instruments used to ensure the T.i.r. and F.i.r. goals in the EU countries: hard law - orders and directives, prohibitions, restrictions or licensing procedures; economic instruments (market-oriented laws) - green taxation, environmental payments, certificates (trade permits) or liability, green subsidies and promotion schemes, as well as disclosure of subsidies that are harmful to the environment (for example, subsidizing fossil fuel prices); soft law - information, management systems, exchanges of experience or binding agreements between government agencies and private business associations (“green" agreements or unions).

Neste texto, trago o que foi produzido a partir do meu encontro com sete professor@s que se auto identificam como homossexuais. Constituo-me como apresentador de outras vidas, apresentador de sete diferentes vidas. Foram convidados para serem coautor@s desta pesquisa professor@s da educação básica, tendo em vista os poucos estudos existentes que relacionem a sexualidade dess@s professor@s com a profissão docente. A questão analisada nesta pesquisa parte da seguinte inquietação: “Quais as narrativas, experiências e de que modos se constituem @s professor@s homossexuais?”. Utilizo como referencial teórico-metodológico a perspectiva pós-estruturalista. A partir dessa perspectiva pude problematizar as formas pelas quais @s professor@s vão se constituindo enquanto docentes homossexuais e discutir como ess@s professor@s vão se produzindo nas relações de poder, nas relações com o outro e, sobretudo, como se relacionam com a instituição escolar. Na tentativa de imergir no campo e buscar informações para serem problematizadas, lancei mão de entrevistas narrativas, encarando esse instrumento de pesquisa não apenas como um conjunto de falas isoladas, mas como narrativas de si dess@s sujeitos, pois narrar um fato não é apenas relatar ou viver o que já passou, implica uma certa experiência. Assumir-se enquanto professor/a homossexual organiza a forma com que o sujeito se comporta dentro escola, vivenciando um contínuo processo de negociação com o outro e consigo mesmo. Ao mesmo tempo tal atitude é um ato político que expõe as múltiplas maneiras possíveis de vivência da sexualidade. @s professor@s homossexuais vão corajosamente criando suas próprias existências e se distanciando do padrão heteronormativo de ser, colocando em suspensão as crenças e as lógicas binárias (homem/mulher, normal/anormal, homossexual/heterossexual, etc.) que estão ao nosso redor nos cerceando da experienciação de diferentes modos de vida. Assim, @s professor@s homossexuais instigam e provocam os outros e a si mesm@s a repensarem as práticas sociais que dão sentido e regem a sociedade contemporânea. No decorrer desta travessia não pretendi e nem desejei produzir certezas e/ou verdades, pelo contrário, quis que elas fossem problematizadas, colocadas em questão, discutidas, abaladas e desmanchadas.
In this paper, I bring what was produced from my meeting with seven teachers who self identify as homosexual. Consisting me as host of other lives, presenter of seven different lives. Were invited to be co-authors of this research basic education teachers, given the few existing studies that relate sexuality of these teachers with the teaching profession. The research question examined in this part of the following concerns: "What are the narratives, experiences and modes that constitute homosexual teachers?". Use as a theoretical and methodological framework poststructuralist perspective. From this perspective could question the ways in which teachers constitute themselves as homosexual teachers and discuss how these teachers will be producing power relations, in relations with each other, and especially how they relate to the academic institution. In an attempt to immerse themselves in the field and look for information to be problematized, threw hand narrative interviews, facing this research tool not only as a set of isolated lines, but as narratives themselves these subjects because narrate a fact is not just reporting or live what has passed, implies a certain experience. Coming out as a teacher homosexual organizes the way the subject behaves in school, experiencing an ongoing process of negotiation with others and with yourself. While such an attitude is a political act that exposes the multiple possible ways of sexuality. Homosexual teachers will boldly creating their own stocks and away from the heteronormative pattern of being, by suspending beliefs and binary logic (man/woman, normal/abnormal, homosexual/ heterosexual, etc.) that are around us in abridging of experiencing different lifestyles. Thus, homosexual teachers pique others and themselves to rethink the social practices that give meaning and govern our contemporary society. During this crossing did not intend nor wished to produce certainties and/or truths, by contrast, had them problematized, called into question discussed, shaken and cut up.

This thesis deals with the issue of what would be the best rules and procedures that Korea could adopt in respect of the private enforcement of competition law, in particular in respect of actions for damages. Its central objective is to analyze how private enforcement could achieve the objectives of competition law such as ensuring competition and protecting consumer interests effectively. In achieving objectives of competition law, optimal enforcement through effective and efficient combination of private and public enforcement is important because it could ensure the most effective distribution of resources between private and public enforcement. In respect of private competition enforcement, Korea wishes to encourage and facilitate private enforcement. However, there is a high possibility that many problems arise over the private enforcement of competition law. The problems include the issues of standing; criteria and measurement of damage; passing on defense; indirect purchaser actions; class and representative actions; and the possible impact of private actions on public enforcement. This thesis explores the issue of the best solution to some of the most important of these issues for Korea in the context of four pervasive themes i) the objectives of competition law ii) the legal and competition law culture of Korea, iii) the relationship between public and private enforcement and iv) the experience of certain other jurisdictions (the US, the EU, and the UK). The analysis takes into account these three comparator jurisdictions for the following reasons. The US has the most mature and long-established system of competition law in the world. The EU is at a particularly interesting stage as regards private enforcement as the European Commission is actively seeking to promote it. The UK is a Member State of the EU and it is therefore useful to look at the UK as a jurisdiction in which the EU rules are actually applied. The final conclusion reached by the analysis of these three jurisdictions.

In this research have been analyzed the experiences of migrants workers that arrived at the region of Ribeirão Preto in decades 1980, 1990 and 2000. We seek to understand the actions of these citizens in the transformation of the region, as well as the conflicts that they experienced with other local groups for the conquest of the space and the right of belonging in the place. For the analysis of the interviews realized with the workers we could observe the forms of survival created by these citizens in the region of Ribeirão Preto, based in complicity relations that make possible the arrival, the permanence and the survival in the place. We still observed the tensions around the question of the migration for the region of Ribeirão Preto from years 1980, when local sectors have started to debate the presence of the migrant in the place, constructing interpretations that, many times, criminalized the presence of these citizens and charged the public intervention by means of the creation of the centers of selections.
Nesta pesquisa foram analisadas as experiências de trabalhadores migrantes que chegaram à região de Ribeirão Preto nas décadas 1980, 1990 e 2000. Procuramos compreender as ações desses sujeitos na transformação da região, bem como os conflitos vivenciados com outros grupos locais pela conquista do espaço e do direito de pertencimento ao local. Pela análise das entrevistas realizadas com os trabalhadores, pudemos observar as formas de sobrevivência criadas por esses sujeitos na região de Ribeirão Preto, baseadas em relações de cumplicidade que viabilizam a chegada, a permanência e a sobrevivência no local. Abordamos, ainda, as tensões em torno da questão da migração para a região de Ribeirão Preto a partir dos anos 1980, quando setores locais passaram a debater a presença do migrante, construindo interpretações que, muitas vezes, criminalizavam a presença desses sujeitos e cobravam a intervenção pública por meio da criação dos centros de triagens.

O presente trabalho se propõe a analisar as experiências dialógicas entre cinema e educação a partir do projeto Cinema para Todos, de oficinas de audiovisual no Estado do Rio de Janeiro. Partindo das relações entre Mídia e Cotidiano, refletirá sobre o cinema como estratégia comunicacional que vai do ambiente escolar até a experiência do espaço urbano como forma de compartilhamentos sensíveis e estímulo às invenções coletivas - essenciais à formação do ser. Tal análise tem lugar num momento da atualidade1 onde sujeito e sociedade sofrem importantes mudanças, a escola como meio de reprodução de práticas sociais passa por uma crise sem precedentes e parece haver uma transformação do político na sociedade atual em detrimento de um fortalecimento cada vez maior das mídias no cotidiano. Deste modo busca-se compreender em que medida a experiência sensível com o cinema pode gerar vinculações sociais dos alunos em relação a seus pares e às suas comunidades. Ao longo da pesquisa foi delineado um caminho cujos eixos centrais se sustentam no método de pesquisa de campo, pesquisa qualitativa com entrevistas em profundidade, pesquisa quantitativa com entrevistas fechadas e revisão bibliográfica para pensar o papel do audiovisual na intervenção do cotidiano e na mediação com a sociedade através dos conceitos de cinema (BENJAMIN, 2012; BERGALA, 2008), vinculação social (SODRÉ, 2010), educação (SODRÉ, 2012; SIBILIA, 2012), héxis educativa (SODRÉ, 2010) e experiência sensível (MAFFESOLI, 1998)
This paper is intended to analyze the dialogue between cinema and education from the Cinema for All project, audiovisual workshops in public schools of the State of Rio de Janeiro. Based on the relationship between Media and Everyday Life, reflect on the cinema as communication strategy in the school environment as a way to share sensitive experiences and stimulate collective inventions - essential to the formation of the. This analysis takes place at a time where the current subject and society suffer major changes, the school as a means of reproduction of social practices goes through an unprecedented crisis and there seems to be a political emptying in today's society rather than a strengthening of growing media in everyday life. We seek to understand the extent to which sensory experience with cinema can generate social ties of students in relation to their peers and their communities. During the research was outlined a path whose central axes are supported in the field of research method, qualitative research with in-depth interviews, quantitative research with closed interviews and literature review to consider the role of audiovisual in everyday intervention and mediation with society through the film concepts (BENJAMIN, 2012; Bergala, 2008), social connection (SODRÉ, 2010), education (SODRÉ, 2012; SIBILIA, 2012), educational héxis (SODRÉ, 2010) and sensory experience (MAFFESOLI, 1998)

The intention of this project is to examine whether or not; Anthony Charles Lynton "Tony" Blair, experienced any belief changes or learning, during the period he was Prime Minister of the United Kingdom (UK), a period which lasted 10 years commencing 1997 until 2007. Our analysis will cover a timeline beginning from 1999 a point in time when the UK participated in NATO’s Operation Allied Force during the Kosovo War until 2006 when Britain took on the reins of the EU presidency for a six-month period. An exploration, of the beliefs behind a leader’s decision making logic, should always be considered a prudent undertaking especially when it comes to foreign policy studies. This is because, it is only through such activity scholars can comprehend the distinction between decisions and actions. Thus, understanding when and how; an individual leaders’ belief system changes, is of central importance in furthering our ability in explaining not only state behaviour, but, also the relationship between ‘self’ and ‘other’. The main purpose of an operational code analysis is to enable political scientists and policy makers alike, to deduce from a particular leader’s verbal content, what that actor's beliefs are and the premises they take in relation to their decision-making process. The first of our two part hypotheses seeks to determine whether Tony Blair exhibited changes in his beliefs at various stages of his premiership. These stages were signified by events which were also crucial in defining his political legacy. The events are divided into three categories, Post Kosovo – Pre Iraq, Pre 9/11 – Post 9/11 and Pre EU – Post EU. On completion of our VICS and SPSS analysis on Tony Blair’s operational code belief we discovered that there were no statistically significant changes in any of his operational indices. So, due to the lack of statistically significant changes in Blair’s Philosophical and Instrumental indices we could not classify the events selected for this analysis as having produced any influence on his belief system. Thus we rejected our null hypothesis and accept the alternative hypothesis.

Abstract:
This thesis consists of an introductory chapter and four self-contained papers on temporary work agenciesand the economic analysis of law. Paper [I] adds to the theoretical literature on the incentives of Temporary Work Agencies (TWAs). Using aprincipal-agent model with hidden action to model two main types of contracts between a TWA and a ClientFirm (CF), the TWA is shown to potentially act against the best interest of the CF when helping to fill avacant position. The results also suggest that the adverse effect of the incentive misalignment is larger whenthe worker is going to be leased instead of hired by the CF. However, this effect could potentially be offsetby introducing a sufficient level of competition among the TWAs. Paper [II] uses individual-level data on young adults to estimate how the probability of being employed inthe Swedish temporary agency sector is affected by whether a partner or other family member has experienceof temporary agency work. The results show a significant effect from all peer groups of a magnitude thatcorrespond to the other most influential control variables. We also find that this cohort of the agency sectorhas a relatively high education level compared to the regular sector, and that there are predominately menworking in thissector. Paper [III] analyses possible effects on total employment, and the distribution between agency work andregular contracts as a consequence of the implementation of the EU Temporary and Agency Workers Directive in Sweden. The analysis is based on changes in the compensation to agency workers in a calibratedextension of a Mortensen-Pissarides search model. Even though the results suggest a negative net effect ontotal employment, the implementation is shown to increase (utilitarian) welfare, and an increased transitionprobability from the agency sector into regular employment will increase welfare even further. Paper [IV] focuses on settlement probabilities for different types of representation within the Swedish LabourCourt. Empirical estimates on a set of unjust dismissal cases show that private representatives are generallyless likely to reach a settlement than their union counterparts. The settlement probabilities converge following court-mandated information disclosure, which suggests that information asymmetry is an importantfactor in explaining differences in settlement behaviour. Privately instigated negotiations are therefore ingeneral insufficient for making cases with non-union representation reach the same settlement rate as caseswith union representation.

Wage inequality is a well-established phenomenon of contemporary labour markets both in the United States and Europe, frequently discussed in the contemporary labour economics literature. In the following paper, based on harmonised data of the EU-SILC database, a semi parametric technique of quantile regression has been applied together with the traditional OLS method in order to estimate the impact of returns to education on wages in the Visegrad Group countries, namely the Czech Republic, Poland, Hungary and Slovakia. The main aim of the analysis is to examine the returns to education in these countries in order to observe differences appearing across them as well as within selected groups formed according to both the highest level of education attained and a number of years spent in a paid work (experience).

The European Union's regional policy has become one of its principal policy areas: It accounts for a major share of EU's budget and is of essential interest for its beneficiaries, the Southern countries and the new EU members of 2004. Created with the ambition to reduce income differences between countries and regions in the EU, it did not only achieve success and thus has also repeatedly been criticised. This paper wishes to present the most important facts of EU regional policy as it developed during the past two decades. It starts with the historical development and discusses the major theoretical arguments which motivate EU regional policy. Consequently, the policy priorities, the so-called "objectives", are presented and the financial contribution made by the Structural Funds to old and new members is shown. The experience in objective 1 areas: Ireland, Spain, Portugal, Greece, the Italian South and East Germany, are discussed in detail. A look at the variety of regional problems in objective 2 areas follows. The paper concludes with the main arguments involved in the present drafting stage of the future EU regional policy. This study investigates the phenomenon of overeducation among 19 highly-skilled migrant workers from EU countries working in jobs in the UK which are not commensurate with their qualifications and experience. Building on recent qualitative studies of the lived experiences of both self-initiated expatriates and migrant workers, the thesis aims, through in-depth qualitative interviews, to interpret, evaluate and refine our understanding of the experiences of highly skilled migrants in the UK in jobs which do not make use of their qualifications and experience. The study sheds light on the experiences of a growing group of internationally mobile EU citizens, who, rather than undertake the one-off movements typically studied in the migration literature, are able, as a result of the freedom of movement which they enjoy as EU citizens, to undertake more fluid mobility between EU nation states. By so doing it addresses the need for a better understanding of contemporary career mobility within the EU which is vital if the community s ideals of a more mobile, skilled and adaptable workforce, able to increase the community s competitive ability in the face of growing globalisation, are to be realised. Incorporating insights from the literature of migration, expatriation, careers and underemployment, the study seeks to gain an understanding of the migrant workers reasons for coming; the barriers they face in their search for employment which is commensurate with their qualifications and experience; their adjustment to their new work, cultural and social environments; and the effect that their stay here has on their sense of identity. The study suggests that the migrants inability to find work commensurate with their skills and experience could have adverse effects on their mental health and may detract from their ability to integrate fully into wider UK society. By restricting its focus to individuals in jobs which are not commensurate with their qualifications and experience, the study helps to add to the relatively small body of knowledge on individuals in skill- and status- underemployment undergoing voluntary (i.e. unforced) downward transitions. The reality of the interviewees situation was very often at odds with their preconceptions. The study has examined the way in which they faced up to the multiple demands of their new environment. It is hoped that it will encourage further research to address these issues and by so doing benefit future generations of EU migrant workers.

The Water Framework Directive (WFD, 2000/60/EC) was introduced in 2000. In implementing the WFD in Sweden expert knowledge in areas relating to the WFD was much needed resulting in establishment of national water management authorities, as the five water authorities, boarded in appointed county administrative boards across the country. As much noted in literature, uncertainties appear when implementing the WFD. Previous literature,with the exception of e.g. Raadgever et al (2011), Brugnach et al (2008) and Sigel et al (2007 and2010), has not put much focus on the types of uncertainty experienced by water management officials working with the implementation of the WFD on a daily basis. There are also few studies in Sweden, such as Gipperth & Elmgren (2010), Hammer et al (2011) and Entson & Gipperth(2010), touching upon the subject although not entirely focusing on practical experiences of uncertainty. Therefore, the aim of this study is to reveal the types of uncertainties experienced by water management officials from: SMHI, the county administrative board in Östergötland and Bothnia Bay, the water authority in the Southern Baltic Sea district, the Northern Baltic Sea and the North Sea, as well as the SEPA. In analysing the empirical data, six types of uncertainties emerged. They showed that water management officials experienced uncertainties in interpreting the WFD e.g. recommendation and manuals from supervisory authorities, measurement techniques, the typology of water bodies, what methods to use in e.g. assessments, knowing the effects of action programmes and lack of data ordata deficiency. In combating these uncertainties, the water management officials used communication as an strategy. Furthermore, responsibility in pointing out uncertainties and ways of reducing uncertainties was also seen as ways of handling uncertainties.

В роботі визначено поняття та особливі ознаки примирення сторін в адміністративному судочинстві. Встановлено мету, завдання, функції, принципи досліджуваного примирення. Визначено суб’єктний склад процедури примирення, встановлено умови та підстави, порядок примирення сторін в адміністративному судочинстві. Враховано досвід окремих держав-членів ЄС (Іспанія, Нідерланди, Німеччина, Франція), а також положення ряду актів ЄС. Узагальнено основні актуальні проблеми в досліджуваній сферіта сформульовано комплекс конкретних пропозицій щодо вдосконалення адміністративно-правового регулювання примирення сторін в адміністративному судочинстві в умовах євроінтеграції України, враховуючи відсутність в ЄС універсальної моделі примирення сторін публічно-правового спору та фрагментарність регулювання примирення сторін в державах-членах ЄС. The dissertation is devoted to the formulation of theoretical and methodological principles of reconciliation of the parties in administrative proceedings and to provide proposals for improving the administrative legislation of Ukraine in this area in the context of European integration. The paper defines the concept and special features of conciliation of the parties in administrative proceedings. It is established that the purpose of conciliation of the parties, as a process, is manifested in the gradual achievement by the parties of a public law dispute of a real consensus on dispute resolution, and, as a result, in the effective resolution of substantive dispute by conciliation. In this sense, conciliation of the parties performs a set of tasks (creating conditions for dialogue between the parties to the dispute; formation in the negotiations of the parties a specific model of mutual concessions that they realize, want to perform such , stimulating, analytical, information and communication, control and supervision, educational and preventive). The system of principles of conciliation of the parties in administrative proceedings are: 1) common law principles; 2) special principles of resolving the case by conciliation (for example, transparency and informativeness of resolving the case by conciliation; dispositiveness, constructive adversarial nature of the parties to the dispute; mandatory entry into force of conciliation conditions after their approval by the court; reasonable terms of resolving the case, etc.); 3) special principles concerning: a) quality, features of dispute resolution through conciliation; principles of accessibility and efficiency; b) voluntary participation in dispute resolution; good faith of all participants in the dispute resolution procedure); characteristics of the qualities of the conciliator (in particular, the principles of competence; independence, impartiality of the conciliator; compliance with the requirements of confidentiality). It is established that the subjective composition of conciliation of the parties is manifested in three models: "simple" (parties to the dispute; the judge who supervises the conciliation, approves the terms of conciliation); "Relatively complicated" (parties to the dispute; a judge who persuades the parties to conciliation and / or fully performs the role of conciliator); 3) "complicated" (parties to the dispute; judge; conciliator). In modern Ukraine there is a "simple" model of the subjective composition of the reconciliation of the parties, which: is characterized by certain features of the "relatively complicated" model; but at the same time it has the potential to transform into a "complicated" model of the subjective composition of the parties. A set of grounds and conditions for resolving a dispute by conciliation in administrative proceedings has been determined. The system of such conditions consists of: 1) positive conditions (the existence of a public law dispute and filing a lawsuit to resolve it; the integrity of the voluntary intentions of the parties to the attempt to reconcile, the implementation of a specific model of conciliation during negotiations and at the time of conciliation; ; reality and rationality of the agreed conditions of conciliation; the presence of the subjects who apply for reconciliation, the appropriate degree of legal personality); 2) negative conditions (inconsistency with the tasks of administrative proceedings in the form of violation of the interests of third parties; the law). The system of grounds covers: normative (norms of the legislation on conciliation of the parties and on the status of the subjects who are parties to the dispute), factual (implementation by the parties of the public-legal dispute of actions on acquisition and realization of the right to conciliation) and procedural-procedural conciliation, court rulings that determine the emergence and exercise of the right to reconciliation). The stages of implementation of the conciliation procedure of the parties in administrative proceedings are: 1) informal and formal initiation and commencement of the conciliation procedure; 2) negotiations in which the parties make a joint statement of conciliation of the parties; 3) submission for approval and approval of the application for conciliation of the parties, in which the court: explains to the parties the consequences of the court decision in connection with the conciliation of the parties; checks the existence of all conditions and grounds for resolving the dispute by, approves the terms of conciliation closes the proceedings or refuses to approve the terms of conciliation and continues the trial. The main current problems in the research area are summarized and a set of specific proposals for improving the administrative and legal regulation of conciliation of the parties in administrative proceeding.

The thesis focuses on formulating the basic doctrinal principals for protecting employees’ labour rights in termination labour legal relationship. The study proposes to distinguish between individual and collective termination of labor legal relationship, while the level and system of guarantees for protection are determined by the concept of “pure” and “burdened” will for terminating labor legal relationship by their parties. The grounds, conditions, features of individual and collective termination of the mentioned relations are determined. Particular attention is paid to protecting the employees’ labor rights in case of labor legal relationship termination on the basis of bankruptcy proceedings. The experience of Ukraine and individual EU countries regarding the legal regulation and judicial practice of this protection based on the pointed procedures is analyzed and compared. The basic doctrinal provisions regarding the notion, signs of protecting the labor rights of employees upon labor legal relationship termination have been formulated, the principles are established according to which such protection should take place, the protective procedures are highlighted, the problems, existing in the segment under review, are systematized and generalized, and the ways to resolve them are proposed.

This thesis in Global Development has looked at the personal experiences of non-European medical doctors that have migrated to Sweden to find out what they have encountered during the process of trying to obtain a Swedish medical license and if there are signs of discrimination. Sweden has a shortage of doctors, but has not resorted to brain drain. Contrary, it is difficult for non-European doctors to work as doctors in Sweden. This thesis has used a qualitative research strategy and five non-European unemployed doctors that were trying to get Swedish medical licenses as well as one non-European doctor that was working, were interviewed. Empirical data from a seminar with Swedish doctors about the pro-cess that foreign doctors have to go through to be able to work in Sweden has also been used in this thesis. The results showed that doctors from non-European countries have stricter requirements to fulfill in order to be able to practice medicine in Sweden than doctors coming from European countries. The system for accepting foreign doctors and validating their competence was flawed. The pro-cess was confusing, frustrating and unnecessarily long. Although there was no direct discrimina-tion or prejudice, European doctors were favored by the system.

Sverige har brist på läkare, men har inte tillgripit ”brain drain”. Tvärtemot är det svårt för icke-europeiska läkare att arbeta som läkare i Sverige. En kvalitativ forskningsstrategi har använts och fem icke-europeiska arbetslösa läkare som försökte få svenska läkarlegitimationer samt en icke-europeisk läkare som arbetade intervjuades. Empiriska data från ett seminarium med svenska läkare som handlade om processen som utländska läkare måste gå igenom för att kunna arbeta i Sverige har också använts i denna C-uppsats. Resultaten visade att läkare från icke-europeiska länder har strängare krav att uppfylla för att kunna arbeta som läkare i Sverige än läkare som kommer från europeiska länder. Systemet för att ta emot icke-europeiska läkare och validera deras kompetens var bristfällig. Processen var förvirrande, frustrerande och onödigt lång. Även om det inte fanns någon direkt diskriminering, så var europeiska läkare gynnade av systemet.

This thesis is an ethnography of the Italian-Slovenian border. The data presented in this thesis have been collected during one year of fieldwork (August 2008 - August 2009) that took place in the Province of Gorizia, the smallest of the region Friuli Venezia Giulia in the North-East of Italy. To be more specific, I conducted my fieldwork in the two areas of this Province that straddle the international border between Italy and Slovenia: the main town of Gorizia and the wine area of Collio that stretches North West of the town. I chose these areas because the town has been portrayed by some locals as a divided town as the Italian-Slovenian border straddles its peripheries and the peripheries of the Slovenian town of Nova Gorica, and the wine growers that live and/or work in the Collio area remove and replace the boundary according to their business. This thesis is about the making and marking of the Italian-Slovenian border now that both Italy and Slovenia are part of the European Union and, more importantly in this context, the Schengen Space. In fact, within the Schengen area the physical structures of the border have been erased; because of this erasure locals discussed the border as having ‘disappeared’, hence putting emphasis on the border structure as an object of demarcation. This thesis is an ethnographic example of how such a combined erasure (of borders within the EU) and simultaneous maintenance of state borders is being experienced on an everyday basis. This research aims to be an example of how Gorizia and the Collio area are shaped by the local residents’ narratives and perceptions of the political processes of bordering and de-bordering: an example of border theory from the local perspective. This work wants to be an example of border as a quality -as ongoing activity-, rather than as a fixed object. As such this thesis is looking at borderworks: the multiple qualities of borders, and how those qualities constantly change.

Proposant de comprendre le point de vue des enfants scolarisés, sur l´expérience de la scolarisation, on est parti de l´idée que les enfants narrent de façon compétente ce qui leur passe dans ce processus. Dans ce sens l´objectif de cette recherche a été de connaître ce que ces enfants pensent et comment perçoivent-ils le processus de la scolarisation à laquelle ils sont soumis. M´inspirant des auteurs comme Foucault (1988, 1989, 1995, 1996, 1999, 2006), Larrosa (1994, 1998, 2002, 2003, 2004, 2007, 2008), Kohan (2002, 2003, 2004, 2006, 2007, 2008) et Sarmento (1997, 2000, 2003, 2004, 2007, 2008), j´ai essayé de trouver une approximation entre les sphères de la philosophie et de la sociologie de l´enfance. À partir de l´analyse du matériel empirique on a pu percevoir que les enfants se sont appropriés discursivement des idées dominantes mises en circulation par la pédagogie sur ce qui est être élève et quels sont les modes scolaires d´agir, penser et parler pris comme les plus adéquats et désirables. Un autre aspect important est le fait que les enfants narrent les formes comment se donnent les relations de pouvoir entre les élèves et les enseignants. Ils démontrent savoir qu´ils occupent une position hiérarchiquement inférieure par rapport aux enseignants et ils prescrivent ce qu´il faut faire pour avoir une réussite scolaire dans ce contexte. Ce que disent les enfants réaffirme l´idée qu´ être élève n´est pas une chose naturelle mais un processus parfois difficile que tous les enfants doivent affronter. Ils revèlent les pratiques discursives et non discursives employées par le dispositif de la scolarisation pour les gouverner, les rendre soumises, silencieuses et pruductives.

Outro aspecto relevante é o fato das crianças narrarem as formas como se dão as relações de poder entre os alunos/as e docentes. Eles demonstram saber que ocupam uma posição hierarquicamente inferior em relação aos docentes e prescrevem o que é preciso fazer para conseguir ter sucesso escolar nesse contexto. O que dizem as crianças neste estudo reafirma a ideia de que ser aluno não é algo natural, mas um processo, muitas vezes difícil, que deve ser enfrentado por todas as crianças. Elas informam também as práticas discursivas e não discursivas empregadas pelo dispositivo da escolarização para governá-las, torná-las submissas, silenciosas e produtivas.

This thesis aims to analyse the implications of European Union (EU) membership on Foreign Direct Investment (FDI) inflows to Turkey by applying a comparative methodology. The effects of EU accession on FDI inflows to three present member states, Ireland, Spain and Poland, is investigated in order to draw conclusions for Turkish case. The attractiveness of each country in terms of locational determinants of FDI are evaluated. Application of our findings in Ireland, Spain and Poland on Turkish case signifies implications of these determinants on attractiveness of Turkey in terms of FDI inflows. Abstract:
Background: International students (IS) are arguably a population facing both educational and migratory challenges. These are understood within Culture Shock (CS, Oberg, 1960), a process of culture learning. Available literature on IS seems to focus mainly on the phases of CS between the arrival in the host country until adaptation, or at the later stage of returning home. The last part of the IS journey in the host country, before the possible return home, appears neglected. Research suggests that in this period, named the ‘crossroad’ in this study, important decisions could be made, such as whether to stay in or leave the host country. Rationale: Internal struggles, dilemmas and uncertainty can arise due to the possible changes to self that IS can develop while abroad, and could be exacerbated by immigration laws. Thus, the crossroad can be a phase of psychological struggle, which can be of interest to mental health professionals. There is limited qualitative evidence on this sub-phase of CS on IS and this research attempts to address this gap by looking holistically at the subjective experiences of these students and letting their specific psychological needs arise. Methodology and main findings: An interpretative phenomenological analysis (IPA) was chosen for this research, using semi-structured interviews. Three superordinate themes emerged from the analysis of the transcripts: a) Changes to self and identity; b) Uncertainty, temporariness and emotional responses; c) Dilemmas at the crossroad. The crossroad emerged from the results as a phase dominated by uncertainty towards the future, leading to experiencing difficult emotions such as worry, anxiety and low mood. From the participants’ accounts, it seemed that the limitations imposed by the UK immigration law were the main trigger for such uncertainty, and that IS perceived their circumstances as largely out of their control. The IS’ psychological and emotional responses seemed connected with having developed a sense of belongingness to the UK, resulting from a process of changes to self and identity experienced during their time abroad.

Abstract:
Much of the public policy discourse about immigration in the UK has drawn on the experiences of post-war immigrants from the former British colonies. The volume and composition of immigration flows has changed significantly in recent years with substantial increases in the number of immigrants, particularly from countries without links to the UK, and as a result of the large scale immigration from the EU Accession countries in Central and Eastern Europe. Immigration remains a contested issue with public and political debates focusing on the nature and impact of immigration and its perceived negative effects on employment, public services and social cohesion. In spite of the growing number of studies examining the experiences of new immigrants in local neighbourhoods and labour markets there is a lack of comprehensive evidence about how these experiences differ across immigrant groups and the role of place in shaping the experiences and outcomes of new immigration. This research draws on a variety of data from the census, national surveys, administrative sources and qualitative interviews to explore the settlement patterns, labour market outcomes and neighbourhood experiences of new immigrants. The findings show that new immigrants are more likely to locate in ethnically diverse and socially deprived neighbourhoods upon arrival although there is variation in the factors determining immigrant settlement by world area of origin in line with differences in migration motives and entitlements in the UK. The findings from the qualitative interviews highlight the range of motivations and constraints that shape immigrant settlement patterns and how these change over time with secondary migration and family formation. Analysis of the labour market position of immigrants defined by country of origin and ethnicity shows the persistence of ethnic penalties in the labour market. Immigrants from ethnic minority groups both from established and new immigrant groups are found to be more disadvantaged in the labour market than white immigrants and the White British. The neighbourhood context, specifically neighbourhood deprivation and ethnic diversity, is associated with poorer employment outcomes, with the relationship between area deprivation and employment shown to depend on ethnicity. The qualitative evidence highlights the role of social networks and a range of other factors in facilitating and hindering the socio-economic integration of new immigrants. The findings, particularly in relation to immigrant social networks, access to welfare, settlement intentions and housing aspirations, challenge common perceptions about new immigrants living in deprived areas in the UK. The research evidence contributes to a better understanding of the settlement patterns and experiences of new immigration and has implications for national and local policies.

Дисертацію присвячено визначенню та вирішенню проблемних аспектів правового регулювання праці суддів у межах поглибленої євроінтеграції України. Надано комплексну соціально-правову характеристику праці суддів, а саме розкрито соціальне значення праці суддів, визначено критерії та ознаки якісної роботи суддів, що засвідчують її належний соціальний вплив. Встановлено актуальні перешкоди ефективній роботі суддів в Україні, а також стан виконання державою євроінтеграційних завдань відносно поліпшення функціонування судів та суддів. Окреслено комплекс теоретичних і практичних проблем, які перешкоджають забезпеченню трудових прав суддів в Україні, впровадженню в систему правосуддя стандартів гідної праці на всіх етапах існування трудових правовідносин із цією категорією працівників: під час виникнення трудових відносин із кандидатами на посаду судді, у процесі перебігу та припинення трудових відносин із суддями. На підставі аналізу судової практики щодо захисту трудових прав суддів в Україні на кожному з означених етапів встановлено реальні проблеми, з якими стикаються судді на практиці під час реалізації свого права на працю, а також визначено роль судового захисту прав суддів у нашій державі. Виявлено особливості правового регулювання виникнення, перебігу та припинення трудових правовідносин за участю суддів в окремих державахчленах ЄС. Враховуючи проаналізований зарубіжний досвід, сформульовано конкретні пропозиції щодо вдосконалення національного законодавства у досліджуваній сфері. The dissertation is devoted to the search and solution of problematic aspects of legal regulation of judges' work within the framework of deep European integration of Ukraine. The study provides complex socio-legal characteristics of the work of judges. It defines the social significance of the work of judges, determinates the criteria and signs of quality work of judges, which confirm its proper social impact. A complex of theoretical and practical problems that hinder the provision of labor rights of judges in Ukraine and interfere the implementation of decent work standards in the justice system is described. The analysis of problems is made at all stages of the existence of labor legal relations with this category of workers: in the beginning of labor relations with candidates for the position of a judge, in the process and termination of employment with judges. Based on the analysis of judicial practice on the protection of labor rights of judges in Ukraine at each of these stages identified real problems faced by judges in practice during the realization of their right to work. The role of judicial protection of the rights of judges in state is also defined. Peculiarities of legal regulation of the emergence, course, and termination of employmentwith judges in some EU member states areinvestigated. Considering the analyzed foreign experience, specific proposals for improving national legislation in the study area are formulated.

Abstract:

The aim of this thesis is to interpret and understand the concept of citizenship in general, and the European citizenship in particular, placed within a broad theoretical framework. Furthermore, the purpose is to examine whether the development of a European citizenship indicates an emergence of a new ‘post-national’ model of citizenship, based on residence rather than nationality or place of birth. In order to address this, the status of third- country nationals (TCN’s), who are legally long-term residents within the Union, in relation to EU citizens has been analysed from the theoretical perspectives.

Different models of citizenship provide the paper with a theoretical framework, through which the empirical data has been examined. The theoretical approaches dealt with in this paper are the liberal, the republican/communitarian and the ‘post-national’ models of citizenship respectively. Fundamental ‘key concepts’ have been derived from these different models of citizenship, which have facilitated the analysis by providing the interpretation of the EU citizenship with an analytical framework.

To find answers to the initial research questions and fulfil the aim of the paper, a qualitative and hermeneutic study has been carried out, aiming at interpreting and understanding the European citizenship placed within its socio-political context. Text and language constitute the units of analysis and, hence, a textual analysis has been conducted of official EU documents. Following a conceptual history approach, concepts are not just reflections of historical processes, but can themselves contribute to historical change by making new things imaginable. As emphasised throughout the paper, concepts embrace at the same time a ‘space of experience’ and a ‘horizon of expectation’.

The main conclusions drawn from the research can be summarised in a number of points. First, while the concept of European citizenship was originally connected to a formal and economic view upon citizenship, close to a liberal/neo-liberal notion of citizenship, the texts express an aim of a more active citizenship, emphasised in the republican/communitarian tradition. Secondly, despite a multicultural and post-national rhetoric concerning the status of long-term resident TCN’s, the gaining of ‘full’ EU citizenship can still only be attained through nationality in a Member State. Thirdly, the importance of interpreting a concept placed within its socio-political context has been clear from the study. The semantic analysis has showed a close link between the European citizenship andthe goal to create an ‘area of freedom, security and justice’ throughout the Union. This goal is interpreted as a response to recent occurrences in the world, but at the same time it expresses expectations about the EU citizenship, and it can thus itself affect future developments in this field.

To sum up, while the concept of European citizenship is post-national to the extent that it applies to all EU citizens irrespective of where in the Union they live, it is still not completely based on the principle of residence. Only nationals of an EU Member State can obtain citizenship of the Union. Thus, the concept of European citizenship, while establishing a citizenship across national borders, is still based on nationality.

The overall aim of this thesis was to examine the distribution of health literacy (HL) levels in newly arrived Arabic-, Dari-, or Somali-speaking refugees in Sweden. Further aims were to investigate sociodemographic characteristics associated with inadequate HL in this group, and to investigate whether HL levels are associated with experiences of the health examination for asylum seekers (HEA), health seeking behaviour and health. Three quantitative cross-sectional studies, using data from two different surveys, were conducted among Arabic-, Dari-, and Somali-speaking, newly arrived refugees taking part in courses in Swedish for immigrants or civic orientation. In addition, an explorative qualitative study, based on focus group discussions, was performed on Arabic- and Somali-speaking newly arrived refugees who had taken part in an HEA. All data were collected 2013-2016. The quantitative data were analysed using different statistical methods, foremost descriptive statistics and univariate and multivariate binary logistic regression analyses. The qualitative data were analysed using Graneheim and Lundman’s method for latent content analysis. The main findings were that the majority of Arabic-, Dari-, or Somali-speaking refugees in Sweden have limited functional health literacy (FHL) and/or limited comprehensive health literacy (CHL). Having a low education level and/or being born in Somalia were associated with having inadequate FHL, but not with having inadequate CHL. Limited FHL was associated with inadequate CHL. Experiences of poor quality of communication and having benefited little from the HEA were more common among those with limited CHL, as compared to those with higher CHL. Experiences of communication problems and a lack of information related to the HEA were found in the qualitative studies as well. In addition, it was more common that those with limited CHL reported poor general health and impaired psychological well-being, and that they had refrained from seeking healthcare. In conclusion: limited HL is common among newly arrived refugees in Sweden and seems to be of importance for the experience of the HEA, health-seeking behaviour and health. HL needs to be taken into consideration in the work with refugees in order to increase equity in healthcare and health.

In the past fifty years, pregnancy has gained a lot of interest in social sciences in correspondence with the surge of the body as systematic category of analysis. The pregnant body seems to become a hyper-body on which simultaneously operate biopolitics, economic forces and social imaginaries, all engaged in the creation of a new, dynamic ethic of reproduction. This thesis is an in-depth exploration of the unfolding of my lived experience of pregnancy on the background of the biomedical landscape. Moreover, it analyses the sharing of this experience with three pregnant women that, like me, immigrated in Portugal. It is developed within a phenomenological and critical frame, and takes the form of a dialogue, a dialectical alternation between the autoethnography of my pregnancy and the reflections it triggered in terms of embodiment, medicalization and socialization. The pregnant embodiment that emerges is a liminal one: challenging postulates of subjectivity and individuality, it reflects the complexity of being at once an “I”, (eu) and an “us” (somos).

After experiencing World War Ⅰand Ⅱ, the European countries recognized that to prevent war on Europe was of necessary. They would like to inspire economic development by economic integration, and furthermore, to push Europe back to the key actor of world politics through political integration. From “European Common Market”, “European Community” to “European Union”, the European countries has gone through many complex negotiations. Among the regimes in European Union, “Common Foreign and Security Policy” works through “Intergovernmental Cooperation”, which is of much higher political meaning. It symbolizes the operation of integration theory has strode from economic to political matters. The operations of CFSP have two important contributions to Europe. First of all, it contributed to the reconciliation of European nations. Second, it demonstrates peace can be achieved through legal and institutional negations without threatening the existing political authorities. Both China and Taiwan can take lessons in the CFSP’s negotiation process, especially in the aspects of how to leave aside disputes and put aside minor differences so as to seek common ground. President Chen Shui-Bian gave a talk on 31 December 2000 which indicated that the Cross-strait relation could learn from EU’s integration experience and jointly seek for new framework of political integration. It could start from economic and cultural integration, build confidence step by step, and look for new framework for political integration. This kind of opinion conforms to international development experience. What norms of EU’s experience should the Cross-strait refer to is the main topic of this research. How do EU’s institutions make compromise between “national interest” and “EU’s development” is another concerning point of the research.
