AbstractAt present, most scholarship on the potential for escalation in cyberspace couches analysis in terms of the technological dynamics of the domain for relative power maneuvering. The result has been a conceptualisation of the logic of operation in cyberspace as one of ‘tit-for-tat’ exchanges motivated by attribution problems and limited opportunity for strategic gain. This article argues that this dominant perspective overlooks alternative notions of how cyber tools are used to influence. This, in turn, has largely led scholars to ignore second-order effects – meaning follow-on effects triggered by a more direct outcome of an initial cyber action – on domestic conditions, institutions, and individual stakeholders. This article uses the case of cyber-enabled political warfare targeting the United States in 2016 to show how escalation can occur as a second-order effect of cyber operations. Specifically, the episode led to a re-evaluation of foreign cyber strategy on the part of American defence thinkers that motivated an offensive shift in doctrine by 2018. The episode also directly affected both the political positions taken by important domestic actors and the attitude of parts of the electorate towards interference, both of which have reinforced the commitment of military planners towards assertive cyber actions.

This article explores the strategy deliberation leading up to Hàà N 4i's decision to go to war in 1959, to embark on a "bigger" war in 1963, and to launch the Tet Offensive in 1968. The militants who controlled the party apparatus advanced their agenda for armed conflict in the South at the expense of socialist transformation in the North. While battling their internal opponents, these hardliners also had to navigate the Sino-Soviet split to advance their war agenda. This article reveals that the launching of the Têêt Offensive signified the militants' neutralization of domestic opposition and foreign obstruction through the implementation of a mass purge known as the "Revisionist Anti-Party Affair."

World War I arose from six remarkable misperceptions that swept through Europe before 1914. Europeans exaggerated the efficacy of offensive military strategies and tactics; overestimated the hostility of neighboring states; falsely believed that strength and bellicosity could intimidate opponents; exaggerated the economic value of empire; believed that war itself was beneficial; and taught themselves a mythical nationalistic history. These misperceptions fostered expansionist foreign policies and bolstered arguments for preemptive and preventive war. They also precluded resort to Tit-for-Tat strategies to achieve cooperation through reciprocity. All of the problems discussed in this collection of essays—perverse payoff structures, short shadows of the future, and large numbers of players—were created or exacerbated by these misconceptions. This case suggests that peace can require political action projects to control malignant misperceptions, although history warns that such projects will not succeed easily.

It has become very popular to view the human as a processor of information, with reaction time (RT) used in various ways to measure the speed of information processing. In many sports quick decisions are essential to success. It is tempting to study reaction time, infer information-processing ability, and use the results to make predictions about success. The purpose of this study was to determine the relationship between various RT and movement time (MT) measures [simple RT, simple MT, simple total response time (TRT), choice RT, choice MT, choice TRT, and information-processing ability as determined by the increase in RT from simple to eight-choice conditions] with batting average, slugging percentage, and total average. 40 varsity baseball players from Colorado State University, University of Wyoming, University of Utah, and Brigham Young University were given 24 practice attempts followed by 48 experimental attempts for both simple and choice RT and MT. These scores were then correlated with batting averages, slugging percentages, and total averages. This research demonstrated no relationship between the various measurements of reaction and movement times and offensive ability in baseball.

Building on earlier articles published in the Journal of Cold War Studies by James G. Hershberg and Zoltán Szoke, this article discusses Romania's involvement in the attempts to negotiate a peaceful conclusion to the Vietnam War before and after the Tet Offensive. The literature concerning the Romanian channel (codenamed Packers) is negligible thus far. Part of the reason is that even though official U.S. documentation on Packers has been available for two decades, relevant Romanian documents were only recently declassified by the archive of the Romanian Ministry of Foreign Affairs. The new evidence from the Romanian archives completes the picture of what was, in effect, the last U.S. chance to begin negotiations over Vietnam without compromising the initial U.S. position. The conversations between Romanian Deputy Foreign Minister George Macovescu and Vietnamese Communist leaders on the eve of the Tet Offensive offer a much more detailed inside look at Hanoi's negotiating position in December 1967–January 1968. The Romanian documents also show the crystallization of the Vietnamese position of March 1968 with regard to opening talks and the San Antonio formula.

“Hue is the most beautiful city in the world,” a Vietnamese woman tells Marine Lieutenant Kramer, a central character in Robert Roth's Vietnam War novel,Sand in the Wind. Published in 1973, five years after the sweeping Tet Offensive had reduced Hue to rubble,Sand in the Windset the city within a complex meditation upon beauty and its relation to human desire, history, the vagaries of chance, ephemerality of happiness, and ineluctability of loss. Though ambitious in intent,Sand in the Windhas not been widely acclaimed. Except for John Hellmann's close reading, it has usually been referred to passingly or overlooked. Thomas Myers dismissed it as a “sterile mural,” a static work fixed upon a wall. I prefer to think of it as “walking point” — an action Myers ascribed to Vietnam War fiction he endorsed for “cutting trails” (227). Like the pointman of a patrol who clears a path for others to follow, the Vietnam War novel, Myers argued, opened a way into tangled historic territory — the territory of war now inhabited by literature. I propose to enter this forbidding area throughSand in the Wind, for I believe that like the novels Myers lauded it too secures a way, a unique way, of engaging safely with the Vietnam War and the losses it entailed.The lives of an estimated 5,713 soldiers, American and Vietnamese, were lost in the battle at Hue, as were almost 3,000 civilian lives. That the “longest and bloodiest” battle of the Offensive took place in Hue during the festive days of Tet was particularly shocking, for Hue was commonly considered an open city, and Tet, the lunar New Year, a time of peace and renewal. Traditionally, Tet Nguyen Dan ushered in the new year with three days of festivity, days of respite during which communal bonds were strengthened. Family members and their relatives renewed the bond of blood by gathering together for an exchange of gifts and good wishes; ancestral bonds were renewed by visits to family graves. Rice farmers plowing their paddies renewed the bond between man and nature.

Marie Henehan presents a systematic study of every roll call vote on foreign policy taken by the Senate between 1897 and 1984. She predicts an increase in Senate activity and disagree- ment on foreign policy after "the emergence of imperialism as a critical issue in 1897, the crisis over involvement in Europe in 1917, the heightened importance of the response to commu- nism in 1947, and the perceived failure of the containment policy in Vietnam between the Tet Offensive in 1968 and the bombing of Cambodia in 1970" (p. 83). Bien que souffrant d’un manque réel de ressources, la part grandissante des PME optant pour la réalisation d’un investissement direct à l’étranger (IDE) appelle à une relecture des stratégies d’internationalisation de ces petites structures. Cet article repose sur l’analyse de cinq cas de PME manufacturières de la région Rhône-Alpes ayant ouvert une filiale à l’étranger. Il présente les principaux risques supportés par les PME et les motivations au déploiement d’une stratégie tête-de-pont. Le choix d’une implantation dans un pays tête-de-pont s’avère être une démarche défensive ou offensive résultant de l’interaction de facteurs endogènes et exogènes. Nos résultats montrent que les stratégies tête-de-pont constituent une stratégie efficace permettant à la fois de gérer les risques et de saisir de nouvelles opportunités d’affaires à l’étranger – notamment dans les pays émergents.

This article explores the impact of one of the key non-military events in the U.S. war in Vietnam, at least in the crucial years from 1964 to 1968. During a two-day U.S.–South Vietnamese conference held in Honolulu in early 1966, Secretary of Defense Robert S. McNamara and Secretary of State Dean Rusk laid out a series of overarching strategic objectives, both military and political, that shaped the allied war effort through the 1968 Tet offensive, and even beyond. The goals outlined at the summit remained the touchstone of U.S. military strategy until they were superseded in 1969 by a policy of “Vietnamization” under the Nixon administration. These political-military objectives, however, suggested a fundamental problem with the U.S. approach to Vietnam, based as it was on a dangerous mixture of naïveté and idealism stemming from faulty assumptions about the efficacy of U.S. power abroad during the Cold War.

The actual effectiveness of the American anti-war movement from 1964-68 and its attempts to sway the policy of President Johnson's administration on the topic of the Vietnam War is debatable. While popular myth has exaggerated the role of protestors in stopping the war, the movement failed to alter state policy on the war in any serious fashion. The anti-war movement could not develop a universal policy of their aims, differing from a gradual exit from Vietnam to a complete anarchist overthrow of the American system, and as such were unable to lobby the government effectively. Within the war itself, however, the Johnson administration and the United States Military encountered a stronger stimulus to reconsider their involvement: the inability to adapt to a guerilla war, the immense man power and resources required to ensure victory, and ultimately the communist Tet offensive of 1968 pushing American forces back. When President Johnson did seek to negotiate with North Vietnam at the end of his term, it was because America had simply failed to beat the Vietcong.

After the Tet Offensive of early 1968, Hanoi agreed to hold talks with U.S. representatives in Paris. The North Vietnamese, however, used the resulting talks with the Johnson administration not to negotiate in any traditional sense but to probe the intentions of Washington and to manipulate domestic and world opinion. Hanoi continued this charade for approximately a year, until domestic and international circumstances forced a meaningful reassessment of its position on a negotiated settlement of the war with the United States. This article explores that reassessment, as well as the evolution of North Vietnam's diplomatic strategy thereafter. Specifically, it considers the factors that conditioned the thinking and policies of Vietnamese Communist leaders, including the balance of forces below the seventeenth parallel and the behavior of close allies in Beijing and Moscow vis-à-vis the United States. The article proposes that military and economic setbacks in the South and in the North combined with recognition of the limits of socialist solidarity forced Hanoi to talk secretly and then to negotiate seriously with the Nixon administration and, ultimately, to accept a peace settlement that fell far short of the goals set by the Vietnamese Communists at the onset of the war.

artigo analisa a Articulação Internacional dos Atingidos pela Vale a partir da mobilização dos trabalhadores atingidos nas comunidades e cidades onde a empresa Vale tem atuação na sua forma destrutiva em impactos sociais, culturais e ambientais. Decorrente do intercâmbio com várias organizações, movimentos sociais e ambientalistas se inicia um processo de construção de uma rede internacional para troca de experiências visando acúmulo e discussão de ações conjuntas de ofensiva e resistencia à atuação da Vale nos diversos países. Essas articulações intentam afirmar que os liames da ofensiva e da resistência locais têm um imperativo: sua construção em escala continental, em perspectiva internacionalizada, posto que é este o circuito e a escala de operações do capital. Assim, no quadro da abordagem deste estudo, o artigo ressalta que a luta dos Atingidos pela Vale, não pode, historicamente, ser compreendida meramente nomarco estrito da luta contra uma empresa e sua atuação. A compreensão se desborda, em esforço de síntese, na direção de uma luta para além da Vale. Thus, under the approach of this study, the article highlights the struggle of People Affected by Vale can´t historically be understood only in the context of the strict struggle against a company and its performance. An understanding overflows in synthesis effort, toward a struggle beyond the Valley. Este artigo se origina de uma pesquisa que problematiza as políticas públicas direcionadas à juventude que comete atos infracionais, especialmente as adolescentes mulheres. Norteadas pelo pensamento de Michel Foucault, discutimos e analisamos o modo como o discurso sobre a população jovem em conflito com a lei é operacionalizado para legitimar intervenções no meio socioeducativo. Partimos da arqueogenealogia foucaultiana para pensar o presente nas relações de poder-saber, refletindo acerca dos discursos sobre os direitos das jovens que cumprem medidas socioeducativas, pois as políticas da socioeducação têm sido pensada, prioritariamente, para os jovens do sexo masculino, invisibilizando as condições específicas que implicam a entrada das adolescentes no sistema de justiça. A operacionalização das políticas públicas para a juventude em conflito com a lei, no presente, indica a execução de medidas que, subsidiadas por discursos produzidos na relação entre instituições de saúde e justiça, violam os direitos garantidos em lei. This article is the result of a research that problematizes the public policies directed to the youth that commits offensive conducts, especially the adolescent women. Guided by Michel Foucault's thought, we discuss and analyze how the discourse on the young population in conflict with the law is operationalized to legitimize interventions in the socio-educational environment. We started from the Foucauldian archaeogenealogy to think about the present in power-knowledge relations, reflecting on the discourses on the rights of young women who serve socio-educational measures, because the policies of socio-education have been designed for young men, invisibilizing the specific conditions that imply the entry of girls into the Brazilian justice system. The operationalization of public policies for youth in conflict with the law, in the present, indicates the implementation of measures that, subsidized by speeches produced in the relationship between health institutions and justice, violate the rights guaranteed by law. Este artículo se origina en una investigación que problematiza las políticas públicas dirigidas a jóvenes que cometen infracciones, especialmente a las adolescentes. Guiadas por el pensamiento de Michel Foucault, discutimos y analizamos cómo se operacionaliza el discurso sobre la población joven en conflicto con la ley para legitimar las intervenciones en el entorno socioeducativo. Partimos de la arqueogenealogía de Foucault para recapacitar sobre el presente en las relaciones de poder-conocimiento, reflexionando acerca de los discursos sobre los derechos de los y las jóvenes que cumplen con las medidas socioeducativas, ya que las políticas de educación social se han diseñado principalmente para hombres jóvenes, haciendo invisibles las condiciones que implican la entrada de los adolescentes a la justicia. La operacionalización de las políticas públicas para jóvenes en conflicto con la ley, en la actualidad, indica la implementación de medidas que, subsidiadas por discursos producidos en la relación entre instituciones de salud y justicia, violan los derechos garantizados por la ley.

Abstract:
James Tait Goodrich was born on April 16, 1946 in Portland, Oregon, United States, the son of Richard Goodrich and Gail (Josselyn) Goodrich. Dr. Goodrich served as a Marine officer during the Vietnam War, during which time he decided his next step would be to pursue a medical career. Not only was he an elite surgeon, but over the years he was also a generous mentor and teacher who shared his craft with many young surgeons who wanted to follow in his footsteps. During the Tet Offensive, he spotted a Vietnamese surgeon in a medical tent opening up a soldier’s head. “Cool,” he thought. “I want to do that” (1). Upon return to the USA, Jim married Judy Loudin on December 27, 1970, the love of his life who gave him the confidence and support to pursue his dreams. Dr. Goodrich completed his undergraduate work at the University of California, Irvine and his graduate studies at the School of Arts and Sciences of Columbia University (1972), receiving his Masters and Doctor of Philosophy degrees in 1978 and 1980, respectively. He received his Medical Degree from Columbia University College of Physicians and Surgeons. After an internship at Columbia- Presbyterian Medical Center (1980-1981), he completed his residency training at the Presbyterian Hospital in New York City and the New York Neurological Institute (1981-1986). He also holds the rank of Professor Contralto of Neurological Surgery at the University of Palermo in Palermo, Italy. He was Director of the Division of Pediatric Neurosurgery at the Children’s Hospital of Montefiore Health System and he served as a Professor of Clinical Neurological Surgery, Pediatrics, Plastic and Reconstructive Surgery at the Albert Einstein College of Medicine since 1998 (2). Dr. James T. Goodrich dedicated his life to saving children with complex neurological conditions. He had a particular interest in the treatment of craniofacial abnormalities. He was a pioneer in this field and developed a multi-stage approach for separating craniopagus twins who have their brain and skull conjoined. In 2016, he famously led a team of 40 doctors in a 27-hour procedure to separate the McDonald twins. Throughout his distinguished career, he became known as the world’s leading expert on this lifesaving procedure. He has been consulted on hundreds of cases, and he routinely traveled the world sharing his vast knowledge and expertise with colleagues (3,4). In Brazil, Dr. Goodrich played a very important role in leading the processes to successfully separate craniopagus sets in Ribeirao Preto (2017-2018), and in Brasilia (2019). A classical multistage surgery was performed to separate the Ribeirao Preto conjoined twins, and Dr. Goodrich participated on all the neurosurgical procedures as a great mentor. In the final operation, on October 28, 2019, some members of Montefiore Hospital medical staff (Dr. Oren Tepper, plastic surgeon, Dr. Carlene Broderick, pediatric anesthesiologist and Kamilah A. Dowling, nurse) also worked alongside Jim and the Brazilian team. An extraordinary and humble man, his words after the first surgical step, during an interview for a TV channel, were that in “this particular surgery we were able to do more than we expected because the anatomy was very good and the team had exceptional skills that made the difference”. Dr. Goodrich was a chief supporter of the Latin American Pediatric Neurosurgery Course (LACPN), having participated in all editions since 2004. In these events, he did not hesitate to share his knowledge during the hands-on sessions and, likewise, his wonderful conferences. Prof. Goodrich was officially honored by the Brazilian Society for Pediatric Neurosurgery during the “XII Brazilian Congress of Pediatric Neurosurgery”, in Florianopolis, Brazil. Dr. Goodrich was a gentle and truly caring man. He did not crave the limelight and was beloved by his colleagues and staff. He has authored numerous book chapters and articles on Pediatric Neurosurgery and is known worldwide as a prominent lecturer in this field. Outside his work, he was also known for his passion for historical artifacts, travelling, wine, and surfing. Dr. Goodrich was an incredible human being. In March 30th, 2020, he passed away after complications due to Covid-19 (5). In that day the world has become a little less bright without Jim. Our sympathy and prayers go to his wife Judy, his three sisters, and all those who were close to him

Materiales y Métodos: estudio cuantitativo con diseño descriptivo. La información se obtuvo a través de un cuestionario diseñado y modificado por las investigadoras y autoadministrado por los estudiantes de siete instituciones públicas de educación media jornada de la mañana. La población estuvo conformada por 5537 adolescentes entre las edades de 10 a 17 años, se realizó un muestreo probabilístico aleatorio simple y a través de la afijación proporcional se tomó una muestra de 774 estudiantes. Resultados: se encontró que los lugares con mayor prevalencia donde se presenta el tipo de agresión entre estudiantes son: cerca al colegio, al salir de clase, al interior del aula cuando no está el profesor y por último en pasillos y baños. El tipo de agresión más frecuente es la verbal, que por lo general se origina cuando se habla mal de la persona o por decir palabras ofensivas; las patadas, golpes y peleas entre grupos como tipo de agresión física no reportaron una frecuencia alta entre los adolescentes. Conclusión: el matoneo continúa presente en las instituciones de educación media convirtiéndose en una problemática social que ha sido tratada por diferentes sectores con el fin de encontrar una solución, pero los esfuerzos no están dando resultados; por ello, se debe continuar fortaleciendo el diseño de estrategias e implementación de modelos de convivencia sana orientadas a padres, educadores y estudiantes para la solución de conflictos y comprensión de consecuencias.PALABRAS CLAVE: adolescente, estudiantes, problemas sociales, violencia. Results: we found that areas with higher prevalence which presents the type of aggression among students are: close to school, after school, as well as in the class when the teacher isn´t in class and finally, it happens in hallways and restrooms. The most common types of aggression are verbal and they start when someone says bad things about the other person, and by saying offensive words; kicks, punches and fights between groups and types of physical assault did not report a high frequency among adolescents. Conclusion: bullying continues in secondary education institutions becoming a social problem where different sectors have tried to solve it but the efforts are not working; for this reason, it is necessary to continue to strengthen in parents, educators and students strategies and models of healthy conflict solution to understand the possible consequences. A população consistiu de 5.537 adolescentes com idades entre 10-17 anos foi realizada uma amostragem probabilística aleatória simples e através da alocação proporcional eu mostrar uma amostra de 774 alunos. Resultados: verificou-se que as áreas com maior prevalência que apresenta o tipo de agressão entre os estudantes estão perto de escola, depois da escola, bem como na classe quando não é o professor e, finalmente, em corredores e banheiros, tipo mais comuns são a agressão verbal e originam quando falar mal da pessoa, como a dizer palavras ofensivas; chutes, socos e brigas entre grupos e tipos de agressão física não relatou uma alta freqüência entre os adolescentes. Conclusão: o assédio moral continua em instituições de ensino secundário tornando-se um problema social onde os diferentes setores têm tentado resolvê-lo, mas os esforços não estão funcionando; porque deveria continuar a reforçar a pais, educadores e estudantes; estratégias e modelos de solução de problemas de vida saudável e compreensão das consequências.PALAVRAS-CHAVE: adolescentes, estudantes, problemas sociais, violência.

Weber, Simmel und Coser stufen Konflikte als konstitutiv für Gruppen als auch für gesellschaftliche Entwicklungen ein. Soziale Konflikte können danach sowohl integrativ wie auch desintegrativ wirken. Diese soziologischen Befunde stehen scheinbar im Widerspruch zur nahezu eindeutig ne-gativen Konnotation des Streits heute. Konflikte werden nahezu aus-schließlich als unangenehm und als störend empfunden und deshalb eher vermieden. In Anlehnung an Simmels Verständnis wird hier mit dem Begriff des ‚offensiven Konfliktmanagements’ operiert. Eine Reaktivierung dieses historischen Begriffsverständnisses tut Not in einer Zeit, in der wir es mit der Paradoxie zu tun haben, dass je friedfertiger, je zivilisierter unser Alltag ist, desto ungeübter sich unser Umgangsvermögen mit Konflikten darstellt.

Nadat de mesthopen uit de steden verdwenen waren bleef er in de 19de eeuw voor de mannen niets anders over dan gebruik te maken van de 'cour' of 'koer' van een van de talrijke cafés. Over de vrouwen werd gezwegen. Zij hoorden immers niet thuis in de publieke ruimte. Mannen plasten natuurlijk ook hier en daar tegen bomen en muren, maar in het kader van een algemeen hygiëne - offensief dat snel na de tweede cholera epidemie {1849} op gang kwam, werd daar tegen ingegaan. De Stad bekostigde en onderhield voortaan publieke urinoirs in open lucht. Die waren exclusief voor mannelijk plasgebruik en dat bleef zo tot het einde van de vorige eeuw. Pas omstreeks 1985 bracht het overweldigende succes van de Gentse Feesten (met bijhorende overlast) de problematische publieke toiletvoorzieningen in de media. Na enkele schuchtere pogingen kwam er in het eerste decennium van deze eeuw fors verbetering in de publieke faciliteiten met aandacht voor de behoeften van vrouwen en meteen ook voor de 'grote boodschap' van de mannen, hier en daar zelfs voor rolstoelgebruikers, baby's en tenslotte ook honden. Voor deze laatste brachten de hondentoiletten soelaas. Die werden al meteen na de introductie in 1998 een onverwacht succes. Hoewel het hier beschrevene enkel de Gentse situatie betreft en de twee keerpunten, de cholera epidemie en de Gentse Feesten, zelfs zeer sterk verbonden zijn met de geschiedenis van deze stad, kenden andere steden een analoge evolutie, mogen we aannemen.

Resumo: O presente artigo propõe-se a apresentar os resultados da pesquisa sobre os índices do crime de ameaça (art. 147 do Código Penal Brasileiro - CPB) praticado contra a mulher no âmbito familiar-doméstico, na cidade de Belém/PA, no período de 2010 a 2014, registrados pela Delegacia Especializada no Atendimento à Mulher (DEAM). A expressividade da pesquisa revela-se pela constatação de que crimes de maior potencial ofensivo, como o feminicídio, são geralmente precedidos do delito previsto no art. 147 do CPB, o que deveria estimular uma atuação preventiva do Estado, como a apuração e repressão regulares, eficazes e céleres das ameaças cometidas no campo das relações domésticas. Para a realização do trabalho pesquisou-se na legislação, na doutrina forense, na jurisprudência e na práxis dos órgãos que compõem a rede de enfrentamento à violência doméstica no estado do Pará, como funciona a persecução penal do delito de ameaça e como a mulher pode proceder para acessar a justiça. Por fim, para averiguar como a ameaça vem sendo registrada e investigada em Belém/PA, foram coletados dados estatísticos dos boletins de ocorrência e dos inquéritos policiais correspondentes na DEAM/Belém. Após a análise dos dados obtidos, constatou-se que a ameaça foi o tipo penal mais recorrente nas estatísticas policiais da Especializada, no período examinado, mas apenas parcela irrisória dos casos foi apurada através de Inquéritos, evidenciando que a exigência de representação penal, a morosidade e a burocracia processuais têm sido óbice ao acesso à justiça e à efetividade da tutela estatal.Palavras-chave: Ameaça; Lei Maria da Penha; Estatísticas da DEAM/Belém; Acesso à Justiça. Abstract: The present article proposes to present the results of the research on the indexes of the crime of threat (article 147 of the Brazilian Penal Code - CPB) practiced against women in the family-domestic environment, in the city of Belém / PA, in the period from 2010 to 2014, registered by the Delegacia Especializada no Atendimento à Mulher (DEAM). The expressiveness of the research is revealed by the fact that crimes with greater offensive potential, such as femicide, are generally preceded by the offense established in art. 147 of the CPB, which should encourage a preventive action by the State, such as regular, effective and speedy investigation and prosecution of threats in the field of domestic relations. In order to carry out the work, the legislation, forensic doctrine, jurisprudence and praxis of the organs that compose the network to deal with domestic violence in the State of Pará, how the criminal prosecution of the crime of threat works and how the woman can proceed to access justice. Finally, to find out how the threat has been registered and investigated in Belém / PA, statistical data were collected from the corresponding occurrence bulletins and police inquiries at DEAM/Belém. After analyzing the obtained data, it was verified that the threat was the most recurrent criminal type in the police statistics of the Specialized, during the period examined, but only a negligible part of the cases was verified through Inquiries, evidencing that the requirement of criminal representation and Morbidity and procedural bureaucracy have been an obstacle to access to justice and to the effectiveness of state tutelage.Keywords: Threat. ZusammenfassungSeit Voltaire der Welt sein „Criez, et qu’on crie“ entgegenschleuderte und damit den Richterspruch gegen den Toulouser Kaufmann Calas zum Fanal erhob, dominiert ein Leitbild die Vorstellung vom politischen Intellektuellen. Dieser zeichnet sich dadurch aus, dass er den Staat und seine Institutionen zum Gegenstand öffentlicher Kritik macht und sich ihnen, wenn nötig, mit einer auf Gelehrsamkeit gründenden Autorität entgegenstellt. Erst das 20. Jahrhundert und der zu dieser Zeit expandierende bürokratische Anstaltsstaat bringen einen neuen Intellektuellentypus hervor. Jener agiert nicht mehr nur als Beobachter, der sich „von außen“ und unter Berufung auf universelle Werte in die politischen Belange von Staat und Gesellschaft „einmischt“. Vielmehr treibt er die Debatte „von innen“ heraus an, indem er seinen Status als juristischer Experte und/oder Staatsbeamter nutzt, um auf Störungen, Widersprüche und Fehlentwicklungen aufmerksam zu machen, welche Demokratie und Rechtsstaat zu beschädigen und auszuhöhlen drohen.Mit Fritz Bauer, ein besonders erfolgreicher Vertreter dieser neuen Spezies des Justiz-Intellektuellen, beschäftigt sich die Biographie von Ronen Steinke. Steinke, selbst promovierter Jurist und derzeit als rechtspolitischer Experte für die „Süddeutsche Zeitung“ tätig, hat für sein Thema einen journalistischen Zugang gewählt. Vom Mainstream der Fritz-Bauer-Biographik, die seit einigen Jahren an der Schnittstelle von Wissenschaft, Publizistik, Film und Ausstellungswesen gedeiht, hebt sich der Autor gleich in zweifacher Weise ab. Erstens verzichtet er auf die üblichen normativen Aufladungen linker Intellektuellenbiographien und nähert sich seinem Untersuchungsgegenstand stattdessen aus historisierender Perspektive. Zum zweiten interessieren ihn jene erfahrungsgeschichtlichen und lebensweltlichen Dimensionen, die bisher unterrepräsentiert oder komplett ausgeblendet blieben.So beleuchtet Steinke erstmals Bauers ambivalente Verbindungen zum Judentum, die dieser nach der Remigration zumeist herunterspielte und negierte. Außerdem greift er die – bislang als waberndes Gerücht – kolportierte These von Bauers verdrängter Homosexualität auf, um zu diskutieren, inwieweit dessen doppelte Außenseiterstellung (innerhalb der Justiz und des linksliberalen Establishments) auch als Folge einer psychologischen Konstellation begriffen werden kann, bei der sich gesellschaftliche Ausgrenzung und selbstgewählte Isolation kumulativ verstärkten. Von der Auseinandersetzung mit dem alliierten Kriegsverbrecherprogramm über die Anklageerhebung im Braunschweiger Remer-Prozess bis zur Vorbereitung und Durchführung des großen Frankfurter Auschwitz-Verfahrens werden die Beweggründe und Leitlinien seines vielseitigen politischen Engagements beschrieben. Dabei wird deutlich, worin sich Bauers Strategie als öffentlicher Intellektueller von der seiner Zeitgenossen unterschied. Mit großer Virtuosität nutzte er die sich bietenden Bühnen in Justiz, Politik, Medien, kirchlichen Akademien und Universitäten, um seine Agenden und Themen vor ein größeres Publikum zu bringen. Berührungsängste hatte er dabei ebensowenig wie Bedenken angesichts des häufig geäußerten Vorwurfs, er würde sein Justizamt zu Zwecken des politischen Kampfes missbrauchen.Diese innere Unabhängigkeit und Autonomie teilte Bauer mit Richard Schmid, einem anderen NS-verfolgten Juristen, der zum Präsidenten des Stuttgarter OLG avancierte. Beide blieben während der fünfziger Jahre insofern Ausnahmeerscheinungen, als sie ihre prononcierte Kritik aus der Position des verbeamteten Juristen heraus äußerten. Erst gut zehn Jahre später – Bauer war zu diesem Zeitpunkt bereits tot – bildete sich in linksliberalen Juristenkreisen ein überschaubares, aber einflussreiches Feld an Wortführern heraus, das den Pfaden von Bauer und Schmid folgte und sich offensiv in öffentliche Debatten einmischte. Ein vergleichender Blick auf diese beiden wortmächtigen Sozialdemokraten hätte somit in gewisser Weise nahe gelegen, um mögliche Zusammenhänge zwischen jüdischer Verfolgungserfahrung und intellektuellem Rollenwechsel präzise zu fassen. So aber wird dieser Zusammenhang teilweise nur behauptet, ohne dass dies empirisch untermauert würde.Alles in allem zeichnet Steinke ein Porträt des Frankfurter Generalstaatsanwalts, das persönlicher, nuancierter und farbenreicher ausfällt als frühere Darstellungen. Auf der anderen Seite treibt die flüssig geschriebene Darstellung, die sich bewusst an ein breites Lesepublikum wendet, streckenweise in der Sphäre des Spekulativen dahin. Interessante Spuren wie Bauers Verbindungen zu Max Horkheimer, Carlo Schmid, Kurt Schumacher, Willy Brandt, Richard Schmid und Rudolf Katz werden ausgelegt, dann aber nicht weiter verfolgt. Steinke trägt der Vielseitigkeit und Ambiguität des Ausnahmejuristen Rechnung, indem er den Privatmenschen bewusst einbezieht. Damit lenkt er den Blick auf Fragen und Konfliktlinien, die in der Vergangenheit teils unentdeckt blieben, teils aber auch absichtsvoll verdeckt worden sind. Mit dieser neuen Biographie wurde eine historische Figur, die in den letzten Jahren ins Monumentalistische zu entschweben drohte, wieder auf ein Maß zurechtgestutzt, an dem sich die künftige Forschung reiben kann. Darin dürfte auch ihr wesentlicher Wert für die Zeitgeschichte liegen.
