Abstract:
In recent years the subject of energy planning has come to occupy a role of growing importance, both in relation to the escalating costs, scarcity and impact of energy procurement and consumption and in relation to the increasingly broad future prospects generated by the development of technologies for the exploitation of renewable sources. Within this framework, the development and use of the latter frequently appears to be without benchmarks for integration into the broader picture of territorial planning, and hence of coordination with other human activities and territorial resources. With this in mind, this book aims to compose the elements of a perspective in which energy planning is seen not as an ulterior and separate form of planning, but as an activity integrated within the more general instruments for the government of the territory, and more specifically one that employs the resources of the territory in a sustainable manner also with a view to endogenous local development.

This chapter discusses the scope of the Brussels 2012, Lugano 2007, and the Hague Convention. This is an important issue because if a case is outside their scope, they will not apply. It considers the international and territorial aspects: the rule that the instruments apply only in situations with an international element; and the fact that they apply only to particular territories. All three instruments apply in the European Union as part of EU law. Their territorial scope is, first and foremost, to be determined by looking at the EU Treaties. In the non-EU Parties to Lugano and Hague, the position is different. In those States, the instruments apply by virtue of international law.

Abstract:
The preprint presents the economic mechanism of investment programs and analyzes its components: specific indicators for evaluating the investment part of developmental programs are proposed; a specific pricing for products manufactured as a result of the implementation of investment projects; a system of financing developmental programs based on the optimal ratio of budget funds, reinvested profits and credit. The empirical base of the study is made up of materials from the petrochemical complex. In this regard, the world trends in the development of petrochemical chemistry and the situation in the petrochemical complex of Russia are considered. Recommendations are given regarding the development of the petrochemical industry of Russia. A multi-criteria optimization model that implements the presented economic mechanism and is intended to form variants of the structure of the governmental program for industrial and regional (territorial) development is developed. The results of a computer experiment are presented. Variants of a conditional program for the development of the Russian oil and gas chemical complex showing the positive impact of the proposed economic mechanism on the structure and indicators of the program are developed.

Abstract:
This book addresses the impact of EU law beyond its own borders, the use of law as a powerful instrument of EU external action, and some of the normative challenges this poses. The phenomenon of EU law operating beyond its borders, which may be termed its ‘global reach’, includes the extraterritorial application of EU law, territorial extension, and the so-called ‘Brussels Effect’ resulting from unilateral legislative and regulatory action. It also includes the impact of the EU’s bilateral relationships, and its engagement with multilateral fora and the negotiation of international legal instruments. The book maps this phenomenon across a range of policy fields, including the environment, the internet and data protection, banking and financial markets, competition policy and migration. It argues that in looking beyond the undoubtedly important instrumental function of law we can start to identify the ways in which law shapes the EU’s external identity and its relations with other legal regimes, both enabling and constraining the EU’s external action.

Abstract:
This chapter identifies the content and scope of application of the EU prohibition of refoulement. Following the ‘cumulative standards’ approach, the analysis incorporates developments in international human rights law (IHRL) and international refugee law (IRL). Taking account of the prominent role of the ECHR and the Refugee Convention (CSR51) as sources of Article 19 CFR, these are the two main instruments taken in consideration. The scope of application of Articles 33 CSR51 and 3 ECHR will be identified in turns. Autonomous requirements of EU law will be determined by reference to the asylum acquis as interpreted by the CJEU. The main focus will be on the establishment of the territorial reach of EU non-refoulement. The idea that it may be territorially confined will be rejected. Drawing on the ‘Fransson paradigm’, a ‘functional’ understanding of the ‘implementation of EU law’ standard under Article 51 CFR will be put forward, as the decisive factor to determine applicability of Charter provisions. The implications of non-refoulement for the different measures of extraterritorial control considered in Part I will be delineated at the end.

Abstract:
This chapter observes how it may be inappropriate to apply a single jurisdictional threshold to diverse instruments such as data privacy laws. In the light of this observation, a proposal is outlined for a ‘layered approach’ under which the substantive law rules of such instruments are broken up into different layers, with different jurisdictional thresholds applied to each such layer. This layered approach is discussed primarily as a technique to be utilized in legal drafting, but it may also be applied in the interpretation and application of legal rules. Article 3 of the European Union’s General Data Protection Regulation, which determines that regulation’s scope of application in a territorial sense, provides a particularly useful lens through which to approach this topic and, thus, the discussion is largely centred around that Article.

Este texto para discussão tem como objetivo discutir a validade e as oportunidades possíveis para a realização da tarefa de coordenação de políticas produtivas no território. Procura dialogar diretamente com as preocupações nacionais de desenvolvimento territorial equitativo e, desse modo, com a Política Nacional de Desenvolvimento Regional (PNDR). Avalia a trajetória recente dos mais relevantes instrumentos de financiamento produtivo com impactos territoriais, quais sejam, a política de crédito rural; os desembolsos do Banco Nacional de Desenvolvimento Econômico e Social (BNDES) para atividades produtivas; os valores aplicados dos fundos constitucionais de financiamento (FCFs) da política regional; e a capacidade governamental de atuar por meio do gasto federal em investimento público. Como resultado da investigação, o trabalho mostra elevada concentração de recursos de financiamento em regiões mais desenvolvidas e pouco afeitas, atualmente, ao patrocínio do pacto redistributivo nacional para uma sociedade justa.

Abstract:
This chapter provides a summary and concluding remarks regarding the future of cross-border insolvency. It argues based on the analysis in the previous chapters that a regime that fits current market conditions and increases global and local welfare is within reach, and is founded on the emerging norms of modified universalism. Persisting territorial inclinations should not cast a shadow over the desirability of modified universalism. Rather than yielding to territorialist inclinations, international actors should strengthen modified universalism by attempting to close gaps in the system to reflect agreed norms and by working to overcome negative biases in favour of positive ones. Modified universalism can crystallize into binding law in the form of customary international law (CIL), which can close gaps and overcome biases. The system can further foster compliance with the norms through a range of measures. While cross-border insolvency is already governed by proper instruments, certain gaps remain. It is suggested that there is room for additional work on the instruments and generally on strengthening the cross-border insolvency system. Future reform should continue to be multifaceted, with different roles assigned to different actors.

Entre las problemáticas ambientales que afectan a las ciudades mineras, una de las más graves es la exposición crónica de la población a metales a través del aire, del suelo o aguas. En 2016, el Ministerio del Medio Ambiente (MMA) evaluó numerosos sitios con potencial presencia de contaminantes (CENMA, 2016), entre ellos los “relaves urbanos”, e identificó múltiples sitios con contaminantes metálicos, concluyendo que existen carencias de información con respecto al contenido de metales en los suelos urbanos y periurbanos en nuestra zona de estudio, la ciudad de Copiapó. El Centro de Desarrollo Urbano Sustentable (CEDEUS) realizó un diagnóstico de la condición ambiental de Copiapó, para luego estimar de forma preliminar el riesgo a la salud de la población debido a la ingestión de polvos de calles y suelos enriquecidos con metales. Parte de la investigación identificó el origen de los metales en la ciudad y cómo se distribuyen en Copiapó. Luego, se analizó cómo los Instrumentos de Planificación Territorial (IPT) y los Instrumentos de Gestión Ambiental pueden ser utilizados para evitar, controlar o mitigar el uso de suelo con presencia de contaminantes a partir de una priorización por las implicancias sanitarias poblacionales. Asimismo, el documento entrega recomendaciones a la política pública para ciudades insertas en un contexto minero
