Abstract:
The article presents the thesis that the activity of the organs of local selfgovernment units is based on the constitutional principle of term of office. All cases of shortening or extending their term of office are constitutional matter. As exceptions to the term of office, they cannot be interpreted extensively. In the light of the provisions of the Constitution of the Republic of Poland, failure to conduct elections of local self-government units on time is an attempt to deprive the Nation of its sovereign rights as a supreme power in the state and exhausts the features of anti-democratic activities of state authorities. The work uses the dogmatic method. The legal provisions concerning the term of office of local government bodies’ activities were analyzed. On this basis, the research problem of the constitutionality of extending the term of office of local government units during the term of office has been solved.

Abstract:
PurposeCEOs’ (chief executive officer) term of office may explain discretionary accruals as a result of opportunistic behavior arising during certain periods of the term of office. Therefore, CEOs, in their early years of office, have incentives to report results that meet market expectations. In turn, CEOs in their senior year may be motivated to use discretionary accruals to gain private benefits. In this scenario, corporate governance mechanisms play an important role in monitoring relationships. Hence, the purpose of this study is to verify the influence of monitoring mechanisms on the relationship between CEOs’ term of office and discretionary accruals.Design/methodology/approachDescriptive statistics, multiple cross-sectional regression to estimate the accruals and regression of panel data to test the hypotheses were used. The sample comprised 195 companies listed on BM&FBovespa.FindingsThe results indicated that CEOs’ long term of office has a negative impact on the level of discretionary accruals, and thus, Brazilian CEOs with a longer term of office tend to establish a certain reputation in the stock market. On the other hand, it is concluded that CEOs’ intentions, in the first years of term, are positively related to the use of accruals and that the monitoring mechanisms can minimize these CEOs’ opportunistic practices.Originality/valueThe results broaden the literature on corporate governance, pointing that different systems of variable remuneration may influence CEOs’ willingness to manage results in their last year of term.

Abstract:
In 2018, amendments to the law entered into force, which extended and reduced the term of administrative officer of the commune, mayor, and city president. There is a dispute in the doctrine regarding the constitutionality of the adopted regulations. Constitution of the Republic of Poland leaves the ordinary legislator to determine the principles and procedure for electing the executive bodies of local government units. The literature presents agruments for and against the introduced changes. The adopted changes are effective from the term of office started in 2018, terms that have already ended are not taken into account.

In recent years, there have been statutory changes interfering with the existing regulations on the duration of the term of office of local government bodies. In 2018, the term of office of those bodies was extended, and in 2022 a law was passed extending the existing term of office of these bodies by half a year. Earlier, in 1998, the inter-term period was extended. The article examines the admissibility of extending the term of office of local government bodies in course of its duration. The term of office principle was characterized and its normative basis were discussed.

Customarily professional legislators are thought to behave more strategically than other legislators in their quest for higher office (Canon 1990; Jacobson and Kernell 1983). The implementation of term limits upsets all the traditional career parameters by restructuring the incentives to remain in political office. For this reason, we posit the following questions: how much difference does a legislature’s level of professionalism make in how members respond to term limits? How do term limits affect legislators’ responsiveness to available opportunities and willingness to take risks to continue their careers? We use a comparative case study approach and pooled cross-sectional data to analyze individual career decisions of legislators in seven states with varying levels of professionalism and term limit laws from 1992-2002. Using multinomial logit, we find that decisions to seek other offices in response to term limits are highly contingent on a state’s level of professionalization.

Can sitting Minister-Presidents rely on an incumbency advantage in German state parliament elections despite the indirect nature of their election? Changes in the office of the Minister-President after (and between) state parliament elections in Germany from 1950 to 2022 show: the importance of state parliaments and their parliamentary party groups should not be underestimated . More new Minister-Presidents were elected during an electoral term than after state parliament elections . Concerning elections to the offices during terms, four different resignation reasons could be identified: successions were successful, in particular, after resignations out of personal reasons . Moreover, it is possible to confirm an indirect incumbency bonus: parties of sitting Minister-Presidents who had served a whole term lost on average less shares of votes than parties of incumbents that had been in office for less than one term . In addition, there has been an increase of incumbent losses since 1990 . Parties of incumbent Minister-Presidents lost more share of votes between 1991 and 2022 than in the time until 1990; this trend is in particular observable again for incumbents that had been in office less than one term .

Abstract:
This study aims to determine the basic application of the regional head office limitation model in Indonesia and how the implementation of the regional head office limitation in various countries. The research method used is normative juridical which uses primary and secondary legal materials and uses the statutory approach, the historical approach, and the comparative approach. The results showed that the underlines of application of the model for limiting the term of office of regional heads are the policy of legislators who equate the model of limiting the position of the head of state government based on Article 7 of the 1945 Constitution also several Constitutional Court decisions which further clarify the technical limitations of the term of office of regional heads. A comparison of the model for limiting the term of office of regional heads in several countries shows that each country applies a different model for limiting the term of office. However, the four countries have one thing in common, namely that the limitation on the term of office of regional heads is a different model from the limitations applied to the positions of heads of state governments. Ideally, the limitation of the term of office of regional heads is a matter that should be decentralized to the regions so that regional regions can determine their policy of limiting their term of office depending on the will of their constituents in the region which is regulated by local provisions.

One of the content materials in constitutional amendment process is Article 7 of 1945 Republic of Indonesia Constitution concerning the President's term of office being limited to only two terms. During the era of President Joko Widodo's leadership, the issue of extending presidential term into three terms resurfaced. This study raises the main issues studied are, First, how is the legal politics of extending the President's term of office in terms of the Presidential Government System. Second, what is the urgency of President's term extension in terms of the Presidential System. This research is a normative juridical research with legal materials. The approach method used is the statutory approach and the conceptual approach. This study uses a qualitative descriptive analysis technique. Based on the results of research and discussion, that First, legal politics in extending the presidential term of office, namely placing a place to filter leaders so they can advance in a direct democratic party has a logical consequence so that in a presidential system of government, the existence of political parties can certainly have an influence on support on every presidential policy taken. Second, the urgency of an extension of the term of office of President in terms of Presidential Government system, that there is no need to extend the term of office for three terms because it causes discontinuity regarding the terms of office of the President and Vice President in Indonesia in order to prevent authoritarianism. The advice from this paper is that the extension of the term of office of the President and Vice President is sufficient for 2 periods and there is no need for an extension of the term of office of the President for more than two consecutive terms, because it can lead to abuse of power.

Methode: This research was conducted using normative legal analysis, with the approach method being the statutory regulation approach. An analysis of the results of this research is carried out by criticizing, supporting, or providing comments, then making a conclusion on the research results with your thoughts and the help of a literature review. Result: Constitutional Court Decision Number 112/PUUXX/2022, the term of office of the KPK leadership will be 5 (five) years and they can be re-elected for only one term of office. Conclusions: The Constitutional Court granted the request for an extension of the term of office of the KPK leadership with considerations, namely: Firstly, there is discriminatory and unfair treatment towards the KPK when comparing it with other independent government institutions which have the same constitutional importance. Firstly, there is discriminatory and unfair treatment towards the KPK if it equates it with other independent government institutions which share constitutional importance, namely having a term of office of 5 years. Second, because based on the principles of benefit and efficiency, the 5-year term of office for the leadership of the Corruption Eradication Committee is much more useful and efficient so that it can correspond to one term of office for the president.

Abstract:
Producing, marketing, and releasing movies in theatres is extremely risky, with many different variables affecting its success. In order to reduce the number of failures, it is essential that the drivers of box office performance are understood by studio managers. This paper examines the combined effect of movie characteristics and studio actions on short-term and long-term box office revenues. These factors are tested using OLS regressions to determine significance of each. The results indicate that release strategy has the biggest effect on opening weekend box office revenue, which is proven to be the best indicator of long-term box office revenue.

Limiting the terms of members of Congress has become a highsalience issue in contemporary American political discourse, necessitating the attention of the United States Supreme Court to provide constitutional guidance. The forces reviving this debate, dormant since the nation's founding period, merit scrutiny. In addition to reviewing the positions of term limitation advocates and opponents, specific limitation proposals--which lack uniformity as some are chamber-specific, others are life-time bans, etc--also require investigation. The review of relevant judicial precedents will also provide helpful preliminary information useful to analyze U.S. Term Limits vs. Thornton, the term limits case decided by the U.S. Supreme Court in May 1995. Researching this increasingly divisive political issue ought to generate a useful, concise synopsis of the historical and judicial issues underpinning the debate, the discussion itself, and analysis of relevant judicial action.

Over recent years, the economic climate on the Swedish office market has been advantageous, and, as a result, both property prices and market rents have been on a constant rise for almost a decade. Moreover, an increased demand for flexibility in lease terms has been seen on the market, which begs the question; how would changing preferences in length of tenure affect rent levels? There exist several convincing theoretical cases that leases should yield different pricing dependent on its maturity and expectation about future market conditions. The conceptual framework developed by Grenadier (1995, 2005) has been used for the valuation of general leasing contracts and lease terms - applying an option-pricing approach. In total, three papers have analysed the effect length of tenure has on office equilibrium lease rates. However, the empirical evidence, to this date, has been inconclusive in its result when trying to isolate the effects. The purpose of this report is to investigate the relationship between rent and lease maturity. A hedonic pricing model will be developed, which allows for different shapes of the term structure curve, building on the model created by Gunnelin and Soderberg (2003), while controlling for price-relevant characteristics omitted in previous research – such as, building quality, quality of office premise, location, and tenant industry. The model will be used in an empirical study applied to commercial office contracts in Stockholm, Sweden, concluded between 2012 and 2019. The data used in the regression comprise of 1 508 office leases, contracted on the Stockholm market during the investigated period. The result showed a significant term structure for 4 out of 8 years for the full sample, and 5 out of 8 years for the subsample only including leases signed in the CBD. Concludingly, giving further evidence to the reasoning that the market adjusts the rents after lease length, according to future market expectations.

Abstract:
This thesis examines the formulation and implementation of us policy towards China during the Clinton Administration's first term of office. Its central contention is that the Clinton Administration's China policy-making process was founded on largely on domestic political calculations, to the detriment of America's long term broad strategic interests in the People's Republic. This is exemplified by his advocacy, implementation, and eventual abandonment, of a strategy of linkage toward China. This thesis contends that President Clinton's preoccupation with domestic political calculations led to three major flaws in his Administration's China policy-making process. Firstly, it led to a failure to define a hierarchy of US priorities in China. Secondly, it led to a failure to articulate a coherent framework for US China relations to either the Chinese or domestic American audiences. Thirdly, Clinton failed to commit himself to, or provide leadership on, China policy except in the event of a political crisis. Accordingly, these flaws encouraged splits within the Administration whereby different agencies pursued their own agendas with Beijing. As a result, the Clinton Administration's China policy appeared confused, incoherent and discordant. This served to undermine both the US strategic relationship with Beijing, and domestic legitimacy for US China policy.

Abstract:
A nation's foreign policy is often subject to change. This change may occur in its relations with other nationstates or with international organizations such as the European Economic Community (E.E.C.). Greece became a full E.E.C. member in January, 1980, when the conservative Nea Democratia was in power. The Nea Democratia, both in government from 1974 to 1981 and in opposition since 1981, has been consistent in its support for the E.E.C.; in contrast, the Panhellenic Socialist Movement (PASOK) has not. PASOK, in opposition from 1974 to 1 981 , was against Greek membership in the European communities. PASOK, in its first term in office from 1981 to 1985, reversed itself on the issue. During this period, PASOK made no effort to withdraw Greece from the E.E.C. This study examines PASOK's reversal of policy. Two domestic factors are examined in detail: the general economic difficulties of Greece during PASOK's first term, and the role of the powerful agrarian interests.

This paper addresses an obscure aspect surrounding Solon’s activity, which occurred after his political and legislative activity and before his opposition to Pisistratus’ moves towards tyranny. It tackles, more specifically, the way in which Solon may have been indirectly involved (as a politician but also as a sophos) in a triangle of interests that would include, besides himself, two personalities associated with a period of stasis (Damasias) and with the status of sophos (Thales). AbstractCoworking spaces in Malta have grown in their presence and use only within the last decade, yet the COVID-19 pandemic may have altered the cultural working office norms of Maltese society. Indeed, this chapter, using in-depth interviews with different groups of people, that is, co-worker owners, employees, traditional employers and members of an employment association, aims to explore how the pandemic may be impacting the coworking industry in complex ways. From the narratives, it emerged that the soft lockdown measures related to the pandemic had caused immediate negative effects due to the fear of contagion on the use of coworking spaces in Malta and the limitations related to social distances in workspaces. However, the pandemic itself may have created a shift within the Maltese context where the idea of remote working is perceived as beneficial and may become more popular. The pandemic may have contributed to the revision of the Maltese employers’ priorities, such as the importance of owning or renting a permanent office space or giving permission to employees to work from home or renting a coworking space for socialisation at work. Therefore, the pandemic may have caused damaging short-term effects to the coworking industry in Malta yet possibly beneficial long-term effects.

This chapter discusses Article 9 of the Optional Protocol to the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment, covering the chronology of draft texts, analysis of Working Group discussions, and issues of interpretation. Article 9 of the Optional Protocol is a standard provision in UN human rights treaties providing for a four-year term of office and the principle of partial renewal with ‘staggering’ elections every two years. However, for the first time in a human rights treaty, Article 9 restricts the re-election of members to once only. This restriction of the possibility for a continuing membership of some members of the Subcommittee on Prevention for more than two terms served as a model for later treaties, such as the International Convention for the Protection of all Persons from Enforced Disappearance and Convention on the Rights of Persons with Disabilities.

Decent quality of indoor air is important for health and wellbeing of building users. We live, work and study in indoors of various types of buildings. Often people are exposed to pollutants at higher concentrations than these that occur out-doors. Continual investigation of indoor air quality is needed for ensuring comfort and healthy environment. Measuring and analysis of occurrence of physical, chemical and biological factors is the first step for suggestion of optimization measures. Inside school buildings there are often inadequate indoor climate conditions such as thermal comfort parame-ters or ventilation. The aim of this study was determination of indoor environmental quality in selected offices in the building of elementary school in Slovakia. The values of operative temperature were not within the optimum range of values for the warm period of the year in one of the monitored offices. The intensity of illumination was lower in the two offices. Low levels of particulate matters were measured except the one office where permissible value was exceeded by 7.6%.

The Low-Level Radioactive Waste Management Office was established in 1982 to carry out the federal government’s responsibilities for low-level radioactive (LLR) waste management in Canada. In this capacity, the Office operates programs to characterize, delineate, decontaminate and consolidate historic LLR waste for interim and long-term storage. The Office is currently the proponent of the Port Hope Area Initiative; a program directed at the development and implementation of a safe, local long-term management solution for historic LLR waste in the Port Hope area. A legal agreement between the Government of Canada and the host community provides the framework for the implementation of the Port Hope Project. Specifically, the agreement requires that the surface of the long-term LLR waste management facility be “conducive to passive and active recreational uses such as soccer fields and baseball diamonds.” However, there are currently no examples of licensed LLR waste management facilities in Canada that permit recreational use. Such an end use presents challenges with respect to engineering and design, health and safety and landscape planning. This paper presents the cover system design, the environmental effects assessment and the landscape planning processes that were undertaken in support of the recreational end use of the Port Hope long-term LLR waste management facility.

Office syndrome is dangerous in long-term health such as headache, eyes soreness, neckache, dizziness, chronic muscle pain, numbness around wrists or feet. In severe cases, it may cause the muscles to contract and hold tight. Therefore, understanding the cause can prevent the danger from this illness. The objectives of this research are to study the behaviors causing Office syndrome in Thai by evaluating the basic knowledge of Office syndrome and inform the useful information to prevent the danger of Office syndrome. 312 participants in the age range of 20-40 years answered the online questionnaire as a tool for data collection. The questionnaire is included 3 sections, 1) personal data, 2) the risks of Office syndrome in each person, and 3) basic knowledge of Office syndrome. The results showed that most of the research participants are female, age between 20-27 years old, and work 5-8 hours a day. 224 people are at a high risk of back pain from Office syndrome and only 83 people have received the basic knowledge of Office syndrome. There are 183 people aware of the Office syndrome symptom. This study found that some participants have well-knowledge about Office syndrome but some still misunderstanding the symptoms of the illness. Therefore, the organizations such as companies or schools should provide basic knowledge and quality Office equipment in workplaces to reduce the risks of Office syndrome and create good habits for their people.

Increasing productivity is generally considered to be the only sustainable way of improving living standards in the long term. The Brazilian economy has had periods of strong growth, particularly until 2010, but the country has performed poorly in terms of aggregate productivity. The federal government has implemented many programs aimed at boosting firm growth and fostering competitiveness in Brazilian industries, though knowledge about their results to date is scarce. This study provides an overview of various Brazilian programs of firm support — including productive finance, business consulting, value chain, export promotion, and innovation support — as well as an assessment of the effects of a subset of these programs on productivity, employment, and real wages. Access to a unique dataset on Brazilian firms and beneficiaries allowed the Office of Evaluation and Oversight to analyze these programs over an 11-year period, 2002 to 2012.

Trichloroethylene (TCE) releases from leaks and spills next to a large government building occurred over several decades with the most recent event occurring 20 years ago. In response to a perceived conventional vapor intrusion (VI) issue a sub-slab depressurization system (SSDS) was installed 6 years ago. The SSDS is operating within design limits and has achieved building TCE vapor concentration reductions. However, subsequent periodic TCE vapor spikes based on daily HAPSITE™ measurements indicate additional source(s). Two rounds of smoke tests conducted in 2017 and 2018 involved introduction of smoke into a sanitary sewer and storm drain manholes located on effluent lines coming from the building until smoke was observed exiting system vents on the roof. Smoke testing revealed many leaks in both the storm sewer and sanitary sewer systems within the building. Sleuthing of the VI source term using a portable HAPSITE™ indicate elevated vapor TCE levels correspond with observed smoke emanation from utility lines. In some instances, smoke odors were perceived but no leak or suspect pipe was identified suggesting the odor originates from an unidentified pipe located behind or enclosed in a wall. Sleuthing activities also found building roof materials explain some of the elevated TCE levels on the 2nd floor. A relationship was found between TCE concentrations in the roof truss area, plenum space above 2nd floor offices, and breathing zone of 2nd floor offices. Installation of an external blower in the roof truss space has greatly reduced TCE levels in the plenum and office spaces. Preferential VI pathways and unexpected source terms may be overlooked mechanisms as compared to conventional VI.

Economic diversification is an incessant theme threading policy discussion in Trinidad and Tobago, although with an ebb and flow over time. This topic is once again at the forefront of policy discussions following the recent oil price decline and subsequent to the new administration that took office in September 2015. This policy brief discusses the potential role that the exchange rate plays in diversification, fiscal adjustment and economic growth. In doing so we use a new estimation of the real effective exchange rate that better captures competitiveness of the country's non-oil exports. The evidence assembled in this policy brief suggests that the exchange rate could have an important role in fiscal adjustment, economic growth, and diversification. We find that a major change in the exchange rate would reduce the size of the fiscal adjustment in the short term. It would boost diversification of non-energyexport products and their markets over the medium term, hence spur economic growth and employment. Presumably, there are perceived short-term downsides. These include (i) an inflationary effect which implies reduced household real income and hence a possible increase in poverty, and (ii), increased cost of imported material used as inputs in production, which compounded by microeconomic level balance sheet effects that arise in the presence of liability dollarisation that also leads to negative impacts of real exchange rate devaluations on firms' performance.

This evaluation reviews the experience of the Inter-American Development Bank Group (IDB Group) with using medium- and long-term guarantees to support its clients during the period 2005 to 2020. This is the first evaluation by the Office of Evaluation and Oversight (OVE) of the guarantee instrument - an instrument that has the potential to mobilize private resources and has been in the tool kit of the Inter-American Development Bank (IDB) since its establishment (see IDB, 1996). The evaluation is delivered at a time when the IDB Group and its borrowers are looking for innovative ways to mobilize additional financing to confront the consequences of the COVID-19 pandemic, to meet the Sustainable Development Goals, and to comply with the Paris Agreement. The From Billions to Trillions initiative prepared jointly by several multilateral development banks (MDBs) aims to mobilize private financing for these goals (AfDB et al., 2015). This evaluation examines the extent to which the IDB Group has used guarantees to mobilize private resources and identifies the main challenges to the use of long- and medium-term guarantees. The focus is on guarantees as an instrument, and thus the evaluation does not assess the outcomes of projects and programs financed using guarantees.

The IDB-9 Agreement included a requirement that the Office of Evaluation and Oversight (OVE) conduct a mid-term review to determine to what extent IDB was implementing the IDB-9 mandates fully and effectively. OVE undertook the reviewduring 2012 and delivered it to the Board in December 2012. The institutional strategy laid out in the IDB-9 agreement extended until 2015, at which time the accomplishments under the strategy and the IDB-9 Results Framework were to be evaluated and a follow-on strategy was to be adopted. The Results Framework specified 2015 as the target date for achieving many IDB-9 mandates, in line with the strategy period. In 2016, the Board of Directors requested that OVE include an IDB-9 evaluation in its 2017-18 work program, to be delivered before the Annual Meetings in Mendoza, Argentina in March 2018. OVE's Mid-Term Evaluation was intended as an early progress report, and as such it focused primarily in detail on the first three years of implementation of the IDB-9 mandates. This evaluation intends to take a broader approach to focus not only on implementation but also on IDB's achievements to date under IDB-9 and their implications going forward.

This report updates data on gross and net public debt for countries in the Latin America and Caribbean (LAC) region up to June and December 2010. Gross public debt refers to the total debt of the central government and the central bank, excluding the latter's monetary liabilities and its short-term debt issued for the purpose of monetary regulation. Net public debt subtracts from the previous amount, Central Banks holdings of public debt and international reserves.The data in this report was collected from questionnaires sent to the LAC countries debt offices in April 2011. A record twenty-three countries completed the questionnaire for this report. These countries were: Argentina, The Bahamas, Bolivia, Brazil, Chile, Colombia, Costa Rica, Dominican Republic, Ecuador, El Salvador, Guatemala, Haiti, Honduras, Jamaica, Mexico, Nicaragua, Panama, Paraguay, Peru, Suriname, Trinidad & Tobago, Uruguay and Venezuela. This report is organized as follows. Section 1 summarizes the new developments regarding public debt during 2010. It also presents summary cross country tables for relevant variables. Section 2 displays, in a nutshell, basic information on sovereign debt level and composition by country, as well as information on benchmark bonds and the most recent debt issuances. Section 3 shows more detailed country data in the Data Tables. Finally, the Methodological Appendix in Section 4 describes the debt concepts included in this report, and attaches the questionnaire sent to each country debt office to gather the data.

The empirical literature on the debt overhang hypothesis has estimated the relationship between investment and leverage at the firm level, which does not allow to disentangle between a firm’s decision not to invest as it is highly indebted and its ability to obtain the necessary resources. Using annual Spanish credit data from the Central Credit Register and non-financial corporations’ annual accounts from the lntegrated Central Balance Sheet Data Office Survey for the period 2004-2019, we study the impact of corporate debt on non-financial firms’ demand for bank loans, as a proxy for their willingness to invest. We find a negative relationship between firms’ leverage and demand for bank credit, thus supporting the debt overhang hypothesis. We then study whether such relationship is affected by financial conditions and find that a reduction in short-term interest rates mitigates the effect of firms’ leverage on demand for credit.
