Abstract:
From the government's perspective, an electronic tender or e-tendering system in the procurement of goods and services in Indonesia is a platform to acknowledge good governance and public services since it enhances cost efficiency, effectiveness, shorter turnaround periods, delivers excellent public monitoring, fosters competitiveness, and increases government accountability. Nevertheless, numerous tenders have managed to fail during the implementation of e-tendering for construction works. The purpose of this study is to identify the factors that contribute to tender failures throughout the Surabaya City area. The factors that contributed to the tender's failure were identified from the results of the 220 construction tenders stated on the LPSE website. Descriptive statistical analysis was used to obtain factors that cause e-tender failures from the data obtained. Administrative, technical, price, and qualification criteria are the most dominant four failure criteria. The most apparent cause for auction failure is the provider's inability to attach references to previous projects.

Abstract:
The purpose of this paper is to evaluate tender prices of chosen beverages according to public procurement based on secondary data analysis. The empirical results of analysis (t-test and F-test) show that average annual prices of these beverages are different and collected data are not included in the same sample. Tender prices are different in each year of observed years, although are based on public tender. Important evidence is that for the public tenders in the abroad is obligatory use of the Czech public procurement law. According to this act the base evaluation criterion is the lowest offered price. Data were collected during the years 2005–2009. This study deals with empirical approach, variability of prices of chosen beverages based on public tenders between the Czech Republic (Ministry of Defence) and local suppliers in Kosovo. Results show low variability of prices, which are based on public tender and legal approach, regulated public procurement. The research conclusion is the fact, that tender prices for piece of non-alcoholic beverage are less than 10 % from annual mean (pcs./CZK) of tendered prices.

Abstract:
The article deals with the theoretical and methodological foundations for holding tenders in order to stimulate the environmentally oriented business. The essence of the state stimulating tender for the introduction of business, taking into account the ecological component, which should cover enterprises of different regions of Ukraine, is considered. The purpose of the tender is defined, which is to regulate the state organization of economic and environmental incentives for business entities, which should allocate funds for the implementation of environmental activities. The principles for the implementation of state tenders to stimulate environmental activities conducted by an environmentally-oriented business are: fair competition among participants; maximum savings and efficiency; openness and transparency at all stages; non-discrimination of participants; objective and unbiased evaluation of tender bids; preventing collusion, corruption and abuse. Depending on the way of carrying out state bidding, on stimulating enterprises of eco-oriented business, there are: open; open with prior qualification; trades with limited participation; two-stage bidding; request procedures for the amount of incentive financing. The terms of the tender, which are approved by the tender committee prior to announcement of the tender and are obligatory for its participants to be fulfilled, are determined. In examining, evaluating an application for participation in a tender, the Tender Committee has the right to demand additional economic and ecological information from the applicants, which characterizes the opportunity of renderers� to develop state-funded funds for environmental protection measures provided for in the tender documentation. The financing of the tender is carried out at the expense of state funds and funds of the applicants who wish to take part in the tender. The size of the payment for participation in the tender is determined by the working group and approved by the tender committee together with the estimate for the organization and holding of the tender. These funds are sent to a separate account of the tendered and are used for payment of press releases, premises rent, business trips, communications, development, coordination, reproduction, translation of documents, negotiations, conferences, etc.

SMART formulation is an essential aspect of the Best Value philosophy to demonstrate performance, evaluate proposals and is required for the continuous improvements within organizations. Based on an evaluation of projects that have been tendered with the BVP award mechanism, it was concluded that both for the tender documents, as the interviews in the procurement process, SMART formulation allows for significant improvement. This study proposes the SMART assessment tool, which is a straightforward and effective method to assess tender documents on their degree of SMART formulation and is illustrated by application on the studied tenders.

Abstract:
Recommending the identity of bidders in public procurement auctions (tenders) has a significant impact in many areas of public procurement, but it has not yet been studied in depth. A bidders recommender would be a very beneficial tool because a supplier (company) can search appropriate tenders and, vice versa, a public procurement agency can discover automatically unknown companies which are suitable for its tender. This paper develops a pioneering algorithm to recommend potential bidders using a machine learning method, particularly a random forest classifier. The bidders recommender is described theoretically, so it can be implemented or adapted to any particular situation. It has been successfully validated with a case study: an actual Spanish tender dataset (free public information) which has 102,087 tenders from 2014 to 2020 and a company dataset (nonfree public information) which has 1,353,213 Spanish companies. Quantitative, graphical, and statistical descriptions of both datasets are presented. The results of the case study were satisfactory: the winning bidding company is within the recommended companies group, from 24% to 38% of the tenders, according to different test conditions and scenarios.

Abstract:
Bidding/Tendering Strategies provide the means through which contractors win jobs. This research examines tenders submitted by contractors with a view to assessing several of the factors that are critical and predominant in the success equation towards winning jobs. The Research also assesses the factors that influence contractors’ tenders as well as the challenges faced in the course of submitting tenders. Using both primary and secondary data sources, the research obtains data on several of the factors that impact on tenders. The statistical technique of central tendency was used for the analysis of the factors which impact on tenders. Research findings reveals as follows: Financial stability of contractor, availability of resources size of construction firm, work experience of construction firm, professional affiliation of contractors are significant variables that impact on tenders. The listed variables recorded values that were between 4.00 and 2.76. The research concludes that financial stability of the contractors with a mean score of 4.00 is the highest ranked factor whilst number of competitors with a mean score of 2.76 is ranked the least factor affecting contractors tender. The research recommends that contractors’ financial stability is a critical factor for consideration during the evaluation of tenders to be submitted by contractors and subsequently the award.

The decision of the BGH was based on the following set of facts: The claimant, a public authority, advertised for tenders for carpentry work on a building project. The defendant building firm submitted the lowest tender - in comparison with five others received. After the deadline for submission of tenders had passed, the building firm informed the claimant that an error had been made in the calculation of the tender price. The transport and assembly costs had been left out by mistake, and the firm asked the claimant to take the tender out of the competition and offer the contract to someone else. The claimant refused to do so, and gave the contract to the defendant without taking the error into consideration. When the defendant did not proceed with the work, it was eventually given to someone else. The claim asserted against the defendant was for the additional costs incurred in comparison with the defendant's tender. The Landgericht dismissed the claim, and the claimant's appeal was also unsuccessful. The appeal in revision by the claimant led to the quashing of the appeal court's decision and a reference of the case back to the appeal court. According to the judgment of the BGH, an mistake in calculations was not of itself a sufficient reason for avoiding a contract, if the recipient of the erroneous information knew of it or had avoided obtaining that knowledge in bad faith. Nevertheless, the recipient of the erroneous information - on the basis of precontractual responsibility or abuse of rights - might be obliged to point out to the informer his mistake. In the tendering process, a public contractor was not usually under any obligation to check the tenders for mistakes in calculation or to make further investigations; but exceptionally such a duty might exist when the fact of a mistake in calculation and the unreasonable consequences thereof for the tenderer is obvious from the tender or from other circumstances known to the contractor. The following contributions examine the judgment from the standpoint of Austrian, Portugese, Swedish and Greek law.

Abstract:
Purpose The purpose of this paper is to examine how the period for which a public procurement notice remains open for bidding (Δt) affects the number of bids. Design/methodology/approach The authors investigated data for 2.404 open procurement tenders in Greece for the years 2018–2021. Using Δt as the grouping factor, the authors defined two samples based on the European Union time limits for the receipt of tenders. Group 1 (Δt ≤ 35) contains all tenders for which the contracting authorities (CAs) have chosen to limit themselves to the minimum number of days allowed by law. Group 2 (Δt>35) includes the remaining tenders where CAs have chosen to keep their notices open for periods beyond the existing minimum time limits, as they are encouraged to do by law. Findings A Mann–Whitney U test, in combination with graphical analysis, revealed that CAs from Group 2 tend to enjoy more bids per tender, that is, more intense competition. Social implications The paper allows decision-makers and legislators to understand the relationship between the time CAs choose to keep their notices open for bidding and the number of bidders in each tender, that is, competition, which according to other authors, affects the outcomes of public procurement procedures. Originality/value The paper fills the research gap regarding the relationship between time for preparation and the number of bids in each tender.

Public construction agencies are one of the largest developers within the Danish construction industry, where such agencies own and develop new public construction projects. Most of these projects are put out in European tender. This study analyses the selection and assignment criteria employed by these agencies in different types of public sector projects.Some of the objectives pursued by the study include the determination of 1/ the selection and assignment criteria mostly used in Danish public tenders 2/how different types of projects use selection and assignment criteria in the bidding process, and 3/any significant difference between the use of selection and assignment criteria in Danish public construction projects. The study uses a quantitative research approach where 157 Danish public tender cases were selected from the European Tenders Electronic Daily database between the period: January 2010 to March 2013. Fisher's Exact Test was conducted to determine if there was any significant use of some selection and assignment criteria. The findings of the study showed that invited tenders with pre-qualification and lowest pricein 69.8% of the tenders are the most used selection and assignment criteria, with little regard to project type.

PurposeThe study objective was to understand if uniformity of approach exists in evaluation methods of public food tender for schools at national and local level. This purpose was divided into three sub-objectives: (1) to extract the main criteria, (2) to document the synthesizing findings process and (3) to prioritize the different decision-making alternatives through pairwise comparisons.Design/methodology/approachTo achieve the sub-objectives (1) and (2), a content analysis of the Italian food tenders was carried out. Analytic hierarchy process was used to evaluate and compare the importance of various food tender evaluation criteria (3). The inclusion criteria were: cities' selection; metro area population; population density; duration of the contract; years.FindingsSix public food tenders were analyzed. The first one concerned the National legislation guidelines. The remaining five food tenders were categorized according to the city investigated. Four macro-categories (Food quality; Sustainability; Resources; Ancillary services) were classified. AHP revealed that “Food quality” and “Resources” categories have greater importance in the evaluation phase of almost all cities investigated.Originality/valueThis study in-depth analyzes each criterion used to evaluate public food tenders, providing a new methodological framework for assigning scores to clusters of criteria. Since the literature search did not reveal any previous study on a quantitative evaluation of elements such as short supply chain, organic food and environmental impacts on public food tenders, this research delivers interesting results and fills this knowledge gap.

Context. Public procurement is an important economic factor. To protect against corruption government organizations are required to apply principles of non-discrimination and transparency for the procurement of goods such as software and of services such as software development. As a consequence, communicating requirements in software procurement has become challenging from the perspective of fairness and transparency, and also from the perspectives of system value and acceptance. Objectives. This study investigates requirements communication techniques which are being practiced in WTO-regulated tenders. The study also identifies challenges and determines the efficiency, effectiveness, and legal compliances of these techniques Methods. A systematic literature review is used to determine requirements communication approaches used in public procurement projects and the difficulties identified. This is followed by a case study to research the known requirements communication techniques used in the selected case through conducting interviews and artifact analysis. Results. The contributions are guidelines for stakeholders to select suitable techniques to communicate requirements during the procurement process. Challenges and recommendations are presented to be taken into consideration while planning software procurements. Conclusions. This study concluded that from a total of 17 requirements communication techniques, 14 have been used in the project analyzed in the case study. It is also stated by the interviewees that all of the techniques are legal to use in public procurement with the exception of one, and this is Interview. From both the literature review and the case study conducted in this research, balanced communication techniques are concluded to be most recommended since they will lead to more interaction between customers and suppliers to communicate requirements.

Ce projet a été réalisé dans le cadre d’un partenariat entre Fujitsu Canada et Université Laval. Les besoins du projets ont été centrés sur une problématique d’affaire définie conjointement avec Fujitsu. Le projet consistait à classifier un corpus d’appels d’offres électroniques avec une approche orienté big data. L’objectif était d’identifier avec un très fort rappel les offres pertinentes au domaine d’affaire de l’entreprise. Après une séries d’expérimentations à petite échelle qui nous ont permise d’illustrer empiriquement (93% de rappel) l’efficacité de notre approche basé sur l’algorithme BNS (Bi-Normal Separation), nous avons implanté un système complet qui exploite l’infrastructure technologique big data Hadoop. Nos expérimentations sur le système complet démontrent qu’il est possible d’obtenir une performance de classification tout aussi efficace à grande échelle (91% de rappel) tout en exploitant les gains de performance rendus possible par l’architecture distribuée de Hadoop.
This project was completed as part of an innovation partnership with Fujitsu Canada and Université Laval. The needs and objectives of the project were centered on a business problem defined jointly with Fujitsu. Our project aimed to classify a corpus of electronic public tenders based on state of the art Hadoop big data technology. The objective was to identify with high recall public tenders relevant to the IT services business of Fujitsu Canada. A small scale prototype based on the BNS algorithm (Bi-Normal Separation) was empirically shown to classify with high recall (93%) the public tender corpus. The prototype was then re-implemented on a full scale Hadoop cluster using Apache Pig for the data preparation pipeline and using Apache Mahout for classification. Our experimentation show that the large scale system not only maintains high recall (91%) on the classification task, but can readily take advantage of the massive scalability gains made possible by Hadoop’s distributed architecture.

This thesis examines the computation of inventory levels based on demand history aboard Submarine Tenders that use the Shipboard Automated Data Processing System (SUADPS) for inventory control. The focus of the thesis was the workload and supply effectiveness issues associated with the processing of the SUADPS levels setting program. The objective of the thesis was to determine the effect on supply effectiveness and stock churn if the levels program was processed less frequently. The thesis concludes that the likely effect of less frequent processing of the levels setting program would be an insignificant decrease in supply effectiveness and a significant decrease in stock churn. Further research involving a review of the assumptions and procedures of the SUADPS inventory model was recommended.

Abstract:
Instances of fraudulent acts are often headline news in the popular press in South Africa. Increasingly, these press reports point to the government tender process as being the main enabler used by the perpetrators committing the fraud. The cause of the tender fraud problem is confidentiality breach of information. This is accomplished, in part, by compromising the tender information contained in the government information system. This results in the biased award of a tender. Typically, the information in the tender process should be used to make decisions about a tender’s specifications, solicitation, evaluation and adjudication. The sharing of said information to unauthorised persons can be used to manipulate and corrupt the process. This in turn corrupts the tender process by awarding a tender to an unworthy recipient. This research studies the generic steps in the tender process to understand how information is used to corrupt the tender process. It proposes that conflict of interest, together with a lack of information confidentiality in the information system, paves the way for possible tender fraud. Thereafter, a system of internal controls is examined within the South African government as well as in foreign countries to investigate measures taken to reduce the breach of confidential information in the tender process. By referring to the Common Criteria Security Model, various critical security areas within the tender process are identified. This measure is assisted with the ISO/IEC 27002 (2005) standard which has guiding principles for the management of confidential information. Thereafter, an information security policy,the Chinese Wall Model will be discussed as a means of reducing instances where conflict of interest may occur. Finally, an adapted Chinese Wall Model, which includes elements of the tender process, is presented as a way of reducing fraud in the government tender process. Finally, the research objective of this study is presented in the form of Critical Success Factors that aid in reducing the breach of confidential information in the tender process. As a consequence, tender fraud is reduced. These success factors have a direct and serious impact on the effectiveness of the Chinese Wall Model to secure the confidentiality of tender information. The proposed Critical Success Factors include: the Sanitisation Policy Document, an Electronic Document Management System, the Tender Evaluation Ethics Document, the Audit Trail Log and the Chinese Wall Model Prosecution Register.

Auditing provides an important role supporting the function of financial markets where information asymmetry exists between shareholders and management. The audit market for the largest publicly listed UK companies, those within the FTSE 350, has however come under scrutiny following a number of financial scandals and, driven both by quality and competition concerns as the largest audit firms, the “Big 4” are dominant. Auditor tenure and long periods without competitive tenders have been recurrent concerns and yet how companies select their auditors is under researched. This study examines the influences on the complex decision process underlying auditor selection in FTSE 350 companies during an important period, namely that between the acquisition of Arthur Andersen by Deloitte in August 2002 and the introduction of the September 2012 UK Corporate Governance Code by the Financial Reporting Council. Based on a social constructionist philosophical perspective and adopting a grounded approach, the study covers 60 auditor selection decisions (over half of those identified in the research period) and includes in depth interviews over a period of two years with those who had recently been involved in a FTSE 350 auditor selection process; both from the buy-side and the sales-side. A conceptual model is developed which illustrates five factor groups that this research identified as influencing auditor selection in typically comprehensive proposal processes. These were: Relationships at the start of the proposal process, Service design, Capabilities and competences of the bidding firms, Behavioural influences during the proposal process and Final decision making. It also identifies interrelationships between these factor groups. These results are important because they inform theory and practice at a time when auditor change is becoming a statutory requirement. The study also has implications for other complex purchases of intangible services, particularly other professional services, and potentially for complex decision situations more generally.

The aim of this diploma thesis is to analyze the impact of openness (competition) to the final price of public tender. The openness is presented by a number of bids offered to a tender and is compared to the level of savings, i.e. ratio of final and assumed value of the tender. The analysis is done on a data set of tenders of works published in the year 2013, which contain 5065 tenders. Based on correlation and regression analysis, the impact of openness was confirmed, concretely each additional bid decrease final price of tender by 2,36 percent. Recommendations for changes of the tender handling are stated at the end of the thesis.

The key objective of a procuring entity is to ensure that it procures services and goods with satisfactory quality at a reasonable cost, but how does the competitive environment effect the realization of these ambitions? The empirical analysis aimed to investigate the effect of qualifications criteria, interpreted as a mean to ensure high-quality services, on the number of submitted tenders as well as the effect of the number of tenders on the size of the bids of public procurement of internal cleaning services in Sweden during 2015-2017. The expectation is that qualification criterions imposes both entry costs and costs associated with fulfilling the contract. With increased prerequisite costs, firms could choose not to participate as the cost associated with becoming a qualified tender are considered too high. Further, increased competition is expected to reduce the size of the placed bid. The diminution of the size of the bid is expectedas a consequence of reduced mark-ups with increased level of competition. To test the hypotheses, an instrument variable 2SLS regression was considered. The main results of the empirical analysis concluded that there are costs associated with few tenders. The direction of effects of setting qualification criteria did not yield cohesive results, as some increased the number of tenders and other decreases them, while some had no significant effect.

Aim/Purpose: This study’s objective is to demonstrate the wisdom of the crowds phenomenon in construction project tenders and relate it to cost overruns in these projects. Background: The wisdom of the crowd’s phenomenon is an age-old idea that argues that collective opinion is better than any single (even expert) opinion. The first data-based evidence for it is from the beginning of the twentieth century when statistician Francis Galton attended an exhibition in which attendants were asked to estimate the weight of a large ox. He found that while individual estimates varied considerably, the median estimate was within less than one percent from the true weight. The existence of the wisdom of the crowds has a particularly important implication in tenders. Consider a tender for a contract in which the winner is the bidder that agrees to take the contract for the lowest cost. If the collective bid, i.e., the mean bid, is the most accurate in assessing the true value of the contract, then the winning bid is overestimating the contract and is therefore expected to end up with a loss. Indeed, this winner’s curse, was first observed in tenders in the petroleum industry and has been since found in many other fields. Methodology: All the construction projects that were tendered and completed between January 2017 and July 2020 under the management of the department of engineering and construction, a government agency in Israel, were analyzed. After data cleansing, the data comprised 148 tenders with 1295 bids and total value of 229 million US dollars. For each project we determined the valid bids, average (valid) bid, the winning bid, the original project estimated cost, and the actual payments to the winning contractor (actual project cost). Contribution: Construction projects in the public sector are typically granted through a bidding process in which the lowest bidder is granted the contract. It is therefore of interest to examine whether the wisdom of the crowds and the winner’s curse phenomena are manifested in this type of tenders. The results could help understand the reasons for cost overruns in public construction projects. Findings: 1. Wisdom of the crowds: For each project we computed the ratio of the average bid and the project’s estimated cost. The mean ratio (for the 148 projects) was 1.01 suggesting that, on average, the bids are within 1 percent from the true project value. 2. Winner’s curse: On average the winning bid was 7.9% less than the estimated cost and 8.1% less than the average bid. 3. Cost overruns: On average, the payments to the contractor were 16.3% higher than the estimated cost, and 18.8% higher than the average bid. 4. In total these results demonstrate how contractors are able to overcome the winner’s curse. On average, payments to the contractor were 30.7% higher than their bid. Recommendations for Practitioners: Tender issuing public agencies should take into account that the winning bid is based on unrealistic optimism and when the winning contractor is tested by the real costs, they will be hard pressed to avoid these losses and therefore will drive the project into cost overruns. Recommendations for Researchers: It is important to model the strategic game between contractors and project managers that represent the tender-issuing agency. This may explain why the construction industry is beleaguered by cost overruns. Impact on Society: In the current state, the public is paying more than needed for construction projects since winning contractors are struggling to spin their losses into gains. Future Research: Develop game theory models that are based on our empirical findings and that can help to reduce cost overruns in construction projects.

Developing countries are increasingly using auctions for the procurement of utility-scale renewable electricity, due to the potential for attracting private investment. However, auction design and implementation can face serious obstacles due to complex context-specific factors. In 2017, Ethiopia launched its Public–Private Partnership (PPP) policy and procurement framework to promote infrastructure development, including electricity generation. Since 2018, it has organised renewable energy auctions to procure new capacity from independent power producers (IPPs). However, the new framework faces numerous challenges. Using a literature review and primary data from more than 70 interviews and from stakeholder consultations, this study explores the political economy challenges and opportunities facing IPP project preparation, decision-making, coordination and implementation, and risks to investors. To date, Ethiopia has held two rounds of tenders to procure 1,000 megawatts (MW) of electricity from eight projects; the first tender for two solar photovoltaic (PV) projects led to the signing of Power Purchase Agreements (PPAs) and was hailed as one of the cheapest tariff rates in sub-Saharan Africa, at US$2.526 cents/kilowatt hour (kWh) over 25 years. However, none of the projects have yet become operational. This study also finds fault lines impeding the implementation of IPP projects, including the risk of foreign currency availability and convertibility of Ethiopian birr to expatriate profits. It proposes measures to overcome these obstacles and mitigate risks, to put Ethiopia on course to achieve universal access to electricity by 2030.

In June 2014, Hambrey Consulting successfully responded to a call for tenders for research to undertake a pilot assessment of the potential economic and associated benefits of establishing minimum market landing size (MMLS) in excess of minimum legal landing size (MLS) for shellfish; and to evaluate if such an intervention could be undertaken at a regional level. The project was originally conceived as including 3 case studies, but the scope of the research led us to focus mainly on the trawl and creel fishery for Nephrops prosecuted by the fleet based in Skye and SW Ross. The basic framework for the assessment approach was to: Develop an economic profile of the case study area and its fishing fleet; Review and synthesise existing data on size profile of the catch, the factors that affect size, including costs associated with individual (vessel) actions or strategies to increase the size profile of the catch; Analyse market and market trends, and the prices for different sizes of product; Develop economic models of representative fishing enterprises, taking account of the relationships between costs and returns and the size profile of the catch; Use plausible scenarios to explore likely short term economic consequences of any changes in MMLS; Use yield and utility per recruit analysis to explore possible yield benefits associated with increased MMLS.
