Full textIn 1995, the WTO2 elaborated the Trade related intellectual property agreement (TRIPS). The latter grants the broadcastors a right to authorize or to prevent the communication of their waves to the public.
Is the existence of the compulsory licence compromised by this agreement? We believe not. Indeed, justifications to the compulsory licence are found in the TRIPS: the general derogation of section 13 and the insertion of the Berne Convention through section 9 allow such licence. We also establish that the national treatment and the most-favoured nation clauses do not apply to the compulsory licence.

Resumo: Esta pesquisa tem como objetivo traçar o perfil de um grupo de TVs universitárias do Brasil e da TV Unaerp de Ribeirão Preto e analisar os modelos de gestão adotados por elas, já que a maior parte veicula a programação por meio da TV por assinatura via cabo. As características que delineiam as TVs universitárias ainda estão sendo formadas no país, portanto, necessita-se identificar os modelos de negócio e as leis que regulamentaram o setor e, desta maneira, verificar de que forma afetam o desenvolvimento e a manutenção dessas emissoras. Para alimentar as argumentações o estudo se apoia nas políticas públicas de comunicação e na legislação em vigor que dão suporte ao entendimento sobre a evolução da televisão universitária no país. A partir de levantamento bibliográfico e pesquisa de campo composta por aplicação de questionário e entrevistas, buscamos abranger o maior número de informações para a realização de um trabalho de pesquisa capaz de produzir conteúdo de referência e reflexão. A TV universitária tem pela frente grandes desafios como o ser reconhecida pela comunidade acadêmica e pela sociedade, promover a sustentabilidade e garantir sua manutenção, consolidar-se no campo público a ter acesso ao Sistema Brasileiro de Televisão Digital Terrestre

Full textENGLISH ABSTRACT: The controversy around the broadcasting of court proceedings has reigned in the United States since the 1950s, reaching a peak with the trial of O.J. Simpson, widely interpreted as an example of the destructive effect of a "media circus" on the administration of justice. In many other U.S. courtrooms, however, television and radio journalists do their work unobtrusively, professionally and to the benefit of their viewers and listeners. The King Commission of Inquiry into allegations of match-fixing in cricket gave South Africa its first experience of television and radio coverage of judicial proceedings, and lay the basis for a more liberal approach to electronic coverage of courts. The Constitution protects freedom of expression, including the freedom to receive and impart information. This has been interpreted by the High Court as conferring on radio journalists the freedom to record and broadcast the King Commission's proceedings. It is argued in this study that the High Court's reasoning could be applied with equal force to television, and to coverage of the courts. It is suggested a trial period of electronic coverage of courts, under clear guidelines for journalists and legal practitioners, may provide greater clarity on the desirability of allowing electronic coverage of courts on a permanent basis.

Simpson was 'n hoogtepunt in die debat. Dié saak word gereeld voorgehou as 'n voorbeeld van die nadelige effek wat 'n "mediasirkus" op die regsproses kan uitoefen. Maar in baie ander Amerikaanse howe doen radio- en televisiejoernaliste hulle werk sonder steurnis, professioneel, en ten voordeel van hul luisteraars and kykers. The Kingkommissie van Ondersoek na beweringe van oneerlikheid in krieket was Suid-Afrika se eerste ervaring van elektroniese dekking van 'n regterlike proses, and kan moontlik die basis vorm vir 'n meer liberale benadering tot elektroniese dekking van howe. Die Grondwet waarborg vryheid van uitdrukking, insluitende die vryheid om inligting uit te stuur en te ontvang. Die Hooggeregshof het onlangs beslis hierdie vryheid beteken radiojoernaliste mag die verrigtinge van die Kingkommissie opneem en uitsaai. In hierdie studie word geargumenteer dat die Hooggeregshof se beslissing ook van toepassing kan wees op televisie, en op hofverrigtinge. Daar word voor die hand gedoen dat Suid- Afrikaanse howe vir 'n proeftydperk elekroniese dekking van hofverrigtinge toelaat, met streng reëls vir joernaliste en regspraktisyns. So 'n proefneming kan dalk groter duidelikheid verskaf oor die voor- en nadele van televisie- en radiodekking van howe op 'n permanente basis.

Full textEn ce qui concerne l’accès des émissions aux réseaux câblés, la thèse met en avant le besoin de sauvegarder un service public de l’audiovisuel. Celui-ci est défini comme un ensemble des règles qui visent à la fois le paysage audiovisuel propre à chaque Etat membre (par exemple pluralisme) et le contenu des émissions proprement dit (émissions informatives, éducatives, épanouissement culturel etc.). Le droit communautaire primaire et dérivé, tel qu’interprété par la Cour de justice, fournit les moyens de conciliation entre, d’une part les intérêts généraux et, d’autre part, les exigences découlant de la libre prestation de services et de la libre concurrence.
En ce qui concerne l’application des droits intellectuels, la thèse aborde la problématique liée à l’épuisement ou la subsistance de ceux-ci. Dans le cas de la câblodistribution, la Cour a affirmé la subsistance du droit. Cette position est corroboré par la nouvelle directive européenne sur le droit d’auteur et les droits voisins dans la société de l’information. La thèse appuie la position de subsistance en considérant qu’elle constitue une condition essentielle pour la juste récompense des auteurs.
Enfin, la thèse aborde les questions plus spécifiques qui naissent à propos de la convergence technologique et juridique. Tout d’abord, il est avancé que le service public de l’audiovisuel n’est pas uniquement lié à des contraintes techniques, mais essentiellement à des objectifs qualitatifs (contenu des émissions). Ainsi, la thèse plaide en faveur de la pérpetuité du service public de l’audiovisuel dans l’ère du numérique. Par ailleurs, des questions plus spécifiques (comme l’accès à la boucle locale, l’interconnexion des réseaux et la numérisation des infrastructures) ont été examinées.

Technological convergence' is an expression depicting the blurring of boundaries between television and telecommunications. As a consequence of this process, the economic assumptions underlying legacy regulatory regimes no longer reflect market realities. Thus, technological convergence pushes for regulatory change, and this, in three directions: (i) deregulation, i.e. the removal of tools providing for exclusive and special rights; (ii) regulatory convergence, i.e. the creation of a level-playing-field between incumbents and new entrants and (iii) re-regulation, i.e. the introduction of new tools, either to replace legacy ones or to respond to emerging concerns. The first part of the dissertation examines the reaction to technological convergence in television and telecommunications regulation. While deregulation was unavoidable in both sectors, so pressing were technological developments, there are marked differences in other respects between them. Television regulation is an example of a 'defensive' reaction, in the sense that steps towards regulatory convergence and re-regulation have been slow and incremental. As a result, legislation is remarkably unstable and distortions, unavoidable. In addition, competition law has emerged as a source of regulation to deal with some concerns neglected in explicit regulatory regimes. In the telecommunications sector, by contrast, the Regulatory Framework for electronic communications constitutes an attempt to lay down, ex novo, a flexible and lasting regime. The second part examines choices around 'conflict points' between regimes, i.e. those areas of substantive overlap between the three sources of regulation identified above. Two conclusions follow from the analysis. First, it appears that one must differentiate, for normative purposes, between regulatory objectives (pluralism, effective competition, harmonisation...) and the specific tools through which these are implemented. In this sense, it seems feasible and justified to reconcile conflicting objectives across the value chain along the lines of tools that are more suited to apply in a changing environment. Secondly, it is noted that television and telecommunications activities are so inextricably linked that any attempt to regulate one of the two sectors in isolation from the other, as is currently the case, is artificial and unsustainable.

Cette introduction est organisée en trois parties. La première est consacrée à la formulation de l’objet de ce travail, la seconde a trait à la méthode qui a été employée pour le réaliser et la troisième présente la forme dans laquelle il a été réalisé, c’est-à-dire le plan. En France et en Italie, du point de vue des droits positifs, la souveraineté appartient à la nation ou peuple. Parler de la souveraineté de l’Etat n’est possible qu’en tant que "raccourci", dès lors que, dans ces deux pays, l’Etat est l’organe qui agit au nom de peuple ou de la nation. La notion de souveraineté de l’Etat au sens qu’on vient de préciser a fait l’objet d’un grand nombre de définitions et de distinctions. Mais ce qui nous intéresse ici n’est qu’un aspect de cette souveraineté. Cet aspect est la capacité à dire le droit, à savoir la juris dictio. Comme l'a rappelé G. de Vergottini, « un des aspects essentiels de la souveraineté consiste dans la capacité à produire des normes juridiques ». A la suite d’un phénomène lent mais continu de centralisation du droit, cette capacité est devenue une capacité totale dans le sens où la souveraineté juridique d’Etats tels que l’Etat français et l’Etat italien signifie que ces Etats disposent du monopole du droit, du monopole de la juris dictio. Cette situation a d’ailleurs été qualifiée d’étatisme juridique ou d’absolutisme juridique.

The past two decades has seen a growing interest, from both policy makers and scholars, in the legal regulation of work performed by self-employed workers. Increases in non-agricultural selfemployment in industrialised countries, together with political and ideological shifts, have fuelled interest in self-employment as a means of increasing employment. The attractions of selfemployment are manifold. To firms, self-employment is part of a two-fold change in the way firms operate: the move towards more flexibility as to the size and composition of the workforce, marked by an increased use of atypical workers and the disintegration of firms by arranging production through outsourcing, subcontracting and franchising. To workers, self-employment offers the greater autonomy connected with being their own boss, a chance of higher returns, or, at least, opportunities of gainful employment in times of high unemployment. To governments, self-employment has been seen as a means of increasing the number of small businesses, supposedly beneficial to the creation of new employment. Encouraging and removing barriers to self-employment is, therefore, a priority for many governments.

Depuis quelques années, l'organisation des services publics locaux connaît dans la plupart des Etats membres de l'Union européenne d'importantes transformations. D’une part, l'organisation administrative des Etats change et les fonctions des collectivités territoriales sont redéfinies. D’autre part, les formes de la gestion des activités d’intérêt général font l'objet de réformes du fait de l'évolution du contexte normatif. Si des dynamiques internes expliquent en partie ces phénomènes, la part que la réception du droit communautaire joue dans ces développements, est significative. De fait, la libéralisation des services publics nationaux étant largement avancée, les institutions communautaires poursuivent désormais l'ouverture des marchés locaux. Les collectivités territoriales ne peuvent donc plus ignorer les règles de la concurrence et de la libre prestation des services. Or l'organisation traditionnelle des services publics locaux n'est pas toujours conforme à ces principes et nécessite des ajustements, voire des réformes drastiques. Il paraît donc utile d'étudier dans quelle mesure le droit communautaire affecte les services publics locaux, dans une perspective matérielle, c'est-à-dire sur le fond des activités, et d'un point de vue institutionnel, c'est-à-dire sur le rôle des collectivités territoriales. Les normes communautaires imposent-elles un modèle unique de gestion des services? La diversité des formes d'organisation locale est-elle prise en compte et respectée comme l'implique le principe de neutralité? L'encadrement réglementaire communautaire n'est-il pas finalement attentatoire à l'autonomie locale? A travers les exemples français et italien et une étude de secteur sur les transports publics de voyageurs, il appert que l'impact du droit communautaire sur les services publics locaux est tout-à-fait considérable. Cependant il ne faut pas négliger l’effet inverse qui s'illustre par la prise en compte par la Cour de justice et la Commission européenne, des pratiques locales et par la promotion en parallèle, dans le droit primaire de l'Union européenne, des services d'intérêt général et des autorités locales.

The phenomenon of people crossing regional and national borders to seek assisted reproduction occurs in many countries across the world and involves different actors, including patients, doctors, fertility clinic practitioners, law-makers, donors, surrogates, children, brokers, and others who take part in the globalised industry of assisted reproductive technologies. This dissertation focuses on the experience of Italian reproductive travellers who seek donor conception treatments outside national borders, as a reaction to Italian regulations on assisted reproduction banning gamete donation in Italy. Through the qualitative analysis of the narrations and practices of heterosexual couples, same-sex couples and single women, this work explores the ways in which people face different reproductive itineraries with the aim of achieving reproduction through donor conception in a context of law evasion. In particular, it takes into account the process that leads people to choose donor conception abroad and investigates the ways in which people make sense of this choice in relation to their understanding of kinship formation. The feelings that accompany this process, the concepts that people mobilise to make both law evasion and donor conception practice coherent with their reproductive goals, and the strategies that they employ to "kin" their donor-conceived children are presented and analysed. This study highlights the fact that Italian CBRC travellers who seek donation treatments abroad mainly consider their reproductive experience as a transgressive act, because by doing so they circumvent laws that forbid those treatments locally. They tend to support the moral validity of their choices by arguing that it aims to accomplish what they perceive as a "normal" goal (having a child). Nonetheless, the recourse to such a reproductive experience challenges existing cultural understandings and the social organisation of kinship.
