Abstract:
Animal welfare (AW) is a growing concern worldwide and veterinary students are expected to demonstrate a high degree of professional interest in the welfare of animals. However, previous studies have highlighted gaps in the teaching of AW teaching in different countries, possibly impairing veterinary competency in the area. This survey aimed to assess the opinions of Italian veterinary students towards AW, as well as their knowledge on the issue. Questions were divided into different sections, investigating the definition of, and information on, AW, knowledge about AW legislation, and the level of tolerance towards AW in regard to the use of animals for different purposes. Results showed that behaviour was the most frequently used word to define AW. Italian students considered their own level of knowledge on AW as good, relying on their university training, websites and television. They requested more AW legislation, but when questioned on specifics of the current legislation, there was a general lack of knowledge. Although poultry, pigs and rabbits were considered the species experiencing the worst management conditions, the species that raised the most AW concerns were companion animals and cattle. Results from this investigation may allow the development of tailored actions aimed at appropriately implementing educational strategies, at national and international levels, to improve the role of future veterinarians as leaders in AW.

Abstract:
In 1988, The Canada and the United States of America signed the Free-trade Agreement of North America. They wrote in a compulsory licence of cablodistribution: cablodistributors could, without consent, intercept the broadcasting waves but would also have to give them a financial compensation.
In 1995, the WTO2 elaborated the Trade related intellectual property agreement (TRIPS). The latter grants the broadcastors a right to authorize or to prevent the communication of their waves to the public.
Is the existence of the compulsory licence compromised by this agreement? We believe not. Indeed, justifications to the compulsory licence are found in the TRIPS: the general derogation of section 13 and the insertion of the Berne Convention through section 9 allow such licence. We also establish that the national treatment and the most-favoured nation clauses do not apply to the compulsory licence.

Abstract:
The movement to protect wilderness resources can conflict with local intentions for land use and development, particularly in economically marginal areas. In rural Italy, on the island of Sardinia, the plan to create a Gennargentu National Park has incited active opposition on the part of the communities affected. In the town of Baunei, responses to environmental legislation are motivated by the desire to maintain communal control over common lands. Political action, both formal and informal, is organised by local understandings about the impact of certain laws and institutions on the town economy, principally by the restriction of residents' usi civici (traditional rights of usufruct). This thesis considers the role and meaning of the usi civici in Baunei, and the implications of this for environmental politics in Sardinia.

Khumalo, Senziwani. "An investigation into how Zimbabwe's Bulawayo viewers negotiate the gay storyline in Generations." Thesis, Rhodes University, 2015. http://hdl.handle.net/10962/d1017784.

Full text
Abstract:
This study seeks to evaluate how aspects of religion, culture, political context, education and class, amongst others, impact on the manner with which Zimbabwe’s Bulawayo residents make sense of media messages which explore issues of homosexuality, as encountered in the soap opera Generations. This is against the backdrop of Zimbabwean legislation, such as the Sexual Deviancy Act, which criminalises homosexuality and the state victimisation of gays and lesbians in this country. The inclusion of homosexual liberties was rejected by all political parties and both public and private media in the recent drafting of a new rule of law. The legislation, including gay rights exclusion in the new constitution, and state action has perpetuated an impression that Zimbabwe is a deeply homophobic society. As a starting point the study examines the claims of the media imperialism thesis which supposes an all-consuming power of western media and next examines Straubhaar’s thesis of ‘cultural proximity’ which argues that there is often a preference for regional media, which is proximate to viewers’ local culture, language and identity. The study explores the prominence of South Africa as a regional media player and that proximate identities with some cultures in that country have played a role in drawing some Bulawayo viewers to South African television, as they feel slighted by Zimbabwean media. Utilising qualitative research methods, the study explores whether or not the representation of gay images on this South African soap opera provides viewers with opportunities for ‘symbolic distancing’. The concept highlights that when people have insight into lifestyles that are different from their own, they use that as a resource to critically analyse their own lives and cultural understandings. The study evaluates if Bulawayo viewers’ sentiments towards homosexuality has been challenged and changed through their interface with the soap opera, Generations.

ENGLISH ABSTRACT: The controversy around the broadcasting of court proceedings has reigned in the United States since the 1950s, reaching a peak with the trial of O.J. Simpson, widely interpreted as an example of the destructive effect of a "media circus" on the administration of justice. In many other U.S. courtrooms, however, television and radio journalists do their work unobtrusively, professionally and to the benefit of their viewers and listeners. The King Commission of Inquiry into allegations of match-fixing in cricket gave South Africa its first experience of television and radio coverage of judicial proceedings, and lay the basis for a more liberal approach to electronic coverage of courts. The Constitution protects freedom of expression, including the freedom to receive and impart information. This has been interpreted by the High Court as conferring on radio journalists the freedom to record and broadcast the King Commission's proceedings. It is argued in this study that the High Court's reasoning could be applied with equal force to television, and to coverage of the courts. It is suggested a trial period of electronic coverage of courts, under clear guidelines for journalists and legal practitioners, may provide greater clarity on the desirability of allowing electronic coverage of courts on a permanent basis.
AFRIKAANSE OPSOMMING: Die netelige vraagstuk rondom die uitsaai van hofverrigtinge het alreeds in the vyftigerjare van die vorige eeu in die Verenigde State ontstaan. Die vervolging van O.J. Simpson was 'n hoogtepunt in die debat.

Abstract:

Abstract:

Abstract:
AbstractItaly has been the first country in the world to adopt the US benefit corporation model (so-called società benefit (SB)), which it transplanted into its legal system at the end of 2015. The Italian società benefit statute is a mix between the US Model Benefit Corporation Legislation and the Delaware Public Benefit Corporation Act but is characterized by some peculiar features, such as the scope of the legislation, which is applicable to all for-profit and cooperative organizational forms provided by the law, and the existence of a public enforcement mechanism based on the attribution of supervisory powers to the Italian Competition Authority. A few years after its introduction, società benefit seems to have been widely accepted, and the movement continues to grow. Furthermore, the Italian legal system continues to support the spread of the SB model, e.g., through the 2019 amendment of the “Public Contract Code,” which introduced new reward criteria for tendering companies that publish the annual report required by the società benefit law to assess their social and environmental impacts. From a comparative law perspective, the Italian “for-benefit” model has been the first one adopted by a civil law system and seems to have influenced other civil law countries.

AbstractThe chapter outlines the undeniable importance of affects, friendships, collective and mutual care and support among LGBTQ people in Italy, reading them as forms of resistance to the general absence of a formal recognition of LGBTQ rights by the Italian state or to the limits of existing legislation. The author starts by introducing some relevant characteristics of the Italian socio-economic and political context and their consequences on the rights and the intimate lives of LGBTQ people. The text then explores the stories of participants, first describing the material and symbolic consequences of the lack of laws protecting LGBTQ rights and then identifying and unpacking some strategies through which participants cope in daily life, namely, working around the law and building networks of care.

Abstract:
AbstractThis chapter examines the argumentative and rhetorical structure of the regulatory techniques used to deal with the SARS-CoV-2 pandemic in Italy. The first part of the chapter aims to clarify the connection between law and rhetoric, in order to provide a framework in which the legislative activity has operated. After analyzing critical aspects of the chosen regulatory tools, we will focus on the three most innovative elements of the pandemic legislation: the frequent use of images, the sporadic presence of sanctions, and the relevant role of experts. In the second part, an analysis of the fundamental traits of visual argumentation will be presented to highlight the fact that the use of images, during the pandemic period, has become a political-normative technique, which is never a neutral tool, but is always subject to interpretation and endowed with a notable rhetorical value. Given the sporadic presence of sanctions, the second section will analyze the argumentative strengthening applied by the legislator in order to promote the obedience of the recipients of the measures. Finally, we will examine the involvement of experts in the justificatory activity of the legislator, and the need for them to acquire legislative legitimacy through a rhetorical-argumentative relationship with citizens.

Abstract:
AbstractItaly is a very complex case of migration management and of foreign workers’ integration in the labour market. Both have developed in the grip of structural national limits, due to the economic and social structure of the country, but also to its political culture and legal framework. Work is certainly among the most effective instruments for ensuring the effective integration of foreigners into the social fabric of the host country. However, the chapter discusses the many obstacles that hinder the full integration of foreigners into the Italian labour market, especially when they do not have a residence permit for work reasons but are beneficiaries of international and humanitarian protection. Since access to work for beneficiaries of international and humanitarian protection is still very complicated, there is a strong risk that the progressive reduction in the number of permits granted for work reasons and the simultaneous increase in the number of those granted for protection will slow down the process of integration through work. Furthermore, particularly long and complicated administrative recruitment procedures would require a comprehensive review of the legislation to become instruments of social and economic integration and not of marginalization. Against this backdrop, the chapter highlights how the law may abdicate from its empowering purpose to become a concrete barrier for the full enjoyment of newcomers fundamental rights.
