This dissertation is about the valuation of contaminated land and the problem of stigma. The value of contaminated land is to a large extent affected by statutory regulations. Stigma, if it exists, is another factor that has significant impact on contaminated land value. This thesis looks at the relevant laws governing contaminated land in Australia. It also introduces an alternative method to assess the stigma factor. -- Contaminated land is a major environmental problem. Apart from causing actual or potential threats to human health and the environment, contaminated land also leads to legal liabilities and financial losses to the landowner. Regarding financial losses, they may be costs to meet legal requirements in relation to clean up and long term monitoring expenses. In addition, they may be losses due to a drop in market value and/or rental of the property, longer vacancy periods, high remediation and monitoring costs. In the extreme case, the property may lose marketability completely. -- Regarding valuation methods, most valuers use traditional valuation methods with arbitrary adjustments. The most straightforward method is the impaired value (affected value) approach. It requires the valuer to assess the property on a clean land basis. From the unimpaired (clean) value, other financial losses due to contamination, remediation costs and stigma value loss are deducted to get the impaired value. The most difficult part is to quantify stigma impact. The existing stigma assessment methods are not satisfactory. Alternative and non-traditional methods are available. However they are academic and are not suitable for day-to-day operation of a valuer. This thesis suggests a multi-criteria decision-making model to assess stigma impact. The target stigma factor is obtained by processing the relevant criteria with the Analytic Hierarchy Process (AHP) method. The best alternative from the model is the reasonable stigma factor for the property.

Full textIn 1995, the WTO2 elaborated the Trade related intellectual property agreement (TRIPS). The latter grants the broadcastors a right to authorize or to prevent the communication of their waves to the public.
Is the existence of the compulsory licence compromised by this agreement? We believe not. Indeed, justifications to the compulsory licence are found in the TRIPS: the general derogation of section 13 and the insertion of the Berne Convention through section 9 allow such licence. We also establish that the national treatment and the most-favoured nation clauses do not apply to the compulsory licence.

Resumo: Esta pesquisa tem como objetivo traçar o perfil de um grupo de TVs universitárias do Brasil e da TV Unaerp de Ribeirão Preto e analisar os modelos de gestão adotados por elas, já que a maior parte veicula a programação por meio da TV por assinatura via cabo. As características que delineiam as TVs universitárias ainda estão sendo formadas no país, portanto, necessita-se identificar os modelos de negócio e as leis que regulamentaram o setor e, desta maneira, verificar de que forma afetam o desenvolvimento e a manutenção dessas emissoras. Para alimentar as argumentações o estudo se apoia nas políticas públicas de comunicação e na legislação em vigor que dão suporte ao entendimento sobre a evolução da televisão universitária no país. A partir de levantamento bibliográfico e pesquisa de campo composta por aplicação de questionário e entrevistas, buscamos abranger o maior número de informações para a realização de um trabalho de pesquisa capaz de produzir conteúdo de referência e reflexão. A TV universitária tem pela frente grandes desafios como o ser reconhecida pela comunidade acadêmica e pela sociedade, promover a sustentabilidade e garantir sua manutenção, consolidar-se no campo público a ter acesso ao Sistema Brasileiro de Televisão Digital Terrestre
Abstract: This research has as its aim make the profile and analyze the models managing of a University Television group in Brazil and from Unaerp TV in Ribeirão Preto, most of them being exhibited via cable TV. The outlining characteristics from University TVs are still being formed in the country, therefore, identifying the business and sectors rules is needed, this manner, verify in which way they affect the development and maintenance of these channels. To arise argumentation the study is based in communication public politics and in the running legislation, which support the understanding about the evolution of University television in the country. Whereof bibliographic studies and camp research made of questionnaire and interview, we tried to embody the highest number of information to promote a research work capable of producing reference and reflection context. The University TV has forward big challenges as to be recognized by the academic and society commuties, promoting its sustainability, maintenance and become stable in the public environment and have access in the Brazilian System of Terrestrial Digital Television

Full textThis thesis identifies and elaborates on the way in which notions of genetic inheritance connect with notions of ’proper’ families and hence shape policies concerning reproduction and family formation. Assumptions about the structure and shape of the ’proper’ or ’traditional’ family - as a heterosexual two-parent unit with biological children - and its claim to naturalness, are embedded in policies related to reproductive technologies and family formation. The thesis explores the discourses surrounding the following specific policies - surrogacy, IVF, adoption, abortion, child support and posthumous reproduction - to elucidate the frameworks of meaning within which we understand these issues.
