Abstract:
Income decreasing strategies conducted by management could be harmful for various stakeholders. One example is big bath accounting, which could be accomplished in numer- ous ways. This study focus on big baths achieved by recognising impairments of goodwill. Purpose - The purpose of this study is to examine patterns of association between big bath accounting and impairment of goodwill within the telecommunication service industry in Europe. Further, this study aim at contributing to the discussion regarding utilisation of big baths through impairments of goodwill, and takes the perspective of an external stakehold- er. Delimitations - The study is restricted to European telecommunication entities comprised in STOXX Europe 600 Index. Method - This study was conducted using a hybrid of qualitative and quantitative research strategy with a deductive approach. The five indicators used to identify various big bath behaviours were inspired and derived from theory and previous research. Data from 2009 to 2015 was collected from the companies’ annual reports and websites, and analysed by the help of codification of each fulfilled indicator where 2009 merely served as a compara- tive year for 2010. By the use of a scoreboard the collected data was summarised on an ag- gregated yearly basis as the industry, not the specific companies, were analysed. Empirical findings - The results of this study suggests that big baths are executed among tele- communication companies within Europe. These are conducted simultaneously as impair- ments of goodwill are present, facilitated by earning management. A possible explanation is considered to be the room for interpretation inherent in IAS 36, enabling goodwill impair- ments to be recognised on managers’ command. Thereby an impairment could be “saved” for better or worse circumstances, or recognised when there exist an opportunity to max- imise (the manager's) wealth in the future. This study reveal the co-occurrence of goodwill impairments and big bath-indications, however a review of causal relationships are not en- abled by the limitations of the chosen method.

Abstract:
Governments have funded the development and production of advanced technology in order to establish supply security and/or to achieve economic growth. The policy of government funding includes three alternatives: the two basic options of maintaining a national project or participating in international collaboration involving a number of sovereign states, and the third option of doing both in parallel. The study examines international collaboration in such a way as to assist in the selection of the appropriate policy option. Particular attention is paid to the perspective of small and large, advanced and less advanced European countries. The research problem is addressed by focusing exclusively on those results which distinguish international collaboration from a national project, summarised under the concepts of collaborative sharing and collaborative efficiency. The former identifies the sharing of funding and technology not to be found in a national project. The latter identifies the difference in efficiency between international collaboration and a national project. Efficiency, indicated by cost, quality and time, is examined under the headings of policy-making, executive management, industrial rationalisation and production volume. Furthermore, collaborative sharing and efficiency are examined in the context of parallel national projects. This focus on the differences between the policy options provides the basis for selecting the appropriate one. Previous studies fail to give convincing answers to the research problem: they concentrate on collaborative efficiency while neglecting collaborative sharing, and they disagree over whether international collaboration or a national project is more efficient. This study attempts to overcome these shortcomings by examining a major case study of international collaboration, namely the European Communication Satellite Programme. The following conclusions are established. To achieve supply security, the collaborative option is considered appropriate for the large, advanced European country, and the parallel option for the large, less advanced countries. To achieve economic growth, the national option is appropriate for the advanced European countries. The smaller, less advanced countries are seen to play only a limited role in government funding of advanced technology.

Neste trabalho, as mudanças estratégicas no setor de telecomunicações da Europa são estudados. Dez maiores empresas da Europa são selecionados para esta análise. Suas mudanças estratégicas sobre a década 2001 - 2011 são estudadas e analisadas. Essas mudanças estratégicas do mercado Telecom Europeia são posteriormente comparados com o seu homólogo indiano. Estes dois mercados são, então, analisada a partir dos pontos de vista de mudanças estratégicas. Finalmente, as semelhanças e diferenças entre os dois mercados são analisados e comparados.
In this work, the strategic changes in the telecom sector of Europe are studied. Ten largest companies of Europe are selected for this analysis. Their strategic changes over the 2001 – 2011 decade are studied and analyzed. These strategic changes of European Telecom market are subsequently compared with its Indian counterpart. These two markets are then analyzed from the view points of strategic changes. Finally, the similarities and differences between the two markets are analyzed and compared.

Abstract:
"The Role of Telecommunications Standards in European Integration" analyses the process of harmonisation for European telecommunications terminal equipment standards from 1958-1996. The M.A. Thesis focuses on Commission legislation dealing with telecommunications standards enacted in the Treaty of Rome up to the Maastricht Treaty with a special focus on the "New Approach to Technical Harmonisation and Standardisation". This thesis also looks at the application of the Low Voltage Directive 73/23/EEC and the Electromagnetic Compatibility Directive 89/336/EEC, and shows in practice, how European integration affected the national transposition of these directives into law and moreover, how the designated standards in these directives were harmonised. The final section assesses the implementation of European harmonised standards under the low voltage directive and electromagnetic compatibility directive into Member State legislation during 1996. And finally, in order to make a contribution to European Integration studies, the role of telecommunication standards is also placed within the framework of political European Integration Theory.

This dissertation examines the process through which distinct national market structures and competitive dynamics could endure in the telecom industry, even as telecom markets were liberalized throughout the Europe Union. The opening of national markets and the international expansion of the telecom operators led many industry observers to predict that a single global market characterized by fierce competition among a few giant firms would emerge beyond the reach of national governments. In the European Union, the initiatives to create a common market for telecommunications posed a further challenge to the national governments' ability to maintain barriers to competition and influence market outcomes in the telecom industry. Finally, the convergence of telecoms, computing and broadcasting stimulated the rapid growth of the internet and a myriad of new on-line services that crossed borders indiscriminately and were very difficult for governments to control. Calling into question the strong predictions of globalization in the telecom industry, this dissertation explores how differences in national regulation, industrial policy and market shape the development of competition in the national telecom markets of France, Germany and the United Kingdom. In each national context policy makers and firms responded differently to the challenges of market liberalization and technological change. First, within the broad European regulatory framework, the national governments adopted different regulatory regimes to oversee the development of competition and the provision of universal service in the liberalized markets. Second, the national governments introduced distinct industrial policy initiatives and regulations to promote investment and innovation in new internet technologies. Third, the new entrants in the liberalized markets were politically powerful national players with very different core businesses and entry strategies. When the European telecom markets were opened to competition, these diverse policy choices and strategic responses created very different frameworks within which competition would develop and new markets for the internet and on-line services would grow.

Abstract:
This thesis looks at two issues. Firstly, statistical work was undertaken examining profit margins, labour productivity and total factor productivity in telecommunications in ten member states of the EU over a 21-year period (not all member states of the EU could be included due to data inadequacy). Also, three non-members, namely Switzerland, Japan and US, were included for comparison. This research was to provide an understanding of how telecoms in the European Union (EU) have developed. There are two propositions in this part of the thesis: (i) privatisation and market liberalisation improve performance; (ii) countries that liberalised their telecoms sectors first show a better productivity growth than countries that liberalised later. In sum, a mixed picture is revealed. Some countries performed better than others over time, but there is no apparent relationship between productivity performance and the two propositions. Some of the results from this part of the thesis were published in Dabler et al. (2002). Secondly, the remainder of the tests the proposition that the telecoms directives of the European Commission created harmonised regulatory systems in the member states of the EU. By undertaking explanatory research, this thesis not only seeks to establish whether harmonisation has been achieved, but also tries to find an explanation as to why this is so. To accomplish this, as a first stage to questionnaire survey was administered to the fifteen telecoms regulators in the EU. The purpose of the survey was to provide knowledge of methods, rationales and approaches adopted by the regulatory offices across the EU. This allowed for the decision as to whether harmonisation in telecoms regulation has been achieved. Stemming from the results of the questionnaire analysis, follow-up case studies with four telecoms regulators were undertaken, in a second stage of this research. The objective of these case studies was to take into account the country-specific circumstances of telecoms regulation in the EU. To undertake the case studies, several sources of evidence were combined. More specifically, the annual Implementation Reports of the European Commission were reviewed, alongside the findings from the questionnaire. Then, interviews with senior members of staff in the four regulatory authorities were conducted. Finally, the evidence from the questionnaire survey and from the case studies was corroborated to provide an explanation as to why telecoms regulation in the EU has reached or has not reached a state of harmonisation. In addition to testing whether harmonisation has been achieved and why, this research has found evidence of different approaches to control over telecoms regulators and to market intervention administered by telecoms regulators within the EU. Regarding regulatory control, it was found that some member states have adopted mainly a proceduralist model, some have implemented more of a substantive model, and others have adopted a mix between both. Some findings from the second stage of the research were published in Dabler and Parker (2004). Similarly, regarding market intervention by regulatory authorities, different member states treat market intervention differently, namely according to market-driven or non-market-driven models, or a mix between both approaches.

La part macroeconòmica de la tesi analitza el procés de transició cap a l'economia del coneixement en els països de l'àrea CEE. La part microeconòmica de la tesi es presenta en tres publicacions. El primer estudi aporta les evidències de les relacions directes i indirectes entre la productivitat i les TIC i confirma la importància de les fonts de productivitat de la coinnovació (complementarietat amb la inversió TIC) de les empreses fabricants de l'Europa de l'Est. El segon estudi analitza les diferències entre els principals impulsors de la productivitat (innovació, internacionalització i capital humà) entre empreses alemanyes i poloneses. La tercera publicació analitza la importància de les fonts de productivitat de la coinnovació utilitzant les dades recents de les empreses poloneses.

El segundo estudio analiza las diferencias entre los principales impulsores de la productividad (innovación, internacionalización y capital humano) entre empresas alemanas y polacas. La tercera publicación analiza la importancia de las fuentes de productividad de la coinnovación utilizando los datos recientes de las empresas polacas.
This thesis is written in the form of a manuscript of five scientific journal papers and presents one of the first pieces of evidence of the relation between information and communication technologies (ICT) and productivity in the countries of Central and Eastern Europe (hereinafter CEE). The macroeconomic part of the thesis analyses the process of transition towards the knowledge economy in CEE countries and reveals a considerable gap between CEE and Western European countries, especially in terms of human capital, infrastructure, innovation capacity and quality of institutions. The microeconomic part of the thesis is presented in three papers. The first paper presents the evidence of the direct and indirect relationships between productivity and ICT, and confirms the importance of the co-innovation productivity sources (complementarities with ICT investment) from Eastern European manufacturing companies. The second paper analyses the differences in main productivity drivers (innovation, internationalization and human capital) between German and Polish companies. The third paper analyses the importance of the co-innovation productivity sources using recent data from Polish companies.

Abstract:
This thesis analyses how the internal divisions occurring on the administrative level of the European Commission affect its capacity to prepare and propose legislation. It examines the consequences of the functional specialisation of different Directorates General (DCs) and the principles of mutual consultation on the ways in which the Commission sets policy agendas and formulates policies. Using the insights of the literature on policy coordination that perceives of decision-making processes in fragmented institutions as a process of coordination among semi-autonomous, but interdependent actors, the thesis analyses the interactions between different Commission DCs and the ways in which they seek to cope with conflict and competition. The research design is qualitative and uses process-tracing of major legislative initiatives taken by the European Commission in the telecommunications and the audiovisual sectors between the mid-1980s and the year 2000. The findings of the empirical analysis suggest that while conflict and debate are ever-present features of how the Commission operates, the extent to which Commission actors manage to settle or to overcome such conflict varies across policy sectors. Low fragmentation results in an 'informal' coordination scenario in which actors settle their disputes. Legislative policy-making is rapid and consistent and usually results in the proposition of legislation, In contrast, high fragmentation bears a tendency towards policy-making taking place in formal and more 'politicised' arenas in which actors multiply and find it more difficult to accommodate their differences. Hence, policy-making is slower, more prone to inconsistencies and less likely to result in the proposition of legislation. The insights gained on fragmentation and coordination in the European Commission alter our existing views of the Commission. Challenging the notion that the Commission fulfils a pre-defined function or agenda, I argue that the Commission is capable of playing different roles, depending on the extent to which it is internally divided.

A privatização de uma empresa é uma mudança empresarial disruptiva que geralmente coincide com o fim de uma posição de monopólio e da subsequente entrada num ambiente competitivo. Os desafios que a privatização coloca são tão árduos que eles levam muitas vezes a liderança (leadership) para executar planos ambiciosos de mudança empresarial. No entanto, a literatura mostra que muitos deles falharam. Na verdade, esses planos preveem mudanças bruscas e importantes que tendem a empurrar a empresa privatizada na armadilha de aceleração (acceleration trap). Um tipo de 'burnout organizacional' (organizational burnout) onde a exaustão e a resignação da força de trabalho afetam drasticamente o desempenho da empresa. A tese, portanto, focalizou em estudar a ligação entre um processo de privatização e o risco de cair na armadilha de aceleração. Uma investigação preliminar sobre a literatura das mudanças empresariais permitiu a concepção de um quadro preliminar teórico que sugere a existência de dois moderadores (moderators) deste relacionamento entre um processo de privatização e a armadilha de aceleração: um 'choque cultural' (cultural clash) e um 'fraco clima de liderança transformacional' (weak transformational leadership). Em seguida, um estudo de caso - baseado numa empresa de telecomunicações europeia e conduzido através de uma abordagem metodológico não puramente indutivo (non-purely inductive approach) - confirma, mas também aprofunda a compreensão da ação desses dois moderadores. A respeito do moderador 'choque cultural' (cultural clash moderator), a análise de dados do estudo de caso da empresa de telecomunicações europeia mostra a importância exercitado tanto por um 'choque de identidade corporativa' (corporate identity conflict) como por um 'conflito de identidade gerencial' (management identity conflict). Quanto ao moderador 'fraco liderança transformacional', a análise dos dados destaca o papel da 'falta de confiança na nova gerência' (lack of trust in the new management), mas também de 'sentido do trabalho' (lack of job sense), principalmente através da perda de 'orgulho no trabalho' (loss of proudness). Finalmente, a análise dos dados salienta que a 'não aceitação do novo sistema de incentivos' (non-acceptance of the new incentive system) afeta significativamente a relação entre a privatização e a armadilha de aceleração, contribuindo tanto para um 'choque cultural' como para um 'fraco clima de liderança transformacional'.
The privatization of a company is a disruptive shift that generally coincides with the end of a monopoly position and the subsequent entry into the competitive game. The challenges that it raises are so arduous that they tend to lead the leadership to execute massive corporate changes. Yet, the literature shows that many of them fail. In fact, those plans envisage abrupt and severe changes that tend to push the privatized company into the acceleration trap: a type of organizational burnout where the exhaustion and the resignation of the workforce affect dramatically the performance of the company. The thesis has therefore focused on studying the link between a privatization process and the risk of falling into the acceleration trap. An initial investigation into the corporate change literature has permitted to design a preliminary theoretical framework, which has suggested the existence of two moderators of the relationship between privatization and acceleration trap: a cultural clash and a weak transformational leadership climate. Then, a single case study - based on a European telecommunication company and driven through a non-purely inductive approach – has confirmed but also deepened the understanding of the action of those two moderators. Regarding the cultural clash moderator, the data analysis of the company’s case study shows the importance played by not only a corporate identity conflict but also by a management identity clash. With regard to the weak transformational leadership climate moderator, the data analysis highlights the role of lack of trust in the new management but also of job sense, particularly through a loss of proudness. Finally, it also derives from the data analysis that the non-acceptance of the new incentive system also significantly affects the relationship between privatization and acceleration trap by contributing to both a cultural clash and a weak transformational leadership climate.

This thesis analyses the current regulatory regimes in the European Union---in particular Germany---and the United States governing the authorization of global mobile personal communications by satellite (GMPCS).
Current satellite licensing regimes fail to take into account the international character of satellite telecommunications. The reliance on a national public interest standard does not properly address the interests of the community of states, industry and consumers and is not suitable to meet the aspirations of international space law. The international harmonization of frequencies and international standardization are indispensable for the introduction of these new services. The establishment of an international communications regulator with the power to adopt binding decisions if required is the most suitable way to address these problems. However, the development of an international public interest standard with clear policy objectives will be hard to achieve.
With regard to the different aspects of ground segment licensing, a gradual approach is the best way to balance the different interests and concerns in this field. The International Telecommunications Union GMPCS MoU and the development of European regulations show a feasible way to achieve a regulatory regime that facilitates the introduction of these new services. Lighter regulations, possibly the introduction of one stop shopping procedures, mutual recognition of licenses and the introduction of general authorizations are measures that can and should be taken at the international level. The interdependence of earth and space segment licensing may lead to the understanding that some aspects of earth segment licensing should also be regulated at international level.
The question will be whether States, industry and users are able to reconcile their interests and the sometimes opposing trends of international cooperation and international competition for the benefit of "all mankind".

This paper examines the contribution of telecommunication private investment to economic growth in Africa and CEE countries using graphical and regression analysis. Data for fourteen African countries and thirteen CEE countries were used for the empirical analysis. The time series data is from 1999-2005. The contribution of telecommunication private investment to economic growth was estimated to be positive but insignificant in the pooled regression analysis. After con-trolling for country specific effects and causality, the effect of telecommunication private investment on GDP was found to be positive and significant. However, the positive impact on GDP was not substantial. When a cross-sectional test was carried out, the contribution of telecommunication private investment to economic growth was discovered to be positive except in 2005, and was also seen to be statistically significant up to 2002. The contribution of the mobile subscribers to economic growth was revealed to be positive and significant both in the pooled and cross-sectional regression analysis.

It aims to analyse the design of the legal and institutional framework of these two sets of rules in the liberalized telecommunications sector in Turkey in the light of the EU law. To this purpose, the thesis initially compares and contrasts the main characteristics of and shared responsibilities between the sector-specific and economy-wide competition rules and institutions in the post-liberalization and post-privatization period. Then, the thesis explores the EU approach on the balance of influence between these two sets of rules and institutions. Against this background, the thesis examines role, design and interaction of the sector-specific and competition rules and institutions in the recently liberalized Turkish telecommunications markets. It, also, analyses some important competition law cases concluded by the Competition Authority. The thesis has two main arguments. Firstly, it argues that liberalization and privatization in the telecommunications sector does not automatically lead to the competitive environment in the sector. Competitiveness of the markets after the postliberalization and post-privatization period critically depends on the existence of a robust, coherent, and transparent regulatory framework ensuring a smooth balance between the sector-specific and the competition rules and institutions. Second argument is that sector-specific rules have a transitional character. As telecommunications markets move towards effective competition, sector-specific regulation will be reduced and the role of the competition rules in those markets will increase.

This research presents an analysis of the European Telecommunication strategic environment with particular focus on the three macro-changes which have been influencing the recent history of such industry. These are, first of all, the shift from a government-controlled market to a privatized market. Second, the introduction of price limitations - called Eurotariff - which are supposed to regulate the mobile traffic throughout Europe. Finally, the constant growth of data and internet traffic demand, compared to the voice traffic demand, mainly due to the success of OTTs (Over-the-Tops) and the introduction of NGN (Next-Generation Network) applications and software. Such changes have increased the competition in an industry which was organized in monopolies and are forcing the companies to change, following the different customers' needs. Throughout the essay, a case study about Telefónica has been developed: after a presentation of the company and of Telefónica's deregulation process, the consequences of the environment analysis will be defined and, finally, some strategic actions will be proposed in order to adapt to the new strategic environment. The methodology which has been followed consists in a research on the models existing in literature designed to analyze the strategic environment. The best ones have been used and applied to the real case, involving Telefónica: the findings obtained have then been considered the basis to define the strategic actions. The purpose of the paper is twofold: first of all to offer an understanding of the telecommunications business with a particular focus on the Eurotariff, OTTs and NGN phenomena; second to show how a strategic environment can be effectively studied, focusing on the changes that characterize the industry, and how the consequences can be deduced. The information coming from this type of studies is very important for a company to understand what to change in order to adapt to a new context and achieve better performances.

O trabalho é focado no setor de telecomunicações na União Europeia, sendo analisado como este vem sendo disciplinado no bloco e quais são as perspectivas para sua disciplina no futuro, inclusive considerando os objetivos específicos da União Europeia, dentre os quais se destaca a constituição de mercados internos do setor. O setor de telecomunicações possui relevante característica dúplice: além de uma atividade econômica específica, também é um meio indispensável ao desenvolvimento de inúmeras outras atividades. Desde a década de 1980, sua disciplina vem em constante transformação. A maioria dos países superou o entendimento de que o setor constitui um monopólio natural e introduziu, ou está introduzindo, a concorrência em seus mercados. O mesmo está ocorrendo na União Europeia, na qual este processo já está em avançado estágio. Assim, no trabalho é apresentado o modelo comunitário de introdução da concorrência nas telecomunicações, baseado na edição de diretivas, com sucessivas etapas de graduais reformas na disciplina do setor. A análise da aplicação do modelo revela uma aproximação do direito da concorrência e da regulação setorial específica, com diminuição e, inclusive, abolição desta, quando constatada concorrência efetiva. Sob o ponto de vista prático, os resultados da aplicação deste modelo são positivos, com melhoria das telecomunicações comunitárias em diferentes indicadores. Contudo, também são observadas imperfeições e aspectos a serem aprimorados. Neste trabalho é demonstrado que, mesmo nos atuais mercados de telecomunicações competitivos na União Europeia, há espaço para a aplicação concomitante do direito da concorrência e da regulação específica do setor. É exposto que a perspectiva para o futuro da disciplina das telecomunicações na União Europeia consiste no fortalecimento da aplicação do direito da concorrência em mercados com concorrência efetiva, mas com manutenção e, inclusive, fortalecimento da regulação específica, no que tange aos aspectos mais técnicos e peculiares do setor, com vistas ao funcionamento de uma verdadeira rede virtual europeia. Para tanto, aponta-se que deverão ser aprimorados aspectos relacionados à constituição de mercados transfronteiriços, especialmente com tecnologias sem fio, à constituição de infraestruturas alternativas, aos incentivos às redes de próxima geração, ao foco em mercados grossistas, à defesa dos consumidores e ao melhor funcionamento das autoridades setoriais.
This study is focused on the European Union telecommunications sector, with an analysis of how it has been governed in that region and the prospects for its treatment in the future, taking into account the specific objectives of the European Union, mainly in relation to the establishment of the internal market. The telecommunications sector has a double relevant characteristic: besides being a specific economic activity, it is also an indispensable means to the development of countless other activities. Since the 1980s, its regulation has come in constant transformation. Most countries have overcome the understanding that the sector constitutes one natural monopoly and have introduced, or are introducing, competition in their markets. The same is occurring in the European Union, where this process is already in an advanced stage. Therefore, this study presents the community model of introducing competition in telecommunications, based on the issuance of directives, with successive stages of gradual reforms in the sector. The analysis of its enforcement shows an approximation of competition law and sector specific regulation, with a reduction and even abolition of the latter, when effective competition is found. From the practical point of view, the results of enforcing this model are positive, with improvement of community telecommunications in different indicators. However, some flaws and improvement aspects are also observed. This study demonstrates that even in today's competitive telecommunications markets in the European Union, there is room for the enforcement of both competition law and sector specific regulation. It shows that the outlook for the future of the telecommunications in the European Union is to enforce the competition law in markets with effective competition, maintaining and even strengthening, however, specific regulation regarding the more technical and peculiar aspects of the sector, aiming at true European virtual networks. To this end, aspects such as the establishment of internal markets, especially with wireless technologies, the provision of alternative infrastructure, incentives for nextgeneration networks, wholesale markets, consumer protection and better functioning of authorities should be improved.

“The Protection of the European Strategic Sectors”. The kind of protection that is at the heart of this doctoral thesis is the defence of the strategic companies established in the European Union (EU) from takeovers by foreign investors, that is to say investors from countries which are not part of the European Economic Area. This work aims, on the one hand, at outlining the main features of a screening mechanism of foreign investments at the EU level and, on the other, at identifying the proper legal basis in the EU Treaties for its establishment. Chapter 1 contains a non-exhaustive list of the European strategic sectors which consist in all the economic sectors in which the EU or its Member States have adopted rules to limit foreign investors’ right to acquire participations in strategic companies for reasons of public security. Indeed, the Court of Justice of the EU (CJEU) used the expression “strategic sectors” in relation to undertakings whose activities are deeply linked to the protection of public security. The EU notion of public security contains both internal and external security, but also the production of goods and the supply of services which are essential for the very existence of a country. Chapter 2 provides a comparative study of the present situation of strategic enterprises’ protection in three EU Member States (Germany, Italy and France). It shows that a fragmented landscape of foreign investment control rules adopted by national authorities represents both a constraint to an efficient internal market of capital movements, and a limit to an effective protection of the European strategic sectors. By contrast, an EU foreign investment control mechanism could lead to a less fragmented system of strategic companies’ protection, which would be able to encourage foreign investments. At the same time, a single EU body of foreign investment control should be more efficient in order to protect EU public security. Moreover, unlike Member States measures such as “golden shares”, this mechanism could enjoy a greater degree of compatibility with the fundamental freedoms of the Treaties. In effect, the CJEU recognises a “presumption of conformity” with the freedoms of movement to the EU secondary legislation which pursues objectives of general interest like the protection of public security. Chapter 3 analyses the most significant experience of foreign investment control at the global level, the Committee on Foreign Investment in the United States, in order to understand if it could be a suitable model for the establishment of a similar body in the EU, the Committee on Foreign Investment in the EU (CFIEU). Once outlined the key aspects of the CFIEU, chapter 3 focuses on the search of the most proper legal basis in the EU Treaties for its establishment. The study tries to demonstrate that Article 207(2) TFEU on unilateral measures of Common Commercial Policy (CCP) could be the right legal basis for the creation of the CFIEU. Indeed, after the Lisbon Treaty, the CCP has become an exclusive competence of the EU which also encompasses the admission and the treatment of foreign direct investments. In conclusion, chapter 3 tries to figure out the implications of the establishment of the CFIEU both on Member States competences (especially their exclusive competence on national security by virtue of Article 4 TEU), and on the international obligations undertaken by the EU towards third countries, with particular reference to the World Trade Organisation rules and international investment law.

The European 3G mobile phone spectrum administrations, which took place between 1999 and 2002, used a variety of different methods for allocating licences. The total value of licence fees raised by auctions tended to be significantly higher than those achieved in countries which adopted a 'beauty contest' approach for assessing bidders. Post-administration, many of the licence-winning firms experienced financial distress. There were suggestions at the time that the firms that won licences through auction procedures had suffered a 'winner's curse'. There was a certain amount of support for this proposition; licence winners across Europe delayed the roll-out of 3G network infrastructure and, in a number of cases, handed back their licences or had them revoked. By pooling data across European spectrum administrations, this thesis presents an empirical analysis of how much was paid for licences and who won them. The analysis provides evidence for the proposition that administrators raised considerably higher revenues with auctions than was the case with beauty contests. In addition to this, the analysis also finds that a number of key revenue-raising factors were out of the control of the administering authorities. The second part of this thesis seeks to identify a winner's curse through a comparative event study of the German auction and the Swedish beauty contest. This analysis provides clear support to the proposition that some firms that won licences through auction procedures suffered a winner's curse. The final part of the thesis examines the role of regulation and regulatory bargaining in the mobile telecommunications industry. Through the application of real option theory, it can be shown that a high licence fee can cause delay in network infrastructure investment. A simple two stage Nash bargaining model can then be used to show how this may affect regulatory behaviour.

The practical part will include the real impacts of European Union's roaming regulation on company T-Mobile Czech Republic, a.s., such as usage of roaming services, new roaming tariffs or company's financial indicators. At the conclusion I will try to predicate possible future roaming development because lately talking about the abolition of roaming fees, which could mean the completion of the single European market in telecommunications.

The Internet Protocol Multimedia Subsystem (IMS) is a component of the 3G mobile network that has been specified by standards development organisations such as the 3GPP (3rd Generation Partnership Project) and ETSI (European Telecommunication Standards Institute). IMS seeks to guarantee that the telecommunication network of the future provides subscribers with seamless access to services across disparate networks. In order to achieve this, it defines a service architecture that hosts application servers that provide subscribers with value added services. Typically, an application server bundles all the functionality it needs to execute the services it delivers, however this view is currently being challenged. It is now thought that services should be synthesised from simple building blocks called service capabilities. This decomposition would facilitate the re-use of service capabilities across multiple services and would support the creation of new services that could not have originally been conceived. The shift from monolithic services to those built from service capabilities poses a challenge to the current service model in IMS. To accommodate this, the 3GPP has defined an entity known as a service capability interaction manager (SCIM) that would be responsible for managing the interactions between service capabilities in order to realise complex services. Some of these interactions could potentially lead to undesirable results, which the SCIM must work to avoid. As an added requirement, it is believed that the network should allow policies to be applied to network services which the SCIM should be responsible for enforcing. At the time of writing, the functional and structural architecture of the SCIM has not yet been standardised. This thesis explores the current serv ice architecture of the IMS in detail. Proposals that address the structure and functions of the SCIM are carefully compared and contrasted. This investigation leads to the presentation of key aspects of the SCIM, and provides solutions that explain how it should interact with service capabilities, manage undesirable interactions and factor user and network operator policies into its execution model. A modified design of the IMS service layer that embeds the SCIM is subsequently presented and described. The design uses existing IMS protocols and requires no change in the behaviour of the standard IMS entities. In order to develop a testbed for experimental verification of the design, the identification of suitable software platforms was required. This thesis presents some of the most popular platforms currently used by developers such as the Open IMS Core and OpenSER, as well as an open source, Java-based, multimedia communication platform called Mobicents. As a precursor to the development of the SCIM, a converged multimedia service is presented that describes how a video streaming application that is leveraged by a web portal was implemented for an IMS testbed using Mobicents components. The Mobicents SIP Servlets container was subsequently used to model an initial prototype of the SCIM, using a mUlti-component telephony service to illustrate the proposed service execution model. The design focuses on SIP-based services only, but should also work for other types of IMS application servers as well.

Fiber-deployment of telecommunications networks is currently a great challenge for sector-specific regulators, national governments, as well as for investing operators. One of the most controversial regulatory issues in Europe (and elsewhere) is whether the emerging next generation access (NGA) infrastructure should be subjected to cost-based access regulation or whether at least a temporary removal of ex ante obligations ("regulatory holidays") should be granted. In answering this question we examine the current and foreseeable EU regulatory framework and show that it does not provide positive incentives for NGA deployment and increasing penetration rates. On the basis of an international comparison with the most recent data on NGA deployment and penetration, it appears, in turn, that deregulatory and/or state aid driven approaches targeted at the demand (subscribers) and supply side (coverage) are more promising. Fiber-deployment of future telecommunications networks ("Next Generation Access" - NGA) is currently a major challenge for sector-specific regulators as well as for investing firms. Although the future socio-economic importance of new telecommunications networks is uncontroversial, the related investment activities vary substantially in international comparison. This work intends to identify the most important determinants of previous NGA deployment using data from the EU27 member states for the years 2005 to 2010. For our analysis, we employ latest data on NGA deployment, relevant competition and regulatory indicators as well as other supply and demand side controls. Our econometric model incorporates: i) aggregated country level data; ii) structurally modeled dynamics of the deployment process which allows us to disentangle long-term and short-term effects; finally, iii) we argue that there is no endogeneity problem with respect to investment activities and regulation since we refer to regulation in preceding broadband markets. For our econometric analysis, we employ several dynamic panel data methods, such as GMM and LSDVC. Our results indicate that stricter previous broadband access regulation has a negative impact on NGA deployment. As regards the dynamics of the adjustment process, we find that there are severe adjustment costs and stickiness towards the desired long-term level of NGA infrastructure. (author's abstract)

s data and document were reviewed. An online survey was sent to the academicians who have Seventh Framework Projects (FP7) projects in these themes in Turkey. Data that were gathered by survey were analyzed by using Mann-Whitney U Test Method. We concluded that the impacts of these four categories of FP7 projects were high on the universities. Value additions of scientific and technological impacts are relatively high compared to other impacts. Universities whose roles were coordinator or WP leader have higher impacts in all factors. s participation and success in the FP7 are growing thanks to TÜ
BITAK&rsquo
s effort, but further efforts are needed for meeting competitive participation within a defined strategy. Bearing in mind the results of the impact analyses, the study supports Turkey&rsquo

This is a study of standardization in complexity. The context is innovation policy. Why do standardization and innovation go hand in hand and what does the interaction of interests between public and private actors look like in the “profile” of the standardization process? The nature of technical specifications, Lead Market Initiatives in Europe, social innovations, eco-innovations and psychological services for recruitment are the target areas of this study done in the style of Science, Technology and Society. We decrypt the codes of the expected behavior veiled in standards, the strategically selective sectoral integration of the European Internal Market, the emergence of innovation in standardized areas, the nature of the European innovation policy and the mission of each particular innovative sector. This research contains answers on how the European Union will move toward a more state-like organization bypassing the sovereignty of its member states. Standardization is a bouquet of strategic activities where each has its purpose, destination and time-framework. By studying standardization, we are able to look into the European future.

Brand loyalty is seen as a repeat purchase and also the ability to recommend services or products. Telecommunication service providers require loyal customers to stay in business. The current thesis examines the impact of how brand function and corporate image create loyalty in North America, Europe, and Africa's telecom service providers. The researcher employed an anonymous online survey in Africa, Europe, and North America. A total of 971 responses were received. Using Partial Least Square regression analysis, the research examined the relationship between the variables: Brand Function, Corporate Image and Loyalty. The study found that brand function and corporate image has a significant positive effect on customer satisfaction. In addition, the research used machine learning algorithm to model the best prediction for consumer recommendation of products and services through their telecommunication service provider to friends and family.
