Full textCivil justice is criticized for its slowness and the procedure for its complexity. Many challenges must be met to enable, while respecting the guarantees of a fair trial, civil cases to be processed within a reasonable time. The emergence of new communication technologies in the field of justice has already offered new solutions to simplify and accelerate procedures. Innovative perspectives are now being studied. But is the deployment of the use of new technologies in civil procedures necessarily a good way of handling disputes? Many emphasize the resulting gain in efficiency when others warn against abuses and excesses which can threaten the balance of procedures and the way in which justice is delivered. Access to the judge for all litigants is at the heart of the discussions. Furthermore, the fear of a robotization of justice linked to the emergence of start-ups and the insertion of programs using artificial intelligence in the field of Justice, threatens the nature of the legal professions. New technologies then appear to be “a double-edged sword”. The resulting benefits are tempered by the risks they generate. Relying on new technologies can be beneficial but only if their use remains in the service of justice and civil procedure, without prejudice to the essence of the action of the legal professions, without widening inequalities. regarding access to justice or opening a loophole regarding the protection of personal data. This topical study must be carried out in a comparative dimension in order to see if the measures applied and envisaged in France could be transposed into the Kuwaiti procedure which is lagging behind on this point. The objective of this thesis is therefore to analyze the scope of application and the challenges of new technologies in civil trials from a comparative law perspective

(integration, diversification). The transaction costs analysis of the new information technologies-strategy relationship raises two contradictory results: the integrating capacities of electronic hierarchies diminish internal organizational costs thus enabling further growth through internalization. But the advantages of growing through internalization are also decreasing since interorganizational information systems and electronic markets reduce transaction costs. This allows externalization for more flexibility in an ever changing competitive environment. Full textThe purpose of this thesis is to study the impact of !CT (Information Technologies and communication) on the profession of estate agent and on the changes in customer behavior. We conducted a qualitative survey among real estate agencies members of service interagency, two surveys quantitative of clients were as well conducted (100 buyers and 100 sellers) and a national quantitative are of real estate professionals.Our research was guided by several principles: t.lle field of theory and the one of research concemed with the various actors. Driven by a strong will of change and evolution of the real estate brokers' practice we chose to focus on the use of the ICT by professionals and clients.In an attempt to understand the importance of the use of technology and communication, we showed that the use of the digital tool as a strategie one enables to modify both the organization of real estate agencies and the way they work, at a time marked by the emergence of new competitors such as real estate agents or low cost agencies ...Being at the same time an actor of the real estate sector and a researcher in information science and communication, our work finds itself in the paradigms of complexity and Constructivism.We had to go back and forth between theory and field research which enabled us to advance, develop, widen, analyze and adapt our work methods depending on observations and our transitory results us to gradually progress

Full textThis dissertation brings to the forefront the informational and communicational aspects of strategic alliances. It examines how different stages of the lifecycle of an alliance are influenced by the communication capabilities of the partners and the interface through which the partners interact. More specifically, the dissertation investigates (i) the impact of firms’ ability to exchange a large information amount (IT capability) on the alliance design, and in particular on the governance structure and the alliance scope, (ii) the choice between information amount and information richness in alliances, (iii) how this choice influences changes in the levels of trust between the partners, and (iv) implications of the above for alliance performance. These issues are examined by extending existing communication media theories to the domain of interorganizational communication and by combining them with contractual and competence perspectives. Evidence for the arguments is provided from a mix of survey and qualitative data. The survey data were collected from two groups of people: Full members of the Association of Strategic Alliance Professionals and alumni participants of the INSEAD executive program on strategic alliances. Full textThe business environment at the end of the 20th century requires that corporations should efficiently manage their information ressources, to wich purpose new information technologies (nit : informatics and telecommunications) can be a great help. However, it is not the present business environment justifies the importance of information ressources, we may add further reason, of genial and technological character. From a general point of view, it may be said that the importance of information within the firms is but me reflection on such social organizations of something that is changing at a global level, wich is said to be entering a new order that has been termed as postindustrial society, or information society amongst other definitions. Nevertheless, in the information society, changes in organizations caused by the introduction of new information technologies are inevitable as organizations are compelled by external environment to be efficient and competitive in order to survive. On a technological level, the progress and generalization of the so-called new information technologies have also played a major role in conferring information ressources me strategic character they possess within organizations. Full textThe fast progress of the technology of the communications and transport, which cause a drop in the costs of the goods, the capital, the people and the information, supported the emergence of the information society, thanks to the speed to which information is gathered and transmitted. The reality of this society in many countries all over the world allowed UNESCO and the UNCSTD (United Nations Center for Science and Technology for Development) to establish criteria making it possible to measure its state and its evolution. French-speaking Africa, territory of our study, appears there late because of many obstacles: technological, political and institutional, legal and ethical, sociocultural and financial. This has as a consequence an insufficient integration of the ICT in socio-economic, educational, and public administration’s contexts. But, the role of the ICT like factor of development, which should result in the installation of new competences into French-speaking Africa, appears still limited by the lack of qualified human resources. If the reasons of this explanation are sought, one can find them in the deficit of the public investments and deprived, which raises the question of the public policies

Full textDue to the digital massive development, more and more organizations (museums, trading companies, public organizations…) have been developing systems of mediation with their public using technologies of interactive communication. That thesis realized in the context of a CIFRE, first aims at better understanding processes of use and processes of interaction when using different types of interactive facilities (touch screens and/or broadcast media). It is also a means to study the process of change of social cognitions, of users’ attitudes and behaviours in real-life context within various stores. According to our assumptions, the results have shown significant modifications of social cognitions, judgments regarding the brand and purchases, particularly after the interaction with the communication device (display) with touch screen (+85% purchases with touch screen display versus +7,5% control condition without display).Purchases are nearly three times more numerous when an audiovisual device (non-touch video screen) is present (vs missing) on the display. Unlike a non-touch audiovisual device, the touch screen increases sales by about 50%.Moreover, in accordance with the theory of engaging communication, the number of purchases is boosted by 39% thanks to the simple fact of touching the product

Full textThe introduction of information and communication technologies (ICT) in the caring relationship is part of a wider movement, aiming at building a real society of information. Although public health is not spared from those new customs, it nevertheless deserves its own specific study, given the singularity imprinted by patient-doctor relationships. Telemedicine, as a distant medical practice, is characterized by its seniority and the novelty of its normative frame. First of all, offering a spatio-temporal mutation of the medical practice, TIC shift traditional boundaries, including those recognized to the author and finality of the medical act. The doctor-patient bond becomes plural and dematerialized. Then, challenges implied by the resort to TIC, this new technical screen, made very imperious the intervention of the law to supervise and control its use. Caring relationship law resorting to TIC is protean. Doctors and patients' rights and duties invariably apply to this new form of medical practice. However, the lawmaker tried to fill this frame out by initiating dedicated rules, yet remaining piecemeal and lacunar. Resorting to the other fields of law is needed with view to a wide supervision. It however demonstrates its failure or unsuitability for such singular activity

Full textThe use of New Information Technologies (NIT) has been very popular these last years in teamwork within firms. This popularity is a consequence of a both technological and cultural phenomenon : The Internet and its derivatives (Extranet, Intranet). The Internet phenomenon has led to the rise of new ways of working, communicating and managing knowledge in organizations. Yet to the firm, using NIT or not is a strategic choice : A wrong decision may lead to death. That is what came to happen to several firms that went though NIT adoption without first analysing the eventual consequences on their competencies. This might be the reason why 48% of the CEOS we met still have negative prejudices about the impact of NIT on learning and communication in their firm. This emphasizes the necessity to study the actual impact of NIT on communication as well as individual and collective knowledge within the firm. Data in this research were collected before and after the implementation of NIT in a Management Information System. Two methods were used : The first one is qualitative, and was based on an action-research. The second one is quantitative, and used statistical analyses of means and variances differences. The main result of this research is that NIT integration in a Management Information System may facilitate access to accurate information and knowledge, and booster performance in the workplace, while not necessarily improving interpersonal cooperation and collaboration

Full textThe recourse pronounced of the Information and Communication Technology (ICT) coincide with the movement of company reorganisation and changes of means of consummation initiated from the 1970s. These evolutions have, as far as there, not seemed converge on a formation of standard company reference. That is why, if the taking into consideration of the demand spread, the progressive context in which become integrated the ITC as well as the importance of company history, explain the coexistence of organisational configuration varied. The technicals in question are widely diffused in the company and promote innovation, that is the product as organisational, providing that been associated with other factors such company organisation, the salaried ability, etc. The company reorganisation allows exploiting better the potentiality in (interm of stocking) and transfer of information of their equipment and improving the product quality or claimed service (supply diversification, steady of orders). If most of the authors are convinced of the ITC importance, the beneficial effects show themselves where they were last expected, in a extensively taylorism organisation of work, and that, in spite of the contemporary evolution. The taylorism assert itself by his character more general (the product standardisation allowing to increase scale economy) not for all that neglect the toyotist concept (notably on the products differentiation and on time reduction). The ITC use, although by organisational modification, not lead in a theoretical point of view, in a constitution of a new company model because those are majoritily management principles older (notably from taylorism) who been taking back and adapted

Full textThree main categories of international actors emerged from the international policy analysis carried out in this PhD : «Powerful» actors have already gained an international reconnaissance and can influence the world-wide politics. «Challenging» actors consist in states and non-states actors, which seek an international status or wish to damage the actual balance of power. «Egocentric» actors focus upon their needs and objectives. From a traditional warfare perspective, the challenging actors are aware that they cannot win against powerful actors, but since their objectives are not compatible, the conflict is unavoidable. In order to win, the challenging actors utilise asymmetric warfare. Their strategy consists in circumventing the opponent’s strengths and exploiting its weakness, using methods completely different from the opponent’s usual mode of operation. They blur boundaries between actions considered crimes and those viewed as warfare. This poses a moral dilemma to the majority of the powerful actors. At the same time, the psychological impact of such kind of attack might out-weight the physical damage inflicted. The experts define this situation as “negative asymmetry”. Information technology plays a major role in the asymmetric warfare. For the powerful actors, it allows real-time situation awareness and response in all dimensions of military operations. This is why information technologies are a source of “positive asymmetry”. At the same time the R&D activity is important. But the users become more dependent from the technology : any attack to the information infrastructure would deeply affect the strength of their forces. The challenging actors utilise commercial technology. They mainly use information technology to gather sustain and to act against the opponent’s will. Without fear and a perception of insecurity, their actions are completely useless. In conclusion, information technology is a force multiplier in the asymmetric conflicts. The gravity centre is and will be the human. In fact, the essence of asymmetric conflict resides into the will and the creativity of the human mind

Protean, they are born guaranteed from the notion of a fair trial as defined by the European Court of Human Rights. Taking a specific color in the criminal trial, this notion appears embodied in itself, the criminal lawyer who, in harmony with his specialty, must adapt to the changes which it has sometimes been. Technologies of Information and Communication have gradually invested the field of Justice and in particular the criminal sphere. Educated the results of experiments conducted abroad, France has also decided to modernize its judicial procedures using these new techniques. Copernican revolution, full of hope at the managerial level and the administration of justice, modern technologies raise fears facto resistance due to their relative complexity and novelty. Thus, a technical difficulty that limits the positive impact of the reforms, in addition symbolic aspects concerning the conduct of judicial ritual, introducing a new dialectic between stakeholders "criminal justice system" and changing the relationship of legal professionals as well as those that unites justice and litigants. Full textThe thesis is concerned with the productivity impact of IT. Indeed, there is no consensus to assert if IT increases the productivity or not. The thesis proposes to reconsider the production theory. The management activities are explicitly considered and distinguished. In short, the enterprise is divided in two kinds of activities: Core activities which contain all resources that are directly concerned with production, and ancillary activities which contain all inputs that are not dedicated to the production process. The thesis models mathematically a production function that includes the ancillary activities together with the core activities. An important assumption of the model is that the core production is complementary to ancillary production. We obtain several results. First, we derive a mathematical formula for the productivity of the manager. Second, we conclude that the impact of a technological change on productivity depends on the kind of activity. The more the technological change concerns ancillary activities, the less the impact of the technological change will be. Some econometric studies confirm our results. We find similar results for the French Industrial sector in 1997. We find a positive and significant relationship between the proportion of blue collars using computers and labor productivity. These is not the case with clericals

Full text"We see computers everywhere but in economic statistics". In 1987, in a New York times paper, Robert Solow sum up in a single sentence a paradoxical situation where coexist, in developed countries from the seventies, a slowdown in productivity gains and an acceleration of technical progress notably concerning information technologies (IT). The aim of the dissertation is to give some elements of explanation to the productivity paradox. In a first part, the reality of the paradox is established. First, technological change is a crucial determinant of productivity gains dynamics. Second, the slowdown in productivity gains is a real phenomenom which stays widely unexplained and the rythm of technological advances in it is impressing. Third, as pointed by solow, we can see computers in every business firms even though the scope and patterns of diffusion are very unequal among nations, sectors, firms and application fields. Fourth, it is not possible to establish a clear relationship between it investments and economic performances, whatever level of analysis. In a second part, an explanation to the productivity paradox is advanced. The phenomenon is explained by 1) time-consuming diffusion processes of information-based technologies, 2) rather persistent mismatches between different knowledge bases and types of capital equipment, and 3) rather slow co-evolutionary mechanisms between the potential opportunities which radically new technologies and new organisational patterns provide, on the one hand, and organisational arrangements which business firms and collective institutions are able to develop, on the other. A simulation model of diffusion highlights the generality of technology-related "retardation mechanisms". Conversely, a qualitative discussion of organisational dynamics further adds to the general point that the full impact of potentially superior technologies is likely to be exploited by any economic system only after a good deal of painstaking adjustment within and among different business organisations and broader institutions

Using a model and with a double approach, analytic and experimental (in a banking environment) we give an interpretation of these impact relations using a procedural rationality criterion. At least we demonstrate the potentiality of these technologies in the improvement of decision process rationality

Callon), we will study the genesis of the socio-technical frameworks of new media (regrouped around multimedia and computer networks) in the context of economic strategy and industrial competitiveness. Full textBased on the ubiquitous computing research started in the beginning of the 90s, the interconnection of the ICT -also known as ambient intelligence - is presented by companies, research centers and public institutions with different social justifications : a logical step of the increase in comfort and well-being, a response to the problems of ageing and dependence as well as to the environmental threat and energy saving. Having described different ambient intelligence projects and points of view collected during a contract with France Télécom, the present research examines social and technical imaginary embodied in these ICT systems. Such questioning involves reconsidering a dichotomic division between "technique" and "society". It enables us to observe a continuity of the imaginary of the infinite rationalization of social activities and of the relationship with nature, which is peculiar to capitalism. At the same time, the analysis of everyday life allows us to observe how the interconnection of the ICT sprawls beyond its original field of industrial production. A historic look at the process of the institution of privatized domestic space tends to demonstrate that the project of ambient intelligence is the outcome of the progressive rationalisation of private space. The modeling of home activities required by this project represents the most advanced stage of this rationalisation. Beyond its social justifications, the ambient intelligence also presents itself as a vehicle of the increased control exercised by the companies over private family life

It raises the positioning question of the new actors of information and documentary communication, those are named here: infomédiaires. Started with the computerization of the French's society, it advance gradually towards the digitalization of agricultural information while passing by a glance thrown on the movements and the operations of the equipment of the rural families in data processing and the installation of the computers in rural public spaces. It deploys under our eyes of true changes, even radical upheavals carried out in each link of the information system agricultural, upstream like downstream, whatever he is a producer, diffusion or user, after having traversed the principal applications of the CIT in agriculture, then in the processes of the communication. It is possible to concretely observe the specific characteristics to each country concerning the digitalization of the agricultural press by examination of the two research samples on the agricultural specialized periodicals from two very different countries in policy and culture. Based on abundant statistical data and of many observations obtained, the perspective analyses could be made on the digitalization of Chinese agricultural information, on the positioning of the infomédiaires concerned - information services, librarians and documentalists

Full textIn the context of a widespread dissemination of Information and Communication Technologies (ICT) in France and within the European Union during the past two decades, of renewal and expansion affecting most universities, our thesis focuses on an analysis of ICT use dynamics in higher education. It aims at grasping, beyond the mere questioning on the causes or effects of changes associated with the use of educational ICT, the interaction between ICT, performances and “innovativeness”.Our developments are structured around four chapters.The first chapter aims at understanding the dynamics associated with various uses of ICT by in undergraduate economics and management students from three French universities. This chapter will aim at showing how extensive use of ICT can induce an increase in student performance as measured by the average overall grades on their exams at the end of the year.The second chapter aims at understanding how students’ ICT uses impact their ability to innovate. Our results show clearly that ICT use contributes to the accumulation of digital skills (in computer and Internet use). These skills are changing the nature of learning and improve the students’ innovative capacity, which certainly increases their economic performance on the job market.The third chapter seeks to show that there is a wide variety of ICT uses by higher education teachers in France. Significant inequalities are seen in both a qualitative and quantitative points of view. Our results indicate that there are many digital divides related to these various uses.The fourth chapter focuses on understanding the relation between ICT use, the accumulation of e-skills and teachers’ innovation capacities. Our results support the thesis that having instrumental competences is a necessary condition for effective activation of informational competences which are themselves necessary for effective deployment of strategic competences related to ICT.Finally, our research has validated the theoretical assumption that the gaps in digital use would persist and affect the higher education sector despite the development and democratization of ICT. Our results have also opened discussions on the various digital skills (e-skills). Thus, we could show that there are distinct layers of digital literacy which should be taken into account to better meet the deficit observed among students and teachers

Full textMany parents decide to educate their children themselves. In the province of Quebec, these parents must, according to the law, offer an equivalent experience to what is offered or lived in school. The resources normally available at school are not necessarily the same as those available to parents at home. However, they can count on the contribution of information and communication technologies (ICT). In this study, we focused on: a) knowing what ICTs are used by all members of a home schooling family and for what purposes; (B) what would, in the opinion of the teaching parents, be further developed; C) understand how teaching parents perceive their use of ICTs and how their perceptions of ICTs have changed since schooling they homeschool; and (d) how ICTs used by teaching parents and their children could connect with other settings (eg, another homeschooling family). In order to do this, a qualitative approach combining observation sessions with semi-directed interviews was adopted with two homeschooling families. The results show that, according to different developmental factors (age, mother tongue, interests, etc.), the increasing availability and development of ICTs (social media, online resources, etc.) facilitate connections between different environments influencing the child by facilitating networking with resource persons and enabling teaching parents to work from home. This allows them to act consistently with their values, beliefs, motivations, etc., which influences them in their choice of starting or continuing homeschooling.

Full textOur study concerning the transmission of skateboard knowledge reveals the role of close contacts between skaters as concerns messages received from the media. Local interaction between those who know and those who want to learn, notably between experts and beginners in places that are designed for that purpose or that are used in that way, must co-exist with the planetary messages that are broadcast by the media. This “ordinary cosmopolitism” is experienced at various levels and intensities by different skaters and expresses the “neo-modern” character of such practices; it represents an invitation to go beyond “methodological nationalism” through an in-depth study of new information and communication technologies and their uses. Our methodology is thus founded on polymorphic techniques (semi-directed interviews, interviews with skaters commenting on videos, ethnographic studies, video analysis, Internet sites, specialized magazines) and brings to light a dual learning process for skaters in Besançon and Thise: firstly, these skaters take advantage of local interactions and organize themselves in pairs or groups; secondly, they use various educational software programmes available in skateboard magazines, videos and Internet sites; or modify such media for their own use in the acquisition of techniques and values associated with skateboarding. This is notably true as concerns the rebel spirit, which is today the “shared superior principle” of this activity: skaters thus act in relative conformity through the adoption of a consumerist approach through their use of new information and communication technologies

Full textThis research is basically aiming at understanding the economic stakes conveyed by the merging between informatics and telecommunications made possible by the rapid development of information technology. It comprises two parts. The first one is devoted to the examination of the information concept and its economic nature. Furthermore it intends to be a critical appraisal of the so called information economy but tries also to provide a comprehensive approach of the recent development of information technology within the framework of advanced capitalism. As far as the second part is encored, it enters the topic of transborder data flows focusing mainly on their economic dimension. They are viewed in relationship with the word economy market by the predominance of transnational economic systems. A particular attention is deserved to the use of telematics network by transnational companies. We also stress the existence of new markets and products generated by the penetration of data processing systems with the world economy. A final stage studies the impact of international data transmission of developing economies and discusses briefly the computerization of the Third world
