Full textThe language in its integral links is related to human intelligence. It helps to restore the picture of the world of the human mind. The perception of the world, or the objective reality of things and effects that leaves the marks in speech, is so called the worldview of the language. Each language has its own perception of the world conected to the nation's history, geographic conditions, lifestyle, culture and so on. The worldview of the language is step by step composed by all who speak that language. Using the investigation method and analysing the usage of the words in texts helps to record and denote the features of the worldview of the language. The research materials are the Corpus of Lithuanian language – Donelaitis and the corpus of Russian language - ruscorpora.ru (национальный корпус русского языка). The data of the analysis of the concept darkness in both languages showed that prototypically darkness is understood in the same way in Lithuanian and Russian languages. The research of the samples was done to denote the most common figurative expressions and conceptual metaphors that are specific to the concepts of darkness in Lithuanian and Russian languages. Full textWith the French Revolution stage actors became recognized in civilian society. In the general movement of artistic independence he was freed from sponsors and became a citizen in his own right, endowed with a true public function. Within this new environment –that of drama actors’ growing worth – François-Joseph Talma foremost Comedie-Française actor built up his personal myth. This actor relied on painting, reviewing and literature to make himself known and durably establish his achievements: the making of a star inevitably involved being acknowledged in other artistic production fields, which he used to inscribe a memory of his acting. The star was then coveted by authors, painters and the audience, who wanted to possess his image, reify and save it from transitory fame. By letting pictures and texts reflect his actor’s aura, Talma managed to be both a star and an artist : a star as he leaned on a modern promotional system , close to economic and political power but an artist also since he took part in the writing , directing and imagination of his roles. Before a star’s and an artist’s image fulfilled two opposite theatre concepts his example is that of a blending of two principles that would henceforth be inconsistent : create and be created, reconciling the creating artist’s image and that of a creature made up for success

Full textLa Reforma tributaria creada con las leyes N° 20.780 y N° 20.899 tenía como objetivos; aumentar la carga tributaria en 3% del PIB, para financiar con ingresos permanentes gastos permanentes como lo sería la educación; avanzar en equidad tributaria mejorando la distribución del ingreso e introducir nuevos y más eficientes incentivos de ahorro a la inversión; impulsar medidas para disminuir la evasión y elusión. Para lograr lo antes señalado se efectuaron diversos cambios al sistema tributario, dentro de los más importantes destaca la creación de nuevos regímenes de renta, eliminación del FUT y la creación del Impuesto Sustitutivo al FUT, algunos beneficios para las micro, pequeñas y medianas empresas; postergación del pago del IVA; Sistema de Tributación Simplificada 14 ter y modificaciones en la ley de IVA específicamente en materia inmobiliaria y una de las más importantes que corresponde la introducción de la norma general anti elusión. Es así como en este contexto se instó la incorporación de un régimen opcional, transitorio y más beneficioso para los contribuyentes de impuestos finales denominado “Impuesto Sustitutivo al FUT” estableciendo un gravamen único a las rentas acumuladas en el FUT o al saldo de retiros en exceso que existiese en tal registro a determinadas fecha, que cumpliendo requisitos remplazaría en el caso del socio o accionista su tributación final, ya sea adicional o el impuesto global complementario. Es así como en los casos que una entidad se acogiese al régimen señalado en el párrafo anterior se podía optar a la aplicación de una tasa fija equivalente al del 32%, que permitiría a las utilidades retenidas ser retiradas, remesadas o distribuidas en la oportunidad que se estime conveniente, con preferencia a cualquier otra suma y sin considerar las reglas de imputación que establezca la ley sobre impuesto a la renta vigente a la fecha del retiro, remesa o distribución, y respecto de ellas no deberá practicarse retención de Impuesto Adicional por las remesas a contribuyentes afectos a dicho tributo siendo este impuesto pagado por la sociedad que se acoge al ISF. Este régimen opcional permitió que un alto número de empresas se acogieran al régimen transitorio y decidieran acogerse el ISF, que generó una recaudación fiscal con un aumento significativo en los años que estuvo vigente y, además, facilitó la adaptación de los contribuyentes a los nuevos regímenes tributarios a la renta. De lo anterior, se podría entender que este impuesto tuvo una importancia económica, debido a que permitió que dineros que estaban empozados en las compañías y que se había decido provisoriamente no tributar, tributaran. Es más, el monto recaudado corresponde a la cantidad de $485.638 millones de dólares, que en gran medida provienen de personas jurídicas acogidas a la tasa fija del 32%. Por otro lado, se da el caso de sociedades acogidas al ISF que sus socios o accionistas y el mismo proyecto (sociedad) suscribieron un contrato-ley con el Estado de Chile mientras se encontraba vigente el régimen para inversionistas extranjeros consagrados en el DL N° 600. Si bien, en su momento este tipo de contrato-ley fueron un mecanismo legal destinado a proveer certeza jurídica a la inversión extranjera que se canaliza a través del mismo, que fue fundamental para atraer la inversión extranjera entre la década del 1980 y 2010, atrayendo inversiones en sectores económicos como minería, electricidad, agua, sanitaria o carreteras. Los proyectos e inversionistas que suscribieron DL N° 600, gozan de un derecho que corresponde a un régimen de invariabilidad tributaria con tasa efectiva del 42% por una cantidad limitada de años, lo que implicaría que su carga total a tributar alcanzaría a dicha tasa y no podría ser la tasa de impuesto adicional ni tampoco la tasa del ISF. Por lo anterior, esta tesis busca resolver un problema de armonización del régimen del ISF y el régimen de invariabilidad tributaria consagrado en los artículos 7 y/o 11 bis del DL N° 600.

Full textPor medio del presente trabajo se presenta una investigación que tiene como objetivo zanjar la naturaleza jurídica del tributo de patente municipal que regulan los artículos 23 y siguientes del Decreto Ley N° 3.063 de 1979 “Sobre Rentas Municipales”1. En específico, el análisis pretende dar con la correcta calificación de la patente municipal dentro del género de los tributos, dilucidando si es que se trata de un impuesto, de una contribución especial o de una tasa. Con miras a este fin, el trabajo se estructura en dos partes. Una primera parte, en que se propone el marco teórico: se expone sobre el desarrollo doctrinario que en derecho comparado han tenido los distintos tipos de tributos, presentándose además la posición del autor para cada temática específica tratada. Y una segunda parte, en que se presenta un análisis particular del tributo de patente municipal, partiendo de la base del marco teórico propuesto.
