Full textIn this work we set out to study firstly the rules of interpretation of talmudic law by means of logical and judicial approach and secondly to determine the nature of juridical reasonning in the talmud as well as the method of legislation in this system of law. The practical interpretation of the talmudic scholars is in with what can best be called the oral law or tora sebeal pe - the main field of our present investigation - and which is composed of a body of intellectual reasonnings (or rules) known as midras halakha or the juridical exegesis. The logical study of these rules has shown that on the one hand, the main and exclusive effort of the judge is applied to the strict litteral interpretation of the tora, and on the other hand, the writ- ten law is open to numerous, conflicting and imperative hermeneutics. To arrive at the judicial decision the talmudic scholars call upon the principle of majority verdict thus bringing to close the dialogue which is the method of devising lawws in this judicial system

Full textAbraham Joshua Heschel (1906 1972), important philosopher of Judaism of the twentieth century, turned his attention direct to the traditional rabbinic literature in the book Torah Min Ha-shamaim Be-Aspaklaria Shel Ha-Dorot. He addressed especially the Talmud and the Midrash. From the Heschelian reading of rabbinic literature emerges a dialectical approach of the theological trends that animated the debates of the first rabbis Those debates review issues like the human and divine elements in revelation, Gods immanence and transcendence, the relationship between religious observance and the spirit behind it, the ideas on miracle and many other themes of rabbinic debate. Heschel identifies in two schools of thought of the first and second centuries of the Common Era, the mystical School of Rabbi Akiva and the more rationalistic School of Rabbi Ishmael the two main paradigms that dialectically tensioned rabbinic thought from the ending of Antiquity and during Middle Ages. According to Heschel, the two tendencies permeate rabbinic thought since them. Heschel makes several conclusions on the relationship between reason and mysticism in Jewish religious experience from this dialectical reading. These conclusions deepen the modern debate on the nature of religious experience. They are also a powerful critique against fundamentalist readings of Jewish traditional texts.

Full textThe Jewish-Christian Disputation that took place in Paris in the summer of 1240 constitutes the historical, cultural and philological framework of our PhD-thesis. This event led to the Latin translation of the Talmud entitled Extractiones de Talmud. The purpose of this thesis is to examine the Hebrew-Jewish textual tradition which lies behind the Latin translation. To achieve this goal, we have drawn a systematic comparison significative selection of passages contained in the critical edition of the Extractiones de Talmud per ordinem sequentialem and the Hebrew-Aramaic original of the Talmud, as it is offered by the canonical edition of Vilnius. This method has allowed us to confirm that the Latin translators were very familiar with both the Christian and Latin traditions; concerning the translators’ method, we have been able to show that they worked with different Talmudic manuscripts which they often enriched with Rashi’s commentaries. Our study has led us to conclude that it is not possible to single out a unique Hebrew-Aramaic manuscript as the Vorlage for the Latin translation of the Talmud. However, we can infer some characteristic features of the texts and its translators, such as the former’s Ashkenazi origin and the fact that the translators were working in the Paris area. The importance of our research in the field of Jewish-Christian polemic and also in the context of Talmudic textual criticism results from the fact that this is the first time ever that research has been conducted to identify the plausible Hebrew sources used in the translation of the Latin text of the Talmud, that is, one of the major landmarks in the history of Jewish-Christian relations during the Middle Ages. The particular manuscripts we have pointed to should certainly receive adequate consideration in any future inquiry into the use of original Talmudic sources by Christian authors during the Middle Ages.

Full textIs it right to want to save reason, at any cost? In the course of the history of ideas, it is a real denaturation of human reason, which we are witnessing. Originally simple mode of apprehension of the real, the reason turned into system, ideology and paradigm. This had the consequence of making the human being from a liberating and fruitful humanism to aconquering and dangerous anthropocentrism. So reason has become a wolf for man; theprotean crisis we are now experiencing is only a symptom of this alteration. The rationalist ideology renders the human being not only incapable of accessing the real as in himself, but also leads him to disguise, to twist, to mistreat the real. Numerous patches have been invented throughout the history of Western ideas by many philosophers to diminish, or at least to contain,this denaturation, but they have had the perverse effect of reinforcing and further rigidifyingthe rational paradigm. It is time to imagine a mode of apprehension different from reality, associated with anunprecedented epistemology, capable of bringing about a new theory of knowledge: it will be about "systematic" thinking. Nourished by talmudic epistemology and cognitive science, this new theory of knowledge, whose prolegomena are posited, is built on a logic radically different from Aristotelian logic.To know otherwise to think otherwise is the stake of this new epistemology

Full textThis dissertation highlights the methods of interpretation used by the Amoraitic Sages to interpret the Torah and establish the Jewish religious law. This work aims to understand how the text of the Torah serves as a basis for legal discussions undertaken by the Sages and therefore tries to understand the approaches that such Sages used to explain and clarify the obscure meanings of the biblical text. In order to achieve that, we have proceeded to a study of the development of the Oral Torah in rabbinic Judaism and a critical analysis of classic works of the Oral Torah, namely the Mishnah and Talmud, besides the text of the Written Torah as a background. The research shows how the application of hermeneutical methods by the Amoraitic Sages is, to some extent, highly subjective and how it helped to define Jewish religious law that is followed even today by Orthodox Jews.

Full textThe RIF was one of the greatest Talmudic Giants and Halachic authorities during the Middle Ages. He lived mostly in North Africa between the years 1013 – 1103 DC. He wrote Sefer ha-Halachot – considered one of the best summaries of the Talmud and one of the most essential books of Jewish law. There hasn't been written any substantial research project about this important work comprising 1700 pages and tens of commentaries. The purpose of this thesis is to analyze the contribution of the RIF to Jewish Law and the learning of the Talmud. The main topics dealt with in this thesis are: -The contribution of the Geonim as the main source to Sefer ha-Halachot. -The commentaries that were written on the book. -The didactical contribution of the RIF to the learning of the Talmud andJewish law. -The study of the RIF as a solution to the crises in teaching the Talmud in Israel. -The influence of the RIF on Jewish Law. A comparison between the Sephardic and Ashkenazic Law. These topics are all focused to the same purpose, to better understand the composition of the RIF, his influence on Jewish Law throughout the generations something that will encourage High School and Yeshiva students and even those who already in the work force to study the RIF

Full textThe talmud is full of references to objects such as excrement, urine, semen, spit etc. . ; all that is now included in the category of "bodily excretions". The target of this thesis is to find the absence of the object's significance in the richness of references. For that we have developed a textual system of the babylonian talmud (in the first half), and a contextual system of the 'talmudic world' (in the second half). The textual references of excretions should not necessairily escape these two systems. Thus, a study of excretions as object seems less pertinent, because meaning stays trapped in the two described systems. We reach this target by developing a methodological basis for a new reading approach to the talmud that consists of a morphology, a syntax and a narratology. Passing by studies of processes of quotation and memorization, contextualization and decontextualization, we present the complex character of the talmud as text. By the presentation of the rhetorical, verb oriented and non referential qualities of the talmud, we present it as a text which is mostly interested in its own textuality. By a conter-ponctuel movement, the second half of the thesis learns the talmudic contextual structures : the discursive dispositions. After a study of the category and the process of categorization in the talmud, and a study of the mechanism of the discursive disposition, we present studies of five central talmudic discursive dispositions that treat bodily excretions. The thesis concludes with a study of the dialectics of the two halfs, and the placing of the 'bodily excretions' problem in its proper setting

Full textSince the Greek Septuagint, the biblical book Mishlei is translated "Book of Proverbs". But in the Jewish hermeneutic tradition, the correct translation is "parables". This new meaning changes the meaning of the whole book. It was therefore necessary to translate the Hebrew text of Mishlei on a new basis, following the Talmudic and midrashic hermeneutics, extended and developed in medieval times by commentators, philosophers and Jewish grammarians. Thus, we propose a new translation, with commentary and philological notes that explore the meanings of the Hebrew text including its metaphorical and allegorical layers. This translation is preceded by a long introduction devoted to locate the premises of Jewish hermeneutics, and to understand the literary and historical proces that prevent access, and create misunderstandings which Mishlei is a crucial example. An important part of the introduction is also devoted to methodological problems of translation of biblical writings

Full textPar ailleurs, aucun sujet n’échappe au Talmud car aucun sujet n’est en dehors des lois religieuses, lesquelles règlent, du moment de sa naissance au jour de sa mort, tous les instants de la vie d’un juif. Et, plus précisément, nous allons nous intéresser au divorce. Dans le droit hébraïque, le cérémonie de divorce se matérialise par la remise du mari à son épouse, d'un document préalablement écrit et signé sur ses instructions, et dans lequel il déclare divorcer de sa femme : le guet. Objet d’une vaste législation, le divorce a connu une longue et profonde évolution dans l’histoire du droit hébraïque. Régis exclusivement par le droit hébraïque jusqu’à la fin du XVIIIème siècle, les juifs furent confrontés – avec l’Emancipation – à un grave dilemme d’ordre religieux, dans le monde et plus précisément en France. Ces derniers se heurtent ainsi depuis maintenant depuis plus d’un siècle, à de sérieux problèmes générés par l’institution du divorce civil et les conflits de lois qu’il engendre et, dont les femmes sont généralement les premières victimes. En effet, d’une part, ces femmes peuvent tomber dans le statut d’agunot et, d’autre part, elles peuvent donner naissance à des enfants qualifiés de mamzerim. La aguna est une femme dont le mariage a pris fin mais qui cependant reste légalement une femme mariée. Sans obtenir un libelle de divorce de son mari, cette femme aguna ne peut se remarier. Le mamzer est un enfant né d’une relation incestueuse ou d’une femme mariée, conçu avec un homme qui n’est pas son mari. Cet enfant, une fois devenu adulte, ne peut se marier avec un juif légitime, alors qu’il est considéré comme un juif à part entière dans d’autres domaines. Interpellés par ces situations, les rabbins ne cessent de trouver des solutions pour venir en aide aux victimes du déni de guet. Pourtant en dépit de leur volonté et de leurs efforts, le problème reste, pour certains, inchangé à ce jour, car les lois sur le divorce juif sont d’origine biblique, c'est-à-dire immuables

Full textThis work deals with the Talmudic ethics of the self, how it differs from other ethical systems of the Mediterranean world of the first centuries CE and in what ways it resembles these systems. Through analysis of texts from classical rabbinic Iiterature, we show that the rabbinic movement developed an anthropological and ethical conception that was dIfferent than the one we find in philosophical and Christian writings of the first centuries. The particularities of the rabbinic ethics of the sel : are studied through the analysis of six themes: all of which figure prominently in rabbinic ethical discussions: repentance (teshuvah), suffering (yissurim) ; master-disciple relationship (rav-talmid) ; the bad inclInation (yetzer ha-ra); the fear of God (yirah) and the relationship between study,and practice of the Law (talmud and ma 'assé). Using the works of Michel Foucault, PIerre Hadot and Vincent Descombes, we try to demonstrate the importance of the rabbinic ethics of the self to the history of the occidental subject and to our way of thinking it, and to articulate its relation to the moral law

Full textTalc pleurodesis is the most effective treatment für malignant pleural effusions. It is a palliative procedure. The appearance of a malignant pleural effusions marks the beginning of the last part of life of a patient with cancer. The cardinal symptom is dyspnoea. To allay, we offer surgical pleurodesis, offen in blind action. This is causing high mortality. We performed 115 thoracoscopic talc pudrages between 1997 and 1999 (36 month). The inpatient mortality was 7,8%. The most offen origins of metastatic carcinoma were Breast cancer (MS 12,4 month), Lung cancer (MS 6,2 month), Carcinoma of unknown primary (MS 10,7 month), Malignant mesothelioma (MS 10,9 month) and Ovarian cancer (MS 2,2 month). The patients with Breast-, Lung- and Ovarian cancer suffered the must from dyspnoea after pleurodesis. That''s why it is necessary, to find standards to choose suitable patients, which profit. The documents are examined, criticized and confronted to other sources of Jewish or Christian origin (Hellenistic Jewish literature, Jewish Apocrypha, rabbinic sources, Targumim, Toledot Yeshu – New Testament, Apostolic Fathers, Church Fathers). The investigation tries to answer to several questions: - What did the rabbis exactly know about Jesus? - Has their information any historical value? - Has their perception undergone some evolution? - Did the rabbis of the Talmud have access to the Gospels as a written source? The conclusion of this thesis is that all these documents are rooted in their Sitz im leben. They obviously attest – contra Peter Schäfer (Jesus in the Talmud, 2007) – that the rabbis had no direct acquaintance with the Gospels as written documents. This study also shows, concerning the Babylonian Talmud, that all the passages relative to Jesus belong to the last editorial layer of this corpus (VIIe-VIIIe century)

Full textContrary to a well-spread notion, legal and ritual issues are an important focus of kabbalistic discourse and the halakhic literature, in turn, is far from having negleted what the kabbalists had to say. Since the historic beginnings of kabbalah, and even in the Talmud, legal and symbolic discourses interpenetrate. Their organic unity and the messianic telos of their dialectics are best articulated in the introduction to the main text of Lurianic kabbalah, 'Ets Hayyim. In the light of the notions presented therein, and following the concept of hierohistory borrowed from Henry Corbin, this study proposes a phenomenological re-reading of three precise aspects of the Jewish ritual, which have crystallized the essential discussions about the relationship between halakhah and kabbalah. The result is a new outlook on the metahistorical and eschatological motives behind the history of Jewish religious practices

The textual sources are among the most influential in the Jewish tradition: the Bible, the Babylonian Talmud, Midrash Rabba, Rashi’s commentary on the Bible, and the Zohar. As for the Oral source, it consists of interviews with French and Israeli Jews, examining representations of Rachel and Lea's figures. This work addresses initially roles of the two matriarchs in the fundamental texts of the Jewish tradition it next presents study of the development of the biblical story through time and texts. After analysing recurrences of different themes of Rachel and Leah in the various sources, it then examines differences and modifications of these themes, in. Order to understand the reason and meaning of their modifications. It further inquire through interviews about the kinds of images associated with the figures of Rachel and Leah today, how they are perceived, the places they occupy in the interviewee's life, and whether they are considered part of a distant past or relevant today. Finally, it compare between the roles of the two matriarchs in contemporary Jewish society and their role in the textual sources of the Jewish tradition

Full textThe construction of hedges in high Andean areas has become a key element in reducing environmental liabilities and, at the same time, contributing to the development of the country thanks to mining. Much of the terrain in these areas is clay soils whose behavior is unpredictable because they present abrupt volume changes depending on the variation in soil saturation. Those who travel on roads on slopes of this type of soil are at high risk due to the landslide suffered by the slopes every year. In this type of slopes, landslides occur when the clay soil is partially saturated, since under these conditions the soil is not stable. For this reason, the stability studies of partially saturated soil slopes were carried out with the infinite slope method. The partially saturated soil failure envelope was constructed with the values of the filter paper test and direct cut according to the saturation to which it is subjected. These values will be important for the calculation of the safety factor, which was obtained from a spreadsheet proposed in this investigation. Finally, the spreadsheet was validated with the Geostudio software, where a variation was obtained within the range of significance + -5%. It was concluded that the slope stability analysis of a partially saturated soil cover provides a factor of safety value from an analysis that more accurately simulates soil behavior.

Full textEl presente estudio se origina en el marco de los requerimientos de la División Andina de evaluar mejores alternativas de producción; específicamente, en este caso, enfocados en el control de los taludes y cumplimiento de las líneas de diseño o límites finales de su mina a rajo abierto. El estudio apunta a obtener un mejor comportamiento de los taludes finales proyectados para el rajo, variando tanto los parámetros de diseño de las tronaduras de precorte y línea buffer, como asimismo las propiedades del explosivo. Se realizaron tres pruebas en la mina, las cuales consistieron en lo siguiente: Primera prueba: Modificación de la malla de perforación de la línea buffer, y reducción de la distancia entre la línea buffer y la línea de precorte. Segunda prueba: Modificación del diseño de perforación y tronadura, cambio de explosivo y disminución del espaciamiento entre los tiros de precorte. Tercera prueba: Cambios en el diseño de perforación de la línea de precorte y línea buffer. Reducción del ángulo de inclinación de los tiros de precorte y de la distancia entre línea buffer y la línea de precorte. A partir de los resultados obtenidos en estas pruebas se realizó una evaluación geomecánica del talud remanente y del cumplimiento de los límites de diseño del rajo. Las principales conclusiones se resumen a continuación: El banco 3468 obtuvo una calificación de 100% de grado de aceptabilidad, considerada como Muy Buena. La pared del banco evaluado presenta un aspecto sano y estable. Sin embargo, se observan algunas deficiencias como la presencia de sobrepiso en el banco superior y de cornisas en el banco intermedio. El banco 3596 obtuvo una calificación de 70% de grado de aceptabilidad, considerada como Buena. Las paredes del banco evaluado se presentan estables y con un buen saneamiento. Se observa presencia de deuda o remanente en la pata del banco. En suma, el análisis de los resultados de las pruebas realizadas permite concluir que los cambios introducidos fueron positivos. En los tres casos se observó una mejora con respecto a la situación concerniente a las prácticas preexistentes, en el sentido que con los nuevos parámetros de diseño es posible obtener taludes más estables. Dado los buenos resultados de estas primeras pruebas ya se están aplicando estos cambios en la faena. En todo caso, se recomienda realizar pruebas adicionales con el propósito de ratificar con mayores antecedentes la implementación definitiva de las modificaciones propuestas.

Full textEl aumento de talud global en las excavaciones a cielo abierto es un ejercicio que ha cobrado importancia las últimas décadas y hoy en día, con los adelantos en equipamiento de monitoreo y fortificaciones, surge como una alternativa viable. Las principales causas que impiden incrementar los ángulos de taludes son el daño que produce la tronadura en el macizo rocoso y la relajación de tensiones provocada por la excavación. Ambos fenómenos disminuyen la resistencia del macizo rocoso. Según H&B (Hoek et al, 2002) la extensión de este daño alcanza hasta dos veces la altura de banco, lo que representa una distancia importante para la estabilidad de taludes. Uno de los objetivos de esta memoria es buscar alternativas de tronadura que disminuyan la extensión de este daño. Sin embargo, la tronadura no es el único aspecto que afecta la estabilidad de un talud. Las estructuras presentes en el macizo rocoso intersectadas por el talud pueden formar cuñas las cuales pueden deslizar y esto puede ser una limitación para empinar el talud. Al estudiar estas diferentes causas, conjuntamente se revisa el amplio espectro de fortificaciones y equipos de monitoreo que permiten controlar y asegurar los taludes. Una vez logrado el objetivo de levantar los taludes, es necesario conocer las implicancias del ejercicio. Se realiza una revisión a los cambios de inversiones, de costos de operación, posibles interferencias operacionales, etc.; lo que permite dar una visión completa de lo que significa realiza un cambio de esta envergadura en una de las operaciones unitarias de la mina. Finalmente, el aumento de ángulos de talud nos entrega un 4,6% menos de costos de carguío y transporte en los primeros 3 años. A lo largo de la vida de mina la reducción de movimiento de lastre nos permite obtener ahorro de 4,47 [MUS$] en costos de transporte y 0,32 [MUS$] en carguío, con un aumento de 0,85 [MUS$] para los costos de perforación y 0,5 [MUS$] en costos de tronadura, obteniendo un ahorro total para el primer diseño de 4,78 [MUS$] al considerar el resto de los ítems mencionados en capítulos anteriores. Para el diseño optimizado en 5°, el ahorro conseguido en los primeros 3 años de costos de carguío y transporte llegan a un 7,4%. Esto se traduce en un ahorro a lo largo de la vida de la mina de 8,16 [MUS$] en costos de carguío y 0,58 [MUS$] en carguío, con un aumento de 0,75 [MUS$] en costos de perforación y 0,2 [MUS$] en costos de tronadura. El ahorro total para este diseño asciende a 10,24 [MUS$].
