The research on the legitimacy and effectiveness of the HRC stems from the observation that there is a deep lack of knowledge regarding the scope of its mission, which has a negative impact on it. This study shows that despite the limits imposed on this body by the ICCPR, its work has a very significant impact on the international human rights protection. To achieve this end, the HRC adopted interpretation methods that have earned it the attention of others bodies, strengthening by the way its legitimacy. Pursuing the same goal, in order to overcome the non-binding nature of its decisions, it endeavors to give its activity the impression of that of a formally court-like function with the purpose to facilitate States’ compliance by the degree of authority with which they are endowed. However, we propose that if States do not take a new step by setting up a single international court in human rights field, it is an urgent that the UN treaties bodies system, as it known today, be rationalized for the individual’s interests. As the effectiveness of human rights dependent on States willingness, the solution against the current pitfalls requires a large-scale political project supported by them

This thesis deals with international law, theory and law philosophy. It focuses on the figure of the human of the rights, on the individual entitled to the rights as they are declared and implemented, on the claim of universality of the « human » of human rights. Is « everyone », with « no distinction », as claimed by international and regional texts, the rights beneficiary? I point out that the abstract and theoretical universal of the human being is being reduced in effect to a located man, as the human of the rights has been captured by the national. In a fîrst step, I draw the picture of the juridical man, of the human as apprehended by law, the theoretical individual entitled to the human rights, through a critical perspective of the legal construction of the juridical subject, of rights foundations and of the relations between rights of the man, of the citizen and of the national - Partie I. I then confront this model to the alien figure, to the theoretical protection of the alien and his effective rights, in order to make the obstacles to the human of the rights universalism emerge - Partie II. The alien figure, this non-national, takes thus effect by revealing the paradoxes of human rights. It points out the loss of universality of Homo juridicus and the reduction of human rights to national rights

Human rights are really born with the writings of French Constituents during the 1789 revolution. These rights are the outcome of a long process of maturity of the conception of the right, which started since the classical jusnaturalisme through the divine right to result in modern jusnaturalisme, the modern natural right, which recognize for man rights by his nature. In fact, after being subject of poignant criticisms, the human rights have gained ground. They have been made legal by many bills of rights at the international as well as the regional level, and they have been constitutional thanks to democratic states. So their claim has become universal. But behind this theoretical universality is hidden a catastrophic practical reality. They are permanently and strongly violated. In fact, the fundamental obstacle which hinders the universalisation of these rights is the capitalistic globalization. This one, from its organization according to the only one logic of the market, raises difficulties of cultural, economic and political nature which prevent men from being able to enjoy their rights. But these difficulties which make the effective and universal practical of the human rights impossible are not a fatality. In fact, for a real universalisation of this norm we must remake the mondial system in substituting at the economical globalization the human rights globalization

Faced with the challenges and issues of freedom, and, subsequently, to development of man and peoples, it seemed necessary to ask ourselves about the universality of right as a guarantee of the future of man and of societies. As for the relation of “Totality” to the “part”, we mentioned the place of the human rights in the political community. It was the question for us to try to move the ambivalent ambiguity which subtracts the rights of the human of the political community or expect the political community rights without the rights of the man. This concern appears as the main one in the question of the universality of human rights. This means that the challenge of democracy in our contemporary world regarding the issue of human rights opposes liberal societies and communitarian ones. If in communitarian societies human does not exist and if in liberal societies the community would have lost its signification, then we ask the question of whether to release him from his political community? That's the question we asked ourselves before starting this inquiry. At this step, we believe that the philosophy of communicative rationality through the ethics of discussion that we studied with Jürgen Habermas, allows us to say that it is possible to reconcile the human and politic community and this community needs to recognize the rights of the man

The present reflection on the framework of intervention of UNO in the field as of human rights, in French-speaking sub-Saharan, pursues two principal goals. The primary goal aims at showing that the United Nations Organization is very committed on the ground of the human rights, in the countries of French-speaking space. This commitment is not new. Since 1960, year of the deployment of the first Operation of peacekeeping in French-speaking sub-Saharan Africa, the Operation of UNO in Congo (ONUC), the United Nations did not cease considering political stability, economic and social of Africa, like priority and the principal condition of the peacekeeping and the securty international. This stability passes by the creation of the effective conditions of promotion and protection of the basic rights of the African citizens. We tried, within the framework of this work to appreciate the assessment of UNO in the field as of the human rights. However, after 56 years of presence in sub-Saharan French-speaking Africa, this asssessment apears mainly negative. The second objective of this work is to analyze more precisely this failure and to understand the causes of them. Indeed, the programmes of promotion of the humlan rights, aiming inculcating a culture of respect of the human rights within the various social and economic categories and at reinforcing the capacities of the States in the field of the human rights are often unsuited to sociocultural réalities of Africa, insofar as they do not take into account, the fundamental causes of the African civil wars, that constitutite the intercommunity conflicts
