The monograph examines the problems of the legal status of a malicious violator of the regime of serving a sentence of imprisonment, as well as determining the mechanisms and limits of bringing these persons to responsibility established by the penal enforcement legislation, as a result of which ways of solving them are proposed. In particular, a retrospective analysis of the norms of domestic legislation defining malicious violators of the regime of serving a sentence in the form of imprisonment is carried out; the author's concept, characteristics of malicious violators of the regime, as well as their classification are given; the composition of malicious violation of the regime of freedom as the basis for bringing to justice a convicted person to imprisonment is examined; the system of penalties applied to to a malicious violator of the regime, as well as the procedure for their appointment and execution; the legal consequences of recognizing a convicted person to imprisonment as a malicious violator of the regime of serving a sentence are established; ways to improve the penal enforcement legislation and law enforcement practice in relation to malicious violators of the regime of serving a sentence are determined. Errors and violations are major contributors to iatrogenic harm in patients. Anesthesia is a complex process within the complex system that is healthcare. In complex systems, decisions need to be reviewed frequently and iteratively with reset baseline data. Errors are unintentional and cannot be avoided simply by trying harder or deterred by the threat of punishment; violations, on the other hand, are deliberate deviations from safe practice. Types of error are statistically predictable, and can be understood in relation to the cognitive processes involved in their generation: either System I thinking, or System II thinking. Safety depends on doing the right things correctly the first time, using a systems-based approach (drawing lessons from aviation and other high-reliability industries) within a just culture.

Chapter 2 describes experiments searching for CP symmetry violations that might account for the matter–antimatter imbalance in our universe. It describes the historical discovery of mesons and quantum-mechanical oscillations between particle and antiparticle (i.e., particle–antiparticle oscillations) in the neutral K meson and heavier meson systems. It introduces quarks and quark flavor. The chapter relates CP violation to violations of time reversal invariance that might be revealed by a spatial separation of positive and negative electric charge within or around the fundamental constituent particles of matter. It describes a halfcentury of experimental searches, including ongoing projects, for the particle electric dipole moments that would characterize such a charge separation. Technological advances (such as ultra-cold neutron beams) and theoretical concepts (such as vacuum polarization) relevant to these searches are introduced. While some CP violation has been clearly observed, its extent remains insufficient to account for the universe’s matter–antimatter imbalance.

Abstract:
The present dissertation aims to establish, initially, a scientific correspondence between the State of Unconstitutional Things, previously recognized by the Supreme Federal Court on September 9th, 2015, in the judgment of the allegation of fundamental precept’s violation nº 347 and the continuous calamity in the penitentiary system of the state of Rio Grande do Norte, which was decreed in March 2015 and persists until 2018. From the link proposed here, the local factual elements which, together, characterize a scenario of serious systemic violations of human rights will be analyzed – through deductive and documentary way, with bibliographic support. Next, the urgent necessity to break the traditional model of regional public security and the consequent structuring of a public security priority policy with a transversal and articulated performance, based on the accomplishment of actions of intelligence and on the citizen emancipation will be demonstrated. Therefore, from the perspective of structural judicial activism, the State of Unconstitutional Things can be seen as an important decision-making technique used to stimulate the need for dialogical and intersectoral practices among various public agencies and civil society in solving issues related to collective demands of high complexity. The relevance of this constitutional study can be reinforced with the existence of Bill nº 736/2015, intended to set legal limits “on the state of unconstitutional things and significant commitment” and with the Law No. 13,675 of June 11th, 2018, which disciplined the National Public Security Policy (PNSPDS) and the Public Security System (Susp). In force since July 12th, 2018, the aforementioned Federal Law expresses “public security actions and transversal policies” as guidelines of the National Public Security Policy (article 5, IV). In this sense, faced with social contexts of extreme vulnerability, as perceived in all the state of Rio Grande do Norte since the public security crisis aggravation for more than three consecutive years, the definition of new constitutional guidelines and the promotion of integrated public policies within the regional prison system are urgent measures. Abstract:
Given the systematic threats facing humanity, there is an urgent need for new thinking about the human rights project. The most prevalent form of global abuse exists in the form of violence against women and children. Sexual violence has been considered the most pervasive, yet least recognized human rights, abuse in the world. Equally prevalent among the modern sources of threats to physical integrity rights are the pervasive practice of torture and the issue of poverty and the threats it poses to human dignity and human rights. Individual civil-political rights and the rights of minorities, including women, ethnic and religious minorities, and indigenous people have been protected at times and violated at other times by states. Moreover, some observers argue that group rights should be properly understood as an extension of the already recognized collective rights to self-determination of people. But this broad spectrum of human rights violations can be organized into two categories: domestic and international. The domestic sources include both local and national sources of human rights abuses, and international sources entail international and global dimensions. These analyses are interconnected and reinforcing, but they can be contradictory at times. Understanding such complex interrelations is a necessary condition for describing factors and processes leading to abuses. In an applied sense, this understanding is essential for suggesting how we should proceed with the protection of basic human rights. Although there is agreement on the most pressing problems of human suffering, there is no consensus over the answers.

Chapter 8 assesses the current US criminal legal system. The chapter argues that when we evaluate this system through the lens of moral side constraints rather than in terms of general justifying aims, it becomes clear that we are not merely doing a poor job of achieving valuable ends, we are violating basic moral rights on a massive scale. Given our indefensible practices of overcriminalizing, overpunishing, incarcerating inmates in inhumane prison conditions, and doing all of this against a backdrop of systemic injustice, it is no exaggeration to condemn the status quo as a widespread and systematic human rights atrocity.

Latina girls and women have often been invisible in the U.S. legal systems of juvenile justice, criminal justice, and immigration as well as in the broader criminological research. Latinas in the Criminal Justice System: Victims, Targets, and Offenders remedies this deficit and investigates the histories, backgrounds, and struggles of system-impacted Latinas. It shares understandings about Latina girls’ and women’s experiences with victimization, law violations, and systems of surveillance and punishment. As a project of social justice, Latinas in the Criminal Justice System addresses how ethnicity, gender, class, sexuality, legal status, and/or carceral status shape perceptions, interactions, and system involvement. Employing a variety of methodologies and data, Latinas in the Criminal Justice System examines how Latina “victims” of interpersonal violence view their interactions with police officers and other systems actors, how Latina girls and women navigate the juvenile and criminal justice systems, and how undocumented Latina women experience the U.S. “crimmigration” system. A social scientist with global affiliations, among others with Columbia University in New York, University of Oslo in Norway, and La Maison des Sciences de l'Homme in Paris, Lindner takes us across history and into nations worldwide to show how emotion spurs hierarchies of domination and therefore causes subjugation, human rights violations, abuse, conflict, and fighting. She spotlights results ranging from the binding and subsequent deforming of Chinese women's feet, to periods of slavery, bondage, feudalism, apartheid, and other events across time. Related actions from political domination internationally, to spousal or child abuse on the homefront are addressed. Lindner looks at how widely divergent societies—from the Japan of Samurais to the Meso America of Aztecs, up to the modern Iraq at war—are driven by hierarchies of emotionally-fueled control with rigid domination. Combining classic literature with emerging research, Lindner explains how similar dynamics are at work also in contemporary societies of the West, albeit more covert. What is still lacking, almost everywhere, is access to the full range of our emotions, together with the skills to regulate these emotions so that they become a liberating force in our lives, play a constructive role for productive, fair, and so-called "good conflict," and inform our institution building. Lindner concludes her book by laying out a road map for how to reduce domination and increase human dignity, both in our lives and in the world, by using the power of emotion to implement global systemic change.

A legal system is understood to be a social artifact in the sense that it is constituted by certain social facts. As such, a legal system has a characteristic use (or purpose) that determines what in this chapter is called its conceptual function. The chapter goes on to argue that the conceptual function of a legal system is to keep the peace by regulating behavior through legal norms. Further, insofar as a legal system is an institution that is created to solve problems of beings like us in a world like ours, the chapter posits that the manner in which legal systems, as a conceptual matter, attempt to keep the peace is by authorizing coercive enforcement mechanisms for some violations of law.

Principle 19 outlines the duties of States with regard to the administration of justice for victims of serious human rights violations and other international crimes. Under this Principle, States must ensure that those responsible for serious crimes under international law are prosecuted, tried and adequately punished. A state’s (criminal) justice obligations have long been recognized by regional human rights courts and international human rights bodies. While the fight against impunity is the explicit aim of the International Criminal Court (ICC) and a major goal of the United Nations, the duty to prosecute lies primarily with the domestic justice system with regional or international mechanisms being subsidiary or complementary. This chapter first provides a contextual and historical background on Principle 19 before discussing its theoretical framework and how human rights courts and treaty bodies have interpreted the duty of States to investigate and prosecute serious human rights violations.

Abstract:
Effective social protection policies are crucial to realizing adolescents’ rights, ensuring their well-being, breaking the cycle of poverty and vulnerability, and helping them realize their full developmental potential. Low- and middle-income countries (LMICs) have extended social security coverage to ensure basic protections—while continuing to develop social protection systems. Social protection for LMIC adolescents in the context of gross violations of their basic rights is examined. Prevalence, consequences of protection rights violations, and the role and impact of social protection programs in ensuring enhanced opportunities for development and well-being among young people are discussed. Results demonstrate direct impacts (e.g., increased income, consumption, goods and services access; greater social inclusion; reduced household stress). LMICs need integrated social protection policy and program expansion if the 2030 Agenda for Sustainable Development is to be realized. With adolescent-centered policies and investments, governments can help adolescents realize their rights to a fulfilling and productive life.
