Abstract:

Energy justice has emerged as a matter of vital concern in energy law, with resonances in the attention directed to energy poverty, and the United Nations Sustainable Development Goals. There are energy justice concerns in areas of law as diverse as human rights, consumer protection, international law and trade, and in many forms of regional and national energy law and regulation. The book covers main themes related to justice. Distributive justice, the equitable distribution of the benefits and burdens of energy activities, is challenged mainly by the existence of people suffering from energy poverty. This concept is also associated with substantive energy equity through such measures as the realization of ‘energy’ rights. There is also a procedural (or participation) justice, consisting in the right of all communities to participate in decision-making regarding energy projects and policies that affect them (this dimension of energy justice often includes procedural rights to information and access to courts). Under the concept of reparation (or restorative) justice, the book includes even-handed enforcement of energy statutes and regulations, as well as access to remedies when legal rights are violated. Finally, the idea of recognition or social justice means that energy injustice cannot be separated from other social ills, such as poverty and subordination based on caste, race, gender, or indigeneity, the need to take into account people who are often ignored. These issues are given specific momentum by thinking through how we might achieve a ‘just’ energy transition as the world faces the climate change challenges.

Energy is vital for a good standard of living, and affordable and adequate sources of power that do not cause climate change or pollution are crucial. Renewables can meet the world’s energy needs without compromising human health and the environment, and this VSI gives a history of their deployment and the principles of their technologies. Wind and solar farms can now provide the cheapest electricity in many parts of the world. Decarbonizing heat is just as important as clean electricity, and can be achieved using renewably generated electricity to power heat pumps and to produce combustible fuels such as hydrogen and ammonia. Several other clean alternatives, notably hydropower, biofuels, nuclear power, and carbon capture, are also becoming important. Lithium-ion batteries are enabling the electrification of transport and providing grid storage. But while market forces are helping the transition from fossil fuels to renewables, there are opposing pressures, such as the United States’ proposed withdrawal from the Paris Climate Agreement, and vested commercial interests in fossil fuels. Net-zero emissions must be reached by 2050 for a sustainable future, and governments must act quickly to accelerate the transition.

Abstract:

The world is at a pivotal crossroad in energy choices. There is a strong sense that our use of energy must be more sustainable. Moreover, many also broadly agree that a way must be found to rely increasingly on lower carbon energy sources. However, no single or clear solution exists on the means to carry out such a shift at either a national or international level. Traditional energy planning (when done) has revolved around limited cost projections that often fail to take longer term evidence and interactions of a wider set of factors into account. The good news is that evidence does exist on such change in case studies of different nations shifting toward low-carbon energy approaches. In fact, such shifts can occur quite quickly at times, alongside industrial and societal advance, innovation, and policy learning. These types of insights will be important for informing energy debates and decision-making going forward. Low Carbon Energy Transitions: Turning Points in National Policy and Innovation takes an in-depth look at four energy transitions that have occurred since the global oil crisis of 1973: Brazilian biofuels, Danish wind power, French nuclear power, and Icelandic geothermal energy. With these cases, Dr. Araújo argues that significant nationwide shifts to low-carbon energy can occur in under fifteen years, and that technological complexity is not necessarily a major impediment to such shifts. Dr. Araújo draws on more than five years of research, and interviews with over 120 different scientists, government workers, academics, and members of civil society in completing this study. Low Carbon Energy Transitions is written for for professionals in energy, the environment and policy as well as for students and citizens who are interested in critical decisions about energy sustainability. Abstract:

This essay examines the adoption of and the indifference to the term “Anthropocene” in diverse discourses addressing the urgency of climate change in the early twenty-first century. Through an analysis of keynote speeches, this essay argues that Anthropocene—a storytelling device invoking a pan-human species responsibility for the current climate crisis—is deployed widely within Euro-Australo-American academic environmental studies and environmental politics, but has not gained political or epistemic traction in environmental justice and climate justice organizations and social movements. Challenging the underlying universalism, anti-humanism, and cynicism woven into Anthropocene discourse, activists from environmental justice, climate justice, and indigenous organizations do not invoke Anthropocene’s rhetoric of humans as destroyers or masters of nature. Rather, these groups provide examples of “people powered” regenerative politics based on life-enhancing political strategies and proactive organizing in support of a just transition toward renewable energy, local economies, and socially and ecologically sustainable communities.

Dealing with the immense societal challenges of climate change and resource depletion requires no less than a fundamental transformation of the energy system, comprising not only technological change, but also cultures of energy use and consumption, new regulations, and new types of actors operating on the energy market. A growing field of interdisciplinary social science research on “sustainability transitions” deals with the dynamics and governance of such transformative, systemic, and socio-technical change processes toward sustainability. This chapter gives an overview of concepts used to study energy system transitions, their strengths and shortcomings, as well as new advancements. The chapter also discusses a concrete example of socio-technical change in the field of renewable energy—wind power—and reflects on some of the lessons that can be drawn from this about the interdependence of energy and society and for an understanding of transitions toward a more sustainable energy system.

Abstract:

The chapter provides insights into the different characteristics and manifestations of energy poverty—a condition that prevents the achievement of socially and materially necessary levels of domestic energy services. On the one hand, the discourse on energy poverty in developed countries (known as “fuel poverty”) is discussed (especially in the European Union), focusing on different forms of definitions and measurement, coping strategies, and attempts to combat the problem. On the other hand, the discourse on energy poverty in developing countries is outlined, highlighting especially rural electrification processes and gender relations. It is shown that energy poverty is deeply embedded in wider social, economic, political, and cultural structures, reflecting inequalities both within and across nations. Therefore, the chapter concludes that measures and interventions to tackle energy poverty must take into account wider societal structures and power relations in order to achieve a just and sustainable energy system and society.

‘Smart infrastructure’, such as smart meters, are innovative, information-based energy technologies designed to promote systemic energy efficiency, cost savings, and to transition energy markets toward sustainable outcomes, including reducing climate change impacts. Smart meters promise innovation in electricity markets–as an enabler of demand-side services and a more distributed energy system. The chapter examines three case studies of legal reform for smart meter introduction in Australia and Germany. It concludes that the realization of the innovation promise of smart infrastructure requires the legal system to address consumer-oriented social and economic changes. While legal responses are growing in sophistication, significant questions around consumer protection remain, although Germany emphasizes consumer privacy more than Australian case studies. Finally, Germany most closely links innovation to climate change and electricity system transitions, whereas, increasingly, Australian policies emphasize the consumer benefits and innovation in the business models for electricity distribution.

Humankind is facing the reality of climate change and energy and resource transitions that could pose a major existential threat. Our future technological development must respond to these challenges. Artificial intelligence and robotics are making tremendous progress. However, in terms of power, energy, and materials consumptions the gap between these technologies and a living being is huge and non-sustainable in the long term. This chapter argues for a radical biomimetic, or Living Machines, approach to the development of next generation technologies; radical meaning including the type of chemistry and ecological processes found in living systems. This radical approach necessitates re-inventing our computational technologies in terms of materials, architectures, and processes, linking these processes within new technological ecosystems, and learning from the self-regulating ecological cycles of birth, growth, death, and re-use found in the natural world.
