The COVID-19 pandemic poses new challenges for the European Union (EU). It is not a repetition of previous crises of European integration. The expectations, but also the confidence of the EU citizens are higher. Divergences between Member States tend to be greater, social inequalities are more complex and the pressure from outside more hostile. At the same time, the EU has gained more experience with crises over the past decade than before, reacts to the current crisis more quickly as well as more supranationally, and - unlike in earlier crises - so far appears globally not as a “sick man”, but as a crisis solver.

De nordiske og de baltiske stater i Europa i dagAf Hans HenningsenDenne artikel fremstiller Grundtvigs tanker om folk og folkelighed i forbindelse med den supranationale unionstankes sammenbrud i øst og etableringen af en supranational union i vest. De nye baltiske statsdannelser benyttes som eksempler på nationalstater, hvor befolkningen synes at kunne leve i fred med store, ikke-baltiske minoriteter uden etniske konflikter. Grundtvigs tanker om folkelighed anskues i forlængelse heraf som grundlag for en forståelse af nationalstaten som et alternativ til den tanke om en union i form af et supranationalt demokrati, der præger de europæiske unionsplaner. Begrebet nationalstat opfattes her ikke nationalistisk, men tolkes i overensstemmelse med Grundtvigs tanker om det folkelige som lig med den demokratisk-folkelige kultur. Disse planer sigter mod at lade en mængde folkeslag indgå. i en fælles europæisk stat, idet begrebet om en demokratisk stat løsnes fra forbundetheden med begrebet om nationalstaten. Artiklen fremlægger en alternativ model hertil, idet det påpeges, at der i Danmark i forlængelse af Grundtvigs tanker ikke skelnes mellem kultur og politik. Forudsætningen for et virkeligt demokrati er denne forbindelse mellem folkelivet og det politiske liv, og eftersom der ikke eksisterer en fælles, europæisk kultur, vil et supranationalt demokrati aldrig blive et sandt demokrati.Tilliden til det supranationale demokrati bunder dybest set i rationalismens abstrakte menneskesyn, det menneskesyn, Grundtvig bekæmpede. Grundtvigs definition af 'folk', 'folkelighed' samt 'levende vekselvirkning' er ikke blot grundlag for denne forbindelse mellem kultur og demokrati, men sikrer også I overensstemmelse med Grundtvigs universalhistoriske perspektiv, at der tages hensyn til de forskellige folkeslags individuelle særpræg. Netop forskellene er basis for en fri samvirken og vekselvirkning mellem folkeslagene, således som det har været målet for dansk indenrigs- og udenrigspolitik de sidste 100 år. Europa har i dag mulighed for at etablere et sådant frit fællesskab, men i stedet vælger unionstilhængene at se bort fra de nationale forskelle og opbygge et supranational demokrati med udgangspunkt i rationalismens abstrakte menneskesyn.

Abstract:
Suprastatehood and supranationality is a legal quality of an international organization that allows it, following the procedure approved by the member states, to make binding decisions, including without the direct consent of an individual state. In modern international law, the role of suprastatehood and supranationality has changed. Therefore, taking into account the dynamics of development and the rapidity of change, it is necessary to analyze the place of suprastatehood and supranationality in the prism of modern international law. The purpose of the work is to examine the peculiarities of the influence of supranational institutions on international relations and international law. The methodological basis of this study is such methods as a method of formal-logical analysis, historical method, comparative method, and functional method. As a result of the conducted research, the peculiarities of the manifestation of suprastatehood and supranationality in the prism of modern international law were analyzed. Definitions of the terms "suprastatehood", "supranationality", "supranational Union" are provided. The peculiarities of the contractual regulation of relations between states and the impact of such regulation on the international legal order and international law are remarked on. It is finalized that the presence of supranational and supranational institutions is a characteristic feature of modern international relations.

The strategic security environment is characterized by high dynamism and growing unpredictability, and it is obvious that every member of society needs to be able to understand strategic problems, both individually and supranationally, and to be able to make informed strategic decisions that will ensure the achievement of certain education goal – the transfer of knowledge between adolescents and older generations. The relevance of the study is in connection with the successful achievement of the objectives of individual and collective military training, and specifically the training in Strategic Management, as well as in connection with the successful acquisition of the officer’s profession. The subject of research is the relationship education-pedagogical mastery-strategic management, while the object is a part of the methodological pedagogical approach implemented in the Strategic Management academic subject on the example of the National Military University of Bulgaria. Introduction. This paper examines the problem of formation and activity of the supranational authority of international organizations. It is noted that the need for such a study is due to the strengthening of European integration and the desire of the European Union (EU) leadership to unite member states to ensure stability in the European region. In such conditions, member states have a desire to preserve their sovereign identity and make maximum use of global mechanisms to achieve their goals and further development, without transferring authority to the supranational level. The purpose of the paper is the analysis of supranationality as an important characteristic of the legal nature of the EU, the determination of its main features through the analysis of the functioning of the institutional system of unification, the division of competences between the EU and the member states, and the disclosure of the principles on which the EU legal system is built. Results. The paper is devoted to supranationality as an important characteristic of the law of the European Union. It emphasizes the uniqueness of EU law, the norms of which regulate social relations related to the development of integration processes within the EU. The importance of the issue of supranationality of EU law and the need for its further research have been proven. Various views on the concept of supranationality are described and its consideration through the prism of features is proposed. The implementation of supranational characteristics of EU law through the activities of EU institutions is pointed out. Attention is focused on the principle of the rule of law and its role in ensuring unity and stability in the EU legal system, the reliability of legal decisions made. In addition, it is proposed to consider supranationality through the division of competences into three types: exclusive, joint and auxiliary. The authors determined where exactly nationality is manifested the most. It has been proven that the direct effect of norms plays an important role in ensuring nationality. It is noted that this principle establishes the most beneficial interaction of the national law of the member states with supranational law for the achievement of EU goals. Conclusion. The paper states that the delegation of powers to supranational bodies of the Union does not threaten the state sovereignty of the participating countries, and the elements of supranationality are aimed at achieving the goals of the EU. The decision to increase or decrease the degree of supranationality is decided only by the member states themselves, depending on whether further development of European integration is necessary. Therefore, supranationality in the EU has a contractual basis and can be considered as one of the ways of cooperation of sovereign states in the integration process.

Abstract:
The German Constitutional Court’s climate verdict provided a re-interpretation of core liberal-democratic concepts, and it is highly relevant for liberal constitutional law in general, including EU and international law—where similar issues are currently being discussed in ongoing trials before the European Court of Human Rights and the International Court of Justice. The present article applies a legal interpretation to analyse the national and transnational implications of the ruling. The results show that the verdict accepts human rights as intertemporal and globally applicable. It applies the precautionary principle to these rights and frees them from the misleading causality debate. However, the court failed to address the most important violations of human rights, it categorised climate policy as a greater threat to freedom than climate change, and the court failed to acknowledge that the Paris 1.5-degree limit implies a radically smaller carbon budget. Furthermore, little attention has so far been paid to the fact that the ruling implies an obligation for greater EU climate protection, especially since most emissions are regulated supranationally. Against this backdrop, the EU emissions trading system demands a reform, which has to go well beyond the existing EU proposals so as to enable societal transformations towards sustainability.

In the most recent decade, the European Union has shown itself to be less robust than globalists imagined. Globalists believed that supranationality was weatherproof – that it would always outperform national alternatives and would survive adversity. Economic stagnation and Brexit belied these expectations. This essay investigates one aspect of the EU’s supranational plight: incompatible goals and the difficulty of mutual accommodation, especially during hard times. EU supranationalists contend that the shared dreams assure harmonious results, but experience reveals that supranational government is shakier than advocates claim because shared ideals and benefits have not been enough for members to put aside conflicting national interests. These rivalries do not doom the European Union’s globalizing project, but they do expose the vulnerabilities of its premises. Supranational union is proving to be unsatisfactory to both many centralizers demanding “more Europe” and decentralizers insisting on “less Europe”. EU leaders are aware of the problem but are wedded to a one-track, two-speed supranational approach that is destined to fail. A dual-track supranational solution analogous to China’s “one country, two systems” offers a better alternative.

Abstract: At first glance, many jurists often perceive their own (Private) law to be somewhat hermetic in nature. Their law exists in its own self-contained cosmos, independent from others in the legal universe, yet its atmosphere is sometimes breached by the 'meteorites' of international and European law. The reasons for this perception are clear: it is often difficult to ascertain in ones own legal system the influences from foreign (or supranational) law and from foreign legal cultures. This is impeded further by most universities failing to approach this topic, except briefly in the context of international and European law. The following therefore shall attempt to at least attenuate this deficit by providing a 'birds-eye view' of German law. In doing so, not only shall the clear marks left in each legal area by foreign and supranational law be shown, but also how they continue to considerably impact upon the German legal landscape and legal culture. Résumé: De nombreux juristes perçoivent souvent à première vue leur propre droit (privé) comme étant de nature assez hermétique. Leur droit existe dans un propre cosmos fermé, indépendant des autres dans l'univers juridique, alors que les «météorites» du droit international et européen ouvrent des brèches dans l'atmosphère. Les raisons de cette perception sont claires: il est souvent diffi cile de constater dans son propre système légal les infl uences du droit étranger (ou supranational) et les cultures juridiques étrangères. Ce phénomène est encore renforcé par la plupart des universités qui ne traitent pas ce sujet, ou brièvement dans le contexte du droit international et européen. C'est pourquoi le présent article s'efforce- t-il d'atténuer à tout le moins ce manquement en fournissant un aperçu «à vol d'oiseau» du droit allemand. Ainsi, on montrera non seulement les traces évidentes laissées par le droit étranger et supranational dans chaque aire juridique, mais on verra aussi comment ils continuent à infl uencer considérablement la culture et le paysage juridiques allemands. Zusammenfassung: Auf den ersten Blick erscheint vielen Juristen das eigene (Privat-) Recht oftmals als ein hermetisch geschlossener Kosmos, der - abgesehen von einigen wenigen oftmals als störend wahrgenommenen 'Meteoriten' aus dem Bereich des internationalen und europäischen Rechts - autark von anderen Universen existiert. Die Gründe liegen auf der Hand: dem eigenen Recht sind die Einfl üsse ausländischen (oder supranationalen) Rechts und der ausländischen Rechtskulturen regelmäßig nur schwer anzusehen und sie werden an den meisten Universitäten (mit Ausnahme eines oftmals kurzen Blicks auf die 'Meteoriten' internationaler bzw. europäischer Herkunft) auch nicht vermittelt. Der nachfolgende Beitrag versucht diesen Missstand zumindest abzumildern, indem 'aus der Vogelperspektive' für das deutsche Recht aufgezeigt werden soll, wie deutlich ausländisches und supranationales Recht in allen Bereichen ihren Spuren hinterlassen haben und auch weiterhin die deutsche Rechtslandschaft und Rechtskultur maßgeblich mitprägen.

La qualification de l’Union Européenne d’entité juridique supranationale fonctionnelle, nécessite l’application d’une méthodologie fondée sur deux idées principales: la première idée est celle de la supranationalité européenne; caractéristique qui met l’intégration européenne actuelle dans une phase supérieure des formes de la coopération internationale sans pour autant aboutir à l’intégration totale et la fusion complète, telle que cette forme est représentait par l’Etat fédéral, ceci nous oblige à comparer cette entité aux principales personnes internationales tels que l’Etat fédéral et les organisations internationales. La deuxième idée de notre recherche est la notion de la fonctionnalité et son application dans le cadre de la l’Union Européenne , cette idée sera rapprochée selon les théories de l’intégration européenne, tout en privilégiant la théorie néo fonctionnelle qui selon nous est la plus pertinente dans l’explication du processus d’intégration européen, après nous traitons les aspects d’application de cette idée dans le cadre de l’Union et ses différentes formes dans les fonctions et attributions qui lui sont reconnues. This study analyses the qualification of the European Union as a supranational and functional entity. In order to prove the validity of this hypothesis, I applied a methodology founded on two principal ideas: the first idea is that of the European supranationality which characteristically puts current European integration in a position that is superior to other forms of international cooperation without actually achieving total integration and complete fusion, such as this form is represented by the federal State. This requires us to compare this entity to primary international players such as the federal State and international organizations. The second idea of our research is the notion of functionality and its application in the framework of the European Union. This idea will be approached according to theories of European integration, privileging the neo-functional theory, which is, in our opinion, the most relevant in explaining the process of European integration. Afterwards, we consider the factors to applying this idea to the Union framework and its different forms within the functions and allocations that are recognized by it. We also look at the principles and concepts that preside over the Union’s functions, giving it a specificity and originality

Abstract:
This dissertation examines International Commercial Arbitration as it appears to have reached a turning point. Through the lens of institutional entrepreneurship opportunity and institutional change theory, the dissertation seeks to determine whether transforming arbitration from an unregulated process to a regulated system would enhance the practice. This question is vital at the present time as arbitration is blemished by increasing cost and time of arbitration proceedings, intervention by national courts in the arbitral process, diminishing party autonomy, and loss of privacy and confidentiality of the proceedings as shown by data from surveys conducted in the last decade or so, and also due to the potential threat posed by the growth of mediation and also litigation in specialist commercial courts. Commentary frequently highlights these issues, but many commentators seldom propose solutions because practitioners benefit from the institution's current chaotic arrangements where they could increase their fees and extend the proceedings for their financial gain. The dissertation shows that international commercial arbitration is a semi-institutionalised institution and would probably benefit from introduction of the regulative institutional pillar to make it fully institutionalised. An appeal procedure, a mechanism to make the process cost-effective, expeditious, and to reduce intervention by national courts in arbitration proceedings so that arbitrants can maintain privacy and confidentiality of their disputes appears desirable. It recommends establishment of a single supranational regulatory organisation called the 'International Centre for Arbitration of Commercial Disputes' (ICACD) to function as a bureaucratic structure in order to respond to the changing needs of the community and to enhance the institution's status and its functionality, such as to establish the 'International Arbitration Awards Review Council' (IAARC).

Si le droit international constitue, aux termes de la constitution et depuis 1946, une source du droit interne bénéficiant en partie d'une autorité supra-législative, le conseil d'état a traditionnellement témoigné d'une grande prudence pour en tirer les conséquences de droit dans le cadre de son contrôle juridictionnel. Compte tenu de l'immuabilité du statut juridique de cette source en droit interne, on s'est interrogé sur les raisons pour lesquelles le conseil d'état s'est, à partir de la fin des années 1980, engagé dans une véritable révolution jurisprudentielle en vue d'assurer un haut degré d'intégration de la majorité des composantes des sources supranationales en droit interne. La confrontation des fondements juridiques de solutions initialement posées en la matière et de celles qui prévalent aujourd'hui - et qui se substituent parfois aux premiers - ont permis d'apprécier la portée de ce phénomène et de comprendre que celui-ci procède essentiellement de considérations extra-juridiques liées a la situation institutionnelle particulière du conseil d'état au niveau
Notwithstanding that since 1946 international law is, according to the constitution, a source of domestic law prevailing to some extent over statues, the concil of state has shown some reluctance to implement this principle. Given the immutability of the legal status of this source of law within the domestic law the question arose concerning the reasons why, since the end of the years 80, the concil of state started to reverse its case law in order to incorporate the greater part of international sources in the domestic law. The confrontation between the legal grounds of the former solutions and of the present ones - which replace often the previous solutions - allows to appreciate the range of this revolution and to anderstand it ; concerning this last point, it appears that it is essentially based upon extra legal considerations due to the peculiar institutional situation of the concil of state at the national level and to its relationship with european courts

Le droit des étrangers est en plein essor sous l'influence des normes supranationales (traités, conventions, droit de la CEDH, etc. ) et notamment du droit communautaire (directives et règlements communautaires). Cette étude porte sur l'influence de ces normes qui participent directement ou indirectement à la mutation du statut interne de l'étranger. On assiste à l'émergence d'un régime migratoire supranational. La Convention de Genève, les accords bilatéraux mais surtout la politique communautaire de l'asile et d'immigration font émerger un véritable statut supranational pour l'étranger. Cette recherche permet notamment de mesurer le degré de communautarisation du statut interne de l'étranger ordinaire mais aussi celui du demandeur d'asile. L'entrée, le séjour et la sortie de l'étranger et du demandeur d'asile sont régis par ces nouvelles normes. Parallèlement à ce phénomène de communautarisation, le droit interne connaît une montée en puissance des droits internationaux des droits de l'Homme. De ces différentes normes et jurisprudences internationales, se dégage un ensemble de droits et libertés protecteurs pour l'étranger. Ces garanties supranationales viennent donc compléter le statut interne de l'étranger. Ces différentes garanties n'ont pas le même effet sur le statut de l'étranger. Si certaines assurent une fonction de " correction " dans le statut interne, c'est à dire qu'elles améliorent le statut interne en accentuant une protection déjà existante dans le statut de l'étranger, d'autres, au contraire, ont une fonction " innovante " puisqu'elles apportent des garanties jusqu'ici inédites dans le statut interne de l'étranger
The rights of foreigners are booming under the influence of supranational norms (treaties, conventions, human rights law within the European community. . . ) and more particulary European directive and community Law. This study has for subject the direct or indirect influence of these norms on the changes in the internal statutes of foreigners. We are witnessing the emergence of a supranational migratory regim regarding foreign migrations. The Geneva Convention, the bilateral agreements but especially the Europeen Community policy regarding the rights of asylum and immigration have brought about a truly supranational status for foreigners. This study essentially allows us to measure the extent of European community law's influence on the internal status of the ordinary foreigner but also that of those asking for asylum. The entry, the stay, and the departure of foreigners and of those asking for asylum are ruled by these new norms. Parallel to this phenomenon of "communitarisation", internal or national law is experiencing a sharp rise in the influence of international rights concerning Human Rights. The European Public Prosecutor's Office, a revolutionary novelty, has raised many issues and questions from the initial moment of the proposal of its creation in 2013 until now. Being a rather controversial topic, both among practitioners and theorists, the European Public Prosecutor's Office presents itself as an "unidentified flying object" among the European or national institutions of the EU Member States regarding the nature of this body, the way it works, the way of influencing the political decision and its competence, the corresponding policy, and the guiding governance, etc. Preventing and combating, investigating, and prosecuting crimes affecting the EU's financial interests is the core task of the European Public Prosecutor's Office. However, as we will see in this paper, the dynamics of globalization and the criminal phenomenon seem to hinder the proper functioning of this new body, the complexity of these crimes and causal links with phenomena such as terrorism, organized crime or trafficking of prohibited substances can influence the European Public Prosecutor's Office`s investigation and prosecution activities. This paper analyzes from an institutionalist perspective the emergence, evolution, and functioning, but especially the future perspective of this newly established body. Conceptually, the added value of the paper will be the political-legal analysis of how the European Public Prosecutor's Office was created, but also how it can actually work in relation to the national authorities and national law systems of the 27 Member States. Last but not least, this analysis wants to position the European Public Prosecutor's Office, together with other European bodies, agencies, and institutions, as a pillar in the European Union's path toward a possible future federalist scenario.

This study overviews how national terms are added to the case-law of the European Court of Human Rights. Contributing to previous literature on the European Court of Human Rights (ECtHR) discourse which focussed on judgments, the study proposes a system of genres approach (Bazerman, 1994), analysing how system-bound elements (SBEs), i.e. those terms and phrases that need to maintain their national embedding, move across multiple procedural genres of the ECtHR (application, case communication, written pleadings, decision and judgment) in four cases against Ukraine, Latvia, Italy and Russia. Against the theoretical-methodological framework of discourse analysis, legal terminology and Legal Translation Studies, the analysis emphasises a critical role of case communications. Case communications recontextualise national elements in a supranational context, translate SBEs, and transform lay representation of applicants into legal discourse. The findings demonstrate how factual reconstruction and SBEs migrate verbatim from case communications into judgments, despite different variants exist in other documents. The study identified some country-specific differences in the rendition of SBEs concerning the use of alphabet and the national caseload. SBEs using Cyrillic tend to omit Cyrillic in judgments. SBEs from high-caseload countries seem to have consolidated versions, both translated (from Ukrainian and Russian) and rendered using translation couplets with loanwords (Italy). SBEs from low-caseload countries (Latvia) are subject to noticeable variation. The study foregrounds the importance of the system of genres approach and problematises decision-making practices concerning SBEs at the supranational level.

In 2021, a massive relocation of cryptocurrency mining farms from China to Kazakhstan caused one of the largest energy crises in Asia and Europe. This work aims at an understanding of the current debate of cryptocurrency mining activities on the environment. The review highlights: 1. The existence of a positive relationship between cryptomining activities and the deterioration of environmental quality; 2. The contribution of renewable energies and blockchain algorithms to mitigate the above effects. The study focuses on exploring cooperation motives and implications arising among stakeholders in these ‘soft’ spaces of interaction. Through informal and semi-formal processes of negotiation employed by several relevant actors, the two case study regions attempt to overcome the clashes between local, national and supranational political and administrative discourses.

Groups affiliated with the meta-brand of AWD are continuing to develop globally and building a transnational, digital networked culture, despite increased scrutiny. This indicates that their structure as a digitally networked, transnational culture provides resilience to traditional policy and law enforcement approaches. Addressing this threat requires insight into the practices that such groups use to interconnect their now multi-nodal, supranational organization.

As one of the founding member states of the European Communities (EC), France has played a major role in the process of European integration since the 1950s. However, French presidents have always treated European integration cautiously, generally supporting forms of supranational integration in areas of socio-economic policy and preferring the intergovernmental mode of governance in areas of defence and foreign policy. In a context marked by the recent weakening of the French influence on European integration (see Assemblée Nationale, 2016), the gradual rise in Euroscepticism since the 2010s (see European Parliament, 2017), as well as the destabilising effect of Brexit (see Zagdoun, 2016), Emmanuel Macron’s 2017 election on an openly pro-European program has foreshadowed the possibility for France to reassert its role as a leading actor in Europe. The aim of this article is to make sense of these events in terms of France’s relationship with the European integration process from its origins to the present day and to understand France’s future role in the evolution of the European Union (EU), while paying particular attention to President Macron’s pro- integrationist influence on the EU.

Short-term rentals mediated by digital platforms have positive and negative impacts that are unevenly distributed among socio-economic groups and places. Detrimental impacts on the housing market and quality of life of long-term residents have been particular contentious in some cities. • In the 12 cities studied in the report (Amsterdam, Barcelona, Berlin, Brussels, Lisbon, London, Madrid, Milan, Paris, Prague, Rome and Vienna), city governments have responded differently to the growth of short-term rentals. • The emerging local regulations of short-term rentals take multiple forms and exhibit various degrees of stringency, ranging from rare cases of laissez-faire to a few cases of partial prohibition or strict quantitative control. Most city governments have sought to find a middle-ground approach that differentiates between the professional rental of whole units and the occasional rental of one’s home/ primary residence. • The regulation of short-term rentals is contentious and highly politicised. Six broad categories of interest groups and non-state actors actively participate in the debates with contrasting positions: advocates of the ‘sharing’ or ‘collaborative’ economy; corporate platforms; professional organisatons of short-term rental operators; new associations of hosts or ‘home-sharers’; the hotel and hospitality industry; and residents’ associations/citizens’ movements. • All city governments face difficulties in implementing and enforcing the regulations, due to a lack of sufficient resources and to the absence of accurate and comprehensive data on individual hosts. That data is held by corporate platforms, which have generally not accepted to release it (with a few exceptions) nor to monitor the content of their listings against local rules. • The relationships between platforms and city governments have oscillated between collaboration and conflict. Effective implementation is impossible without the cooperation of platforms. • In the context of the European Union, the debate has taken a supranational dimension, as two pieces of EU law frame the possibility — and acceptable forms — of regulation of online platforms and of short-term rentals in EU member states: the 2000 E-Commerce Directive and the 2006 Services Directive. • For regulation to be effective, the EU legal framework should be revised to ensure platform account- ability and data disclosure. This would allow city (and other ti ers of) governments to effectively enforce the regulations that they deem appropriate. • Besides, national and regional governments, who often control the legislative framework that defines particular types of short-term rentals, need to give local governments the necessary tools to be able to exercise their ‘right to regulate’ in the name of public interest objectives.

Introduction u cours des deux derniers millénaires, il y a eu plusieurs façons de conserver, transmettre et même créer la connaissance ; la tradition orale, l’écrit manuscrit, l’écrit imprimé et l’écrit numérisé. La tradition orale et le manuscrit ont dominé pendant plus de 1400 ans, et ce, jusqu’à l’apparition du livre imprimé en 1451, résultant de l’invention mécanique de Gutenberg. Il faudra attendre un peu plus de 550 ans, avant que l’invention du support électronique déloge à son tour le livre imprimé, prenant une ampleur sans précédent grâce à la révolution numérique contemporaine, résultat du maillage des technologies de l’informatique, de la robotique et de la science des données. Les premières universités qui sont nées en Occident, au Moyen Âge, ont développé cette tradition orale de la connaissance tout en multipliant l’usage du manuscrit créant ainsi de véritables communautés de maîtres et d’étudiants ; la venue de l’imprimerie permettra la multiplication des universités où l’oral et l’écrit continueront de jouer un rôle déterminant dans la création et la transmission des connaissances même si le « support » a évolué du manuscrit à l’imprimé puis vers le numérique. Au cours de toutes ces années, le modèle de l’université s’est raffiné et perfectionné sur une trajectoire somme toute assez linéaire en élargissant son rôle dans l’éducation à celui-ci de la recherche et de l’innovation, en multipliant les disciplines offertes et les clientèles desservies. L’université de chaque ville universitaire est devenue une institution florissante et indispensable à son rayonnement international, à un point tel que l’on mesure souvent sa contribution par la taille de sa clientèle étudiante, l’empreinte de ses campus, la grandeur de ses bibliothèques spécialisées ; c’est toutefois la renommée de ses chercheurs qui consacre la réputation de chaque université au cours de cette longue trajectoire pendant laquelle a pu s’établir la liberté universitaire. « Les libertés universitaires empruntèrent beaucoup aux libertés ecclésiastiques » : Étudiants et maîtres, qu'ils furent, ou non, hommes d'Église, furent assimilés à des clercs relevant de la seule justice ecclésiastique, réputée plus équitable. Mais ils échappèrent aussi largement à la justice ecclésiastique locale, n'étant justiciables que devant leur propre institution les professeurs et le recteur, chef élu de l’université - ou devant le pape ou ses délégués. Les libertés académiques marquèrent donc l’émergence d'un droit propre, qui ménageait aux maîtres et aux étudiants une place à part dans la société. Ce droit était le même, à travers l'Occident, pour tous ceux qui appartenaient à ces institutions supranationales que furent, par essence, les premières universités. À la fin du Moyen Âge, l'affirmation des États nationaux obligea les libertés académiques à s'inscrire dans ce nouveau cadre politique, comme de simples pratiques dérogatoires au droit commun et toujours sujettes à révision. Vestige vénérable de l’antique indépendance et privilège octroyé par le prince, elles eurent donc désormais un statut ambigu » . La révolution numérique viendra fragiliser ce statut. En effet, la révolution numérique vient bouleverser cette longue trajectoire linéaire de l’université en lui enlevant son quasi monopole dans la conservation et le partage du savoir parce qu’elle rend plus facile et somme toute, moins coûteux l’accès à l’information, au savoir et aux données. Le numérique est révolutionnaire comme l’était l’imprimé et son influence sur l’université, sera tout aussi considérable, car cette révolution impacte radicalement tous les secteurs de l’économie en accélérant la robotisation et la numérisation des processus de création, de fabrication et de distribution des biens et des services. Ces innovations utilisent la radio-identification (RFID) qui permet de mémoriser et de récupérer à distance des données sur les objets et l’Internet des objets qui permet aux objets d’être reliés automatiquement à des réseaux de communications .Ces innovations s’entrecroisent aux technologies de la réalité virtuelle, à celles des algorithmiques intelligentes et de l’intelligence artificielle et viennent littéralement inonder de données les institutions et les organisations qui doivent alors les analyser, les gérer et les protéger. Le monde numérique est né et avec lui, a surgi toute une série de compétences radicalement nouvelles que les étudiants, les enseignants et les chercheurs de nos universités doivent rapidement maîtriser pour évoluer dans ce Nouveau Monde, y travailler et contribuer à la rendre plus humain et plus équitable. En effet, tous les secteurs de l’activité commerciale, économique, culturelle ou sociale exigent déjà clairement des connaissances et des compétences numériques et technologiques de tous les participants au marché du travail. Dans cette nouvelle logique industrielle du monde numérique, les gagnants sont déjà bien identifiés. Ce sont les fameux GAFAM (Google, Apple, Facebook, Amazon et Microsoft) suivis de près par les NATU (Netflix, Airbnb, Tesla et Uber) et par les géants chinois du numérique, les BATX (Baidu, Alibaba, Tenant et Xiaomi). Ces géants sont alimentés par les recherches, les innovations et les applications mobiles (APPs) créées par les partenaires de leurs écosystèmes regroupant, sur différents campus d’entreprises, plusieurs des cerveaux qui sont au cœur de cette révolution numérique. L’université voit donc remise en question sa capacité traditionnelle d’attirer, de retenir et de promouvoir les artisans du monde de demain. Son aptitude à former des esprits critiques et à contribuer à la transmission des valeurs universelles est également ébranlée par ce tsunami de changements. Il faut cependant reconnaître que les facultés de médecine, d’ingénierie et de sciences naturelles aux États-Unis qui ont développé des contacts étroits, abondants et suivis avec les hôpitaux, les grandes entreprises et l’administration publique et cela dès la fin du 19e siècle ont été plus en mesure que bien d’autres, de recruter et retenir les gens de talent. Elle ont énormément contribué à faire avancer les connaissances scientifiques et la scolarisation en sciences appliquées ..La concentration inouïe des Prix Nobel scientifiques aux États-Unis est à cet égard très convaincante . La révolution numérique contemporaine survient également au moment même où de grands bouleversements frappent la planète : l’urgence climatique, le vieillissement des populations, la « déglobalisation », les déplacements des populations, les guerres, les pandémies, la crise des inégalités, de l’éthique et des démocraties. Ces bouleversements interpellent les universitaires et c’est pourquoi leur communauté doit adopter une raison d’être et ainsi renouveler leur mission afin des mieux répondre à ces enjeux de la civilisation. Cette communauté doit non seulement se doter d’une vision et des modes de fonctionnement adaptés aux nouvelles réalités liées aux technologies numériques, mais elle doit aussi tenir compte de ces grands bouleversements. Tout ceci l’oblige à s’intégrer à des écosystèmes où les connaissances sont partagées et où de nouvelles compétences doivent être rapidement acquises. Le but de ce texte est de mieux cerner l’ampleur du défi que pose le monde numérique au milieu universitaire et de proposer quelques idées pouvant alimenter la réflexion des universitaires dans cette démarche d’adaptation au monde numérique. Or, ma conviction la plus profonde c’est que la révolution numérique aura des impacts sur nos sociétés et notre civilisation aussi grands que ceux provoqués par la découverte de l’imprimerie et son industrialisation au 15e siècle. C’est pourquoi la première section de ce document est consacrée à un rappel historique de la révolution de l’imprimerie par Gutenberg alors que la deuxième section illustrera comment les caractéristiques de la révolution numérique viennent soutenir cette conviction si profonde. Une troisième section fournira plus de détails sur le défi d’adaptation que le monde numérique pose aux universités alors que la quatrième section évoquera les contours du changement de paradigme que cette adaptation va imposer. La cinquième section servira à illustrer un scénario de rêves qui permettra de mieux illustrer l’ampleur de la gestion du changement qui guette les universitaires. La conclusion permettra de revenir sur quelques concepts et principes clefs pour guider la démarche vers l’action. L’université ne peut plus « être en haut et seule », elle doit être « au centre et avec » des écosystèmes de partenariats multiples, dans un modèle hybride physique/virtuel. C’est ainsi qu’elle pourra conserver son leadership historique de vigie du savoir et des connaissances d’un monde complexe, continuer d’établir l’authenticité des faits et imposer la nécessaire rigueur de la science et de l’objectivité.
