Abstract:
This chapter provides an overview of Indonesia’s courts and their operation, except for the Constitutional Court, which is covered in Chapter 5. It begins with a general discussion of key aspects of judicial decision-making, including Indonesia’s version of the system of precedent (yurisprudensi) and principles of statutory interpretation, before examining post-Soeharto judicial reform, the success of which has been mixed, at best. The chapter then covers the relative jurisdictions of the various courts that sit below the Supreme Court in the judiciary hierarchy—the district, administrative, religious, human rights, and military courts—before considering appeals courts and their processes. This chapter also discusses the Supreme Court and its functions, including cassation, ‘PK’ reconsideration (a form of final appeal), judicial review, and supervision of other courts. The chapter concludes by discussing the difficulties of enforcing the decisions of Indonesia’s courts, and some of the problems presented by widespread judicial corruption.

This chapter examines how far civil courts are bound by MiFID I/MiFID II under European law, within the following topics: whether civil courts and contracting parties may be less strict or stricter than MiFID I/MiFID II, whether MiFID I/MiFID II has any influence on the principle of ‘relativity’ or ‘proximity’, proof of causation, or a contractual limitation or exclusion of liability in the Member States; and whether the civil courts are obliged to determine if MiFID I/MiFID II rules have been infringed in disputes between investment firms and private investors. The chapter concludes that MiFID II and MiFID I are unclear, and, as the EU Court of Justice has not yet explicitly answered the main questions, it will be necessary to await the further judgments.

Abstract:
This book discusses how justice was administrated and applied in medieval Egypt. The model that evolved during the early middle ages involved four judicial institutions: the cadi, the court of complaints (mazalim), the police (shurta), responsible for criminal justice, and the Islamised market law (hisba), administrated by the market supervisor (the muhtasib). Literary and non-literary sources are used to highlight how these institutions worked in real-time situations such as the famine of 1024-1025, which posed tremendous challenges to both the market supervisor and the ruling establishment. The inner workings of the court of complaint during the Fatimid period (10th-12th century) are also extensively discussed. The discussion is extended to include the way the courts of non-Muslim communities were perceived and functioned during the Fatimid period. The discussion also provides insights into the scope of non-Muslim self-rule/judicial autonomy in medieval Islam.

Abstract:
This chapter examines efforts to remedy the problems with farm placements. It looks at the state boards of charity, visiting agents, and courts as examples of methods used to improve placing out. As the state boards worked to legitimize their expertise and county officials tried to improve the care given to dependent children, work remained to standardize care and encourage placements. State boards recommended a second initiative in addition to better oversight of institutional care to secure more placement homes and supervision for children: hiring state visiting agents to supervise placed-out children. This chapter explores how the two-pronged issue of mistreatment of children in placement homes and the resulting efforts to increase supervision ultimately forced placers and visitors to make a number of proposals, including a return of direct aid and more involvement by the courts. It also considers the rise in paid foster care and how it affected all facets of dependent child care.

This chapter comments on Article 43 of the Rome Statute of the International Criminal Court. Article 43 sets out the functions and responsibilities of the Registry, one of the four organs of the International Criminal Court listed in article 34. It is a neutral body, charged with judicial and administrative support functions for all organs of the Court. In terms of budget and size, it is the largest. With the Registrar at its head and under the supervision of the Presidency, the Registry ensures the non-judicial aspects of the administration and the servicing of the Court. These include responsibilities with regard to the defence, victims and witnesses, outreach, and detention.

This chapter comments on Article 103 of the Rome Statute of the International Criminal Court. Article 103 deals with State enforcement of sentences. The enforcement regime of the International Criminal Court is premised on three broad principles: sentences are served in the prison facilities of States and are subject to their laws; enforcement of the sentence is subject to the supervision of the Court; and the sentence imposed by the Court is binding upon the State of enforcement. The provisions of the Statute governing enforcement are quite succinct, and much of the detail on the issue appears in the Rules of Procedure and Evidence.
