Abstract:
The subject constructed by and for labour law---the "worker"---is bodiless, sexless, genderless, and male. This thesis investigates how and why this construction occurs both through a discussion of general theoretical issues surrounding the way law constructs its subjects, and through a specific case study. The case study considers a set of sexual harassment cases decided in the "mainstream" unfair dismissal jurisdiction. As a site of women's overt presence in the labour market, these cases are disruptive to settled constructions of "the worker", particularly because they connect the sexuality of women (and their gender) to their status as worker. In so doing, they suggest the possibility of a "womanworker"---a woman who is simultaneously woman and worker. The thesis concludes by exploring the consequences of this possibility and asks how the recognition of women's experiences, needs and specificities can allow the subject of labour law to be reconstructed.

Abstract:
The thesis examines challenges museum curators face when outsourced performers – whose role it is to embody the work of other artists – are included in exhibition projects. The research questions are: What are the practical, juridical and ethical challenges that come with situating outsourced performance labour in the museum setting? What does the inclusion of live performance in exhibition projects mean for the role of the museum curator? Two exhibition cases in Stockholm are studied in the thesis: Marina Abramović – The Cleaner (2017) at Moderna Museet and Dora García, I Always Tell the Truth at Bonniers Konsthall (2018–19). The material consists of digital surveys that were sent out to employed performers from each exhibition case as well as interviews that were conducted with both performers and curatorial staff. The material was examined using theories on affective labour and the theoretical notion of de-skilling and re-skilling of acquired competences.  The thesis shows that the practical challenges include the architectural conditions of museum buildings, insufficient prior knowledge on what working with performers entail, short project timespans and limited exhibition budgets. The juridical challenges include a lack of union recommendations for performance in museums and the difficulty of situating reperformances of historical works that in its form and duration may go against national labour regulations. The ethical challenges include commodification of performers’ subjectivity through instances of affective labour and mechanisms of objectification. In turn, both the outsourced performer and the museum curator turned performance curator inhabits a precarious working situation. The role of the performance curator is highly administrational and organisationally tedious in its positioning between curatorship, performing arts production and human resource management. Additionally, it entails a prodigious amount of affective labour in the reproductive mode – of emotional investments, conflict resolution and social liaison.

The dissertation is devoted to the systematic and detailed analysis of the legal essence, content and features of the status of the head of a higher education institution as a subject of labor law, as well as actual problems of practical nature and the search for solutions to them. In the scientific work the legal characterization of the activity of the head of a higher education institution as a form of realization of labor rights for the fulfillment of official duties, as well as a specific kind of labor activity was carried out. Defined the notion and essential features of the labor-legal status of the head of a higher education institution, in particular, the nature of the legal relationships that the composition is established between the head of a higher education institution (as an employee) and the founder of a higher education institution (as an employer). Features of the emergence and termination of labor relations with the head of the higher education institution are highlighted, and the gaps and conflicts in the normative and legal regulation of labor relations with the head of higher education institution are identified. Specific suggestions and recommendations for improving the legal regulation of the status of the head of a higher education institution as a subject of labor law have been formed.

Abstract:
Anomalies noticed in midwifery practice prompted a review of literature around progress in labour after Loop Excision of the Transformation Zone (LETZ). The previous research was equivocal. This study investigates the pattern and progress of women's labours following LETZ, and the effect of the experience on women. It also explores the basis of clinical decisions made by midwives. It takes place in North East England and involves women giving birth in 2004-2005. The case study strategy brings together quantitative retrospective case control results, qualitative analysis of semi-structured interviews from women and midwives, and guidelines and protocols surrounding assessment and management of labour. The quantitative data is from 111 women after LETZ and 214 controls, reducing to 94 and 150 respectively after removal of cases with confounding variables. Interviews are from four women, three individual midwives caring for one of the women and a focus group of four midwives. In the interviews, women gave no thought to how their births may be affected by LETZ, as no one had discussed the possibility with them. Women having their second baby after LETZ take less time to reach full dilatation; a result related to grade of Cervical Intraepithelial Neoplasia. Women having their first baby after LETZ are 1.8 times more likely to be admitted later in their labours, an important emergent issue that needs further research. Women having their first or second baby after LETZ are 2.3 times more likely to have a premature birth, confirming indications in previous research. This study for the first time reveals important differences in pattern and progress of labour after LETZ. It adds to our knowledge of premature birth after LETZ. Midwives, obstetricians and colposcopists need to incorporate the study results into counselling of women before LETZ and during any pregnancy after LETZ.

Abstract:
In response to the reification of social reality caused, according to the first generation of the Frankfurt School, by the instrumental mastery of nature, Adorno, Horkheimer and Marcuse have elaborated a critique of instrumental reason aimed at providing the theoretical tools for a treatment of the social realm as a field of human practice. Concerned with the risks of reproducing the relationship between humanity and nature hindering human emancipation, they have nevertheless sought to limit the task of critical theory to a theoretical form of resistance, thereby divorcing social theory from the practical orientations found in Marx‟s critique of political economy. It was not until the works of second-generation critical theorist Jürgen Habermas, that one could find a renewed attempt to link theory with the objective conditions of existence thought to be required for human emancipation. With these theoretical developments, however, social theory was effectively stripped of its critique of technology, and became primarily concerned with the problem of human emancipation as a matter strictly regarding intersubjective relations. The present work proposes that the formulation of a social critique oriented towards the institutionalisation of emancipatory practice cannot presuppose or apologise for the instrumental mastery of external nature. It shall be argued that in order to achieve such a task, the critique of instrumental reason elaborated by the first generation of Frankfurt School theorists must be complemented and completed with the broad outline of an institutional framework capable of indicating the conditions of existence required for the actualisation of human emancipation as the labour-mediated reconciliation of humanity with both internal and external nature, and for which the works of G.D.H. Cole provide a potential basis for rethinking critical theory and updating libertarian socialism.

This thesis deals with the development of the labor market in the region Plzeň in 2001 - 2011. The purpose is to identify what factors and how much affect employment and unemployment in the labor market in region Plzeň. The author analyzes the time series on population, employment and unemployment in the region Plzeň of the portals CSO, Ministry of Labour and socials affairs. The work contains an estimate of the supply side of the labor market based on demographic projections in context with the impact of pension reform. Research is subjected to the expected development of the demand side of the labor market on which it can be expected changes of the requirements of employers in skills needs. Analytical investigation in this thesis is completed questionnaire to which they are subjected unemployed. Through deduction from the information obtained from these data sources is determined the expected development of the labor market in the region Plzeň, and his problems are not adequately addressed.

Eating disorders are now considered an epidemic among girls and women throughout the United States. This thesis suggests a study in which the acts and processes of anorexia nervosa and bulimia nervosa are positioned as a form of cultural labor undertaken by some Western women in order to embody the myth of the ideal female body. The researcher uses her own lived experience of anorexia and bulimia and her pursuit of embodying femininity in order to raise and guide the major questions concerning femininity and eating disorders in Western culture.

Abstract:
The concept of ‘diversity’ has become a common feature in UK organisations over the last twenty or so years. It offers arguments about what the world is like, who people are, how they relate to one another, and how the world should be. It has been used to bring about a host of different actors, objects and practices. Yet, we know relatively little about one of the central elements of this field – diversity practitioners. They play an important role in defining what diversity means in local contexts, they are the experts of the field. Drawing on Foucault’s theories of power/knowledge and the ‘subject’, along with the notion of bricolage, the research examines the different forms of knowledge that diversity practitioners use to construct themselves as expert subjects, and in turn how they seek to construct a particular subject of others, the ‘diversity trainee’, as the subject who is the outcome of diversity training. The findings show how the subjects of the diversity practitioner and the diversity trainee are shaped by dominant societal discourses of the expert and the neoliberal subject, as well as by the history of equality work and the organisational challenges that diversity practitioners face. But they also show that diversity practitioners are actively involved in forming themselves as subjects by producing subject positions and rationalities, which construct skills, values, and knowledge. Diversity training is shown to mobilise a form of power known as ‘modern government’ in seeking to constitute the diversity trainee as a selfregulating subject, which adds complexity to previous discussions of the ethics of this form of power. Diversity practitioners are central elements of their field, so recognising the relations of power/knowledge in their practices is fundamental to considering any future development of their practices, as well as better understanding the concept of diversity itself.

В докладе проведен анализ периода и амплитуды колебаний величины межоперационных заделов в зависимости от характерных параметров производственных линий. С использованием кинетического уравнения, определяющего плотность распределения предметов труда по состояниям, обоснован механизм возникновения колебаний межоперационных заделов синхронизированной линии. Демонстрируется аналитический метод определения собственных частот колебаний потоковых параметров синхронизированных производственных линий. Получено и численно решено дисперсионное уравнение, определяющее связь частоты колебаний и длины волны колебаний.

Siekiant išvengti socialinių konfliktų ir sudaryti realias socialinės partnerystės principo įgyvendinimo sąlygas, Lietuvos teisės sistemoje įtvirtintas darbo teisinių santykių subjektų atstovavimo institutas. Darbo tikslas yra išnagrinėti atstovavimo darbo teisėje instituto reglamentavimą Lietuvos teisės aktuose. Tačiau pagrindinis uždavinys yra išryškinti tiek darbuotojų, tiek darbdavių atstovavimo reglamentavimo trūkumus, išaiškinti pagrindines praktikoje iškylančias bei galinčias iškilti problemas, nustatyti dėl netobulo šio instituto reglamentavimo esamas spragas bei kolizines normas. Šiame darbe bus nagrinėjami tokie klausimai, kaip asociacijos laisvės principo esmės atskleidimas, be kurio nebūtų atstovavimo teisės, darbo teisės subjektų steigimo pagrindiniai principai bei didžiausias dėmesys skiriamas darbuotojų ir darbdavių atstovavimo problemoms išnagrinėti. Aptariant šiuos klausimus yra analizuojami tiek Lietuvos teisės aktai, tiek Tarptautinės darbo organizacijos konvencijų normos. Taip pat darbe trumpai aptarta darbo subjektų atstovų praktinė padėtis Lietuvoje.
Lithuania Law sistem legitimate the representation institute of Labour Law subjects to avoid social conflicts and to make real conditions to implement social partnership. The purpose of this work is to analyse the legal regulation of institution of representation of Labour Law subjects in Lithuanian national laws. However the main task is to expose shortcomings of legal regulation of the institution of the representation of employers and employees, to ascertain basic practical problems, to reveal breaches and collisions in legal regulation caused by it’s imperfection. In this work author analises a lot of questions with a view to reveal basic problems of this institute in Lithuania, examines the ways in which employee/employer relationships have changed and developed. There is aduced principle of liberty of association, which is the base of representation institute, discussed basic establishment rules of Labour Law subjects. As it was mentioned, the basic part of work describes the main problems of the representation of employee and employer. The writer considers the role of trade unions and how these have declined. There is a short review of real Labour Law subjects status in Lithuania.

Este estudo procura estabelecer uma relação entre discurso e trabalho. Com base na Análise de Discurso francesa, tal como foi elaborada por Michel Pêcheux, busca ressignificar, desde Karl Marx, passando por Louis Althusser e Hannah Arendt o lugar teórico do trabalho no interior de uma teoria materialista dos sentidos. O que é o trabalho? Pergunta feita a vinte e um trabalhadores metalúrgicos da região metropolitana de Porto Alegre que sofreram acidente de trabalho. Os testemunhos narram, para além do acidente, as trajetórias profissionais. Na análise as definições apontam para a afirmação do óbvio. Determinações que rompem a linearidade do discurso, marcas da elipse e incisa, que levam o sentido ao limite da falta e do excesso. Nada é trabalho, tudo é trabalho. Efeitos de sentido designados discurso de labor, que interpelam o sujeito por um funcionamento verborrágico. O sujeito se desdobra como função e goza do alívio de ser meio do meio de funcionamento. O que no social é demanda de reprodução é para o sujeito demanda de consumo. A interpelação é do/no ato de produção. A comada social produz o sujeito como efeito entre o fato vazio, contingente do consumo e a falta objetiva, que o sujeito produz e que deve necessariamente reproduzir. Injunção na história, dispersão do sujeito. Algo escapa, acontece, transborda. O que se repete materialmente deixa marcas na ordem do discurso. A ambiguidade é o modo de acesso à ambivalência entre vida e morte: viver trabalhando para não morrer. Laço metafórico que confronta no sujeito um discurso que o consolida e que o esvazia. Causa de um gesto de realização impossível, o trabalhador se desloca na cadeia metonímica. Repetir, reiterar, reproduzir e resistir. O trabalhador existe entre ser e fazer, ter e estar, viver e trabalhar. No batimento da reprodução a vida resiste, mas não se resolve, permanece ambígua.
This study aims to set a relation between the concepts of discourse and work. Based on the french line of thought of Discourse Analyses, as theorized by Michel Pêcheux, the concept of work is defined based on ideas from Karl Marx, Louis Althusser and Hannah Arendt, as a way to resignify it within a materialist theory of meaning. What is work? This was the question asked to twenty one metal workers from the metropolitan area of Porto Alegre, who had a work accident. Their testimonies go beyond the accident and tell us about their entire professional life. It analyzes points to the obvious. Determinations that break the linearity of discourse, marks of ellipses and incises, all of those taking the meaning to the limit of the lack and the excess. Nothing is work, everything is work. Effects of meaning, designated as labor discourse, which interpellates the subject by a verbose operation. The subject unfolds as a function and as a jouissance of being a work medium. The interpellation comes from the act of production and in itself is present. The social command brings forth the subject as an effect between the empty fact – a consumption contingency – and the objective lack – which the subject himself creates and must reiterate. Injunction in history, dispersion of the subject. Something escapes, happens, overflows. What is materially repeated leaves traces in the discourse. The ambiguity is the door to the ambivalence of life and death: a life of work in order not to die. It is a metaphorical bond that sets at the subject a discourse that both consolidates and empties him. As a cause of a gesture of impossible realization, the worker moves himself in the metonymic chain. Repeat, reiterate, reproduce and resist. The worker exits between being and doing, having and being, living and working. At the beat of the reproduction, life resists, but does not answer itself: remains ambiguous.

Šiame darbe yra analizuojami darbo teisiniai santykiai ir teisės normos reguliuojančios diskriminacijos dėl lyties draudimą sudarant ar nutraukiant darbo santykius. Siekiant kuo išsamiau atskleisti šią temą pirmiausiai yra nagrinėjamas lygybės principas, iš kurio yra kildinamas diskriminacijos draudimo (nediskriminacinis) principas, kuris yra įtvirtintas tiek Lietuvos, tiek tarptautiniuose teisės aktuose. Lygybės ir diskriminacijos draudimo principais draudžiama taikyti skirtingus įdarbinimo kriterijus, skirtingas darbo sąlygas, atleidimo iš darbo pagrindus, tokius pat santykius vertinti skirtingai dėl aplinkybių, kurios nesusijusios su darbuotojo dalykinėmis savybėmis. Diskriminacija darbo teisinių santykių srityje yra suprantama kaip bet koks lygias darbo ir profesinės veiklos galimybes ir lygiateisius santykius pažeidžiantis arba panaikinantis išskyrimas, apribojimas ar pranašumo teikimas. Kitaip tariant, bet koks skirtingas darbuotojų traktavimas dėl jų lyties, kurio pasekmės – nelygios teisės darbo santykiuose, pvz. : tam tikros darbo sąlygos, paaukštinimas pareigose, kvalifikacijos kėlimas yra laikomas diskriminacija. This paper analyzes the legal labour relations and the laws, regulating the prohibition of gender discrimination in establishing or terminating the labour relations. In order to reveal this theme in as more details as possible, first the principle of equality is examined, where the prohibition of discrimination (discriminatory) principle is derived from. The latter is established in both Lithuanian and international law. The principles of equality and non-discrimination allows the application of different employment criteria, different working conditions, bases of dismissal from work, to treat the same relations differently due to the circumstances, unrelated with employee’s professional characteristics. Discrimination in the field of legal labour relations is understood as any exclusion, restriction or superiority, violating or voiding the equal employment and career opportunities, and the equal relations. In other words, any different treatment of employees because of their gender, the consequences of which include unequal rights in labour relations, for example, certain working conditions, promotion, training, is considered as discrimination. Labour migration to Sweden is analysed from a labour perspective. As regards theory, the thesis focuses on how class and ethnicity intersect in a capitalistic setting, but it also gives attention to gender and age as structural principles. The main purpose is to analyse migrants in Sweden as a party in the relationship between labour and capital, and to explore how the immigration and the active recruitment of workers in other countries affected and was affected by the relative strengths of the parties on the labour market, covering the period 1945–1952. The relationship between labour and capital, regarding migration-related issues, is analysed from above and below on both national and local level, and the thesis discerns how the state mediated between the parties. It examines the first encounters between foreign-born and native-born workers at shop-floor level, how these encounters affected the relationship between the trade union and the industrial management concerned, and explores how all this, in turn, affected the relationship between the national parties on the Swedish labour market. A structural perspective is combined with micro analyses of narratives from the actors involved, which opens up for a study of the history of society. Firstly, the thesis addresses the relationship between the Swedish Engineering Employers’ Association and the Swedish Metalworkers’ Union, and secondly it is a local workplace study, focusing on Svenska Stålpressnings AB in Olofström (the Swedish Steel Pressing Company). The more precise focus of attention is on war refugees from Estonia employed by the company in Olofström between 1945 and 1947, and on Estonians recruited directly from West German refugee camps in the early 1950s. The study reveals that the Metalworkers’ Union at first opposed labour recruitment abroad – at both national and local level –, but also how coincident interests developed between labour, capital and the state regarding labour immigration. An important finding is that the Metalworkers’ Union had great influence considering which companies would be allowed to recruit foreign-born workers, and that the trade union could direct the migrations to workplaces with acceptable staff policies. A fundamental research problem for the thesis is, furthermore, how social groups construct ethnic boundaries between “us” and “the others”. It is stressed that Estonians’ background experiences and social memories differed from those of the Swedish workers, and that these differences affected the outcomes of the first encounters. But it is also pointed out that the Estonian group was internally divided, with a basis in interwar Estonian political history and in disparate class backgrounds among the Estonians.

Досліджена роль суб’єктних та позасуб’єктних оцінок у процесі діадичної міжсуб’єктної взаємодії. Проаналізовані два підходи до інтерпретації мети та припустимих меж конкуренції. Досліджені особливості суб’єктного оцінювання на ринку кінцевих благ. Розроблена модель ринку кінцевих благ, розділеного на цінові категорії. Розглянуті передумови стійкості цінових категорій. Досліджений механізм впливу продавця на свідомість покупця за рахунок зміни референтної точки та поля вибору. Розглянутий процес розподілу спільно створеного продукту між учасниками виробництва. Проаналізована роль суб’єктних та позасуб’єктних оцінок у розподілі спільно створеного продукту. Досліджений процес інституціоналізації оцінок. Запропонована модель ринку праці, яка включає суб’єктне оцінювання. Аналізуються проблеми відтворювально-ефективного розподілу спільно створеного продукту. Встановлені принципи ефективного комбінування ринкового саморегулювання та державної політики з метою забезпечення сталого розвитку. Проведен анализ отличительных черт рыночной координации. Исследована терминологическая нестрогость содержания категорий “рынок” и “рыночное”. Выявлена возможность исследования рыночной координации на уровне диадического межсубъектного взаимодействия. В диссертации вводится новый методологический принцип индивидуалистического релятивизма, включающий внутренне-компаративное и внешне-компаративное субъектное оценивание. Исследована роль субъектных и внесубъектних оценок в процессе диадического межсубъектного взаимодействия. Проанализированы эгоистический и интегративный подходы к интерпретации целей и допустимых пределов конкуренции. Исследованы особенности субъектного оценивания на рынке конечных благ. Разработана модель рынка конечных благ, разделенного на ценовые категории, включающая субъектные оценки покупателей и продавцов. Рассмотрены предпосылки устойчивости ценовых категорий с учетом различной ценовой эластичности спроса для разных ценовых категорий. Исследован механизм влияния продавца на сознание покупателя за счет изменения точки сравнения и поля выбора. Выявлено, что в условиях среды, контролируемой продавцом, покупатель утрачивает суверенитет при совершении покупок. Рассмотрен процесс распределения совместно созданного продукта между участниками производства. Проанализирована роль субъектных и внесубъектных оценок в распределении совместно созданного продукта. Выявлены угрозы нарушения паритета в отношениях между участниками совместного производственного процесса и появления перераспределительной власти за счёт манипулирования субъектными оценками контрагента. Исследован процесс институционализации оценок, предполагающий игнорирование промежуточных причинно-следственных связей при оценивании предметов или явлений. Предложена модель рынка труда, которая включает субъектное оценивание работником возможных последствий прекращения контракта с работодателем. Выявлены объективные предпосылки смещения экономической власти во взаимодействиях типа “работник – работодатель” в пользу работодателя с последующей гиперэксплуатацией наиболее квалифицированной части рабочей силы. Анализируются проблемы воспроизводственно-эффективного распределения совместно созданного продукта применительно к воспроизводству рабочей силы. Изложена концепция пенсионной реформы, учитывающая участие пенсионера в воспроизводстве будущих поколений и учитывающая специфику субъектного оценивания. Выявлена специфика концентрации политической власти в условиях манипулирования субъектными оценками участников политического процесса. Установлены принципы эффективного комбинирования рыночного саморегулирования и государственной политики с целью обеспечения устойчивого развития. Разработана концептуальная модель реформы регулирования внешнеэкономической деятельности, включающей аукционную продажу квот на вывод иностранной валюты за пределы Украины. Проанализированы возможности этой реформы по регулированию платёжного баланса и предотвращению кризисов, вызванных валютными шоками
The analysis of the characteristic features of market coordination is carried out. A new methodological principle of individualistic relativism is introduced in the paper. The role of subject and out-of-subject estimations in the process of dyadic interaction between subjects is studied. Two approaches to the interpretation of the purpose and permissible levels of competition are distinguished. Peculiarities of subject estimations on the market of final goods are investigated. The model of market divided into price categories is suggested. Preconditions of price categories sustainability are reviewed. The mechanism of sellers’ impact on the minds of customer by changing the reference point and field of selection is investigated. The process of sharing of common product between participants of production is considered. The role of subject and out-of subject estimations in product distribution is examined. The process of estimations’ institutionalization is reviewed. The model of labour market regarding subject estimations is suggested. Problems of reproductive efficiency of common product distribution are analyzed. Principles of effective combining of market self-regulation and public policy to ensure sustainable development are discussed. Conceptual models of pension reform and foreign economic activity regulation reform are worked out.

Šis magistrinis darbas nagrinėja darbo santykių stabilumo principų įgyvendinimą įmonės/verslo ar jų dalių perdavimo atvejais. Lietuvos Respublikos darbo kodekso 138 straipsnis numato tik dalinę darbuotojų apsaugą ir darbo santykių tęstinumą įmonės/verslo ar jų dalių perdavimu atveju, t.y. - perdavimas negali būti teisėta priežastis nutraukti darbo santykius. Perdavimo procesas dažnai neįvyksta ne todėl, kad verslas yra neperspektyvus, o darbdavys nesąžiningas, bet dėl paties proceso sudėtingumo ir su tuo susijusių teisinių bei biurokratinių problemų. Įmonės/verslo ar jų dalių perdavimu, o ypač jo padariniais, yra suinteresuoti ne tik perėmėjas bei perdavėjas, tačiau ir įmonės darbuotojai. Perduodant įmonę/verslą ar jų dalis labiausiai nukenčia darbuotojas - su darbuotojais laiku, o kartais ir visai neatsiskaitoma, žmonės iš darbo atleidžiami nepagrįstai, praranda darbo vietas ir pagrindinį pragyvenimo šaltinį. Neretai darbdaviai, darbuotojams, pavėluotai pateikia arba apskritai nepateikia rašytinės informacijos apie ketinimą vykdyti įmonės/verslo ar jų dalių perdavimą; apie perdavimo dieną, numatomus veiksmus, perdavimo priežastis, etapus bei teisinius, ekonominius ir socialinius padarinius, turinčius įtakos darbuotojui; apie keičiamas sąlygas, tame tarpe, susijusias su darbu, darbo užmokesčiu bei perkvalifikavimu. In the Master Paper, the implementation of the principle of stability of labour relations in cases of transfer of an enterprise/business or parts hereof is discussed upon. The Article 138 of the Labour Code of Republic of Lithuania foresees only a partial protection of the employees and a succession of the labour relations in case of a transfer of the enterprise/business or a part hereof, i.e. a transfer can be considered a lawful reason for terminating the labour relations. A process of transfer often does not take place not for prospectlessness of the business or dishonesty of the employer, but because of a complex character of the process itself as well as the related legal and bureaucratic problems. Not only the assignee and the assignor, but also employees of the enterprise take an interest in a transfer of the enterprise/business or parts hereof, in particular the consequences of such a transfer. In case of a transfer of an enterprise/business or parts hereof, an employee suffers mostly: the settlement with the employees often is made non-timely and sometimes is not made at all, employees are discharged groundlessly, losing their jobs and the key means of their subsistence. Cette thèse s’inscrit dans la démarche de l’Économie du bien-être au sens où elle répond au double enjeu qui guide cette discipline, à savoir faire des mesures de bien-être subjectif des sujets d’analyse en soi et des outils visant à améliorer l’analyse économique. La première partie de cette thèse explore l’interaction existant entre temps de travail au sein des couples et le bien-être subjectif. Le Chapitre 1 démontre qu’être simultanément sur-employés peut avoir un effet positif sur le bien-être des deux membres du couple. Le Chapitre 2 démontre que les femmes travaillant plus que leurs maris subissent des baisses de bien-être. Ce Chapitre présente une posture nouvelle dans la littérature au sens où il prouve que cette baisse de bien-être ne semble pas imputable aux normes de genre mais à l’absence de justice dans la distribution des tâches au sein du ménage. La seconde partie de cette thèse adopte une posture différente au sens où le bien-être subjectif y devient un outil permettant l’évaluation de politiques du marché du travail. Le Chapitre 3 démontre que les réductions du temps de travail implantées en France et au Portugal à la fin des années 1990 ont amélioré en moyenne la satisfaction des travailleurs vis-à-vis de leur emploi et de leur temps de loisir. Le Chapitre 4 évalue l’effet direct et les externalités causés par la hausse de la contribution Delalande en France en 1999. Cette contribution visait à protéger l’emploi des seniors. Ainsi, l’augmentation de cette contribution a augmenté la perception de sécurité des seniors concernés mais ceci s’est fait aux détriments de leurs plus jeunes collègues, qui ont vu leur perception de sécurité de l’emploi diminuer
The present thesis contributes to the literature by exploring how relative working time within households and changes in legal norms on the labour market are linked to subjective wellbeing. Bydoing so, this thesis matches the objectives of the Economics of Wellbeing in that it both considers subjective wellbeing as a subject of study per se and a tool for economic analyses. The first part ofthis thesis examines how relative working time in household affects subjective wellbeing. Chapter 1 demonstrates that being simultaneously overemployed may translate into higher wellbeing of both couple members. Chapter 2 shows that women working more than their husbands are likely to experience wellbeing losses. However, this Chapter is innovative in that it demonstrates that these losses in utility are not caused by violation of gender norms but because of the unfairness of the time allocation within household. The second part of this thesis adopts a different perspective sinceit takes subjective wellbeing as a tool to perform welfare analysis of labor market reforms. Chapter3 estimates the impact of working time reductions implemented in Portugal and France at the end ofthe 1990’s and concludes that workers experienced increases in job and leisure satisfaction. Chapter4 evaluates the impact of the increase in the Delalande tax in 1999. This tax aimed at keeping older workers in the labor force. Then, this Chapter shows that perceived job security of older workers increased thanks to the higher Delalande tax but this has been done at the cost of lower perceived job security of their younger colleagues

This research work focuses on the process of Goiânia metropolization having as object of analysis the rural in the city. The way that Goiânia was projected in the design of "City-Garden" brought from Europe in the early 20th century, by Architect Planner Atilius Corrêa Lima, expresses well the city's relationship with the countryside. Goiânia, a planned city under the aegis of modernity, occupied originally by the territory's agrarian society, the rural tradition of Goias his subjects, culture, way of being and acting of country man from Brazilian Cerrado (?). The design of City-Garden sought rapprochement of the field with city, rural livelihoods and urban to justify the creation of a city full of signs of modernity, advancement and progress that would provide the order of "isolation" of Goiás in relation to urban industrial society of Southeast Brazil. Thus, Goiânia should, at the same time, expressing his strong relationship with the field, but also, paradoxically, denying the rural way of life which is subjecting the inhabitants of Goiás. Rural and urban shall be more than spatial dichotomies to become socioeconomic dichotomies, the place of the "backwardness and stagnation" should be replaced by the place of the "advancement" and of the economic and social progress. This conflict materializes the hegemony of industrial capitalism on the territory of Goias and Goiânia is the hallmark of this hegemony. The symbol of modernity which arrives at the Center-Western Brazil to open the doors to progress. However, the process of metropolization took place quickly and provided a "disconnect" between time, space and subject. With significant structural changes in the rural space that they entered subject to urban life time slow quick time, had as a consequence the emergence of a metropolis with its urban fabric of loaded free that express the existence of rural in the city. This Rural, manifested in the form, the structure and function of these spaces in the city having as an agent of incorporation the rural subject with his technique and strength that characterize as workers and rural workers in the social division of labour. The relationship of rural with Goiânia and Goiânia with the peculiar form of rural and that needs a watchful as a look needed to see a stamp watermark that sometimes needs of body contact and tact to be unveiled. We thus contribute to the debate over relations city-countryside, urban-rural and city-rural and urban-field seeking to understand the social phenomena of "new rural" and new "ruralidades" in contemporary society.
Este trabalho de pesquisa enfoca o processo de metropolização de Goiânia tendo como objeto de análise o rural na cidade. A forma como Goiânia foi concebida na concepção de Cidade-Jardim trazida da Europa do início do Século XX, pelo Arquiteto Urbanista Atílio Corrêa Lima, expressa bem a relação da cidade com o rural. Goiânia, uma cidade planejada sob a égide da modernidade, ocupada inicialmente pela sociedade agrária do território goiano, da tradição rural de seus sujeitos, da cultura, do jeito de ser e agir do sertanejo do Cerrado Brasileiro. A concepção de Cidade-Jardim buscou a aproximação do campo com a cidade, dos modos de vida rural e urbano para justificar a criação de uma cidade carregada de signos da modernidade, do avanço e do progresso que iria proporcionar o fim do isolamento de Goiás em relação à sociedade urbana industrial do Sudeste Brasileiro. Assim, Goiânia deveria, ao mesmo tempo, expressar sua forte relação com campo, mas também, paradoxalmente, negar o modo de vida rural ao qual se sujeitavam os habitantes de Goiás. Rural e urbano passam a ser mais que dicotomias espaciais para se tornarem dicotomias socioeconômicas, o lugar do atraso e da estagnação deveria ser substituído pelo lugar do avanço e do progresso econômico e social. Esse conflito materializa a hegemonia do capitalismo industrial sobre o território goiano e Goiânia é a marca dessa hegemonia. O símbolo da modernidade que chega no Centro-Oeste brasileiro para abrir as portas da região para o progresso. Porém, o processo de metropolização se deu de forma rápida e proporcionou um descompasso entre tempo, espaço e sujeito. Com significativas mudanças estruturais no espaço que inseriram os sujeitos rurais do tempo lento à vida urbana do tempo rápido, teve como conseqüência o surgimento de uma metrópole com sua malha urbana carregada de rugosidades que expressam a existência do rural na cidade. Rural, este, que se manifesta na forma, na estrutura e na função desses espaços na cidade tendo como agente constitutivo o sujeito rural com sua técnica e força que os caracterizam como trabalhadores e trabalhadoras rurais na divisão social do trabalho. A relação do rural com Goiânia e de Goiânia com o rural se expressa de forma peculiar e que necessita de um olhar atento como um olhar necessário para se enxergar um carimbo marca d água que, às vezes, necessita do contato corporal e do tato para ser desvendado. Buscamos, dessa forma, contribuir no debate sobre as relações cidade-campo, urbano-rural e cidade-rural, bem como campo-urbano que buscam compreender os fenômenos sociais do novo rural e das novas ruralidades na sociedade contemporânea.

Трудова діяльність працівників поліції є однією з форм праці, право на яку закріплено у ст. 43 Конституції України. Вибір такої почесної професії завжди означав готовність до напруженої роботи на благо Вітчизни та відданість національним інтересам. Місія, що покладається на працівників поліції, є дуже відповідальною - служити суспільству шляхом забезпечення охорони прав і свобод людини, протидії злочинності, підтримання публічної безпеки і порядку. У межах реалізації нашою державою напрямку на європейську інтеграцію, надзвичайно актуальними сьогодні постали питання щодо реформування діяльності поліції в цілому, а також удосконалення правого регулювання статусу її працівників. Це стосується, зокрема, і трудоправового статусу працівників поліції. У розділі 1 роботи визначено сутність правового статусу працівника поліції як спеціального суб’єкта трудового права, поняття, зміст та основні риси його трудової діяльності, правові основи регулювання такої діяльності. Розділ 2 присвячений характеристиці основних принципів, завдань та функцій трудової діяльності працівників поліції. У розділі 3 досліджуються актуальні проблеми та напрями вдосконалення правової регламентації трудової діяльності працівників поліції. Наукова новизна роботи полягає в тому, що: 1) запропоновано внести зміни до ч. 5 ст. 91 Закону України «Про Національну поліцію», у якій йдеться про компенсацію роботи поліцейського у вихідні, святкові та неробочі дні шляхом надання йому іншого дня для відпочинку. Зокрема, необхідно передбачити як альтернативу можливість отримання грошової компенсації у подвійному розмірі при залученні його до роботи у такі дні, що у свою чергу узгоджувалося б зі статтями 72 та 107 Кодексу законів про працю України (с. 62-63); 2) дістало подальшого розвитку авторське тлумачення терміну «трудоправовий статус працівника поліції». Вбачається, що це закріплена Конституцією України, законами України «Про Національну поліцію», «Про державну службу», «Про запобігання корупції», Кодексом законів про працю України система прав, обов’язків, заборон, обмежень, заохочень та гарантій професійної діяльності працівника поліції, а також міра відповідальності за невиконання або неналежне виконання ним службово-трудових обов’язків (с. 21-22). Основні положення і висновки роботи обговорювалися на міжкафедральному науково-практичному семінарі «Правові реформи в Україні: стан і перспективи розвитку» (м. Чернігів, 2019 р.). Основні результати проведеного дослідження викладені у 1 науковій праці.
The employment of police officers is a form of labor, the right of which is enshrined in Art. 43 of the Constitution of Ukraine. Choosing such an honorable profession has always meant a willingness to work hard for the good of the Fatherland and a commitment to national interests. The mission of the police is very responsible - to serve the community by ensuring the protection of human rights and freedoms, combating crime, maintaining public safety and order. As part of our country's pursuit of European integration, the issues of reforming police activity as a whole, as well as improving the right regulation of its employees' status, are extremely relevant today. This applies in particular to the employment status of police officers. Section 1 of the paper defines the essence of the legal status of a police officer as a special subject of labor law, the concept, content and main features of his employment, the legal basis for regulating such activity. Section 2 deals with the description of the basic principles, tasks and functions of the work of police officers. Section 3 explores the current issues and areas for improving the legal regulation of the employment of police officers. The scientific novelty of the work is that: 1) it is proposed to make changes to Part 5 of Art. 91 of the Law of Ukraine "On the National Police", which refers to the compensation of police work on weekends, holidays and non-working days by giving him another rest day. In particular, consideration should be given to the possibility of receiving double compensation when hired to work on such days, which in turn would be consistent with Articles 72 and 107 of the Labor Code of Ukraine (pp. 62-63); 2) the author's interpretation of the term "police officer's employment status" was further developed. It is believed that this is enshrined in the Constitution of Ukraine, the laws of Ukraine "On the National Police", "On the Civil Service", "On Corruption Prevention", the Labor Code of Ukraine system of rights, duties, prohibitions, restrictions, incentives and guarantees of professional activity of an employee police, as well as the degree of responsibility for their non-performance or improper performance of their official duties (pp. 21-22). The main provisions and conclusions of the work were discussed at the inter-departmental scientific-practical seminar "Legal Reforms in Ukraine: State and Prospects for Development" (Chernihiv, 2019). The main results of the study are outlined in 1 scientific paper.

Abstract:
This dissertation examines how the paradoxical process takes place whereby women are both integrated and segregated within male-dominated sites of social action, here in the Swedish labor market, national economy and military during the First World War. The potential of the First World War to change the societal gender distribution of labor in Sweden is limited by the fact that Sweden was not a belligerent state, and that the mobilization of men thus was limited. It is in social planning activity, and in the general state of preparedness for war and crisis, that this study has sought to analyze contemporaneous understandings of womens’ "tasks" in times of war and crisis. Earlier research has shown that women can be integrated in several different ways which can reproduce the gender order. This order can be re-created either in that women and men gain access to different "arenas" on different conditions, or in that women and men gain access to the same arena on different conditions (to mens’ advantage). From a gender-theoretical perspective, re-segregative integration is analyzed both at the level of conceptions and of practices. The study consists of three studies, regarding the domains of the labor market, the national economy (or economizing activity), and the military. The concept of the (social) task is used to capture those activities which voluntary organizations, the state, and/or womens’ organizations offered or enjoined/assigned to women in times of war and crisis. Women were offered tasks in e.g. the military medical service and in war veterinary care services, within so-called "time expense economizing" activities organized for the economy’s household sector, and with sewing articles of uniform clothing for older reserve troops (the landstormen). In addition, plans were laid up (although never carried out in practice) whereby women in wartime could be called upon to fill the "gaps" in the labor market left by men mobilized into the armed forces. In the domain of the labor market, womens’ integration was envisioned as taking place within an "extraordinary arena" on other conditions than those applying to men. Womens’ tasks were related to mens’ peacetime tasks, then being called "replacement work"; in relation to mens’ military service, placed into a context of "civil preparedness". In the domain of the national economy (or economizing activity), within the state National Economizing Commission, women were also integrated into a “special arena” on other conditions than those applying to men. Women were recruited into "womens’ administrations", or as the "only woman" to otherwise completely male-dominated administrations, and their tasks were limited to dealing with "the private households". In the domain of the military, women were still integrated into a "special arena" auxiliary to a male regular arena. Tasks were constituted as voluntary, were offered by voluntary organizations, and were focused on the provision of care services. In all these societal domains, a qualitative difference was created between what men did and what women did, or were envisioned to do. Womens’ tasks were constituted as feminized tasks. The tasks were however designed in a way which both challenged and confirmed more traditional conceptions of the "male defender", the "male provider", and the "masculine state and public sphere". One can reason here in terms of the gender order’s having been maintained, despite integration. In theory or in practice, this was done by tasks being recontextualized, whereby the existing order was maintained. By placing womens’ tasks into another context, order was secured, enabling the claim that "nothing has really happened". This could be expressed by saying that, when the gender order is threatened, a type of "assisting logic" intervened which placed threatening phenomena into a new context: the consequence of this was that tasks which women did, or were to do, became diminished.

Invandrade kvinnor i Handels. Föreställningar om arbetskraftsinvandrade kvinnor i Handelsnytt 1961-1976. (Immigrant women in Handels. Conceptions of labour immigrated women in Handelsnytt 1961-1976). The primary purpose of this thesis is to analyze the written conceptions of labour immigrated women in Handelsnytt, a Swedish Trade Union magazine. The analyses of the conceptions are based on theoretical categories of class, gender and ethnicity. The purpose is to examine how labour immigrated women, as members of the Union, Handelsanställdas förbund, were perceived and how the conceptions of them were expressed through these categories. The time period of the study is based on Yvonne Hirdman´s gender contract- The Equality contract, it was a time period when labour immigration peaked and later on attenuated. And also a time when women in Sweden begun to work outside of home in a wider extent than before. The study also means to explore power relations and subordination of the given categories and how these integrate and enhance each other.   The results demonstrate a significance absence of articles, features and overall coverage of immigrated women in Handelsnytt. The small amounts of articles about or for immigrated workers tend to leave the immigrated woman unseen.  The immigrant workers are rarely individually described; they are mostly defined as a sexless group or as a man. If the lack of recognition may be explained by limited membership of female immigrated workers could be one answer, but not entirely satisfying. Even though the trade industry was dependable on its workers language knowledge, which is a large part of the rhetoric inflicting the immigrant articles, it may not mean there were no female immigrant workers in this industry. However the results cannot with certainty claim it to be either way, not the lack of female members or as a proof of the domination of male rhetoric within the trade union-Handels.

The emergence of the concept of Fair Trade has inspired a new form of supply-determination by socially conscious consumers. Since it began official certification, Fair Trade has served as a tool to curb the exploitation of labor. It has also promoted direct connections between vendors and producers, organized participatory democracy, continuity in trade relations, respect for the environment, movement toward equal status of gender, and living wages for workers. Small family farmers now produce over 51 percent of coffee in the world, and 90 percent of the world's cocoa. With a History Honors Thesis, I seek to examine the use of worker-owned recuperated factories of Argentina for the production of Fair Trade footwear and apparel. Such factories require more complicated chains of supply (primary materials, numerous factories for production, contractors, transportation, warehouses, and retail) than primary materials such as coffee. Started in the 1980s, the recuperated factories in Argentina may provide the complex links to a sweatshop-free market, which have been lacking. The experiment has exploded to about 180 businesses since an economic crisis in 2001 forced owners to flee and workers to gain expropriation, half through legislation and half through occupation, according to journalist Andrés Ruggeri. My project seeks to investigate whether chains of production and distribution of complex Fair Trade certified or sweatshop-free products, using recuperated factories in Argentina, could serve as an economic alternative for manufactured Fair Trade products. By pursuing in-depth research on this project and understanding porteño culture and labor struggles, I have built a strong foundation for a thesis. My independent study project for the School for International Training during my Fall 2005 semester abroad in the Southern Cone (Argentina, Uruguay, Paraguay, and Brazil) became my passion and provides preliminary background information. Basing the project on interviews I had conducted with workers from ceramics, textile, and shoe recuperated factories all over, I found evidence of new supply chains with words from key leaders like Raul Godoy, Vasco Abelli, and Luis Caro (Control Obrero, El Movimiento Nacional de Empresas Recuperadas, and El Movimiento Nacional de Fábricas Recuperadas por los Trabajadores). I also became personally involved in the network of founders of current trade groups based in Argentina, with whom I will consult for my work on the History Honors Thesis. Building directly on research interests, and especially the interviews that I conducted in my semester in Argentina, I will address the complexities of the philosophical foundations, key figures, and actions that have comprised the vast history of labor in Argentina from its pre-capitalist mutuales artisan communities up to the contemporary situation with close academic mentorship from Professor Levenson. With plentiful sources of information, I will document each prospective or current deal to produce for Fair Trade distributors, develop an understanding of which products are feasible for ethical supply chains, analyze the success of such collaborations with new distributors, and compare and contrast them with business for former or other clients. Portions of the movement vary in ideology and vision, but all seek to maintain relations with former distributors. The primary concern is surviving and gaining expropriation, but the movement is witnessing a series of new strong inter-relations and projects for Fair Trade. There is a hopeful outlook for the recuperated factories, and integration into a Fair Trade market is a feasible goal for the next era (2006-2011) of the movement

O presente trabalho analisa a trajetória dos sujeitos vazios e expressos na norma lingüística efetivamente utilizada pela elite paulistana, em fins do século XIX até a década de 1930, quando S. Paulo recebeu grande afluxo de imigrantes usuários de \"línguas de sujeito nulo\". Partindo de uma avaliação crítica do \"variacionismo paramétrico\", baseado em Labov e Chomsky, propomos o \"gerativismo trans-sistêmico\". Nessa perspectiva, a língua é gerada em dois níveis: no nível de origem biológica e inata, a faculdade da linguagem, após amadurecimento, dota o indivíduo de \"competência lingüística\"; no nível de natureza social, o habitus, depois de internalizado, o proverá de \"capital lingüístico\", tal qual proposto por Bourdieu. Temos, assim, um módulo gerativo que permite ao indivíduo oferecer seus produtos no mercado lingüístico altamente concentrado. A análise de corpora lingüísticos nos levou a concluir que a elite, apesar de fazer um maior uso do sujeito vazio, já incrementava o uso dos expressos, fenômeno já bem avançado no dialeto caipira. Tal comportamento é explicado por fatores estruturais internos à língua, e também expressa, do ponto de vista histórico-social, uma clara opção por uma forma lingüística que se opunha à norma dos imigrantes, tal qual previsto no habitus da elite.
This paper analyses the trajectory of empty subjects and overt subjects in the standard language of the elite of São Paulo from the late XIX century to 1930s, when that city received a large influx of immigrants, who were speakers of languages with null subject . Starting from a critic assessment of the \"parametric variacionism\", based on Labov and Chomsky, we propose the \"trans-systemic generativism\". From this perspective, language is generated in two levels: in the biological and innate level, the language faculty, after matured, endows the individual with \"linguistic competence\"; in the social level, the habitus, after internalized, provides the individual with \"linguistic capital\", as proposed by Bourdieu. Therefore we believe that there is a generative module that allows individuals to offer their products in the highly concentrated linguistic market. The analysis of the linguistic corpora led us to conclude that the elite, despite making more use of empty subject, was already boosting the use of overt subjects, a phenomenon well advanced in the caipira dialect. This behavior is explained by structural factors internal to language, and also expressed, from the social-historical standpoint, a clear choice of a linguistic form as opposed to the standard language of immigrants, as established by the habitus of the elite.

During the 19th century the European states experienced a new kind of threat to their existence. The military threats from other countries were now accompanied by civilian threats that inspired mass protest, terrorism and other menaces to the established order. In Sweden, these threats were mainly seen as connected to the rising labor movement and to a growing number of foreign citizens. The aim of the dissertation is to examine surveillance for national security carried out by the Stockholm Criminal Investigation Department and its Police Bureau between 1885 and 1922. Apart from examining what specific surveillance methods that were used, the dissertation gives an answer to the question why the surveillance was carried out, and why it was carried out the way it was. It also discusses how differences and similarities between the surveillance in Sweden and other countries can be explained and how the surveillance between 1885 and 1922 relates to the corresponding activities during the latter part of the 20th century. The main conclusions are that there was a lack of formal rules regulating the surveillance, and that it therefore was based on the following of routines. The bureaucratization process that characterized the period influenced the surveillance, which came to be performed as a bureaucratic machine, characterized by a tendency of expansion. This meant that the surveillance activities were constantly expanded and became more and more extensive. The expansion is connected to the surveillance phenomenon, which could be said to have an unlimited scope. Furthermore, it is suggested that this specific historic legacy has affected the development of Swedish security police activity during the second half of the 20th century.

This case study is specifically concerned with the implementation and impact of the Health and Social Services Delivery Improvement Act (Bill 29-2002) upon unions and the workers who deliver health care services in one health authority in British Columbia. The Act eliminated or reduced a number of union roles, and workers’ rights and benefits previously achieved through decades of collective bargaining. Qualitative, face-to-face interviews with four health care union leaders or designates combined with documentary analysis and literature reviewed were the methods employed to collect data. This study documents four major findings: 1. The legislation impacted all workers facing programme and facility closures but in particular support workers, mainly women, who were contracted out who also lost pay equity gains established through collective bargaining; 2. Amidst the government ideology and dogma of the public policy shift with contracting out there were initial reports of organizational impacts in health facilities with reduced morale, increased workload, a division between workers and reduced quality of service to patients and residents; 3. Unions experienced legislative interference in their role and described this as “union busting” in neo-liberal times of health care restructuring; 4. Unions employed several democratic mechanisms to resist and forged alliances to strengthen their resistance.

Over the course of the 20th century, the type of farm labour desired by the North American agricultural industry and the strategies used to procure that labour have undergone significant changes. Rather than relying on immigrant or domestic workers, many growers are now choosing to import temporary foreign workers under contract programs such as the Canadian Mexican Seasonal Agricultural Worker Program (MSAWP). This thesis discusses the implementation of the MSAWP in British Columbia's Okanagan Valley, a region that has for many years depended upon the labour of migrant Quebecois workers to harvest its crops but has for several years experienced severe agricultural labour shortages. Based on fieldwork which explored the experiences of Mexican and Quebecois migrant farmworkers in the Okanagan. it is suggested that the valley's labour shortage has largely been created by the agricultural industry and government, neither of which have improved the conditions of farmwork to the point where agricultural labour would appeal to Canadian workers, and that the MSAWP's implementation has a number of implications, both positive and negative, for agricultural labourers and farmers in the valley.

From the 1940s to the 1970s the communist left in British Columbia used debates and perceptions of environmental change as a means to engage in a critique of capitalist society. In engaging in these debates, communists articulated a Marxist understanding of the connections between capitalism and environmental change. However, these articulations were heavily connected to broader occurrences that situated the communist left alongside a diverse group of social actors. Beginning in the 1940s the communist left situated their critique of provincial forest policy into a wider social debate over the management of forest resources. During the 1950s and 1960s, concerns over environmental change were transformed into debates over the effects of nuclear weapons and industrial pollution. From the late 1960s through to late 1970s elements of the communist left once again engaged with the environmental changes taking place in the forest sector, as renewed concerns developed over the status of the forest economy and the preservation of wilderness areas. To investigate the communist left’s perceptions and politicization of these issues this thesis focuses on the activities of communist controlled unions such as the International Woodworkers of America as well as the B.C. section of the Communist Party of Canada/Labour Progressive Party. In addition to these organizations, this thesis also follows the experiences of Erni Knott. As a woodworker, a founding member of the IWA, a member of the Communist Party, and an active environmentalist, Knott’s experiences highlight the complex way in which communist politics merged and conflicted with perceptions of environmental change.

The construction of the Canadian Pacific Railway (CPR) was not a conquest of man over nature as some historians have suggested and the driving of the last spike did not cement that victory. By studying the CPR from an environmental perspective, it becomes obvious that the relationship between the people and the environment in the mountains was two-fold: workers had an effect on the environment through fires, deforestation, excavation, and blasting, and the environment likewise had an effect on workers through the hardships of weather, challenging terrain, avalanches, and floods. Shortcuts, such as steep grades and wooden bridges, taken by the CPR throughout construction to save money and time, as well as the poor route choice, had unintended consequences for the operation of the railway. Massive deforestation and fires had repercussions for the watershed of the eastern Rocky Mountains and the choice of Rogers Pass meant that the CPR had to deal with numerous avalanches and deep snow. Steep grades and lines that were easily flooded or open to avalanches resulted in the deaths of numerous workers and expensive repairs to engines and the track. The construction of the CPR also had a notable impact on western Canada as it opened up the land to tourism, settlement, agriculture, and the lumber and mining industries. In building and operating the line, the CPR had to learn to adapt to the environment in order to carry out repairs quickly and get trains through.

My research aims to highlight the way in which Black political mobilization in the Southeastern United States specifically is linked to the movement for decolonization throughout Africa and the Caribbean in this time period. This project will include an examination of the thoughts and writings of many of the aforementioned key figures of the Pan African movement on the question of race and coloniality of Black people in the United States. I will organize this examination around the question of Black labor at this time period and the way in which it was (re) organized leading up to the Second World War leading to the “success” of development projects throughout the rural Southeast, mainly the Tennessee Valley Authority. This will lead to an analysis of the way in which Black southern communities specifically understood their positionality in connection to that of colonized subjects throughout the Black Atlantic.

Both the theoretical outlines of a solution to the climate and ecological crisis, as well as concrete efforts at environmental reform and energy transformation, often run into the ambivalent role of organised labour, particularly trade unions, in todays growth-oriented, fossil-fuel based economy. On the one hand, trade unions often already formally endorse the ideal of sustainability, on the other hand, in concrete environmental conflicts, they often the side with "jobs" against climate and environmental protections, and thus serve as a support of the growth-oriented fossil economy. The concept of a just transition, embodying the attempts at creating a framework in which the interests of workers and climate protection can be reconciled, thus also becomes ambivalent, serving often as a basis for arguments against more ambitious decarbonization. The aim of this thesis, drawing on the theoretical framework of critical political ecology, is to explore the possibilities of solving this dilemma in the case of Czech trade unions. A Study on the Settlement Mechanisms for the Emergent Labor-Management Disputes ---- “cooling-off period” as the Core Subject Abstract This thesis aims at exploring the importance of the settlement mechanisms for the emergent labor-management disputes, particularly on the subject of the “cooling-off period”. The settlement mechanisms for the emergent labor-management disputes in general and the provisions relating to the “cooling-off period” in particular, incorporated in the 2002 amended version of the “Labor-management Dispute Resolution Act“, proposed by the Executive Yuan of this government, were examined. By analyzing the relevant literature and information, including the case of “lockout at US west coast ports-2002” as supportive argument, this research has found that both the labor laws of United States and Japan have well-defined essential elements and resolving mechanisms for the emergent labor-management disputes, with special integration of the “cooling-off period” by which the government can invoke power on the emergent settlement of the disputes. Thus, the “cooling-off period” becomes a major mechanism in these two countries in dealing with emergent labor-management disputes. Additionally, the procedure of the “advance notice of dispute actions”, which offers a period for cooling both sides involved in the dispute and hence avoiding major negative impact, can also be considered as a supplementary mechanism. For the purposes of preserving national security and public interest, the amending “Labor-management Dispute Resolution Act” of this government has incorporated provisions to prevent and resolve the emergent labor-management disputes, including particularly the partial compulsory arbitration, the divesting special professional groups of the rights of dispute actions, and to the specific groups of businesses, the obligation of the “advance notice of strike” and the restrain from dispute actions in the “cooling-off period”. However, among them, the provisions of “advance notice of strike” and the “cooling-off period” are less comprehensively considered and less well-defined, as comparing to those in the labor laws of United States and Japan. Therefore, this thesis recommends that, this government must take into consideration the employer’s dispute actions, such as lockout, in the advance-notice regulation. For effective execution of the law, the content and procedure of the advance notice, as well as the penalty for violation must clearly be defined. Amendment of a least three-day period prior to the dispute actions, which is subjected to the consensus of both parties, is also recommended. More importantly, a clear-cut defining of the essential elements for the emergent labor-management disputes and the “cooling-off period” is necessary. The procedures by which the government can invoke power and apply “cooling-off period” to deal with the emergent settlement of the disputes must be explicitly formulated. In accord with the current administrative system of this nation, the Council of Labor Affairs should be assigned the duty of training staffs with expertise to deal with the emergent disputes, and the Director of the Executive Yuan should be granted the highest authority and responsibility to cope with the emergent labor-management disputes. Abstract:
Since 2012, hundreds of companies have poured thousands of dollars into hackathons – finite events where creatives come together in small teams to design, build, and demo a new product of feature. The spectacle of the hackathon engages participants in a number of things: a transgressive ethos, disciplined play, and hacker’s literacies (Santo 2011). Based on my dissertation fieldwork at seven hackathons in three industries (journalism, healthcare, and e-government), I explore various types of play labor (Terranova 2000) based on the performances of eight teams. I show how teams creatively manage their peers’ affective and intellectual labor, and negotiate what appear to be industry-specific preferences for different technologies. In the process of competing for status and recognition, they engender distinct forms of play labor and making do. Hackathon participants directly embed resistance in their designs; some learn how to learn (Bateson 1972), giving them a strategic advantage over other classes of workers. They embody the characteristics of the new worker-subject required in the digital economy, as mutable, playful, and rapid.

This research aims to understand the correlation between comprehensive vocation subject’s teachers’ emotional labor and job burnout and the differentiation with different background variables on those. The questionnaire method was used, comprehensive vocation subject’s teachers at senior vocational schools who have been teaching in school year 2009 to 2010 were chosen as participants and “emotional labor and job burnout” questionnaire was developed as the instrument in this study. 446 questionnaires were distributed and 369 effective questionnaires which accounted for 82.6%. Descriptive statistics, one-sample t-test, independent t-test, one-way ANOVA, and canonical correlation were adopted and the conclusions were as follows: 1. Teacher’s emotional labor performed over upper-intermediate level, teachers’ job burnout performed over intermediate level. 2. Teacher’s emotional labor verified by their age, position they stayed the longest, marriage, years of service, and special education qualification. 3. Teacher’s labor burnout verified by marriage. 4.When teachers had higher feelings of emotional labor, they would have lower feelings of job burnout which includes two dimensions, depersonalization and lack of person accomplishment. Based on the results, the suggestions are provided for education administration, teachers, and follow-up researches as a reference.

The new Collective Agreement Act, which has been modified in 2008, has come into force since May the First, 2011. Article 6 of the new Collective Agreement Act officially introduced in the concept of the duty to bargain in good faith. However, it is questionable whether the employers and the unions are obligatory to discuss about all the subjects proposed on the bargaining table. Since there is a type of subject called “management prerogatives” which has long been thought that the employers could decide unilaterally. Therefore, it is unfavorable for the employers, if they were considered failing to fulfil the bargaining duty and committing unfair labor practice for refusing to bargain about such subjects. Under thecircumstances specifying the scope of the subjects which must be bargained is crucial to both unions and employers. The goals of this study, is to establish the system of mandatory bargaining subjects by inquiring into how the concept of collective bargaining subjects has been developing during the past eighty years under National Labor Relations Act. To fulfil this goal, in chapter 1, this study examines whether Subsection 1 of Section 2 of Article 6 and Section 1 of Article 12 of Taiwan’s new Collective Agreement Act are suitable regulations for the mandatory bargaining subjects; besides, reviews the developing opinions of Unfair Labor Practice Board in related cases. After figuring out the existent problems, in chapter 2, this study observes the legalization process of the duty to bargain and the bargaining subjects, the labor relations and collective bargaining system, along with the primary categories of bargaining subjects. In chapter 3 and 4, this study would like to goes on reviewing the leading cases of the U.S. Supreme Court and the National Labor Relations Board, in order to find out how the Board and the Court have built the distinction between mandatory and permissive bargaining subjects, as well as what standards and factors they have suggested to draw the line between the two subjects. This study then focuses particularly on employers’ management decisions, which have provoked intense debate in American labor law. The study also researches the evaluations and reflections made by American labor scholars about the distinction and ramifications of bargaining subjects, and the management prerogatives notion. Lastly, based on the observations of American labor law, the study tries to present the guidelines to define and specify the mandatory bargaining subjects, and adoption of the legal effects following the mandatory-permissive distinction compatible with the context of Taiwan’s legal system.

In dealing with the pressure of environmental change, organizations come up with a responding strategy called “organizational change”。In the past, the Municipal United Hospital underwent environmental pressure from inside and outside. The hospital responded the pressure by taking “organizational change” as the way of integrating their services, improving the benefits of health care. Thus, Taipei City Hospital was officially established in January, 2005. In the process, “medical care” and “humanistic concern” are two points at balance. Therefore, the importance of Social Worker Room is increasing with time, providing instant service and recognizing the status of individual physical labor. In addition to the acknowledgement of “medical worker” as “highly emotional labor”, in confronting the pressure of “organizational change”, how the “organizer” has been affected by emotional labor”, “job satisfaction” and “organizational commitment” is also taken into consideration.The scenario of this study is “organizational change”, and the subject is the “medical social worker” of Social Worker Room. In order to examine the situation closely, the method of qualitative study is assumed. And the materials are analyzed by case study research. The significant results are as followed: I. The changing movement’s impact on the “social medical worker”. The advantages are: A. Absorbing innovative services, advancing the opportunities of personal training; B. Improving their working and social skills; C. Improving their capability of adaptation and of enduring frustrations. The disadvantages are: A. The way of communicating messages is not complete; the good intention of the organizer is not expressed; B. Too much temporary occupations, the practice of service are replaced by abundant of administrative affairs. The sense of achievement cannot be fulfilled; C. Losing self assurance for not being fully appreciated of their professional occupation.II. The impacts on “emotional labor”: The advantages are:A. Highly loaded with emotional labor, increasing the support degree of fellow workers;B. Having positive influences in terms of the ‘professional’ exercise. The disadvantages are:A. In carrying out highly emotional labor, the organization does not rules to follow; B. The load of emotional labor is not valued by the organizer, affecting their performance of service and the image of the organization.III. The impacts on job satisfaction: The advantages are: A. As a result of new working contents, the inherent sense of satisfaction is uplifting; B. The manipulation of resources is enhanced comparing to that of before the reformation; C. Expanding the interpersonal relationship, generating positive effects. The disadvantages are: A. Changing of working characteristics, resulting in some job variations. Therefore, the sense of satisfaction is reduced; B. Magnifying their administrative roles, therefore, their professional occupation is wavered. C. It takes time to be familiar with the organizational system after the reformation; D. Insufficient of human resources, demolishing their identification.IV. In the case of organizational commitment: The advantage is that they have a common consensus, and that may be seen as a “reshaping of organization” of the time. The disadvantages are: A. Organizer fails to comprehend their job expectations, suffocating the voice from the basic level of the organization; B The way of communicating is not available to all, not allowing the personnel to express themselves. C. Vague leadership and changeable in policy, the members are losing their faith on the system. D. The liberty of their job contents are limited, manifesting the domination of the authority.Correlations of the above-mentioned structures: A. When the reformation tends to be positive force, the relationship between emotional labor, job satisfaction, and organizational commitment also appears to be positive: 1 The positive force of the reformation helps in reducing the burden of emotional labor; 2 The attitude of the reformation has positive correlations to the job satisfaction and organizational commitment. B. The variation between emotional labor, job satisfaction, and organizational commitment when the reformation tends to be negative force: 1. If the receiving of reformation messages is not complete, emotional burden is increasing; 2. Reformation actions results in the increasing of emotional labor. However, when their role and occupation are fulfilling their capabilities, the pressure is released, and the crisis of professional ennui is relieved.To sum up my study, to place the specific advices ob individual research as the references for the organization’s adjustment: I. As to “organization change”: A. Value the rights and interests of the workers; B.Applying variation management strategies, continuing the communication with the worker; C. Highlighting the influences of the reformation, emphasizing straight communication of information. II. As to “emotional labor”: A. Focusing on the essence of emotional labor, developing corresponding strategies of human resources management. B. Emphasizing the importance of preventive management. C. developing a corresponding measure to prevent emotional exhaustion. III. As to “job satisfaction”: A. Flexible management measures, improving worker’s job devotion; B. Constructing an ideal provision of salary and benefits, advancing the performance of their occupation. IV. As to “organizational commitment”: A. A democratic, open working environment which facilitates the workers learning process, encouraging their ability to learn, and to innovate. B. Constructing learning organization, as a strategy of managing human resources; C. The organizer himself should be seen as the one who assists the organization.

Social entrepreneurship is an innovative solution to increasing social problems related to unemployment and its inseparable social impact, such as social exclusion of persons that are disadvantaged in terms of labour market access. In spite of the fact that the law of the Czech Republic lacks a legal framework of social entrepreneurship (the term of social enterprise as such is not legally based nor defined), there are many local activists who make effort to change this state of inequality, using social enterprises as a means of generating new workplaces for people handicapped in terms of entering an open labour market. The main practical goal of the thesis I hereby present is to help those social entrepreneurs with creating more sustainable organisation structure of their businesses. The first part of my thesis is dedicated to explaining basic concepts and charting a theoretical framework of the research. In the second part I focus on the results of empirical research regarding social enterprise operation. The results may serve as practical advice on organisation structure optimisation in the field of gastronomy. The questionnaire will also test the employees intent to leave the organization. Random selected employees from all levels in the organization participated in this study. In this study gender, marital status and employment duration had a significant impact on job satisfaction.

This thesis analyzes the economic performance of recent European immigrants to Canada. The data source for the analysis is the Longitudinal Survey of Immigrants to Canada, which followed immigrants entering Canada during 2000-2001 for four years. The purpose of this research is to examine the general category of European immigrants by region and country of birth in order to better understand the experience of immigrants in the Canadian labour market during their first years of settlement. Several important differences are observed within the European immigrant population in terms of economic performance. While Southern and Eastern European immigrants appear to have a slow start, their labour market performance improves rapidly, rivalling Western European immigrants after four post-immigration years. Immigrant category, education, and home language have a significant effect on overall labour market performance of recent European immigrants to Canada.

Le succès de carrière a fait l’objet d’une multitude d’études et deux formes de succès ont été identifiées; le succès subjectif et le succès objectif de carrière. Dans le cadre de notre recherche, nous nous sommes intéressés au succès subjectif de carrière compte tenu de son association confirmée avec le bien-être psychologique, la qualité de la vie au travail (Nabi, 2003; Peluchette, 1993), la motivation intrinsèque, la confiance en soi (Abele et Spurk, 2009b) et l’engagement envers l’organisation (Hennequin, 2009a). En outre, selon diverses études (Arthur, Khapova et Wilderom, 2005; El Akremi, Guerrero et Neveu, 2006), le succès de carrière a tendance à être examiné plus sur la base des critères objectifs (salaire et promotions) que des critères subjectifs (la perception de l’individu). Par ailleurs, il y a eu une méta-analyse, élaborée par Ng, Eby, Sorensen et Feldman (2005) qui a examiné les déterminants du succès de carrière, à la lumière de deux perspectives théoriques développées par Turner (1960); soit la perspective de la mobilité par concours « contest mobility » et la perspective de la mobilité sponsorisée « sponsored mobility ». Ces auteurs ont révélé que les recherches sur le succès de carrière ont une portée limitée; « there is only a limited range of variables being examined as predictor of career success » (p. 396); d’où la nécessité d’examiner d’autres déterminants de succès de carrière, en les associant aux deux perspectives théoriques développées par Turner (1960). La présente recherche s’inscrit également dans la lignée des études qui ont pour but d’analyser les déterminants du succès de carrière. Toutefois, elle traite des liens entre le succès subjectif de carrière, les possibilités de mobilité externe et la congruence personne-organisation. Sur la base des recommandations de Ng, Eby, Sorensen et Feldman (2005), nous avons associé la congruence personne-organisation au modèle de la mobilité sponsorisé et les possibilités de mobilité externe au modèle de la mobilité par concours. Notre étude est de type explicatif, compte tenu du fait qu’elle tente de vérifier les liens entre le succès subjectif de carrière, les possibilités de mobilité externe et la congruence personne-organisation. À cet effet, nous avons eu recours à des données qui ont été colligées auprès de professionnels des ressources humaines, membre de l’ordre des conseillers en ressources humaines et en relations industrielles (Saba et Dufour, 2005) afin de pouvoir tester empiriquement les liens que nous anticipions entre notre variable dépendante (succès subjectif de carrière) et nos variables indépendantes (congruence personne-organisation et possibilités de mobilité externe) en tenant compte à la fois de notre variable médiatrice, à savoir le sponsorat organisationnel qui intervient dans le lien entre la congruence personne-organisation, et de nos variables de contrôle, qui sont l’âge, le genre, le statut marital, la scolarité, l'ancienneté dans l'organisation et l'ancienneté sur le marché du travail. Par ailleurs, nous avons adopté une méthode quantitative et nous avons procédé à des analyses statistiques, afin de faire sortir les caractéristiques de la distribution des variables; à des analyses bivariées, afin d’analyser les relations (statistiques) entre notre variable dépendante (succès subjectif de carrière) et chacune de nos variables indépendantes (la congruence personne-organisation et les possibilités de mobilité externe) et à une régression multiple, afin de déterminer si des corrélations existent entre les différentes variables à l’étude, nous avons également effectué un test de médiation afin de vérifier le rôle médiateur du sponsorat organisationnel dans le lien entre la congruence personne-organisation et le succès subjectif de carrière. De façon générale, nos hypothèses de recherche on été confirmées. Les possibilités de mobilité externe et la congruence personne-organisation sont liées positivement au succès subjectif de carrière. De plus, nous avons identifié une médiation partielle du sponsorat organisationnel dans le lien entre la congruence personne-organisation et le succès subjectif de carrière.
Career success has been the focus of much research. In the literature, two forms of success have been identified, subjective and objective career success. In our study, we are interested in subjective career success given its confirmed association with psychological well-being, quality of life at work (Nabi, 2003; Peluchette, 1993), intrinsic motivation, self confidence (Abele & Spurk, 2009b) and commitment to the organisation (Hennequin, 2009). In addition, according to various studies (Arthur, Khapova, & Wilderom, 2005; El Akremi, Guerrero, & Neveu, 2006), career success is more often examined on the basis of objective criteria (e.g., pay level, promotions) than in terms of the perception of the individual. Furthermore, a meta-analysis of 140 studies published by Ng, Eby, Sorensen, and Feldman (2005) examined the predictors of objective and subjective career success in the light of the two theoretical perspectives advanced by Turner (1960), namely contest mobility and sponsored mobility. The authors of this synthesis concluded that «There is only a limited range of variables being examined as predictors of career success » (p. 396); hence the importance of examining other predictors of career success that relate to the theoretical perspectives developed by Turner (1960). Our study is therefore situated in research that aims to analyze the predictors of career success. It examines the links between external marketability, person-organization fit and subjective career success. Based on the recommendations of Ng, Eby, Sorensen, and Feldman (2005), we associated external marketability to contest mobility and person-organization fit to sponsored mobility. We used data collected from human resource professionals, all members of a professional association located in Quebec (Canada) (Saba & Dufour, 2005). The analysis tested the relationships that we hypothesized between the dependent variable (i.e., subjective career success) and the independent variables (i.e., person-organization fit and external marketability). Further analysis tested the mediating influence of organizational sponsorship in the association between person-organization fit and subjective career success. These analyses included age, gender, marital status, education, organisation tenure, and experience in the labour market as control variables. Descriptive statistics, bivariate correlations, and multiple regressions were used to describe the sample and to test our hypotheses. In general, our research hypotheses were supported. External marketability and person-organization fit are positively related to subjective career success. In addition, we have identified a partial mediation of organizational sponsorship in the relationship between person-organization fit and subjective career success.
