Abstract:
Actually, basic needs postulates securing of the elementary conditions of existence to every human being. Despite of the practical and theoretical importance of the subject the greatest irony is non- availability of any universal preliminary definition of the concept of basic needs. Moreover, this becomes the reason for unpredictability of various political programmes aiming at providing basic needs to the people. The shift is necessary for development of this or any other conception. No labour reforms could be made in history till labours were treated as objects. Its only after they were started being treating as subjects, labour unions were allowed to represent themselves in strategy formulations that labour reforms could become a reality. The present research paper highlights the basic needs of Human Rights in life.

Abstract:
This theoretical article represents a psychological analysis of the factors of the digital information environment that transform the labour behaviour of the subject (agency), discusses the possibility of asking the question about join subject (agency) of labour ‟individual-digital information environment”. It is shown that as a result of the digitalisation of society, the following changes have occurred in the field of labour – the autonomy of labour, de-standardisation, virtualisation of labour relations, a decrease in the share of physical labour, the convergence of play and labour. A set of contradictions that are brewing in the classical models of professional development is also highlighted. As conclusions, the conditions that are the mediators of the desired single subject of labour and the research ‟gaps” that indicate the horizons of further research in this area are presented.

Abstract:
In this article, I argue for a public relations research agenda which places new divisions of labour and worker subjectivities at the centre. While communication technology may be facilitating greater work flexibility, research is needed into how work processes interact with broader inequality regimes, producing new discourses and possibilities for resistance among public relations practitioners. I discuss the benefits of sociological frameworks which position work as a central organising process through which power relations are constructed and maintained. I then propose that Bourdieu’s theory of habitus complements Glucksmann’s ‘Total Social Organisation of Labour’ (TSOL) framework, combining a focus on power relations within a field with a feminist analysis of new divisions and processes of labour. After briefly discussing cultural and public relations scholarship which problematises work from a critical perspective, I conclude by framing a critical feminist public relations research agenda on labour, which utilises Bourdieuvian theory and Glucksmann’s TSOL.

Abstract:
Lagutina I. V. Electronic labour book and data protection. – Article. The article considers the protection of personal data as a modern and active law that provides a system of checks and balances to protect the individual if his personal data is processed. Data processing must meet the basic requirements of personal data protection, namely independent control and respect for the rights of the personal data subject. The development of legislation on personal data protection has been marked by a significant expansion of the rights of their subjects and the legal regulation of all transactions with information from collection to destruction. With the adoption of the Law of Ukraine “On Personal Data Protection” of June 1, 2010, a regulatory framework for the protection of personal data in national legal practice was created. It is emphasized that the right to protection of personal data is not absolute; it may be restricted as necessary to satisfy the general interest or to protect the rights and freedoms of others. The right to data protection is often interlinked with other rights, such as freedom of expression and the right to receive and impart information. Any type of information can be personal data, provided that the information relates to an identified person or a person who can be identified. Personal data are processed legally if they meet one of the following criteria: processing is carried out with the consent of the personal data subject; data processing is required by contractual relationship; data processing is necessary for the controller to comply with a legal obligation; data processing is required to comply with the vital interests of personal data subjects or others; data processing is necessary to perform the task in the public interest; the legitimate interests of the controllers or other persons are the basis for processing, but only if they are not outweighed by the interests or fundamental rights of the data subjects. It is necessary to develop a sectoral mechanism for the protection of personal data of employees under labour legislation of Ukraine, as the Law of Ukraine “On Personal Data Protection” does not take into account the peculiarities of personal data protection of employees as subjects of labour relations.

Abstract:
The subject constructed by and for labour law---the "worker"---is bodiless, sexless, genderless, and male. This thesis investigates how and why this construction occurs both through a discussion of general theoretical issues surrounding the way law constructs its subjects, and through a specific case study. The case study considers a set of sexual harassment cases decided in the "mainstream" unfair dismissal jurisdiction. As a site of women's overt presence in the labour market, these cases are disruptive to settled constructions of "the worker", particularly because they connect the sexuality of women (and their gender) to their status as worker. In so doing, they suggest the possibility of a "womanworker"---a woman who is simultaneously woman and worker. The thesis concludes by exploring the consequences of this possibility and asks how the recognition of women's experiences, needs and specificities can allow the subject of labour law to be reconstructed.

Vigeland, Anne. "Exhibiting Performing Subjects : Curating Outsourced Performance Labour in Museum Settings." Thesis, Stockholms universitet, Institutionen för kultur och estetik, 2020. http://urn.kb.se/resolve?urn=urn:nbn:se:su:diva-180926.

Full text
Abstract:
The thesis examines challenges museum curators face when outsourced performers – whose role it is to embody the work of other artists – are included in exhibition projects. The research questions are: What are the practical, juridical and ethical challenges that come with situating outsourced performance labour in the museum setting? What does the inclusion of live performance in exhibition projects mean for the role of the museum curator? Two exhibition cases in Stockholm are studied in the thesis: Marina Abramović – The Cleaner (2017) at Moderna Museet and Dora García, I Always Tell the Truth at Bonniers Konsthall (2018–19). The material consists of digital surveys that were sent out to employed performers from each exhibition case as well as interviews that were conducted with both performers and curatorial staff. The material was examined using theories on affective labour and the theoretical notion of de-skilling and re-skilling of acquired competences.  The thesis shows that the practical challenges include the architectural conditions of museum buildings, insufficient prior knowledge on what working with performers entail, short project timespans and limited exhibition budgets. The juridical challenges include a lack of union recommendations for performance in museums and the difficulty of situating reperformances of historical works that in its form and duration may go against national labour regulations. The ethical challenges include commodification of performers’ subjectivity through instances of affective labour and mechanisms of objectification. In turn, both the outsourced performer and the museum curator turned performance curator inhabits a precarious working situation. The role of the performance curator is highly administrational and organisationally tedious in its positioning between curatorship, performing arts production and human resource management. Additionally, it entails a prodigious amount of affective labour in the reproductive mode – of emotional investments, conflict resolution and social liaison.

Thesis for a degree of Candidate of Science in Law, specialty 12.00.05 «Labor law; social security law». – Yaroslav Mudryi National Law University, Ministry of Education and Science of Ukraine. – Kharkiv, 2018.
The dissertation is devoted to the systematic and detailed analysis of the legal essence, content and features of the status of the head of a higher education institution as a subject of labor law, as well as actual problems of practical nature and the search for solutions to them. In the scientific work the legal characterization of the activity of the head of a higher education institution as a form of realization of labor rights for the fulfillment of official duties, as well as a specific kind of labor activity was carried out. Defined the notion and essential features of the labor-legal status of the head of a higher education institution, in particular, the nature of the legal relationships that the composition is established between the head of a higher education institution (as an employee) and the founder of a higher education institution (as an employer). Features of the emergence and termination of labor relations with the head of the higher education institution are highlighted, and the gaps and conflicts in the normative and legal regulation of labor relations with the head of higher education institution are identified. Specific suggestions and recommendations for improving the legal regulation of the status of the head of a higher education institution as a subject of labor law have been formed.

Colgan, Valerie. "Progress in labour after colposcopy treatment." Thesis, Northumbria University, 2010. http://nrl.northumbria.ac.uk/586/.

Full text
Abstract:
Anomalies noticed in midwifery practice prompted a review of literature around progress in labour after Loop Excision of the Transformation Zone (LETZ). The previous research was equivocal. This study investigates the pattern and progress of women's labours following LETZ, and the effect of the experience on women. It also explores the basis of clinical decisions made by midwives. It takes place in North East England and involves women giving birth in 2004-2005. The case study strategy brings together quantitative retrospective case control results, qualitative analysis of semi-structured interviews from women and midwives, and guidelines and protocols surrounding assessment and management of labour. The quantitative data is from 111 women after LETZ and 214 controls, reducing to 94 and 150 respectively after removal of cases with confounding variables. Interviews are from four women, three individual midwives caring for one of the women and a focus group of four midwives. In the interviews, women gave no thought to how their births may be affected by LETZ, as no one had discussed the possibility with them. Women having their second baby after LETZ take less time to reach full dilatation; a result related to grade of Cervical Intraepithelial Neoplasia. Women having their first baby after LETZ are 1.8 times more likely to be admitted later in their labours, an important emergent issue that needs further research. Women having their first or second baby after LETZ are 2.3 times more likely to have a premature birth, confirming indications in previous research. This study for the first time reveals important differences in pattern and progress of labour after LETZ. It adds to our knowledge of premature birth after LETZ. Midwives, obstetricians and colposcopists need to incorporate the study results into counselling of women before LETZ and during any pregnancy after LETZ.

Masquelier, Charles. "Labour, knowledge and communication : rethinking the practical content of critical social theory." Thesis, University of Sussex, 2011. http://sro.sussex.ac.uk/id/eprint/7343/.

Full text
Abstract:
In response to the reification of social reality caused, according to the first generation of the Frankfurt School, by the instrumental mastery of nature, Adorno, Horkheimer and Marcuse have elaborated a critique of instrumental reason aimed at providing the theoretical tools for a treatment of the social realm as a field of human practice. Concerned with the risks of reproducing the relationship between humanity and nature hindering human emancipation, they have nevertheless sought to limit the task of critical theory to a theoretical form of resistance, thereby divorcing social theory from the practical orientations found in Marx‟s critique of political economy. It was not until the works of second-generation critical theorist Jürgen Habermas, that one could find a renewed attempt to link theory with the objective conditions of existence thought to be required for human emancipation. With these theoretical developments, however, social theory was effectively stripped of its critique of technology, and became primarily concerned with the problem of human emancipation as a matter strictly regarding intersubjective relations. The present work proposes that the formulation of a social critique oriented towards the institutionalisation of emancipatory practice cannot presuppose or apologise for the instrumental mastery of external nature. It shall be argued that in order to achieve such a task, the critique of instrumental reason elaborated by the first generation of Frankfurt School theorists must be complemented and completed with the broad outline of an institutional framework capable of indicating the conditions of existence required for the actualisation of human emancipation as the labour-mediated reconciliation of humanity with both internal and external nature, and for which the works of G.D.H. Cole provide a potential basis for rethinking critical theory and updating libertarian socialism.

Abstract:
AbstractFinland has only relatively recently become a country of immigration, and as a result most immigration and integration policy legislation is also relatively recent. Since the 1990s, the number of migrants to Finland has increased steadily, motivating the adoption of various policy measures to regulate migration and support integration. From the perspective of migrant labour market integration, the two most important legislative acts are the Aliens Act (FINLEX 301/2004) and the Act on the Promotion of Immigrant Integration (FINLEX 1386/2010), which lay out basic labour market integration supports for migrants, and determine who can work in Finland and on which grounds. Finland’s comprehensive residence-based welfare state policies and collective bargaining based labour regulation also shape labour market outcomes for migrants. Immigrants working in Finland are subject to the same labour regulations as native Finnish citizens. There are different justifications for labour market access for different groups of immigrants, depending on from which country they come, and what kind of work they are doing. The chapter will go over the principle legislation regulating migration and migrants working in Finland. Also, the legislative basis for applying for asylum is discussed.

Abstract The majority of migrants from Latvia move abroad intending to work, and so fall into the category of ‘work migrants’. A crucial role in their job placement is played by an increasingly complex network of intermediaries. This includes formal employment agencies, more informal, social network-based mediators and even illegal service providers. Despite the agencies providing job placements abroad being subject to regulations, fraud and the mistreatment of jobseekers has emerged as a cause for concern. Even when there is no ill will from the intermediaries, immigrant workers often suffer discrimination from their employers, sometimes leading to a re-evaluation of their return migration plans. This chapter explores the employment conditions of Latvian migrant workers. It analyses the operation of private employment agencies offering employment abroad and, in more general terms, sheds light from the Latvian migrant workers’ perspective on their treatment by employers. In doing so, this analysis demonstrates that almost a fifth of those respondents who used the services of private employment agencies had experienced unfair treatment. Moreover, at least one in three Latvian migrant workers encountered some form of discrimination at work, and around one in six were in a precarious and vulnerable position due to the nature of their employment contract. The chapter concludes with recommendations for further studies and policy development.

Abstract:
Scientific literature offers extensive examples of the role of mathematics education in the development of personality and intelligence as well as its application in everyday life and professional activities. Furthermore, the attitude towards the role of mathematical knowledge in the labour market is widely discussed in the society. In order to reflect the views of respondents on the issues of mathematics education and the potential values of mathematics, the survey was carried out. The research data was analysed considering the respondents` education speciality, gender, age and mathematics learning experience. Study results show that mathematics is widely used in everyday life as well as in professional activities, and gives advantage in the labour market. It is difficult to learn mathematics but it is highly worthy. Thus the subject of mathematics is becoming a crucial instrument for promoting an all-round education and personal development. Therefore, many higher education courses have to be mathematics-intensive, and students need to have a high level of competence in the subject to promote person’s resilience.

Abstract:
According to different approaches to pronoun processing, in pro-drop languages, null pronouns are interpreted as referring back to the grammatical subject and topical referent, while overt pronouns are usually interpreted as coreferring with a non-subject and non-topical antecedent. The present study investigates whether thematic role and grammatical function impact (overt and null) pronoun production in Romania. Results show that we do not encounter a clear division of labour between the two pronoun forms triggered by syntactic structure alone and that thematic roles matter as well. The findings support a multi-dimensional approach, suggesting that different referential forms are constrained by different factors.

Abstract:
An important feature of many rural markets is the over-supply of labour. An insufficient number of jobs in rural areas is usually associated with the shortage of capital, companies, consumers and skilled workers, i.e. limited impact of the agglomeration effect. Additionally, in regions with structural changes in agriculture, the phenomenon of increased or hidden unemployment is visible. One of the important objectives of labour market policy in Poland was a promotion of employment, especially in peripheral, poor and agricultural territories. Along with the accession of Poland to the EU, both agricultural and cohesion policy instruments supported by the structural funds have also been aimed at resolving the problems of rural labour markets. They concerned mainly the diversification of agricultural activities, support of entrepreneurship, as well as development of knowledge and skills. The paper considers the barriers and challenges in increasing employment in rural Poland. In particular, the changes on local rural labour markets and the influence of relevant policy tools thereon have been studied. The study is based on the quantitative and qualitative analysis of the public statistics and information on the implementation of selected EU CAP and Cohesion Policy instruments in Poland from the period 2007-2014 and the literature of the subject. The study showed that, despite the favourable economic situation and the effects of projects aimed at creating and maintaining non-agricultural jobs in rural areas supported by the EU founds, the rural employment rate and the number of people employed in agriculture did not increase significantly. In this context, the paper provides the explanation of limited improvements in terms of rural employment and policy offers recommendations in this area.

Abstract:
To gain a clearer understanding of the overall economic and environmental impact of the manufacturing process of a single vehicle, including its operational phase, it is useful to examine the process in a life-cycle perspective and with an exergy approach.. The method of Extended Exergy Accounting (EEA) has already provided reliable results both for the assessment of entire countries and for the analysis of specific industrial sectors. National transportation sectors, generally reputed inefficient, have been the subject of a series of energy and exergy efficiency studies, though so far the phase of vehicle manufacturing was not specifically addressed. The present study is an attempt to quantitatively develop the complex evaluation of the exergy cost of a single vehicle, in particular of a commercial truck produced in the US (for which the available data are extensive and reliable). In the analysis performed in the course of this study, the last version of EEA has been employed, with the latest available data on the allocation coefficients for labour and capital cost factors. Particular attention is given to data selection and their processing. The values of the exergy costs for materials flows, energy inputs and of their equivalents for capital, labour and environment remediation are predicted. The results shows numerically the exergetic costs of economic, labour, material and energy inputs, and emphasize the further research of environmental remediation costs.

Abstract:
Education for employability is one of the greatest challenge for Higher education institutions in Europe, but especially in Spain. The European Higher Education Area assumes that competence development becomes crucial to connect higher education curricula with evolving labour market demands. The Authentic Learning Scenarios foster the competence development bringing work experience to the formal learning. Considering that online learning methodologies seems to have a relevant role into a life long learning perspective to achieve authentic learning environments is a singular challenge. We have introduced the authentic learnig scenarios attributes into a specific subject and we have tested its impact on students competence profile. Apart from testing if the new subject design is effectively atuthentic, the findings show that when the learning process includes authenticity the students perception about their perfomance in the competence more relevant for the job market improves.

Abstract:
Digitalization is transforming business and the world of work by redefining the boundaries of production, consumption, and distribution. This brings many advantages, but also disadvantages, both for workers and employers. At the same time, digitalization has resulted in the establishment of a new entity in the field of work – the digital platform. Although, they are most often presented as exclusively intermediary agencies that deal with bringing the job seeker and the client in touch, digital platforms have become much more than that over time. In the legal space given to them, which does not currently treat them as a visible party in the contractual relationship, digital platforms enjoy their legally undefined position, which results in creation of a new formation of workers, known as crowdworkers. The subject of this paper is crowdwork, a sa special form of digital work in which the client (service user) and digital worker usually are not in any form of contractual relationship. The very nature of related tasks in corwdwork is about performing a large number of simple, straightforward work operations, although it can also be about far more complex and creative work tasks. This type of work and provision of services, in addition po positively assessed flexibility, often contains negative sides which are reflected in low labour costs, lack of social protection, as well as complete exclusion of crowdworkers from any form of labour protection.

Full text
Abstract:
The National Park Service (NPS) manages the Nation’s most iconic destinations that attract millions of visitors from across the Nation and around the world. Trip-related spending by NPS visitors generates and supports economic activity within park gateway communities. This report summarizes the annual economic contribution analysis that measures how NPS visitor spending cycles through local economies, generating business sales and supporting jobs and income. In 2020, the National Park System received over 237 million recreation visits (down 28% from 2019). Visitors to national parks spent an estimated $14.5 billion in local gateway regions (down 31% from 2019). The estimated contribution of this spending to the national economy was 234,000 jobs, $9.7 billion in labor income, $16.7 billion in value added, and $28.6 billion in economic output. The lodging sector saw the highest direct effects, with $5 billion in economic output directly contributed to this sector nationally. The restaurants sector saw the next greatest effects, with $3 billion in economic output directly contributed to this sector nationally. Results from the Visitor Spending Effects report series are available online via an interactive tool. Users can view year-by-year trend data and explore current year visitor spending, jobs, labor income, value added, and economic output effects by sector for national, state, and local economies. The interactive tool is available at https://www.nps.gov/subjects/socialscience/vse.htm.

Abstract:
Blue Mountain is a 35-minute work for two actors and orchestra. It was commissioned by the Ultima Festival, and premiered in 2014 by the Danish National Chamber Orchestra. The Ultima festival challenged me – being both a composer and writer – to make something where I wrote both text and music. Interestingly, I hadn’t really thought of that before, writing text to my own music – or music to my own text. This is a very common thing in popular music, the songwriter. But in the lied, the orchestral piece or indeed in opera, there is a strict division of labour between composer and writer. There are exceptions, most famously Wagner, who did libretto, music and staging for his operas. And 20th century composers like Olivier Messiaen, who wrote his own poems for his music – or Luciano Berio, who made a collage of such detail that it the text arguably became his own in Sinfonia. But this relationship is often a convoluted one, not often discussed in the tradition of musical analysis where text tend to be taken as a given, not subjected to the same rigorous scrutiny that is often the case with music. This exposition is an attempt to unfold this process of composing with both words and music. A key challenge has been to make the text an intrinsic part of the performance situation, and the music something more than mere accompaniment to narration. To render the words meaningless without the music and vice versa. So the question that emerged was how music and words can be not only equal partners, but also yield a new species of music/text? A second questions follows en suite, and that is what challenges the conflation of different roles – the writer and the composer – presents? I will try to address these questions through a discussion of the methods applied in Blue Mountain, the results they have yielded, and the challenges this work has posed.

Гарлицька, Т. С. Substandard Vocabulary in the System of Urban Communication. Криворізький державний педагогічний університет, 2018. http://dx.doi.org/10.31812/123456789/3912.

Full text
Abstract:
The article is devoted to substandard elements which are considered as one of the components in the system of urban forms of communication. The Object of our research is substandard vocabulary, the Subject is structural characteristics of the modern city language, the Purpose of the study is to define the main types of substandard vocabulary and their role in the system of urban communication. The theoretical base of our research includes the scientific works of native and foreign linguists, which are devoted to urban linguistics (B. Larin, M. Makovskyi, V. Labov, T. Yerofeieva, L. Pederson, R. McDavid, O. Horbach, L. Stavytska, Y. Stepanov, S. Martos). Different lexical and phraseological units, taken from the Ukrainian, Russian and American Dictionaries of slang and jargon, serve as the material of our research. The main components of the city language include literary language, territorial dialects, different intermediate transitional types, which are used in the colloquial everyday communication but do not have territorial limited character, and social dialects. The structural characteristics, proposed in the article, demonstrate the variety and correlation of different subsystems of the city language. Today peripheral elements play the main role in the city communication. They are also called substandard, non-codified, marginal, non-literary elements or the jargon styles of communication. Among substandard elements of the city language the most important are social dialects, which include such subsystems as argot, jargon and slang. The origin, functioning and characteristics of each subsystem are studied on the material of linguistic literature of different countries. It is also ascertained that argot is the oldest form of sociolects, jargon divides into corporative and professional ones, in the structure of slangy words there are common and special slang. Besides, we can speak about sociolectosentrism of the native linguistics and linguemosentrism of the English tradition of slang nomination. Except social dialects, the important structural elements of the city language are also intermediate transitional types, which include koine, colloquialisms, interdialect, surzhyk, pidgin and creole. Surzhyk can be attributed to the same type of language formations as pidgin and creole because these types of oral speech were created mostly by means of the units mixing of the obtruded language of the parent state with the elements of the native languages.
