Providing a new cross-national and international narrative, this book captures the complexity of social policy reform process that has taken place over the past 25 years. Drawing on data relating to multiple countries, the book examines global, cross-national and local cases in order to shed light on the impact of international forces on social policy. The book addresses major theoretical debates about the direction of welfare state reform processes across the Organisation for Economic Co-operation and Development (OECD) and beyond, offering empirically rooted analyses of change and new perspectives on the impact of global competition on social policy.

Abstract:

This article examines the impact of welfare states on poverty reduction. It considers how different welfare regimes have reacted to help stressed populations, especially the poor, and how welfare states in developing countries protect their less capable populations under the pressures of globalization and postindustrial economic transformation. To address these questions, the article reviews existing theoretical and empirical literature on welfare states and poverty. It first describes three welfare state typologies in terms of skill and employment provisions before discussing the issues of targeting and encompassing welfare institutions. It then explores the redistributive policies of welfare states and how demographic transformations affect poverty. It also assesses the effects of two different types of welfare regimes observed in developing countries—productivist and protectionist welfare regimes—on poverty outcomes. Finally, it analyzes which configurations of social policies reduce poverty more effectively.

Abstract:

This chapter examines Article 12 of the Vienna Convention on Diplomatic Relations which refers to the establishment of offices away from the seat of the diplomatic mission. Article 12 states that the members of the sending State may not establish offices forming part of the mission in the localities other than those where the mission itself is established without prior express consent. The Article traces its roots from the general practice of missions being established in the seat of government of the receiving State and to follow that government if it moved either permanently or to a summer residence. However, there are exceptions to this. One example would be in China when between 1927 and 1937; many of the missions remained in Peking although the Government had moved to Nanking. In making the Article, the members of the International Law Commission stressed the difficulty for the receiving State in ensuring privileges and immunities away from the seat of government and to prevent abuses.

Organization employees, experts on mission, contractors, and troop contingents may have direct responsibility for wrongful acts. This is stressed in the commentary to Article 66 of the Draft Articles on the Responsibility of International Organizations, which underscores that if the conduct of an individual is attributed to an international organization or a State, this does not exempt that person from the individual criminal responsibility that he or she may incur for his or her conduct. The chapter explores the challenges to pursue civil and criminal remedies against individuals and the role played by international organizations to help secure that responsibility.

The contemporary status of the eight South Asian nations were determined by creation of the British Indian empire and by the process of decolonization. This book by the late Ainslie T. Embree is an insightful exploration of how the boundaries of these states were created between 1757 and 1857. During these one hundred years, political and military developments in the Indian subcontinent made a significant impact upon the definition of borders as they (almost) exist today. The narrative begins after Aurangzeb’s death, when vast areas of the Mughal Empire were taken over by regional powers, following which the East India Company swiftly expanded its territory, thus altering the boundaries of the region. Embree explores the meaning of ‘boundaries’ and ‘frontiers’. While the British stressed on ‘natural frontiers’, those shaped by natural landscape, there was also the French sense of ‘natural borders’, which represented state borders reflecting social composition. Artfully written, with a careful examination of archival materials from England and India, this book reveals the colonial and local interests at work while modern states were carved into being.

In the United States, the welfare state has long been a source of political and academic debate, and this volume pulls together much of our current knowledge about its origins, development, functions, and challenges. This introductory chapter provides an overview of the volume’s main themes and sections. For example, many of the following chapters emphasize the public-private mix in social policy, in which the government helps certain groups of citizens directly (e.g., through social insurance) or indirectly (e.g., through tax expenditures and regulations). Many chapters stress disjointed patterns of policy-making, which can lead simultaneously to problems of high cost and low impact on poverty and inequality. Even under a variety of stresses, however, much of the American welfare state remains quite resilient. The contributing authors are experts from political science, sociology, history, economics, and other social sciences.

This chapter considers the debate about Anglo-Scottish union that accompanied James VI’s accession to the southern Crown. Through an analysis of David Hume of Godscroft’sDe Unione insulae Britannicaeand Richard Verstegan’sA Restitution of decayed intelligence, both published on 1605, it argues that the prospective union was far more politically fraught and intellectually significant than commonly recognized. Unionists like Hume urged ethnic erasure through the forging of a common British identity within an integrated British state. Brito-Sceptics like Verstegan stressed ethnic difference to the point of adopting Tacitean racial vocabularies. Precocious historical linguistics underlay each side. Each carried at its center a competing religious agenda. These matrices provide a frame for understanding the contemporary writings of such figures as Richard Hooker, William Camden, and William Shakespeare.

Analysing the development of the concept of non-state parties to an armed conflict from the writings of philosophers in the eighteenth century through international humanitarian law (IHL) treaty law to contemporary practice, three threads can be identified. First, as pointed out by Rousseau almost two and a half centuries ago, one basic principle underlying the laws of war is that war is not a relation between men but between entities. Accordingly, the lawful objective of parties cannot be to harm opponents as individuals but only to overcome the entity for which the individual fights. This necessitates that any party to an armed conflict is a collective, organized entity and not a loosely connected group of individuals. Second, de Vattel already stressed that civil war is fought between two parties who ‘acknowledge no common judge’ and have no ‘common superior’ on earth....

Chapter 1 presents the “Ben-Gurion doctrine,” formulated in the 1950s, the closest Israel has to a formal defense doctrine, which still informs its strategic thinking today. The doctrine viewed the Arab-Israeli conflict as uniquely long, bitter, all-encompassing, and existential and considered Israel’s geography a strategic nightmare, making it a vulnerable state with indefensible borders. It stressed the fundamental strategic asymmetries with the Arabs, including territorial and population size, economic resources, staying power, military objectives and capabilities, and diplomatic support. The strategic response it proposed called for “a nation in arms” and was based on “three pillars,” deterrence, early warning, and military decision, and on a defensive strategy to be executed offensively, by transferring the battle to enemy territory. It further emphasized the pursuit of peace as a foremost strategic objective, the need for great power alliances but strategic autonomy, and the importance of nation-building.

Abstract:

The Public’s Law is a theory and history of democracy in the American administrative state. The book describes how American Progressive thinkers—such as John Dewey, W.E.B. Du Bois, and Woodrow Wilson—developed a democratic understanding of the state from their study of Hegelian political thought. G.W.F. Hegel understood the state as an institution that regulated society in the interest of freedom. This normative account of the state distinguished his view from later German theorists, such as Max Weber, who adopted a technocratic conception of bureaucracy, and others, such as Carl Schmitt, who prioritized the will of the chief executive. The Progressives embraced Hegel’s view of the connection between bureaucracy and freedom, but sought to democratize his concept of the state. They agreed that welfare services, economic regulation, and official discretion were needed to guarantee conditions for self-determination. But they stressed that the people should participate deeply in administrative policymaking. This Progressive ideal influenced administrative programs during the New Deal. It also sheds light on interventions in the War on Poverty and the Second Reconstruction, as well as on the Administrative Procedure Act of 1946. The book develops a normative theory of the state on the basis of this intellectual and institutional history, with implications for deliberative democratic theory, constitutional theory, and administrative law. On this view, the administrative state should provide regulation and social services through deliberative procedures, rather than hinge its legitimacy on presidential authority or economistic reasoning.

Philosophers in the Islamic tradition faced a dilemma arising from their dual intellectual heritage: the philosophical triadition influenced by Plato stressed the duality of the human and emphasized the need to focus on the soul as the true subject of human experiences, including pleasures and pains, and yet the scriptures addressed the carnality of humans in this life and especially in the afterlife. Earlier thinkers such as al-Fārābī (d. 950) and Avicenna (d. 1037) acquiesce to a dualistic reading of the human and praise the pleasures of the soul over that of the body. However, later thinkers recognize that the soul remains in some state of embodiment, requiring a clearer understanding of the holistic nature of the human. I focus on one area problematizing dualism: the pleasure of the embodied human located in the erotics and carnality of the person analyzed in the Ladhdat al-nisāʾ (pleasure of/in women) literature.
