AbstractThis article seeks to defend the law of unjust enrichment against the recent influential attacks of Robert Stevens (“The Unjust Enrichment Disaster” (2018) 134 LQR 574) and Lionel Smith (“Restitution: A New Start?” in Devonshire and Havelock, The Impact of Equity and Restitution in Commerce (2018), ch. 5). A central argument here put forward is that there is a law of unjust enrichment, embodying a cause of action in unjust enrichment, which unites what Stevens and Smith see as disparate categories. A linked but separate argument is that, within the central area of unjust enrichment, Stevens is incorrect to regard the defendant's acceptance of performance as being necessary to trigger restitution albeit that acceptance may be relevant in establishing that the defendant has been enriched. A further, and more specific, argument is that, with great respect, the overruling, as a matter of principle, of Sempra Metals Ltd. v IRC [2007] UKHL 34, [2008] 1 A.C. 561, by the Supreme Court in Prudential Assurance Ltd. v HMRC [2018] UKSC 39, [2018] 3 WLR 652, seems unfortunate and appears to have been influenced by Stevens's excessively narrow approach to the meaning of “at the expense of”.

Born at Renfrew on 8 October 1900, Thomas Stevens Stevens (‘TSS’) was the only child of John and Jane Stevens. His father, a draughtsman and engineer, was production director of William Simons and Company Ltd of Renfrew, shipbuilders specializing in dredger construction. Before her marriage in 1898, his mother Jane (née Irving) was a schoolteacher. His upbringing was typically middle-class, and both parents gave every encouragement for their son to study. However, as a delicate asthmatic youngster Tom's early education was given, until the age of eight, at home by his mother—a fact held by many to be responsible for the seeds that brought forth his great love of language and his sensitive and wide-ranging intellect. Thereafter he attended Paisley Grammar School (1909–15) and the Glasgow Academy (1915–17). At Paisley Grammar School his attention was drawn by Joseph Towers, a teacher of English, and at the Glasgow Academy he delighted in the sardonic humour of G.L. Moffatt, who taught mathematics. Physics and chemistry had nevertheless captured his imagination and in the Academy he enjoyed the extensive opportunities that were provided for practical chemistry. It was a love and a boyish enthusiasm that he retained and continued to practise throughout his professional career. In a popular lecture that he gave in the 1950s, ‘The anatomy of the chemist’, Tommy includes the account given by the famous American teacher, Ira Remsen, of the most impressive experiment he had ever performed: ‘nitric acid acts upon copper’. The story ends, ‘… I drew my fingers across my trousers and another fact was discovered. Nitric acid acts on trousers…’. With its smells, fizzes and bangs it is surely a portrait of the young Stevens himself.

Abstract:
This research paper explores the top ten CSR-contributing companies in India and their contributions toward environmental sustainability. The study analyzes the CSR spending patterns of these companies and the percentage of their CSR funds directed toward environmental sustainability. The results indicate a significant variation in CSR spending and contribution towards environmental sustainability among the top ten companies. Companies like Wipro Ltd, ITC Ltd, and Infosys Ltd have directed a considerable percentage of their CSR funds toward environmental sustainability. On the other hand, companies like Tata Consultancy Services Ltd, Tata Sons Private Ltd, and Indian Oil Corporation Ltd did not contribute to environmental sustainability, despite significant CSR spending. The findings suggest that there is a need for companies to prioritize environmental sustainability in their CSR activities, given the current environmental challenges faced by the country. The study recommends that companies should adopt sustainable practices and invests more in environmentally sustainable CSR initiatives to achieve a balance between economic development and environmental conservation.

We suggest that the description by Cramer et al. (2012) of traditional models of personality structure does not perfectly reflect the models actually endorsed by researchers. Personality researchers assume that many variables will have considerable secondary loadings and that the major personality factors will not account for all of the covariation among those variables. A model that includes common factors provides a more parsimonious explanation of covariation among personality variables than does a model consisting of network links only. This article explores the cross‐cultural invariance (construct validity) of two work‐related personality inventories based upon the Five Factor Model (the HPI and the IP/5F). The results show a good convergent and discriminant validity between scales that measure the Big Five personality dimensions. A factor analysis indicates that all personality scales load on the hypothesized Big Five dimensions. The methodological foundations underlying these attempts to explain personality, however, remain an unpopular and often ignored topic. The target paper and this rejoinder explore three methodological core issues in the philosophy of science for comparative personality research: Conceptualising personality variation, identifying domains of variation and measuring variation. The present research reports the results of three studies showing that individuals with a fragile self–concept in the domain of performance are particularly vulnerable to stereotype threat effects. Specifically, women who explicitly described themselves as rather mathematical but whose implicit self–concepts contradicted these claims were vulnerable to stereotype threat effects on mathematical performance. This effect was robust across three studies, independent of the subtleness or content of the stereotype threat manipulation. We note that network analysis provides some new opportunities but also has some limitations: (i) network analysis relies on observed measures such as single items or scale scores; (ii) it is a descriptive method and, as such, cannot test causal hypotheses; and (iii) it does not test the influence of outside forces on the network, such as dispositional influences on behaviour. In two German samples we investigated whether three major personality prototypes (resilient, overcontrolled, and undercontrolled) can be replicated across different Big Five instruments (NEO‐FFI and NEO‐PI‐R), and whether they can be differentiated into replicable subtypes. For prototypes and subtypes, replicability within and consistency across samples was quantitatively measured. Three replicable prototypes were confirmed, but only two replicable resilient subtypes (well adjusted and assertive) were found. The dot probe task is a widely used measure of attention allocation to threatening stimuli. The present two studies examine the reliability of different versions of this task using words as well as pictures as stimulus material. Estimates of both internal consistency and retest reliability over one week lead to the conclusion that the dot probe task is a completely unreliable measure of attentional allocation in non‐clinical samples. One system relates to avoidance or withdrawal behaviour, called the Behavioural Inhibition System (BIS), whereas the other system relates to approach behaviour, called the Behavioural Approach System (BAS). In two samples, it was investigated whether individual differences in surface of personality as described by the Big Five can be explained by BIS/BAS. In this article we present data illustrating the divergence of stereotypes and assessed personality traits in North and South Italy, test hypotheses about the associations of temperature and national wealth with national character stereotypes in 49 cultures, and explore possible links to national values and beliefs. Results suggest that warmth and wealth are common determinants of national stereotypes, but that there are also idiosyncratic influences on the perceptions of individual nations.
