Abstract:
The ICC is independent court that prosecutes serious crimes under article 5 Rome Statue and has jurisdiction of the State Parties. Omar Al-Bashir is alleged of comitting human rights violations in Sudan’s Darfur. However, the problem is that Sudan is not a state party of Rome Statue 1998. The purpose of this research is to find out does the ICC has jurisdiction to investigate and adjudicate human rights violations by Omar Al-Bashir in Darfur, Sudan. This research is prescriptive normative legal research. Type Legal materials include primary and secondary legal materials. The technique of collecting legal materials used is literature study and through research instrument. The results showed that the ICC as an international judicial institution has jurisdiction to investigate and adjudicate human rights violations by Omar Al-Bashir that occurred in Darfur, Sudan. However, Omar Al-Bashir’s status as head of state with immunity, the weak authority of the ICC in carrying out the arrest of Omar Hassan Al-Bashir, and the lack of cooperation between Sudan and state parties in carrying out the arrest of Omar Hassan Al-Bashir hampered the judicial process. The ICC has conducted an investigation, issued a warrant for arrest of Omar Hassan Al-Bashir and cooperated with Sudan so that Sudan agreed to hand Omar Hassan Al-Bashir over to the ICC for trial. The jurisdiction ICC to prosecute Omar Al-Bashir shows that perpetrators of serious human rights violations can still be tried wherever he is regardless their impunity. In addition, international cooperation is necessary in investigation and prosecution of crimes for the smooth of the judicial process.

Abstract:
Contextual hermeneutics allows interpreters to read the Bible from their location. However, interpreters not only read meaning into the text, as a number of scholars claim, but in the process, they actually illuminate the original context underlying the text. To demonstrate this point, I will be analyzing the story of Rizpah through the lens of a current event, the Japanese government’s efforts to remove the ‘comfort women’ bronze statues in Korea. The bronze statues embody counter-narratives that challenge and ultimately threaten the master narrative of the Japanese government. Likewise, Rizpah who stands on a boulder also functions as a counter-monument against King David. She resists the royal historian’s effort to whitewash David’s involvement in the murder of the Saulide descendants. However, to understand the specific way in which Rizpah challenges the royal court propaganda, it is necessary to engage critical methods of reading.

Pre-trial detention is not advance punishment and the deprivation of liberty should only occur if necessary in the interests of justice. Striving to achieve this objective, Article 58 of the Rome Statute dictates that an arrest warrant shall be issued if there are reasonable grounds to believe that the person has committed a crime within the jurisdiction of the court. The Pre-Trial Chamber has over the years relied on the reasonable suspicion threshold sourced from the European Convention on Human Rights (echr) as an elucidation of the reasonable belief standard. It is argued that the reliance on echr is misplaced in the context of the evidentiary thresholds present in the Rome Statue. Textually, reasonable belief is a higher standard than reasonable suspicion. Instead, it is submitted that the Court should rely on the prima facie case jurisprudence from the icty to interpret the threshold for Article 58.

Abstract:
In various countries throughout the world when rebel groups make an attack on innocent civilian and commit gross human rights violation, it is not punishable by the national courts. However, in 1998 a grounding breaking idea turned into reality, and 50 years of debate ended as the first International Criminal Court was established as a result of the Rome Statute. The Court entertains or investigates different crimes which are committed in its member’s sates across the world. However, the writers of this paper prefer the situation in Darfur; the case of Al Basher is selected as a context to discuss the role of the ICC Prosecutor. This is mainly preferred because Sudan has been the first situation referred by the Security Council since the ICC was established and the state concerned Sudan is not a party to the Rome Statute, therefore this situation has its particularities compared with others. In spite of this a lot of controversies and misconceptions are being witnessed on the understandings and implementation of international laws in Africa between ICC and African leaders. Basically, the controversy and misconception is not something emanates from the vacuum rather they are generated from various prevailing thoughts. African states accuse ICC as a neo colonialist institution targeting African leaders in addition to alleging ICC as playing double standard role in African and the rest of the world for instance ICC prosecution till now only in Africa in spite of Israel-Palestine and Afghanistan where the western countries have major interest from the conflict. Hence, the analysis of role the International Criminal Court’s Prosecutor in Darfur Crisis, Sudan (the case of Omer Al-Bashir) is centered in line with main objective of the establishing Rome Statue in July 2002 which thrives that all member states of UN have to have the same standard in their respective territories.

A fragmentary Egyptian Middle Kingdom statuette was found in the north-west area of Central Court at Knossos in 1900. The three hieroglyphic texts show that the statue was mortuary in character, and that it was linked to a gold-caster called User of the Wadjet nome in Egypt. The User statuette is part of a wider distribution of Middle Kingdom statues from Nubia, Anatolia, and the Levant which have been found in funerary and nonfunerary contexts. Theories for this distribution are reviewed including diplomatic gifts and exchanges, dedications in sanctuaries, the movement of specialised Egyptian workers, portable funerary statues and looting. Looting of tombs in the Wadjet nome followed by redistribution of finds looks like the most likely explanation for the appearance of User's statuette on Crete.

AbstractA 2015 court judgment in the United Kingdom ruled that a seized Libyan statue should be returned to the ownership of the State of Libya. The judgment prompts a critical discussion of the involvement of professional conservators in the trafficking of cultural objects. Higher standards of due diligence are recommended for conservators and other professional experts engaging with cultural objects that might have been stolen and trafficked. Stronger professional due diligence is but one component of a broader policy of demand reduction that will be necessary to control the theft and trafficking of cultural objects, and to offer protection to cultural sites around the world.

Abstract:
The cultural property becomes objects of destruction in armed conflicts, such as Syria and Iraq, which were carried out by ISIS squads (Islamic State of Iraq and Syria). For ISIS’s actions, the ICC should judge ISIS. However, new problems will arise regarding the jurisdiction of the ICC to judge ISIS. Based on the explanation of this background, the question will arise: How are humanitarian law regulations related to protecting cultural property during armed conflict? And what is the regulation of the ICC’s jurisdiction over the protection of cultural property in armed conflict by ISIS? The research in this article is normative legal research with the statue approach. According to humanitarian law, the research results show that the regulations relating to the protection of cultural property during armed conflict are contained in the 1954 Hague Convention, Additional Protocol I and Additional Protocol II of the Geneva Conventions of 1977. The destruction of cultural property carried out by ISIS is included in war crimes, one of the Rome Statute material jurisdictions. In this case, the Rome Statute applied by the ICC has juridical power to uphold justice and punish, including war crimes committed by ISIS. For the destruction of various cultural property in Iraq and Syria, ISIS can be judge by the ICC through a referral by the UN Security Council based on the provisions stipulated in the 1998 Rome Statute.

Summary In 2014 the discovery of a Mithras' statue at Tarquinia occurred. This was due to the Comando Tutela Patrimonio Culturale dell'Arma dei Carabinieri, which informed the Soprintendenza per i Beni Archeologici dell'Etruria Meridionale about clandestine activities in May 2014 on the poggio della Civita – where the ancient city of Tarquinia stood – in a zone close to the Etruscan temple of the Ara della Regina (fig. 1). As soon as possible, the Soprintendenza carried out an archaeological excavation, focusing the effort on the need to find evidence for the place of origin of the magnificent sculptural group (fig. 2), which represents Mithras Tauroctonus. This sculpture was recovered by the Carabinieri after investigation by the police, directed by the Procura della Repubblica of the law court of Rome. Archaeological research since then has led to the discovery of another marble part of the same sculpture (fig. 3), i.e., the dog leaning on the knee of the bull and perfectly dovetailing with the Mithraic Tauroctony. The discovery of another fragment pertaining to the same sculpture is an irrefutable proof that the Mithras' statue came from the domus of the Civita of Tarquinia, which represents an important and new scientific result. The only other sculptural group depicting Mithras in Southern Etruria was one previously found in Vulci, discovered in 1975 after a clandestine excavation close to the domus del Criptoportico. This new finding proves the spread of this cult in Tarquinia, as well, and the style of the new sculpture suggests a chronological priority of the Tarquinian Mithraeum in respect to that in Vulci.

Pros and cons of the authority to deal with judicial constitutionality review of Government Regulation in Lieu of Law (Perpu) either from fellow judges of the Constitutional Court (MK) or from the world of legal science is acceptable. The pros and cons is not due to the differences in interests between them, but it is caused by the differences in schools or schools of thought and interpretation methodologies adopted. The authority of the Constitutional Court to review the constitutionality of Perpu is in line with the philosophy of Judicial Activism (the concept of active understanding) which is identical to the "Statue of the Goddess of Justice" whose eyes are not closed in order to be able to watch and absorb the "sense of social justice", to incorporate the living legal values in the society, respond to the demand and aspiration of the people and, furthermore, to create “the thinking judges” which make their decisions responsive. However, the authority of the Court to review the constitutionality of the Perpu might cause “broader impacts” in the future which means that the impact will not be only on the constitutionality review of the Perpu but also on the other decisions of Constitutional Court.

Article 2 of Law Number 30 Year 1999 concerning Arbitration and Alternative Dispute Settlement indicates that dispute settlement or disagreement among parties in a certain legal relationship shall be the authority of the arbitration institution, if it has been agreed in an arbitration agreement. This research tried to criticize the concept of absolute nature of the arbitral decision in the settlement of business dispute in the perspective of the theory of justice. Method of data retrieval used in this research was by collecting literature study by studying data and analyzing the entire contents of library by linking to existing problems. The final and legally binding arbitral decision, if associated with Aristotle's corrective theory of justice, does not at all reflect the basic value of justice. This is indicated by not giving an opportunity for another party whose position is higher to correct the decision, whereas in the judicial system, the court as an ordinary court having legal status (legal statue) and legal authority (legal authority/legal power). Verdict the panel of judges can still be corrected through the usual remedies (appeals) and extraordinary reviews.

Abstract On 26 September 2018, six American States Parties to the Rome Statute referred the Situation in Venezuela to the Office of the Prosecutor (‘OTP’) of the International Criminal Court, regarding crimes against humanity. Those States rested on Article 14 of the Rome Statute to proceed. That referral – namely, crimes committed outside the territory of the referring State(s) – was the second of its kind received by the icc in its more than 15-year working history. The otp is currently considering the referral under the so-called ‘Preliminary Examination’ stage, wherein the admissibility test is likely to be addressed within the complementarity principle, according to Article 17 of the Rome Statute. Despite the duty to exercise their criminal jurisdiction, as the Preamble to the Rome Statue stipulates, and the fact that those six American States recognize some sort of extraterritorial jurisdiction, those States remained inactive. What should the otp do when six democracies, who are able to act, do not even try to launch an investigation for crimes they have expressed concerns about, without providing an explanation for their inactivity? This article will analyse how the otp should deal with this referral in terms of the complementarity principle, having regard to the positive approach to complementarity. Accordingly, it will be argued that the Prosecutor should refrain from intervening until those States attempt to act and/or, in case of legal or factual inability, justify the referral.

The promulgation of the implementation of the Constitutional Court's decision is in the spotlight of other State Institutions that have repealed articles that have been canceled by the Constitutional Court in the new Law. Likewise with the authority of the Constitutional Court. In the process of presidential impeachment by the MPR there are indications that the Constitutional Court's Decision stating that the president and / or vice-president were proven guilty by the Constitutional Court can also be set aside, given the political process in the MPR which refers to the minimum decision-making conditions. The president is attended by at least ¾ of the total number of MPR members and is approved by at least 2/3 of the total members present. The research method used is a normative research method with the statue approach approach. The focus of this research is (1) what is the concept of the principle of simple justice, quick, and low cost in Indonesian’s act? And (2) what is legal view of the principle of simple justice, quick, and low cost about sharia economic verdict at Malang City Islamic Court in 2019? This research using library research and statue approach, also using legal material in the form of primary legal material, secondary legal material, and tertiary legal material for the example books, journals, acts, legal dictionary, etc. And then all of those legal material will be adjusted within the object of this research. The result of this research is the concept of the principle of simple justice, quick, and low cost can called principle is just because fulfill the meaning of legal principle and the function of legal principle. The principle of simple justice, quick, and low cost have been implemented in various judicial procedural law at Indonesia. Act Number 35, 2014 on Child Protection (UUPA) and Qanun (provincial law) Aceh Number 6, 2014 regarding Qanun Jinayat has given rise to legal dualism. Both laws and regulations govern the same case in the jurisdiction of Aceh, so that it can cause problems in its enforcement. This research applies primary, secondary and tertiary legal sources. This research uses the statue approach. Library research data are then analyzed from secondary and tertiary legal sourcesby using deductive method.The research shows that the enforcement of absolute power at the judicial institutions relating the trial of the sexual offence towards children cases in Aceh, the Public Court, which is granted its power under the UUPA,is privilege compared to Syar’iyah Court, which is having its power from Qanun Jinayat. The reasons for this are as following: a) the punisment in the UUPA is more serious and cumulative, while in Qanun Jinayat is more lenient and alternative; b) UUPA regulates specific things regarding child cases, while Qanun Jinayat is general; c) the enforcement of UUPA together with its changes is still facing hurdles, and there is also the enactment of Qanun Jinayat; d) there are problems in regards with lack of facilities of the detentions and budget during the process of the cases and there is an absent of the cooperation between correctional center for the convicted under the Qanun Jinayat; e) judges in the Public Court mostly already have certificates in dealing with child case compared to Syar’iyah Court. This research found that the later court judges have not had any certificate yet. The enforcement of punishment towards the perpetrators in Aceh mostly tried under the UUPA compared to using Qanun Jinayat as it provides more justice for victims.

This research is an empirical juridical legal research that describes the results of research on the applicable law in the community that is legal research conducted by collecting data with the facts that occur and field studies in general or should, with the method of the statue approach legislation. A statuette of a woman dating from the Second Dynasty of Lagash features exceptional gold, silver and copper bracelets that have been recently restored and analysed. The statue is remarkable for its refined dress, to date known only from a small number of female figures, almost all linked to the court of Lagash's Second Dynasty. Examination of the statuette and comparable pieces has revealed possible traces of polychromy, although these vestiges are particularly difficult to identify with any certainty. This paper presents these results within the larger corpus of female depictions from the Second Dynasty of Lagash, together with other very similar examples, to better understand the meaning of the specific costume they wear and the possible identity of the women wearing it.

The Supreme Court's sweeping decision in December, 2003, in McConnell v. FEC was as unexpected as it was dramatic. For months the conventional wisdom had been that the Court was certain to overturn one and possibly both of the main parts of the McCain-Feingold law, or otherwise substantially narrow the statue. Instead, the justices, by a slim 5-4 majority, did just the opposite; not only upholding the law but doing so in terms that virtually echoed the defendants' arguments. Proponents were stunned and thrilled. Opponents were appalled; Justice Scalia called it the “opening act of a national tragedy.” Both sides agreed, however, that the decision in McConnell stands as one of the most important campaign finance and First Amendment precedents in several decades.

The purpose of writing this article is the Fulfillment of the Rights of Children of Rape Victims in District Court Decision Number: 512 / Pid.Sus / 2017 / Pn.Bil. The study method uses a statutory approach (statue approach), a case approach (case approach), and a conceptual approach (Conceptual Approach). The rape crime is very worrying especially if the victim is a child who is still under age, because this will affect the psychological development of the child and cause lifelong trauma. Rape according to the legal construction of Indonesian law (KUHP) is an act of forcing a woman who is not his wife to have intercourse with him with violence or threats of violence. The state provides protection by regulating it in various laws, one of which is contained in Article 76D of the Child Protection Act. Based on the explanation above, the writer is interested in conducting a research related to the issue of "Fulfilling the Rights of Children of Rape Victims in the Decision of the District Court of Part Number: 512 / Pid.Sus / 2017 / Pn.Bil". Because in this case the writer is very sad about the verdict, what about the victim's witness whether the criminal sentence given to the defendant's children's rights has been fulfilled. Considering the crime of rape is often experienced by children, girls, adult women, including those who are mentally, physically and socially vulnerable who are sensitive to various threats from within and from outside their family. The threat of violence from outside his family, his house can often be driven out, because it can be seen by the surroundings.

Zen is one of Mahayana Buddhism which is propagated in China, Korea, Japan, Vietnam, and many counties in the West. In Thailand Zen was known widespread because of Buddhadasa Bhikkhu’s translated works. Furthermore, he has studied and applied its teachings for developing Thai society through establishing Suan Mokkhabalarama. There is the center of study and practice the Dhamma which reflects the concept of Zen, such as Spiritual Theater, Curved Stone Court, Natural Uposatha, Dhamma Ships, Avalokiteshavara Bodhisattva’s Statue, and Nalike Pond. These places are strongly influenced by Dhamma puzzle of Koan and Zen garden arrangement which emphasize the cultivation of wisdom, living simple and in harmony with nature. In the term of Dhamma teaching Buddhadasa Bhikkhu mixes the principle of Theravada and Zen teachings properly, that is the principle of working with empty mind.

This study aims to find out about the urgency of involving the Constitutional Court in the amendment of the 1945 Constitution of the Republic of Indonesia, and how prospective the Constitutional Court to involve in the amendment to the 1945 Constitution of the Republic of Indonesia. This study uses a type of normative research and several approaches, namely; law approach (statue approach), comparative approach, and conceptual approach. The results of this study indicate that the urgency of involving the Constitutional Court in amending the Constitution is based on several things, including: First, the weaknesses in the first amendment to the fourth amendment; Second, the existence of the MPR as a political institution; third, the implementation of the Checks and Balance System principle; Fourth, the realization of the Constitutional Court as the Guardian of Constitution. The prospective involvement of the Constitutional Court in the amendment to the 1945 Constitution of the Republic of Indonesia is to emphasize the political goodwill of the MPR to develop a mechanism for amending the 1945 Constitution of the Republic of Indonesia by involving the Constitutional Court as a state institution which provides a review of changes made by the constitution before obtaining approval from the MPR to be determined as a result of the amendment to the new 1945 Constitution. The result of the constitutional change mechanism by involving the Constitutional Court was intended to produce constitutional changes that have the character the people of the constitution.

Alors que durant toute l’époque classique ces distinctions étaient octroyées avec une grande parcimonie par le peuple athénien, ce législateur satura le territoire civique de ses effigies, mettant à l’honneur de nouvelles formes statuaires – la statue équestre –, investissant de nouveaux espaces – les dèmes –, tout en limitant les autres manifestations monumentales dans l’espace public. Les effigies honorifiques furent davantage imposées que négociées ou, à tout le moins, furent octroyées de façon bien moins tatillonne par la communauté qui, au demeurant, avait été redéfinie de façon restrictive. Au fur et à mesure qu’elles envahissaient l’espace public, par un phénomène de compensation, les effigies de Démétrios de Phalère furent ainsi détruites, transformées ou avilies, selon des modalités variées qui permettent de dresser les contours d’une véritable culture de l’outrage, établie sur la longue durée. It has been a widespread belief among historians of antiquity that Athens’ importance on the political scene declined rapidly after 338, and especially after 322; Athens, so it is assumed, succumbed to the will of Alexander and, later on, of his Diadochoi. Of course, it cannot be denied that Athens found itself in a very precarious and sometimes impossible position. Yet the attitudes of Athens towards one king or the other, as well as its status, vary considerably until 261, the end of the Chremonidean War against Antigonos Gonatas, king of Macedon.Certain aspects of the Athenian relationship with the various monarchs are reflected in the decrees of the assembly, passed in honour of royal officials, as well as in the decrees conferring the highest honours (proedria of the games, sitesis in the Prytaneion, and a statue) upon Athenian citizens who belonged to a king's court. My purpose is to examine precisely the image that Athens projects through the above-mentioned decrees with regard to its relations with the various rulers and their officials; and these in relation to its perception of its own position on the military and political scene on different historical occasions.

This paper discusses the increasing application for Marriage Dispensation during the corona virus pandemic which is viewed from the sociological aspect of law. Applications for dispensation for marriage are more complicated and must be submitted through the Religious Courts, but the facts on the ground show that the number of applications for dispensation for marriage is increasing during this pandemic. The situation during this pandemic which makes sociological factors, the occurrence of imbalances in the structure of society makes the dysfunction of the community's inability to maintain their nature. The legal issues are: (1) What are the factors that increase the number of applications for a marriage dispensation in the Jombang Religious Courts (2) What are the considerations of the Jombang Religious Court judges in granting the marriage dispensation. This research is juridical and sociological in Jombang Religious Court. By using a statue approach, conceptual, with primary and secondary data types and analyzed descriptively qualitatively. The discussion of the research results shows that: 1). The increasing application for Marriage Dispensation during this pandemic is caused by the association of children with restrictions on learning activities so that their time is used more for playing gadgets that are not common and the lack of parental supervision, this makes many factors that can plunge them. 2). The basis of the judge's consideration in granting the application for dispensation for marriage is based on "benefit and harm" then the court will grant the request for dispensation. Permohonan dispensasi nikah memang lebih rumit dan harus diajukan melalui Pengadilan Agama, namun fakta di lapangan menunjukkan jumlah permohonan dispensasi nikah semakin meningkat di masa pandemi ini. Situasi di masa pandemi ini yang menjadikan faktor sosiologis, terjadinya ketidakseimbangan dalam struktur masyarakat menjadikan disfungsi ketidakmampuan masyarakat dalam menjaga kodratnya. Permasalahan hukum tersebut adalah: (1) Faktor-faktor apa sajakah yang menyebabkan meningkatnya jumlah permohonan dispensasi nikah di Pengadilan Agama Jombang (2) Apa saja pertimbangan hakim Pengadilan Agama Jombang dalam memberikan dispensasi nikah. Penelitian ini bersifat yuridis dan sosiologis di Pengadilan Agama Jombang. Dengan menggunakan pendekatan patung, konseptual, dengan jenis data primer dan sekunder serta dianalisis secara deskriptif kualitatif. Pembahasan hasil penelitian menunjukkan bahwa: 1). Meningkatnya permohonan Dispensasi Nikah di masa pandemi ini disebabkan oleh pergaulan anak dengan pembatasan kegiatan belajar sehingga waktunya lebih banyak digunakan untuk bermain gadget yang tidak lazim dan kurangnya pengawasan orang tua, hal ini menjadikan banyak faktor yang dapat menjerumuskan mereka. 2). Employees of the federal courts' apparatus, in accordance with the current regulations, are public civil servants. In practice and in existing scientific research there is an approach to determining the legal status of this category of public servants through their duties, without specifying the specific requirements for candidates for the position to be filled. The purpose of this study is to define additional qualification requirements to be imposed on the applicant for the position of State Civil Service «Court Secretary» in court, in addition to those contained in the Federal Law «On State Civil Service of the Russian Federation» and orders of the Judicial Department of the Supreme Court of the Russian Federation. The tasks of this work are to study the theoretical foundations of the concept of «status of a State civil servant », to compare federal legislation, decrees of the President of the Russian Federation, decisions and other acts of ministries and departments in the field of the State civil service in the apparatus of federal courts; Justification for the need to include in the status of a public servant serving in the court apparatus additional requirements for the level of education. The methodological basis of the present study was the general scientific methods such as analogy, derivation, system analysis, as well as the private scientific methods: formal-logical, technical-legal and comparativelegal in their various combinations. The study concluded that it was necessary to distinguish the status of federal court staff according to the level of education required to replace a public civil service post, in particular the «Registrar of the Court».

The prosecution of serving heads of state before international criminal courts is still very challenging even though most of these courts do not recognise immunities for international crimes. While the recognition of head of state immunity before national and foreign domestic courts for international crimes is supported by customary international law, the recognition of immunities before international criminal courts is determined by the statute creating the court.. Consequently, while the Rome Statute creating the International Criminal Court (the ICC) does not recognise any form of immunity, the Malabo Protocol creating the African Criminal Court (the ACC) recognised the immunity of senior serving state officials for international crimes. Currently, the ICC is investigating the situation in Ukraine which may lead to the possible arrest of President Putin of Russia and his senior officials for crimes against humanity and war crimes committed when Russia invaded Ukraine. The article argues that prosecuting a serving president like Putin by the ICC may be similar to the Al Bashir case because it will be difficult to arrest and surrender him to the Court and also the fact that Russia is not state party to the Rome Statute. Consequently, the waiving of immunity before an international court is not enough; cooperation by the home state of the offender and other states is needed in matters arrest and surrender to the prosecuting court.

Proposals for addressing this state court funding crisis have emphasized public education and the creation of coalitions to influence state legislatures. These strategies are unlikely to succeed, however, and new institutional arrangements are necessary. Dedicated state trust funds using specific state revenue sources to fund courts offer the most promise for adequate and stable state court funding.

The constitutional protections toward crime witnesses in Indonesia are indisputably inevitable. As an effort to uphold justice, Indonesia relies on the formal mechanism of criminal law known as the criminal justice system. The system starts from reports by the police, prosecution by the prosecutor, to the stage of a trial in a court, and execution in a prison. Throughout its development, the criminal justice system seemed to focus more on protecting criminal offenses (criminal oriented) rather than paying attention to the rights of witnesses and victims (witness and victim-oriented). Therefore, the studies that concern the rights of witnesses and victims are highly needed in order to figure out ways to balance the treatment between the suspects/defendants and the witnesses and victims. Through the use of the statue approach and conceptual approach, the positions and the rights of legal protection for witnesses and victims are thoroughly captured and described in this current research. Besides, the factors causing uneven attention and unfair treatment toward crime victims are also specifically identified.

This Note argues that courts should interpret 28 U.S.C. § 1441, which permits removal from state court to federal court, to allow removal from state administrative agencies when the agency performs “court-like functions.” Circuits that apply a literal interpretation of the statute and forbid removal from state agencies should adopt this “functional” approach. The functional approach, which this Note calls the McCullion-Floeter test, should be modified to comport with legislative intent and public policy considerations: first, state agency adjudications should not be removable when the adjudication requires technical expertise, which federal courts cannot obtain because they adjudicate cases in a variety of subject areas; second, they should not be removable where an agency’s authorizing statute demonstrates a clear legislative intent to prefer plaintiffs. Absent either of these features, however, court-like agency adjudications should be removable.

Abstract Article 20(3) of the Rome Statute bars the International Criminal Court from trying a person for conduct proscribed by the Statute if the person has already been tried in relation to the same conduct before “another court,” provided that the proceedings in the other court were genuine. The article discusses application of Article 20(3) of the Rome Statute and, by implication, of the Court’s admissibility framework to non-State courts. It argues that Article 20(3) applies where there has a been a trial before a court of a State, whether that State is a party or not to the Rome Statute. Article 20(3) can in principle apply to a trial before a non-State court were the trial to satisfy the customary international law rules on attribution of conduct to a State.

Though the buying pieces of the Classic and Italian art of the Petrine time seemed to lack strategy, one can perceive some tendencies that show an aim to create what the German call Antikensammlung, a collection of Classic art kept at the royal court and organized under museum principles. One of plausible proves of this activity is an unfulfilled project made by Iuriy Kologrivov, who was busy buying pieces of art for the Imperial compilation in Rome. Having acquired some education as an architect, he proposed to Peter the Great an extant draft of the Venus’ Gallery meant to adorn his residence. For the center of the composition the statue of the Tauride Venus was chosen. Whereas this masterpiece was purchased by chance almost last of all, the average quality of the whole collection seems to be rather high, the display having been planned not as decorative one, but as an exhibition based on both art and historic principles. Some new for Petrine culture context traits include discrete exposition of Classic statues (and their copies) and modern Italian pieces along with presence of several statues of the same character (untypical for garden and interior decorative style of the period). This way of thinking coms back to Kologrivov’s culture experience gathered in Italy and even in a shape of an unrealized proposal is an interesting example of a classic art museum space and reflected the latest trends in perception of the Antiquity in Russia and Europe in the beginning of the 18th century.

Penelitian ini bertujuan untuk mengetahi dan mengkaji 1) status Kepulauan Senkaku menurut Hukum Internasional, 2) Penyelesaian Sengketa Internasional Kepemilikan Kepulauan Senkaku antara China dan Jepang. Penelitian ini merupakan penelitian yang menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statue approach), pendekatan sejarah (historical approach) dan pedekatan fakta (fact approach). Data yang diperoleh dan diolah adalah data sekunder, pengumpulan data dilakukan mengunakan metode studi kepustakaan dengan mengumpulkan bahan hukum dan informasi yang berupabahan hukum primer, sekunder, maupun tersier. Dalam rangka mendapatkan pemaparan yang jelas, data-data tersebut kemudian disusun secara sistemmatis dan dianalisis dengan menggunakan metode deskriptif. Hasil penelitian ini menunjukan bahwa 1) Kepulauan Senkaku, Kepulauan yang tidak ada penghuni dan Kepulauan yang dalam setatus Quo, terbukti kedua negara China dan Jepang saling meng klaim ketika mengetahi adanya sumberdaya alam yang melimpah di Kepulauan Senkaku. 2) Dari semua perjanjian yang pernah dilakukan China dan Jepang tidak juga menemukan titik temu, China dan Jepang dapat menempuh cara-cara penyelesaian sengketa internasional. Sesuai dengan Pasal 33 Piagam PBB yang menyatakan, para pihak dalam suatu persengketaan yang tampaknya sengketa tersebut akan membahayakan perdamaian dan keamanan internasional, harus pertama-tama mencarai penyelesaian dengan cara negosiasi, penyelidikan, mediasi, konsiliasi, abitrase, pengadilan, menyerahkannya kepada organisas-organisasi atau badan-badan regional, atau cara- cara penyelesaian damai laiannya yang mereka pilih. Maka penyelsesaian yang harus dilakukan China dan Jepang yaitu penyelesaian sengketa secara damai, seperti Negosiasi, pencarian fakta, jasa-jasa baik dan apabila tidak juga menemukan penyelesaian, dapat menempuh International Court Of Justice / Mahkamah Internasional.

The article contains a theoretical analysis of the doctrinal and legislative foundations of arbitration proceedings in the Russian Federation, as well as the legal status of the arbitration court in the system of protection of violated or disputed civil rights. The authors begin their research with a description of the existing methods of protecting rights. The arbitration court is referred by the legislator to the number of subjects exercising legal protection and is actually equated in its legal status with state courts. Despite the indisputable private law nature of the arbitration court, it has historically been and remains the only state-recognized subject of private law, whose decisions are subject to compulsory execution, if necessary. In addition, the decision of the arbitral tribunal, which has become binding on the parties to a legal conflict, is the basis for refusal to accept a statement of claim filed with a state court and containing a claim that is identical to that already considered by the arbitral tribunal. Therefore, it can be argued that arbitration is the only alternative to state legal proceedings (as opposed to mediation and all other ADRs). The difference between arbitration proceedings and mediation and other out-of-court conciliation procedures is shown. The issue of the correlation between arbitration courts and religious courts, as well as other public organizations providing services for the resolution and settlement of conflicts in the social sphere, has been analyzed. The conclusion is made about the exceptional position of arbitration courts, which do not allow attributing religious courts and other public organizations to them

Protection of intellectual property laws can be started from the action of preventing the entry or exit of goods from a country. The Directorate General of Customs and Excise, Ministry of Finance of the Republic of Indonesia, which is the implementing agency in the customs sector, can control the import or export of goods suspected of being or originating from the result of intellectual property infringement. It is a financial activity involving several institutions including the Directorate General of Customs and Excise, the Ministry of Finance of the Republic of Indonesia as executor, the Directorate of Trademarks, the Ministry of Law and Human Rights as the institution that issues trademark rights and the Commercial District Court to exercise judicial authority. Its implementation, regulations have been made regarding the processes and conditions for controlling the export and import of goods, which accommodate the interests of the state as a regulator with the aim of regulating and harmonizing customs regulations and trademark law and the interests of rights holders or mark owners as the injured party if there is an infringement. However, there are arrangements that are "considered" to be detrimental to the right holder or registered mark owner, that is in relation to the domicile of the party applying for trademark protection in the customs area. This research uses a normative research type and a statue approach as well as a conceptual approach. So that with this research the brand owners or rights holders can determine the right steps to protect the registered marks in accordance with applicable regulations.

Credit settlement process if the debtor is malicious, the bank is based on a substitution power of attorney from the debtor made a notariil Fiduciary deed and registered with the Fiduciary Office, the debtor makes a sale under the hands, the sale of collateral is voluntary, the result is submitted to the bank to repay the loan, the bank can conduct the auction in general and through the Court.

The village official election for the position of hamlet head in Aursati Village in 2022 has led to a prolonged conflict between the village government and the candidate for hamlet head who got the highest score. This study aims to identify the resolution of village official conflicts in Aursati Village, Tambang Sub-district. This descriptive qualitative study used the statue approach and conceptual approach. Results: First, the process of selecting a candidate for hamlet heads in Aursati Village caused conflict in which the village head of Aursati issued a decree for appointing and inaugurating a hamlet head with a lower score. This resulted in the loss of the hamlet head candidate who got the highest score. Participants who get the highest score felt disadvantaged because their rights were taken away for subjective reasons that could not be proven. Thus, this case was handled legally by filing a complaint to the Pekanbaru Administrative Court. Second, the appointment and dismissal of village officials have been regulated in the Kampar District Regulation Number 12 of 2017, but there were still shortcomings and weaknesses as it has not covered the resolution of conflicts arising from the results of the village official election for the position of hamlet head.

Abstract: This article researches the problem of establishing causal link in Member State liability cases under European Union (EU) law. It tackles the presumption that the condition of direct causal link is left to national courts to determine. The author examines EU legal rules concerning the Member State liability and their interaction with national law. As an example of national law, the author examined German State liability law and those of its rules that are relevant for causation in Member State liability cases. The results show that the case law of the Court of Justice of the European Union influences the establishment of the causal link before national courts in Member State liability cases. Résumé: Le présent article traite du problème de l'établissement du lien causal dans des affaires de responsabilité d'un Etat membre en droit de l'UE. Il soulève la presumption selon laquelle il appartient aux cours et tribunaux nationaux de déterminer la condition du lien causal direct. L'auteur examine les règles du droit de l'UE concernant la responsabilité de l' Etat membre et leur interaction avec le droit national. A titre d'exemple de droit national, l'auteur analyse le droit de la responsabilité de l'Etat allemand et celles parmi ses règles qui s'appliquent au lien de causalité dans des cas de responsabilité d'un Etat membre. Les résultats indiquent que la jurisprudence de la Cour de Justice de l'Union européenne influence l'établissement du lien causal devant les cours et tribunaux nationaux dans des affaires de responsabilité d'un Etat membre. Zusammenfassung: Die vorliegende Arbeit untersucht die Frage der Feststellung des Kausalzusammenhangs in Fällen der Haftung von Mitgliedstaaten nach EU-Recht. Insbesondere wird diese Frage im Hinblick auf die Annahme, dass die Feststellung von der Voraussetzung des unmittelbaren Kausalzusammenhangs den nationalen Gerichten überlassen wird, analysiert. Die Autorin vergleicht EU-Rechtsvorschriften zur Haftung der Mitgliedstaaten mit den Vorschriften des nationalen Rechts. Als nationalrechtliches Beispiel führt sie deutsches Staatshaftungsrecht und für die Fälle der Haftung von Mitgliedstaaten maßgebende Vorschriften an. Aus der Analyse ergibt sich, dass die Rechtssprechung des Gerichtshofs der Europäischen Union die Feststellung des Kausalzusammenhangs in Fällen der Haftung von Mitgliedstaaten vor den nationalen Gerichten beeinflusst.

In each procedural law court, the provisions concerning evidence are regulated. Evidence is the stage where the parties try to convince the panel of judges about the truth of the arguments put forward in a dispute based on valid evidence. Evidence has an important role because the results of evidence can be the basis for consideration by the panel of judges in making a decision. Evidence in the procedural law of the state administrative court is not only carried out in the Indonesian state administrative court but also in the South Korean Administrative Court. The historical development and organizational structure of the South Korean Administrative Court are the basis for analyzing the Evidence in the South Korean Administrative Court. Lessons from the South Korean Administrative Court can see the similarities and differences in the concept of evidence and type of evidence used in the South Korean Administrative Court with the Indonesian State Administrative Court. The approach used in this study is the statutory approach, comparative approach, and conceptual approach.

A law can often be a double-edged sword—its mandate or protection of one right will sometimes come at the cost of another. Compounding this problem of unintended consequences is that laws do not operate in a vacuum. Instead, laws interact with other laws, and if they conflict, courts must determine which will prevail. Determining the validity of class-action waivers in employment arbitration agreements will require reconciling the Federal Arbitration Act’s mandate that arbitration agreements be enforced according to their terms against the National Labor Relations Act’s protection of employees’ right to engage in concerted activities for the purpose of mutual aid and protection. The dispute over the validity of these agreements requires courts to determine which law and congressional policy should prevail. The National Labor Relations Board and circuit courts throughout the country have been unable to reach a uniform decision, which has prompted the United States Supreme Court to grant certiorari on a triad of cases concerning this issue. With a decision from the nation’s highest Court expected during the 2017–18 term, this Comment analyzes the background and legal arguments behind these competing statutes to determine how the Court is likely to rule. This Comment concludes that, given the Court’s previous rulings in arbitration and class-action cases and the recent Supreme Court confirmation of Justice Neil Gorsuch, the Court is likely to rule in favor of validating class-action waivers in employment arbitration agreements.

AbstractInternational criminal courts and tribunals regularly face difficulties in obtaining cooperation from States, a stumbling block that hinders the process of bringing criminals to justice and trying them before a court of law. In doing so, States can be held accountable under the rules of state responsibility. This possibility was raised in key decisions and scholarly texts on the issue. This paper seeks to expand the discussion on the matter and analyze the responsibility of States for their failure to cooperate with international courts. Additionally, this paper suggests amendments to the ICC Rome Statute to strengthen the judicial assistance regime, considering that this court is designed to become the permanent court dealing with war crimes and crimes against humanity and that a review of the Statute is to take place in May or June 2010.
