Abstract:
The Constitution of Republic Indonesia is absent to describe Pancasila as the rule that forms an underlying basis for a legal system in Indonesia. It might become a problem when the majority number of statesmen is difficult to find a legal reference regarding Pancasila as the basic norm in Indonesia. This article aims to discover the position of Pancasila as the basic norm in statutory system in Indonesian, and how Pancasila is implemented in the construction of Indonesia legal system. Pancasila as the basic norm is reflected in the preambule of 1945 Constitution and in article 1 (3) of 1945 Constitution. Prior to the amendment of 1945 Constitution, explaination regarding Pancasila as a basic norm was stipulated in MPRS Decree XX/MPRS/1966 regarding Source of the Law Governance Republic Indonesia and Hieararchy of Law and Regulatin in Indonesia, also MPR Decree II/MPR-RI/1978 regarding Guidline of Implementation Pancasila or Eka Prasetya Pancakarsa. Furthermore, after the amendement of 1945 Constitution, Pancasila as the basic norm might be found in Law Number 12 Year 2011 regarding Establishment of Legislation and Presidential Regulation Number 87 Year 2014 regarding Implementation Regulation of Law Number 12 Year 2011 regarding Establishment of Legislation. The concept of Pancasila as the basic norm is implemented as micro aspect which is in the principle of statutory making, and macro aspec as the foundation of rule of law as well as legal development in Indonesia.

Abstract:
This article aimed to discuss the selection system of Constitutional Court Judges in Indonesia. The standardization of the recruitment system in the selection of candidates for Constitutional Court judges performed by DPR, the President, and the MA has varied due to multi-interpretations of the provisions of Article 20 (1) & (2) of Constitutional Court Law, contrary to the fact that the Third Amendment to Constitutional Court Law sets forth the mandate to selection committees. The model of the recruitment system has not been constitutionally optimal, while the process mechanism should meet transparency (involving public knowledge), participation (getting the public involved in every process), objectivity (competency-based), and accountability. However, several recruitment practices have overlooked those principles, urging further evaluation of the recruitment to take place comprehensively. One gate system in the recruitment with the assistance of the selection committees seems to be inevitable and simultaneously serves as the solution to reconstruct the system into a more standardized one in the time to come. Moreover, the selection committees must be true statesmen since they hold the authority to verify and select other statesmen as the candidates for the recruitment. The involvement of credible, professional, objective, transparent, and participative selection committees is expected to help achieve legal objectives and intent as wished by the constitution and to bring about the spirit of the prophetic law that serves as the core of the subject matter.

Abstract:
There is an unclear definition regarding the qualification of a statesman in the candidacy of Constitutional Court Justices. In addition, no assessment is used to search for those who qualify as statesmen. This study aims to determine the nature and characteristics of statesmen as an indication of the selection mechanism of Indonesian Constitutional Court Justices and evaluate whether the selection mechanism may produce justice with statesman qualification. The research method is normative and empirical legal research, which uses philosophical, historical, conceptual, and statute approaches. The result shows that the concept and nature of statesmanship as a requirement for Constitutional Court Justices is based on the Republic of Indonesia's Constitution and the Constitutional Court Law, which states that Constitutional Court Justices must meet the requirements such as integrity and impeccable personality, fair; and statesman who control the Constitution and state administration. However, the recruitment procedure is excessively more political and unstandardized. Therefore, the current mechanism for selecting Constitutional Court Justices may not generate Justices with statesman-like behavior. The research recommends that in the future, the selection mechanism of the Constitutional Court Justices needs to be reconstructed to produce Justices with statesman qualifications by having a more transparent procedure.

Abstract:
This study examines Indonesia’s sinking of illegal fishing ships influencing its relationship with countries in Southeast Asia region. Considering that the loss of and damages to national resources due to illegal, unreported, and unregulated (IUU) fishing in Indonesia are so huge, President Joko Widodo has a commitment to no longer tolerate such a crime. The approach of his Minister of Maritime and Fishing Affairs has been to sink IUU Fishing ships which mostly flagged foreign flags. As a result, Indonesia’s relation with neighboring countries is affected. However, the assertive policy of Indonesia did not lead to a commotion among the states in the region. Hence, this study attempts to discover why Indonesia does not find significant obstacles to continuously carry out sinking foreign IUU fishing ships from its counterparts in Southeast Asia region namely Malaysia, Thailand, Vietnam, and the Philippines. Statements of the statesmen around the countries and other related documents on the matter are used to examine their response to the Indonesia’s policy. In line with the method, this study capitalizes neoclassical realism by Gideon Rose in which foreign policies are considered a reflection of systemic pressure, domestic political demands (innenpolitik), and state power.

Abstract:
AbstractAs a significant ‘moment’ in twentieth-century international diplomacy, the rise of post-colonial Afro-Asia at the Bandung Conference of 1955 is replete with symbolic meanings. This paper proposes a conceptual approach to understanding the symbolic dimension of international diplomacy, and does so by ruminating on the newly unearthed Indonesian material on the Bandung Conference. To this end, ‘diplomacy as theatre’ is introduced as an interpretive framework to re-cast the conference as a theatrical performance, in which actors performed on the stage to audiences. Focusing on the city of Bandung, this paper reconstructs some examples of the ‘performative’ dimensions of international diplomacy, and elaborates on the notion of ‘staging’ the city and the role played by the people of Bandung, including the significance of conference venues, as well as the impromptu creation of a ritual citation that contributed to an iconic ‘performative act’ during the conference. Sukarno, Nehru, Zhou Enlai and Nasser all understood the importance as performers in their role as new international statesmen, representing the esprit de corps of the newly emergent post-colonial world. In deconstructing the symbolic, it will become evident that the role played by Indonesia significantly influenced the underlying script of the diplomatic theatre which unfolded at Bandung.

Abstract:
M. Natsir was one of the most prominent figures in religious discourse and movement in Indonesia. He was ada’wa reformer as well as a politician and a statesman. His most well known ideas were about the relationship between Islamand state, Islam and Pancasila, and his idea on da’wa. He stated that a country would be Islamic because of neither itsformal name as an Islamic state nor its Islamic state principles. The principles of the state could be generally formulated aslong as they referred to the Islamic values. Natsir also stated that the essence of Pancasila didn’t contradict with Islam; evensome parts of it went after the goals of Islam. However, it didn’t mean that Pancasila was identical with Islam. In relation toda’wa, he stated that it should be the responsibility of all Muslims, not only the responsibility of kyai or ulama. To make ada’wamovement successful, he suggested that it needed three integrated components; masjid, Islamic boarding school, andcampus.

Abstract:
This article aims to provide understanding of Ahmad Syafi’i Ma’arif, an Indonesian statesman and religious leader, over QS. An-Nisa: 34 with the discourse of gender equality in the contextualization of Islamic teachings in Indonesia, including the role of women in public space. The important point of understanding Ahmad Syaf’i Ma’arif is in his ability to give a central, non conservative and illiberal in raising the leadership spirit of women according to Islam and the state. Syafi’i Maarif assessed that the context discourse between Arab-Indonesia can not be ignored when the reader want to understand the content of QS. An-Nisa: 34. Arab women have its own space and dynamism, that is different from women in Indonesia, so this context is influential in understanding the Qur’an. The notion of the gender equality of Syafi’s Ma’arif is that there are certain circumstances, such as pregnant and childbirth, that only women can do. The efforts of Ahmad Syafi’i Ma’arif in contextualizing QS. An- Nisa: 34 is an important work on the ground of the Qur’an as a guideline (QS. Abstract:
Democracy has grown since the time of Ancient Greek civilization with the concept of Greek city states and Athens in 450 BC and 350 BC. Even in 431 BC, Pericles, a well-known Athenian statesman, defined democracy by putting forward several criteria: (1) government by the people with full and direct participation of the people; (2) equality before the law; (3) pluralism, namely respect for all talents, interests, desires and views; and (4) respect for a separation and personal area to meet and express individual personality (Roy C Macridis, 1983:19-20). In the same era, we can also get acquainted with the political thoughts of Plato, Aristotle, Polybius and Cicero, etc., to mention some of the thinkers of that time, who also laid the foundations for the notion of democracy. During its development, the concept of democracy underwent an increasing fertile phase and moved towards moderation during the Renaissance. So far, great thoughts have arisen about the relationship between the two rulers or the state on the one hand and the people on the other. There are new and surprising thoughts about the power and thought of Niccolo Machiavelli (1469-1527). On the Social Contract and the Separation of Powers by Thomas Hobbes (1588-1679), Jhon Locke (1632-1704). Many of these big names have thoughts of contributing significantly to efforts to redefine or implement the term democracy.

Abstract:
As a reslut of forced Christianization, the motherland threatens to alienate the indigenous population of our colonies from herself.’ With this slogan a combination of left-wing political parties entered the elections for the Dutch Parliament in June 1913. This combination won the elections and in the end it was the liberal Cort van der Linden who was commissioned to form a government. The then governor-general of what was called the Dutch East Indies, the Christian statesman A. W. F. Idenburg (1861-1935), consequently considered relinquishing his post, now that a government would be formed of a political colour different from his own. On the advice of the leader of his party, the Dutch politician, journalist, and church leader Abraham Kuyper, however, he decided that his decision to stay or to resign would depend on the possibilities of co-operation with the new minister of colonial affairs. But he had no illusions about the opinion of the European press in Indonesia. ‘Against me,’ he wrote in a letter to the outgoing minister of colonial affairs, J. H. de Waal Malefijt (1852-1931), a fellow party member, ‘a devilish howling has burst out in some of the papers. They all agree that I must go.’

Zionis, Rijal Mumazziq. "Relasi Agama dan Negara Perspektif KH. A. Wahid Hasyim dan Relevansinya dengan Kondisi Sekarang." al-Daulah: Jurnal Hukum dan Perundangan Islam 5, no. 2 (October 1, 2015): 333–59. http://dx.doi.org/10.15642/ad.2015.5.2.333-359.

Abstract:
Abstract: KH. A. Wahid Hasyim is a progressive and a dynamic Muslim thinker. As a Muslim scholar, he was consistent in his Islamic thought. At the same time, as a statesman, he put the unity of the nation above anything else. The struggle that is worth to be noted here is that although he offered Islam as the state principle by supporting the inclusion of the seven clauses of the Jakarta Charter, but he was willing to remove the seven clauses for the sake of securing unity and integrity of the nation. In Islamic political theory, he is classified as a substantive thinker who supported the symbiotic relationship between religion and state. Up to now, his thought remains relevant to be implemented in the context of the relationship between religion, nation, and state. It is not enough to justly read and examine KH.A. Wahid Hasyim’s thought, the most important thing is how to apply his idea in Islamic and Indonesia context. He advocated moderation (tawazun), tolerance (tasamuh), middle way (tawassuth), and fairness (i’tidal). These values should always be adopted since they are the inclusive and accommodative principles for the life of the nation. Thus, those principles are still relevant for present Indonesia. Keywords: KH. Wahid Hasyim, religion and state relationship, current condition Abstrak: KH. Pribadi, jejak langkah dan perjuangan KH.A.

Abstract:
Abstract. This article attempts to briefly look at the similarities and differences in the initial conditions for the formation of the two countries: the United States of America and Indonesia, especially in the dynamics of the relations between statesmen and religious leaders, including political relations with religious issues at the beginning of independence until the present. In fact, since 1776, the United States government has chosen a secular-democratic form of state that guarantees freedom of various kinds, and may not protect a particular religion. On the other hand, in Indonesia, although since 1945, the government of the Republic of Indonesia has guaranteed freedom of religion for everyone, in reality, discrimination and persecution of the majority against minorities still often occurs in the name of defending a particular religion. Keywords: The United States of America, Indonesia, issues of religious liberty.

"A Thematic Study of the Quran and Hadith on the Election of Leaders: A Case Study of Presidential Elections in Indonesia in 2024." Abstract:
This article aims to analyze the contestation of the Presidential Election in Indonesia in 2024 using thematic studies of the Qur'an and Hadith. On a theological level, Muslims must determine a Qur'an candidate leader because Muslims in Indonesia will be the largest contributor of votes. The urgency of this research is to formulate the ideal presidential candidate according to Islamic guidance. This article uses qualitative research with a study of literature. Primary data sources in this research are verses of the Qur'an and Hadith. The collected data will be analyzed using the method of Tafsir Madhuri and content analysis. The results show that the value of leaders in the Qur'an and ideal leaders in Indonesia have some correlation with one another. Some criteria are that a statesman must be one with integrity, have ability and competence, be a visionary, be inclusive, should have risk management skills and also problem solving abilities, and especially understanding of the people and a patriotic charisma. Islamic leaders have a significant role in measuring the contestation of the 2024 Presidential Election, but this is not very substantive, considering that all pairs of presidential and vice presidential candidates are homogeneous in terms of their religion. The Qur'anic level of leader criteria can be a further review for the community to determine political dynamics.

Munjid, Achmad. "ABDURRAHMAN WAHID’S CONTRIBUTION FOR INTER-RELIGIOUS DIALOGUE IN INDONESIA." Aqlam: Journal of Islam and Plurality 5, no. 1 (June 18, 2020). http://dx.doi.org/10.30984/ajip.v5i1.1134.

Abstract:
Abstract: By understanding the historical development of inter-religious dialogue in Indonesia and its global setting since 1970s from rhetoric strategy to meaningful encounter, this paper seeks to situate important contribution of Abdurrahman Wahid’s legacy besides those of other key figures in the field. The paper will critically analyze how and why Abdurrahman’s ideas and works in inter-religious dialogue are intertwined with his family and personal biography, socio-political context of the New Order and after and his traditionalist Muslim background. In particular, Abdurrahman’s reinterpretation of Islamic texts, doctrine and tradition will be discussed in the light of his vision for Indonesian democracy. His notion of religious pluralism, tolerance, peaceful co-existence, mutual understanding, and indigenization of Islam will be explained as intellectual and political enterprises by which he navigates and challenges all forms of injustices especially created by the New Order’s politics of fear, exploitation of anti-Communist sentiment, ethnicity, religion, race and inter-social groups (SARA) and developmentalist ideology under Suharto’s presidency. His engagement in inter-religious dialogue will be read against the developing context of the New Order’s post-1965 politics of religion to the 1990s re-Islamization, the persistent growth of Islamic sectarianism, exclusivism, and identity politics that eventually results in interreligious tension and mutual suspicion, especially between Muslims and Christians. The paper seeks to understand how and why Abdurrahman Wahid as a prominent leader of Muslims as majority group explores inter-religious dialogue as a means by which religious communities are supposed to contribute and work together in overcoming common problems faced by the society. His commitment for and advocacy of the local culture, tradition, minority rights, and Islamic inclusivism will be understood as his struggle as statesman, religious leader, public intellectual and social activist for the creation of equality and justice for all citizens and human dignity in accordance with Islamic teaching and principles of democracy. Keywords: Inter-religious Dialogue, Religious Pluralism, Indigenization of Islam, Islamic Sectarianism, Identity Politics, Democracy.
