This chapter starts by considering which version of the Singapore International Arbitration Centre (SIAC) Rules should apply to an arbitration and the meaning of certain defined terms (Rule 1). The SIAC notice provisions (Rule 2) are addressed in Part B. The matters to be covered by a claimant in a notice of arbitration in order to start an arbitration (Rule 3) are then covered in Part C. Finally, the requirements for a valid response to a notice of arbitration (Rule 4) are explained in Part D. Unless otherwise stated, all references to the SIAC Rules are to the 2016 version of the rules.

The text starts by providing an overview. Various torts are then arranged along a spectrum from intentional torts, through negligence, to stricter liabilities. Also considered are issues relating to damages, compensation, limitation, and vicarious liability. After introducing intentional torts, the book looks at the tort of negligence. Chapters also cover nuisance and duties relating to land and defamation and privacy. Finally, stricter liabilities are examined such as product liability.

Abstract:
The tremendous social inequalities provoked by the laissez-faire model of state led to the advent of the ‘Social Question’ and socialism, and finally to state intervention in social matters. First, during the interbellum period, in Soviet Russia, the Fascist and Nazi regimes, and only after 1945 in democratic states where a consolidated welfare state model developed, until in the 1980s its cost began to grow untenably, and governments started cutting taxes and reducing social spending. The welfare state has impacted European legal systems in crucial aspects like the ‘constitutionalization’ of social rights; the appearance of collective bargaining as a source of law; the creation of specific procedures to solve labour conflicts, as the mixed council of workers and employers or the creation of specific public social jurisdictions; and, finally, scholarly social law, that started in Weimar Germany, and later expanded to the UK and most European law schools.

This chapter starts from the view that legal performance matters to law: its outcomes, doctrines, and history. Here, rather than defending that view (a task undertaken elsewhere), it analyzes the methodological issues that arise from it. Distinguishing performances—expressive, embodied legal events, and practices—from both literary and legal texts (the traditional objects of law and literature), it assesses the vexed words “performance” and “performativity” as analytic tools, set against the rich historical lexicon. It then distinguishes “law in performance” and “law of performance” from “law as performance,” arguing that analysis of more familiar interpretive objects (aesthetic performances, legal texts) cannot substitute for sustained attention to legal events and practices. Finally, it briefly outlines some paradigms for understanding legal performance: legal conjuration, enactment, or mimesis; legal surrogation (metaphoric, metonymic, or indexical); and legal theatricality-antitheatricality.

This chapter considers the question of whether arbitration remains client-focused. It looks at two aspects of modern arbitration practice which may not be as client focused as they could, and should, be. The first is the need to reduce the time and cost of arbitration; the second is the fear of arbitral tribunals that their awards will be open to challenge. The discussion starts from the very basic and very obvious proposition that clients’ interests are most likely to be aligned before there is a dispute. Once a dispute has arisen, even the most reasonable of clients can become unreasonable. Thus, if anything is going to be done to address the expensive and time-consuming aspects of the dispute resolution process, it needs to be done before the dispute starts. It needs to be in the rules which will apply to the arbitration.
