In Autran v. State, the Texas Court of Criminal Appeals found "[t]he officers [sic] interest in the protection of appellant's property, as well as the protection of... the agency from claims of theft, can be satisfied by recording the existence of and describing and/or photographing the closed or locked container." Thus, Autran interpreted Article I, Section 9 of the Texas Constitution as requiring less intrusive means than the Fourth Amendment of the U.S. Constitution for conducting automobile inventory searches. This note examines the proper scope of an automobile inventory search as currently defined under federal and Texas law, and discusses Autran's failure to adhere to stare decisis' by unnecessarily overturning previously relied upon precedents.

Abstract:
The article revolves around the doctrine of precedent within the so-called European legal space, wondering whether and to what extent we can speak of a convergence towards a stare decisis model boosted by the harmonizing role of the Court of Justice of the European Union. The article argues that although there are still some differences between civil law and common law legal systems they regard more the style of reasoning and the deep understanding of the relationship between the present decision of a court and past judicial decisions than the very existence of the constraints of the latter upon the former. The article concludes that a sort of mechanism of stare decisis has in fact been created, even though, on the one hand, uncertainty remains as to the way in which the binding force of a precedent concretely operates in the system, and on the other hand, this mechanism relates exclusively to the relationships between past and future decisions of higher courts (horizontal effect). This change, far from being a shift towards a truly judge-made law system or a consequence of the final abandonment of the dictates of the rule of law, enhances legal certainty contributing to the fundamental requirement of stability of law as a feature of the ideal of the rule of law.

Para tal efecto se precisan los conceptos de <em>stare decisis</em> y <em>ratio decidendi</em>. Posteriormente se realiza una reconstrucción de la norma creada por esta alta Corte. Finalmente se analiza dicha norma a luz de diferentes concepciones de normas de obligación, para en consecuencia concluir que la norma creada, en el caso colombiano, es una norma constitutiva.</p>

El presente trabajo pretende demostrar como si bien un ordenamiento sin ningún tipo de regla del precedente resulta disfuncional, tanto la identificación de su ratio decidendi como sus condiciones de aplicación resultan altamente indeterminadas. Para demostrar tal tesis se procede mediante cuatro pasos. En primer lugar, se intenta esclarecer el concepto de precedente, adoptando un concepto amplio, y analizando en qué sentidos aquellos pueden ser vinculantes. En segundo lugar, se plantea la pregunta acerca de cuándo podemos afirmar que un ordenamiento jurídico contiene una regla del precedente vinculante. En tercer lugar, se presentan algunos problemas en la identificación de la ratio decidendi del precedente. En cuarto lugar, se analizan algunas de las distintas operaciones que se pueden realizar con un precedente. Por último se proponen algunas conclusiones provisionales.

Webster v. Reproductive Health Services represented the first occasion in which a state, defending a challenge to its abortion laws, called for the Supreme Court to reconsider Roe v. Wade. Building on the tools of the economic analysis of law, we will try to solve the riddle of precedents in the World Trade Organization (WTO). In the first part of the article, it will be shown how the traditional economic models used to advocate the efficiency of stare decisis do not capture its distinguishing traits due to oversimplification. Second, it will be argued that a de jure regime of stare decisis is ill suited to the peculiar nature of WTO's litigation. More precisely, the action of interest groups and the intricacies characterizing the legislative process of the WTO create incentives that are drastically different from private litigation.

In Kisor v. Wilkie, the Supreme Court recently confronted whether to overrule the doctrine under which courts defer to agencies’ interpretations of their own ambiguous regulations—so-called Auer or Seminole Rock deference. In its prior reexaminations of Seminole Rock, the Court had progressively restricted the doctrine’s scope, leading observers to wonder whether the Justices would scrap it for good. This question of administrative law ignited a corollary debate about stare decisis. Writing for the majority, Justice Kagan argued that stare decisis mandated the preservation of Seminole Rock. Yet as she appealed to stare decisis, her opinion further restricted the conditions under which deference applies. Concurring in the judgment, Justice Gorsuch contended that the majority was wrong to invoke stare decisis while simultaneously modifying the doctrine in basic respects. Preservation of precedent, in his view, was inconsistent with its continued modification. Embedded in Justice Gorsuch’s opinion was a deep question about identity over time: If a precedent is heavily modified through subsequent case law, may the final case “reaffirming” and further modifying the precedent justifiably trace its lineage to the original case announcing the principle, such that the principle’s supposed “antiquity” lends it enhanced stare decisis weight? This Article, extending Justice Gorsuch’s critique, answers in the negative. Continuous and profound modification of a precedent casts doubt on the quality of the Court’s original reasoning and erodes the connection between earlier and later cases, thus weakening the stare decisis weight due the precedent upon its reconsideration.

It is widely held that the common law doctrine of stare decisis, which recognizes judicial decisions as sources of law, applies neither to international law in general nor to World Trade Organization (WTO) law specifically. However, in practice, the WTO’s judicial decision-making processes might be said to manifest some of the key characteristics of the common law doctrine of stare decisis. The present study examines the key values and processes related to stare decisis, including consistency and certainty of law, identification of the ratio decidendi of a case and the rules of vertical and horizontal binding precedent as located within the hierarchy of the courts. The WTO’s institutional and regulatory frameworks, as well as key WTO cases, are considered in examining the extent to which the decision-making processes of the Dispute Settlement Body incorporate the doctrine of stare decisis.

Dari hasil penelitian ini diketahui bahwa Hakim dalam menjatuhkan Putusan Nomor 380/Pdt.G/2021/PN Mdn dan Nomor 604/Pdt.G/2021/PN Mdn tidak mengikuti prinsip peradilan stare decisis karena hakim memutuskan bahwa hak asuh anak di bawah umur jatuh kepada ayahnya. This research is a normative legal research that is descriptive in nature with a case approach. This research uses types and sources of legal materials consisting of primary and secondary legal materials. The technique for collecting legal materials is done through literature study. From the results of this research, it is known that the Judge in issuing Decision number 380/Pdt.G/2021/PN Mdn and Decision number 604/Pdt.G/2021/PN Mdn did not follow the principle of stare decisis because the judge ruled that custody of children under age fell to their father. We find that relative to judges retained by institutions such as judicial commissions or state legislatures, those retained via either partisan or retention elections are significantly more likely to join majorities that overturn precedent. Most of this effect is due to behavior in high-profile cases that garner media attention. We find little evidence that an impending election moderates these effects. Finally, we find no evidence that judges retained via nonpartisan elections treat precedent differently than their institutionally retained colleagues.
