In Autran v. State, the Texas Court of Criminal Appeals found "[t]he officers [sic] interest in the protection of appellant's property, as well as the protection of... the agency from claims of theft, can be satisfied by recording the existence of and describing and/or photographing the closed or locked container." Thus, Autran interpreted Article I, Section 9 of the Texas Constitution as requiring less intrusive means than the Fourth Amendment of the U.S. Constitution for conducting automobile inventory searches. This note examines the proper scope of an automobile inventory search as currently defined under federal and Texas law, and discusses Autran's failure to adhere to stare decisis' by unnecessarily overturning previously relied upon precedents.

Abstract:
The value of “precedent” in the case law of the Court of Justice of the European Union and the attempt to identify its characteristics within the European Union legal framework cannot be proceeded without the preemptive analysis of the legal reasoning and of the creative role of the judge. The role of the precedent in the legal reasoning and in the interpretation of the European Union law, as well as the unanimously accepted capacity of the judge to “create” law, are to be indented as the pivotal conditions allowing the development of a stare decisis system. The second part of the present thesis is focused on the peculiar features of the judicial precedent in the case law of the Court of Justice. In particular, we could notice, firstly, the absence of a clear definition and distinction between the concept of ratio decidendi and obiter dicta; secondly, we underline the need to overcome the classical distinction between persuasive precedent and binding precedent, in order to properly evaluate the scale of value that the precedent can take following the use and the function that is playing from time to time. Moreover, the analysis of the efficacy of the precedent will be confined, in this second part of the work, to the “self-precedent” of the Court, meaning to the obligation for the judge to follow his own precedent. The analysis will then highlight the role of precedent in case it is overruled or distinguished by the Court: practice that, ultimately, has to be conceived as a confirmation, as well as a recognition, of the precedent’s value. Furthermore, in spite of the absence of a doctrine of precedent in the European Union legal system, we recall two circumstances in which the judicial precedent assumes a de facto binding value. Firstly, we analyse the use of precedent in the decision-making activity of the judge, and then those norms of the rules of procedure that required the Court of Justice to decide by explicit reference to the previous judgment. Lastly, the analysis will be focus on the efficacy of the Court’s precedent with respect to the Tribunal is the evaluation of the impact of the vertical relationship between the two judges and the extension to which the Tribunal is bound by the Court’s as well as in the relationship between the Court and the national judge.

A primeira parte analisa os princí­pios constitucionais da isonomia, da rule of law e democrático como fatores justificadores e legitimadores da adoção da doutrina do stare decisis, na medida em que asseguram coerência e consistência nas decisões judiciais e concretizam o ideal de segurança jurídica e justiça. A segunda parte analisa o papel desempenhado pelas Cortes Judiciais nos Estados modernos, descreve a analisa criticamente os diversos modelos teóricos de aplicação da doutrina do stare decisis com o objetivo de estruturar uma teoria coerente os fundamentos doutrinários para uma correta aplicação da doutrina e, finalmente, elabora os princípios institucionais que governam o abandono da doutrina anteriormente estabelecida para harmonizar as tensões entre as necessidades de estabilidade e flexibilidade da ordem jurí­dica, que decorrem das demandas da segurança jurídica e as exigências dos princípios morais mutáveis concernentes à justiça social.
This present Ph.D. thesis in Constitutional Law is about stare decisis which imposes to the inferior Courts the duty of obeying and following the judicial Superior Courts precedents. This thesis is divided in two parts. The first part analyses the constitutionals principles of equality, rule of law and democratic as both justifying and legitimating factors of the adoption of the stare decisis, since they both assure coherency and consistency in the judicial decisions and reaffirm the ideal of stability and justice. The second part analyses the role played by Judicial Courts in the modern States, it describes and critically analyses the various theoretical models about the stare decisis doctrine in order to develop a coherent theory for a correct use of the doctrine and, finally, develop the institutional principles that the rule the overruling to harmonize the tensions between the needs of stability and flexibility of judicial system, that come from the demands of juridical certainty and the demands of the changing moral principles that concern to the social justice.

The nature of the Italian Court of cassation is now undergoing profound changes. The present Doctoral Thesis seeks to read this metamorphosis by tracing the events that led to the development of the model of the French cassation, in ancien régime and in the revolutionary context, and that of stare decisis, structured in the English Seventeenth Century and established in the Nineteenth Century in line with the reform of judicial structures.

Abstract:
Much of our current understanding of how consumers shop for goods and services is based on cross-sectional analyses of end-of-trip variables (e.g., basket composition, total spending) that has largely assumed purchase behavior is constant over the course of a shopping trip, however research has begun to demonstrate how an initial purchase can influence a subsequent purchase decision. This suggests shopping behavior may not only vary throughout a shopping trip, but rather is specifically influenced by when a purchase decision occurs within a shopping trip. I build on this foundation through two essays that show how and why a consumer’s in-store purchasing behavior is influenced by both the decisions they have made and the decisions they anticipate to make later. The first essay demonstrates that a consumer’s relative spending— the price of an item, relative to the prices of the other items in the same product category—evolves nonlinearly over a single shopping trip, and this pattern is distinct for budget and nonbudget shoppers. The second essay examines whether and how encountering promotions in-store, but temporally in advance of the promoted product influences a consumer’s redemption decision. These findings suggest that shoppers’ decisions evolve of a single shopping trip as a function of the decisions and evaluations the have made earlier in the shopping trip, as well the decisions they still have left to make. In each essay, implications for researchers and practitioners are presented and opportunities for future research are discussed.

Cortical states, defined as the dynamics of cortical neural activity on the timescale of seconds or more, vary during different behavioural states. Originally associated mainly with the sleep-wake cycle, it is now recognised that cortical states present subtle changes during waking that reflect the cognitive and behavioural demands an individual is pursuing. Therefore, it has been suggested that attention leads to a desynchronised cortical state, characterised by the absence of low frequency oscillations, which is thought to improve the information processing of the object of interest and thereby improve performance in attention demanding tasks. To maximise the beneficial effects of desynchronisation, it has been proposed that this state should occur locally, as this may spot-light the attended feature. I investigated this hypothesis by asking whether attending to a specific sensory modality leads to local desynchronisation of the sensory cortex of the modality being used. I trained mice to perform visual and auditory decision making tasks, and assessed cortical state through spectral analysis of widefield calcium signals. Genetically encoded calcium indicators were expressed in cortical excitatory neurons, and their activity was imaged simultaneously across cortex while the animals were performing the different tasks. Cortical states correlated with task engagement rather than with task performance, and this effect was global. Unexpectedly, the biggest desynchronisation was seen in somatosensory cortex in all tasks, and there was along lasting effect of reward. These effects could not be explained by movement or pupil diameter, a commonly used measure of arousal. Furthermore, desynchronisation correlated with reaction time. Thus, variations in cortical state closely relate to changes in task engagement, demands and outcome. This suggests that desynchronization is not a causal effect of attention that improves performance, but instead may be a cognitive state related to preparing rapid and coordinated responses to sensory stimuli.

Abstract:
Despite what the realists and other critics might say, Australian judges in particular, do take the doctrine of precedent seriously. This is evidenced by the volume of cases that are discussed in this thesis. Included in these cases are numerous decisions of the High Court of Australia. My approach to the topic has been wherever possible, to rely on primary authorities - the cases and legislative provisions - with reference being made to secondary materials only where such materials are of undoubted standing. As a general rule, I have limited discussion to the operation of the doctrine in courts of general jurisdiction, with only occasional references to specialized courts and tribunals such as the Family Court of Australia and Administrative Appeal The Doctrine of Precedent in Australia Tribunals. The focus of the thesis is on what the judges actually do. It is not intended to approach the topic from a jurisprudential perspective. I have not attempted to develop a Grand Theory, but there is a theme: that as Australian judges in courts below the High Court, and in some cases in that court itself, often regard it as 'invidious'1 to have to decide matters for themselves, the judges frequently concern themselves with what the doctrine of precedent demands of them. My approach has been to synthesize many scattered observations on the doctrine of precedent - which has not been done before in Australia. In a number of areas where the rulings and dicta of the courts have left contradictions or a gap I have attempted to derive and to articulate a set of rules from such hints as can be found in relevant judgments. I trust others will find such rules helpful, logical and persuasive. The law is stated as at 31 July 1995.

In recent years, various metrics have been developed for measuring the similarity of states in probabilistic transition systems (Desharnais et al., 1999; van Breugel & Worrell, 2001a). In the context of Markov decision processes, we have devised metrics providing a robust quantitative analogue of bisimulation. Most importantly, the metric distances can be used to bound the differences in the optimal value function that is integral to reinforcement learning (Ferns et al. 2004; 2005). More recently, we have discovered an efficient algorithm to calculate distances in the case of finite systems (Ferns et al., 2006). In this thesis, we seek to properly extend state-similarity metrics to Markov decision processes with continuous state spaces both in theory and in practice. In particular, we provide the first distance-estimation scheme for metrics based on bisimulation for continuous probabilistic transition systems. Our work, based on statistical sampling and infinite dimensional linear programming, is a crucial first step in real-world planning; many practical problems are continuous in nature, e.g. robot navigation, and often a parametric model or crude finite approximation does not suffice. State-similarity metrics allow us to reason about the quality of replacing one model with another. In practice, they can be used directly to aggregate states.

Este trabalho pretende identificar e analisar quais são os critérios mais importantes utilizados pelos Business Angels e pelos Venture Capitalists no processo de tomada de decisão de investimento às start-ups, e posteriormente, compará-los, de forma a verificar se existem diferenças significativas entre os dois tipos de investidores. Para tal recorreu-se à aplicação de um questionário enviado por email, no qual foi solicitado aos participantes que classificassem a importância dos critérios propostos com base numa escala do tipo Likert de cinco pontos, de nada importante a muito importante. No total, foram submetidas 15 respostas, 10 por parte dos Venture Capitalists, e 5 provenientes dos Business Angels. A análise dos dados foi efetuada com recurso à estatística descritiva e as hipóteses foram testadas com base em testes não paramétricos. Os resultados indicam que, para os dois tipos de investidores, os critérios mais importantes dizem respeito aos aspetos relacionados com o produto.
This study pretends to identify and analyze the most important criteria used by the Business Angels and the Venture Capitalists in the investment process to start-ups, and then, compare them, in order to verify whether there are significant differences between the two types of investors. To this end was used a questionnaire sent by email with a Likert scale with five points, (between “not important at all” and “very important”), where the investors were asked to rate the importance of the proposed criteria. In total, 15 responses were submitted, 10 by the Venture Capitalists and 5 from the Business Angels. Data analysis was performed using descriptive statistics and hypotheses were tested using non-parametric tests. The findings show that, for the two types of investors, the most important criteria are related to the aspects of the product.

In writing this edition of State of the Nordic Region, it was, of course, vital to acknowledge the impact of the Covid-19 pandemic. Abstract:
Suriname is highly vulnerable to the effects of climate change. Among the factors that exacerbate its vulnerability are its dependency on fossil fuels, the degradation of important ecosystems (e.g., mangroves), and the fact that 87% of the population, and most of the countrys economic activity is located within the low-lying coastal area. Many sectors are at risk of suffering losses and damage caused by gradual changes and extreme events related to climate change. For Suriname to develop sustainably, it should incorporate climate change and its effects into its decision-making process based on scientific- evidence. The State of the Climate Report analyzes Surinames historical climate (1990-2014) and provides climate projections for three time horizons (2020-2044, 2045-2069, 2070-2094) through two emissions scenarios (intermediate/ SSP2-4.5 and severe/ SSP5-8.5). The analysis focuses on changes in sea level, temperature, precipitation, relative humidity, and winds for the seven subnational locations of Paramaribo, Albina, Bigi Pan MUMA, Brokopondo, Kwamalasamutu, Tafelberg Natural Reserve, and Upper Tapanahony. The Report also analyzes climate risk for the countrys ten districts by examining the factors which increase their exposure and vulnerability on the four most important sectors affected by climate change: infrastructure, agriculture, water, and forestry, as well as examining the effects across the sectors. The State of the Climate Report provides essential inputs for Suriname to develop and update its climate change policies and targets. These policies and targets should enable an adequate mainstreaming of climate change adaptation and resilience enhancementinto day-to-day government operations. It is expected that the Report will catalyze similar efforts in the future to improve decision-making by providing science-based evidence.
