Abstract This article challenges the traditional view that informal sponsalia (as described in D. 23,1) were legally unenforceable in classical Roman law. After a close examination of the contents and structure of D. 23,1 and related Digest texts, it offers a new interpretation of a crucial passage from Aulus Gellius (Noctes Atticae 4.4), which has traditionally been read as showing that Roman sponsalia were unenforceable. The article then concludes with a consideration of the literary evidence offered by Varro, Plautus and Ovid.

This study provides a description of the Mediterranean monk seal (Monachus monachus) diet from the Aegean Sea coast of Turkey. A total of 23 prey items belonging to five species were identified from the two stomachs examined. Cephalopods constitute the dominant prey group by weight (94·01%). Sarcotragus sp. (Porifera) and Posidonia oceanica (Magnoliophyta) are assumed to be incidental prey. Of the cephalopods identified, Eledone moschata and Bathypolypus sponsalis were encountered for the first time in a monk seal stomach.

A sample of 360 Bathypolypus sponsalis from the central western Mediterranean Sea (the Sardinian Channel and the Tyrrhenian Sea) was analysed in order to describe size, depth distribution and reproductive data. The first record of the species in the Tyrrhenian Sea and of a spent female are reported in this paper. The size-structure of the sample was in between values of documented data from the western and eastern Mediterranean basins and the minimum mature sizes in both sexes and spermatophore length were similar to previous data from the eastern Mediterranean Sea. Low values of gonadosomatic index and fecundity, the asynchronous ovulation, in addition to an extended reproductive period, have been associated with an intermittent spawning strategy.

La ricerca si propone di indagare il ruolo del consenso nell’ambito degli sponsalia entro una prospettiva diacronica, partendo dal fidanzamento ‘arcaico’ per giungere a quello ‘classico’. Particolare attenzione viene riposta alla tutela processuale della sponsio di fidanzamento di età arcaica e al cambio di mentalità intorno al 90 a.C., che porta l’ordinamento a negarla giudicandola contraria alla morale. Viene quindi presa in esame, con riferimento all’età classica, la rilevanza del consenso dei diretti interessati, espresso con varie modalità, al fine di delineare un sistema di responsabilità consapevole di tipo ‘pre-familiare’.
The present research aims at investigating the role of agreement on the field of the "sponsalia" in a diachronic perspective, from the archaic betrothal to the classical one. Special attention is paid to the legal protection of the betrothal "sponsio" in archaic age and to the change of mentality occurred around 90 BC, which led the legal system to deny that, because it was deemed contrary to morality. With regard to the classical age, the relevance of the variously expressed agreement of the people involved has been taken into consideration in order to delineate a premarital kind of "informed liability" system.

Viene proposta una lettura dei Promessi sposi alla luce del principio della complessità, sviluppato secondo l’ottica della teoria sistemica. Il raffronto tra due testi teorici: la Lettre à M.R C*** sur l’unité de temps et de lieu dans la tragédie e Del romanzo storico e, in genere, de’ componimenti misti di storia e d’invenzione ha evidenziato come l’idea di complessità, e dunque di relazione, insita nello sviluppo del concetto di verosimiglianza, sia alla base del pensiero critico manzoniano fin dai suoi esordi e lo abbia inquietato negli anni. È stata ricercata nel testo la progressiva riflessione di Manzoni sul concetto di verosimile; operazione che ha suggerito una traccia interpretativa applicabile al Romanzo, orientata a coglierne una dimensione profondamente complessa e articolata, attraverso la quale l’autore ha guidato i suoi lettori alla contemplazione della Verità incarnata nelle vesti del vero storico, sotto la forma di una promessa sponsale. È stata riscontrata una relazione tra le tre parti strutturali che sono state identificate nel volume finito di consegnare alle stampe dallo stesso Manzoni nel 1842 (la ‘quarantana’): l’Introduzione, i trentotto capitoli, la Storia della colonna infame, ravvisando in questa costruzione, l’architettura in cui Manzoni ha, con maestria, incastonato il suo Vero.
The Betrothed was analysed from a point of view focusing on complexity starting from systemic theory. The comparison between two theoretical texts: Lettre à M.R C*** sur l’unité de temps et de lieu dans la tragédie and Del romanzo storico e, in genere, de’ componimenti misti di storia e d’invenzione, highlighted how the idea of complexity, and consequently of relationship at the core of the concept of lifelikeness, has underlied Manzoni’s criticism since its beginning and has troubled it in time. Manzoni’s progressive reflection on verisimilitude has been researched: the which has given an interpretation applied to The Novel, to a complex and articulated dimension through which Manzoni guided the readers to the contemplation of Truth embodied in historical reality, in the form of a betrothal. The ‘quarantana’, the novel given to the publisher in 1842 by Manzoni, has been analysed and a relationship between its three structural parts has been identified: l’Introduzione, thirty-eight chapters , la Storia della colonna infame. In its frame was found the architecture in which Manzoni brilliantly set his Truth.

Abstract:

Although there is much theoretical and empirical data about the life history responses of time constrained organisms, little is known about the latitude compensating mechanism that enables northern populations’ developmental rates to compensate for latitude. To investigate the importance of photoperiod on development and growth, I collected adults and raised the offspring of the obligatory univoltine damselfly Lestes sponsa from two populations at different latitudes (53º N and 63º N). The offspring were raised in a common laboratory environment at 21º C and at the two photoperiods corresponding to the sites of collection. Field data showed that adult and egg sizes decreased towards the higher latitude. This adult size difference was a genetically fixed trait since the same size difference between populations was also found when larvae where reared in the laboratory. All studied individuals expressed shorter development time and faster growth rates under northern photoperiod regimes. Northern damselflies showed fixed body size and mass at emergence despite being reared at different photoperiod conditions. Similarly, southern individuals kept body size at emergence constant at both photoregimes, but overcompensated shorter development time in the northern photoregime by gaining higher body mass than in original,southern photoregime. There was no difference in hatching synchronisation between larvae from the south and the north. I found evidence of higher synchrony at adult emergence among northern individuals. The previous investigation of L. sponsa phenology in natural conditions together with these laboratory results indicate the presence of the latitude compensating mechanism that is triggered by a response to photoperiod. A positive correlation between photoperiod and developmental rate in this damselfly, and probably in many other temperate insect species, might be adaptive since it optimises the life history stage transitions and body size/mass at each latitude.

Abstract:
Clearing of old growth forests resulted in a substantial loss of nesting habitat for cavity-nesting waterfowl during the late 19th and early 20th centuries. Since then, many hardwood forests have matured into size classes capable of producing cavities suitable for nesting ducks. To quantify changes in cavity availability in U. S. Fish and Wildlife Service Region 3, which contains most of the midwestern U.S., I examined current cavity availability at 4 sites where cavity availability had been estimated in the past; Mingo National Wildlife Refuge (NWR) in Missouri, Shiawassee NWR in Michigan, Mead Wildlife Area (WA) in Wisconsin, and Muscatatuck NWR in Indiana. I found densities of 1.8 ± 0.4, 1.4 ± 0.3, 0.9 ± 0.4, and 1.8 ± 0.4 suitable cavities per hectare at each of these sites, respectively. Suitable cavities per hectare increased at Mingo NWR (433%) since 1966 and Shiawassee NWR (1400%) since 1974, but remained similar at Mead WA and Muscatatuck NWR since the mid-1980's, after accounting for differences in past, study-specific criteria for cavity suitability. Differences among sites were likely due to variation in species composition, stage of forest maturation, timber management, and time elapsed since the previous studies. Comparison of size-class distributions for all trees and for trees with cavities indicated that cavities occur in the largest trees and that forests have yet to mature into the most prolific cavity-producing size classes. This conclusion was corroborated by forest growth modeling results from Forest Vegetation Simulator, a forest growth-modeling program from the USDA Forest Service. I used Forest Inventory and Analysis data to model growth from 2008 to 2058 at 10-year intervals for Region 3. Cavity per tree estimates from the 4 study sites were applied to modeling outputs, and cavity availability was projected to almost double over the entire region by 2058. Thus, the observed and further expected increases in cavity density in the region justify re-examination of nest box programs and possibly a reduction of artificial nest boxes in some areas of the region where sufficient natural cavities exist. Because current and future estimates indicate sufficient nest sites for cavity-nesting waterfowl, efforts should be spent protecting and restoring brood-rearing wetlands, which are known to be declining in many areas of Region 3.

The alula, a small thumb-like appendage on a bird wing, is often credited with increasing lift and decreasing the risk of stall during bird flight. Using field based studies; researchers have observed that the alula lifts away from the wing at critical moments in flight, such as take-off and landing. However, to date, there has been no conclusive experimental evidence to support the idea that use of the alula affects lift. To determine the effect of the alula on avian flight, we used a wind tunnel to study the wings of four ducks: the Wood Duck (Aix sponsa), the Redhead Duck (Aythya americana), the Black Scoter (Melanitta americana), and the Lesser Scaup (Aythya affinis). We used a combination of lift/drag measurements and Particle Image Velocimetry (PIV) to test the wings at velocities from 10–16 m/s and angles of attack from −20 to 25 degrees. The alula was observed to naturally lift as the stall angle was approached. Of the four wings, the Black Scoter demonstrated the largest maximum lift coefficient (1.4), followed by the Wood Duck (1.3), the Lesser Scaup (1.2) and lastly, the Redhead Duck (0.9). All four wings had minimum drag coefficients near 0.1. The Lesser Scaup was the only wing which had a measurable change in lift (10%) attributable to alula deployment. PIV results for the flow field around the Lesser Scaup wing showed higher velocities on the top side of the wing when the alula was deflected.
