This thesis approaches key areas of insurance contract law and their reform from the perspective of Adams and Brownsword’s theory of contract law ideologies. Pursuant to this theory, there are two layers of ideologies underlying contract law. One is the formalist versus realist judicial approaches. In Scots law, a creditor may enlist the aid of a third party known as a 'cautioner', who agrees to pay the creditor if the principal debtor defaults.
