Abstract:
Ever since union - and before - black South Africans have been excluded from parliament, provincial councils and other law-making bodies. This means that blacks have never participated in the electoral process. The voting (electoral) system - its nature and workings - remained the sole preserve of white political parties and the Apartheid government of the day. As a result of a conjuncture of circumstances (as per Harare Declaration), the African National Congress and the apart0heid government are now engaged in talks. Hopefully this will ultimately lead to negotiations towards a new Constitution which will make provision for a single unitary, non-racial, non-sexist South Africa with universal franchise on one single common voters roll and one person one vote. Part of the process of constitution-making for such a South Africa, will be the working out of a system of voting, an electoral system, which would be appropriate for the country. The African National Congress has recognised the need for a multi-party system, the right of all other political forces and organisations to organise and to compete for power on the political terrain. The ANC also recognises that all parties enjoying significant support should have the right to be represented in a Constituent Assembly and parliament. The question which needs to be resolved is: What would be an appropriate electoral system to achieve the stated objec0tive? It is to place the issue before the people of our country and to ensure participation at the widest levels by all the organisa0tions of the people in the process of constitution-making (including formulating and/or agreeing upon an acceptable system of voting), that the African National Congress, Community Law Centre (University of the Western Cape) and the Centre for Development Studies have organised a conference to be held in the Western Cape on 2 - 4 NOVEM0BER 1990. This conference will not be a decision-making one. nor will there be any resolutions at the end of the conference. The objective is to facilitate meaningful discussions throughout the country. To facilitate this process, we present a discussion document entitled "ELECTORAL SYSTEMS: A CRITICAL SURVEY" which has been prepared by Professor KADER ASMAL, a member of the Constitutional Committee of the ANC and Professor of Law at Trinity College, Dublin. It is hoped that arising from these discussions, there will be more meaningful discussions and consultations amongst or0ganisations such as trade unions, civic organisations, women’s organisations and other sectoral or0ganisations - ultimately leading to a situation which we would be better able to decide on an acceptable, unity building and democratic electoral system.

Crime fiction is an emergent category in South African literary studies. This introduction positions South African crime fiction and its scholarship in a global lineage of crime and detective fiction. The survey addresses the question of its literary status as ‘highbrow’ or ‘lowbrow’. It also identifies and describes two distinct sub-genres of South African crime fiction: the crime thriller novel; and the literary detective novel. The argument is that South African crime fiction exhibits a unique capacity for social analysis: a capacity which is being optimised by authors and interrogated by scholars

Abstract:
This thesis spans two fields - South African dance and the philosophy of humour - and attempts to link them through an understanding of their formal mechanisms. I attempt to establish two main ideas: that there is a need for a critical praxis in South African dance, and that humour in dance can be part of this process. In Chapter One, I discuss elements of the South African dance and theatre industries pre- and post-1994 towards arguing my first point (that South African dance would benefit from a critical praxis). I probe some of the challenges facing artists and describe howchoreographers are dealing thematically and stylistically (but not formally) with the concept of the 'New' South Africa. Through an investigation of concerns voiced by critics regarding choreographic form in the country, I argue that South African dance would benefit from critical formal investigations in dance-making. Finally, I discuss traditional views of humour in South African dance/theatre and in philosophy, which suggest that humour is predominantly seen as frivolous and unworthy of serious attenfion. In Chapter Two, I offer a defence for humour's more profound critical aspects, suggesting that humour can in fact be seen as critical 'thinking in action'. A discussion of theories about humour reveals that the basis for humour is the incongruous. A subsequent discussion of form in theatre and dance shows how the incongruous might work within dance form to create meta-dance. In this way, I attempt to link the two fields of humour and South African dance and to make the connection between the critical capaci~ies of meta-dance and those of humour. I suggest, in other words, that humour in dance can create a critical awareness, of the likes advocated in Chapter One. In Chapter Three, I discuss aspects of two works: my own This part should be uncomfortable (2008) and Nelisiwe Xaba's Plasticization (2004). The two analyses differ from each other as does the humour in both works. Despite the differences, I argue that humour in both works is operating on a critical level that includes a meta-level of signification.

Abstract:
'White Shark Cage Diving' (WSCD) enables tourists to experience a face-to-face encounter with wild sharks in the open water. In order to attract the animals close to the cages, tour operators often use chum, bait, or decoys, which interferes with the natural habits of marine wildlife. These practices have great potential to adversely impact animals and the marine environment, with unknown long-term consequences. Globally, South Africa has the most extensive WSCD industry. The management is based on a policy paper and regulations published in 2008 by the Minister of Environmental Affairs (a ministry which also included Tourism). This thesis discusses the question of whether South Africa's WSCD industry is appropriately regulated in the light of today's best practices. South Africa's regulatory framework will be compared to the management arrangements of other jurisdiction where WSCD takes place. The ultimate objective of this thesis is to determine whether the South Africa's WSCD regime strikes a sustainable balance between commercial interests and the need to protect this elusive creature.

Abstract:
South Africa is faced with many mutually reinforcing societal challenges which include, amongst others, a high rate of unemployment, poverty and inequality. The community that is mostly affected by these challenges is the black African community. In order to deal with the challenge of poverty and inequality which causes other societal problems, entrepreneurship and enterprise development becomes the answer. This view is supported by the body of knowledge available on the subject of entrepreneurship and enterprise development. This paper undertakes to understand critical success factors affecting entrepreneurial culture within black African communities in South Africa. In addition, this paper undertakes to investigate the perceived influence of education and training, access to funding, government policies (i.e. regulatory environment), government programmes, commercial and financial infrastructure, physical infrastructure, crime, corruption and social and cultural norms on the success of entrepreneurial culture development within black African communities. Propositions are made and tested through conducting in-depth interviews with individuals involved with the dynamics presented by this subject on a day to day basis. Evidence collected is interpreted into knowledge and finally recommendations are made.

Abstract:
South African International Relations (IR) is a prominent source of China-Africa research and analysis, producing reports, journal articles and books that seek to illuminate the emerging relationship between China and Africa. It plays an important role in the framing of the relationship, as well as how it is perceived outside of the discipline. However, critical concerns have been raised about the context within which South African IR operates. It is therefore important that IR research, including its assumptions, dominant concepts, professed values and aspirations to studying the China-Africa relationship, be critically examined. The aim of this thesis is to contribute to critical thinking in South African IR by opening up for future discussion the new directions and possibilities for China-Africa IR. Utilising a critique located in Critical International Relations Theory (CIRT), this thesis critically reflects upon both the context of South African IR’s China-Africa research and the perspectives it has produced. The thesis argues that in spite of many descriptive and empirical studies, China- Africa research is theoretically underdeveloped in South African IR. Further, it argues that theoretical work is marginalised despite the fact that both historical and contemporary research relies on concepts drawn from IR theory. South African IR’s focus on policy relevance is advanced as a reason for the prevalence of theoretical underdevelopment. This thesis concludes by reviewing arguments for the improved use of IR theory in China-Africa IR, which will lead to a better understanding of this important relationship.

Social, political and economic changes in post-apartheid South Africa have generated the need for a major reform of the legislative regime governing companies in order to ensure that that regime is capable of addressing the challenges faced in domestic and international circles, and to also meet the demands of globalisation. 1 These developments include the change in culture from company liquidations to commercial renewal which caused the Department of Trade and Industry (DTI) to embark on drastic reforms of South Africa’s business rescue mechanism as part of the broader company law reform project. 2 The domestic and global environments have indeed changed drastically with corporate structures showing significant evolution.

Abstract:
There are certain financial institutions that are considered to be systemically important financial institutions – which means that these institutions are of such a large scale that should they fail, it would disrupt the financial sector due to their complex nature and interconnectedness amongst other sectors of the economy and this could lead to bank runs and ultimately financial instability. As a result thereof, government authorities would need to step in and provide financial support to prevent the imminent threat associated with the possibility of bank failure. Thus, this dissertation aims to investigate and explore the common reasons and factors that contribute to banking institutions; inability to achieve or maintain financial stability in South Africa, subsequent to our democracy in 1994. The dissertation will further explore the regulatory policy frameworks and the measures put in place to rescue banking institutions. The focus will be on the Banks Act. 94 of 1990, particularly section 68, which facilitates the procedure for winding up of a bank, and sections 69 and 69A, which facilitate the procedure for placing a bank under curatorship. This dissertation will also analyse the cases of African Bank and VBS Mutual Bank which recently fell into hardships, as well as the amendments implemented in terms of the Banks Amendment Act 3 of 2015. Furthermore, the dissertation will highlight the importance of the South African Reserve Bank (SARB) and its evolution as a central bank. The changing roles of the SARB and the powers and responsibilities vested in it in terms of the South African Reserve Bank Act 90 of 1989, the Banks Act 94 of 1990, the Constitution of South Africa Act, 1996 and the Financial Sector Regulation Act 9 of 2017 will be explored in so far as the financial stability mandate is concerned. And finally, the new developments in the South African financial sector will be discussed: the shift to a Twin Peaks model, the Financial Sector Regulation Act and the powers of the Resolution Authorities.

Abstract:
Citizens interact with government departments and agencies for public services and goods which lead to a service encounter between a public official and client. Various initiatives and policies have been developed and are being implemented in the public service to adopt a client-centred approach to service delivery. The White Paper on the Transformation of the Public Service of 1997, identifies the eight Batho Pele principles which sets the framework for implementation of service quality within the South African public service. Government departments are expected to implement measurable service standards to determine levels of service quality to be met that will define levels of client satisfaction with service provision. The assessment of the service encounter by the client informs perceived levels of satisfaction held. This assessment of service quality by clients is therefore value-laden, subjective and periodic. The study focused on the implementation of measures to create and maintain a clientcentric public service in South Africa that would lead to levels of client satisfaction with service quality. The study assessed the implementation and maintenance of service quality at the Social Security Agency of South African the Eastern Cape. The SASSA is responsible for the disbursement of various social grants to facilitate a quality of life as enshrined by the Bill of Rights in the Constitution of South Africa, 1996. The focus of the study was linked to beneficiary maintenance and customer care at SASSA. The study included three different sample groups namely the clients, officials engaged in grant administration and different levels of management which included senior management, district and area managers. The findings revealed that the SASSA has implemented numerous new programmes aimed at a client-centric approach to service delivery. Analysis of the findings revealed expectation as well performance gaps which indicated that officials do not comply with the protocols of the agency and the Batho Pele principles. The promised service standards specified within the SASSA Customer Care Charter is not being realised which fundamentally indicate inefficient and ineffective monitoring of compliance with norms and standards. A conclusion drawn therefore is that the human dignity of clients in search of socials assistance who chiefly constitute vulnerable groups is being infringed. Three key service quality dimensions are identified that needs intervention for improved service quality. These dimensions include tangibility, assurance and responsiveness of functional components identified in respect of nine themes.

Abstract:
This research deals with socially responsible investing (SRI) in its broadest context in South Africa and includes an analysis of the risk-adjusted performance of local SRI funds. SRI refers to an investment strategy whereby investors integrate moral as well as environmental, social and governance (ESG) considerations alongside conventional financial criteria in evaluating investment opportunities. Typical SRI strategies include screening, shareholder activism and cause-based (targeted) investing. The primary objective of this research was to obtain a deeper understanding of SRI in South Africa as it represents a powerful means whereby private sector capital can be channelled into areas of national priority. Data and methodological triangulation strategies were adopted to investigate the research problem, respond to the research questions and test the research hypotheses of this study. The phenomenological component of the research consisted of an extensive literature review as well as in-depth, face-to-face interviews conducted with twelve SRI fund managers and industry experts. The positivistic dimension of this research centred on the construction of the first complete database of SRI funds in South Africa, the sourcing of quantitative primary data and the testing of eight pairs of null and alternative hypotheses. Risk-adjusted performance was evaluated by means of the Sharpe, Sortino and Upside-potential ratios during three sub-periods, namely 1 June 1992 to 31 August 1998, 1 September 1998 to 31 March 2002 and 1 April 2002 to 31 March 2006. Forty-three SRI funds have been launched in South Africa since June 1992 and it is estimated that SRIs constitute approximately 0.7 percent of the total investment capacity in the country. It was found that most local SRI funds combine a cause-based investment strategy with a positive or best-of-sector screening approach. ESG screens were found to focus on the promotion of broad-based Black Economic Empowerment and the development of social infrastructure in South Africa. The FTSE/JSE SRI Index and the Financial Sector Charter were identified as the most prominent drivers of SRI in South Africa, whereas a lack of skills and a shortage of new SRI opportunities, asset classes and funds were seen as impediments to the growth of the local SRI sector. The empirical evidence shows that: - local SRI funds underperformed relative to their respective benchmark indices during the first two sub-periods but significantly outperformed them during sub-period three (the resurgence period of SRI in South Africa); - local SRI fund performance is not significantly different from that of a matched sample of conventional (non-SRI) funds; and - local SRI funds significantly underperformed relative to the general equity market in South Africa during sub-period two (the decline period of SRI in South Africa) but performed on a par with the FTSE/JSE All Share Index during sub-periods one and two. The findings of this research therefore suggest that investors can consider SRI funds as part of a well-diversified investment strategy. It is strongly recommended that a Social Investment Forum be established in South Africa to address the educational needs of stakeholders in the local SRI sector. It is also recommended that local asset managers adopt a focused differentiation strategy to take advantage of the growing SRI sector in South Africa.

Abstract:
This article examines the Curriculum documents produced in South Africa since the election of a democratic government in 1994 in order to consider the possibilities they create for the inclusion of critical literacy in the teaching of home languages. This discussion is set against an analysis of the apartheid curriculum documents prior to 1994 and a consideration of the ongoing inequalities in the provision of human and material resources across the system. Despite real constraints with regard to implementation, it is argued that the new Curriculum effects a significant break with the past and makes a positive contribution to transforming language education.

ENGLISH ABSTRACT: The Public-Private Partnership (PPP) is a popular instrument for public service delivery. It is important that public managers will be able to recognize when a PPP would be an appropriate service delivery option, and will be able to maximize a PPP‘s chances of success when it is the chosen service delivery instrument. The research question addressed in this dissertation is: ―What are the critical factors that can be replicated that separate successful PPPs from PPPs that do not deliver or that collapse? In this dissertation critical success factors for PPPs are identified through a step-by-step process in which different sources of success factors are analysed and where successively identified sets of success factors are compared and combined in a repetitive layered process of synthesis. A list of success factors is created and expanded through an iterative process of evaluation, removal of duplications, combination of related success factors and listing of unique success factors. Success factors are found in literature while describing the PPP concept and partnership mechanics and management. Success factors are identified in partnership literature, in public governance literature, in private sector collaboration literature, in entrepreneurial studies and in a collection of perspectives on success. These perspectives include those of stakeholders, of private operators, of the third sector as well as perspectives from disciplines and knowledge and practice frameworks such as project management, corporate governance, enterprise risk management and organisational design. Additional success factors are identified in a discussion on the evaluation of partnerships, where it is shown that success factors can be derived from evaluation based on characterization, from partnership definitions, from the perspective of programme evaluation, from measuring the performance of business improvement districts, from alternating focus partnership evaluation (sector by sector, theme-based, local-level) and from service delivery evaluation. The evaluation of partnership examples also provides insight into success factors. The final filtering and synthesis of evidence uses the results of questionnaires, from which success factors are derived, to conduct a final distillation and produce the final list of success factors identified. A total of 466 individual success factors are identified in this dissertation, these factors are grouped into 43 distinct categories. The two most critical success factors for PPPs are identified as firstly delivering a publicly needed service and secondly achieving the objectives of the partnership. The answer to the research question described above is that critically, two conditions must be met to make a PPP successful, and that is that the goals of the PPP must be achieved and that a public need must be satisfied. There are many additional success factors which can further define success and degrees of success, all of which are descriptions of desired conditions from the perspective of stakeholders. The exploratory and hypothesis-generating study culminates in a hypothesis that states that if public managers are faced with a choice of service delivery options, and the use of a PPP is one option, and if the manager applies the categories of recommended critical success factors identified in this dissertation, the manager will be able to determine whether a PPP would be an appropriate service delivery vehicle, and furthermore, if PPP is chosen as service delivery vehicle, the public manager would, through the application of the success factors identified in this dissertation, have a greater chance of successful implementation of the PPP through purposeful collaboration. The study contributes to the public management body of knowledge by covering new ground in terms of the evaluation and management of public-private partnerships.
AFRIKAANSE OPSOMMING: Publiek-Privaat Vennootskappe (PPVe) is 'n gewilde instrument vir die lewering van openbare dienste. Dit is belangrik dat openbare bestuurders sal weet wanneer 'n PPV 'n goeie opsie sal wees vir openbare dienslewering en hoe om 'n PPV se geleentheid vir sukses te verhoog as dit die gekose dienslewerings-instrument is. Abstract:
The goal of this dissertation is to highlight the ambiguities contained in section 61 of the Consumer Protection Act 68 of 2008 (CPA), which attempts to introduce strict product liability for the entire supply chain in the event of product failure, and to propose amendments from which both the consumer as well as the supply chain could benefit. The new dispensation of strict product liability will lead to a step away from the no-fault based liability system that our courts have implemented for decades. Although this system is unfamiliar to South Africa, strict liability regimes have been followed in foreign countries for a considerable period of time. A comparative study of the approaches followed in America and Europe, which both advanced strict product liability regimes, will be undertaken in this study in order to illuminate problematic aspects relating to the concept of defect contained in section 61 of the CPA as well as the various duties of the supply chain in a strict product liability regime. It is argued that the provisions of the CPA ought to be supplemented with regulations, including, but not limited to, the implementation of adequate safety regulations to mitigate product recalls and product liability claims.

Abstract:
The world is currently facing a global climate crisis largely associated with growing greenhouse gas emissions, of which carbon dioxide (CO₂) emissions are a significant component. As the fourteenth largest emitter of CO₂ globally and the highest per capita CO₂ emitter in Africa, South Africa has a responsibility to implement legal and fiscal instruments to reduce its emissions. One instrument receiving growing global attention to reduce CO₂ emissions is carbon tax; a tax imposed directly on the emission of carbon or the use of products which generate carbon emissions. South Africa is following the global trend and has for the past decade sought to formulate a carbon tax regime which is effective in its operation, equitable in its impact across different sectors, and which does not result in the collapse of the country's economy. Whilst yet to be finalised, several policy documents have provided a clear indication of its anticipated form, and 2015 saw the publication of the Draft Carbon Tax Bill with the Bill being re-­released in 2017, which by all accounts is due to be finalised for implementation in mid-­2017. The time would accordingly appear ripe to critically review the country's anticipated carbon tax regime, and this forms the focus of this dissertation. This critical review was undertaken against several tax design elements identified by international commentators, namely: environmental effectiveness; tax revenue; support for the tax; legislative aspects; technical and administrative viability; competitiveness effects; distributional aspects and adjoining policy areas. The critical analysis of South Africa's imminent carbon tax regime against generally accepted tax elements has determined that it will be effective in its operation, equitable in its impact across different sectors and it will promote a more sustainable and resilient domestic economy.

This thesis analyses the Employment Equity Act 55 of 1998 and its application in labour law in South Africa. After an initial examination of the general concepts with regards to employment equity and current international conventions regarding employment equity, the study will move on to examine employment equity as it stands in the law today. In examining the current law regarding employment equity, a brief historical background will be offered in order to show the legacy of apartheid: the immense disparity between the different categories of South African people in the modern era. By using this background and analysing the relevant provisions of the Constitution, it will be argued that there is a very real need for employment equity measures to bring about a true sense of equality in South Africa and that such measures are fully endorsed by the Constitution. After it has been established that affirmative action is an important tool in the creation of an equal South Africa, the measures put in place to help create this equal South Africa will be critically analysed. This critical analysis will point out certain weaknesses in the current affirmative action system. Following this critical analysis of the South African employment equity law, the employment equity systems used in Brazil, Canada and Malaysia will be examined in detail. The purpose of this analysis will be to find the strengths and weaknesses and successes and failures of these foreign systems. This will be done in order to highlight those areas of the foreign systems that can be implemented into South African law in order to make the South African employment equity system stronger. The weaknesses of those systems will also be highlighted in order to learn valuable lessons from other system’s failures so that South Africa does not make the same mistakes. The final part of this thesis will be in depth discussions and the proposal of solutions to the weaknesses of the South African employment equity system that have been highlighted throughout the thesis. These proposals will be put forward in order to ensure the most efficient and effective employment equity system in South Africa. There will also be a reassessment of the most valuable lessons learned from the foreign systems that would be easily implemented into or avoided by the South African system in order to ensure an effective employment equity system. The purpose, therefore, of this thesis is to critically analyse employment equity in South Africa. A further purpose will be to propose certain amendments and changes to the current system to ensure the Employment Equity Act is reflective of the needs of the people South Africa.

The research reported here evolved from the researcher’s ethnographic immersion in an ICT for Development (ICT4D) project in a deep rural part of South Africa. During ethnographic immersion, three key issues emerged from fieldwork. Firstly, the researcher realised his limited understanding of the worldview of research participants. Secondly, he realised his inability to appropriately and ethically do community entry and implement the ICT4D artefact (e.g. ICT4D training and policy), especially because of his limited understanding of the cultural context, underlying values, emancipatory concepts and interests, as well as incomplete insight into the oppressive circumstances that the people in the research setting find themselves in. The third issue relates to an inability to interpret and explain the collisions and conflicts that emerged from introducing, aligning, and implementing the ICT4D artefact. Through critical ethnographic methods and a critical orientation to knowledge, the researcher shows how these inabilities, collisions, and false consciousnesses emerged to be the result of cultural entrapment and ethnocentricity that he and the research participants suffered from. A key argument throughout this thesis is that the emancipation of the researcher is a precursor for the emancipation of the researched. The researcher thus asks: In what ways should ICT4D researchers and practitioners achieve self-emancipation, in order to ensure the ongoing emancipation and empowerment of the deep rural developing community in South Africa? The study subsequently argues the link between the topic of this thesis, namely the issue of ethical research practice, and the primary research question. A unique perspective on these problems is presented as the study looks at emancipatory ICT4D research and practice in context of a deep rural Zulu community in South Africa, and specifically the journey of social transformation that the researcher himself embarked on. The study retrospectively applies Bourdieu’s critical lineage to reflect on the research contribution and how the researcher was eventually able to construct adequate knowledge of the ICT4D social situation. Building onto the idea of critical reflexivity, the researcher argues that critical introspection should also be part of critical ICT4D research in South African contexts. Through confessional writing, the researcher describes experiential knowledge of the worldview collisions that emerged from ICT4D research and practice. In particular, manifestations of the collisions between the typical task-orientated or performance-orientated value system of Western-minded societies and the traditional loyalty-based value system or people-orientated culture of the Zulu people are described. The research contributes by challenging dominant ICT4D discourses and by arguing for an end to a line of ICT4D research and practice where outsiders with a Western task-orientated worldview, like the researcher himself, make unqualified and inadequate assumptions about their own position in ICT4D practice, and about their own understanding of how to “develop” traditional communities in South Africa through ICTs. Following Bourdieu, the researcher argues that one can only build an adequate understanding of the social situation through critical reflexivity, by making the necessary knowledge breaks, and by allowing oneself to be carried away by the game of ICT4D practice.

Feminist theories emerged out of the revolutionary enthusiasm that swept the Western world during the late eighteenth and nineteenth century Europe. Based on the assumption that all persons have "inalienable or natural" rights upon which governments may not intrude, feminists in Europe and America advocated that equal rights should be extended to women who up to this point were not considered legal beings separate and deserving of these rights. Most African writers and feminists have argued that since most of the theories of feminist jurisprudence have their roots in this Euro-centric context, they cannot be applicable to African women and should therefore be discarded. The thesis acknowledges that to a certain extent their assertions are true. For years feminist jurisprudence has been restricted to an academic engagement with the law failing to take into account the practices and customs of different communities. It has largely been the realm of the middle class bourgeois white female and therefore has been inaccessible to the African woman. The thesis aims, however, to prove that these theories of feminist jurisprudence although Euro-centric have a place in the understanding and advancement of African women's rights in South Africa. In Chapter One the writer traces the history of South African women's rights and the laws that affect African women. Chapter Two presents the emergence of feminist theories and categories of feminism. The writer then seeks to identify the misunderstandings and tensions that exist between the two. The narrow conception of Euro-centric feminism has been that its sole purpose has been the eradication of gender discrimination, however, for African women in South Africa they have had to deal with a multiplicity of oppressions that include but are not restricted to gender, race, economic and social disempowerment. This is dealt with in Chapter Three. It is the opinion of the writer that despite these differences feminism does play a critical role in the advancement of women's rights in South Africa. Taking the South African governments commitment to the advancement of universal rights, the writer is of the opinion that African women can look to the example set by Western feminists, and broaden these theories to suit and be adaptable to the South African context. The answer is not to totally discard feminist theories but to extract commonalities that exist between African and European women, by so doing acknowledging that women's oppression is a global phenomenon. This is the focus of Chapter Four. To avoid making this work a mere academic endeavour, the writer in Chapter Five also aims, through interviews, to include the voices of African women and to indicate areas that still need attention from both the lawmakers and women's rights movements (Feminists). Finally, the writer aims to present a way forward, one that is not merely formal but also substantively attainable.

Since the dissolution of apartheid, corporate governance in South Africa has evolved from being a soft mainly ethical issue to a hard knowledge-based technological issue, recognised as pivotal to the success and revitalisation of the country’s capital markets and, ultimately, the prospects of the corporate economy. These high stakes have produced a succession of measures aimed at transforming corporate governance in the economy. As such, South Africa’s corporate managers are consistently faced with the seemingly unassailable obstacle of discerning and implementing technologically progressive and culturally/racially unbiased management strategies/systems. The focus of this thesis is the latter of these two obstacles. Ubuntu acts as the scope via which the issues embedded within the incumbent management strategies/systems are viewed. Ubuntu philosophy embodies a socio-cultural framework that applies to all individuals and institutions throughout the continent. It embodies collectivism and teamwork, creation of synergies and competitive advantages, humanist leadership styles and maturity, consensus in decision-making systems, effective communication, and community-based corporate social responsibility. Ubuntu is pervasive in almost all parts of Southern African continent – it is integrated into all aspects of day-to-day life throughout the region. This thesis reviews and analyses some of the lessons that can be learned through the inception of African management, more specifically Ubuntu management, within South Africa’s corporate sphere. This thesis aims to prove that there exists a need for a new South African corporate management system, one which is able to harmoniously integrate the incumbent, western-orientated management strategies and systems with one of African origins.

A quantitative research study was conducted in order to obtain insight and knowledge of the perceptions of management with regard to changes taking place within the Financial Services Sector (FSS). The call centre at Sanlam Head Office in Bellville was used as a case study, and focus was primarily with first line managers at the call centre. The motivation for the study stemmed from the researcher’s experience within the FSS coupled with introduction of legislation for financial service providers. The ultimate objective of the study is to provide generic guidelines of how managers should respond to change on various and different levels and to equip managers with tools to apply during change phases and cycles within the organization. The literature review covers areas that releates to how managers responded to change in areas of leadership, culture, structure and legislation. Changes in these four areas were researched from different authors that specialize in organizational development, leadership development, organizational change and legislation. These ideas and perspectives from a range of South African and international writers gave the researcher an opportunity to conceptualize change, in general, and to provide a clearer understanding of generic competencies that are required to deal with it. Some models of how to deal with resistance to change and key success factors in dealing with it, are discussed. The researcher elected to work with managers at the Sanlam call centre, since they experience and are directly exposed to implementation of change at grassroots level. Results of the research confirm that dealing with change is a challenging experience for managers. A participatory management approach will result in less resistance from employees. The investigation also recommends that deciding on a vision with all key role players is not a once-off occurrence, but should be revisited, realigned and adjusted as the need arises within the organization. Furthermore, the results confirm that soft skill training and development such as conflict and diversity management should be implemented during the diversity and the changing face of the workplace. The main objective and recommendation is that managers should relook and revisit their management styles, involve all role players during decision making processes, and value and appreciate employee’s inputs and ideas.

Abstract:
In a critical analysis of several independantly produced South African comics of the 1980s and early 1990s, close analysis of the comics leads to an assessment of the artists'intentions and purposes. Discussion of the artists' sources focuses on definitions of different types of comics. What is defined as a comic is usually what has been produced under that definition, and these comics are positioned somewhere between the popular and fine art contexts. As the artists are amateurs, the mechanical structure of comics is exposed through their skill in manipulating, and their initial ignorance of, many comic conventions. By comparison to one another, and to the standard format of commercial comics, some explanation of how a comic works can be reached. The element of closure, bridging the gaps between frames, is unique to comics, and is the most important consideration. Comic artists work with the intangible, creating from static elements an illusion of motion. If the artist deals primarily with what is on the page rather than what is not, the comic remains static. Questions of quality are reliant on the skill with which closure is implemented. The art students who produced these comics are of a generation for whom popular culture is the dominant culture, and they create for an audience of peers. Their cultural milieu is more visual than verbal, and often more media oriented than that of their teachers. They must integrate a fine art training and understanding into the preset rules of a commercial medium. Confronted with the problem of a separation of languages, they evolve a new dialect. Through comparative and critical analyses I will show how this dialect differs from the language of conventional comics, attempting in particular to explain how the mechanics of the cornie medium can limit or expand its communicative potential.

ENGLISH ABSTRACT: Leadership is, without a doubt, one of the most valuable commodities in business. It is no secret that organisations depend greatly on leaders for their success, and that the effectiveness of the organisation is related to the effectiveness of its leaders. Organisations worldwide are continuously searching for the finest leaders to organise and lead their organisation to optimal performance. However, leadership is much more complex than initially meets the eye. A great many researchers have conducted decades of research on the topic and have not yielded irrefutable evidence on leadership. Although research has succeeded in defining different types of leadership and leader influencing, and power tactics, the characteristics, behaviour and situational factors of effective leadership are still under contention. The phenomenal complexity and elusive character of the leadership construct should be considered as a problem whose resolution would greatly enrich our knowledge. For social and organisational psychologists, understanding leadership, its behaviours and processes, forms a fundamental, if not chief element of group and organisational processes. These processes can arguably lead to group, and thus organisational effectiveness. In this study, leadership is explored from the basis of social learning theory and focused specifically on South Africa’s emerging economy. Bandura, the founder of social learning theory, advocates that people learn their behaviour by observing those who are superior and desirable to them, and then imitate their behaviour. According to this theory, leaders have a very direct effect on the behaviour of their subordinates, which enables them to mould employee behaviour by being a good role model. In addition, literature on leadership has corroborated that role modelling is one of the most effective influencers on employee behaviour. This study attempts to uncover which leadership behaviours is conducive to organisational effectiveness. This information can be useful to all other potential or current leaders in the South African economy, and the insights gained from the study can be used as a valuable framework from which they can lead their organisations through their own behaviour. The objective of this research project is thus to come to a deeper understanding of what the critical leadership behaviour in the emerging South African economy looks like. Through acknowledging the complexity of human behaviour and the leadership construct we want to comprehend what behaviour it is that makes leaders successful. Individual, in-depth interviews with a number of South Africa’s most successful business leaders is seemingly the best method of uncovering what these ‘effective leader behaviours’ are. These interviews create an understanding of how successful leaders view leadership and what behaviour they (as the experts on leadership behaviour) deem important. The repertory grid interview technique is utilised in this qualitative study, to uncover how these leaders perceive leadership. This is an attempt at coming closer to understanding what the cunning logic of nature’s design looks like, in terms of effective leader behaviour. This study focuses on South Africa in the current emerging economy, and aims at providing insights into the specific leader behaviour that is conducive to organisational effectiveness. These insights can be used as a starting point from which leaders can cultivate their own behaviour to mould a desired organisational culture, and reach organisational objectives.
AFRIKAANSE OPSOMMING: Leierskap is ongetwyfeld een van die sakewêreld se waardevolste kommoditeite. Dit is algemene kennis dat organisasies baie afhanklik van goeie leierskap vir organisatoriese sukses is. Daar kan ongetwyfeld aangevoer word dat die effektiwiteit van organisasies direk aan die effektiwiteit van sy leiers gekoppel is. Organisasies wêreldwyd is voortdurend op soek na die beste leiers om hul besighede te organiseer, te inspireer en tot optimale prestasie te lei. Leierskap is egter baie meer kompleks as wat dit aanvanklik voorkom. Dekades se navorsing oor leierskap kon tot op hede nog nie onweerlegbare bewyse rakende leierskap lewer nie. Alhoewel navorsing al der duisende verskillende definisies van leierskap, leierskapstipes, beïnvloedingstaktieke en magstaktieke opgelewer het, kon navorsing oor leierskap nog nie daarin slaag om definitiewe leierskapsgedrag, leiereienskappe of situasionele faktore wat aan effektiewe leierskap gekoppel is, te bepaal nie. Die enorme kompleksiteit en ontwykende aard van die leierskapskonstruk behoort vir die besigheidswêreld ‘n probleem te wees waarvan die oplossing baie waardevol sal wees. Bedryfsielkundiges sal veral baie baat vind by die volledige begrip van leierskap en die gedrag en prosesse wat daarmee gepaard gaan, aangesien leierskapsgedrag as ‘n fundamentele, indien nie ‘n kerndeel van groep- en organisatoriese prossesse se sukses, gesien kan word. Deur leierskap beter te verstaan sal organisasies in ‘n beter posisie wees om groep- en organisatoriese effektiwiteit te verbeter. In die studie onder oë is leierskap ondersoek vanuit die raamwerk van sosiale leerteorie soos geproklameer deur Albert Bandura, met ‘n spesifieke fokus op die huidige en ontluikende Suid-Afrikaanse ekonomie. Bandura voer aan dat as mense, leer ons gedrag aan deur na ander in hoër en geloofwaardige posisies te kyk, en dan hulle gedrag na te boots. Leiers, volgens hierdie teorie, het ‘n baie direkte en wesenlike invloed op hulle volgelinge, en kan daarom werknemergedrag vorm en beïnvloed deur hulle eie gedrag, deur ‘n goeie rolmodel te wees. Hierbenewens bestaan daar ook ‘n magdom literatuur oor leierskap wat aanvoer dat rolmodellering een van die mees effektiewe beïnvloeders van werknemergedrag is. Deur beter te verstaan hoe hierdie suksesvolle leiers leierskap sien, en watter gedrag hulle as bevorderlik beskou, kan ons hopelik nader aan die waarheid kom oor watter gedrag tot organisatoriese effektiwiteit bydra. In hierdie kwalitatiewe studie is daar van die repertoirerooster tegniek (‘repertory grid technique’) gebruik gemaak om agter te kom hoe hierdie leiers leierskap beskou in ‘n poging om nader aan ‘n volle begrip van die ingewikkelde logika van die natuur se ontwerp in terme van leierskapsgedrag te kom. ENGLISH ABSTRACT: We critically assess the successes and failures of the economic phenomenon that is Black Economic Empowerment as represented by the Ownership Element of the Scorecard. We briefly evaluate the successes and failures of the first wave of BEE deals on the JSE and through the use of contemporary observations of this phenomenon as reported on by the media, we make the key assumption that these media reports are an unbiased account of the phenomenon. We critically assess the current status of BEE and find that progress has been made in terms of black ownership on the JSE, as well as on the legislative front, through the introduction of a comprehensive standardised measurement framework. The progress has in the main been extremely slow and limited. We also find that whilst funding models have improved, the success of BEE deals is still to a large extent dependent on stellar performance of the Stock Exchange and generous dividend policies. Disappointingly we also find that the debate about what constitutes broad-base BEE continues unabated as most deals continue to fail to meet public expectations of broad-base empowerment and equitable equity participation by all BEE deal beneficiaries.

Die eerste vlaag SEB-transaksies op die Johannesburgse Effektebeurs (JEB) word kortliks beoordeel, waarna die media se eietydse waarnemings oor hierdie verskynsel tot die sleutelaanname lei dat sodanige mediaberigte 'n onbevooroordeelde weergawe van die stand van swart ekonomiese bemagtiging is. Die studie bied 'n kritiese beskouing van die huidige status van SEB, en dat daar wél vordering gemaak is met betrekking tot swart eienaarskap op die JEB, sowel as op wetgewende gebied deur die instelling van 'n omvattende, gestandaardiseerde metingsraamwerk. Vordering was egter tot op hede merendeels uiters stadig en beperk. This thesis focuses on the process of interpreting and the difficulties faced by interpreters in the Magistrates' Court in Grahamstown, South Africa. More particularly, the thesis seeks to establish whether the constitutional guarantee of language equity can be applied to the courts - given the numerous problems with interpreting. Respondents from different spheres of the legal profession were interviewed in order to ascertain their perspectives on the state of interpreting, problems that are encountered by interpreters and attitudes displayed by other members of the legal profession towards interpreters. The methodology used in the thesis is that of a critical ethnography. As such, the research also has a critical focus, seeking to determine the ideologies and interests of different ):articipants in the legal process. On the basis of the data collected, a number of conclusions are drawn. The first is that interpreting in South Africa is in trouble. The system of interpreting is beset by a number of different problems. This study describes four different types of problems that are faced by interpreters: linguistic problems, environmental problems, training and administrative issues, and poor status in the eyes of the other participants in the legal process. Together the cumulative effect of these problems is the undermining of the principle of equity in the justice system. Finally, the thesis provides various practical and achievable solutions to the problems outlined above, specifically those faced by interpreters. The researcher also critically evaluates the efforts and motives of the Department of Justice and Constitutional Development.

Abstract:
The main focus of this thesis is to show the nature of the relationship between the South African Defence Force and the local media from 1975-83. The thesis will analyse issues specifically relating to the nature of the relationship and show how and why they are relevant to understanding the authoritarianism of the apartheid state. The nature of the relationship will be conceptualised by way of the analogy of a marriage. The thesis will show that for the SADF the relationship was “a marriage of convenience” whereas for the media it was a “marriage of necessity”. This relationship operated within the context of a highly militarised society that has been termed a “Garrison State”. The apartheid government introduced legislation governing reporting of defence matters and the media (namely the South African Defence Act 1957 including amendments made up until 1980) that imposed legal constraints within which defence correspondents had to operate. Moreover, the MID’s secret monitoring of the local media reveals the extent to which the military distrusted the media. A sampling of the coverage of defence matters in a selection of newspapers will reveal how their editorial staffs and reporters operated in a situation where the flow of information was controlled by the military. This will also show that certain defence correspondents cultivated close relations with SADF personnel to ensure that they were kept informed. The thesis will also show how the SADF reacted to the international media exposure of Operation Savannah and Operation Reindeer and how the SADF sought to limit the damage to its reputation by clamping down on the local media. The creation of two media commissions both headed by Justice MT Steyn, set out to investigate the manner in which local media reported on security issues in an environment in which the media and the public were confronted by the “Total Strategy” discourse of the apartheid government. The working relationship between the SADF and the media encapsulated in the thesis can be described as highly complex and the use of the “marriage” analogy assists in understanding this relationship.

Tourism, as an industry, has a great impact on society and the environment. It adds to economic growth; and therefore, many governments try to enhance tourism because they realise the potential economic returns. Within each country, there are towns or cities that have great tourism potential. In South Africa, Knysna is a good example of a small town with great tourism potential. This study examines the critical success factors of tourism destination marketing for the town of Knysna. Most South Africans see Knysna as an ideal holiday destination, as it has the infrastructure and offerings to make tourists' holidays unforgettable. However, unfortunately, in recent times bad publicity has caused Knysna's image to be damaged. To improve the town's image and to add to its economic growth, tourism bodies and the community have had to work together to ensure that Knysna sustains its position in the national and international tourism markets. The best way to achieve this is through effective destination management and destination marketing. The aim of this study is to determine how effective destination management and destination marketing can lead to competitive growth and to enhancing a destination's position in the tourism industry, and also to providing a set of practical guidelines for the successful implementation of the destination marketing of the town of Knysna. A literature study was conducted to find out what the theory reveals about destination management and marketing. This was followed by an empirical survey; and this survey was conducted in Knysna in the Western Cape. The results of the survey were compared with the literature and tourism operators and managers can now use these as a point of departure to fill any gaps, thus leading to the optimal positioning of Knysna on the international tourism map.

ENGLISH ABSTRACT: In 1997, the South African Qualifications Authority (SAQA) published its guidelines 'to provide for the development and implementation of a National Qualifications Framework (NQF)' (Government Gazette 1997:35). This framework was to pave the way for compelling transformation in the education sector. One of the key features of the framework would be a directive that a series of competencies, or generic skills, that SAQA termed its 'critical cross-field outcomes' would have to be incorporated into the design of all programmes of learning. The publication of the guidelines sparked considerable debate; a debate that, in the five years since 1997, does not appear to have been resolved. As higher education institutions prepare for the 2003 submission of programmes to SAQA for registration, the importance of swift and meaningful intervention is self-evident. This report gives an account of a study undertaken to allow for the critical analysis of generic learning outcomes, or specifically SAQA's critical outcomes, as they present themselves in a technikon diploma programme. While the initial impetus in terms of the skills debate may appear to have arisen as a result of national imperatives, the overview of the literature pointed to international precedents, particularly when the issue of generic skills was contextualised against the background of the changing higher education landscape. Thus empirical research was conducted at the Cape Technikon using the National Diploma in Human Resources Management, its academic staff and its second-year student group, as its focus. The qualitative data, generated via multiple techniques including document analysis, interviewing, and a survey, provided a wealth of information and in-depth insight into the perceptions and attitudes of the respondents. The researcher endeavoured to maintain a practical focus throughout the study and sought to interpret and critique existing practice against best practice as described in the literature. The findings highlighted numerous issues relating to the integration of generic learning outcomes into programmes of learning. Key among these were the apparent lack of clarity and guidance among students and staff about the meaning of, and envisaged role for, the generic learning or critical outcomes; the fact that many in the technikon sector are already employing those teaching and learning strategies that are deemed appropriate when following an outcomes-based approach; that the changing student profile has had a direct impact on what happens in the classroom; and that assessment systems and practices appear to be the main barriers to the effective development of generic skills. In response, this study recommends that a structured, holistic, process approach be implemented at those institutions that are serious about integrating SAQA's critical outcomes into their programmes of learning. While such an approach would require institutional support and guidance, as well as an overall commitment to staff development, it is the contention of the researcher that the technikon sector, by virtue of its career-oriented focus and the design of its programmes, is ideally positioned to embrace the SAQA challenge successfully.

The journey towards becoming a counselling psychologist, in South Africa, includes the completion a 12 month internship. The internship year holds many challenges and demands for novice professionals and aims to assist them in making the transition from student to professional. This study aims to explore the subjective experiences of intern counselling psychologists and the critical incidents which assist them in making this transition. In addition, it aims to identify experiences impacting on the interns’ professional development and professional identity. Three registered counselling psychologists, who completed their internship at a South African university counselling centre within the last year, were recruited and participated in individual interviews. These interviews were semi-structured and followed the Critical Incident Technique method. Each interview was voice recorded and transcribed. The data collected was analysed using thematic content analysis. As the research design is qualitative, using a phenomenological approach, the focus is on presenting information-rich and detailed descriptions of participants “lived” experiences of their internship year. It attempts to understand significant incidents or events which influenced the participants’ professional and personal development as they navigate through this ambiguous period to become independent and ethical practitioners. Four predominant themes emerged from the data collected, which include a discussion pertaining to professional boundaries and limitations, learning within the internship environment, the effects of professional and personal support and, lastly, the transition from dependent to independent professional functioning.

The goal of this study is to explore three different models that three selected university choirs chose to accommodate diversity: two choirs with different identities existing independently alongside each other on one campus (model A), one choir, implementing diversity (model B) and one choir with a Eurocentric character (model C). Each university was treated separately, collecting qualitative data to provide historical insight into the choir, to determine profiles of the relevant conductor(s) and choristers and to determine the management body’s views regarding the role of the choir(s) within the institution. Information on repertoire indicates preference for musical styles, favouring an African or Western perspective or showing measures of cultural adaptability. Data was collected from choristers, conductors, organisers and university representatives by questionnaires and personal interviews as well as historical data in the form of concert programmes of the selected university choirs. The research findings indicated that the three universities concerned chose to handle their cultural diversities in completely different ways, resulting in creating unique choral identities which are evident in aspects such as repertoire, choristers’ experience and the support from the institution.

The World Health Organization has recommended Telemedicine to improve health care in developing countries. The objective of this study was to produce Critical Success Factors that will investigate and identify factors that influence the acceptance and continued use of Telemedicine in the Eastern Cape Department of Health, and to suggest ways to sustain this technology from initial adoption (the pilot programme) to full adoption. Sub questions investigated which other facilitating factors, such as management support or previous Information Technology exposure must be present in order for the technology to be adopted successfully. The study made use of a questionnaire to investigate the user acceptance and behaviour of health care workers. A return rate of 76% was achieved. The data was analysed making use of Statistical Package for the Social Sciences (SPSS), specifically the Chi Square test. From these results Critical Success Factors where then formulated to address the problems identified. The Critical Success Factors that were identified include: Implement and disseminate best practice within a legislative framework; Find a champion; Change management strategies; Training; Sustainable finance; Technical issues and Project management principles If these CSFs are addressed before and during the implementation of Telemedicine it will increase the acceptance and use of the technology among health care workers. In an attempt to provide much-needed finance for road investments, the government’s national road agency has introduced numerous toll roads over the last three decades. It is currently in the process of introducing open road tolling on a network of Gauteng’s highways. Economic theory provides a rich understanding for pricing road use, particularly with regard to the pricing of externalities. By quantifying these externalities for the South African case, this paper reveals evidence of gross mispricing for road use. Specifically, the magnitude of road freight trucks’ external costs indicates that there is an absolute underpricing of road use for these vehicles. On the grounds of the externalities considered in this paper, passenger cars should, in fact, face a toll negligible in comparison to heavy vehicles. That they do not points to massive cross-subsidisation and that the relative price between light and heavy vehicles should be revisited. Appropriate pricing will improve economic efficiency by reducing cross-subsidisation. It will also rationalise the choice of freight modalities in South Africa, with the likely effect that a greater volume of goods will be carried by rail. Despite the welfare gains that the policy offers, one must be cognisant of the distortions that optimal road pricing may have.

This mini-dissertation evaluates the laws regulating beneficiary funds in South Africa. A beneficiary fund is a fund established for the purposes of accepting lump sum death benefits awarded in terms of Section37C of the Pension Funds Act (the Act) to a beneficiary (dependant or nominee) on the death of a member, which are not paid directly to that beneficiary or to a trust nominated by the member, or to the member’s estate or to the guardian’s fund. This replaces the previous payments to trusts and a fund can now only pay to a trust if the trust was nominated by the member, a major dependant or nominee; a person recognised in law or appointed by a court as the person responsible for managing the affairs or meeting the daily care needs of a minor or incapacitated major dependant or nominee. Any association of persons or business carried on under a fund or arrangement established with the object of receiving, administering, investing and paying benefits, referred to in section 37C on behalf of beneficiaries, payable on the death of more than one member of one or more pension funds is a beneficiary fund and must be registered by the Financial Services Board and approved. Beneficiary funds were introduced as a result of the amendments to the Pension Funds Act into the Financial Services Laws General Amendment Act, 22 of 2008. The beneficiary funds were introduced with stronger regulatory framework. They have sufficient governance, reporting requirements and conduct annual audits.

ENGLISH ABSTRACT: AIDS is a killer disease which is spreading like wildfire in all sectors of the population of Southern Africa, in spite of AIDS prevention programmes that are implemented in these communities. Why does this state of affairs exist? Conflicting views exist about the origin of AIDS and about the knowledge of different racial groups with regard to the disease. A number of researchers have argued that knowledge or information dissemination is not a necessary condition for behavioural change, as is evident from historical efforts to combat sexually transmitted disease. However, this thesis shows that knowledge is a variable or component that has frequently been used in almost all studies done on AIDS in Southern Africa. The present author thus searches for the rationale for the phenomenon that knowledge of AIDS does not necessarily result in preventative behavioural change. In this regard the importance of effective communication strategies and cognisance of the nature of target groups are highlighted, because negligence regarding these factors can serve as an impediment to behavioural change. The whole social fabric of the target community and basic individual needs are important elements that should also be major considerations before preventative programmes are implemented.

This study describes the social practices involved in the situated activity of report writing in an engineering automotive discourse community in South Africa. In particular, the study focuses on the subjectivity of predominantly English Second Language (ESL) engineers writing reports by determining what literacy means to them and what meanings they give to dominant literacy practices in report writing, especially feedback in text production. In the South African engineering workplace, because of the diversity and complexity of language and identity issues, the appropriation of the required literacy skills tends to be multifaceted. This context is made more complex as English is the business language upon which engineering is based with engineering competence often related to English proficiency. Therefore, the study is located within the understanding that literacy is always situated within specific discoursal practices whose ideologies, beliefs, power relations, values and identities are manifested rhetorically. The basis for this critical theory of literacy is the assertion that literacy is a social practice which involves not only observable units of behaviour but values, attitudes, feelings and social relationships. As the institution’s socio-cultural context in the form of embedded historical and institutional forces impact on writer identity and writing practices or ways of doing report writing, notions of writing as a transparent and autonomous system are also challenged. As critical ethnography is concerned with multiple perspectives, it was selected as the preferred methodology and critical realism to derive definitions of truth and validity. Critical ethnography explores cultural orientations of local practice contexts and incorporates multiple understandings providing a holistic understanding of the complexity of writing practices. As human experience can only be known under particular descriptions, usually in terms of available discourses such as language, writing and rhetoric, the dominant practices emerging in response to the report acceptance event are explored, especially that of supervisor feedback practices as they causally impact on report-writing practices during the practice of report acceptance. Although critical realism does not necessarily demonstrate successful causal explanations, it does look for substantial relations within wider contexts to illuminate part-whole relationships. Therefore, an attempt is made to find representativeness or fit with situated engineering literacy practices and wider and changing literacy contexts, especially the impact of Higher Education and world Englishes as well as the expanding influence of technological and digital systems on report-writing practices.

Abstract:
A review of contemporary South African and European critical approaches 'to "Soweto poetry" is undertaken to evaluate their efficacy in addressing the diverse and complex dynamics evident in the poetry. A wide selection of poetry from the 1970's and early 1980's is used to argue that none of the critical models provide an adequate methodology free from both pseudo-cultural or ideological assumptions, and "reader-grid"(imposition of external categories upon the poems).From this point of entry, three groups of critics with similar approaches are assessed in relation to Soweto poetry. The second chapter illustrates the deficiency in critical method- ology of the first group of critics, who rely on a politicizing approach. Their critique presupposes a coherent shift in the nature of Black Consciousness poetry in the 1970's, which is shown to be vague and problematic, especially when they attempt to categorize Soweto poetry into "consistently thematic" divisions. In the third chapter, it is argued that ideological approaches to Soweto poetry are impressionistic assessments that depend heavily on the subordination of aesthetic determinants to materialistic concerns. The critics in this second group draw a dubious distinction between bourgeois and "worker poetry" and ignore the inter- play between the two styles. Pluralized mergings within other epistemological spectrums are also ignored, showing an obsessive materialist bias. The fourth chapter examines the linguistic approach of the third group of critics. It is argued that they evaluate the poetry in terms of a defined critical terminology which assumes an established set of evaluative criteria exist. This is seen to be empiricist and deficient in wider social concerns. In the final chapter, it is submitted that each of the critical approaches examined foregrounds its own methodology, often ignoring the cohabitation of different systems of thought. In conclusion it is argued that a critical approach can only aspire to the formulation of a "black aesthetic" if it traces the mosaic of cultural borrowings, detours and connections that permeate Soweto poetry. Abstract:
Boreholes NG1 and NG2 were drilled on the farm Nooitgedacht 406 KQ to intersect the lower Critical and lower Zones of the western Bushveld Complex. The aim of this study is to describe the textural features and chemical characteristics of the olivine-bearing rocks in the intersections, as determined by petrographic studies, XRF analysis and microprobe analysis. The olivine-bearing rocks are dunites, harzburgites and olivine pyroxenites. They comprise olivine and orthopyroxene, with minor chromite, clinopyroxene and plagioclase, and their textures vary between adcumulate, mesocumulate and poikilitic. The sequence intersected can be broadly correlated with that in the eastern Bushveld Complex. Of the whole-rock inter-element ratios, the MMF (MgO)/[MgO+FeO])ratio is the clearest indicator of cyclicity. The olivine-rich rocks are more primitive than the associated rocks, and seem to become more primitive with height in most intervals. The plagioclase in the olivine-bearing rocks is unusually sodic in corrposition, having a maximum Na₂0 content of 8.12%. A comparison of olivine and plagioclase compositions with those in other intrusions has revealed that the only other major intrusion with sodic plagioclase is the Kiglapait intrusion of Canada. In the Kiglapait intrusion the sodic plagioclase occurs in conjunction with fayalitic olivine as opposed to the forsteritic variety of this study. Chemical variations in the rocks sampled indicate that periodic replenishment of the magma from which the rocks crystallised must have occurred. In some of the olivine-bearing intervals where little fractionation is evident, replenishment seems to have been continuous. In other intervals fractionation appears to have continued uninterrupted for significant periods, prior to rejuvenation by fresh influxes of magma.

An increase in the global competitiveness has forced manufacturing organisations to re-look their facility from a labour productivity standpoint. Leveraging a manufacturing operation into a competitive avantage must at all times support the organisation’s objective. It is therefore critical that the operation reviews its strategy so that it fulfils the ever changing needs in the market. Purpose – The main objective of this research is to identify the critical success factors to improve direct labour efficiency within Johnson Controls Automotive South Africa (Pty) Ltd (JCI). Design/methodology/approach – A combination of a comprehensive literature review and visits to the Uitenhage plant and head office were employed in the study. JCI practices were observed to highlight the level of direct labour productivity. This was followed by interviewing relevant and key personel who had an involvement in achieving direct labour productivity in the plant. A questionnaire-based research approach was adopted for this purpose and a total of 83 valid survey responses were received from staff in the Uitenhage plant, together with head office staff who directly supported the plant. The questionnaire was designed to identify and test perceptions of employees, regarding the factors of production, identified as sub variables. The research aim was to determine the most practical and effective strategies to improve direct labour productivity. Results were analysed and interpreted after which recommendations were formulated. Findings – Several critical success factors identified as sub variables were tested to understand their impact on direct labour productivity. Empirical results showed that organisational culture, leadership culture, employee engagement, communication and skills, development and training, had a significant effect on direct labour productivity. Respective ratings of these elements were discussed with the focus of improving this going forward. Research limitations/implications – Continued scepticim within JCI about the benefits of direct labour productivity to their business is one of the fundamental limitations this research faces. Originality/value – The novelty of the research project stems from the realization of key factors contributing to the improvement of direct labour productivity within the JCI enviroment. The results would provide JCI with indicators and guidelines for a successful implementation of direct labour productivity initiatives in the Uitenhage plant.

ENGLISH ABSTRACT: Executive remuneration in South Africa has continued to attract public outrage and generate much debate among various stakeholders due to the perceived non-alignment of compensation packages awarded to senior executives and company performance. This research examines the relationship between executive compensation and financial performance of South African listed companies. Furthermore, the study investigates the link between executive pay and sustainability performance measures such as environmental, social and governance (ESG) criteria. Almost no research has been done in South Africa to examine the link and integration of ESG performance metrics into executive pay as researchers continue to focus on traditional financial measures of performance such as earnings (EBITDA), earnings per share (EPS), return on equity (ROE), return on assets (ROA), total shareholder return (TSR) and share price. The link between executive compensation and sustainability metrics (ESG) has become a topic of much discussion among academics and investors due to the potential influence of ESG factors on companies’ financial performance and sustainable long-term value creation. The research begins by examining the changes in the level of executive compensation during a five-year period and by testing the relationship between executive pay and traditional financial performance measures. The results show that the total compensation of CEOs has been steadily increasing during the five-year period while variable performance bonuses experienced a slight decline during the economic recession of 2007 to 2008. The results provided evidence that there is a statistically significant positive relationship between executive remuneration and company profitability. Findings for the second objective suggest that while executive compensation plans of many companies have been formally tied to ESG performance metrics, few companies in the study have disclosed effective and robust ESG performance measurement systems that tie executive pay to sustainability performance.

Income tax is levied upon a taxpayer’s taxable income. Various steps are taken in order to arrive at the taxpayer’s taxable income. The starting point when calculating taxable income is determining the taxpayer’s ‘gross income’. ‘Gross income’ is defined in terms of section 1 of the Act. Various terms within the gross income definition are not clearly defined, except in the case of a ‘resident’. Even in the case of the definition of a ‘resident’, the aspect of ‘ordinarily resident’ is not defined and nor is the ‘place of effective management’. The following components fall within the definition of ‘gross income’: • The total amount in cash or otherwise; • received by or accrued to, or in favour of, a person; • from anywhere, in the case of a person who is a resident; • from a South African source (or deemed source), in the case of a non-resident; • other than receipts or accruals of a capital nature. The ‘total amount’ in ‘cash or otherwise’ is the first step when determining the taxable income of a taxpayer for a particular year of assessment. Gross income only arises if an amount is received or has accrued; this amount need not be in the form of money but must have a money value. The next component, ‘received by or accrued to’, is related to time and implies that a taxpayer should include amounts that have been ‘received by’, as well as amounts that have ‘accrued to’ him during the year of assessment. ‘Resident’ and ‘non-resident’ unlike the other components, are defined in terms of section 1 of the Income Tax Act. There are two rules used to determine whether natural persons are residents, these are: • To determine whether natural persons are ‘ordinarily resident’; or • where the natural person is not an ‘ordinarily resident’, the ‘physical presence test’ will be applied. ‘Source’ means origin and not place; it is therefore the ‘originating cause of the receipt of the money’. There is no single definition for the word ‘source’ as circumstances may differ in various cases. The facts of each case must be analysed in order to determine the actual source of income for that particular case. The last component of the definition of ‘gross income’ is the exclusion of ‘receipts and accruals of a capital nature’. The Act does not define the meaning of ‘capital nature’ but does indicate that receipts or accruals of a capital nature are, with certain exceptions, not included in ‘gross income’. Receipts or accruals that are not of a capital nature is known as ‘revenue’ and subjected to tax. This study is primarily aimed at an examination of court cases related to the various components falling within the definition of ‘gross income’.

Over the last 10 years the South African fiscus has introduced numerous changes to the Income Tax Act (ITA) which affect the income tax implications of persons ceasing to be a resident of South Africa. The two main changes were: - The introduction of a world-wide basis of taxation for residents - The introduction of capital gains tax (CGT) as part of the ITA The aim of this treatise was to identify the income tax implications of persons ceasing to be a resident of South Africa. Resulting from this research, several issues in the ITA have been identified, and the two major ones are summarised below. Firstly, upon the emigration of the taxpayer, there is a deemed disposal of a taxpayer’s assets in terms of paragraph 12 of the Eighth Schedule. It is submitted that the resulting exit tax may be unconstitutional for individuals. It is recommended that South Africa should adopt the deferral method within its domestic legislation for individuals who are emigrating. The deferral method postpones the liability until the disposal of the asset. Secondly, on the subsequent disposal of assets by former residents where there was no exit charge in terms of the exemption under paragraph 12(2)(a)(i) of the Eighth Schedule. Depending on the specific double tax agreement (DTA) that has been entered into with the foreign country, taxpayers have been given vii the opportunity to minimise or eliminate the tax liability with regard to certain assets. This should be of concern from the point of view of the South African government. Further issues noted in this treatise were the following: - It is submitted that the term ‘place of effective management’ has been incorrectly interpreted by SARS in Interpretation Note 6. - It is further submitted that the interpretation by SARS of paragraph 2(2) of the Eighth Schedule is technically incorrect. The above issues that have been identified present opportunities to emigrants to take advantage of the current tax legislation. It is further recommended that taxpayers who are emigrating need to consider the South African domestic tax law implications, respective DTA’s, as well as the domestic tax laws of the other jurisdiction, not only on the date of emigration but also on the subsequent disposal of the respective assets.

This treatise was undertaken to critically analyse the new general anti avoidance rules (new GAAR) as set out in sections 80A to 80L of the Income Tax Act1. A discussion on the difference between tax evasion and tax avoidance was performed in the first chapter. The goals of this treatise were then set out. An analysis of the requirements for the application of the new GAAR was performed in the second chapter. The courts have historically reviewed the circumstances surrounding an arrangement when determining whether tax avoidance has occurred. The new GAAR requires the individual steps of an arrangement to be reviewed in isolation. Secondly, the courts have historically held that the purpose test, when determining the taxpayer‘s purpose, was subjective. The wording of the new GAAR indicates that this test is now objective. Thirdly, the courts have historically viewed the abnormality of an arrangement based of the surrounding circumstances. The wording of the new GAAR requires an objective view of the arrangement. An analysis of the secondary provisions contained in sections 80I, 80B and 80J of the new GAAR was performed in the third chapter. With regards to section 80B, it was submitted that the Commissioner should issue an Interpretation Note detailing all the methods ―he deems appropriate.

The variations in the composition, specifically the Cr20 S content and the Cr:Fe ratio, and the morphology of the Lower Group (LG) and Middle Group (MG) chromitite seams of the Critical Zone (CZ) across the western Bushveld Complex, including the Ruighoek and Brits sections, is investigated by means of whole-rock chemical data, both major and trace elements analysis, XRD and electron microprobe data. As a result ofthe paucity of exposed or developed LG1 - LG5 chromitite seams in the western Bushveld Complex, this study is confined to the investigation of the compositional variations of the LG6 to MG4 chromitite seams. In only one section, the Ruighoek section, was the entire succession of chromitite seams, from the LG1 - MG4, exposed. The silicate host rocks from the LG6 pyroxenite footwall to the collar of the CC2 drillcore (lower uCZ) in the Rustenburg section were sampled. This study reviews the compositional trends of the silicate host rocks, as the compositional variations of the chromitite seams reflect the chemical evolution of the host cumulate environment and, to a lesser degree, the composition onhe interstitial mineral phases in the chromitite seams. The compositional variations of the LG and MG chromitite seams are attributed to the compositional contrast between the replenishing magma and the resident magma. The chemical trends of the LG and MG chromitite layers and the host cumUlate rOCKS do not support the existence of two compositionalfy dissimilar magmas in the CZ, rather the cyclic layering of the CZ and the chemical variations of the chromitite seams are attributed to the mixing of primitive magma with the resident magma, both of which have essentially similar compositions. The compositional variations of the LG and MG chromitite seams along strike away from the supposed feeder site (Union section) to the distal facies (Brits section) are attributed to the advanced compositional contrast between the resident magma and the replenishing primitive magma pulses. The CZ is characterized by reversals in fractionation trends and this is attributed to the compositional evolution of the parental magma and not to the replenishment of the resident magma by influxes of grossly dissimilar magma compositions. The Cr20 S content and the Cr:Fe ratio of the MG chromitite layers increase from the Ruighoek (near proximal) section to the Brits section (distal facies). This is attributed to the advanced compositional contrasts between the resident magma and the replenishing primitive magma. In contrast, the Cr20 3 content and Cr:Fe ratios ofthe LG6 and LG8a chromitite seams decreases eastwards from the Ruighoek section. The average Cr:Fe ratio for the western Bushveld Complex is between 1.5 and\2.0, nonetheless, a progressively lower Cr:Fe ratio is noted from the LG1 chromitite up through to the MG4 chromitite seam in the Ruighoek section. tn the LG2 - LG4 chromitite interval a deviation to higher.lratios is encountered. A progressive substitution of Cr by AT and Fe in the Cr-spinel crystal lattice characterizes the chromitite succession from the LG1 seam up through the chromitite succession to MG4. The petrogeneSiS of the chromitite seams of the CZ is attributed to magma mixing and fractional crystallization of a single magma type.

Abstract:
The purpose of this dissertation was to critically analyse the recently introduced section 7C of the Income Tax Act, 58 of 1962 (ITA) with the aim of determining whether section 7C achieved its stated objective. Although aimed at tax abuse through the use of trusts, the section is a further limitation on trusts, a vehicle that has been affected by numerous legislative amendments over the past couple of decades. The introduction of section 7C of the ITA is directly in line with the existing section 7 as well as international trends including the Base Erosion and Profit Shifting (BEPS) final reports. As globalisation accelerates and data becomes more readily available to both developed and developing economies the transparency of structures will become more evident and the previously utilised loopholes will close. Additionally, the current economic downturn in South Africa (SA), and globally, is likely to result in more aggressive revenue authorities. Taxpayers will have to ensure that they receive appropriate advice and that tax is considered at the outset of structure development opposed to being an afterthought following the commercial agendas. Further, there is currently room for the application of sections 7C, 7(5) and 7(8) simultaneously in specific circumstances which may result in the application of both donations and income tax. The question remains as to whether the application of these section is fair and/or correct. I think it is probably difficult to argue that it is not at this stage. Finally, it is submitted that the question raised by this dissertation – does section 7C of the ITA achieve its stated objective (the prevention of tax evasion through interest free loans) has been answered in the affirmative.
