Abstract:
Administrative Agencies often rely on guidance documents to carry out their statutory mandate. Over the past few decades, the Food and Drug Administration (FDA) has been criticized for using soft law guidance documents to exercise powers beyond those authorized by Congress. Since attacks on the use of guidance documents persist and agencies need soft law to respond quickly and flexibly to rapid technological growth, it is essential to develop a solution that preserves this crucial regulatory mechanism and prevents its abuse. The most likely alternative to soft law guidance is formal regulation, which must be developed through the notice-and-comment process. The delays introduced by these formal processes, however, leave innovators uncertain about how to comply in the interim, which slows innovation. Alternatively, agencies may turn toward even less formal mechanisms, which are less expensive. However, these informal mechanisms also present problems, namely vagueness, contradictory rulings, and regulatory accumulation. This Note focuses on how courts can curb the abuse of guidance documents and avoid the pitfalls associated with these two alternatives. This Note identifies the ends of FDA regulation, the various mechanisms the FDA uses to achieve these ends, and the Agency’s and regulated entities’ attitudes toward guidance documents. Courts may either treat notice-and-comment rulemaking as necessary to finality and refuse merits review or classify such documents as final and conduct a merits review. This Note endorses the latter solution because it helps courts preserve agency discretion, principally limits discretion, and incentivizes uniformity and predictability. This solution is limited to documents that are practically binding on the agency.

<abstract><p>In this paper, we propose a direct method to solve the dual fuzzy matrix equation of the form $ \mathbf{A}\widetilde{\mathbf{X}}+\widetilde{\mathbf{B}} = \mathbf{C}\widetilde{\mathbf{X}}+\widetilde{\mathbf{D}} $ with $ \mathbf{A} $, $ \mathbf{C} $ matrices of crisp coefficients and $ \widetilde{\mathbf{B}} $, $ \widetilde{\mathbf{D}} $ fuzzy number matrices. Extended solution and algebraic solution of the dual fuzzy matrix equations are defined and the relationship between them is investigated. This article focuses on the algebraic solution and a necessary and sufficient condition for the unique algebraic solution existence is given. By algebraic methods we not need to transform a dual fuzzy matrix equation into two crisp matrix equations to solve. In addition, the general dual fuzzy matrix equations and dual fuzzy linear systems are investigated based on the generalized inverses of the matrices. Especially, the solution formula and calculation method of the dual fuzzy matrix equation with triangular fuzzy number matrices are given and discussed. The effectiveness of the proposed method is illustrated with examples.</p></abstract>

Sammanfattning

Detta examensarbete inom produkt- och processutveckling har genomförts på uppdrag av SMS Smart Media Solutions AB i Stockholm. Syftet med arbetet har varit att ta fram och utveckla ett stativ som ska kunna hålla upp till 4 stycken datorskärmar och som tillåter ergonomisk anpassning och användning. Under projektets gång har antalet skärmar utökats från 4 till 8 för att tillmötesgå uppkomna kund- och marknadskrav. Målet med examensarbetet har varit att ta fram en färdig prototyp som ska kunna ligga till grund för tillverkning av stativet.

Under utvecklingsarbetet har verktyg som QFD, funktionsanalys, Ishikawa-diagram, Pugh’s jämförelsematris och FMEA använts för att säkerställa att kund-, marknads-, kvalitets och funktionskrav uppfylls. Arbetet inleddes med en idégeneringsfas som utmynnade i ett antal olika koncept. Koncepten utvärderades utifrån kravspecifikation, funktion, antal standardkomponenter och pris. Konceptet som ansågs starkast utvecklades till en prototyp vilken i sin tur testades och utvärderades.

Resultatet av examensarbetet är att det utvecklade stativet är infört i SMS Smart Media Solutions’ produktportfolio och kommer att finnas med i SMS’ produktkatalog för 2010. Stativet motsvarar alla krav som satts upp i kravspecifikationen och alla problemen som definierats i problemformuleringen har lösts.

 


Abstract

This thesis in product and process development has been made in cooperation with SMS Smart Media Solutions AB in Stockholm. The aim of the thesis has been to develop a new display bracket that can carry up to 4 monitors and that allows ergonomically adjustments and usage. During the project the amount of maximum monitors has been changed from 4 to 8 to meet the demand of the customers and the market. The goal of the thesis has been to develop a prototype that would be the ground of the future bracket that will be offered in SMS Smart Media Solutions’ product portfolio.

To make sure that the developed bracket meets all the demands and criteria, tools like QFD, analysis of function, Ishikawa diagram, Pugh’s matrix and FMEA have been used. The process of the product development started with brainstorming and concept generation. The developed concepts were evaluated using analysis of requirements, costs, functions and the amount of used standard components. The winning concept was carried on into a prototype that was tested, evaluated and improved.

The result of the thesis is that the developed bracket has been integrated to SMS Smart Media Solutions’ product portfolio and will be added to SMS’ product catalogue for 2010. The final bracket met all the criterions that were set in the specification of requirements and all the problems form the problem statement were solved.

Soit $T$ une constante positive. Dans le présent travail, nous nous intéressons à l'existence d'une solution $T$-anti-périodique et d'une solution $T$-périodique de l'équation différentielle d'Abel \begin{equation*} \theta^{\prime}=f_0+\sum_{j\in \mathbb N} f_j\theta^j \end{equation*} avec $f_j$, ($j \in \lbrace 0, 1, 2, ...\rbrace$) à variation bornée sur $[0, T]$. Nous allons généraliser cette équation au cas impulsif où $\theta$ et $\theta^{\prime}$ subissent des sauts dépendants de l'état. Le premier chapitre consiste en un rappel de quelques définitions, notions de bases et résultats fondamentaux de l'analyse réelle et fonctionnelle que nous allons utiliser tout au long des chapitres 2 et 3. Au deuxième chapitre, on étudie l'existence d'une solution $T$-anti-périodique dans le sens que $\theta(0)= -\theta(T)$. Les conditions que nous imposons nous permettent d'utiliser le théorème du point fixe de Banach. Cette méthode nous donne non seulement l'existence d'une solution, mais aussi un moyen de trouver la solution numériquement ainsi qu'une majoration de la vitesse de convergence uniforme, d'une suite d'itérations de Picard vers la solution. Les résultats obtenus dans ce chapitre sont publiés dans \cite{BelleyGueye17}. Au troisième chapitre, on étudie l'existence d'une solution T-périodique pour la même équation. On utilise encore le théorème du point fixe de Banach pour garantir l'unicité de la solution. L'unicité est nécessaire pour que la fonction moyenne $M(\mu)$ que nous introduirons plus tard soit bien définie. Cette méthode nous donne également, non seulement l'existence d'une solution, mais aussi un moyen de trouver la solution numériquement ainsi qu'une majoration de la vitesse de convergence uniforme d'une suite d'itérations de Picard, vers la solution.

El presente plan de negocios nace del vínculo con la Facultad de Medicina de la Universidad de Chile, con el objetivo de determinar el potencial de mercado del Producto Reportero, un sistema de monitoreo y control automático, que posee características únicas en el mercado, cómo son el sistema de mensajería electrónica, monitoreo y control vía web. En base al estudio de mercado realizado, se determino que existe una demanda insatisfecha que las empresas existentes no han logrado cubrir por los costos elevados de las soluciones técnicas factibles de implementar y por un déficit importante de su gestión comercial. Considerando las características del producto y la definición de mercado relevante para el, se elaboró un plan de negocio para la empresa CONTROL SOLUTION1, que comercializará Reportero, adoptando una estrategia competitiva de enfoque, orientándose a pequeñas y medianas empresas de la Región Metropolitana, de rubros caracterizados por contar con procesos productivos donde el monitoreo de variables físicas es un factor crítico. La estrategia de marketing, contempla la comercialización del producto mediante multicanales: alianzas comerciales, alianzas complementarias y venta directa al cliente final. Las decisiones estratégicas de las alianzas operará en función de los diversos segmentos de mercado. Esta industria se caracteriza por presentar un atractivo importante, con proveedores que presentan un poder negociador medio, donde el poder negociador de los compradores y sustitutos es bajo, y no existen importantes represalias ni ambientes hostiles, lo que nos lleva a estimar que se pueden obtener grados importantes de rentabilidad. La evaluación financiera muestra que utilizando una tasa de descuento de un 35%, la empresa tiene una valoración hoy de M$ 6.675 y una TIR de 67%. En dicha evaluación hemos evaluado el Proyecto Puro, es decir financiado 100% con capital. Por otra parte, el Break Even se logra a partir del séptimo mes, con un volumen de 12 reporteros vendidos. Asimismo, el flujo de caja alcanza su equilibrio en el octavo mes con un volumen de 14 reporteros. En cuanto a las sensibilizaciones y posibles escenarios, hemos tomado variables estratégicas del negocio. Entre ellas, podemos distinguir, los efectos de potenciales entrantes (mercados locales como extranjeros), y aspectos internos del negocio, entre otros. Lo anterior, se traduce en los posibles efectos en la demanda, márgenes y precios, los cuales son muy sensibles y que frente a estos debemos procurar medidas. Finalmente, inferimos que es necesario patentar Reportero, de manera de minorizar potenciales riesgos y viabilizar nuestro negocio en cuanto a nuestras estimaciones de tres años.

The Kirkwood-Buff (KB) theory of solutions, published in 1951, established a route from integrals over radial (pair) distribution functions (RDFs) in the grand canonical ensemble to a set of thermodynamic quantities in an equivalent closed ensemble. These “KB integrals” (KBIs) can also be expressed in terms of the particle-particle (i.e., concentration or density) fluctuations within grand canonical ensemble regions. Contributions by Ben-Naim in 1977 provided the means to obtain the KBIs if one already knew the set of thermodynamic quantities for the mixture of interest; that is, he provided the inversion procedure. Thus, KB theory provides a two-way bridge between local (microscopic) and global (bulk/thermodynamic) properties. Due to its lack of approximations, its wide ranging applicability, and the absence of a competitive theory for rigorously understanding liquid mixtures, it has been used to understand solution microheterogeneity, solute solubility, cosolvent effects on biomolecules, preferential solvation, etc. Here, after using KB theory to test the accuracy of pair potentials, we present and illustrate two extensions of the theory, resulting in a general Fluctuation Solution Theory (FST). First, we generalize KB theory to include two-way relationships between the grand canonical ensemble’s particle-energy and energy-energy fluctuations and additional thermodynamic quantities. This extension allows for non-isothermal conditions to be considered, unlike traditional KB theory. We illustrate these new relationships using analyses of experimental data and molecular dynamics (MD) simulations for pure liquids and binary mixtures. Furthermore, we use it to obtain conformation-specific infinitely dilute partial molar volumes and compressibilities for proteins (other properties will follow) from MD simulations and compare the method to a non-FST method for obtaining the same properties. The second extension of KB theory involves moving beyond doublet particle fluctuations to additionally consider triplet and quadruplet particle fluctuations, which are related to derivatives of the thermodynamic properties involved in regular KB theory. We present these higher order fluctuations obtained from experiment and simulation for pure liquids and binary mixtures. Using the newfound experimental third and fourth cumulants of the distribution of particles in solution, which can be extracted from bulk thermodynamic data using this extension, we also probe particle distributions’ non-Gaussian nature.

The integration of services and products into solutions can open up new business opportunities for firms. This thesis concerns how firms can provide solutions that are perceived as high quality. Solutions are often provided over several years, which implies a changed customer relationship compared to product provisions. Since the solution aims to support the customer’s activities, firms face new challenges when introducing solutions. One challenge is to integrate all components and activities of the solution, and simultaneously support the customer’s activities. In addition, the firm must ensure that the solution and all of its parts are of high quality. Most of the existing research on quality is related to the management of a firm’s internal activities and the interaction during exchange. Within the research on quality, customer orientation means that a firm should manage the relevant product or service to meet customer requirements. When this is achieved, the product or service is of high quality. Since solutions are seen as services and products that are integrated as an outcome, as well as a customer relational process that aims to support the customer’s activities, firms have little to learn from previous research about the quality of solutions. The aim of this thesis is to increase knowledge about how to manage solution quality. The thesis combines insights from research on quality with research on solutions and servitization. Three research questions are answered. The first question concerns the content of solution quality; the second deals with how firms can, with support from interventions, meet the new challenges that arise from solution provision; and the third question concerns how customers can be involved to achieve solution quality. The research questions are answered through five papers based on literature studies and empirical data. The papers contribute to an increased knowledge of solution quality and how firms can work to achieve it. The results of the thesis suggest that solution quality is built on seven quality dimensions: reliability, communicability, internal consistency, empathy, approachability, tangibility, and adaptability. In addition, knowledge of processes and customer relationships are two prerequisites for the concept. These dimensions and prerequisites are supported by interventions that can provide a change. However, it has become evident that whatever intervention is used must be related to the dimensions that are supposed to be improved. Furthermore, customer involvement is argued to be an intervention to support the prerequisites for solution quality, especially during the solution  development. The results of this thesis extend the research on quality by increasing the knowledge of the solution quality concept and by changing the view of customers and their involvement during solution development.
Den här avhandlingen berör hur företag kan möjliggöra så att produkter och  tjänster, integrerade i så kallade helhetslösningar, kan levereras med hög kvalitet. Helhetslösningar levereras ofta över en längre tid vilket medför en förändrad kundrelation till skillnad mot när endast en produkt levereras. Helhetslösningar syftar till att stödja kunden i dess aktiviteter. Det medför att företagen möter nya utmaningar. En utmaning är att få den komplexa helhetslösningen, bestående av olika komponenter och aktiviteter, att passa ihop och samtidigt bidra till att stötta kundens aktiviteter. Dessutom behöver företagen säkerställa att helhetslösningen och alla dess delar har hög kvalitet. Tidigare forskning inom kvalitetsutveckling berör företags interna processer och aktiviteter. När man inom kvalitetsutveckling talar om kundorientering innebär det att företaget med interna medel ska arbeta för att möjliggöra så produkten eller tjänsten möter kundens specifikationer. När detta är uppnått har produkten eller tjänsten hög kvalitet. Företagen har här inga riktlinjer att följa när de ska leverera helhetslösningar som ska anpassas efter kundens aktiviteter och när en så tydlig kundrelation ska utvecklas. Det finns med andra ord ingen vägledning för vad som är kvalitet eller hur man möjliggör hög kvalitet på helhetslösningar. Den här avhandlingen visar vad som ingår i begreppet kvalitet när det gäller helhetslösningar (lösningskvalitet) samt hur företag kan möjliggöra det. Tre olika frågor har huvudsakligen behandlats. Den första frågan besvarar vad lösningskvalitet innehåller. Den andra berör hur företag med hjälp av åtgärder kan bidra till en förändring inom företaget för att möta de nya utmaningar som uppstår med att leverera helhetslösningar. Den tredje frågan berör på vilket sätt kunden kan involveras för att uppnå lösningskvalitet. För att besvara frågorna har ett antal studier baserade på empiriskt material genomförts, och fem artiklar har författats under forskningsprocessen. Artiklarna bidrar till att öka förståelsen för lösningskvalitet och hur företag kan arbeta för att uppnå det. Avhandlingens resultat visar att lösningskvalitet består av sju olika dimensioner: tillförlitlighet, kommunicerbarhet, intern överensstämmelse, empati, nåbarhet, påtaglighet, och anpassningsbarhet. Dessutom är kunskap om processer och kundrelationer två förutsättningar för att uppnå lösningskvalitet. Dimensionerna betraktas som riktmärken för lösningskvalitet som företag kan arbeta mot. Dimensionerna och förutsättningarna stöttas i sin tur av åtgärder som används för att bidra till den interna förändringen inom företaget. Resultaten visar dock att använda åtgärder inte alltid leder till en förändring. Endast noga utvalda åtgärder som relaterar till en specifik dimension möjliggör en förändring. Exempel på en möjlig åtgärd är kundinvolvering. Speciellt vid utveckling av helhetslösningar, betraktas kundinvolvering som en möjlig åtgärd för att stötta förutsättningarna till lösningskvalitet. Resultaten i den här avhandlingen bidrar huvudsakligen till en ökad kunskap om vad kvalitet är när det gäller helhetslösningar. Ytterligare ett bidrag är att föreslå kundens förändrade roll under utveckling och vid leverans av helhetslösningar för att uppnå lösningskvalitet.

This project initiated in February 2018 and end date was set to August2018.The methodology used in this project is based on the Six-Sigma tools which is widely appreciatedglobally to obtain the Zero-defect production.The implementations of this method and other tools are efficient and beneficial to reduce thedefects in the production without compromising the initial quality of the product.This thesis resulted in a quality improvement approach for eliminating the dust using methods suchas Six-Sigma and 5 why’s.
